WHEREAS DATING BACK TO 1926, BLACK HISTORY MONTH WAS ESTABLISHED ON THE PRINCIPALS OF DR. CARTER G WOODSON WHO FOUNDED THE ASSOCIATION OF THE STUDY OF AFRICAN-AMERICAN LIFE AND HISTORY AND WHEREAS DURING THE MONTH OF FEBRUARY WE CELEBRATE THE VAST, RICH AND SIGNIFICANT CONTRIBUTIONS OF AFRICAN-AMERICANS TO THE UNITED STATES AND OUR CULTURAL IDENTITY , AND WHEREAS THE THEME FOR BLACK HISTORY MONTH IN 2023 IS BLACK RESISTANCE WHICH EXPLORES HOW AFRICAN-AMERICANS HAVE RESISTED HISTORIC AND ONGOING OPPRESSION IN ALL FORMS. AND WHEREAS AFRICAN HISTORY IN NORTHEAST FLORIDA SPANS MORE THAN 450 YEARS AND ST. JOHN'S COUNTY IS HOME TO FORT MOSAY THAT WAS ESTABLISHED A THE FIRST FREE AFRICAN-AMERICAN SETTLEMENT IN THE PRESENT BOUNDARIES OF THE UNITED STATES.
HENCE, WHEREAS, THE HISTORIES OF AFRICAN-AMERICANS, ST. AUGUSTINE AND SAINT JOHN'S COUNTY ARE FOREVER INTERSECTED THROUGH SIGNIFICANT HISTORICAL EVENTS THAT HELPED SHAPE THE NATION.
ST. JOHN'S COUNTY IS DEDICATED TO HONORING THE HISTORY, CULTURE AND CONTRIBUTION AFRICAN-AMERICANS BROUGHT AND CONTINUE TO BRING TO OUR COMMUNITY.

WE ARE ASKING TO REZONE THE 1.9-ACRE PARCEL FROM OPEN RURAL TO TUD AND ADD -- PU DIS, AND ADD IT TO THE EXISTING PUD. THE ORIGINAL PUD WAS ADOPTED IN 2015. IT WAS ORIGINALLY A 65-ACRE SITE AND BY FOR INDICATED BY -- BIFORCATED BY AN EASE MEANT.

IT PRESENTED TO THE BOARD ON SEPTEMBER 20TH RESULTED IN A REQUEST TO DRAFT THIS LDC AMENDMENT.
THE ITEM WAS PRESENTED TO THE PLANNING AND ZONING AGENCY ON DECEMBER 15TH AND RESULTED IN A RECOMMENDATION FOR APPROVAL IN A 5-0 VOTE. STAFF'S PRESENTATION ON SEPTEMBER 20TH DISCUSSED HOW VET WRAU -- VETERINARY OFFICES ARE IN THE LOW COUNTIES. THEY OPERATE DIFFERENTLY DEPENDING ON HOW THEY STRUCTURE LAND REGULATIONS.
THE COUNTY THAT'S ALLOW VETERINARY OFFICES INCORPORATE SPECIFIC DESIGN CONDITIONS. IN THAT PRESENTATION THEY IDENTIFIED AREAS OF CONCERN AS LISTED HERE.
THE BOARD DISCUSSION INCLUDED THE EXPECTATION THAT REASONABLE CONDITIONS WOULD BE INCORPORATED INTO THE CODE TO ADDRESS SUCH CONCERNS. THAT DOES LEND THE OPPORTUNITY FOR A VETERINARY CLINIC TO COME IN AND TAKE OVER THE OFFICE.THE VET OFFICE BEING IN THE SAME BUILDING AS OTHER PRACTICES AND DISTURBING OR DISRUPTING OTHER PRACTICES IS ADDRESSED BY YOUR CODE AMENDMENT BY KEEPING THEM IN AN INDIVIDUAL BUILDING.
AND I THINK YOUR SPACE LIMITATION APPLIES TO RESIDENTIAL AND NOT COMMERCIAL. SO IT DOESN'T CREATE THE PROBLEM OF THE BUILDING BEING 150 FEET, SAY, FROM ANOTHER MEDICAL OFFICE BUILDING. THAT WOULD BE FINE.

THIS TWO LOTS TO THE EAST OF THE PARK WILL EXPAND THE ATHLETIC FIELD WHERE KIDS CAN PLAY BASEBALL AND FOOTBALL.
THE FIELDS AREN'T BIG ENOUGH RIGHT NOW.
FOR A BOY OR A GIRL TO COMPETE IN ANY YOUNG SPORTS, THEY HAVE TO GO TO HASTINGS. I DON'T WANT TO TO SEE ANY CHILDREN 14 YEARS OLD RIDING A BICYCLE DOWN THE COUNTY ROAD AT 8:00 IN THE EVENING. THIS PROPERTY HAS BEEN IN THE WORKS FOR QUITE AWHILE NOW. THE LOT IMMEDIATELY SOUTH CURRENTLY HAS A WELL ON IT AND A SEPTIC SYSTEM.

THAT WAS THE DISCUSSION BEFORE THE BOARD. THE BOARD LIKED THE IDEA BECAUSE IT REDUCED THE IMPACTED LINKS AND IT WAS APPROVED.
DONE. THE APPEAL PERIOD EXPIRED SO NO ONE CAN CHALLENGE THE PUD REZONING.
THEN WE WENT ALONG THE PROCESS. WHILE THE PUD APPLICATION WAS PENDING WE HAD A CONCURRENCY IMPACT AGREEMENT.
IT HAS BEEN IN DRAFT FORM AND THE COUNTY'S PUBLIC RECORDS FOR MONTHS. I DRAFTED IT AND WE MADE CHANGES BASED ON STAFF COMMENTS ALONG THE WAY.
JUST FOR PEOPLE WHO DON'T KNOW, THAT'S HOW THE PROCESS IN ST.
JOHN'S COUNTY WORKS. LITERALLY THE APPLICANT FILES THE DOCUMENTS AND YOUR PROFESSIONAL STAFF REVIEWS THE DOCUMENTS AND PROVIDES COMMENTS BACK.
FOR EXAMPLE, THE TRANSPORTATION PLANNING STAFF WOULD SAY YOUR PROPORTION GNAT SHARE BASED ON STATE LAW WHICH IS 163 AND SECTION 163.3180 PROVIDES PROPORTION SHARE RULE.
YOUR LAND DEVELOPMENT INCORPORATES IT BY STATE LAW.
IT PROVIDES A WAY OF CALCULATING A PROPORTION GNAT FAIR SHARE IN THE MATTER OF P -- OF THIS PUD BECAUSE THE NUMBER WAS REDUCED FROM 405 TO 305. THE PROPORTION GNAT SHARE CHANGED DURING THE REVIEW DURING THIS APPLICATION FOR THE CONCURRENCY AND IMPACT CREDIT AGREEMENT TO 358,$057.
THAT'S THE NUMBER -- $358, 057 AND THAT WAS THE NUMBER ON THE CONSENT AGENDA. THEY OFFERED TO PREPAY SOME OF THE IMPACT FEE MONEY THAT THE ROAD IMPACT FEE MONEY THAT WOULD BE OWED TO THE COUNTY FROM THIS PROJECT ANYWAY TO HELP PAY FOR THE WIDENING OF 4-MILE ROAD AT STATE ROAD 16.
IT WAS TO PAY FOR SO THE COUNTY COULD CONSTRUCT.
AND AS REFLECTED IN THIS, AND I CAN PUT THIS -- I CAN PUT -- I'M ON PAGE 4 OF THE AGREEMENT, SUBSECTION D SAYS THAT THEY WILL ALSO, FREE OF CHARGE, MEANING DONATE AND NOT GET ROAD IMPACT FEE CREDITS 20 FEET OF RIGHT OF WAY FOR THE WIDENING OF 4-MILE ROAD. SO IT IS $358,000 OF PROPORTION GNAT SHARE MONEY DUE BY STATE LAW AND THEN PREPAY AN ADDITIONAL $750,000 IN ROAD IMPACT FEES AND CONTRIBUTING THE 20 FEET OF RIGHT OF WAY FOR THE WIDENING OF 4-MILE ROAD.
IT IS SO THE COUNTY'S PROFESSIONAL STAFF CAN DECIDE WHEN IT IS READY TO WIDEN 4-MILE ROAD TO MAKE THOSE IMPROVEMENTS.

NOT SO MUCH ABOUT STATE ROUTE 16. 4-MILE ROAD, A LOT OF DISCUSSION. AND I DID HEAR COMMISSIONERS TALK ABOUT THE DESIRE FOR INFRASTRUCTURE INCOMPATIBILITY.
THE DESIRE TO SEE THINGS DONE SOONER RATHER THAN LATER.
AND IN RESPONSE TO THAT I DID HEAR MS. SMITH SAY THAT THE PROPORTIONAL FAIR SHARE AND IMPACT FEES WOULD FUND AN ITEM ON THE COUNTY'S ONE CENT SALES TAX.
THAT ITEM COST 2.5 MILLION. SO WHEN I SAW THE CURRENT AGREEMENT THAT TOTALS 1.1 MILLION I DID WRITE TO EACH OF THE COMMISSIONERS AND EACH OF THE CHAIRS AND THE COMMISSIONERS AND I DID HIGHLIGHT MY CONCERNS AND MY REASONS FOR OBJECTING.
I DO UNDERSTAND THE COUNTY ATTORNEY HAS REVIEWED THAT AND PERHAPS DOES NOT FIND THESE ITEMS EXACTLY [INAUDIBLE].
SO IT APPEARS [INAUDIBLE] I STILL DID HEAR WHAT I HEARD.

FOR BACKGROUND AFTER A YEAR OF EXTENSIVE MODELING IN 2019, THE DISTRICT ISSUE -- ISSUED WHAT WE CALLED THE DASH 19 PERMIT. THIS IS TO LET US KNOW THAT THE STORM WATER SYSTEM IN UNITS 5 THROUGH 9 OF THE COMMUNITY FUNCTIONED AS DESIGNED AND IT OUTLINED 31 CONDITIONS FOR THE ASSOCIATION TO MIGHT. ONCE THAT PERMIT WAS ISSUED, JIM HENSLEY WHO IS A PROMOTER IN THE COMMUNITY FILED A CHALLENGE TO THE PERMIT CAUSED US A SEVEN-MONTH DELAY AND THEN BEFORE STORM SEASON HE DROPPED HIS CHALLENGE WITHOUT ANY CHANGES TO IT. EACH COMPLAINT HAS RESULTED IN MORE TIME THE ASSOCIATION HAS CONTINUED TO RESPOND TO ALL OF THESE COMPLAINTS AND AT THE SAME TIME RESPONDING TO THE REQUEST FROM THE DISTRICT AND NOW THEIR PEURD -- THIRD PARTY ENGINEER IS USING DAVID HAMSTRA.
TKAOD -- TODAY CONDITION 26 IS THE ONE ITEM THAT IS REMAINING ON THE PERMIT. THE PLANS HAVE BEEN SUBSTANTIALLY APPROVED BY THE DISTRICT.

THEY ALSO SERVE THE MASTER ASSOCIATION AND THE COUNTRY CLUB AND ONE MAJOR BUSINESS ENTITY. WE DO HAVE A MAINTENANCE PROTOCOL AND WITH THAT MAINTENANCE PROTOCOL WE HAVE WEEKLY, QUARTERLY, MONTHLY AND OUTSIDE INSPECTIONS BY OUTSIDE VENDORS. THERE IS A RESERVE STUDY THAT EXTENDS 30 YEARS. AND WITH THAT THE -- IT EVALUATES EVERY ITEM WITHIN THE COMMUNITY TO ASSESS ITS LIFE EXPECTANCY. THERE ARE SEMIANNUAL INSPECTIONS AND THIS MEANS YOU GO OUT AND MY STAFF GOES OUT AND CLEANS EVERY CATCH BASIN IN THE COMMUNITY. WE DO BI-ANNUAL CERTIFICATIONS THROUGH THE WATER MANAGEMENT DISTRICT.
WE RECENTLY HAVE DONE A GOOD DEAL OF PROJECTS AND HAVE MONEY SCHEDULED TO BE SPENT IN THE NEIGHBORHOOD OF ABOUT $2 MILLION. OF THOSE FIVE PUMP STATIONS, FOUR WERE RECENTLY REBUILT WHICH INCLUDES NEW PIPES AND NEW ENGINES AND REBUILT PUMPS. ALL OF THAT TOTALED $650,000.
TO HAERB -- HEAR PEOPLE SAY NOTHING HAS BEEN DONE [INAUDIBLE]. WE HAVE INSTALLED CAMERA SYSTEMS TO MONITOR THIS SYSTEM 24/7. I I DID WANT TO GET BACK TO A COUPLE OF ISSUES WE HAD AT THE LAST MEETING.
THERE WERE ACCUSATIONS OF THINGS NOT BEING DONE.
AS I SAID AS THE RESERVE STUDY IN WHICH THE COMMUNITY PLANS FOR AND REPLACES EVERY ITEM. THERE WERE STATEMENTS ABOUT UNPASSABLE ROADS. THESE ROADS -- WE LIVE IN A MARSH ON BARRIER ISLAND. WE DO EVERYTHING POSSIBLE TO MAKE THINGS AS GOOD AS CAN BE. BUT WE CANNOT COME BACK AGAINST TIDAL SURGES. THERE WAS COMPLAINTS ABOUT THE SAWGRASS NOT BEING ABLE TO PUMP. IN CONCLUSION THE COMMUNITY TAKES ALL OF THE STORM WATER SYSTEM SERIOUSLY. THEY PLAN FR EVERYTHING.

A COUPLE WEEKS AGO SEVERAL RESIDENTS OF MARSH LANDING WHO COINCIDENTLY HAVE ALSO SUED THE HOA MADE CLAIMS BEFORE YOU ABOUT OUR STORM WATER MANAGEMENT SYSTEM. SIMPLY PUT THEY STATED THAT THE SYSTEM DOES NOT PREVENT FLOODING FROM KING TIDES OR HURRICANES AND THAT THEY HAVE NEVER SEEN ANY MAINTENANCE OF ANY OF THE PONDS. MY PURPOSE THIS MORNING IS TO SHARE SOME BRIEF REMARKS WHICH CHALLENGE THOSE COMMENTS.
FIRST, OUR STORM WATER MANAGEMENT SYSTEM WAS NEVER DESIGNED OR PERMITTED TO PREVENT KING TIDES OR HURRICANE STORM SURGES. RATHER IT WAS BUILT AND CERTIFIED TO PREVENT FLOODING FROM 25-YEAR RAINFALL EVENTS.
AND SECOND THROUGH THE 19 APPROVAL PROCESS, OUR HOMEOWNERS ASSOCIATION WILL HAVE SPENT OVER $2.7 MILLION ON THE MAINTENANCE OF THIS STORM WATER MANAGEMENT SYSTEM FUNDED OF COURSE BY OUR RESIDENTS THROUGH SPECIAL ASSESSMENT AND SHARPLY HIGHER ANNUAL DUES. TO SUGGEST THERE HAS BEEN NO MAINTENANCE OF THE STORM WATER MANAGEMENT SYSTEM OR THAT IT IS INTENDED TO STOP KING TIDES OR STORM SURGES IS SIMPLY NOT TRUE.

MY BACKYARD ABUTS TO POND 30 IN THAT NEIGHBORHOOD.
YOU CAN SEE THE BEFORE AND AFTER THE REDUCTION AND THE POND LEVEL THERE ON MY HOUSE. DURING MOST OF THE 30 YEARS INCLUDING TIMES OF HURRICANES THE WATER LEVEL IN THAT POND AND OTHERS WAS LOWERED ABOUT TWO DAYS AHEAD OF ANY LARGE STORM OR HURRICANE AND THEN AFTER THE STORM ALLOWED TO ADJUST TO A ROUTINE LEVEL. ALL HOUSES BUILT AROUND THAT TIME HAD YARDS GRADED TO THE LEVEL AT WHICH THE PONDS WERE AT THAT TIME. THE WATER MANAGEMENT SYSTEM SEEMED VERY EFFECTIVE, ALTHOUGH IT WAS NEVER EXPECTED TO PREVENT FLOODING DUE TO HURRICANES. ABOUT FIVE YEARS AGO THE POND BEHIND MY HOUSE HAD THE WATER LEVEL LOWERED SEVERELY AFTER LITIGATION AFTER HURRICANE IRMA. SINCE THEN MY BACKYARD HAS ERODED SEVERELY WITH DIRT FALLING INTO THE DRY AREA BETWEEN MY YARD AND THE LITTLE BIT OF WATER THAT IS LEFT THERE AS WELL AS INTO THE WATER ITSELF.
IT HAS BEEN DANGEROUS TO WALK AT THE EDGE OF MY PROPERTY BECAUSE OF THIS EROSION AND MULTIPLE IRRIGATION HEADS HAVE FALLEN INTO THE POND AS WELL. IN ADDITION, THE DRAINING DOWN OF THE POND HAS EXPOSED RUSTED DRAINAGE PIPES AND THE AESTHETICS OF MY BACKYARD HAS DETERIORATED.
I CAN ONLY ASSUME MY PROPERTY VALUE IS NOT AS HIGH AS IT MIGHT HAVE BEEN BECAUSE OF THAT. SO THERE WAS NO REAL PROPERTY DAMAGE, EVEN THOUGH THE PONDS HAD BEEN LOWERED ABOUT THREE TO FOUR FEET.
BUT IN JULY OF 2020 AFTER SOME RAINY SEASONS CAME ALONG, THERE WAS A TRACTOR THAT GOT STUCK IN THE MUD IN MY BACKYARD AND IT WAS OBSERVED THAT WATER WAS ACTIVELY FLOWING THROUGH MY YARD INTO THE LAKE. AFTER CONSULTING WITH NUMEROUS EXPERTS IT WAS AN ARTISIAN WELL AND IT WAS NOW COMING UP FROM THE EARTH AND FLOODING MY PROPERTY.
YOU HAVE TO TAKE INTO CONSIDERATION MY HOUSE WAS BUILT 30 YEARS AGO AND MY SLAB WAS POURED 30 YEARS AGO.
SO WE STARTED SEEING SLAB FOUNDATION DAMAGE DUE TO THE WATER FLOWING THROUGH THE YARD, AND WE NOTICED CRACKS IN THE POOHING DECK AND -- CRACKS IN THE POOL DECK AND LIKES IN THE POOL. THIS IS WHAT MY POOL DECK LOOKS LIKE. IT WAS ABOUT TWO INCHES.
THE STEPS OF MY POOL HAVE PULLED AWAY FROM THE HOUSE.

IT IS CERTAINLY NOT UNIQUE TO OUR HOME AND IT IS SOMETHING WE NEED TO CONTINUE TO ADDRESS AND EVALUATE.

SAFETY IMPROVEMENTS ARE BEING CONSTRUCTED AT HOLMES BOULEVARD, A ROADWAY TRAVELED BY THE PARENTS, STAOEFPERS AND STUDENTE STUDENTS. AND WE ARE PROVIDING TRAFFIC RELIEF AT 312 AND TO THE NORTH WE ARE CURRENTLY WIDENING AND UPGRADING AND IMPROVING COUNTY ROAD 210 FROM TWO LANES TO FOUR LANES. IT WILL HAVE BIKE LANES AND SIDEWALKS AND THAT'S SOMETHING WE DESPERATELY NEED.
2023 IS AN OPPORTUNITY TO THINK BIG ABOUT OUR TRANSPORTATION FUTURE. I WOULD LIKE TO GET BOARD CONSENSUS BECAUSE I HAVE BEEN WORKING WITH THE STAFF TO COORDINATE WITH OUR STATE LEGISLATIVE DELEGATION AND OUR CONGRESSIONAL DELEGATION AND THE DEPARTMENT OF TRANSPORTATION FDOT TO PLAN A TRANSPORTATION EVENT INCLUDING A SUITABLE LOCATION AND FORMAT. THIS EVENT WOULD HIGHLIGHT OUR TRANSPORTATION PRIORITIES AND OUR NEEDS AND I BELIEVE IT WOULD HELP US BRING STATE AND FEDERAL RESOURCES BACK TO ST. JOHN'S COUNTY TO SOLVE THESE TRANSPORTATION CHALLENGES WE ARE FACED WITH. CAN WE GET BOARD CONSENSUS TO KIND OF PUT THAT EVENT TOGETHER SO THAT WE CAN HIGHLIGHT THE NEEDS AND TRY AND SOLICIT FUNDING?
