BEACH WALK IS JUST TO THE EAST OF HERE. AND SO THE CUMBERLAND INDUSTRIAL PARK HAS BEEN AROUND FOR MORE THAN 20 YEARS. BACK IN THE DAY IT WAS OUT IN THE MIDDLE OF NOWHERE. AND SO THEY PURCHASED 3.6 ACRES, PROBABLY 20 OR SO YEARS AGO AND BUILT THEIR BUILDING, SO THEY'VE GOT A 15,000 SQUARE FOOT BUILDING HERE AND THEN TWO 7500 SQUARE FOOT BUILDINGS THERE. THE CHANGING NATURE OF THIS AREA HAS CHANGED THE NATURE OF BUSINESSES THAT ARE WITHIN THESE BUILDINGS, AND SO REALLY THE REASON WE'RE HERE TODAY IS BECAUSE WE NEED TO ADD USES THAT ARE REALLY GOING ON IN THE PROPERTY ALREADY.

THEY JUST ARE NOT PERMITTED IN THE CURRENT PUD. THE COMPREHENSIVE PLAN AMENDMENT WAS APPROVED AND THEN THEY BOTH PROVIDE FOR TIMING TRIGGERS AND WAYS TO BRING THE PROPERTY INTO COMPLIANCE WITH ZONING AND BUILDING CODES. TO DATE, THE MAJORITY OF THOSE VIOLATIONS HAVE BEEN ADDRESSED, HOWEVER, THERE IS USE AND TIMING THAT IS KIND OF REMAINED. OUR LANDFILL CURRENTLY DOES NO SERVE AS A LANDFILL THAT ACTUALLY BURIES WASTE. IT SERVES AS A TRANSFER STATION.

SO THIS PROVISION IS ACTUALLY NOT WARRANTED AT THIS TIME. THEY ARE REQUESTING WAIVERS FROM, A VARIANCE FROM THE MINIMUM REQUIREMENT OF 500 FEET FOR ANY COMPOSTING YARD WITHIN R NON-RESIDENTIAL STRUCTURE, SO THERE'S A SMALL PORTION OF THE PROJECT THAT IS WITHIN 500 FEET OF MORGAN'S COVE WHICH IS A PUD LOCATED TO THE WEST OF THIS PROPERTY.

AND THE APPLICANT HAS PROVIDED THAT THERE ARE AN EXTENSIVE AMOUNT OF WETLANDS THAT SEPARATE THE OPERATION FROM THE ACTUAL RESIDENTIAL. THEY HAVE REQUESTED A VARIANCE TO THE FENCING AND BUFFERING AND SCREENING. THEY'VE PROVIDED THAT THEY HAVE A SIX FOOT FENCE. IT'S NOT AN OPAQUE FENCE. IT IS A FENCE THAT IS LIKE A CATTLE TYPE FENCE, A FARM FENCE THAT SURROUNDS THE PROPERTY, AND THEY ARE INDICATING THEY'RE NOT IN SIGHT OF ANY GENERAL PUBLIC, YOU DO NOT SEE THE OPERATION FROM ANYWHERE AROUND IT.

THE SAME PROPERTY OWNER OWNS THE PROPERTY THAT IS ALL THE WAY AROUND IT.

SO THEY OWN QUITE A BIT OF PROPERTY, AND THEN THEY HAVE ALSO INDICATED THAT THE PROPERTY IS LOCKED WHEN IT'S NOT IN OPERATION. THEY HAVE ASKED FOR A VARIANCE FROM A SOLID WASTE FACILITY WITHIN A 100-YEAR FLOODPLAIN AND THE APPLICANT DID SUBMIT A FLOOD PLANE ANALYSIS THAT DID JUSTIFYING HAVE JUSTIFY THE LOCATION OF THAT SPHULT IN THIS LOCATION. SPECIAL USE IS A USE THAT IS NOT APPROPRIATE EVERYWHERE WITHOUT SOME RESTRICTIONS, AND SOME COMPATIBILITY REVIEW, SO DUE TO THE LOCATION AND SURROUNDING AREA, IT APPEARS THAT THIS USE CAN BE GRANTED WITHOUT A SUBSTANTIAL DETRIMENT TO THE AREA. IT DOES NOT APPEAR TO IMPACT THE PUBLIC GOOD ORE IMPAIR THE INTENT AND PURPOSE OF COMPREHENSIVE LAND OR THE LAND DEVELOPMENT CODE.
