TODAY WE HAVE TWO ITEMS BEFORE US. THEY ARE BOTH FOR THE SAME PROJECT BUT WE HAVE MADRD 2004 PER WINN DIXIE WALL SIGNS AND -- A NONZONING VARIANCE, 2021.

BRIEFLY THE BOARD HAS SEEN THIS ITEM BEFORE. I JUST WANT TO ACKNOWLEDGE THAT PREVIOUSLY THE BOARD CONSIDERED BOTH THE MAIN WINN DIXIE SIGN AND THE SECONDARY SIGN.

IN BETWEEN THE PRIOR MEETING AND NOW. STAFF HAS ADMINISTRATIVELY REVIEWED AND PERMITTED THE MAIN SIGN AND SO FOR TODAY'S PRESENTATION, OUR APPLICATION WHAT WE HAVE IS THE SECONDARY SIGN WHICH IS 34.29 SCARE FEET IN SIZE AND READS WINN DIXIE, BEER, WINE AND SPIRITS. DUE TO THE SIZE OF THIS SIGN AT 34.29 SQUARE FEET, IT DOES EXCEED THE 24 FOUR FOOT SQUARE, IN REFERENCE TO 3.08 POINT D OF THE LAND DEVELOPMENT CODE.

THAT'S WHY WE HAVE A JOINT APPLICATION HERE BOTH FOR THE OVER LAY REVIEW AND FOR THE REQUEST TO EXCEED THE 24 SQUARE FEET ALLOWED. I DO HAVE THE SIGNS HERE INDICATING WHAT WE'RE TALKING ABOUT WITH THE WINN DIXIE WITH THE NEW LOGO AND THE BEER, WINE AND SPIRITS. AND I BELIEVE A PICTURE. OF THE EXISTING LIQUOR SIGN IN THE BOTTOM LEFT AND PROPOSED WINN DIXIE BEER, WINE AND SPIRITS SIGN IN THE TOP RIGHT CORNER. THAT'S ALL I HAVE HERE. WE HAVE THE APPLICANT PRESENT, HER NAME IS SAM, IF YOU HAVE SPECIFIC QUESTIONS, I'M SURE SHE WOULD BE HAPPY TO ANSWER THEM.

HAVING LOOKED AT THIS AND STUDIED THE BUILDING THIS MORNING, THERE IS A VERY LARGE WINN DIXIE SIGN OVER THE DOOR REPEATING WINN DIXIE OVER BEER, WINE, SPIRITS IS BASICALLY -- IF WE WERE TO APPROVE THIS, THE REMAINING BEER, WINE AND SPIRITS WOULD SUPPORT WITH THE EXISTING REGULATION. SO, MY [INAUDIBLE] RIGHT NOW IS TO APPROVE IT WITHOUT THE SECOND

I HAVE A QUESTION. IN REGARDS TO WHAT IS REQUIRED FOR LIQUOR LICENSE, IS IT REQUIRED THAT A NAME OF A BUSINESS BE ASSOCIATED DIRECTLY WITH IT BEING ADVERTISING FOR

BEER, WINE AND SPIRITS? >> WELL CERTAINLY IT WASN'T BEFORE.

>> WELL, I MEAN. YEAH BUT WHAT WAS BEFORE IS NOT WHAT IS NOW EITHER.

I'M JUST ASKING, IF ANYBODY KNOWS THE ANSWER TO THAT QUESTION.

>> THIS IS JACOB. I WANT TO JUMP IN A LITTLE BIT ON THIS ONE AND KIND OF GUIDE A LITTLE BIT THE SPIRIT OF WHAT THIS SECONDARY SIGN IS. SO IN A SENSE, EVEN THOUGH THIS IS WINN DIXIE, WE ALL ACKNOWLEDGE THAT. THIS PORTION OF THE BUILDING IS ESSENTIALLY ACTING AS A SECONDARY STORE FRONT AND SO THE OVERLAY PROVISIONS AND OTHER PROVISIONS OF LAND DEVELOPMENT CODE ESSENTIALLY TREAT THIS AS A STAND ALONE SIGN NOT PURELY A SECONDARY SIGN TO THE EXISTING WINN DIXIE. IT'S TREATED AS ITS OWN LIQUOR STORE. GINGER, I CAN'T SPECIFICALLY ANYTHING ABOUT REGULATIONS

REGARDING REQUIRING A NAME ON SOMETHING LIKE THAT. >> I WAS JUST THINKING IN REGARDS TO OTHER PLACES WHERE IT SAYS PUBLIX AND THEY HAVE IDENTIFICATION IT'S PUBLIX, BEER, WINE AND LIQUOR. I PERSONALLY DON'T HAVE A PROBLEM WITH IT BEING, EIGHT FEET LARGER THAN IT'S SUPPOSED TO BE, ESPECIALLY SINCE IT'S A STAND ALONE STORE.

IT'S NOT LIKE A SEPARATE ENTRANCE AND ATTACHED IN ANY WAY PHYSICALLY INSIDE THE BUILDING

TO THE GROCERY STORE. >> YEAH -- I WOULD AGREE WITH THAT.

I THINK THAT WHAT JACOB MENTIONED IS RELEVANT, IT'S LEGALLY TREATED AS A STORE FRONT. IN LIGHT OF THAT, IT DOES HAVE RELEVANCE.

AESTHETICALLY WHEN YOU LOOK AT THE SHEER SIZE OF THAT PORTION OF THE BUILDING, IT BEING A LITTLE BIT OVER SIZED COMPARED TO CODE, IT DOESN'T REALLY STICK OUT AS AN EYE SORE.

I THINK IF ANYTHING, IT'S MORE PROPORTIONATE IN THIS INSTANCE. I DON'T HAVE A PROBLEM WITH IT

BEING BIGGER THAN CODE. >> OKAY. WELL, LET'S NOT FORGET, WE ARE THERE'S A VARIANCE HERE. I DON'T WANT TO SET A PRECEDENCE GREAT POINT.

THE TOTAL SQUARE FOOTAGE PROBABLY WOULD BE WITHIN THE REALM AND MAYBE IT MIGHT BE A PERCENTAGE VERSUS ACTUAL SQUARE FOOTAGE. NOT THAT WE'RE GOING TO CHANGE THAT TODAY. THAT MIGHT BE A BETTER WAY OF ADDRESSING THE ISSUES VERSUS

I WANT TO READ, I HAVE IN MY STAFF REPORT. THE DEFINITION OF A NON-ZONING VARIANCE SO THE BOARD CAN BEST UNDERSTAND IT. NONZONING CARRY APSE IS A CASE BY CASE DEVIATION TO THE RULE WAS OF THE LAND DEVELOPMENT CODE.

IT MUST BE DEMONSTRATED COMPLIANCE WOULD BE PRACTICALLY IMPOSSIBLE OR ALTERNATE TO THE CODE THAT CONFORMS TO THE GENERAL INTENT AND SPIRIT OF THE CODE.

ONE THING THAT KEEPS COMING TO MIND FOR ME IS A COUPLE BLOCKS AWAY IS PUBLIX LIQUORS WHICH HAS PRETTY MUCH TO MY KNOWLEDGE EXACTLY THE SAME ARRANGEMENT OF SIGNAGE AS BEING PROPOSED

ESPECIALLY WHEREVER YOU HAVE OTHER SIMILAR PLACES THAT HAVE LIKE SIGNAGE.

SO IF YOU JUST ADVERTISE JUST LIQUOR, IT'S MISLEADING BECAUSE OF THE FACT IT'S NOT ADVERTISING THE WINE AND BEER. AND GOING BACK TO THE POINT WHAT IT SAYS ABOUT WINN DIXIE, WINE, BEER AND LIQUOR. THAT'S ADVERTISING THAT YES, THEY ARE A GROCERY STORE.

THERE IS WINE AND BEER. HAVING A SIGN THAT SAYS WINN DIXIE NEXT DOOR THAT SAYS, BEER WINE AND SPIRITS DIFFERENTIATES IT FROM BEING THE GROCERY STORE. AND IT'S NOT JUST BAR AND GRILL.

I THINK IT'S VERY IMPORTANT TO HAVE THE NAME WINN DIXIE THERE. >> WELL, LIKE I SAID, I'M NOT GOING TO FALL ON A CROSS TO FIGHT FOR THIS. I JUST WANTED TO MAKE EVERYONE

I THINK YOU KNOW, FUTURE CIRCUMSTANCES HAVING A SECONDARY STORE LIKE THIS, IT'S PROBABLY GOING TO BE NOT THE NORM. AND THEN WHEN WE LOOK AT EVEN WINN DIXIE ITSELF AND THESE OTHER SIMILAR STORES IN THE AREA, THEY ARE ALREADY ALL OF THEIR MAIN SIGNS ARE ALREADY

LARGER THAN CODE AS IT IS. >> YEAH. >> THAT'S PROBABLY WHY THEY WANT TO DO IT. IF AT SOME POINT IN THE FUTURE, AT SOME POINT IN THE FUTURE, WINN DIXIE CHANGES ITS NAME FROM WINN SOMETHING ELSE BESIDES DIXIE, THEY MAY CHANGE THE LIQUOR STORE TO SOMETHING ELSE BESIDES WINN DIXIE AS WELL AND MAY BE SOLD OFF AT SOME POINT IN TIME. IT LOOKS LIKE THE LAWS HAVE CHANGED AND THEY CAN SELL LIQUOR IN THE GROCERY STORE. THEN THEY MAY WANT TO SELL OFF THAT PORTION OF THE BUILDING OR RENT IT OUT AND IT MIGHT BECOME A CLOTHING STORE OR DRY CLEANERS STORE.

IT WOULD BE ENTITLED TO HAVE A BIGGER SIGN. >> YEAH.

I THINK THAT'S A GOOD POINT. YOU HAVE TO ACCOUNT FOR NONE OF THAT IS ANY OF THAT COULD HAPPEN IN FUTURE. GOOD POINT. THEN YOU CAN SAY, WELL, IT WASN'T APPROVED BECAUSE OF THE FACTS BEFORE. I THINK YOU HAVE TO LOOK LONG-TERM AS WELL AS WHAT IS CURRENT AND DOES -- AS JACOB SAID, YOU KNOW IS IT WITHIN THE REALMS OF WHAT IS GOING ON IN THE NEIGHBORHOOD?
