SO IF YOU CAN IMAGINE WE HAVE COMMERCIAL PLANT NURSERIES OUT IN OPEN RURAL PARTS OF THE COUNTY IT'S A SUITABLE PLACE TO BE BUT OF COURSE A LOT OF TIMES THOSE COMPANIES OPERATE AND INSTALL INTO THINGS LIKE THAT SO CURRENTLY OUR CODE DOESN'T ALLOW FOR LANDSCAPE SERVICES TO BE OUT IN OPEN RURAL CALCULATE CATEGORIES AS A HIGHER INTENSITY USE THAT ENDS UP NEEDING A COMMERCIAL ZONING. SO THE COUNTY COMMISSION WAS TO PROPOSE SOME LAND DEVELOPMENT CODE CHANGES THAT WOULD ALLOW LANDSCAPE SERVICE TO OPERATE ON AN EXISTING NURSERY.
SO WE HAVE DRAFTED SOME LANGUAGE I'M GOING TO GO OVER THE LANGUAGE HERE AND KIND OF TALK ABOUT OUR THOUGHT PROCESS ABOUT HOW WE TRY TO MAKE THAT POSSIBLE.
SO WE ARE LITERALLY ADDING AN ACCESSORY USE.
CREATING A NEW USE AN OPEN RULE ZONIN AND NEEDS TO BE APPROVED AS A SPECIAL USE. SO IF YOU WERE EVER TO HAVE ONE OF THESE IT'S GOING TO COME BEFORE THIS BOARD AND FIND THAT THE BOARD HAS TO FIND THAT THE LANDSCAPE SERVICE IS CONSISTENT AND COMPATIBLE WITH THE AREA AND DOESN'T HAVE THE ADVERSE EFFECTS ON POTENTIAL SURROUNDING PROPERTIES WHETHER THEY ARE RESIDENTIAL OR AGRICULTURAL. SO WE CREATED A SERIES OF STANDARDS THAT WE BASED OFF OF EXISTING RULES AND REGULATIONS IN OUR CODES. WE HAVE HOURS OF OPERATIONS THAT IS CONSISTENT WITH OUR NOISE ORDINANCE.
WE HAVE A PERCENTAGE OF THE LANDSCAPE SERVICE CAN ONLY BE 25% OF THE SITE AREA. SO AGAIN, THE MAJOR USE HAS TO BE THE PLANT NURSERY. THEN WE HAVE SOME SEPARATION REQUIREMENTS IN CASE THERE IS A BUDDING RESIDENTIAL TO MAKE SURE THESE BIG LANDSCAPE TRUCKS AND SO FORTH ARE AT LEAST 200 FEET AWAY FROM RESIDENTIAL PROPERTIES AND THEN LIKEWISE MAKING SURE THOSE RESIDENTIAL PROPERTIES AREN'T BURDENED BY THE NOISE OR SOUND OR VISUAL OF LARGE TRUCKS AND MACHINERIES COMING AND GOING AND ADDING SOME REASONABLY INTENSIVE SCREENING REQUIREMENT TO IT'S. THIS IS ACTUALLY THE LANGUAGE THAT WOULD BE INSERTED SO IF YOU'RE LOOKING AT THE REAL THING CAN JUST BE ADDED TO THE LAND DEVELOPMENT CODE AND THEN ANY APPLICANT TRYING TO MOVE FORWARD WITH THIS WOULD SUBMIT FOR SPECIAL USE APPLICATION AND COME FORWARD FOR REVIEW BY THIS BOARD.
