>> GOOD MORNING. >> MAGGIE COSCO BEACH BOULEVARD. I JUST WANTED TO TAKE A MINUTE TO RECOGNIZE AND THANK BRIAN FROM THE CITY OF SAINT AUGUSTINE BUILDING DEPARTMENT FOR HIS INNOVATIVE AND CREATIVE APPROACH IN HELPING OUR LOCAL BUSINESSES OVERCOME SOME OF THE OPERATIONAL CHALLENGES OF THE COVID-19 CRISIS. ALTHOUGH WE ARE ANXIOUS TO RESUME A LIFESTYLE, A CHANGE IN THE APPROACH OF HOW WE DO THINGS IS HERE TO STAY AT LEAST FOR A WHILE.
THE REOPENING OF RESTAURANTS WITHIN THE ESTABLISHED GUIDELINES IS A WELCOME STEP TO RESUMING A MORE FAMILIAR WAY OF LIFE. HOWEVER, THE PUBLIC MAY NOT BE AWARE OF THE CHALLENGES THAT COME WITH ONLY ALLOWING 25 PERCENT OF REGULAR SEATING CAPACITY FOR A RESTAURANT. AS IN MANY SERVICE INDUSTRIES, THERE IS A PREDETERMINED NUMBER OF STAFF OR PERSONNEL REQUIRED FOR THE FUNCTIONING OF OPERATIONS REGARDLESS OF WHETHER YOU HAVE 25 PERCENT SEATING OR 100 PERCENT SEATING. FOR MANY OF OUR LOCAL RESTAURANTS, 25 PERCENT SEATING CAPACITY DOES NOT BRING ENOUGH REVENUE TO WARRANT THE RESTAURANT TO BE OPEN BECAUSE IT DOES NOT JUSTIFY THE COST OF REQUIRED NUMBER OF STAFF.
GOOD GOVERNANCE SHOULD CREATE SOLUTIONS TO SOLVE PROBLEMS WITHIN OUR COMMUNITIES.
AND BRIAN LAW TOOK THE INITIATIVE TO DO JUST THAT. BRIAN DEVELOPED A RESOLUTION THAT ALLOWS EXPEDITED PERMITTING WAS REGULAR FEES WAIVED TO GIVE LOCAL RESTAURANTS THE OPPORTUNITY TO CREATE ADDITIONAL OUTDOOR SEATING IN UNDERUTILIZED AREAS LIKE PARKING LOTS AND SITE AREAS. THE SAINT AUGUSTINE BEACH COMMISSION PASS A RESOLUTION ON MAY 4 AND I UNDERSTAND THAT THE CITY OF SAINT AUGUSTINE ANNOUNCED A SIMILAR RESOLUTION YESTERDAY. I'M ENCOURAGED BY THE CONTINUED WORK OF ALL LOCAL LEADERS TO CREATE OPPORTUNITIES FOR OUR LOCAL BUSINESSES TO RESUME OPERATIONS. CREATING EMPLOYMENT IS THE KEY TO REESTABLISHING OUR LOCAL ECONOMY, WHICH IMPACTS THE BIGGER PICTURE. IT IS IMPORTANT TO REMEMBER THAT THERE ARE SOME BUSINESSES THAT HAVE NOT BEEN ALLOWED TO REOPEN AS PER THE GOVERNOR'S EXECUTIVE ORDER AND PHASED PLAN. LIKE MANY OTHERS I LOOK FORWARD TO THE DAY I CAN GET A HAIRCUT, MY NAILS DONE. BUT AT THIS TIME, I WOULD LIKE TO ESPECIALLY THANK THE COMMISSION FOR CREATING ADDITIONAL FUNDING OPPORTUNITIES FOR OUR LOCAL BUSINESSES. SOME RECIPIENTS OF THOSE FUNDS -- IT WILL MAKE A BIG DIFFERENCE. THE DIFFERENCE OF BEING ABLE TO CONTINUE THEIR BUSINESS OR CLOSE THEIR DOORS FOREVER. I ALSO APPRECIATE AND WOULD LIKE TO THANK THE ADMINISTRATION AND STAFF WHO HAVE BEEN INSTRUMENTAL IN HELPING TO CREATE OPPORTUNITIES FOR LOCAL BUSINESSES AND JUST LIFE IN GENERAL, GETTING BACK TO A MORE FAMILIAR FEEL. THANK YOU ALL. YOUR WORK IS GREATLY
APPRECIATED. >>CHAIRMAN SMITH: THANK YOU.
ES? >>MALE SPEAKER: (INDISCERNIBLE
. >>MALE SPEAKER: IF YOU SEND THAT MESSAGE BACK TO YOUR FELLOW COMMISSIONERS. AS A RESIDENT I OBSERVED THE EXCELLENT JOB ALL OF YOU HAVE DONE MANAGING THIS CRISIS AND STAYING IN TOUCH WITH ME.
AND I WANT YOU, AS A SIDE NOTE POINT OUT THAT MR. LAW IS AN ALUM OF SAINT JOHNS COUNTY STEP
THAT'S WHAT HE SO DRAINED GOOD. >>CHAIRMAN SMITH: THANK YOU.
>>MALE SPEAKER: ANYBODY ELSE FOR PUBLIC COMMENT? GOOD MORNING.
PLEASE STATE YOUR NAME AND ADDRESS FOR THE RECORD.
>> GOOD MORNING THIS IS TOM REYNOLDS. SAINT AUGUSTINE BEACH FLORIDA.
THE FIRST THING I WOULD LIKE TO DO IS COMMISSIONER DEAN SPEAKING?
>>MR. DEAN: YES, SIR. GO AHEAD.
>>MALE SPEAKER: OKAY. TODAY I WOULD LIKE TO AS THE COMMISSION THAT THEY WOULD TAKE UP A BAND OF ANY ALCOHOLIC BEVERAGES AT THE ST. JOHN'S COUNTY PEER.
I SPOKE TO BEFORE THIS, BUT NOW THAT IT'S KNOWN THAT ALCOHOL CONSUMPTION IS ADDING TO THE SPREAD OF THE CORONAVIRUS, I THINK IT IS TIME THAT THE COMMISSION ACT AND DO A
[00:10:03]
PERMANENT BAND AND NOT ALLOW ALCOHOL AT ANY OF THE EVENTS DOWN AT THE SAINT AUGUSTINE BEACH PIER ON THE PUBLIC PROPERTY. AND THAT'S ALL I HAVE TODAY.THANK YOU VERY MUCH FOR HOLDING THESE MEETINGS.
>> THANK YOU, TOM. TOM, IF YOU WOULD HANG UP, PLEASE? MR. CHAIRMAN? ANYBODY ELSE HAVE ANY PUBLIC COMMENT THIS MORNING?
[Regular Agenda]
SINGLE PUBLIC COMMENT WILL) WILL TURN BACK TO THE REGULAR AGENDA.COMMISSIONER DEAN? >>MALE SPEAKER: MR. CHAIR, COMMISSIONERS, JUST YOU KNOW OF YOUR ITEMS THREE AND FOUR, ITEM 3 PER THE AGENDA WILL NOT BE HEARD EARLIER THAN 9 AM AND ITEM NUMBER FOUR WILL NOT BE HEARD EARLIER THAN 10:30 AM.
ITEM NUMBER FOUR WILL ALSO INCLUDE A REQUEST FOR JULY BUT THAT WILL BE NO EARLIER THAN 10:30 AM. THANK YOU.
>>CHAIRMAN SMITH: WITH THAT I WILL ENTERTAIN A MOTION TO APPROVE THIS SPECIAL AGENDA.
>>CHAIRMAN SMITH: I HAVE A MOTION AND SECOND. ANY DISCUSSION? SEEING THEM ALL IN FAVOR SIGNIFY BY SAYING AYE. THE MOTION CARRIES.
[Item 1]
>>CHAIRMAN SMITH: AGENDA ITEM NUMBER ONE, MR. CONRAD. EMERGENCY MANAGEMENT UPDATE.
>> GOOD MORNING, MR. CHAIR AND COMMISSIONERS. A QUICK UPDATE ON TESTING FOR ST. JOHN'S COUNTY. I'M GOING TO LEAVE THAT TO THE DOCTOR TO PRESENT TO YOU.
IT WILL BE ALLOWING TESTING FOR ASYMPTOMATIC INDIVIDUALS A LETTER GIVE YOU SOME INFORMATION AND DETAILS ON THAT. ONE POSITIVE PIECE OF NEWS THAT I WANT TO PRESENT TO YOU IS THE MOST RECENT UPDATE. THE DEPARTMENT DASHBOARD IS A LITTLE DELAY COMING OUT OF THE WEEKENDS, BUT FROM MAY 1 TO MAY 8, WE ONLY SAW ONE DAY WHERE THERE WERE TWO CASES. THE REMAINING DAYS OF THAT SEVEN-DAY PERIOD WERE ONE OR LESS NEW CASES PER DAY IN ST. JOHN'S COUNTY. GOOD NEWS OVER THE LAST SEVEN DAYS. HOPEFULLY WE WILL SEE THE GOOD NEWS LOCALLY AND THAT WILL SPREAD NATIONALLY ACROSS THE WORLD. JUST AN UPDATE ON THE ECONOMIC RECOVERY WORKSHOP AND -- THAT WERE -- ECONOMIC RECOVERY TASK FORCE AND THINGS THAT HAVE BEEN GOING ON FOR YOUR LEADERSHIP IN THE ADVICE AND COUNSEL THAT YOU GIVEN TO US.
THE SMALL BUSINESS EMERGENCY GRANT WILL BE LAUNCHED ON WEDNESDAY.
AS THE FUNDS THAT YOU ALLOCATE AS PART OF THAT. SO STARTING WEDNESDAY, LOCAL BUSINESSES WILL BE ABLE TO APPLY FOR THAT SMALL BUSINESS EMERGENCY GRANT.
OBVIOUSLY, THE FUNDS ARE LIMITED. THERE WAS A PRESS RELEASE PUT OUT YESTERDAY ON THOSE FUNDS ANYONE CAN GO TO THE WEBSITE. THERE IS A LINK TO HOW TO APPLY TO GET IN TOUCH WITH THE STAFF IN ORDER TO QUALIFY FOR THOSE FUNDS.
ADDITIONALLY, WE HOPE THAT THE OTHER PIECE, WILL BE READY BY NEXT MONDAY.
WE ARE STILL IN CONSULTATION WITH OUR CONSULTANTS, CAPITAL ACCESS, AS THEY WORKED WITH THE REQUIREMENTS BECAUSE THERE ARE MORE STRINGENT REQUIREMENTS GIVEN THAT IS HIGH DEBT FUNDING. ADDITIONALLY, AS YOU KNOW YOU GAVE PERMISSION AND APPROVAL FOR US TO GIVE OUT THE SMALL BUSINESS CARE PACKAGES. THEY WENT OUT LAST WEEK.
I THINK IT'S IMPORTANT TO NOTE THAT THOSE ARE FREE. AND I SAY FREE, THEY ARE FREE TO THE COMMUNITY. THERE'S FEDERAL FUNDING THAT SUPPORTED THE PURCHASE OF THOSE KIDS BUT HUNDRED ARE GONE. WE HAD OVER 300 CALLS ASKING ABOUT THAT AND THERE ARE 87 ON A WAIT LIST. AS WE GET THE ADDITIONAL RESOURCES OVER THE NEXT WEEK OR TWO WE WILL HAVE THE KIDS PREPARED EMERGENCY MANAGEMENT AND FIRE RESCUE HAS DONE A GOOD JOB PREPARING THOSE KIDS. BUSINESSES WILL BE CONTACTED AND BE ABLE TO PICK UP THE CARE PACKAGES. ALL THEY HAVE TO DO IS ASK IF THEY FALL IN THAT SMALL BUSINESS AREA. AND THEN JUST AN UPDATE ON THE HOTLINE THAT WE LAUNCHED APPROXIMATELY A MONTH AGO -- MAYBE THREE WEEKS AGO. TO DATE WE RECEIVED OVER 475 CALLS TO THE HOTLINE HELPING INDIVIDUALS AND BUSINESSES. WE'VE RECEIVED APPROXIMATELY 75 CALLS ONLY DISMISS HOTLINE. THERE IS STAFF ENGAGED TRYING TO ANSWER AS MANY QUESTIONS AS OUR LOCAL BUSINESSES AND INDIVIDUALS HAVE ABOUT RECEIVING ASSISTANCE AND THAT
[00:15:01]
WILL REMAIN OPEN DURING THE REMAINDER OF THE LOCAL STATE OF EMERGENCY.I WILL TURN IT OVER TO FOR THE EMERGENCY MANAGEMENT UPDATE AND ALL STANDBY FOR QUESTIONS.
>>CHAIRMAN SMITH: THANK YOU. GOOD MORNING DR. ELLICOTT.
>> GOOD MORNING. DR. ELLICOTT DIRECTOR HEALTH OFFICER MEDICAL DIRECTOR WITH FLORIDA DEPARTMENT OF PUBLIC HEALTH IN ST. JOHN'S COUNTY HERE TO GIVE A STATUS UPDATE ON COVID-19 BEFORE BEGIN, WANT TO THANK OUR CHAIR OF OUR BOARD OF COUNTY COMMISSIONERS AND OUR ADMINISTRATOR AND HIS TEAM, MR. CONRAD, FOR YOUR SUPPORT, AS ALWAYS.
AS OF YESTERDAY, OUR DASHBOARD HAS NOT BEEN UPDATED BUT AS OF YESTERDAY OUR TOTAL TASKS IN THE STATE OF FLORIDA ARE SOMEWHERE BETWEEN -- OVER ONE HALF MILLION -- IT'S ABOUT 2.7 PERCENT OF FLORIDA'S POPULATION WAS TESTED. ONE PERSON MAY HAVE HAD MORE THAN ONE TEST. THAT'S ABOUT A SEVEN PERCENT POSITIVE RATE NOTED.
IN ST. JOHN'S COUNTY WHICH WAS 2.7 PERCENT OF FLORIDA'S POPULATION.
THREE PERCENT POSITIVE VERSUS SEVEN PERCENT FOR THE STATE OF FLORIDA.
OUR TOTAL CASES AT THIS TIME IS 222. OUR DASHBOARD IS BEING UPDATED REGULARLY, HOWEVER THERE IS A LAG TIME BETWEEN RECEIPT OF THE RESULTS FOR THE LABS AND WHEN THEY ARE SENT TO US. HOSPITALIZATIONS IN FLORIDA REMAIN AT ABOUT 80 PERCENT OF ALL THE CASES WITH 17 PERCENT IN ST. JOHN'S COUNTY. WE ARE TALKING ABOUT THE ENTIRE TIME NOT JUST LAST WEEK THAT'S ABOUT FOUR PERCENT IN ST. JOHN'S COUNTY WITH ST. JOHN'S COUNTY AT TWO PERCENT. PUBLIC HEALTH FOCUS MONITORING AND CONTACT TRACING.
YOU'VE HEARD A LOT ABOUT THIS OVER THE PAST FEW MONTHS. OUR FOCUS CONTINUES TO BE ON EARLY CASE IDENTIFICATION. ISOLATION AND CONTACT TRACING, ATTEMPTING TO CURB THE SPREAD OF THE DISEASE. TO ELABORATE, AS I SHARED BEFORE, WHEN THE DEPARTMENT OF HEALTH RECEIVES NOTIFICATION THAT A PERSON HAS TESTED POSITIVE FOR COVID-19, THE DEPARTMENT CONDUCTS AN INVESTIGATION BASED ON CDC GUIDANCE TO IDENTIFY THOSE INDIVIDUALS HOME THAT HAD CLOSE CONTACT WITH THE PERSON WHO TESTED POSITIVE.
IN ORDER TO SAVE LIVES, WHICH IS THE BURDEN ON OUR HEALTHCARE SYSTEM -- CONFIDENTLY MAKE PROGRESS TO RETURN TO WORK IN SCHOOL. STUDIES DONE BY THE JOHNS HOPKINS SCHOOL OF PUBLIC HEALTH SUGGEST THAT THE UNITED STATES MUST IMPLEMENT A ROBUST AND COMPREHENSIVE SYSTEM TO IDENTIFY ALL COVID-19 CASES AND TO TRACE AND ISOLATE ALL CASES, ALL CLOSE CONTACTS OF EACH IDENTIFIED CASE. CONSIDER THE FOLLOWING.
IT IS ESTIMATED THAT EACH INFECTED PERSON CAN, ON AVERAGE, IN FACT 2 TO 3 OTHERS.
SO WHAT IS THAT MEAN EXACTLY? IT MEANS IF ONE PERSON SPREADS THE VIRUS TO THREE OTHERS, THE FIRST POSITIVE CASE CAN TURN IT INTO WAS A 59,000 CASES IN 10 ROUNDS OF INFECTIONS.
THIS DATA EXPLAIN THE NECESSITY OF OUR PUBLIC HEALTH CURRENT AND FUTURE EFFORTS TO CONTACT GRACE AND ISOLATE POSITIVE CASES OF COVID-19. WE NEED TO INTERRUPT THE TRANSMISSION OR TRAIN OF INFECTIONS. EACH CASE CAN BE SUCCESSFULLY TRACED AND ISOLATED CAN BECOME A SELF-LIMITING TRAIN OF INFECTION AND THAT CASE THEN BECOMES ITS OWN TRAIN CABOOSE AND IT WILL STOP THE ROUND OF TRANSMISSIONS. ADDITIONALLY, EACH POSITIVE INFECTIOUS DISEASE HAS 10 CLOSE CONTACTS. AND MUST BE CONTACT TRACED AND MONITORED DURING THEIR INFECTIOUS PERIOD TO BE SURE THAT THEY'RE TREATED OR ISOLATED. CONTACT TRACING IS WHAT YOU PUBLIC HEALTH PROFESSIONALS IN THE DEPARTMENT OF HEALTH DO FOR OVER 100 REPORTABLE DISEASES IN THE STATE OF FLORIDA EVERY DAY.
THIS IS OUR EXPERTISE. THIS IS WHAT WE DO BEHIND THE SCENES.
PRIOR TO COVID-19, AS ALWAYS, WE ARE AVAILABLE 24 SEVEN WITH A NURSE ON CALL AFTER HOURS AND ON WEEKENDS. IN ADDITION WE OPERATE IN-HOUSE SEVEN DAYS A WEEK, 5:52 PM AS
[00:20:01]
WE HAVE DONE OVER THE PAST EIGHT WEEKS AS WELL AS CONTINUING TO BE AVAILABLE AND TAKING CALLS FOR COVID-19 AND NINE COVERED COVID-19 ISSUES 24 SEVEN.NOW TO OUR VULNERABLE POPULATIONS, LAWN CARE FACILITIES.
THE DEPARTMENT OF HIDE IN THE AGENCY CARE ADMINISTRATION ARE WORKING DAILY TO AVOID OUTBREAKS OF COVID-19 AND OR LONG-TERM FACILITIES. WE HAVE TWO GOALS, ONE, KEEP COVID-19 FROM ENTERING LONG-TERM FACILITIES AND TO, IDENTIFY ANY COVID-19 INFECTIONS EARLY. TO THAT END, WE ARE SYSTEMATICALLY CONDUCTING INVESTIGATIONS AS WELL AS TESTING STAFF AND RESIDENTS IN ORDER TO AVOID VIRUS SPREAD AND OUTBREAKS. IN THE PAST 2 TO 3 WEEKS WE WORKED WITH THE STATE DEPARTMENT OF HEALTH TO HAVE OVER 1500 SPECIMENS COLLECTED AND SENT FOR COVID-19 TESTING.
A SINGLE POSITIVE STAFF MEMBER OF ONE OF THESE FACILITIES CAN CAUSE AN OUTBREAK RESULTING IN HOSPITALIZATIONS AND HOSPITAL DEATHS MANY OF THESE VULNERABLE RESIDENTS.
IF A STAFF MEMBER WORKS AT MULTIPLE FACILITIES, THIS CAN RESULT IN FACILITY TO FACILITY SPREAD. EARLY IDENTIFICATION AND IDENTIFICATION OF CASES ALLOW US TO IMPLEMENT IMMEDIATE ACTIONS TO AVOID LOSS OF LIFE. REGARDING GETTING BACK TO WORK.
ONTO THE MITIGATION STRATEGY. SOCIAL DISTANCING HAS WORKED AND IS WORKING.
AS YOU ARE AWARE, GOVERNOR DESANTIS ISSUED AN EXECUTIVE ORDER 'S PHASE 1 SAFE AND SMART STEP-BY-STEP PLANNING FOR FLORIDA'S RECOVERY. EFFECTIVE AS OF LAST MONDAY, MAY 4. ADDITIONALLY, ON APRIL 30, STATE SURGEON GENERAL ISSUED A RENEWAL OF THE DECLARATION OF PUBLIC HEALTH EMERGENCY DETERMINING THAT COVID-19 CONTINUES TO BE A THREAT TO PUBLIC HEALTH IN FLORIDA. RECOGNIZING THAT A SIGNIFICANT PORTION OF INDIVIDUALS ASYMPTOMATIC AND THAT THOSE WHO DEVELOP SYMPTOMS ARE PRESYMPTOMATIC CAN TRANSMIT THE VIRUS TO OTHERS BEFORE SHOWING SYMPTOMS. THE CDC HAS EXPANDED ITS TESTING CRITERIA TO INCLUDE ASYMPTOMATIC PERSONS.
CONFIRMED BY THE WORLD HEALTH ORGANIZATION THE RAPID SPREAD OF COVID-19 ACROSS U.S.
PROVIDES CLEAR EVIDENCE OF COVID-19 TRANSMISSION FROM ASYMPTOMATIC PERSONS AS WELL AS THE EVENTUAL NEED THAT ALL COMMUNITIES HAVE TO RELAX CURRENT SOCIAL DISTANCING STRATEGIES AND PRACTICES ARGUE FOR BROAD-BASED TESTING TO INCLUDE ASYMPTOMATIC PERSONS.
GOVERNOR DESANTIS REOPENED FLORIDA TASK FORCE REPORTS AND STATES THE FOLLOWING TESTING FOR COVID-19 IS A CRITICAL COMPONENT TO OPEN IN A SMART STEP.
THE AMOUNT OF TESTING SHOULD BE FURTHER EXPANDED SO STATE AND LOCAL HEALTH OFFICIALS CAN ADEQUATELY MONITOR THE PROCESS. THE REPORT CONTINUES IMPORTANTLY AND CURRENTLY, FLORIDA HAS MORE TESTING CAPACITY. WE MUST WORK TO ENCOURAGE THIS TESTING UP TO OUR CAPACITY. IN ALIGNMENT WITH THE RECOMMENDATIONS FOR THE GOVERNOR'S TASK FORCE THE FLORIDA DEPARTMENT OF HEALTH LAUNCHED AN INITIATIVE.
THIS EXPANDED TESTING INITIATIVE LED BY THE FLORIDA DEPARTMENT OF HEALTH COUNTY HEALTH DEPARTMENTS STANDS FOR IN MAY, TO REACH TWO PERCENT OF THE POPULATION.
DOH IS TESTING EVERY DAY. THE MAY TODAY INITIATIVE BUILT UPON A STUDY FROM HARVARD UNIVERSITY THAT SAYS FOR PUBLIC SAFETY AND CONFIDENCE, WE NEED TO TEST 2 TO 6 PERCENT OF OUR POPULATION AS WE REOPEN OUR COMMUNITIES. THE HARVARD STUDY IS LOOKING AT 2 TO 6 PERCENT PER DAY WHILE HE MAY TODAY INITIATIVE IS BEGINNING WITH TWO PERCENT.
THE DEPARTMENT OF HEALTH IN ST. JOHN'S COUNTY INCREASED OUR ON-SITE SPECIMEN COLLECTION FOR COVID-19 TESTING TO INCLUDE ASYMPTOMATIC PERSONS. FROM 9 AM TO 4 PM TODAY THROUGH SATURDAY AND TODAY THROUGH SATURDAY AND 11:51 ON SUNDAY WHILE SUPPLIES LAST AND WEATHER PERMITTING, WITH THE GOAL TO REACH TWO PERCENT OF OUR POPULATION COVID-19 TESTING IN KEEPING WITH THE INITIATIVE. AT THE MOMENT, WHILE DEMAND HAS BEEN STRONG, WE HAVE NOT REACHED FULL CAPACITY AT THE HEALTH DEPARTMENT SITE FOR THE COVID-19 TESTING.
WHILE SUPPLIES LAST, WE HAVE CAPACITY FOR 300 COLLECTIONS PER DAY, THAT'S DIAGNOSTIC TESTING. IN THE PAST FIVE DAYS EXCEPT TO ARRANGE OUT ON SUNDAY WE DID
[00:25:01]
FROM ABOUT 130 TO 200 COLLECTIONS A DAY. THESE NUMBERS ONLY INCLUDE THE HEALTH DEPARTMENT TESTING SITES. THEY DO NOT INCLUDE TESTING PERFORMED BY OTHER COMMUNITY TESTING LOCATIONS. I WISH TO TAKE THIS OPPORTUNITY TO THANK ALL THOSE WHO ASSISTED THE PSA OFFICERS FOR THE TRAFFIC SAFETY AND CONTROL.TO CONTINUE, A REMINDER ABOUT THE IMPORTANCE OF WEARING FACE MASKS.
THE CONVINCING EVIDENCE OF ASYMPTOMATIC TRANSMISSION ALSO SUPPORTS THE CDC'S RECOMMENDATION FOR WEARING CLOTH FACE COVERINGS IN PUBLIC SETTINGS.
THIS RECOMMENDATION FOR THE GENERAL PUBLIC TO USE SOME FORM OF FACE MASK OR CLOTH FACE COVERING ONE IN A CROWDED OUTDOOR OR INDOOR SPACE IS A KEY MITIGATION STRATEGY WHERE OTHER SOCIAL DISTANCING MEASURES CANNOT BE MAINTAINED. PLEASE REMEMBER THAT HER EFFORTS FOR SOCIAL DISTANCING, PHYSICAL SEPARATION IS HAVE A POSITIVE AFFECT.
IT REALLY DOES WORK. SHOULD WE BECOME COMPLACENT AND EASE UP PREMATURELY ON SOCIAL DISTANCING THE PANDEMIC COULD CHANGE FOR THE WORSE AND ECONOMIC COSTS WOULD GROW.
AS A REMINDER THE BEST AND MOST UP-TO-DATE INFORMATION IS AVAILABLE AT THE FLORIDA HEALTH WEBSITE. PLEASE CONTINUE TO PRACTICE SOCIAL DISTANCING MAINTAINING SIX FEET FROM THOSE AROUND YOU IN SOCIAL SETTINGS AND DO NOT CONGREGATE IN GROUPS OF MORE THAN 10 PEOPLE. USE GOOD HYGIENE WASHING YOUR HANDS WITH SOAP AND WATER.
STAY AT HOME IF YOU ARE SICK. AS ALWAYS, MY HEART REMAINS WITH INDIVIDUALS AND FAMILIES AFFECTED AS THEY STRUGGLE WITH GRIEF AND ILLNESS. THANK YOU.
>> THANK YOU FOR THE INFORMATION. I AGREE WITH YOU 100 PERCENT.
MAY I SUMMARIZE WHAT I HEARD JUST MAKE SURE I HEARD ACCURATELY?
>> YES. >> THE HEALTH ORGANIZATIONS RECOMMENDING TO TO SIX PERCENT OF ALL PEOPLE TO BE TESTED, NOT JUST OUR HEALTHCARE WORKERS AND EMS. ACCESS MY UNDERSTANDING.
>> OKAY. WE AT THE COUNTY LEVEL HAVE THE CAPACITY WE LESS THAN HALF THE CAPACITY BEING USED ON A DAILY BASIS AT THE LOCATION THAT YOU CITED.
ASYMPTOMATIC PEOPLE SHOULD BE TESTED AND THERE IS NO COST TO THE PEOPLE GETTING TESTED.
>> CORRECT. >> IS VERY BASIS OF
RECOMMENDATION FOR RETESTING? >> ABSOLUTELY CORRECT.
THAT IS CORRECT. THERE'S NO SPECIFIC RECOMMENDATION AT THIS TIME, HOWEVER, FOR EXAMPLE, I WAS TESTED LAST WEEK AND I PLAN TO BE TESTED THIS WEEK.
THERE IS NO SPECIFIC GUIDANCE. IF WE HAD MORE TESTING, WE WOULD WANT TO DO IT MORE REGULARLY. WE WANT TO GIVE OPPORTUNITY TO OTHERS.
YOU ARE CORRECT. HIS A SPOT IN TIME. WE ARE AWARE OF THAT.
WE DON'T HAVE A FALSE SENSE OF SECURITY, BUT IT HELPS US TO SEE BETTER WHERE WE ARE.
>> FACTS, NOT FEAR. >> CORRECT.
>> IS THE TESTING FOR THE VIRUS WERE INDEED BODIES ARE BOTH AT THE SAME TIME.
>> IT IS FOR THE VIRUS. >> JUST VIRUS.
>> YES. I HEARD CONVERSATIONS ABOUT ANTIBODY TESTING IS SET
AVAILABLE AND OR AREA. >> IS AVAILABLE AT TIA, I BELIEVE UP TO A CERTAIN NUMBER FOR HEALTHCARE WORKERS AND FIRST RESPONDERS.
IT WILL PROBABLY COME MORE AVAILABLE AS TIME PROGRESSES. IT IS STILL NEW.
WE ARE STILL LEARNING MORE ABOUT THE RELIABILITY, VALIDITY AND QUALITY OF THE TESTS.
>> OKAY. SO BASICALLY, THIS IS A PUBLIC CALL TO ENCOURAGE PEOPLE TO GET TESTED EVEN IF THEY DON'T HAND, SYMPTOMS FOR THE BENEFIT OF THE WHOLE COMMUNITY.
>> EXACTLY. >> THIS INFORMATION IS HELPFUL.
>> HOW MUCH DO WE REALLY HAVE OR DON'T HAVE? CERTAIN COMMUNITIES ARE TO BE MORE AFFECTED THAN OTHERS AND IT'S IMPORTANT TO DETERMINE THE PREVALENCE SO WE CAN MOVE FORWARD BETTER MORE FACT-BASED DECISIONS.
>> BASED ON THAT I PLAN TO GET. >> THANK YOU.
WITH THAT BEING SAID, AS WE DO SAFELY GO BACK TO WORK AS WE ARE ABLE TO -- IS A LOT MORE VEHICLES ON THE ROADS THIS WEEK THAN I DID LAST WEEK. THAT CAN BE GOOD AND BAD.
IF IT'S SAFE IT'S WONDERFUL. BUT THIS VIRUS IS NO PARTICULAR TO AGE, RACE, GENDER,.
IT'S INVISIBLE SO IT IS DIFFICULT TO RECOGNIZE A LEISURE TESTED.
ACTUALLY WHETHER YOU HAVE IT OR NOT. LOOK FOR JOB ANTIBODY TESTING
[00:30:06]
AVAILABLE TO SEE HOW THOSE RESULTS PLAY OUT, BUT I WANT TO ENCOURAGE PEOPLE AS WE DO GET BACK INTO A DIFFERENT ROUTINE, TO BE CONSIDERATE OF OTHERS WHO MAY HAVE MORE CONCERNS BECAUSE WE CAN TELL WHO IS VULNERABLE -- MORE VULNERABLE VERSUS OTHERS.SO WAS, LIKE THE HOLIDAY SEASON WHERE A LOT OF PEOPLE ARE CELEBRATING AND ARE STARTING TO GET BACK INTO THAT ENJOYABLE, COMFORTABLE, WHATEVER YOU WANT TO CALL IT ROUTINE, THERE ARE STILL PEOPLE WHO ARE SUFFERING, WHO ARE SCARED AND WE NEED TO BE CONSIDERATE OF THOSE WHO MAY NEED A LITTLE MORE SPACE AT THE GROCERY STORES OR WHEN YOU'RE OUT AND ABOUT.
HOW THAT CONSIDERATION WHILE WE ARE -- MOST OF US ARE STARTING TO FEEL LIKE WE JUST MAKE IT SAFE TO GET BACK TO THE ROUTINE BE CONSIDERATE OF THOSE WHO ARE NOT AND IT'S NOT EASY TO TELL WHO IS TO BUT I'M GLAD TO SEE THAT PEOPLE ARE GETTING BACK INTO A MEANS TO FEED THEIR FAMILIES AND BE ABLE TO SUPPORT THEMSELVES. OBVIOUSLY SAFETY AND HEALTH IS FIRST BUT IT ISN'T AND NOT AN ORDER. THANK YOU FOR THE INFORMATION.
I WILL BE ENCOURAGING PEOPLE TO TEST. I'M GETTING A LOT OF CALLS ABOUT PEOPLE LOOKING FOR INFORMATION. I DON'T A GOOD DAY HAS GONE BY THAT HAVING GIVEN OUT THE HELPLINE NUMBERS I'VE HAD PEOPLE PRACTICALLY IN TEARS THANKFUL TO FIND THIS INFORMATION OUT BECAUSE THEY ARE AFRAID OF THE UNKNOWN MORE THAN REALITY. BY GETTING TESTED THAT GIVES THEM DEFINITIVE FACTS THAT THEY CAN BASE THEIR DECISIONS ON TO REMAIN HEALTHY IS TO BE ABLE TO MAKE ENDS MEET.
THANK YOU FOR THIS INFORMATION. IT'S VERY HELPFUL.
>> THANK YOU. >> ANY OTHER QUESTIONS? THANK YOU VERY MUCH. GOOD MORNING.
>> LINDA STUDENT ST. JOHNS COUNTY EMERGENCY MANAGEMENT DIRECTOR.
GOOD MORNING. THE EEOC REMAINS AT A LEVEL II WITH THE CITIZENS INFORMATION CENTER AND STAGING AREA IN PLACE. TODAY WE'VE GIVEN OUT 147,236 ITEMS DISTRIBUTED TO OVER 71 DIFFERENT AGENCIES AND ORGANIZATIONS.
WE WERE NOTIFIED YESTERDAY BY THE STATE OF FLORIDA EMERGENCY MANAGEMENT THROUGH FEMA THAT EACH COUNTY IS GOING TO BE RECEIVING CLOTH FACE COVERINGS FOR OUR CRITICAL INFRASTRUCTURE THAT WORK INSIDE OUR COMMUNITY. AT THIS TIME, WE DO NOT HAVE THOSE NUMBERS BUT THEY WILL BE FREE TO THE FOLLOWING GROUPS. WE USE A SIMILAR WAY TO GET THEM INTO THE COMMUNITY AS WE DO WITH THE SMALL BUSINESS PPE BAGS. THE CRITICAL INFRASTRUCTURE INCLUDE UTILITIES, FOOD DISTRIBUTION, ENERGY, AGRICULTURE AND COMMUNICATIONS.
AND COMMUNICATIONS, THEY ARE DESCRIBING CABLE COMPANIES, PEOPLE THAT ARE ENTERING OTHER PEOPLE'S HOMES. FOOD DISTRIBUTION IS PEOPLE THAT ARE IN WAREHOUSES OR EVEN OUR FOOD BANKS THAT WILL BE ABLE TO HAND THEM OUT TO OUR FOOD BANKS ARE HANDING OUT TO OUR PUBLIC. UTILITIES BOTH COUNTY AND CITY UTILITIES.
WE THINK THAT IS A GREAT PROGRAM TO PIGGYBACK OFF THE PROGRAMS THAT WE HAVE IN PLACE FOR OUR FIRST RESPONDERS, HEALTHCARE, THE HOSPITAL AND THE PROGRAMS FOR THE SMALL BUSINESSES. THIS IS ANOTHER WAY WILL HELP OUR COMMUNITY TO STAY SAFE.
THAT'S WE HAVE TO REPORT THIS WEEK FROM THE EMERGENCY OPERATIONS CENTER.
>>CHAIRMAN SMITH: ANY QUESTIONS ? SEE NONE.
THANK YOU VERY MUCH. >> THANK YOU.
>> ANY QUESTIONS FOR MR. CONRAD?
>> SCENE NINE, WE WILL OPEN UP FOR PUBLIC COMMENT.
>>MR. WALDRON: WILL HAVE PUBLIC COMMENT ON THE EMERGENCY MANAGEMENT UPDATE.
-- I THINK WE HAVE A CALL WAITING. NO, I DON'T.
>>CHAIRMAN SMITH: WITH PUBLIC COMMENT CLONESCLOSED WILL MOVE ALONG TO AGENDA ITEM NUMBER
TWO. >> GOOD MORNING AND THANK YOU FOR CALLING IN. PLEASE STATE YOUR NAME AND ADDRESS FOR THE RECORD, PLEASE?
>> TOM REYNOLDS, SAINT AUGUSTINE BEACH. THANK YOU COMMISSIONERS.
FIRST THING I WOULD LIKE TO DO IS GIVE YOU AN UPDATE I WANT TO THANK STATE REPRESENTATIVES STEVENSON'S OFFICE, THE DISTRICT MANAGER FOR ASSISTANCE IN UNEMPLOYMENT.
I ALSO WANT TO THANK, ON BEHALF OF MY NEIGHBORS TRAVIS HUSTON'S OFFICE FOR ASSISTANCE WITH THEIR UNEMPLOYMENT. THANK YOU VERY MUCH TO THOSE ELECTED OFFICIALS.
[00:35:02]
WE REALLY NEEDED THAT HELP. FOLKS, COMMISSIONERS, ALSO, I WAS WONDERING IF IN THE FUTURE, WE COULD GET THE DR., OUR HEALTH DEPARTMENT SPECIALISTS, THE DOCTORS THAT JUST SPOKE WITH SOME OF THE THINGS SHE SAID ARE PRETTY SCARY. IF WE COULD GET HER TO DO AN EVALUATION OF ALL THE EVENTS THAT ARE GOING TO BE AT THE PIER.FOR EXAMPLE, WE KNOW THAT DR. BIRX AND DR. FAUCI BOTH SAID WE ARE GOING TO NEED PHYSICAL SOCIAL DISTANCE AND FELT THE SUMMER AND YEAR AND WITH A FALL FLAREUP.
I WAS HOPING THEY COMMISSIONERS OR SOMEBODY COULD SHOW WHERE THE CROWDS ARE BEING GATHERED ESPECIALLY BEACH BLASTS. IF NOTHING ELSE, MAYBE THE COUNTY COMMISSIONERS COULD DO A STRICT ENFORCEMENT OF NO ALCOHOL AT THESE EVENTS, WHICH MIGHT HELP DISCOURAGE SOME OF THE PEOPLE FROM COMING AND LIGHTING UP THE FIREWORKS GROUND.
I KNOW WE HAVE A BIG EVENT, BUT WE ALSO KNOW THAT A LOT OF THE NUMBERS THAT WE ARE RECEIVING ARE NOT QUITE ACCURATE AND COMMISSIONERS, I KNOW YOU KNOW THESE THINGS.
HISTORY TELLS US THAT PANDEMIC NUMBERS ALWAYS RISE QUITE A BIT AFTERWARDS.
AND ONE OTHER THING, COMMISSIONERS, PRETTY SURE THAT YOU PROBABLY SAW ON THE NEWS IN THE ARTICLE THAT FOR THE FIRST TIME EVER, THE FLORIDA DEPARTMENT OF LAW ENFORCEMENT REDACTED A LOT OF THE DEATH REASONING. AND AS YOU PROBABLY KNOW, THE MEDICAL EXAMINERS ARE VERY UPSET IN THE STATE OF FLORIDA. THE LEAD MEDICAL EXAMINER SPOKE OUT AGAINST THE FDLE REJECTING THESE. SO ALWAYS CONSIDER, COMMISSIONERS, I WOULD APPRECIATE THAT DR. AND I COULD TELL SHE'S AN INCREDIBLY SHARP LADY BUT A LOT OF THE NUMBERS THAT THEY'RE GETTING MIGHT NOT BE SO ACCURATE.
BUT ONCE AGAIN, TO WRAP THIS UP, I WOULD REALLY APPRECIATE IT IF WE COULD GET AN UPDATE ON ALL THOSE EVENTS COMING UP AT THE PIER. NOW I'M PRETTY SURE THE SUMMER CONCERTS HAVE BEEN CANCELED. THAT'S GOOD. BUT HOW MANY THOUSANDS OF PEOPLE WE GET AT THAT BEACH BLAST AND IF THERE'S EVER GOING TO BE AN OUTBREAK IN ST. JOHN'S COUNTY, TELL YOU, DECEMBER 31, 2020 ON YOUR CALENDAR AND COUNT TWO WEEKS BECAUSE IF YOU COULD PROBABLY GET CHIEF HARDWICK TO WEIGH IN ON THIS. THERE ARE THOUSANDS AND THOUSANDS AND THOUSANDS OF PEOPLE THERE. AND ROBERT CAN GIVE YOU A FIRST-HAND ACCOUNT OF HOW MANY PEOPLE ARE ACTUALLY THERE.
>> THANK YOU, TOM. HOW MANY PEOPLE CAN SPREAD THIS THANK YOU VERY MUCH COMMISSIONERS. AS ALWAYS, KEEP UP THE GOOD WORK.
>> THANK YOU. >> I SEE NO OTHER PUBLIC
COMMENTS. >> WITH NO PUBLIC COMMENT NOW.
[Item 2]
WE WILL MOVE ALONG TO AGENDA ITEM NUMBER TWO. MR. MCCORMACK.>> THANK YOU, MR. SHARE. THE BOARD IS A BITPOSITION TO CONSIDER TO EXTEND FOR ANOTHER SEVEN DAY PERIOD THE LOCAL STATE OF EMERGENCY. YOU'VE HEARD FROM YOUR ADMINISTRATOR AND THE DEPARTMENT OF HEALTH. YOU'VE HEARD FROM YOUR EMERGENCY MANAGEMENT DIRECTOR, YOU'VE HEARD FROM PUBLIC SPEAKER.
SO, THE BOARD MAY CONSIDER WHETHER TO APPROVE THE PROCLAMATION FURTHER EXTENDED FOR SEVEN DAYS. THANK YOU.
>> THANK YOU. ANY QUESTIONS OF MR. MCCORMACK? PUBLIC COMMENT?
>> WE WILL HAVE PUBLIC COMMENT ON AGENDA ITEM NUMBER TWO. THE EMERGENCY PROCLAMATION EXTENSION. MR. CHAIRMAN, I SEE NO PUBLIC COMMENT.
>> WE ARE BACK TO THE BOARD. I WILL ENTERTAIN A MOTION.
>> ALL MAKE A MOTION. I MAKE A MOTION TO ADOPT THE EMERGENCY PROCLAMATION NUMBER 2020 ÃEIGHT. THE PROCLAMATION EXTENDING THE DECLARATION OF A LOCAL EMERGENCY AS PROVIDED BY CHAPTER 252 PART ONE. AND BY ST. JOHN'S COUNTY
ORDINANCE EVER 2019 Ã40. >> MR. CHAIR, BEFORE THE BOARD VOTES WE HAVE EMERGENCY PROCLAMATIONS BY THE BOARD AND EMERGENCY ORDERS BY THE ADMINISTRATOR. I LIKE TO DOUBLE CHECK WITH THE CLERK BECAUSE MY ORDER WOULD HAVE THIS AS -- PATRICK IS GREAT.
>> IT'S NUMBER 13. >> I SECOND THE MOTION.
>> ALL RIGHT. A MOTION BY COMMISSIONER WALDRON AND A SECOND.
ANY DISCUSSION? >> SEE NONE PLEASE VOTE.
[00:40:01]
IT PASSES 4-0. THANK YOU VERY MUCH. WITH THAT BEING SAID, WE WILL[Item 3]
MOVE ALONG IN THE AGENDA TO AGENDA ITEM NUMBER THREE. AGENDA ITEM NUMBER THREE WHICH WAS NOT TO BE HEARD EARLIER THAN 9 AM. ESTHER KELLY.THIS IS EXPERT TODAY IT IS. >> AND MR. CHAIR, I'D LIKE TO GO OVER FORMALLY THIS EX PARTE A AS A REMINDER FOR THE BOARD. SO FOR X PARTAKE COMMUNICATIONS, IF THERE HAVE BEEN ANY, THE COMMISSIONER SHOULD MENTION THE SUBJECT OF THE COMMUNICATION, AND IF POSSIBLE, THE IDENTITY OF THE GROUP PERSON OR ENTITY WITH WHOM THE COMMUNICATION TOOK PLACE.
>> FOR WRITTEN COMMUNICATIONS, OUR THOSE THAT GO INTO FCC OUR STAFF TAKES ABOUT THEY GO INTO THE RECORD. IF ANY COMMISSIONER HAS DONE ANY INVESTIGATIONS, SITE VISITS, THAT TYPE OF THING, THEN -- RECEIVED ANY EXPERT OPINION, THAT SHOULD BE DISCLOSED. THE DISCLOSURE SHOULD BE REASONABLY DETAILED SO THAT PERSONS WHO HAVE OPINIONS CONTRARY TO THOSE EXPRESSED IN THE EX PARTE COMMUNICATIONS HAVE REASONABLE OPPORTUNITY TO RESPOND TO THOSE. THANK YOU, MR. CHAIR NEXT THANK YOU. NOW WE WILL GO THROUGH OUR DISCLOSURES.
OMMISSIONER DEAN? >>MR. DEAN: I HAD A PHONE CONVERSATION WITH KAREN TAYLOR, THE APPLICANT'S LAND USE PLANNER CONSULTANT.
SHE AND I DISCUSSED -- SHE OUTLINED TO ME THE STATUS OF THE NEGOTIATIONS AND THE DISCUSSIONS AND THERE SEEM TO BE AGREEMENTS THAT WERE BEING REACHED BETWEEN THE APPLICANT
AND THE HOA. >> THANK YOU COMMISSIONER DEAN.
COMMISSIONER WALDRON. >>MR. WALDRON: I HAD A MEETING ON JANUARY 23, 2020 1 PM WITH MS. KAREN TAYLOR, THE STAFF AND MR. FRANK DEMAREE.
AT THE TIME WE DISCUSSED THE HISTORY THEY HAD WITH SOME DRAINAGE CONTAINING TO THE PROJECT. I GUESS THE GENERAL OUTLAY OF THE PROPERTY AND THEN ON THURSDAY, MARCH 26 AT 12:30 PM I HAD A MEETING WITH KAREN TAYLOR STAFF OF MR. HANK WHETSTONE. THEY SHOWED ME SOME CHANGES, INCREASED BUFFER, AND THEY ALSO MADE A SITE VISIT LAST WEEK I DROVE BY THE LOCATION.
>> I THINK THAT'S IT. >> COMMISSIONER JOHNS?
>> I HAD THE SAME MEETING. REGARDING THE SUBJECT SITE, THE DRAINAGE.
MY CONVERSATIONS WITH SURROUNDING PROPERTY OWNERS AND HOW THEY ADDRESS THE DRAINAGE BUFFERING. BETWEEN PROPERTY VALUES. I HAD A MEETING WITH MS. TAYLOR MR. WHETSTONE ON MARCH 26. I DISCUSSED CHANGES TO THE SITE AND CONVERSATIONS WITH THE SURROUNDING PROPERTY OWNERS AND CHANGES IT INCREASES ON THE PROPERTY BASED ON DISCUSSIONS THEY HAD WITH SURROUNDING PROPERTY OWNERS.
>> ALL RIGHT. ON JANUARY 23 AT 2:00 PM, THENCE 2020.
I MET WITH MS. KAREN TAYLOR. MR. FRANK DEMAREE AND MS. TERESA BISHOP.
WE DISCUSSED THE ZONING REQUEST. WE LOOKED AT THE -- DISCUSSED THE SITE, DISCUSSED WHAT WAS HAPPENING AT THE PRESENT TIME IN REGARDING TO HIS CLEARING AND DISCUSSED ELEVATIONS OF THE PROPERTY. ALSO EXTENSIVELY DISCUSSED OBJECTIONS REGARDING TRAFFIC NOISE DENSITY AND COMPATIBILITY AND DISCUSSED SCREENING AND WHAT WOULD BE DONE TO US ACCOMPLISH TO MAKE THE PROJECT GO.
ON MARCH 26, 2020 AT 1230, I MET WITH MS. KAREN TAYLOR ESTHER HANK WHETSTONE AND MS. ALICE MORSE. WE DISCUSSED THE BOUNDARIES, THE REASONS FOR EXPANSION OF THE BOUNDARY, AND SHE PROVIDED AN EXTENSIVE LIST OF THINGS THAT WE WENT THROUGH PROVIDE THAT FOR THE RECORD. IT WAS HELPFUL TO HAVE THAT AS WELL.
AND HAD A LOT TO DO -- THIS SUMMARY AS VERY THOROUGH. I'LL PROVIDE THAT FOR THE
[00:45:03]
RECORD. >> IF I MAY, ALSO, I DO KNOW DURING ROLL CALL, FOR COMMISSIONER BLOCKER, AS THE BOARD KNOWS, HE IS SERVING A MILITARY ORDERS. HAVING BEEN ON MILITARY ORDERS, THINGS CHANGE.
IF YOU DID HAVE AN OPPORTUNITY TO CALL IN AND PARTICIPATE IN THIS AGENDA ITEM OR SUBSEQUENT, AT THAT TIME JUST TO LET YOU KNOW THAT WOULD HAPPEN AND I WOULD ASK HIM TO DISCLOSE X PARTAKE BEFORE PROCEEDING FURTHER AND JUST MAKE SURE HE IS SUFFICIENTLY AWARE OF THE AGENDA ITEM TO PARTICIPATE. I JUST WANTED TO MENTION COMMISSIONER BLOCKER IS SERVING
I'LL FINISH SOME OF MY EXPERT TODAY AS WELL. I DID HAVE EMAILS IN REGARD TO THE PROJECT THAT ARE ALSO PUBLIC RECORD ALREADY. ONE OF THEM -- ONE OF THE ADJOINING LAND OWNERS DAUGHTERS HAS BEEN CONSISTENTLY ENGAGED THAT'S MS. CHRISTINE BENTLEY.
SOME OF THOSE ARE IN PUBLIC RECORD. MR. JOHN'S.
>> I DID WANT TO MENTION THAT I WOULD DROP BY THIS TIME DOMINIC SITE TO CONDUCT PERSONAL BUSINESS THAT FOR THE PURPOSE OF THIS AGENDA ITEM BUT I WANTED TO -- (INDISCERNIBLE) --
JUSTIN KELLY WAS GROWTH MANAGEMENT. THIS IS AGENDA ITEM NUMBER THREE. THIS IS A REQUEST ON 3.38 ACRES IN A COMMERCIAL NEIGHBORHOOD WITH COMMERCIAL CONDITIONS. THIS ITEM WAS HEARD ON FEBRUARY 4 OF 2020.
DURING THIS MEETING CONCERNS WERE RAISED BY THE NEIGHBORING PROPERTY OWNERS ABOUT INCREASED INTENSITY AND ACTIVITY ON THE PROPERTY. THE BOARD PROPOSED THAT THE APPLICANT MEET WITH THE PROPERTY OWNERS AND DECIDED TO BE CONTINUED AND AT THAT TIME THE MOTION PASSED. ON FEBRUARY 19 THEY MET WITH THE HOA AT THE REQUEST OF THE BOARD AND THEIR LEGAL COUNSEL'S WERE PRESENT AS WELL. FROM THAT MEETING A LIST OF ALLOWED AND EXCLUDE USES WAS AGREED UPON AS WELL AS A 150 FOOT BUFFER ALONG THE -- THE APPLICANT'S MET WITH COUNTY STAFF TO REVIEW THE CONDITIONS. AT THAT TIME ALL PARTIES WERE IN AGREEMENT. PROVIDED IS AN AERIAL MAP OF THE SUBJECT PROPERTY.
JUST NORTH OF STATE ROAD 16 LOCATED IS THE ASHLEY COVE RESIDENTIAL NEIGHBORHOOD.
>> CURRENTLY, THE SUBJECT PROPERTY IS A FUTURE LAND USE AND IT IS COMPRISED OF SEVERAL DIFFERENT ZONING DISTRICTS. THIS REQUEST WOULD ALLOW FOR FLEX WAREHOUSE SPACE.
AS MENTIONED THERE ARE TWO CONDITIONS. THE FIRST IS THE REMOVAL OF HIGH USES AND THE SECOND IS A MINIMUM 150 FOOT BUFFER WITH A STANDARD AROUND THE NORTHERN PROPERTY BOUNDARY. THIS CONDITION WOULD ALLOW FOR THE STORM WATER RETENTION POND TO BE INCLUDED WITHIN THE BUFFER. TO GIVE SOME BACKGROUND INFORMATION AND CONTEXT TO THIS SITE, THE PARCEL THAT IS ZONED R G1 WAS REZONED TO PROVIDE FOR 16 MULTIFAMILY RESIDENTIAL UNITS. THIS PROJECT NEVER COMMENCED.
THE PARTIAL SETTERS OWNED COMMERCIAL OR REZONED TO ALLOW FOR COMMERCIAL BUSINESS AND OFFICE TYPE USES. PROVIDED HERE IS THE SITE PLAN PROPOSED BY THE APPLICANT INTO THE LAYOUT. THE DEVELOPMENT WOULD CONSIST OF SIX WAREHOUSE BUILDINGS EACH 16,000 FEET IN SIZE. THE MAIN ACCESS WOULD BE FROM STRATTON BOULEVARD AND THAT WOULD BE THIS ACCESS RIGHT HERE. THERE IS ALSO -- TO THE NORTH THERE IS A RECORDED EASEMENT THAT IS OWNED BY THE APPLICANT. THAT IS RIGHT HERE AND THAT PROVIDES ACCESS TO TWO RESIDENTIAL HOMES. ALSO YOU CAN SEE THE YELLOW LINE HERE THIS IS THE PROPOSED 150 FOOT BUFFER THAT WOULD BE LOCATED HERE WHERE THE POND IS
[00:50:01]
LOCATED. REVIEW BY STAFF SHOW THAT COMMERCIAL CONSTRUCTION PLANS WERE APPROVED FOR BUILDING NUMBER ONE ON THE PARCELS THAT ARE ZONED CN AND CGD INCLUDED ONE 15,000 SQUARE-FOOT BUILDING AN INFRASTRUCTURE AND YOU CAN SEE IT'S CURRENTLY UNDER CONSTRUCTION. APPROVAL OF THESE PLANS ALLOWED IN CG ONLY IN THE RETENTION POND WAS CONSTRUCTED MEETING ALL THE STANDARDS. PROVIDED HERE IS A TABLE SHOWING THE TYPES OF USE CATEGORIES THAT WOULD BE PERMITTED.AS SUBMITTED CW ZONING WOULD ALLOW FOR THE USES PROPOSED AND IT IS COMPATIBLE FOR FUTURE USE LAND. ALSO ARE A LIST OF CURRENTLY ALLOWED USES EITHER BY RIGHT OR SPECIAL USE ON THE PROPERTY. THESE USES ARE INCLUDED ON THE LIST OF EXCLUDED USES THAT WERE AGREED UPON BY THE APPLICANT AND THE HOA. SO STAFF RECEIVED SEVERAL PHONE CALLS AND EMAILS IN OPPOSITION TO THIS PROPOSED REZONING CONCERNS FOR THE PROXIMITY TO THE RESIDENTIAL AREA. THE POTENTIAL FROM NOISE AND TRAFFIC.
THE STAFF RECEIVED EMAIL CORRESPONDENCE FROM THE HOA AND THEIR LEGAL COUNSEL SUPPORTING THIS REQUEST IN THE AGREED-UPON CONDITIONS. OVERALL, STAFF FINDS THAT THE REQUEST MEETS THE REQUIREMENTS OF THE LAND DEVELOPMENT CODE AND COMPREHENSIVE PLAN AND HAS NO OBJECTION. THE BOARD HAS BEEN PROVIDED WITH FOUR FINDINGS OF FACTS TO RECOMMEND APPROVAL OR DENIAL. THAT INCLUDES THE STAFF PRESENTATION AND WE WILL STAND
BY FOR QUESTIONS OR COMMENTS. >> THANK YOU.
ANY QUESTIONS? >> THE BOARD WILL FIND A RED FOLDER IN REGARD TO THE LETTER THAT WAS SUBMITTED IN THE PRESENTATION THAT WAS IN SUPPORT OF HOA'S COUNSEL. THAT WILL ALSO BE IN THE RECORD.
SEEING MEN WILL MOVE ALONG TO THE APPLICANT. GOOD MORNING.
>> GOOD MORNING. KAREN TAYLOR. 77 SARAH GOSSETT STREET.
AND WITH ME IS HANK WHETSTONE AS WELL AS SCOTT YEOMAN. THEY ARE THE TWO APPLICANTS FOR THE APPLICATION. AND JUSTIN HAS GONE THROUGH IT AND I HAVE MET WITH YOU ALL AND KEPT YOU UP WITH EMAILS AND DIFFERENT THINGS BUT I WILL GO THROUGH IT QUICKLY AND THEN OPEN FOR QUESTIONS. THIS MAP REALLY WAS JUST TO GIVE EVERYBODY A GENERAL IDEA OF WHERE THIS IS LOCATED IN RELATION TO I-95. A LITTLE CLOSER AND IT GIVES YOU THAT -- WHERE IT IS OFF STRATTON BOULEVARD AND HOW THAT RELATES TO STATE ROAD 16.
IT IS A .34 ACRES AND THERE IS -- ARE PERMITTED IMPACTS OF -- ARE PERMITTED IMPACTS OF .20 ACRES FOR JURISDICTIONAL BALANCE. AS JUSTIN SAID IT'S IN THE MIXED-USE DISTRICT FUTURE LAND USE AND THE COMBINATION OF ZONING THAT IT DID HAVE, PLUS THIS DEMONSTRATES THE ZONING AROUND IT WHICH IS IW TO THE EAST, THE PUD, WHICH IS -- THE LAW SAYS THE LOSS TO THE NOX WHICH IS RESIDENTIAL. CG THAT IS UNDEVELOPED TO THE SOUTH AND OR IS THE BALANCE OF THAT. ORIGINALLY, AND WE MENTIONED THIS A FEW TIMES, BUT WE DID PLAN TO ONLY DO A PORTION OF THE SO THAT IT WOULD BUFFER IT.
BUT IT WAS DETERMINED BY STAFF THAT WE NEEDED TO INCLUDE THAT AREA IN ORDER TO SEE RETENTION POND FOR THE MORAN INTENSE USES. IT WAS NOT OKAY WHEN YOU WENT TO THE CW BECAUSE IT ALLOWS FOR INDUSTRIAL USES. THIS SHOWS THE EASEMENT AND IT SHOWS YOU THE DIMENSIONS AND HOW THINGS RELATE IN THE NUMBER OF FEET.
IT ALSO SHOWS THE EASEMENT THAT COMES DOWN IN HEARING SHOWS A PORTION OF THAT EASEMENT THAT WILL DISAPPEAR AS WELL. AND THAT EASEMENT GOES ACROSS.
HE SITE PLAN, JUSTIN SHOWED YOU THAT. IT HAS THAT NEW MAIN ACCESS FROM STRATTON, WHICH IS DOWN IN THE SOUTHERN PORTION. THERE WE GO.
THIS WOULD BE A SECONDARY TYPE ACCESS. AND AGAIN, THAT RETENTION POND THAT IS WELL UNDERWAY AND ALMOST COMPLETED. THE LAYOUT, HE SHOWED YOU THAT,
[00:55:08]
TOO. THE SITE WAS LAID OUT SO THAT THE REAR OF THE BUILDINGS WOULD RELATE TO EITHER OF THE RESIDENTIAL -- WE HAVE RESIDENTIAL HERE IN RESIDENTIAL HERE. SO THAT BUILDING WOULD HAVE ALL THE ACTIVITIES CENTRAL TO THE SITE AND AWAY FROM THAT. IT SHOWS YOU IN THE ACTUAL DISTANCES AND PRETTY CLOSE, BUT NOT QUITE. I SHOWED YOU THIS BEFORE SO I THOUGHT I WOULD INCLUDED AGAIN, JUST TO SHOW THE BUSINESS IN THE SETBACKS. THIS DEMONSTRATES THAT.CHAIRMAN SMITH MENTIONED THE LIST OF THINGS THAT I INCLUDED WHEN I MET WITH YOU ALL.
AND I JUST KIND OF WANTED TO GO THROUGH THAT A LITTLE BIT, THE THINGS THAT WE DID AFTER THE HEARING AND WE DETERMINED AND FOUND OUT THAT THE NEIGHBORS HAD OBJECTIONS.
THERE WAS SOME DISCREPANCY IN THE HOA PERSON THAT WAS RECEIVING APPEARED THERE WAS SOME DISCREPANCY IN WHAT I USED AS THE DIMENSIONS FOR THE ADVERTISING.
SO THAT WAS ALL UPDATED AND REDONE. NEW SIGNAGE AS WELL.
WE DID A LOT OF DIRECT EMAIL CORRESPONDENCE WITH THE NEIGHBORS AND PROVIDED THE MATERIALS AND ANSWERED LOTS OF QUESTIONS. WE DID HAVE A MEETING WITH THE HOMEOWNERS ON FEBRUARY 19 WE USE THE NEW, SPECIAL USE AND USE AND SPECIAL USE TABLE WHICH YOU KNOW NOW IS 10 PAGES LONG. I WENT THROUGH AND CROSSED OUT THOSE USES THAT THEY FELT WERE OBJECTIONABLE. AT THAT TIME, HANK VOLUNTARILY SAID HE WILL INCLUDE THE 150 FOOT BUFFER TO THAT SO THERE'S NO QUESTION IN THE FUTURE THAT SOMEONE MIGHT COME BACK AND FILL IN THE RETENTION POND AND HAVE THAT GO AWAY. WE ALSO AGREED ON THE LANDSCAPING. I WILL SHOW YOU THAT IN A MINUTE.
SO THAT THERE WOULD BE THE SCREENING WOULD BE MORE EFFECTIVE, THE BERM FOR THE RETENTION POND. WE DISCUSSED WITH THEM THE TRAFFIC REDUCTION AND CAME UP WITH A CHART ON THAT, WHICH I WILL ALSO SHOW YOU IN A MINUTE THAT BASICALLY SHOWS THAT THE CW USES WOULD ACTUALLY BE QUITE A BIT LESS THAN THOSE THAT WOULD'VE BEEN ALLOWED IN THE CG AND CM. WE DID MEET WITH STAFF AS JUST MENTIONED IN THE ATTORNEY'S OFFICE AND WENT THROUGH THE LIST AND WENT THROUGH THE TRAFFIC AND ALL OF THE DIFFERENT THINGS ALONG WITH THE HR REPRESENTATIVE. AND THAT'S WHAT WE CAME UP WITH THE LIST, WHICH IS NOW IN YOUR ORDINANCE. THIS IS A LANDSCAPE PLAN.
IT'S A LITTLE HARD TO SEE HERE, BUT INDICATES -- AREA. IT DOES INDICATE THE LANDSCAPING HERE. YOU CAN SEE THIS NECESSARILY HERE, BUT THIS IS THE TOP OF THE BERM AS WELL FOR THE PLAN. SO THE IDEA IS THESE PLANS ALONG HERE ARE GOING TO MOVE UP THE BERM LITTLE BIT AND MATCH THOSE THAT ARE ON THE TOP. THIS BERM WILL STAY THE SAME.
THIS LANDSCAPING, THIS GENTLEMAN DID NOT OBJECT. THIS IS THE TRAFFIC IMPACT STATEMENT THAT WE USE AND I BELIEVE WE GAVE TO YOU ALL AS WELL.
IT JUST KIND OF DEMONSTRATES THE DIFFERENCE BETWEEN THE NUMBER OF TRIPS THAT SOMETHING UNDER CG AND SEE AND ZONING. WE TOOK SOME OF THE THINGS THAT WE COULD PUT THEIR AND GAVE THE TRIPS BASED ON THE IT THAT THE COUNTY USES IN THE WE USE THE SCENARIOS FOR THE CW ZONING INCLUDING LIGHT INDUSTRIAL, AND FACTORING IN BUSINESS PARK TO DEMONSTRATE THAT THERE WOULD BE A LOT LESS TRAFFIC. WE ALSO DID NOT INCLUDE IN THE FIRST SCENARIO THE RESIDENTIAL THAT WAS APPROVED THAT WAS MR. YOUMANS PROPERTY. AND I DID THIS JUST ASA SHORT, LITTLE THING TO REVIEW. ON THE LEFT-HAND SIDE IS THE CODE.
AND IT SHOWS THE STRIKETHROUGH. AND THAT'S WHAT YOU HAVE IN YOUR PACKAGE.
BUT ON THE RIGHT SIDE OF THIS ONE, IT DEMONSTRATES THE NUMBER OF USES THAT HAVE BEEN REDUCED BY THIS, GOING THROUGH THIS WITH EVERYONE AND IT SHOWS YOU THOSE THAT REMAIN IN THE RESIDENTIAL, THOSE THAT REMAIN IN THE HIGH INTENSITY COMMERCIAL SUMMER BY RIGHT IN SUMMER BY SPECIAL USE. WHEN YOU MOVE ALONG THE LIGHT INDUSTRIAL USES, THOSE THAT
[01:00:04]
REMAIN AGAIN IN THE NEIGHBORHOOD PUBLIC SERVICE STATUS SIMILAR WE DID REMOVE SOME THINGS FROM THAT BUT TOTALLY STRUCK THE GENERAL PUBLIC SERVICE AS WELL.WITH THAT, WE FEEL LIKE THIS IS COMPATIBLE WITH THE AREA AND IS COMPATIBLE WITH THE COMMERCIAL TYPE USES. AS WE'VE SAID TO THE WEST AND NORTH THROUGH THE SITE DEVELOPMENT BUFFERS, THERE IS INDUSTRIAL TO THE EAST AND THERE IS CG ZONING TO THE SOUTH. WE ALSO FEEL THAT THE CHANGES IN THE USES MAKE THEM MORE COMPATIBLE AS WELL. IT'S SIMILAR TO OTHER INTENSITIES IN THE AREA AND AS WE MENTIONED BEFORE, THIS IS THE HYBRID ZONING THAT YOU OFFER, THAT GIVES PEOPLE THAT FLEX SPACE TO KIND OF GO THROUGH SOME COMMERCIAL TYPE USES THAT ALLOW FOR THOSE LIGHT INDUSTRIAL USES. THE BUFFERS AND SETBACKS WILL CONFORM TO THE LAND DEVELOPMENT CODE ALONG WITH THAT 150 FOOT BUILDING SETBACK, WHICH IS NOW IN YOUR ORDINANCE AS WELL.
WE HAVE DEMONSTRATED THAT THERE IS A REDUCTION IN TRAFFIC. WITH THAT, WE FEEL THAT THE PROPERTY IS COMPATIBLE AND IT IS CONSISTENT WITH THE GOALS, POLICIES AND OBJECTIVES OF THE COMPLIMENTS CONSISTED WITH THE REQUIREMENTS OF THE LAND DEVELOPMENT CODE.
IT RECEIVED APPROVAL FROM THE PDA AND WE FELT LIKE WE HAVE RESOLVED THE ISSUES WITH THE ADJACENT NEIGHBORS THAT WE HAVE BEEN ABLE TO CONTACT AND HAVE CONTACTED US.
WITH THAT, WE WOULD REQUEST APPROVAL AND I AM HAPPY TO ANSWER ANY QUESTIONS.
>> ANY QUESTIONS? >> THANK YOU.
WITH THAT WE WILL OPEN UP FOR PUBLIC COMMENT.
>> PUBLIC COMMENT ON AGENDA ITEM NUMBER THREE. GOOD MORNING.
>> GOOD MORNING. MY NAME IS SCOTT YEOMAN. THIS IS MY BUSINESS PARTNER.
WE JUST WANT TO BRIEFLY SAY THAT WE ARE ADJACENT LANDOWNERS TO THE PROPERTY IN QUESTION.
AND THAT MY WIFE AND I HAVE OWNED IT FOR BACK ABOUT 20 YEARS AGO IN THE WE FORMED OUR COMPANY, THE COMPANY BOUGHT IT FROM MY WIFE AND DIED. WE'VE BEEN AROUND A LONG TIME BUT WE JUST WANTED TO SHOW THAT WE ARE IN SUPPORT OF THIS AND HAVE NO ISSUES WITH THE CONDITIONS THAT WERE CHANGED ON THE REZONING.
>> THANK YOU VERY MUCH. >> ANY OTHER PUBLIC COMMENTS?
>> MR. CHAIRMAN, I DON'T SEE ANY.
>> ALL WAIT A MOMENT TO MAKE SURE. WAS NO MORE PUBLIC COMMENT, WE WILL CLOSE PUBLIC COMMENT AND I WILL GIVE OPPORTUNITY FOR COMMISSIONER DEAN.
>> THANK YOU. I WOULD LIKE TO MAKE A MOTION TO APPROVE ITEM 3, MOTION TO ENACT ORDINANCE 2020 Ã17, OUR REQUEST TO REZONE APPROXIMATELY 8.34 ACRES OF LAND TO COMMERCIAL WAREHOUSE WITH CONDITIONS BASED ON THE FOUR FINDINGS OF FACT AS PROVIDED IN
STAFF REPORT. >> I HAVE A MOTION AND A SECOND . ANY DISCUSSION?
>> SEEING NONE, PLEASE VOTE. IT PASSES 4-0.
>> MAY I COMMENT? >> YES, SIR.
>> I WOULD LIKE TO THINK THAT ONLY THE APPLICANT BUT ALL THE HOMEOWNERS WHO HAVE WORKED DILIGENTLY IN THE PAST SEVERAL MONTHS TO REACH AN AGREEMENT WHICH APPEARS TO, I THINK, RESOLVED WHAT STARTED OUT TO BE A PRICKLY PROBLEM. AND I GUESS THE LAST SENTENCE IN THE STORY MIGHT BE THAT GOOD BUFFERS MIGHT MAKE GOOD NEIGHBORS.
>> ALL RIGHT. WE HAVE NEXT ON OUR AGENDA A TIME CERTAIN, NO EARLIER THAN NO EARLIER THAN 10:30 AM. IN FACT, WE HAVE ABOUT 56 MINUTES.
SO LET'S DO -- I WAS A LITTLE OFF ON MY ESTIMATION. WITH THAT BEING SAID, LET'S GO AHEAD AND CONDUCT ANY OTHER BUSINESS THAT NEEDS TO COME BEFORE THIS BOARD.
[Reports]
SO WHAT WE WILL DO IS WE WILL SKIP AGENDA ITEM NUMBER FOUR AND WE WILL COME BACK TO IT AT 10:30 AM. LET'S GO AHEAD AND DO ANY COMMISSION REPORTS IF ANYBODY HAS ANYTHING. COMMISSIONER DEAN?[01:05:04]
>>MR. DEAN: I WANT TO SPEND A MINUTE OR TWO -- OR LESS (LAUGHING) -- ON REFLECTING ON THE EXTREME ECONOMIC DAMAGE THAT HAS OCCURRED LOCALLY WITH THE IMPACT OF THE CORONAVIRUS AND PARTICULARLY, THE TOURISM INDUSTRY. AND DOES SOME OF YOU MAY KNOW I SERVE ON THE TCV BOARD. COMMISSIONER WALDRON SERVES ON THE BOARD AND I THINK THAT REFLECTS, TOGETHER, A LARGE GROUP OR GROUPS OF DIFFERENT BUSINESSMEN AND WOMEN WHO HAVE BEEN TRAGICALLY IMPACTED OVER THE LAST 6 TO 8 WEEKS. IT'S SCARY, REALLY.
I'VE BEEN IN TOUCH WITH A NUMBER OF LOCAL BUSINESSMEN AND WOMEN WHO HAVE CONTACTED ME ABOUT JUST THE UNCERTAINTY THAT WE ALL FACE AND PARTICULARLY, THE BUSINESS COMMUNITY.
AND I WOULD LIKE TO SUGGEST OR RECOMMEND, MR. CHAIRMAN, GU, THAT WE CONSIDER A PLACEHOLDER POSSIBLY FOR NEXT TUESDAY AT THE EARLIEST, THE TDC, AS I UNDERSTAND IT MEETS MONDAY,
THEY MAY HAVE SOME ADDITIONAL SUGGESTIONS OR COMMENTS. I CAN TELL YOU THAT I THINK -- IN MY OPINION, I THINK WE, THE COMMISSION, MAY NEED TO TAKE ACTION TO ASSIST OUR TOURIST COMMUNITY, TOURISM COMMUNITY TO DO SOME -- EITHER MARKETING OR ADVERTISING.
THE FACT THAT WE WANT TO BE -- AT SOME POINT IN THE NEAR FUTURE, I HOPE, OPEN FOR BUSINESS, WE HAVE TO GET OUR TOURISM INDUSTRY BACK ON ITS FEET.
RIGHT NOW IT IS FLAT. I WOULD LIKE TO SUGGEST THAT WE START WITH A PLACEHOLDER NEXT TUESDAY WHERE WE CAN DISCUSS WITH THE POSSIBILITY OF TAKING ACTION THEN OR IN THE FUTURE.
AND I THINK THAT IS THE ONLY COMMENT I HAVE THIS MORNING.
>> WE WILL DO THAT. FOR A RED FOLDER COMING FORTH ESPECIALLY AFTER TDC MEETS ON MONDAY. THANK YOU COMMISSIONER DEAN, WELCOME BACK.
>> COMMISSIONER WALDRON? >>MR. WALDRON: I JUST HAD A QUESTION IF WE COULD GET STAFF TO LOOK INTO -- I'VE RECEIVED SOME PHONE CALLS ABOUT WE'VE HAD CANCELLATIONS, REFUNDS NOT COMING WITHIN TICKETMASTER. IF WE COULD LOOK INTO THAT.
MY CONCERNS -- WE PROBABLY OF A CONTRACT. .
IF THIS IS HOW THEY'RE GOING TO TREAT OUR CUSTOMERS IN THIS TIME YOU NEED BY NOT GIVING THE REFUNDS TO THEM PROMPTLY, THEN MAYBE WE NEED TO READDRESS THEIR CONTRACT.
>> I CAN HAVE THEM LOOK INTO IT. AND DO YOU HAVE A LIST OF ANYBODY THAT'S PROVIDED INFORMATION.
>> NO. APPARENTLY FROM WHAT I READ IT'S OTHER ARTICLES ON TICKETMASTER THEY'VE NOT REFUNDED.
>> WILL CHECK WITH THE STATUS. >> NOT JUST OURS BUT OTHERS.
MAKE SURE THAT EVERYBODY IS GETTING -- I KNOW IS CAN HAVE AND ARE GOING TO PUT THE BLAME ON THE COUNTY. IT'S NOT OUR FAULT.
>> I WANT TO AGAIN, THANK -- WE MAY WELL HAVE COMMENTS BUT THINK OUR RESIDENTS WERE BEING VERY PATIENT, THE MAJORITY OF THEM. THERE ARE A FEW THAT HAVEN'T.
STILL USE GOOD SOCIAL GUIDANCE AND THE GUIDELINES TO TRY TO STAY POSITIVE IN YOUR OUTLOOK, TOO. YOU READ THESE HORROR STORIES ABOUT BUSINESSES OPENING AND THE PATRON ARE GETTING UPSET BECAUSE THEY CAN GET SERVED FAST ENOUGH FOR -- BUSINESSES ARE IN A NEW ERA OF TRYING TO FIGURE OUT HOW TO MANAGE IT ONLY 25 PERCENT.
GIVE EVERYBODY A BREAK. TREAT THEM LIKE YOUR FAMILY A LITTLE BIT.
BE NICE AND COURTEOUS TO THEM BECAUSE THEY ARE STRUGGLING ALSO.
AFTER STRUGGLING PROBABLY WORSE THAN US ESPECIALLY PEOPLE THAT ARE RETIRED AND HAVE INCOME COMING REGARDLESS AND HAVE THEM WORKING THROUGH THIS. BUT I ALSO WANT TO THANK THE STAFF ARE WORKING DILIGENTLY TO THE VIRUS SO FAR AND THE TOWN IS FILLING UP.
TRAFFIC IS GETTING WORSE. 95 IS BUMPER-TO-BUMPER AGAIN. A LOT OF SEMI'S HAULING PRODUCT BACK AND FORTH WHICH IS GOOD. HOPEFULLY THE FARMERS ARE -- HOPEFULLY THAT'S PICKED UP.
BUT BE CORDIAL TO EACH OTHER AND WE WILL GET THROUGH THIS. HOPEFULLY LESS UNSCATHED THAN
[01:10:11]
WE ARE NOW. THANK YOU.>> COMMISSIONER JOHN SKI. >> THANK YOU.
>> I WANT TO WELCOME BACK COMMISSIONER DEAN. I LIKE THE HAIRSTYLE.
A LITTLE BIT. >> THE LONG HAIR LOOK, IT'S
GROWN ON YOU. >> (INDISCERNIBLE).
>> (LAUGHING). >> IT SEEMS LIKE YOU BOTH HAVE
SHORT HAIRCUTS. >> I'D BE GLAD TO ACCOMMODATE
YOU (LAUGHING). >> I'M PROUD TO SAY MY WIFE TRIM JUST THE EDGES. I DO WANT TO WELCOME YOU BACK. THE REST OF THE COMMISSIONERS PRAYING FOR COMMISSIONER BLOGGERS SAFETY. WE THANK HIM FOR HIS SERVICE TO OUR COUNTRY. HE'S GOT A LOT ON HIS PLATE I'M SURE.
I ALSO WANT TO THANK OUR RESIDENTS FOR SAFELY CONDUCTING THEMSELVES.
THAT EXTRA PATIENCE AS YOU MENTIONED, THE CONSIDERATION. IT REALLY WARMS MY HEART TO LIVE IN A COUNTY WHERE PEOPLE DO THAT IN TIMES OF STRESS. YOU CAN SEE PEOPLE'S CHARACTER
IN TIMES LIKE THIS. >> I WANT TO THANK THE STAFF FOR EVERYTHING YOU DO TO PREPARE THE MEETINGS. THIS DOES NOT HAPPEN BY ITSELF.
IT TAKES A LOT OF PEOPLE COMMUNICATING IN WAYS IN ORDER TO MAKE THIS GO AS SMOOTHLY AS IT DOES SO WE CAN CONDUCT BUSINESS WORDS ESSENTIAL. THIS BUILDING WAS NOT DESIGNED OR BUILT FOR TWO-WAY COMMUNICATION. HOW YOU MANAGED TO DO THAT IS
FASCINATING AND APPRECIATED. >> I THINK THE STAFF FOR PUTTING TOGETHER THE GRANTS THAT ARE AVAILABLE.
>> COORDINATING -- I TALKED WITH THE CITY AND I KNOW THESE ARE GREATLY NEEDED CBGB FUNDS THAT ARE BECOMING AVAILABLE. THERE ARE A LOT OF THINGS GOING ON THAT ARE HELPING PEOPLE TO ADAPT AND TO MEET THEIR NEEDS AND I DO NOT WANT THEM BRINGING UP JUST AS A MATTER OF BUSINESS, BUT THIS IS WHERE THE RUBBER MEETS THE ROAD. THIS IS WHERE A LOCAL GOVERNMENT BEST SERVES ITS LOCAL COMMUNITY. WE HAVE THAT ABILITY BECAUSE WE HAVE THE STAFF AND THE COLLABORATION TO CHANGE QUICKLY TO ADAPT TO MEET THE NEEDS THAT GOVERNMENT IS NOT KNOWN FOR MOVING QUICKLY, BUT THIS IS AN EXCEPTION.
I WANT TO POINT THAT OUT TO OUR LISTENERS, IT IS NOT EASY TO DO THINGS IN THE SUNSHINE LAW, TRANSPARENTLY, LEGALLY, AND EXPEDITIOUSLY. BUT YOU ARE DOING IT EFFECTIVELY I WANT TO THANK YOU ALL FOR THAT.
>> THANK YOU. I WASN'T GOING TO GIVE A REPORT SO THAT'S WHAT I'M TRYING TO CATCH UP SEEING I WAS PUTTING ON THE SPOT. BUT NONETHELESS, JUST FROM A FOOD FOR THOUGHT POTATO HARVEST IS GOING ON. POTATO PRICES ARE STRONG AND LIKEWISE MOVEMENT IS GOOD. PEOPLE ARE EATING AT HOME AND THAT COMMODITY FOUND A STRONG PLACE IN THE MARKETPLACE TODAY. OTHER CROPS ARE WRAPPED UP ALL YOUR LEAFY GREENS, AND THE COVERED CROP FIELD CORN LOOKS ROUGH. WE'VE BEEN A LITTLE ON THE DRIVE SIDE ON THE SOUTHERN END OF THE COUNTY. THIS WEEK AND WE DID HAVE A RESPITE FROM THE DROUGHT WHICH WAS WELCOMED. THE OTHER NEWS THAT I DO HAVE IS DOCTORING GOAL HAS BEEN RECENTLY HIRED BY THE UNIVERSITY OF FLORIDA AS VICE PRESIDENT TO TAKE THE PLACE OF DOCTORS JACK PAYNE. HE IS CHARGED IN THE INSTITUTE OF FOOD AND AGRICULTURAL SCIENCES THERE. HE COMES ON THE USDA VIA A LONG LIST OF OTHER INSTITUTIONS THAT HE SERVED WITH HIS UNIVERSITY OF GEORGIA NOT TOO LONG AGO.
ONE THING I DO WANT TO NOTE IS THAT THAT POSITION IS NOW A VICE PRESIDENT.
IT IS NO LONGER A SENIOR VICE PRESIDENT POSITION AT THE UNIVERSITY OF FLORIDA, WHICH IS A BIG DIFFERENCE. WITH THAT, WE WILL MOVE ALONG TO ADMINISTRATION.
>> GOOD MORNING. TWO THINGS TO BRING BEFORE THE BOARD THIS MORNING.
AS EACH OF YOU KNOW IS TURMAC ROBERSON HAS BEEN SERVING AS THE INTERIM GROWTH MANAGEMENT DIRECTOR SINCE AUGUST OF LAST YEAR AND APPROXIMATE LAST NINE MONTHS.
[01:15:03]
APPROXIMATELY FIVE OF THOSE MONTHS I'VE HAD THE OPPORTUNITY TO SERVE BESIDE HIM ALWAYS IN THAT CAPACITY. HE'S DONE A FANTASTIC JOB. HE HAS GOTTEN YES EVERY TIME I ASKED HIM. HE WORKS HARD. HE HAS MANAGED TO DO WITH LESS STAFF. HE'S NOT HAD AN ASSISTANT DIRECTOR HE'S ALSO NOW DOWN A SENIOR SUPERVISING PLANNER WITH THE DEPARTURE OF MS. FRAZIER. HE'S CARRIED A HEAVY LOAD HE'S DONE IT WELL AND WITH A GOOD ATTITUDE. AS EACH OF YOU HAVE HAD THE OPPORTUNITY TO SEE HIM IN YOUR INDIVIDUAL BRIEFINGS AND OCCASIONALLY WHAT IS BEFORE THE BOARD, HE IS ADEQUATELY PREPARED. HE HAS BEEN IN THE GROWTH MANAGEMENT DEPARTMENT FOR THE PAST SEVERAL YEARS AND PRIOR TO THAT, HE SERVED IN THE AIR FORCE AS AN OFFICER. I WOULD LIKE TO PRESENT THEM TO YOU ALL THIS MORNING FOR RATIFICATION FOR THAT PERMANENT SPOT OF GROWTH MANAGEMENT DIRECTOR.>> ANY COMMENTS OR QUESTIONS DISCUSSION? COMMISSIONER DEAN?
>>MR. DEAN: I'VE HAD THE OPPORTUNITY TO WORK CLOSELY WITH MR. ROBERSON OVER THE LAST NINE MONTHS IN HIS INTERIM AND BEFORE THAT AS HIS ASSISTANT ROLE.
I THINK THAT HE IS -- HE HAS DONE AN OUTSTANDING JOB. THE THING THAT IMPRESSED ME IS THAT -- I ALWAYS LIKE A QUICK RESPONSE, EVEN IF IT'S A NO. A QUICK RESPONSE TO ME IS IMPORTANT IN GOVERNMENT BECAUSE SOMETIMES IT'S RARE. SO HE HAS ALWAYS BEEN VERY RESPONSIBLE IN QUICKEN ANSWERING MY QUESTIONS ON BEHALF OF THE CONSTITUENTS.
I'M A BIG FAN. >> THANK YOU, COMMISSIONER.
MR. JONES. >> HE'S THE RIGHT MAN FOR THE JOB. HE'S DOING A GOOD JOB. I LOOK FORWARD TO THE PERMANENCY. COMMISSIONER WALDRON?
>> I'D LIKE TO THANK MICHAEL FOR HIS QUICK RESPONSES IN DEALING WITH -- IT'S GOT TO BE HARD DEALING WITH FIVE DIFFERENT OF US ADMINISTRATION. AND HE'S ALWAYS BEEN REALLY ATTENTIVE TO THE NEEDS AND LOOKED AT IT WITH DIFFERENT ANGLES AND I APPRECIATE THAT QUICK AND DECISIVE ANSWERS. WE MAY NOT LIKE THE ANSWER, BUT WE GOT AN ANSWER.
AND APPRECIATE THE ACKNOWLEDGMENT. THIS IS FOR THE ENTIRE STAFF.
I'LL SAY I GET ANSWERS BACK SOMETIMES 10 O'CLOCK AT NIGHT. ON THE WEEKENDS, I DON'T EXPECT THAT. IF IT'S IMPORTANT TO CALL YOU, BUT IT CAN WAIT UNTIL MONDAY MORNING. YOU HAVE FAMILIES, DO BUT MIKE IS BEEN ATTENTIVE AND I
WE NEED TO TAKE PUBLIC COMMENT ON THIS?
>> YES. MR. CHAIR, AS A REMINDER, THERE IS A STATUTORY REQUIREMENT FOR THE -- THAT THEY GO THROUGH THE DEPARTMENT HEADS. THE BOARD SHOULD TAKE PUBLIC
COMMENT ON THIS. >> COMMISSIONER WALDRON?
>> WE WILL NOW HAVE PUBLIC COMMENT ON ACCEPTING UNCLE ROBERSON AS MANAGEMENT
DIRECTOR. >> MR. CHAIRMAN, ZERO PUBLIC
COMMENT. >> WE ARE BACK TO THE BOARD?
>> ENTERTAIN A MOTION? I WILL MOVE TO RATIFY OR CONFIRM HIS APPOINTMENT AS
GROWTH MANAGEMENT DIRECTOR. >> AGAIN.
I HAVE A MOTION AND SECOND. ALL IN FAVOR, SIGNIFIED BY SAYING I.
>> OPPOSED A. >> MR. ROBERSON CONGRATULATIONS. THANK YOU FOR YOUR WILLINGNESS TO DO THAT.
ALL RIGHT, ADMINISTRATION. >> THANK YOU MR. JEREMIAD QUICKLY ON THAT AS YOU ALL KNOW OTHER THAN MR. BRADLEY, WELL PRESENTED FOR YOU MR. ROBERSON IS THE FIRST DIRECTOR THAT HAVE HAD THE OPPORTUNITY PRESENT BEFORE YOU WANT TO TELL HIM HOW MUCH I APPRECIATED I TOLD HIM THAT PUBLICLY BUT I WANTED SAY IT PUBLICLY AS WELL.
HOPEFULLY IT'S A PLEASURE FOR MANY YEARS. THANK YOU.
THE SECOND PART TO THAT, I DO NOT BELIEVE THIS NEEDS RATIFICATION BUT I WANTED YOU PRESENTED TO YOU AND MR. MCCORMICK YOU WANT TO WEIGH IN IF I'M MISTAKEN.
AS PART OF SOME OF THE CHANGES TODAY WE ARE ALSO PREPARED TO MOVE BUILDING SERVICES OUT FROM UNDERNEATH GROWTH MANAGEMENT. AT THIS TIME THEY WOULD BE A DIRECT REPORT TO THE ASSISTANT COUNTY ADMINISTRATOR, MR. BRADLEY. SO THAT WOULD BE -- IT DOESN'T CHANGE ANYTHING LOGISTICALLY DOESN'T CHANGE ANYTHING FOR THE PUBLIC.
THE PUBLIC STILL RECEIVES ALL THE SAME SERVICES IN THE PERMANENT CENTER GROWTH MANAGEMENT AND BUILDING SERVICES WHICH TO WORK SIDE-BY-SIDE AND HANDED HAND BUT WE WOULD LIKE TO PRESENT THE FOR THE BOARD IF THEY WANTED TO BE ANY PUBLIC
DISCUSSION ON THAT. >>CHAIRMAN SMITH: ANY PUBLIC DISCUSSION CONCERNS FROM THE BOARD? SEE NONE --
>> I WAS GONNA SAY, I DON'T KNOW THAT THAT REQUIRES BOARD CERTIFICATION.
[01:20:14]
I THINK WE WERE QUICK ON THAT. IT PROBABLY WOULD NOT HURT JUST TO DO THAT.I DON'T KNOW THAT IT'S REQUIRED. IT WOULD TAKE ME A FEW MINUTES TO SEE UNDER THE STATUTE WHETHER SOMETHING WOULD BE REQUIRED.
SO I THINK YOU COULD JUST DO IT AND RATIFY IT.
>> ALREADY. WE WILL TAKE PUBLIC COMMENT ON THAT.
COMMISSIONER WALDRON? >> I WILL TAKE PUBLIC COMMENT ON SEPARATING THE BUILDING -- MR. CHAIRMAN I SEE NO PUBLIC COMMENT.
>> I WILL ENTERTAIN A MOTION. >> I WILL MOVE TO RATIFY AND CONFIRM THE MOVE OF THE HEAD OF THE BUILDING DEPARTMENT TO REPORT DIRECTLY TO THE ASSISTANT COUNTY ADMINISTRATOR RATHER THAN TO THE GROWTH MANAGEMENT DIRECTOR.
>> SECOND. >> I HAVE A MOTION AND A SECOND. ANY DISCUSSION?
>> SEE NONE, ALL IN FAVOR SIGNIFY BY SAYING AYE THE MOTION CARRIES.
>> THANK YOU. ONE MORE THING TO PRESENT FOR DISCUSSION, AFTER WE MOVE THROUGH THE COVERED PROCESS, WE NOTICED THAT THERE ARE A LOT OF GRANT REQUESTS THAT REQUIRE EXPEDITIOUS TIME FILING. WHAT WE WOULD LIKE TO PRESENT THIS MORNING FOR CONSIDERATION NEEDED TO BEGIN DISCUSSING FOR US TO HAVE THE OPPORTUNITY TO BRING BACK TO YOUR RESOLUTION IN SOME FORM OR CAPACITY THAT WOULD ALLOW ADMINISTRATION TO PURSUE GRANTS WITHOUT BOARD APPROVAL. NOW THE CAVEAT TO THAT IS THAT WOULD NOT CHANGE IF THERE IS APPROVAL, IF THE GRANTS ARE AWARDED, THE BOARD WOULD STILL HAVE THE OPPORTUNITY TO SAY NO, WE DO NOT WANT TO ACCEPT THE FUNDS. AS YOU ALL KNOW EACH AND EVERY DOLLAR THAT COMES TO THE COUNTY MUST BE APPROVED THROUGH YOU ALL APPROPRIATED TO THE BOARD AND AT THE OTHER FUNDS. I'D LIKE TO BRING IT UP FOR DISCUSSION.
THE PURPOSE OF THAT SPECIFICALLY -- WE CAN DO THAT FOR A SPECIFIC TIME PERIOD WEATHERBY 60 DAYS, SIX MONTHS ONE YEAR,. IT'S BASICALLY SO WE CAN MOVE ON SOME OF THESE GRANTS THAT HAVE QUICK DEADLINES. WE NOTICED A NUMBER OF THEM DURING THE COVERED PROCESS. I JUST WANTED TO BRING THAT TO THE BOARD FOR DISCUSSION AND I WILL STAND BY AWAITING YOUR RESPONSE.
>> COULD YOU RAISEADDRESS THE STAFFING ISSUE.
>> YES, SIR. THANK YOU. ADDITIONALLY, WE HAVE -- BASED ON LAST YEAR'S STAFFING REQUESTS, THERE WAS A POSITION ALLOCATED FOR THIS BOARD FOR A GRANT DEVELOPMENT MANAGER. THAT POSITION IS POSTED. IT WOULD ALLOW THAT PERSON AS WELL AS WORKING WITH OTHER COUNTY DEPARTMENTS -- AS EACH OF YOU KNOW THERE ARE A NUMBER OF GRANTS THAT WE PURSUE EVERY YEAR THEY COME BEFORE THIS BOARD.
THEY WOULD ALLOW THAT PERSON TO GO AND PURSUE GRANTS ON BEHALF OF THE COUNTY WITHOUT HAVING TO GET BOARD APPROVAL FOR EACH AND EVERY TIME. ESSENTIALLY IT WOULD ALLOW THAT PERSON TO DO THAT JOB UNENCUMBERED. THERE WOULD STILL BE THE CHECK AND BALANCE BECAUSE THOSE FUNDS WOULD NOT BE APPROPRIATED OR TECHNICALLY RECEIVED UNTIL THE BOARD APPROVED IT. THERE'S STILL THAT CHECK AND BALANCE.
STAFF WOULD NEVER PUT THE BOARD IN THE POSITION OF ACQUIRING FUNDS THAT WAS NOT IN THE BEST INTEREST OF THE BOARD OF THE COUNTY.
>>CHAIRMAN SMITH: ANY DISCUSSION?
>> THANK YOU MR. CHAIR. WOULD THAT INCLUDE GRANTS THAT REQUIRE COUNTY OR STATE OBLIGATION OF PURCHASER PATIENT.
>> YES, SIR. IT WOULD INCLUDE THE ABILITY TO PURSUE ANY AND ALL GRANTS THAT WERE REQUIRE ANY -- IT WOULD ALLOW US TO PURSUE THEM BUT IT WOULD REQUIRE BOARD
COMMISSIONER DEAN? >> WELL COMMISSIONER JONES ASKED THE QUESTION. I'D LIKE TO MAKE SURE THAT WE ARE NOT COMMITTING THE COUNTY TO A MATCH THAT WE HAVE NOT BEEN BRIEFED ON AN APPROVED IF THAT'S POSSIBLE.
I DO NOT HAVE A PROBLEM GOING FORWARD PURSUING GRANTS. BUT THERE NEEDS TO BE, IN MY OPINION SME KIND OF CAVEAT TO THE GRANTING AGENCY FOR ANY MATCHED FUNDS WOULD BE SUBJECT TO COURT APPROVAL -- IF THAT MAKES IT WILL ONLY MATCH -- BUT ANY CONDITIONS -- WE CAN LOOK AT THAT IN A RESOLUTION AS WELL, BUT ANY KIND OF CONDITIONS THAT MAY BE -- NEED OVERSIGHT THAT'S FOR CERTAIN. COMMISSIONER JOHNS?
>> THANK YOU. I WOULD LIKE TO HAVE AT SOME POINT WHEN IT'S AVAILABLE A BRIEFING ON THE PRIORITIZATION OF SEARCHING FOR GRANTS. MATTER HOW MANY GREAT WRITERS YOU HAVE THERE'S MORE GRANTS AVAILABLE TO RESEARCH, THAT, DETERMINE THE CAPABILITY OR SO.
THAT WILL HAVE THE MANPOWER. TO UNDERSTAND WHAT IS THE FOCUS.
[01:25:05]
SIX MONTHS, 12 MONTHS, ONE MONTH OR THE GRANT THAT WOULD BE PURSUED THE GENERAL TOPICS WOULD BE BENEFICIAL TO. I HAVE NO CONCERNS WITH SOMEBODY PURSUING GRANTS.I JUST WANT TO MAKE SURE THAT BEFORE WE SET THEM FREE THEY'RE GOING IN A DIRECTION MOST BENEFICIAL TO THE COUNTY AND THAT WE HAVE AN UNDERSTANDING OF THE GENERAL THEME, FOCUS, WHATEVER YOU WANT TO CALL FOR THAT TIME PERIOD. AS WE SEE WITH THE VIRUS IT CHANGES OUR PRIORITIES QUICKLY. WITH LIMITED RESOURCES I WANT TO MAKE SURE THAT THEY -- IS NOT REQUESTED OF DOWN CAPABILITY OR COMPETENCE I JUST WANT TO BE ABLE TO TELL PEOPLE WHAT WE ARE PURSUING IN BROAD TERMS NOT GRANTED BY GRANT. I FEEL SOMEONE CAN PURSUE IT WITHOUT ONE BY ONE APPROVAL I JUST WANT TO UNDERSTAND FOR ANY PHYSICAL PERIOD OR WHAT ARE THEY LOOKING FOR WHAT WOULD BE APPLICABLE IN THE BENEFIT THAT WE ARE HOPING TO ACHIEVE.
>> ANY OTHER DISCUSSION FROM THE BOARD?
>> SO WITH THAT, MR. CHAIR, WE WILL GO BACK AND WE WILL LOOK AT SOME OF THOSE CONDITIONS AS OUTLINED BY COMMISSIONER DEAN AND COMMISSIONER JONES ON THE MATCHING PORTION OF THAT AS WELL AS WILL LOOK AT WHERE THE PRIORITIZATION WILL BE. WE WILL BRING BACK ANOTHER PROPOSAL TO YOU BEFORE WE GET TO A POTENTIAL ORDINANCE THAT WAY THERE COULD BE ANOTHER LAYER OF DISCUSSION. WILL HAVE THE BACK TO THE NEXT WEEK OR TWO.
>> KNOW THAT'S ALL. >> COUNTY ATTORNEY?
>> MR. CHAIR, OTHER THAN TO CONGRATULATE, NO FURTHER REPORT, THANK YOU.
>> THANK YOU. WITH THAT BEING SAID, WE ARE HEREBY RECESSED UNTIL 10:30 PM AMEN
[Item 4]
>>CHAIRMAN SMITH: WE WILL NOW RECONVENE. WE ARE ON ITEM NUMBER FOUR.
IT IS IT IS 10:30 AM. WOULD YOU LIKE TO START US OFF?
>> THANK YOU. I'M GOING TO READ THROUGH SOME ITEMS. THERE HAS BEEN A REQUEST FOR THIS MEETING TO BE DELAYED. I WILL READ THAT REQUEST.
I'D LIKE TO GO THROUGH SOME SORT OF BACKGROUND INFORMATION SUCH AS NOTICE.
AND THEN, IT WILL COME BACK TO THE BOARD. AND SO, THE FIRST ISSUE TO BE TREATED WILL BE THIS ISSUE ABOUT REQUEST FOR DELAY. SHOULD THE BOARD GRANT THAT, THAT IT WOULD BE RE-NOTICED AND RESCHEDULED ETC. SHOULD THE BOARD NOT APPROVE THAT, THEN THE ITEM WILL ROLL INTO THE PUBLIC HEARING STARTING WITH EXPLORATORY COMMUNICATIONS, DISCLOSURE OF, AND THEN ROLLING IN AS PART OF YOUR NORMAL PROCEDURE.
SO IF I MAY, MR. CHAIR, THERE HAD BEEN A REQUEST MADE. PLEASE ALLOW THIS EMAIL TO SERVICE MY FORMAL REQUEST. THIS IS FROM MR. CAROL, WAS A PRINCIPAL APPELLANT.
PLEASE ALLOW THIS EMAIL TO SERVICE MY FORMAL REQUEST TO DELAY OUR APPEALS OF THE ZONING AND NON-ZONING VARIANCES UNTIL REGULAR MEETINGS ARE HELD AGAIN, WHICH WILL ALLOW THE APPEALS TO BE HELD IN AN OPEN AND PUBLIC. SO THAT SOME OF THE HUNDREDS OF PUNTER FEATURE REGIONS, RESIDENTS WERE OPPOSED HAVE A CHANCE TO HAVE THEIR VOICES HEARD. I AND THE HUNDREDS OF PUNTER FEATURE RESIDENTS WHO ARE OPPOSED TO THE VARIANCES WISH THAT THESE HEARINGS BE DELAYED UNTIL REGULAR MEETINGS NOT HELD BY CMT RESUME. PLEASE CONFIRM THAT THIS REQUEST HAS BEEN RECEIVED AND PLEASE LET US KNOW IF YOU NEED TO CONTACT -- IF WE NEED TO CONTACT THE COUNTY ATTORNEY.
ND SO, THIS REQUEST WAS ACKNOWLEDGED. I WOULD NOTE, HE DOES TALK ABOUT THE APPEALS THROUGH ZONING AND NON-ZONING VARIANCES WHICH ARE PART OF THIS AGENDA ITEM. THERE IS ALSO AN ARC APPEAL. THE WAY I WOULD CONSTRUE THIS REQUEST IS THAT THE ENTIRE AGENDA. SO THAT IS THE REQUEST.
I WOULD LIKE TO GO -- I THINK A LITTLE BIT IN BACKGROUND JUST WITH INFORMATION FOR THE BOARD
[01:30:01]
AND THE APPELLANT IN THE APPLICANT. AND THE LISTENING PUBLIC.AS THIS BOARD IS AWARE AND AS TRICIA BISHOP WILL OUTLINE FURTHER, SHOULD THE MATTER PROCEED, ON JANUARY 29 AND FEBRUARY 4, RESPECTIVELY, THE APPELLANT HERE TIMELY FILED APPEALS TO CERTAIN APPROVAL OF CERTAIN ZONING AND NON-ZONING VARIANCES BY THE PUNTER OF DEIDRE ZONING ADJUSTMENT BOARD AND DESIGN APPROVAL BY THE ARCHITECTURAL REVIEW COMMITTEE.
WITHIN DAYS OF THE RECEIPT OF THE APPEALS, NOTIFICATIONS UNDER THE NEIGHBORHOOD BILL OF RIGHTS WERE SENT OUT ON EACH ADVISING OF THEIR SUBMITTAL THAT A PUBLIC HEARING WOULD BE SCHEDULED IN THE FUTURE. STAFF REVIEWED THE APPEAL APPLICATIONS AND PROVIDED COMMENTS. ONCE THE APPLICATIONS WERE FOUND TO BE COMPLETED, THE APPEALS WERE SET FOR HEARING BEFORE THE BOARD ON APRIL 7, 2020.
NOTICE OF THE APRIL 7 HEARING WAS PUBLISHED IN THE RECORD, TWICE, MAILED TO ADJACENT PROPERTY OWNERS INCLUDING THE APPELLANT TWICE EMAILED VIA THE NEIGHBORHOOD BILL OF RIGHTS NOTIFICATION TWICE AND POSTED AT THE PROPERTY. THE SECOND ROUND OF NOTICES SET OR PUBLISHED AT THE END OF MARCH INCLUDED ALL THE COUNTIES STANDARD LANGUAGE ABOUT HEARING REMOTELY VIA CMT, THAT IS TELEPHONE, VIDEO, ETC., AS THOSE PROCEDURES ARE DESCRIBED IN THE NOTICE AND SUBMITTING MATERIALS ELECTRONICALLY. EMAILS, DIAGRAMS, PICTURES CONSISTENT WITH THE BOARD'S EMERGENCY PROCLAMATION 20 2003. COPIES OF THE PUBLISHED NOTICES ARE ALREADY IN THE RECORD AND COPIES OF THE ADDITIONAL NOTICES WILL BE PROVIDED TO THE CLERK FOR REVIEW AND INSPECTION AS WELL. THE NEIGHBORHOOD BILL OF RIGHTS NOTIFICATION NOTICE OF THE APRIL 7 MEETING AND LINKS TO THE AGENDA ITEM OR POSTED ON THE WEBSITE. ON OR ABOUT APRIL 3. PURSUANT TO THE BOARD'S DIRECTION AT ITS MARCH 31 MEETING, THE APRIL 7 PUBLIC HEARING ON THE APPEALS WAS CONTINUED AND SUBSEQUENTLY SENT BY THE BOARD AT THE MAY 12 SPECIAL MEETING, NOT TO BE HEARD BEFORE 10:30 AM.
AS WITH THE PRIOR HEARING DATE NOTICE OF THIS NEW DATE AND TIME WAS PUBLISHED IN THE SAINT AUGUSTINE RECORD, MAILED TO ADJACENT PROPERTY OWNERS AND EMAILED VIA THE NEIGHBORHOOD BILL OF RIGHTS NOTIFICATION. EACH ONE OF THESE NOTICES INCLUDED THE STANDARD CMT LANGUAGE. AGAIN, THE PUBLISHED NOTICE TO SEND THE RECORD AND COPIES OF THE ADDITIONAL NOTICES WILL BE PROVIDED AS WELL. AS BEFORE THE NEIGHBORHOOD BILL OF RIGHTS AND NOTICE OF THE MAY 12 SPECIAL MEETING, TODAY'S MEETING, AND LINKS TO THE AGENDA ITEM WERE ALSO POSTED A NUMBER OF LOCATIONS ON THE COUNTY'S WEBSITE.
ON THE AFTERNOON OF WEDNESDAY, MAY 6, STAFF ADVISED THE APPELLANT VIA EMAIL THAT HE HAD A RIGHT TO REQUEST THE HEARING BE -- THE APPELLANT RESPONDED EMAIL THAT'S WHEN I READ TO THE BOARD. THAT SAME AFTERNOON, WITH A REQUEST TO DELAY THE HEARING.
UNFORTUNATELY, LATER IN THAT AFTERNOON, STAFF ERRONEOUSLY ADVISED THE APPELLANT APPELLEE AND SOME OTHER MEMBERS OF THE PUBLIC VIA EMAIL THAT THE APPEAL WOULD NOT BE HEARD ON MAY 12. THE FOLLOWING AFTERNOON, THE NEXT DAY, MAY 7, I SENT AN EMAIL TO THE APPELLANT THE APPELLEE AND THE SAME MEMBERS OF THE PUBLIC THAT HAD GOTTEN THE PREVIOUS DAY'S EMAIL CLARIFYING THAT THE ITEM HAD PNOT BEEN CONTINUED OR DELAYED AND THAT THE DECISION TO GRANT THE APPELLANT'S REQUEST WAS IN THE BOARD'S SOLE DISCRETION OF THE MAY 12 SPECIAL MEETING. I FURTHER ADVISE THE PARTIES TO BE PREPARED TO GO FORWARD IF THE REQUEST IS NOT APPROVED. THE CONTENT OF THIS EMAIL WAS ALSO POSTED AT THE COUNTY'S WEBSITE THE FOLLOWING DAY, MAY 8. I HAD FURTHER CORRESPONDENCE WITH THE APPELLANT REGARDING HIS APPEAL AND THE PROPOSED TESTIMONY -- AND PROPOSED TESTIMONY MADE IN MAY 10.
TO CLARIFY FOR THE RECORD, ALL THESE EMAILS WILL ALSO BE INCLUDED IN THE RECORD FOR
[01:35:01]
THESE APPEALS. MR. CHAIR AND BOARD MEMBERS, NORMALLY, THE BOARD HAS VERY WIDE DISCRETION PERTAINING TO CONTINUING AN ITEM. THE GENERAL ROLE IS THAT IT MAY BE CONTINUE -- IT MAY BE CONTINUED FOR AND ANY PUBLIC PURPOSE, SO TO SPEAK.HOWEVER, THIS TYPE OF AGENDA ITEM IS DIFFERENT THAN THE GENERAL AND I WOULD LIKE TO DESCRIBE THAT TO YOU. FIRST OF ALL, IN THE -- IN THE APPEAL TO THE PUNTER FEATURE IS ZONING DISTRICT AND AN ZONING BOARD, DECISIONS, THE PUNTER ZONING DISTRICT REGULATIONS HAS A PROVISION I WOULD LIKE TO SHARE TO THE BOARD, THE APPELLANT, AND THE LISTENING PUBLIC. THAT IS -- I'M READING FROM SECTION 1 OF THE ZONING DISTRICT REGULATIONS. ALL PROVISIONS OF THE ST. JOHNS COUNTY DEVELOPMENT LAND CODE THAT ARE NOT IN CONFLICT WITH THE PROVISIONS OF THE PUNTER FEATURE ZONING SHALL APPLY TO THE PUNTER DEIDRE ZONING DISTRICT. AND IN THE COUNTY'S LAND DEVELOPMENT CODE, THERE IS A PROVISION OF APPEALS AND THAT PROVISION APPLIES AND IT IS SECTION 9.07.03. APPEALS FROM THE DECISIONS OF THE PLANNING AND ZONING AGENCY.
NOW THE PLANNING AND ZONING AGENCY IS ANALOGOUS TO THE PLANNING AND ZONING PONTEVEDRA ZONING BOARD. AND WHAT THAT SAYS -- I COULD READ THROUGH THE WHOLE THING BUT ALL READ THROUGH THE KEY LANGUAGE IF I MAY? THAT IF AN APPEAL IS MADE, THE APPEAL SHALL BE SCHEDULED ON THE NEXT AVAILABLE MEETING OF THE BOARD OF COUNTY COMMISSIONERS. NOW NEXT AVAILABLE MEETING HAS TO BE CONSTRUED AS NEXT REASONABLY AVAILABLE MEETING. THERE COULD BE SOME CIRCUMSTANCE WHERE IT MAY NOT ACTUALLY BE THE NEXT CALENDAR MEETING, BUT THE NEXT AVAILABLE MEETING FOR PURPOSES SUCH AS NOTICE AND WHATNOT. AND, YOU KNOW, FOR I THINK OTHER CONSIDERATIONS, WHICH WOULD POSSIBLY NOT MAKE IT THE NEXT AVAILABLE MEETING. BUT NONETHELESS, THAT IS A PROVISION PERTAINING TO APPEALS FROM THE PLANNING AND ZONING AGENCY AND BY ANALOGY THE COUNTRY FEATURE ZONING AND ADJUSTMENT BOARD. SO WITH THAT, MR. CHAIR AND BOARD MEMBERHAT THE REQUEST IS. I'VE DESCRIBE SOME OF THE BACKGROUND INFORMATION I'VE DESCRIBED WHAT THE CODE PROVISIONS PERTAINING TO THE CZAR, AND SO, THE BOARD MAY CONSIDER THIS REQUEST. MR. CAROL -- AND I BELIEVE AN ASSOCIATE OF MR. CAROL IS HERE TODAY. THEY MAY WANT TO MAKE A BRIEF STATEMENT TO THE BOARD ABOUT THE REQUEST. IF THEY DO, MY ADVICE WOULD BE TO ALLOW A BRIEF STATEMENT AND IN FACT, THIS TIME, MR. CHAIR, I WOULD ASK THAT IF THEY ARE GOING TO DO THAT, IT WOULD ALSO BE MY ADVICE THAT THE REPRESENTATIVE OF THE APPLICANT, MISS SMITH, BE ABLE TO RESPOND AND THAT IT'S BACK TO THE BOARD PERTAINING TO A DECISION OR NOT UNLESS -- ON THIS REQUEST. THANK YOU MR. CHAIR.
>> THANK YOU. WOULD YOU LIKE TO SPEAK.
>> YES, SIR. MR. COMMISSIONER DEAN?
>> (INDISCERNIBLE). >> THIS ITEM, THE SCHEDULE --
IS SCHEDULED FOR ACTION TODAY. >> THAT IS GREAT.
>> AND NOW WE HAVE A REQUEST FOR TO BE DELAYED.
>> THAT IS CORRECT. >> DOES THE BOARD ONLY NEED TO TAKE ACTION WITH A MOTION IF THE BOARD CHOOSES TO DELAY IT OR DO WE NEED TO TAKE ACTION TO KEEP IT ON THE AGENDA? MY OPINION WOULD BE THAT THE ONLY ACTION WE WOULD NEED TO TAKE IS THAT IF THERE WERE A MOTION AND A SECOND TO DELAY THE ITEM OR POSTPONE IT BECAUSE IT'S ALREADY ON THE AGENDA FOR ACTION.
>> THAT IS CORRECT. ONCE IT IS BACK TO THE BOARD, UNLESS THERE IS A MOTION TO
[01:40:03]
POSTPONE DELAY OR RESCHEDULE THAT TYPE OF THING, IF THERE IS NO MOTION OR THERE'S A MOTION DIES, THEN THE MATTER WILL ROLL INTO WHAT IS ON THE SCHEDULE WHICH IS THE ITEM ON THEMERITS. >> WE WILL ALLOW MR. CAROL AND HIS OR HIS REPRESENTATIVE TO COME FORWARD AND PRESENT YOUR REQUEST.
>> GOOD MORNING. >> NEIL HAS A SORE THROAT FOR HIS HEALTH AND EVERYONE ELSE IS GOING TO WEAR A PROTECTIVE MASK.
I'M HIS SON. I WILL BE REQUESTING THAT THIS BE DELAYED ON HIS BEHALF.
THE COUNTY ATTORNEY, ONE THING HE DID NOT MENTION IS THAT HIS EMAIL WAS SENT OUT IT FOR 15 P.M. ON A THURSDAY. WE HAD MADE PLANS AND DISCUSSED FOR RESIDENTS IN DALTON COVE HAD MADE PLANS BASED ON THE FACT THAT WE BELIEVE THAT THIS MEETING WAS GOING TO BE DELAYED SIGNIFICANTLY. ACCORDINGLY, WE MAKE THE REQUEST -- I'M NOT SURE IF I'M ALLOWED TO BRING THIS UP, REGARDING PUBLIC NOTICE, THERE IS A 300 FOOT RULE, STATE RIGHT-OF-WAY SAND ROADS AND GOLF COURSES THAT ARE SUPPOSED TO BE SUBTRACTED FROM THAT.
NONE OF THE RESIDENTS ON PABLO DRIVE WITHIN 300 FEET WERE NOTIFIED OF ANY MEETING, THE ARC MEETING, THE ZONING ADJUSTMENT BOARD MEETING OR THIS MEETING.
SO I WOULD ASK THAT PUBLIC NOTICE BE CONSIDERED -- THAT THAT BE CONSIDERED AS AN ISSUE.
THERE IS A RESIDENT ON PABLO DRIVE, PABLO BOULEVARD, MISS POWELL, SHOULD BE CALLING HIM WITH PUBLIC COMMENT. SHE HEARD HER NEIGHBOR. SHE'S BEEN IN COMMUNICATION WITH ME. BUT SHE HAS NOT RECEIVED ANY PUBLIC NOTICE EVEN THOUGH SHE
SHOULD HAVE. >> THANK YOU, MR. CHAIR.
I THINK AS TO THE ISSUE OF PUBLIC NOTICE, MY UNDERSTANDING, THAT THERE HAD BEEN -- MR. MULTIS WILL ADDRESS THE.
>> THANK YOU, AND GROWTH MANAGEMENT MAY ACTUALLY BE ABLE TO CORRECT ME ON SOME OF THIS, BUT THE APPLICANT IS TRADITIONALLY RESPONSIBLE FOR PROVIDING THE ADJACENT PROPERTY OWNERS A LIST WHICH THEN GOES OUT I BELIEVE FROM GROWTH MANAGEMENT AS MR. MCCORMICK INDICATED ADJACENT PROPERTY NOTICE WAS MAILED OUT FOR EACH MEETING AND IT WENT OUT TWICE FOR THE APRIL 7 AND WENT OUT AGAIN FOR THIS MEETING. I BELIEVE THAT HAS BEEN COMPLIED WITH. I THINK IF THE ISSUE IS WHETHER CERTAIN RIGHTS-OF-WAY WERE SUBTRACTED OR NOT, HAVE TO LOOK AT A SPECIFIC PROPERTY OWNER WHO SAYS SHE SHOULD HAVE BEEN INCLUDED OR NOT TO SEE WHETHER THAT WAS CORRECT OR NOT. IF MR. CAROL CAN PROVIDE WHATEVER THEY THOUGHT SHOULD HAVE BEEN INCLUDED, WE CAN TAKE A LOOK AT THAT.
BUT THE EVIDENCE OF THE ADJACENT PROPERTY OWNERS MAILING WILL BE INCLUDED IN THE
>> WILL NOT HEAR FROM MS. SMITH. GOOD MORNING.
>> GOOD MORNING MR. CHAIRMAN FOR THE RECORDS ELLEN AVERY SMITH 100 WHITESTONE PLACE SAINT AUGUSTINE. I AM HERE ON BEHALF OF PUNTER FEATURE COMMERCIAL PROPERTIES WHICH IS AN AFFILIATE OF A PETROLEUM COMPANY. WITH ME ARE HERBERT AND JOHN PAYTON AND DREW AS WELL AS MEMBERS OF OUR TEAM ARE READY FOR HEARING.
GAIT OWNS THE PROPERTY THAT IS SUBJECT TO THE APPLICATION. SO WE FILED ZONING AND NON-ZONING CARRIES APPLICATIONS AS WELL AS A PUNTER FEATURE REVIEW APPLICATION IN NOVEMBER P2019. THOSE DOCUMENTS WERE COMMENTED BY STAFF.
THEY ARE IN A DECEMBER 2019 STAFF REPORT. WE WENT TO A MEETING OF THE PUNTER FEATURE ARCHITECTURAL REVIEW COMMITTEE IN DECEMBER AND THAT BOARD APPROVED THE ARCHITECTURAL REVIEW PART AND RECOMMENDED APPROVAL OF THE VARIANT ZONING AND NON-ZONING VARIANCE APPLICATIONS. THAT WAS IN DECEMBER. ENJOY IN JANUARY WENT TO THE ZONING BOARD THAT BOARD APPROVED APPLICATIONS. AND THE APPELLANT, AS MR. MCCORMICK NOTED CORRECTLY FILED HIS APPEALS ON JANUARY 29 OF FEBRUARY 4. ALMOST 4 MONTHS AGO. SO, LDC SECTION 9.07.02 SAYS APPEALS MUST BE HEARD ON THE
[01:45:02]
NEXT REASONABLY AVAILABLE MEETING OF THE BOARD OF COUNTY COMMISSIONERS.AGAIN, THE APPEALS WERE FILED ON JANUARY 29 AND FEBRUARY 4. FOR WHATEVER REASON, THE APPEAL HEARING WAS NOT SET UNTIL APRIL 7 AND WE KNOW WHAT HAPPENED WITH THAT.
IT'S NOBODY'S FAULT. THIS HEARING WAS PROPERLY NOTICED.
THERE HAS BEEN MORE THAN AMPLE NOTICE AND THE APPELLANTS ARE HERE IN PERSON.
THEY'VE OBVIOUSLY LET LOTS OF PEOPLE IN THE COMMUNITY KNOW ABOUT THIS AND IN THE LOW ACTUAL NOTICE TRUMPS PUBLISHED NOTICE. SO AGAIN, WE, IN RESPECT FOR GATES DUE PROCESS RIGHTS, WHICH WE NEED TO REMEMBER, THEY ARE A SUBSTANTIALLY AFFECTED PARTY HERE BECAUSE THEY ARE THE PROPERTY OWNER. IT HAS BEEN WAITING A LONG TIME TO HAVE THIS APPEAL HEARING AND IT HAS SUFFERED DAMAGES. WE WOULD JUST RESPECTFULLY REQUEST THAT THIS HEARING GO FORWARD AS PROPERLY NOTICED TO RESPECT GATES RIGHT AND THE APPELLANT IS HERE AND IS CAPABLE OF MAKING A PRESENTATION TO YOU TODAY.
WE DO NOT HAVE AN AUDIENCE FULL OF PEOPLE. THERE MAY BE PEOPLE ON THE TELEPHONE WHO CAN CALL IN AND TIMELY MAKE ANY COMMENTS THAT THEY WOULD LIKE.
THANK YOU FOR YOUR CONSIDERATION.
>> SEE NONE WE WILL MOVE FORWARD WITH THE HEARING THAT HAS BEEN SCHEDULED FOR TODAY.
WE WILL BEGIN WITH EX PARTE COMMUNICATIONS. COMMISSIONER DEAN?
>> I -- ON MAY 7, I MET WITH ELLEN AVERY SMITH ANDREW FOR RICK TO DISCUSS THE TOTALITY OF THE PROJECT AS IT WAS PLANNED, THE BASES FOR THE REQUESTED ZONING AND NON-ZONING VARIANCES. TO ADDRESS ANY QUESTIONS I HAD. THAT WAS ON MAY 7. THEN YESTERDAY, MAY 11 I HAD A TELEPHONE CONVERSATION WITH MR. PAYTON WHICH WENT OVER THE SAME INFORMATION, THE PROPOSED GAS STATION AND CARWASH AND THE NEED FOR THE VARIANCES.
>> COMMISSIONER WALDRON. >> I THINK COMMISSIONER DEAN DID A GOOD JOB I WANT TO REMIND THE BOARD AS THEY DID FOR AGENDA ITEM NUMBER THREE FOR THE EX PARTE COMMUNICATIONS, THE SUBJECT AND IDENTIFY THE PERSON OR GROUP OR ENTITY WITH THE GROUP IT TOOK PLACE WITH FOUR WRITTEN COMMUNICATIONS, WE HAVE GONE THROUGH AND SEARCHED THE EMAILS THAT HAD BEEN RECEIVED BY THE COUNTY COMMISSIONERS.
I HAVE A PACKET OF THOSE AND WE WILL PUT THOSE INTO THE RECORD. BUT IF ANY MEMBER ALSO HAD DONE ANY SITE VISIT OR INVESTIGATION THROUGH THE COMMISSION MEMBER ITSELF, SURE -- SHOULD DISCLOSE
THAT AS WELL. >> THANK YOU COMMISSIONER
I'M GOING TO GO BACK. I'VE HAD SOME OTHER MEETINGS ON THE PROJECT WHICH WE MAY HAVE CROSSED SPEAKING'S I WANT TO MENTION THOSE MEETINGS ALSO. FIRST OF ALL I WANT TO DESCRIBE MY MEETINGS. I DO NOT MAKE A WHOLE LOT OF COMMENTS IF ANY AT ALL.
I DON'T ASK QUESTIONS. I LET THEM PRESENTED TO ME AND THAT'S IT.
NO MORE DIFFERENT THAN WE DO IN HEARING. SO SHE WILL PROBABLY TELLING YOU THAT MY MEETINGS ARE BORING AND QUICK. BUT ON THURSDAY -- WILL GO IN KIND OF CHRONOLOGICAL ORDER, BUT THURSDAY, JUNE 13 AT 11 O'CLOCK I MET WITH MS. ELLEN AVERY SMITH TOM AND LINDA. I DO NOT RECALL ANYTHING BEING DESCRIBED ABOUT THIS PROJECT BUT WE HAD A MEETING ON URBAN DEVELOPMENT. ON JANUARY 23 OF 2020, I SPOKE WITH MS. ELLEN AVERY'S AND FRICK ABOUT CROSSING. I SPOKE WITH MS. ABOUT DURDEN DEVELOPMENT. I THINK THIS WAS MENTIONED COMING UP BEFORE THE BOARD.
THURSDAY, MARCH 26 AT 2020 I MET WITH MS. SMITH ANDREW AGAIN ABOUT URBAN DEVELOPMENT AND THIS WAS MENTIONED ON THE GAUGE PROJECT THIS APPEAL COMING. AND THEN ON MAY 7, MAY 7 OF 2020 AT MAY 7 OF 2020 AT 9:30 AM IT WAS MS. SMITH AND MR. FRICK.
THEY SHOWED ME THEIR SIDE OF THE STORY THAT I DIDN'T HAVE HARDLY ANY QUESTIONS.
I THINK THE ONLY STATEMENT I MADE IS THAT THEY UNDERSTAND. I ALSO MADE A SITE VISIT ON MAY 10 TO THE PROPERTY. ALSO MR. CAROL'S PROPERTY THERE, THE PROPERTY TO THE
[01:50:06]
NORTH. I VISITED THE GATE STATION. AND I DON'T KNOW WHAT THEY'RE CALLING THAT ROAD ANYMORE. I JUST CALL IT TO 10. AND I ALSO RECEIVED NUMEROUSEMAILS ON THE SUBJECT. >> COMMISSIONER JOHN SKI.
>> THANK YOU. YESTERDAY 11 I RECEIVED A PHONE CALL REGARDING THIS AGENDA ITEM AND THE CORRESPONDENCE THEY RECEIVED FROM HIS CORRESPONDENCE HE INDICATED THAT IT WAS ON THE AGENDA POTENTIALLY OFF THE AGENDA AND BACK ON THE AGENDA.
AND HE DELIVERED EMAILS WITH THE INFORMATION FROM WHICH HE DERIVED HIS CONCLUSIONS.
I HAD A MEETING MAY 7 WITH MS. SMITH AND MR. FRICK TO DISCUSS THE APPEAL, THE HISTORY OF THE PROPERTY AND DEVELOPMENT POTENTIAL DEVELOPMENT OF SURROUNDING PROPERTIES, THE EVOLUTION OF DEVELOPMENT IN THIS AREA, AND THE TIMING OF WHO DEVELOPED WHAT.
ALSO IN MEETINGS RELATED TO DURDEN DEVELOPMENT. THAT WAS THE FOCUS OF THE MEETINGS WITH MS. SMITH AND MR. FRICK ON MARCH 26 AND MARCH 12 AND JANUARY 23.
AND IN AT LEAST TWO OF THOSE MEETINGS THIS APPEAL WAS BROUGHT UP WITHOUT ANY
SIGNIFICANT DETAIL. >> I WILL DISCLOSE MY EX PARTE AS WELL. ON MAY 7 AT 11 AM I MET WITH MS. SMITH, MR. FRICK PATRICK MCCORMICK AND TERESA BISHOP. WE DISCUSSED THE HARDSHIP FOR THE VARIANCE AND ALSO DISCUSSED THE DIFFERENCE BETWEEN THE VARIANCES. WE DISCUSSED THE HARDSHIP FOR SIGNAGE. WE SET BACK A REQUIREMENT BECAUSE OF RESTRICTIVE COVENANTS. WE DISCUSSED ALL OF THE VARIANCES AS A WHOLE.
GOING BACK, A LITTLE BIT FURTHER, I WOULD LIKE TO MENTION THAT WE DID HAVE A MEETING ON THAT WE DID HAVE A MEETING ON MARCH 26. AND AT THAT MEETING I MET WITH MS. SMITH TRUE FRICK AND PAUL LASORDA ON DURDEN PARK IT WAS BRIEFLY MENTIONED AT THE END OF IT THAT THERE WAS AN APPEAL THAT WAS FORTHCOMING AND THAT WAS IT.
IT WAS JUST A MENTION OF IT. I ALSO WANTED TO -- I WANT TO DISCLOSE THAT I HAVE HAD MANY EMAILS ON THIS. I HAVE RESPONDED FAIRLY GENERALLY TO MOST OF THE EMAILS. ON A COUPLE OF THEM I HAVE BEEN MORE DETAILED ON MARCH MORE DETAILED ON MARCH 31, 2020 -- I RESPONDED TO HIM AND PROVIDED CLARITY WAS ADDRESSING WITH THE APPEAL BECAUSE OF THE OBVIOUS MISGUIDANCE ALLUDED TO WITHIN THIS CORRESPONDENCE.
AGAIN ON MAY 7, 2020 MS. LAURA ATKINSON HAD MORE DETAIL IN MY RESPONSE -- THAT SHE HAD WITH HER EMAIL. I PROVIDED CLARITY EXACTLY WHAT THE BOARD WAS HEARING.
AND THOSE ARE TWO MORE SPECIFICALLY I ADDRESSED BECAUSE OF A LOT OF MISINFORMATION THAT THEY WERE PROVIDING TO ME IN THEIR CORRESPONDENCES.
YESTERDAY, MAY 11, 2020, I VISITED THE SITE I DROVE BY THE EXISTING GATE STATION ON A1 A.
I DROVE BY TO OBSERVE THE APPLICANT SITE. I THEN WENT TO MR. CAROL'S SITE THE SHOPS AT PONTEVEDRA I STOPPED IN. I WALKED THE PROPERTY I VISITED WITH SOME OF THE SHOP OWNERS. SO I DID THAT YESTERDAY AFTERNOON.
THAT SHOULD CONCLUDE MY DISCLOSURE. MR. WALDRON?
>> I NEED TO ADD THAT I DID GO BY THE GATE STATION ON A1 A.
>> OKAY. VERY GOOD. ANYTHING ELSE? LET ME JUST BRIEFLY GO OVER THE -- THE TEMPLATE FOR THIS MEETING THAT HAS BEEN ESTABLISHED BY THE OFFICER AND COUNTY ATTORNEY. WILL BEGIN WITH A STAFF PRESENTATION THAT WILL PROCEED FOR 10 MINUTES. WE WILL HAVE THE APPELLANT COME UP FOR 15 THE APPELLEE FOR 15 MINUTES AND WILL HAVE PUBLIC COMMENT AND COMMENT LIMITED TO THREE MINUTES FOR EACH INDIVIDUAL. THEN WE WILL PROVIDE A REBUTTAL TIME BEGINNING WITH THE APPELLANT FOR THREE MINUTES AND THEN APPELLEE FOR THREE MINUTES AND THEN WE WILL BE BACK TO THE BOARD. WE CAN ADAPT THAT AND ADJUST THAT THAT IS THE BASIC TEMPLATE THAT WE HAVE TODAY. WITH THAT BEING SAID WILL MOVE ON WITH STAFF. MS. BISHOP ÃMR. -- I HAVE A COUPLE OF HOUSEKEEPING ITEMS.
[01:55:13]
ONE IS THAT JUST TO MAKE IT CLEAR THAT THIS PROPERTY THAT IS OWNED ARE THREE ALLOWS FOR THE GAS STATION AND SOME OF THE MISCOMMUNICATION FLOATING AROUND.IT DOES ALLOW FOR A GAS STATION AND WHAT YOU ARE HEARING TODAY IS APPEALS FOR AN ADDITIONAL GROUND SIGN ON THE PROPERTY, ALLOW A 78 SQUARE-FOOT CARWASH SIGN, AND 81.8 SQUARE-FOOT WALL SIGN A 65 SQUARE-FOOT FRESH KITCHEN WALL SIGN A 46 SQUARE-FOOT FROZEN YOGURT SIGN AND TO ALLOW FOR A 145 FOOT BUILDING THAT IS PARALLEL TO A1 A AND TO ELIMINATE SOME OF THE REQUIRED LANDSCAPING BETWEEN THE FRONT OF THE BUILDING IN THE PARKING AREA.
THOSE ARE THE SPECIFIC THINGS ARE ADDRESSING. NOT WHETHER A CARWASH AND A GAS STATION CAN BE AT THAT SITE. AND IS PLANNING APPEAL 2020 Ã 02 WHICH IS APPEALING THE DECISION OF THE PONTEVEDRA ZONING VARIANCE 2019-10 AND THE NON- ZONING VARIANCE WHICH WAS GRANTED BY THE BOARD ON JANUARY 6. AND THEN THE ARC APPEAL, IT'S 2020 Ã101 AND IT APPEALS THE DECISION OF THE ARCHITECTURAL REVIEW COMMITTEE 20 1908 THAT WAS MADE DECEMBER 18, 2019. PHIL PONCE CARWASH AND ASSOCIATED LANDSCAPING.
THIS IS THE SUBJECT PROPERTY. IT'S AN AERIAL OF THE PROPERTY. YOU CAN SEE THE PROPERTY IS DESIGNATED COMMERCIAL ON THE FUTURE LAND USE MAP. AND IT IS ZONED R3, WHICH IS COMMERCIAL IN THE PONTEVEDRA ZONING DISTRICT. THE PROPERTY IS COMPRISED -- IT IS UNDEVELOPED RIGHT NOW. IT HAS AN EXISTING RETENTION POND IT IS ADJACENT TO A DEVELOPED AREA AND A SHOPPING CENTER. IT IS LOCATED ON A1 A NORTH.
THE OWNER OF THE ADJACENT PROPERTY, THE SHOPPING CENTER, IS APPEALING THE ARC APPROVAL THE PONTEVEDRA SIGNS REQUEST AND TWO OF THE THREE NON-ZONING VARIANCE REQUESTS FOR THE LIEN THE ELIMINATION OF LANDSCAPING TO THE FRONT OF THE BUILDING AND THE PARKING AREA.
THIS IS JUST AN OVERALL SITE PLAN OF THE SITE. THIS IS JUST A RENDERING OF THE SIGNAGE AS WELL AS THE GATE. AND WHERE THE SIGNS MAY BE LOCATED ON THAT GATE STATION.
THIS IS A RENDERING OF THE CARWASH. THIS IS THE DEFINITION OF VARIANCE FROM OUR LAND DEVELOPMENT CODE. I WANT TO ADD THAT PONTEVEDRA ZONING ADJUSTMENT REGULATIONS HAS A DEFINITION OF HARDSHIP WHICH IS SIMILAR TO THIS ONE.
THERE ZONING CODE ALSO INCLUDES THE LAND DEVELOPMENT COUNTY DEFINITION.
>> THE APPELLANT IS SAYING THAT THE PROJECT THAT WAS MADE AND THE APPROVALS THAT WERE MADE WERE NOT IN THE SPIRIT OF THE CODE DURING THE PUBLIC INTEREST IN THE FIFTH CRITERIA FOR THE NON-ZONING VARIANCES. THE ELIMINATION OF LANDSCAPING, ALLOW THE BILLING TO EXCEED HUNDRED 20 FEET. THE ARC APPLICATION AND SAYING THOSE ELEMENTS ARE NOT CONSISTENT WITH THAT AREA AND ARE NOT CONSISTENT WITH THE PONTEVEDRA ZONING DISTRICT REGULATION.
HE APPLICATION CONTINUED FOR ADDITIONAL GROUND SIGNS AND COLOR AND MATERIALS OF THE WALL SIGNS. THEY'RE LARGER THAN THE MAXIMUM 24 SQUARE FEET AND THEY ARE NOT IN HARMONY WITH THE REDUCTION OF THE VISUAL DISTRACTION WITH THE UNIFORM SIGN CRITERIA IN THAT AREA AND THE CARWASH BUILDING IS 21 PERCENT LONGER THAN THE MAXIMUM AND THAT IS NOT IN HARMONY WITH THE PURPOSE AND INTENT OF THE PONTEVEDRA AESTHETICS.
THIS IS FROM THE APPEAL. THIS IS MORE FROM THE APPEAL PERIOD IS THE REAL DIRECTION AND DISTRACTION. THOSE TYPE OF THINGS THAT THEY WERE LOOKING AT.
AND THEN THE -- IN THE ITEM ARC 20 1908 WHICH WAS HEARD BY THE ARCHITECTURAL COMMITTEE ON
[02:00:01]
DECEMBER 18, 2018 THE COMMITTEE VOTED TO GO AHEAD AND APPROVE THOSE REQUESTS THAT WERE MADE.WE HAVE RECEIVED -- WE HAVE RECEIVED CORRESPONDENCE AS WELL HAVE.
CORRESPONDENCES IN YOUR PACKET THAT WE RECEIVED PRIOR TO THAT. SOME OF THE CURRENTS THAT THEY HAVE BEEN EXPRESSING IS DAMAGING TO THE SCENIC HIGHWAY OVER COMMERCIALIZATION OF THE AREA IN TRAFFIC. AND THEN STAFF HAS OFFERED SEVEN FINDINGS OF FACT TO RECOMMEND APPROVAL OF THE APPEAL FOR CONDITIONS SEVEN FINDINGS OF FACT TO RECOMMEND THE DENIAL OF THE APPEAL AND WE ALSO OFFER ONE FINDING OF FACT TO THE ARC APPEAL OF 2020 Ã01 AND TWO CONDITIONS INTO FINDINGS OF FACT. THAT CONCLUDES THE STAFF PRESENTATION AT THIS POINT. I CAN TRY TO ANSWER QUESTIONS THAT YOU MAY HAVE AS WELL AS THE APPELLANT IS HERE AS WELL AS THE PROPERTY OWNER THAT IS HERE.
>> THANK YOU. ANY QUESTIONS FOR STAFF?
>> ALL RIGHT. THANK YOU VERY MUCH.
>> THANK YOU. >> NOW WE WILL MOVE ALONG TO
THE APPELLANT. >> GOOD MORNING.
>> BEFORE I BEGAN WITH READING THE STATEMENTS A QUESTION FOR MS. BISHOP BECAUSE I WAS PRESENT AT THE ARC MEETING ALLISON VOTED AGAINST TWO OF THOSE MOTIONS.
>> MR. CALLIS CRAIG. ONE OF THOSE MOTIONS WAS A 2-1 FROM THE ARCHITECTURAL REVIEW COMMITTEE. THAT'S CORRECT. THANK YOU.
>> AND THEN ONE MORE NOTE REGARDING PUBLIC COMMENT BECAUSE I DID RECEIVE A NUMBER OF TEXT MESSAGES SINCE THIS BEGAN. JANE RULISON JANE POWELL JOSEPH MCHENRY AND NICOLE CHRISTIE AND TRY TO CALL IN. THEY CALL INTO THE SYSTEM AND THE SYSTEM HANGS UP ON THEM. I'M NOT SURE WHO IS HANDLING THAT FROM A TECHNICAL PERSPECTIVE READING THIS ON BEHALF OF CAROL SENIOR MY FATHER.
>> I AM THE OWNER HEREBY APPEAL TO THE SAME JOANIE'S TO REVERSE THE VARIANCES GRANTED ON JANUARY 6, 2020. NAMELY 2019 Ã10 REQUESTING HIS ZONING.
SECTION 10 C TO A SIGNS TO EXCEED THE ALLOWANCES FOR WALL SIGNAGE SECTION 10 CQE TO ALLOW ADDITIONAL GROUND SIGN IN SECTION 10 F8 TO ALLOW FOR SIGNS AND THE LANDSCAPE BUFFER.
PONTEVEDRA PDC AR 2019 Ã16 REQUESTED A NON-ZONING VARIANCE.
THE OVERLAY DISTRICT STANDARDS SECTION SECTION 8Q5 A1. EIGHT Q5 E1 TO ALLOW FOR FLAT ROOFS SECTION 8 Q5 A 11 CARWASH TO EXCEED THE 120 FOOT MAXIMUM BUILDING LENGTH BY 25 FEET.
TO ALLOW NO LANDSCAPING BUFFER BETWEEN THE FRONT OF THE BUILDINGS AND THE PARKING LOT.
ALL TESTIMONY CONTAINED HIS -- AS IT'S BASED ON THE ORDINANCES DEVELOP MANUALS OF ST. JOHN'S COUNTY. I'M A REAL ESTATE DEVELOPER WHO IS OWNED PROPERTY ACROSS MULTIPLE CITIES OVER THE COURSE OF 40 YEARS. FURTHER I'VE SOUGHT THE EVIDENCE OF AN ATTORNEY. REGULATORY GUIDELINES ARE IN PLACE WHICH SET THE LEGAL STANDARDS TO OBTAIN ZONING AND NON-ZONING VARIANCES. THESE ARE INCLUDED HEREIN.
THE APPLICANT FAILED TO MEET THE STANDARDS AND I BELIEVE THIS RUNS CONTRARY TO THE PUBLIC INTEREST. BEFORE GETTING INTO THE -- AT LIKE TO REMIND THE THE COMMISSIONERS. THE STATED PURPOSE AND DEVELOPMENT.
IN ORDER TO FOSTER AND PRESERVE PUBLIC HEALTH, SAFETY COMFORT AND WELFARE AND TO AID IN THE HARMONIOUS ORDERLY PROGRESSIVELY DEVELOPMENT THE UNINCORPORATED AREAS OF ST.
JOHN'S COUNTY. IT IS THE INTENT THAT THE DEVELOPMENT PROCESS BE EFFICIENT IN TERMS OF TIME AND EXPENSE EFFECTIVE IN TERMS OF DEVELOPING APPLICATIONS AND EQUITABLE IN TERMS OF CONSISTENCY WITH ESTABLISHED REGULATIONS AND PROCEDURES.
IN CONSIDERATION OF THE INTEREST OF THE CITIZENS, FURTHER, THE STATED INTENT --
[02:05:02]
OBJECTIVES TO BE OBTAINED -- THIS IS SHORTENED FOR BREVITY OBJECTIVES TO BE CONTAINED INCLUDE PROTECTION OF ADJACENT RESIDENTIAL USES REDUCTION OF VISUAL DISTRACTION, ENHANCEMENT OF THE APPEARANCE OR INCREASED LANDSCAPING OF PUBLIC AND PRIVATE PROPERTY, THE STATED CRITERIA FOR GRANTING THE VARIANCE IS 10-42. ZONING ORDINANCES MAY BE GRANTED WHICH ARE NOT IN THE PUBLIC INTEREST -- IT WILL RESULT IN UNNECESSARY AND UNDUE HARDSHIP. THE CRITERIA FOR GRANTING VARIANCES SECTION 20 ZONING VARIANCES MAY BE GRANTED WHICH ARE FOUND TO BE NOT CONTRARY -- IT WILL RESULT IN UNNECESSARY AND UNDUE HARDSHIP. THE APPLICANT MUST DEMONSTRATE A HARDSHIP.THE APPLICANT FAILED TO STATE A HARDSHIP. WITH REGARD TO 2019 Ã10 THE APPLICANT REQUESTED A VARIANCE TO EXCEED THE ALLOWANCES FOR WALL SIGNAGE.
IN THE PRESENTATION THE APPLICANT STATED THE FOLLOWING AS HARDSHIPS NUMBER ONE COMPLIANCE WITH THE PRIVATE AGREEMENT SETBACKS WITH THE PROPERTY TO THE SOUTH -- THAT'S OUR PROPERTY FORCES THEM TO BUILD THE BUILDINGS FURTHER BACK.
ANDREW AS STATED ONE HOUR AND 16 MINUTES INTO THE HEARING. IF EACH SIGN WERE FOR A UNIQUE BUSINESS THE SIGNS WOULD BE ALLOWED STATED BY TONY ANDERSON 48 MINUTES INTO THE HEARING.
IT FAILS TO MEET THE STANDARDS BY LAND DEVELOPMENT CODE SECTION 12 QUOTING IN THIS CONTEXT HARDSHIPS CREATED BY ANY ACT OF THE OWNER ARE NOT CONSIDERED HARDSHIPS JUSTIFYING THE VARIANCE. I'M GOING TO GO OFF SCRIPT BASICALLY WHAT THIS STATEMENT IS THE COMPANY CREATED A SETBACK AGREEMENT WITH CX THE 11 WHEN THEY SOLD US THAT PROPERTY. SO INSANE THAT IT IS A HARDSHIP THAT THE GAS STATION HAS TO BE SET BACK FURTHER THAN OTHERWISE WOULD BECAUSE OF A PRIVATE AGREEMENT THERE TRYING TO STATE THAT'S A HARDSHIP. IT'S HER OWN CREATION. THE LAND DEVELOPING CODE SAYS IF YOU CREATE A HARDSHIP -- NOT HARDSHIP -- THEY CREATED THE AGREEMENT BETWEEN ITS PARCEL WHICH I OWN A PORTION THEREOF. THERE STATED HARDSHIP IS THE AGREEMENT OF THEIR OWN CREATION AND BY LEGAL DEFINITION NOT A HARDSHIP. THE ARGUMENT SET FORTH IN NUMBER TWO IS NOT A HARDSHIP. THE BIT -- IF THE BUSINESSES WERE INDIVIDUAL THEY HAVE THEIR OWN FIREWALLS PAYMENT FACILITIES AND BATHROOM FACILITIES.
THAT IS NOT THE CASE. UNDER THIS STANDARD A LARGE RESTAURANT COULD HAVE A WALL SIGN FOR EACH SECTION OF THEIR RESTAURANT. THE ARGUMENT THAT THE APPLICANT PUT FORTH WOULD CREATE A PRECEDENT WHEREBY A LARGE RESTAURANT OR OTHER BUSINESS COULD REQUEST THAT WHICH RUNS CONTRARY TO THE SPIRIT OF THIS CODE.
WITH REGARD TO 2019 Ã16 THEY REQUESTED A VARIANCE TO ALLOW NO LANDSCAPING BETWEEN THE FRONT OF THEIR BUILDING AND THE PARKING LOT. THE ARGUMENT WAS THAT CUSTOMERS HAVE A TENDENCY TO DISPOSE TRASH IN THE LANDSCAPING AND IT PRESENTED A HARDSHIP.
BY THIS STANDARD EVERY PARCEL AND COMMERCIAL RETAIL PROPERTY COULD APPLY FOR A ZONING VARIANCE TO ELIMINATE LANDSCAPING BETWEEN THE FRONTS OF THEIR BUILDINGS IN THE PARKING LOT. I'VE OWNED AND MANAGED COMMERCIAL PROPERTY FOR CLOSE TO 40 YEARS. IT'S A MATTER OF EFFORT AND COST.
GRANTING EXPERIENCES NEITHER IN THE SPIRIT OF THE CODE NOR IN THE PUBLIC INTEREST.
ALSO REGARDING 29 Ã16 THEY REQUESTED A VARIANCE TO ALLOW FOR A BUILDING LONGER THAN 120 FEET. IN THEIR PRESENTATION, THEY STATED THAT THE ADDITIONAL LENGTH OF THE CARWASH WAS TO ENHANCE THE FUNCTION OF THE CARWASH WITHOUT GIVING TECHNICAL DETAILS AND HOW THIS CREATED A HARDSHIP AS STATED BY TONY ANDERSON APPROXIMATELY ONE HOUR INTO THE HEARING. THE APPLICANT OPERATES NUMEROUS CARWASHES WHICH ARE SHORTER THAN WHAT HE PROPOSED. THE APPLICANT STATED THAT OTHER BUILDINGS ALSO EXCEED 120 FOOT LENGTH LIMIT, BUT THEY FAILED TO MENTION THAT THESE BUILDINGS WERE BUILT PRIOR TO THE ADOPTION OF THE CURRENT LAND DEVELOPMENT CODE. AND THAT SAID BUILDINGS HAD ARCHITECTURAL FEATURES THAT ARE ECSTATICALLY PLEASING. THEY DEMMINGS RATED NO HARDSHIP IN GRANTING THIS VARIANCE WOULD ALLOW FOR A LARGE BUILDING THAT IS NOT IN KEEPING WITH THE
[02:10:20]
LOCAL ARCHITECTURE AND CONTRARY TO THE PUBLIC INTEREST. THIS IS NOT A TRIVIAL MATTER.THE ENTIRE DISTRICT AND THE CHARACTER IS AT STAKE IN ITS DECISION.
IF THEY VOTE IN FAVOR IT WILL SET A PRECEDENT WILL TURN A1 A INTO BEACH BOULEVARD IN SHORT ORDER. I'M SAYING THAT IS A STATEMENT OF FACT BECAUSE I'LL BE ONE OF THE FIRST APPLICANT FOR MORE SIGNS, LARGE SIGNS AND MORE COLORFUL SIGNS.
AND FAILURE TO GRANT THESE VARIANCES WILL RESULT IN A DISCRIMINATION LAWSUIT AGAINST THE COUNTY. OTHER PROPERTY OWNERS WILL FOLLOW SUIT AS WELL.
THE OVERLAY DISTRICT WILL BE DEAD IN THE CHARACTER OF PUNCHER VISUAL WILL BE DESTROYED IN THE NAME OF COMMERCIAL USES. THE ONLY WAY PUNCHER BEECHER CAN MAINTAIN ITS CHARACTER IS IF WE PLAY A LEVEL PLAYING FIELD AND FAVORITISM IS NOT GRANTED TO SPECIAL INTERESTS. I WOULD CAUTION THE COMMISSIONERS AGAINST RELYING ON THE PUNCHER FEATURE REVIEW COMMITTEE OR ZONING BOARD AS EXPERTS TO HAVE SETTLED THIS MATTER PREVIOUSLY. THE APPLICANT ONLY INCLUDED PARCEL NUMBER 051-28-0030 EVEN THOUGH THE PROJECT WILL BE BUILT ON PARCEL 05120030 AND PARCEL 052-50-0010.
PARCEL NUMBER ZERO -- IS A TINY SLIVER ON THE 30 ACRES OF THE SUBJECT PROPERTY.
DOING THIS MINIMIZE NOTICE FOR THE MEETINGS ONLY A HANDFUL OF HOMES ON SAILFISH DRIVE RECEIVED NOTICE. WHETHER THIS WAS INTENTIONAL OR ACCIDENTAL IS IRRELEVANT.
THE FACT REMAINS THAT THE MEETINGS WERE LIGHTLY ATTENDED AND THE COMMITTEES COULD NOT CONTEMPLATE SUFFICIENT PUBLIC COMMENT. I WOULD STRESS THAT THEY ONLY DECIDE THE CASE THAT WHETHER OR NOT THEY BELIEVE THE APPLICANT SHOWED A GENERAL HARDSHIP.
I'M NOT CALLING FOR GATES TO NOT BUILD THE GAS STATION OR CARWASH.
THEY ARE FREE TO DO SO WITHIN THE BOUNDS OF THE CODE AFTER THEY GO TO THE PROCESS AND CONFORM ACCORDINGLY. THAT IS THE CONCLUSION OF MR. CAROL'S PREPARED STATEMENT.
I'M HAPPY TO TAKE QUESTIONS TO THE BEST OF MY ABILITY. THE APPLICANT IS NOT ABLE TO
SPEAK ANY QUESTIONS? >> THANK YOU VERY MUCH.
WE WILL NOW HEAR FROM THE APPELLANT.
>> GOOD MORNING. ALAN AVERY SMITH 100 WHETSTONE PLACE SAINT AUGUSTINE HERE ON BEHALF OF PONTEVEDRA COMMERCIAL PROPERTY WHICH IS AN AFFILIATED GATE PETROLEUM COMPANY WITH ME ARE HERBERT AND JOHN PAYTON ANDREW FRICK ALSO TONY ROBBINS NOT TONY ANDERSON AS OUR PROJECT PLANNER AND KIM ALLERGEN IS HERE IN CASE WE NEED ANY SUPPORT REGARDING WETLANDS WHICH THERE HAS BEEN SOME MISINFORMATION REGARDING AND ALSO BRAD DAVIS IS HERE ON THE CIVIL ENGINEERING SIDE AND MIKE ON THE ARCHITECTURAL SIDE. JUST TO BEGIN AS A FORMALITY, ALL OF THE APPLICATION MATERIALS THAT HAVE BEEN FILED BY GATES TEAM, YOUR STAFF REPORTS IN THE ORDERS APPROVING THE APPLICATIONS FROM THE ARCHITECTURAL REVIEW COMMITTEE AND THE PUNCHER BEECHER ZONING ADJUSTMENT BORDERING THE COUNTY'S FILE.
WE SUBMIT THOSE FOR THE RECORD FOR APPEAL. JUST TO GET GOING A LITTLE BIT.
I WANT EVERYBODY TO NOTE THAT THE PROPERTY THAT IS SUBJECT TO THIS APPLICATION IS LOCATED ALONG THE WEST SIDE OF A1 A IN THIS CONFIGURATION. GAIT OWNS ALL OF THIS PROPERTY.
THIS IS THE PROPERTY THAT IS SUBJECT TO THE APPLICATION. IT'S BEEN STATED ON THE PUBLIC RECORD IN ALL OF THESE HEARINGS. THE FUTURE LAND USE DESIGNATION AND THE COMMERCIAL USE WHICH ALLOWS THE CARWASH AND GAS STATION AS A MATTER OF RIGHT AS IS THE OR THREE ZONING. WE ARE NOT TALKING ABOUT A USE THAT IS NOT PERMITTED.
BY RIGHT. THERE'S BEEN SOME MISINFORMATION PROVIDED TO THE PUBLIC ABOUT WETLANDS BEING ON THE PROPERTY AND SO WE WANT TO BE CLEAR, AGAIN, THIS IS THE SUBJECT PROPERTY FOR THE GAS STATION AND CARWASH AND IN THE HISTORIC RECORDS OF THE WATER MANAGEMENT DISTRICT, THERE WERE HISTORIC HOLDING PONDS FOR A UTILITY PLANT IN THIS LOCATION.
THAT PLANT DOES NOT PUT ITS WATER IN THE POND AND SO THESE ARE THE PONDS THAT HAVE BEEN VEGETATED. THEY ARE NOT WETLANDS. MS. ALLERGEN IS HERE WE CAN TALK ABOUT THAT. I WANT TO BE CLEAR THAT THERE ARE ACTUALLY SEVERAL -- THERE
[02:15:05]
ARE TWO DIFFERENT APPLICATIONS THAT I WANT TO MAKE SURE THAT EVERYONE UNDERSTANDS THAT THERE IS A DIFFERENCE BETWEEN A ZONING VARIANCE IN A NON-ZONING VARIANCE BECAUSE ONLY A ZONING VARIANCE REQUIRES APPROVE OF HARDSHIP. A NON-ZONING VARIANCE DOES NOT.SO FOR THE SIGNS, WITH MR. ROBBINS WILL GO THROUGH THE DETAILS OF THE SIGNS.
BUT AGAIN, THE SIGNS ARE SUBJECT TO THE APPLICATION. AND WITH RESPECT TO THAT, THE VARIANCE WILL NOT BE CONTRARY TO THE PUBLIC INTEREST AND BY REASON OF EXCEPTIONAL NARROWNESS, SHALLOWNESS OR UNUSUAL SHAPE OF THE SPECIFIC USE OF PROPERTY OR BY REASON OF THE USE OR DEVELOPMENT OF PROPERTY IMMEDIATELY ADJOINING THE PIECE OF PROPERTY IN QUESTION, THE LITERAL ENFORCEMENT OF THE ZONING ORDINANCE WOULD CAUSE UNDUE HARDSHIP FOR THE APPLICANT. I POINTED OUT BECAUSE THERE IS A DECLARATION OF RESTRICTIVE COVENANTS THAT'S RECORDED AGAINST TITLE TO THIS GAUGE PROPERTY AND MR. CORNELIUS IS PROPERTY -- MR. CAROL'S PROPERTY THAT -- THAT IS THE IMMEDIATELY ADJOINING PROPERTY THAT REQUIRES THIS CONVENIENCE STORE TO BE SET BACK. THAT'S PART OF THE HARDSHIP.
IT'S NOT SELF-INDUCED BY GATES. NOW, WHEN WE TALK ABOUT -- I MENTIONED THE DECLARATION OF RESTRICTIVE GOVERNMENT, COVENANTS. YOU HAVE A A COPY IN YOUR APPLICATION NOTEBOOK. WE WOULD ARGUE THAT TREATING A SINGLE TENANT OWNER FOR MULTIPLE USES IN DIFFERENT PORTIONS OF THE PROPERTY DIFFERENTLY THAN OTHER PROPERTIES ALONG A1 A CONSTITUTES A HARDSHIP. YOU REVIEW MANY LAND DEVELOPMENT ITEMS. YOU KNOW THAT AN APPLICANT CAN ASK FOR UNIFYING SIGN PLAN AND NOT HAVE TO PROVE HARDSHIP. THAT WOULD CAN BE APPROVED BY A WAIVER.
THIS IS SIMILAR TO WHAT WERE ASKING FOR, THE UNIFIED SIGN PLAN FOR THE GATE CARWASH AND CONVENIENCE STORE. THE CONVENIENCE STORE INCLUDES NOT ONLY A CONVENIENCE STORE ASPECT BUT A YOGI AND KITCHENETTE NEED TO BE BRANDED. MR. ROBBINS WILL TALK ABOUT THAT. SO -- AND THEN GOING INTO THE NON-ZONING VARIANCE, AGAIN, IT DOES NOT REQUIRE PROOF OF HARDSHIP. WE ARE DEALING WITH THE PORTION OF THE STORE ABOUT THE FUEL CANOPIES AND THE FLAT ROOFS. WE ARE DEALING WITH THE LENGTH OF THE CARWASH BUILDING IN ORDER TO GET MECHANICAL EQUIPMENT TO BE PUT INSIDE FOR NOISE BUFFERING AND WE ARE TALKING ABOUT THE LANDSCAPE. SO AGAIN, THE LEGAL REQUIREMENTS FOR A NON-ZONING VARIANCE DID NOT REQUIRE THE PROOF OF HARDSHIP.
THEY REQUIRE THESE. THESE ARE OUT OF YOUR LAND DEVELOPMENT CODE.
IN THE INTEREST OF TIME I'LL TURN IT OVER TO MR. COPENHAVER AND MR. ROBINSON THEY WILL TAKE
ANTHONY ROBBINS 13901 SET PARK DRIVE. BEGINNING WITH THE ADDITIONAL GROUND SIGN ON THE IMAGE BEFORE YOU, ONE GROUND SIGN IS AUTHORIZED FOR ONE -- IF THE PARCEL IS BUT THERE BE NO NEED FOR THE REQUEST. LET ME REITERATE OTHER PARTS OF THE CODE THAT ARE NOT MENTIONED ENOUGH AND THAT IS THE FACT FOR THE PURPOSE AND INTENT OF THE REGULATIONS DEAL WITH THE REDUCTION OF VISUAL CLUTTER OF VISUAL DISTRACTION.
AND USE OF UNIFORM SIGNED CRITERIA THAT CAN CLUSTER COMPLEMENTARY SIGNAGE.
IN PARTICULAR THAT PORTION ENCOURAGES THE USE OF THIS UNIFORM METHOD.
SO WHEN THE REQUEST IS FOR MORE THAN ONE SIGN EVEN THOUGH THERE'S ONLY ONE STREET FRONTAGE. INSTEAD OF A 60 FOOT SIGN THE OWNERS PROPOSED SMALLER SIGNS AND AGREED TO THE COLOR ADJUSTMENTS. BY ALLOWING THOSE TWO GROUND SIGNS THEY ARE WITHIN THE PERIMETER BUFFER. THERE IS AN EXISTING SIDEWALK.
AGREEING TO THE SIZE LIMITATION AND KEEPING IT AS FAR BACK FROM A1 A WHILE MAINTAINING THE SAFETY. THE SIGNS WILL BE LANDSCAPED AS WELL TO INCREASE THE COMPLEMENTARY NATURE AND COHESIVENESS WITHOUT CREATING A DISTRACTION.
AS IT RELATES TO THE INCREASED NUMBERS OF SIGNS, THE REQUEST IS SMALLER WITHIN THE A ADJACENT SHOPS. THE REQUEST -- IN ORDER TO HAVE THEM RECOGNIZABLE.
ON THE TOP PICTURE OF THE CONVENIENCE STORE IT HAS ONE OPTION OF THE COLOR -- WITH
[02:20:15]
BLACK-AND-WHITE MOSTLY ONLY FULL-SIZE SIGNS BUT THAT WAS AN OPTION THAT WAS AGREED TO THAT IF THEY WISH TO INCLUDE THE COLOR WHICH IS TRADEMARKED, THAT THEY BE LIMITED TO ONLY 24 SQUARE FEET, BUT EVEN WITH THE LARGER AREA, MR. SHARON MEMBERS OF THE COMMISSION THE ENTIRE SIZE OF THE SIGNAGE ALONG THE BUILDING IS FAR LESS THAN 10 PERCENT OR 50 PERCENT OF WHAT IS PERMISSIBLE IN OTHER AREAS. IT'S NOT AS IF THE WALL SIGNS ARE TAKING UP THE END TIRED -- THERE'S FAR FEW BUILDINGS. IT'S FAR SMALLER THAN THE BUILDING ITSELF WHILE LONGER AND IT DOES HAVE THE ARCHITECTURAL TREATMENTS AND LANDSCAPING THAT ALL TOUCH BASEON IN A MOMENT TO. >> PLACEMENT OF THE SIGN THAT DOES NOT FACE THE STREET CAME UP AT THE LAST MINUTE BUT BECAUSE WE SPLIT THE CANOPY WE CAN ONLY HAVE ONE WALL SIGN SO THIS REQUEST IS FOR THE NORTH OF THE SOUTH SIDE.
SPLITTING THAT CANOPY AND HAVING THE FLAT ROOF MR. KOBER HAGAN WOULD LIKE TO ADDRESS THE
IT'S A PLEASURE TO BE HERE THIS MORNING. IN TERMS OF THE FLAT ROOF SOME OF YOU MAY KNOW I WAS THE CHAIRMAN OF THE PONTEVEDRA AREA C FOR A NUMBER OF YEARS AND I KNOW THAT CODE WELL. AND THAT CODE DOESN'T -- WELL IT ISN'T A ONE-SIZE-FITS-ALL CODE. THE OVERLAY WAS DEVELOPED TO ENSURE THAT UNATTRACTIVE AND LARGE BIG BOX TYPE BUILDINGS WERE NOT APPROVED WITHOUT MORE AESTHETIC APPEAL IN THE PONTEVEDRA AREA. SO AS YOU CAN SEE BASED ON THIS DRAWING AND WHAT THE ARC ALSO APPROVED WAS THE RENDERINGS GOT A HIGHER DESIGN AESTHETIC THAN THE TYPICAL STRUCTURE.
THE INDIVIDUAL ROOFLINES OF MATERIAL CHANGES IN THE SAW GIVEN ATTRACTIVE APPEAL.
THE DETAIL REVIEWS MATERIAL CHANGES RECESSED WALLS AND A CURBING FRONT ENTRYWAY.
GAIT HAS GONE TO GREAT LENGTHS TO MAKE THIS ATTRACTIVE. ONLY A PORTION OF THE BUILDING RECEIVES A FLAT ROOF. IT IS STILL 200 FEET AWAY FROM THE RIGHT-OF-WAY ITSELF.
I THINK SEEING IS BELIEVING ENOUGH GOT A COUPLE OF IMAGES THAT I CAN PUT ON THE CENTER HERE. AND YOU ALL CAN TELL FOR YOURSELF.
>> AND MR. COPENHAVER IF THESE ARE NOT ALREADY IN THE RECORD I'D ASK YOU TO SUBMIT THEM
AFTER PRESENTATION BOX I WILL. >> SO AGAIN, YOU CAN SEE IT'S DONE TASTEFULLY.
DO NOT KNOW IF ALL OF YOU HAVE GOTTEN A CHANCE TO VISIT THAT.
THERE IS AN AMPLE AMOUNT OF LANDSCAPING AROUND THAT AS WELL.
WE HAVE THE LANDSCAPED ISLANDS WHICH HAVE BEEN INCREASED IN SIZE AND FLANKED THE ENTRANCEWAY. IT'S NOT IN THE CENTER THERE. A LOT MORE PEOPLE COINCIDE AND THAT'S PART OF -- (INDISCERNIBLE) -- THE APPLICANT MENTIONED WITH THE TRASH. JUST THE IMAGES OF THE STORE ITSELF AS A REFERENCE.
>> THANK YOU. >> COMING BACK TO THE REQUEST FOR THE LONGER BUILDING, THE REQUEST OF LENGTH ALLOWS THE MAJORITY OF THE EQUIPMENT, THE CLEANING COMPONENTS, THE DEVICES AND STORAGE SPACES TO BE ENCLOSED AND SCREENED FROM VIEW. IT'S ONLY THE VACUUMS IN THE PEG AGE BEING OUTDOORS.
THE LENGTH OF THE BUILDING WILL BE NOTICEABLE TO THE REAR OF THE PROPERTY WHICH I WILL SHOW YOU IN A MOMENT BUT THE FACADE WILL BE -- IT WILL BE THIS MONOLITHIC MONSTROSITY THAT'S NOT THE WORD HE USED A PLANE BUILDING. THAT IS NOT THE CASE.
THE RENDERING IS THERE BE FOR YOU BUT THERE WILL BE LANDSCAPING HARDSCAPE FEATURES AND BREAKING UP INTO SMALLER ELEMENTS. WE AGREED THAT THE ENHANCING OF LANDSCAPING OF THE VACUUMS AT THE ARC AND AT THAT POINT, THE BLUE BOX ON THE LOWER LEFT IMAGERY IS THE LOCATION FOR THE CARWASH MUCH MORE TO THE WEST THEN MERCHANTS PLAZA OR THE SHOPS AT PONTEVEDRA. AND THE ANGLE IS NOT PARALLEL BUT IT SET BACK FARTHER.
[02:25:11]
ALSO, THE TWO BUILDINGS TO THE NORTH AND SOUTH WERE DOUBLE AND ALMOST TRIPLE WHAT WE ARE REQUESTING. THE INCREASE OF 25 FEET IS NOT OUT OF CHARACTER WITH WHAT IS IN THE IMMEDIATE AREA AND WE CAN DISCUSS IT FURTHER IF QUESTIONS COME UP.LASTLY THE LANDSCAPING NOT BEING BETWEEN THE DOORS AS THOSE PRESENTED PREVIOUSLY IS ACCURATE. GATES HAS BEEN AT THIS BUSINESS FOR QUITE A WHILE AND THEY KNOW WHAT DOESN'T WORK. SO INCLUDING THE ISLANDS AROUND THE DOORS -- IT'S NOT LIKE THEY'RE GETTING OUT OF THE LANDSCAPING. LOOKING AT THESE ELEMENTS AND ANALYZING THE VARIANCES REQUIRE YOU TO TAKE THEM A PIECE AT A TIME.
THE VISION IS IF I'M TRAVELING ON THE GOLF COURSE HEADING TOWARD JACKSONVILLE BEACH.
IF YOU ADD THE ELEMENTS OF THE CONTROLS THAT HAVE BEEN INSTALLED, THE LANDSCAPING PLAN, THE LOWER ELEMENTS IN THE STYLE THAT THEY'RE PROVIDING, WE WANT TO PRESENT YOU WITH AN IMAGE OF WHAT ALL THE ELEMENTS TOGETHER COMBINED, THE COMPROMISES THAT WERE GIVEN, THE ELEMENTS THAT WERE GIVEN WITH THE GRANTING AND GETTING BACK TO THE CODE THE CODE HAS PROVISIONS FOR RELIEF AND THERE ARE ELEMENTS THAT ENCOURAGE MORE COMPATIBLE DEVELOPMENT.
>> I WANTED TO MENTION -- THE BOARDS WHICH ARE EXPERTS IN THEIR FIELD HAVE APPROVED BOTH OF THESE APPLICATIONS. THEY DID FIND AND WE HAD A LONG DISCUSSION ABOUT HARDSHIP AND THEY FOUND FOR THE ZONING VARIANCE APPLICATION WHICH IS THE ONLY ONE THE HARDSHIP IS APPLICABLE TO THAT THERE WAS HARDSHIP. I ALSO WANT TO NOTE THAT IN THE ZONING VARIANCE APPLICATION, THERE ARE TWO PARCEL IDENTIFICATION NUMBERS NOTED AND IN THE NON-ZONING VARIANCE THERE ARE TWO NUMBERS NOTED JUST TO CLARIFY SOMETHING THAT THE APPELLANT SAID A FEW MINUTES AGO. SO WITH THAT WE ARE HERE TO ANSWER WHATEVER QUESTIONS YOU MAY HAVE AND WE WOULD RESPECTFULLY REQUEST THAT YOU
DENY -- >> ANY QUESTIONS FOR THE
WE WILL MOVE ALONG INTO PUBLIC COMMENT. BEFORE WE DO THAT, HAVE WE HAD ANY ANSWERS -- I NOTICED WE HAD FOUR CALLS WAITING AND NOW THEY LOOK LIKE TO CUT OFF BUT
I CHECKED WITH STAFF TO ANSWER THE PHONE LINES. JUST FOR THE LISTENING PUBLIC THE CALLING NUMBER IS 209-1625 -- EXCUSE ME 209-1265. I APOLOGIZE.
THAT NUMBER HAS BEEN PROVIDED AS WELL AS THE LISTENING PUBLIC THE NUMBERS FLASHED ACROSS THE BOTTOM. IF FOR SOME REASON SOMEONE IS DISCONNECTED THEY CAN CALL BACK. WE WILL GET THEM IN THE QUEUE. IF IT CONTINUES TO BE A PROBLEM MR. CAROL CAN INDICATE WHEN SOMEONE IS NOT ABLE TO GO THROUGH BUT STAFF HAS ASSURED
ME THAT ANYONE CAN CALL. >> THAT NUMBER IS 904THAT
ANYONE CAN CALL. >> THAT NUMBER IS 904-209-1265.
ALL RIGHT. >> PUBLIC COMMENT ON AGENDA ITEM NUMBER FOUR. IF YOU ARE HERE TO SPEAK, PLEASE COME FORWARD.
SEEING NONE HERE, WE WILL GO TO THE PHONE.
>> WILL GOOD MORNING. CAN YOU STATE YOUR NAME AND ADDRESS FOR THE RECORD, PLEASE?
>> YES. THIS IS JOE MCINERNEY. I AM A ST. JOHN'S RESIDENT 1005
BLACKBERRY LANE IN ST. JOHN'S. >> COHEAD.
OKAY. THANK YOU VERY MUCH COMMISSIONERS.
I DID SEND AN EMAIL TO YOU AND THE COUNTY ATTORNEY LAST WEEK. OUTLINING OBJECTIONS TO THE GRANTING OF THESE VARIANCES. AND THAT WAS BASED ON MY VIEWING OF THE JANUARY MEETING IN WHICH I DID TAKE EXCEPTION TO THE APPLICANT'S CONTENTION THAT THERE WOULD BE NO DETRIMENT TO PUBLIC WELFARE OR OTHER IMPROVEMENTS IN THE AREA. AND CERTAINLY BY NOT COMPLYING WITH THE DISTRICT OVERLAY, THERE WOULD, IN FACT, BE THE POTENTIAL FOR A DETRIMENT TO OTHER IMPROVEMENTS AS OTHER APPLICANTS AND WOULD STEP FORWARD REQUESTING LARGER
[02:30:05]
SIGNS, COLORED SIGNS IT WOULD BEGIN A PROCESS OF DESTROYING THE AESTHETIC OF THE OVERLAY DISTRICT. SECONDLY, THE APPLICANT MAINTAINED HARDSHIP BASED ON SETBACK. AND OTHER IMPROVEMENTS ALONG THE DISTRICT HAVE NOT CLAIMED A SETBACK HARDSHIP. IT SEEMED TO ME THAT WAS NOT A VALID CONTENTION TO MAKE.THIRDLY, THAT THE SIGNAGE SHOULD BE INCREASED BASED ON PRECEDENTS INCLUDING SAWGRASS VILLAGE AND THE VERANDA. BUT WHERE SAWGRASS VILLAGES 38 SAWGRASS VILLAGES 38.8 ACRES OF A TOWN CENTER CONCEPT AND WHERE THE RENT IS 14.97 ACRES, OF MIXED OFFICE COMMERCIAL USE, THIS IS A FIVE-ACRE GAS STATION AND CARWASH. THE REALLY NOT APPLICABLE.
I DID CONCLUDE IN THAT EMAIL THAT GATE IS REALLY -- HAS DEVELOPED A PROTOTYPE UNIT THAT THEY ARE ATTEMPTING TO SIDE APPEAR IN PONTEVEDRA. AND RATHER THAN TO ADAPT THEIR PROTOTYPE TO THE STANDARDS OF PONTEVEDRA, AND THE COUNTY, THEY ARE ASKING THE COUNTY TO ADAPTED STANDARDS TO THEIR PROTOTYPE. IT DID SEEM BACKWARD.
AND INAPPROPRIATE. I WOULD LIKE TO MAKE ONE FINAL STATEMENT, I AM A RETIRED ARCHITECT. AND I CERTAINLY DO ADMIRE THE WORK THAT THESE ARCHITECTS AND PLANNERS HAVE DONE. THE PROJECT REALLY IS QUITE ATTRACTIVE.
I BELIEVE IN ARCHITECTURE AND I BELIEVE IN ARCHITECTS. AND I BELIEVE THAT THE CARWASH, FOR EXAMPLE, IF ONE BAY COULD BE REDUCED OR TAKEN OFF IT WOULD REDUCE THE LENGTH TO THE HUNDRED 20 FEET. AND CERTAINLY THE ARCHITECTS, THESE GOOD ARCHITECTS KNOW THAT THROUGH THE USE OF DESIGN METHODS, WALL DESIGN MATERIALS AND PATTERNS THAT POINTS OF INTEREST CAN BE ESTABLISHED ARCHITECTURALLY. AND THAT THE ARCHITECTURE SHOULD STAND ON ITS OWN AND THE -- THE SIGNS ARE NOT NEEDED TO BE EXCESSIVE LENGTH SO, I DO AS THAT THE COMMISSIONERS CONSIDER THESE MINOR MODIFICATIONS AS A WAY OF AVOIDING HAVING TO GRANT A VARIANCE AND THEREBY ACCOMPLISHING THE PRESERVATION OF THE OVERLAY DISTRICT DESIGN STANDARDS AND SO -- ALL RIGHT. THANK YOU VERY MUCH.
>> THANK YOU. GOOD MORNING. PLEASE STATE YOUR NAME AND
ADDRESS FOR THE RECORD, PLEASE. >> GOOD MORNING.
MY NAME IS ROBERT MCVEIGH AND I LIVE AT EIGHT TARPON ROAD IN PONTEVEDRA BEACH.
>> COHEAD MR. ROBERT. >> GOOD MORNING.
ONCE AGAIN MY NAME IS ROBERT MCVEIGH. I'M A PROPERTY ADJACENT TO THE PROPOSED DEVELOPMENT SITE I REPRESENT THE MAJORITY OF RESIDENTS WHICH IS A SUBDIVISION SURROUNDING THE LAND WITH A WHEN A BEING THE FOURTH SIDE.
BEFORE I GET INTO THE OBJECTION THIS MORNING AND BECAUSE WE FEEL EXTREMELY RELEVANT AND IMPORTANT I LIKE TO RECAP BRIEFLY VERY BRIEFLY WHY THERE IS AN OUTPOURING OF OBJECTION FOR THIS PROPOSAL. FIRST OFF, THE PLANNING AND STORM A MAJOR CONFLICT OF INTEREST. IT HAPPENED MULTIPLE TIMES IN OUR COMMISSIONER -- THE RESIDENTS FEEL LIKE 1/3 GAS STATION IS IN THE BEST INTEREST OF THE COMMUNITY.
ALL THE ADDED NECESSARY WILDLIFE -- THERE'S NO LAND TO ENTER THE MARKET OUT THERE.
THEY HAVE NOTHING TO WORRY ABOUT. ALL OF THE PLAN IS CLASSIFIED AS WET LANDS AND THEY ONLY PAID $1400 IN PROPERTY TAXES ON ABOUT 30 ACRES AND NOW THEY WANT TO SAY IS NO LONGER WETLANDS AND BUILD ON IT. FOR COMPARISON THE AVERAGE CITIZEN PAYS ABOUT 2500 A YEAR IN TAXES ON ONLY QUARTER ACRE LOTS.
HOW IS THIS FAIR TO US. THE FACT THAT THIS MEETING WAS CALLED DURING THE MIDDLE OF A
[02:35:01]
PANDEMIC BY COMMISSIONER WHO IS NOT EVEN CLOSE TO THE DISTRICT IS SUSPICIOUS AND THE COMMUNICATION HASN'T HELP THE SITUATION BECAUSE MANY CITIZENS RECEIVED AN EMAIL THAT THIS ITEM WAS GOING TO BE POSTPONED AND THEN THAT DECISION WAS REVERSED.WE ARE WELL AWARE OF THE LONG-TERM PLAN FOR THE LAND AFTER THE GAS STATION GETS BILLED WHICH INCLUDES A 340 UNIT APARTMENT COMPLEX BUILDS ON WETLANDS.
E KNOW THAT IF THE APARTMENT COMPLEX WERE TO BE BUILT FIRST THEY WOULD NOT BE ABLE TO GET THEIR GAS STATION TO MEET WITH THE ZONING LAWS. LET'S SEGUE TO THE VARIANCES INTO THE BUILDING CODES WHICH ARE AT THE ROOT OF TODAY'S GATHERING.
THE BUILDING CODE STATES EXCEPTIONS CAN BE GRANTED IF A HARDSHIP WERE TO OCCUR.
>> IT'S IMPOSSIBLE FOR THEM TO HAVE A HARDSHIP IF THE ONLY OTHER ACREAGE BEHIND THE GAS STATION. THERE'S PLENTY OF ROOM FOR THEM TO REPOSITION.
THE BUILDING CODES ARE IN PLACE FOR A REASON TO PROTECT THE BEACH FROM TURNING INTO THIRD STREET AND FROM TURNING IT INTO JACK'S BEADWORK FROM TURNING IT INTO BEACH BOULEVARD WHICH IS WHAT THE CITIZENS WANT THE CAREFULLY PLANNED BLENDING OF THE NATURAL ENVIRONMENT IS ONE OF THE REASONS WHY PONTEVEDRA BEACH IS A SPECIAL PLACE TO LIVE AND CALL HOME.
AND TO MAKE EXCEPTIONS TO THE BUILDING CODE SETS A DANGEROUS PRECEDENT.
>>CHAIRMAN SMITH: YOUR TIME IS UP HAVE A GREAT.
>> TIME IS UP? HAVE A GREAT DAY AND STAY SAFE.
>> GOOD MORNING. HOLD ON ONE SECOND FOR ME MA'AM.
>> LAST WEEK THEY WOULD LET ME TALK THIS WEEK THEY'RE BEEPING IN.
>> PLEASE STATE YOUR NAME AND ADDRESS FOR THE RECORD.
>> MARY CONCRETE. PALM VALLEY.
>> THE REASON I'M CALLING IS THAT WE WORKED A LONG TIME GETTING THE OVERLAY DISTRICTS PUT IN AND GETTING ARCHITECTURE TO REVIEW THINGS AND GET IT ESTABLISHED UP HERE BECAUSE PEOPLE APPEAR SAID THEY WANTED CERTAIN STANDARDS. AND THE COMMERCIAL PEOPLE COME IN AND THEY ALWAYS WANT A LITTLE BIT MORE OR A LITTLE BIT HERE AND PUSH IT A LITTLE BIT THERE. I THINK THEY HAVE DONE, ON THIS, A FAIRLY DECENT JOB IN TERMS OF MAKING LOOK BETTER THAN WHAT WE ORIGINALLY SAW. HOWEVER, I WOULD LIKE TO BRING TO THE BOARD'S ATTENTION THAT THE OVERLAY DISTRICTS AND THE ARCHITECT -- THESE THINGS THAT WE PUT IN ERROR ARE PUT IN FOR A REASON. THEY ARE PUT IN BECAUSE PONTEVEDRA DOES NOT WANT TO LOOK LIKE A COMMERCIAL CENTER. AND I THINK THAT THE BOARD SHOULD LOOK AT THIS AND NOT JUDGE US IN WHAT WERE DOING ON A IA BY ANYTHING ELSE THEY SEE IN THE COUNTY. BECAUSE THIS WAS DESIGNED TO KEEP PONTEVEDRA LOOKING EXACTLY LIKE IT DOES. THEY DON'T MUCH LIKE COMMERCIAL EXCEPT THAT THEY DO LIKE TO GET GAS AND THEY DO LIKE TO SHOP AND THEY DO LIKE TO EAT. OF COURSE IT'S HAVING THE CAKE AND EAT IT. AND SO WHAT THEY DID IS THEY TRY TO CUT IT DOWN TO A POINT WHERE IT WAS ACCEPTABLE TO THE PUBLIC AND WE HAD A LOT OF HEARINGS BEFORE THIS WAS ACCEPTED. ANYTIME SOMEBODY WANTS TO COME IN AND MAKE CHANGES, I WOULD REALLY LIKE TO SUGGEST TO THE COMMISSION AND THE STAFF THAT THEY LOOK AT THESE WITH A VERY JAUNDICED EYE BECAUSE THEY KNOW WHAT PONTEVEDRA LOOKS LIKE. IN -- NOW GATE DID HAVE MASSIVE -- BUT THE VERY FACT THAT THEY HAD TO MAKE THEM TELLS YOU WHAT THEY CAME IN AND WANTED TO DO IN THE FIRST PLACE, WHICH WAS TOTALLY UNACCEPTABLE HERE. SOME GLAD THAT THE CHANGES WERE MADE, BUT I WOULD REALLY LIKE TO BRING TO THE BOARD'S ATTENTION AND FOR THE BOARD TO BRING IT TO THE STAFF'S ATTENTION, THAT THESE RULES AND REGULATIONS ON THE OVERLAY DISTRICT WERE SET UP FOR THE COMMUNITY, NOT TO MATCH ANYTHING ELSE IN ST. JOHN'S
[02:40:03]
COUNTY. NOW I THINK THIS MIGHT TURN OUT TO BE HALFWAY DECENT, BUT I WOULD SAY THERE'S NO HARDSHIP HERE AT ALL. I DON'T SEE ANY HARDSHIP TO ANYTHING GATE DOES TO THEMSELVES. BUT THAT'S BESIDE THE POINT.SO I WOULD JUST LIKE TO HAVE YOU KEEP IN MIND THAT YOU ARE DEALING WITH A -- WHAT THE PUBLIC WANTED A PAIR AND NOT BUT A PERSON COMING IN AND BUILDING SOMETHING WANTS AND WHAT THEY THINK THE PUBLIC WANTED SO THANK YOU VERY MUCH AND HAVE A GOOD DAY.
>> YOU TOO. GOOD MORNING. IF YOU WOULD PLEASE STATE YOUR NAME AND ADDRESS FOR THE RECORD, PLEASE?
>> GOOD MORNING. 611 PONTEVEDRA LAKES BOULEVARD.
>> GO AHEAD. >> ON MY CURRENT BIOLOGY STUDENT AT THE UNIVERSITY OF NORTH FLORIDA. I PREVIOUSLY WORKED AT THE RESEARCH RESERVE AND AM A FORMER EMPLOYEE OF PAIN. I JUST WANTED TO EXPRESS MY CONCERN AS THIS PIECE OF LAND BEING CRUCIAL HABITAT FOR A LOT OF THE ANIMALS THAT ACTUALLY LIVE ON THE LAND THAT THEY GAVE UP BACK IN 84. I CAN'T IMAGINE THAT HE DID THAT FOR THE -- I WOULD LIKE TO STATE THAT THIS IS A PIECE OF CRUCIAL HABITAT THAT NOT ONLY ORGANISMS THAT ARE CURRENTLY THERE, BUT ORGANISMS HAVE MIGRATED THROUGH THE AREA AND USE IT FOR BREEDING PURPOSES AND SUCH. I CAN'T IMAGINE THAT ANYMORE CARE WOULD BE GIVEN A WILDLIFE IF THE VOICES OF CONCERNED CITIZENS ARE NOT EVEN LISTEN TO WHAT WOULD LIKE TO STATE THAT IT'S AN IMPORTANT PIECE OF LAND AND I WOULD SAY THAT CONSIDERING THERE IS A MASSIVE GATE STATION IN NOKIA T AS WELL AS JACK'S SPEECH I THINK IT'S UNNECESSARY AND IT'S REALLY GOING TO DO A LOT MORE HARM THAN HELP.
AND I THINK THAT PONTEVEDRA BEING THE BEAUTIFUL PLACE IT IS, WE NEED TO HOLD ONTO THE PIECES OF LAND THAT WE HAVE LEFT. AND THANK YOU ALL FOR
>> GOOD MORNING. PLEASE STATE YOUR NAME AND ADDRESS FOR THE RECORD, PLEASE.
>> CHANDRA CLARK 62 POND: LANE PONTEVEDRA.
>>. [BLEEP] DEE. GO AHEAD BUXOM CALLING TO REGISTER MY COMPLAINT AGAINST GAGE BUILDING A STATION ON THE WETLANDS HERE IN PONTEVEDRA.
MY CONCERN IS THE DESTRUCTION OF HABITAT FOR A VITAL ANIMALS WHO MAKE THEIR HOME THERE AND ORGANISMS. SO THAT SO THAT IS MY CONCERN AND ALSO,
THAT PRETTY WELL SUMS IT UP. IT'S WETLANDS AND I DON'T WANT DESTROYED BECAUSE OF THE HABITAT THAT IT DESTROYS FOR ANIMALS.
>> YES, MA'AM. >> SO THAT'S IT.
>> OKAY. THANK YOU FOR YOUR INPUT.
>> ARE WELCOME. GOOD MORNING. PLEASE STATE YOUR NAME AND
ADDRESS FOR THE RECORD, PLEASE. >> SURE.
MY NAME IS BRIAN ELIASSON I LIVE AT -- (INDISCERNIBLE). I'M CALLING BECAUSE I'M CONCERNED WITH WHAT IS GOING TO HAPPEN WITH THE POND THAT IS NEXT TO THE AREA.
I MISSED THE FIRST PART SO I'M NOT SURE WHERE THIS DEVELOPMENT IS GOING TO BE, BUT THE POND THAT IS RIGHT NEXT TO THE SIDEWALK, IT HAS A LOT OF WILDLIFE.
AND WHEN WE PASS BY EVERY DAY, WE BIKE AROUND IT AND WE STOPPED BY AND WE SEE THE FISH.
THERE'S A LOT OF WILDLIFE IN THAT AREA. AND I FEEL THAT IS GOING TO BE DISPLACED. AND YOU KNOW, IT JUST GIVES US SOMETHING TO LOOK AT WHEN WE PASS BY. AND WE BIKE WITH MY DAUGHTER EVERY DAY.
[02:45:04]
IT'S REALLY SAD THAT THERE'S NO OTHER POND AROUND THAT WE CAN SEE.THERE'S BIG FISH THAT WE HAVE JUMP IN THE POND. THEY ARE LIKE TWO FEET LONG.
AND THEY ARE -- IT'S A PIECE OF GREENERY THERE'S DUCKS AND GEESE, THERE'S LOTS OF ANIMALS LIVING IN THAT LITTLE AREA. AND I JUST WAS WONDERING IF IT'S GOING TO BE DEVELOPED OR NOT. I JUST WOULD BE SAID TO SEE IT GO.
BUT THAT'S ALL I WANTED TO SAY. THERE.
>> AND THAT'S ALL I WANTED TO COMMENT ON.
>> MY NAME IS MARY BARTLETT. I MET 62 POND VALLEY LANE IN PONTE VEDRA. YEAH.
GO AHEAD. >> I WAS DISAPPOINTED WE HAVE TO DRAW THE LINE SOMEWHERE. WE ARE USING UP ALL OF OUR NATURAL RESOURCES WE HAVE TO STOP. OR IT'S NOT GONNA STOP. WE LOOK AT SOUTH AMERICA WE WANT THEM TO SAVE THEIR NATURAL RESOURCES SO I NEED THINK WE NEED TO BE AN EXAMPLE FOR OTHER COUNTRIES I DON'T KNOW WHAT PROOF THEY HAVE I WOULD RATHER THEY SPEND THEIR TIME AND ENERGY LOOKING AT SOMETHING MORE ENVIRONMENTALLY SUSTAINABLE LIKE SOLAR ENERGY FOR CARS OR STUFF LIKE THAT THAT'S ALL I HAVE.
>> WE APPRECIATE YOUR INPUT. THANK YOU.
>> MR. CHIRI WOULD LIKE TO INTERJECT AND I WAS GOING TO PROVIDE THIS INFORMATION TO THE BOARD LATER. ANY ISSUE ABOUT WETLAND OR PONDER THAT TYPE OF THING? IT'S NOT PART OF THE APPLICATION AND IS NOT PROPERLY PART OF THIS AGENDA ITEM.
PEOPLE CAN SPEAK IN PUBLIC COMMENT WHATEVER THEY WISH TO, BUT IT WOULD BE MY ADVICE TO THE BOARD THAT CRITERIA TO THE ZONING VARIANCE AND ARC APPEAL. NOT TO THE ISSUE WETLAND AND THAT TYPE OF THING. THANK YOU.
>> OKAY. IS THERE ANY OTHER PUBLIC COMMENT?
>> OKAY. SO SEEING NONE ON THAT,
>> MR. CHAIR, THERE WAS A CONSTITUENT WHO HAD WRITTEN IN AND I THINK PROVIDED A POWERPOINT, THAT TYPE OF THING. SHE INDICATED SHE MAY HAVE HAD SOME DIFFICULTY CALLING IN AND
SO, I THINK STAFF HAS THAT. >> I WAS GOING TO ASK HIM TO BE FAIR IF THEY HAD A PROBLEM THEY SAID SEND A TEXT IF THEY GIVE US THE NAME AND NUMBER WE WILL CALL THEM AND THEY CAN PUT THEIR PUBLIC COMMENT. I DO NOT KNOW HOW MANY PEOPLE GO THROUGH THAT SHE SAID COULD NOT. I THINK ON EITHER SIDE.
IF YOU WOULD GO TO THEM WANT TO GIVE THEM THEIR NAME AND NUMBER WE WILL CALL.
SECOND DOOR. WE CERTAINLY DO NOT WANT ANYBODY TO BE LEFT OUT.
>> MR. CHAIR JUST AS A REMINDER MR. CONRAD INDICATED THAT THE CALLING NUMBER IS 904
>> MR. CHAIR JUST AS A REMINDER MR. CONRAD INDICATED THAT THE CALLING NUMBER IS 904209, 1265.
[02:50:13]
>> I'LL SAY FOR THE RECORD WE HAVE NOT BEEN ADVISED BY TECHNICAL STAFF THAT WE'VE HAD ANY TECHNICAL ISSUES. THAT -- THAT WOULD CAUSE CALLERS NOT BEING ABLE TO:.
THERE MAY BE ISSUES ON THE CALLER SIDE THAT HAVE TECHNICAL ISSUES, BUT AS COMMISSIONER WALDEN INDICATED IF WE CAN RACH OUT TO THEM WE WILL DO OUR BEST.
>> IT CERTAINLY MAY BE ON THEIR SIDE.
>> GOOD MORNING. HAVE YOU GONE;-).
>> GOOD MORNING, COULD WE HAVE YOUR NAME AND ADDRESS FOR THE RECORD, PLEASE?

I WOULD LIKE MY SENTIMENTS KNOWN I WOULD LIKE TO SAY NO. PLEASE, DO NOT DO THAT.
>> OKAY. ANY OTHER COMMENTS? I THANK YOU FOR YOUR SERVICE AND THANK YOU FOR TAKING INTO CONSIDERATION BECAUSE I LIVE RIGHT OFF OF A WHEN A ON THE GOLF COURSE, WHOLE MIND AND THEY CUT BACK TREES SO MUCH THAT I SEE TRAFFIC NOW.
WHEN I MOVED HERE IN 2012 I DID NOT EVEN KNOW THAT WAS A WAY. I WAS NEW TO THE BEACH I DID NOT EVEN KNOW THAT WAS A WHEN A. NOW I'M LOOKING AT TRAFFIC AS I'M SPEAKING TO YOU FLYING BY ALL NINE ON THE LAGOON COURSE. AT NIGHT ALL OF THOSE NEON LIGHTS SHINE INTO MY HOUSE. I HAVE A TWO-STORY HOUSE. ONE OF THE FIRST TWO STORIES THAT WAS A REBEL. THEY REBUILT IT IN 078 BIG TWO-STORY SHINGLE AND I'M SO SADDENED BY WHAT IS HAPPENING HERE. MY HEART BREAKS EVERY SINGLE DAY. THE NOISE POLLUTION AND THE EYESORES ON A1 A IS TERRIBLE.
OUR BEAUTIFUL COMMUNITY IS TURNING INTO A PUBLIC CONGESTED NOISY PLACE.
IT'S VERY UPSETTING. I'M DOING THE BEST I CAN TO PRESERVE WHAT I CAN ON MY
THANK YOU FOR YOUR INPUT. >> THANK YOU FOR YOUR TIME.

>> MR. CHAIRMAN, THAT'S ALL I SEE.
>> FOR PUBLIC COMMENT NOW CLOSE, WE WILL GO TO REBUTTAL.
>> I'M SORRY, MR. CHAIR. THERE HAD BEEN ONE CONSTITUENT GENERAL WAS AND WHO HAD EMAILED IN AND I THINK HAD PROVIDED A POWERPOINT. SHE DID WANT TO HAVE PRESENTED FOR PUBLIC COMMENT. AND IF I MAY, JUST TO PROVIDE AS MUCH INFORMATION TO THE BOARD, AS REASONABLY POSSIBLE, I WOULD LIKE TO READ HER EMAIL. AND I THINK THAT HER POWERPOINT IS UP AND THIS WOULD SORT OF, I THINK, BE CONSIDERED HER PUBLIC COMMENT.
IF I MAY, MR. CHAIR. >> YES, SIR.
>> SO, THIS IS JANE RAWLINSON. SHE SAID 543 GRANADA TERRACE PONTE VEDRA BEACH.
I PLAN ON CALLING INTO THE BOC C MEETING TOMORROW IN ORDER TO ADD MY COMMENTS ON THE APPEALS HEARING FOR THE GATE DEVELOPMENT ON A1 A AND PONTE VEDRA BEACH.
HOWEVER SHOULD I NOT GET THROUGH TO SPEAK AND ATTACH THE SURVEY FINDINGS I WOULD LIKE TO THE FOLLOWING TO BE READ INTO THE RECORD AS OFFICIAL TESTIMONY.
DURING THE MEETINGS WHERE MULTIPLE VARIANCES WERE ALLOWED FOR THE GATE GAS STATION AND CARWASH DEVELOPMENT PROJECT, THE COUNTY'S OWN STAFF HAD NO FINDINGS OF HARDSHIP TO GRANT THE VARIANCES. IN ADDITION THE STAFF STATED THESE VARIANCES WERE
[02:55:01]
INCONSISTENT WITH THE LDC. THESE VARIANCES WERE AGAINST THE CODE.THERE IS NO FINDING OF HARDSHIP. AND IT APPEARS THAT THIS DEVELOPMENT IS INCONSISTENT WITH THE SURROUNDING AREA. ATTACHED ARE THE RESULTS OF A SURVEY FROM THE PUNTER FEATURE BEACH COMMITTEE ON THE PROPOSED GATE GAS STATION AND CARWASH DEVELOPMENT BASED ON THE NUMBER OF RESPONSES COMPARED TO THE NUMBER OF RESIDENTS, THIS SURVEY HAS AN ACCURACY OF B1 PERCENT. THE OVERWHELMING MAJORITY OF RESIDENTS 89 TO 98 PERCENT ARE TELLING YOU AS THE REPRESENTATIVES TO OVERTURN THE VARIANCES FOR THIS DEVELOPMENT. IN ADDITION, THERE WERE TWO QUESTIONS ADDED AT THE END OF THE SURVEY REGARDING FINANCIAL FAVORITISM AND WHETHER OR NOT THE RESIDENTS BELIEVE THAT THIS DEVELOPMENT FITS THE SURROUNDING AREA. THE SURROUNDING AREA IS A COUNTY STATE AND NATIONAL SCENIC HIGHWAY AND OTHER THAN OTHER BUSINESSES THAT EXISTED BEFORE THE REGULATIONS WERE IN PLACE, THERE HAS NOT BEEN A VARIANCE APPROVED.
IN ADDITION THIS AREA CONSISTS OF UPSCALE SHOPPING AND PROFESSIONAL BUILDINGS.
YOU SHOULD PERSONALLY DRIVE OVER THERE BEFORE CONSIDERING WHAT THE RESIDENTS BELIEVE IS NOT APPROPRIATE TO BE VISIBLE ON THIS STRETCH OF A1 A. ALMOST THROUGH HERE.
THE RESIDENTS WHETHER THE COMMISSIONERS OF THE CHARACTERS -- SYSTEMS THAT HAVE BEEN PAST ATTEMPTS OF SEPARATING FROM COUNTY GOVERNMENT I BELIEVE THAT ISSUE WILL AGAIN BE RAISED UNLESS THESE VARIANCES ARE OVERTURNED AND THIS LAND CONSISTENT WITH THE SURROUNDING AREA. SO THAT IS HER EMAIL. I DO THINK THE HER POWERPOINT AND SURVEYS UP THERE AND IN A MOMENT WE CAN HAVE THE STAFF CLICK THROUGH THEIR.
I WOULD SAY THAT THERE IS CASE LAW PERTAINING TO QUASIJUDICIAL HEARINGS YOUR DECISION IS TO BE MADE WHICH IS DESCRIBED IN THE PACKAGE AND I THINK THAT YOU ARE FAMILIAR WITH IT AND BEFORE YOUR MAKE THE DECISION I WILL REITERATE THAT. WHAT THE BOARD CANNOT BASE ITS DECISION ON IS HOW MANY HANDS GO UP OR DOWN SORT OF 90 PERCENT, THAT TYPE OF THING IT HAS TO BE BASED ON THERE IS A CODE. THERE'S EVIDENCE IN THE APPLICATION AND APPEAL. HOW DO THOSE MATCH? IT DOES NOT MATTER WHETHER THERE ARE 10,000 PEOPLE IN FAVOR OR TWO IN FAVOR. THAT, AS THE BOARD KNOWS IS NOT RELEVANT TO THE QUASIJUDICIAL DECISION. THANK YOU.
IF WE COULD HAVE STAFF JUST KIND OF I GUESS, PAGE THROUGH HERE.
AND AGAIN, THE WETLANDS ISSUE, TAX ISSUES, THOSE TYPES OF THINGS, THOSE ARE NOT FOR THIS SET OF DECISIONS YOU HAVE IN FRONT OF YOU TODAY. THEY WOULD NOT BE RELEVANT.
>> THANK YOU, MR. CHAIR. >> THANK YOU.
WE WILL MOVE ALONG THROUGH OR BOTTLE. WE WILL OFFER THREE MINUTES TO THE APPELLANT -- THE APPELLATE FIRST.
>> I'M SORRY. >> ONE THING I WOULD LIKE TO POINT OUT REGARDING THE APPLICANT. SHE STATED THAT THE AGREEMENT BETWEEN THE TWO PROPERTIES, SHE STATED THAT SAY HARDSHIP. GAGE LITERALLY WROTE THOSE MUTUALLY BINDING EASEMENTS AND COVENANTS WHEN THEY SOLD US THE PROPERTY.
IT'S A DOCUMENT OF THEIR OWN CREATION IT IS THEREFORE NOT A HARDSHIP.
THE FACT THAT THEY NEED LARGER SIGNS BECAUSE THE FACT THAT THEY SET THE GAS STATION BACK TO SUPPOSEDLY COMPLY WITH OUR SETBACK AGREEMENTS, SOMETHING THAT WE WILL CONTEST IF WE HAVE
[03:00:01]
TO, THAT'S HER OWN CREATION. THEIR ATTORNEYS WROTE IT. THEY'RE THE ONES THAT IMPOSED ON US, IT'S NOT HARDSHIP. THAT'S ALL I HAVE IN REBUTTAL. GENERALLY SPEAKING, WHAT YOU HEARD IN A RECEIVED THREE MORE TEXT MESSAGES FROM PEOPLE WHO SAID CAN I CALL IN AFTER THE PUBLIC COMMENT WAS CLOSED. THAT'S A SMALL SAMPLING OF WHAT THE RESIDENTS OF PONTE VEDRA HAVE TO SAY. ORIGINALLY, I GOT EMAILS I MANAGE THE SHOPS AT PUNTER FEATURE. I GOT LOTS OF EMAILS ASSUMING WE WERE DEVELOPING THE PROPERTY BECAUSE WE MAINTAIN THE RETENTION POND. I GET CALLS FOR BASICALLY ANY KIND OF SIGN POPS UP ON THE PROPERTY -- YOU PROBABLY ONLY SAW THREE OR FOUR PERCENT OF REALLY WHAT THE DISTASTE IS. THE RESIDENTS DO NOT WANT A ONE DAY TO LOOK LIKE BEACH BOULEVARD. THE APPLICANT, HOWEVER THE ARCHITECT AS THEY DO A GOOD JOB MAKING IT LOOK PRETTY IN A PRESENTATION BUT THE REALITY IS THIS IS GOING TO BE A HUGE BOULEVARD GAS STATION. LAND DEVELOPMENT CODE SAYS 24 SQUARE-FOOT SIGN, THAT'S ALMOST 4 TIMES THE SIGNS. IF YOU GRANT THAT WE, FOR OUR PROPERTY, WE WILL SEEK A VARIANCE WE WILL SEEK A LARGER SIGN. OTHER COMMERCIAL PROPERTY OWNERS WILL SEEK LARGER SIGNS. COMMERCIAL PROPERTY OWNERSHIP YOU ARE COMPETING FOR EYEBALLS ALONG THE ROAD. IF YOU DON'T HOLD THE LINE IN TERMS OF SQUARE FOOTAGE A1 A WILL LOOK LIKE BEACH BOULEVARD. THAT'S ALL I HAVE TO SAY. THANK YOU.>> NOW WE WILL HEAR FROM THE APPELLEE. THANK YOU, MR. CHAIRMAN.
FIRST OF ALL, THERE HAS BEEN NO COMPETENT SUBSTANTIAL EVIDENCE PRESENTED BY THE APPELLANT ARE MEMBERS OF THE PUBLIC THAT WOULD WARRANT THE OVERTURNING OF THE COMMITTEE IN THIS MANNER. WITH RESPECT TO THE RESTRICTIVE COVENANTS WHICH IS IN YOUR PACKAGE, IT BENEFITS MR. CAROL'S PROPERTY. IT WAS PUT IN PLACE FOR TALBOTT WHICH IS UNDER PRIVATE PROPERTY SO THAT TALBOTS WAS VISIBLE FROM A1 A. THEY HAVE THE RIGHT TO ENFORCE THAT FOR BUSINESS ON THEIR PROPERTY. THAT IS A HARDSHIP.
ON THIS PROPERTY DOES IS SUBJECT TO THIS APPLICATION. WE CONTEND THAT EVEN THOUGH YOU HAD YOUR PROPERTIES OWNED PED, YOU COULD ASK FOR WAIVERS AND HAVE A UNIFIED SIGN PLAN.
PUD CAN BE ON THE PROPERTY OF ANY SIZE. HAVING WAIVER DOES NOT REQUIRE PROOF OF HARDSHIP. IN THIS CASE, THE CODE IS CONTRARY IN TREATING A NON- ZONED PROPERTY DIFFERENTLY THAN A ZONED PROPERTY IN PONTE VEDRA ONLY.
THAT'S ANOTHER PART OF HARDSHIP. A LOT OF INFORMATION WAS PUT OUT HERE THAT IS MISINFORMATION THAT IS NOT RELEVANT TO THIS PROPERTY.
I THINK WE WILL WRAP IT UP BY SAYING THANK YOU FOR YOUR TIME. WE APPRECIATE EVERYONE CALLING THEM. I'M GLAD THAT WORKED OUT WELL AND WE WOULD JUST COME AGAIN, AS THEY DO TINNITUS APPEAL. YOU HAVE EXPERT BOARDS WHO HAVE HEARD THESE APPLICATIONS TWICE.
MR. CAROL AND HIS SON HAD THE OPPORTUNITY TO BE IN FRONT OF BOTH OF THOSE BOARDS IN YOU.
THEIR DUE PROCESS HAS BEEN SERVED. OUR DUE PROCESS HAS BEEN SERVED. THERE'S NO COMPETENT SUBSTANTIAL EVIDENCE FOR YOU TO DO ANYTHING BUT DENY HIS APPEAL. IQ.
>> THANK YOU. >> NOW WE ARE BACK TO THE BOARD FOR ANY COMMENTS, QUESTIONS, ANYTHING THE BOARD MAY HAVE TO DISCUSS?
>> MR. CHAIR, IF I MAY, THE DOCUMENT THAT MR. CAROL HAVE REFERRED TO AND MS. SMITH ALSO HAD OCCURRED, IT IS IN THE RECORD. IT IS THE DECLARATION OF EASEMENTS AND RESTRICTED COVENANTS. AND AGAIN, THE RECORDING INFORMATION IS ON THE DOCUMENT ITSELF. I WOULD SAY THAT THE DOCUMENT SPEAKS FOR ITSELF IN TERMS OF RIGHTS AND OBLIGATIONS OF THE AFFECTED PARTIES THEREIN.
THANK YOU. >> ANY DISCUSSION FROM THE BOARD ANY QUESTIONS? COMMISSIONER DEAN.
>>MR. DEAN: (INDISCERNIBLE). >> MR. CHAIR, I'M SORRY.
VERY SORRY. COMMISSIONER DEAN, HIS BACK IS PROBABLY GOING TO SMACK ME.
I WOULD LIKE TO GO OVER JUST SORT OF THE -- THE GRADING CRITERIA.
BECAUSE IT DOES HAVE A ZONING VARIANCE REQUEST A SET OF NON- VARIANCE ZONING REQUESTS AND A
[03:05:10]
APPROVAL REQUEST A SET OF THOSE. LET ME PUT IT THIS WAY, WITH THE BOARD LIKE ME TO SORT OF -- MR. MCCORMICK COMMENTED THAT THE BOARD IS QUITE FAMILIAR WITH WHAT WE HAVE OPTIONS THAT HANDS. I LIKE TO HAVE THE MOTION AS ITWOULD BE PRESENTED. >> APOLOGIES.
>> THE FLOOR SHORES. >> THANK YOU.
>> I'D LIKE TO MOVE TO DENY 2020 Ã02 AND ARC APPEALED 2020 L1.
GAIT CONVENIENCE STORE CARWASH UPHOLDING THE DECISIONS OF THE PONTE VEDRA ZONING ADJUSTMENT BOARD WHICH APPROVED THE REQUEST FOR ZONING VARIANCE. NONE ZONING VARIANCE 2019 Ã16 AND ASSOCIATED DESIGN APPROVAL ARC 20 1908. ASSOCIATED SUBJECT TO -- SUBJECT TO THE SEVEN FINDINGS OF FACT AND FOUR CONDITIONS AS PREVIOUSLY LISTED ON EACH
