IN ORDER TO FURTHER MITIGATE THE TRANSMISSION OF THE CORONAVIRUS, REDUCE RISK OF COVID-19 ILLNESS, BOARD OF COUNTY COMMISSIONERS HAS ADOPTED PROCEDURES TO CONDUCT USING REMOTE PARTICIPATION SO THAT THE PUBLIC HAS A MEANS TO COMMENT DURING THE MEETING WITHOUT PHYSICALLY ATTENDING. ALONG WITH PRIOR COMMUNICATIONS INCLUDING E-MAIL, THE PUBLIC WILL BE ABLE TO COMMENT BY TELEPHONE WHILE WATCHING THE MEETING VIA GTV OR BY STREAMING POSTED ON THE COUNTY'S WEBSITE. SECOND, THERE IS NO JOB SECURITY FOR THOSE WORKING IN THIS UNCERTAIN ENVIRONMENT. WITH EXPECTED BUDGET CUTS DUE TO THE PANDEMIC, ALREADY TALK IN TALLAHASSEE OF DROPPING NON-RECURRING ITEMS. I WOULD RECOMMEND, GIVEN THE FACT THAT THE BUDGET HAS TO BE ACTED ON THIS MONTH BY JUNE 30TH, EITHER BY THE LEGISLATURE OR GOVERNOR, THE GOVERNOR IS GOING TO APPROVE THE BUDGET WITH OR WITHOUT ANY VETO ITEMS ON THE APPROPRIATIONS ACT OR THERE MAY BE A SPECIAL SECTION. ALL THAT SAID, SOMETHING IS GOING TO HAPPEN THIS MONTH.
I WOULD RECOMMEND AND ASK THE LEGAL IF WE COULD SIMPLY HAVE A CONSENSUS TO SEND A LETTER SIGNED BY THE CHAIRMAN IF IT'S THE CONSENSUS OF THE BOARD TO STRONGLY RECOMMEND THAT THE LEGISLATURE NOT REDUCE ANY FUNDING TO THE FACT PROGRAM FOR ST. JOHNS COUNTY.

A CAMERA SAYS EVERYTHING.

I'M SURE THAT YOU GUYS HAVE HAD A CHANCE TO REVIEW THAT. AND SOME OF YOU MAY HAVE BEEN ABLE TO WATCH THE PZA MEETING AS WELL. GIVE YOU BACKGROUND FIRST, JUST TO START OUT, SINCE YOU DON'T HAVE A TYPICAL STAFF REPORT IN THIS PARTICULAR CASE.

UNFORTUNATELY, HE WASN'T ABLE TO PROVIDE EVIDENCE SHOWING WHERE THAT WAS BEFORE HE GOT THE PZA. I WASN'T PRESENT AT PZA. BUT I WENT BACK AND WATCHED THE VIDEO. AND THE VIDEO SHOWS THAT A COUPLE OF MEMBERS WERE ASKING HIM ABOUT WHERE THIS LOCATION OF THE DRAIN FIELD WAS AND HE WASN'T ABLE TO PROVIDE SUFFICIENT ANSWERS FOR THAT. AND YOU'LL SEE THAT THE MAKER OF THE MOTION AND A SECOND, AS WELL AS A COUPLE OF OTHER PEOPLE AT THE TIME VOTED TO SUPPORT THAT BECAUSE THEY DIDN'T FEEL THERE WAS ENOUGH EVIDENCE SHOWING WHERE THAT WAS TO ESTABLISH THE HARDSHIP.
AFTER THAT PARTICULAR MEETING, HE WAS DENIED, HE CAME AND SOUGHT MYSELF OUT AND TALKED TO ME. I SAID WE NEED TO GET A SURVEY OF THAT TO SHOW WHERE THE DRAIN FIELD IS, TO SHOW THAT THERE ACTUALLY IS A HARDSHIP. BECAUSE YOU'LL SEE FROM THE STAFF REPORT THAT THE STAFF SAID THERE WAS A HARDSHIP AS FAR AS THE TOPOGRAPHY GOES ON THE PROPERTY. THE QUESTION FOR THE STAFF AT THE TIME OF THE PLANNING AND ZONING AGENCY WAS WHETHER OR NOT THIS WAS THE MOST, WHETHER THE RELIEF HE SOUGHT WAS THE BEST BECAUSE THEY DIDN'T KNOW WHERE THE DRAIN FIELD WAS. AT THE TIME THE STAFF SOUGHT OUT EVIDENCE FROM THE HEALTH DEPARTMENT. THE HEALTH DEPARTMENT MAP SHOWED THE DRAIN FIELD IN A DIFFERENT SPOT. THAT IS WHY I SAID WE NEED TO GO GET A SURVEY. I HAVE COPIES OF THAT AS WELL. THE DRAIN FIELD IS WHERE IT WAS TESTIFIED TO AT THE PLANNING AND ZONING AGENCY. THEREFORE, WE BELIEVE IT DOES SHOW THAT THERE WAS A HARDSHIP. I THINK NOW THAT WE PROVIDED THAT EVIDENCE TO YOUR STAFF, I BELIEVE THAT THEY DON'T NECESSARILY HAVE AN OBJECTION TO THE PLACEMENT AS WELL.
THAT WAS BACKGROUND. LET ME GET INTO MY NORMAL PRESENTATION.
SO MR. DISTEFANO DID PRESENT EVIDENCE AT THE PZA SHOWING THAT HE BUILT THE SHED.
AFTER THE FORMER SHED WAS DESTROYED BY THE HURRICANES. AT THE TIME, AS AN ACCESSORY STRUCTURE, HE DIDN'T REALIZE THAT HE NEEDED TO COME GET A FORMAT FOR THAT.
NOW HE REALIZES IN ST. JOHNS COUNTY YOU HAVE TO GET A PERMIT FOR MOST STUFF THAT YOU DO.
AT THE TIME HE DID ASK HIS NEIGHBORS AND RECEIVE SUPPORT FROM HIS NEIGHBORS.
THAT IS WHY YOU'LL SEE IN THE RECORD THAT THERE IS A NUMBER OF SUPPORTING AFFIDAVITS AND EVIDENCE SHOWING THAT HE HAS SUPPORT FOR THIS LOCATION FROM HIS NEIGHBORS.
NOT JUST NOT OPPOSITION BUT ACTUAL SUPPORT FOR WHERE HE PUT IT.
AND HE PLACED IT WHERE IT WAS BECAUSE OF THE TOPOGRAPHY AND LOCATION OF THE SEPTIC DRAIN FIELD. UNFORTUNATELY, AS I SAID PREVIOUSLY, IN REPRESENTING HIMSELF, HE WASN'T ABLE TO PRODUCE THE PROPER EVIDENCE, WHICH LED TO THE DENIAL.
THE STAFF HAD INITIALLY STATED THAT THERE WAS A HARDSHIP IN THE PZA STAFF REPORT, BUT WITHOUT FURTHER PROOF OF THE LOCATION OF THE DRAIN FIELD, THEY DIDN'T KNOW IF THE CURRENT PLACEMENT WAS THE LEAST INTRUSIVE. THIS LED SEVERAL MEMBERS OF THE PZA MEMBERS TO STATE, THE CHAIRMAN STATE ON THE RECORD THAT THEY DIDN'T HAVE THE PROBLEM BECAUSE THEY TOOK THE TESTIMONY THAT HE PRESENTED AS FACT.
IN OTHER WORDS, IT WASN'T ENOUGH FOR SOME OF THE MEMBERS. I'M HERE TODAY ON THIS APPEAL TO SHOW YOU THIS EVIDENCE. TO SHOW THAT WE DID ENGAGE A LICENSED SURVEYOR, DOCUMENT THE EXACT LOCATION OF THE SEPTIC SYSTEM AND DRAIN FIELD. AND THAT SHOWS THAT THE TOPOGRAPHY AND EXACT LOCATION OF THE DRAIN FIELD PROVIDE THE HARDSHIP JUSTIFYING THE

ACTUALLY, THIS IS A LICENSED SURVEY, THE SEPTIC FIELD IS HERE, DRAIN FIELD IN THIS AREA. THIS IS WHERE THE SHED HAS BEEN PLACED. THE FORMER SHED WAS UP HERE. AND AS IT DETERIORATED, AND WHEN HE WENT TO REBUILD IT, HE COULDN'T PLACE IT BACK UP HERE, BECAUSE THIS WAS THE NEW DRAIN FIELD THAT HAD BEEN PUT IN. HE NEEDED TO PUT IT BACK HERE. IT NEEDS TO BE I THINK I CAN'T STATE FOR THE RECORD WHAT THE ISTANCE IS, BUT IT HAS TO BE A CERTAIN NUMBER OF FEET FROM WHERE THE DRAIN FIELD IS. THAT IS WHY THE SHED, WHICH IS SIMILAR IN SIZE, SHAPE, SIMILAR IN HEIGHT, AND ALL ASPECTS OF WHAT THE FORMER SHED WAS THAT WAS ON THE PROPERTY.
I DO WANT TO STATE FOR THE RECORD, BECAUSE I THINK THERE WAS A COUPLE OF QUESTIONS IN MY CONVERSATIONS WITH STAFF AND WITH MAYBE SOME OF THE COMMISSIONERS, I DON'T RECALL WHICH ONES, BUT AS FAR AS THE HEIGHT OF THIS STRUCTURE, IT IS I BELIEVE 11 FEET IN HEIGHT TODAY. SO IT'S NOT PARTICULARLY HIGH. IT'S THE SAME HEIGHT AS WHAT THE HOUSE IS. THIS PARTICULAR STRUCTURE SERVES AS THE GARAGE OF THE HOUSE. 1300 SQUARE FOOT HOUSE. DOESN'T HAVE A GARAGE.
THIS SERVES AS A GARAGE FOR THE HOUSE AND THAT IS THE ONLY REASON THERE IS ELECTRICITY TO IT. NOT FOR ANY OTHER REASON AT ALL.

IN FAIRNESS TO WORLD COMMERCE CENTER, SINCE IT'S BEEN AROUND FOR 18 YEARS, WE THOUGHT BEST IT KEEP ITS VESTED DEVELOPMENT RIGHTS, WHICH ARE PART OF ITS PRIVATE PROPERTY RIGHTS.
EVEN THOUGH THE SCHOOL IS COMING TO WORLD COMMERCE CENTER, SO TO SPEAK.
REQUESTING THE ADDITION OF INDUSTRIAL LAND TO PROPERTY THAT IS OWNED BY RING POWER TO BRING IN A PROSPECTIVE NEW BUSINESS TO ST. JOHNS COUNTY. WE'RE ASKING TO REMOVE THE OPTIONAL MIXED USE OVERLAY AND THEN ADDITIONAL MINOR REVISIONS TO THE PUD.
YOU'LL RECALL ACTUALLY THE PZA LAST YEAR APPROVED AN AMENDMENT TO THE PUD TO ALLOW THE PUBLIX GREEN WISE STORE WHICH WILL BE CONSTRUCTED IN THE SOUTHWESTERN PORTION OF THE PROPERTY TO BE DEVELOPED OF WHAT THEY CALL A SIP AND STROLL. ONE IS A BID OR INVITATION TO BID, WHICH PRIMARILY IS CONCERNED WITH THE PRICING COMPONENT. COMPARABLE WOULD BE IF WE PUT OUT SPECS FOR LET'S SAY A FACILITY. TO BE CONSISTENT WITH MANY OF OUR CONTRACTS IN RECENT YEARS, WITH TWO ONE-YEAR RENEWALS. IN 2010 AND 2015, AS RECOMMENDED HERE, TO ENSURE A SUFFICIENT POOL OF RESOURCES, FOR TEMPORARY EMPLOYEES, WE'VE UTILIZED TWO TEMPORARY AGENCIES. SO AGAIN, THE RFP PROCESS WAS CHOSEN AGAIN. AND WHILE PRICING AGAIN IS AN IMPORTANT FACTOR IN THIS, I WANT TO KIND OF APPROACH WHY AN RFP PROCESS WAS UTILIZED. ONE, TO UNDERSTAND THE PROSPECTIVE EMPLOYER, HOW THEY RECRUIT AND HOW THEY MANAGE TEMPORARY EMPLOYEES WHO WORK FOR THE COUNTY. THESE EMPLOYEES, THEY'RE TEMPORARY EMPLOYEES OF THIS AGENCY, WHILE THEY'RE NOT COUNTY EMPLOYEES, THEY REPRESENT AND CAN BE IDENTIFIED AS COUNTY EMPLOYEES, THERE ARE TIMES WHEN THEY MAY HAVE A ST. JOHNS COUNTY T-SHIRT OR A UNIFORM ON. SO WE WANT TO MAKE SURE THAT THE AGENCY CERTAINLY RECRUITS AND MANAGES THEIR TEMPORARY EMPLOYEES. SO THERE IS CERTAINLY A SCREENING PROCESS. CERTAINLY OCCASIONS ALTHOUGH, YOU KNOW, I UNDERSTAND THERE ARE FEW OF THOSE, WHERE THE COUNTY MAY UTILIZE TEMPORARY STAFFING FOR SOME TECHNICAL EXPERTISE, POSSIBLY IN AN ENGINEERING CAPACITY, LARGELY FOR A NON-RECURRING ENGINEERING ITEMS. FOR THIS PARTICULAR PROCESS, I'M SORRY, THIS PARTICULAR RFP, THERE WERE FOUR EVALUATORS CHOSEN TO EVALUATE THE RFP PROCESS.
AGAIN, THERE WAS A CRITERIA ESTABLISHED. THE IDEA OF HAVING FOUR EVALUATORS, REPRESENTATIVE OF A CROSS SECTION OF THE COUNTY, IT IS THE INTENT TO CREATE WHAT WOULD BE AN OBJECTIVE REVIEW OF IT. RATHER THAN A SUBJECTIVE VIEW WHERE LET'S SAY PURCHASING USED TO REFER IT TO AS STACKING THE DECK.
LET'S SAY, PUBLIC WORKS, THEY HAD AN ENGINEERING PROJECT, YOU DON'T WANT EVERYONE ON THE EVALUATION TEAM NECESSARILY TO BE A PUBLIC WORKS ENGINEER. THE APPROXIMATE ESTIMATE AND THE POTENTIAL MATCH AN OBLIGATION TO THE COUNTY AND AM LOOKING FOR DIRECTION FROM THE BOARD ON SENDING A LETTER TO JACK'S USA AND NORTHEAST FLORIDA REGIONAL COUNSEL FOR THEIR SUPPORT SHOULD THE BOARD CHOOSE.
