THIS IS A PROPERLY NOTICED HEARING HELD IN CONCURRENCE WITH REQUIREMENTS OF FLORIDA LAW. THE PUBLIC WILL BE GIVEN AN OPPORTUNITY TO COMMENT ON TOPICS RELEVANT TO THE AGENCY'S AREA OF JURISDICTION AND THE PUBLIC WILL BE GIVEN AN OPPORTUNITY TO OFFER COMMENT AT A DESIGNATED TIME DURING THE HEARING.

ANY MEMBER OF THE PUBLIC DESIRING US TO SPEAK MUST INDICATE SO BY COMPLETING A CHARACTER SPEAKER CARD AND IS SCRAIBL IN THE FIORE ANY ADDITIONAL SPEAKERS MAY BE HEARD AT THE DISCRETION OF THE CHAIRMAN.

THE PUBLIC SHALL SPEAK AT A TIME DURING THE MEETING AND FOR A LENGTH OF TIME AS DESIGNATED BY CHAIRMAN WHICH SHALL BE THREE MINUTES. SPEAKERS SHOULD IDENTIFY THEMSELVES, WHO THEY REPRESENT, AND STATE THEIR ADDRESS FOR THE RECORD. SPEAKERS MAY OFFER SWORN TESTIMONY. IF THEY DO NOT, THE FACT THAT TESTIMONY IS NOT SWORN MAY BE CONSIDERED BY THE AGENCY IN DETERMINING THE WEIGHT OR TRUTHFULNESS OF THE TESTIMONY.

WE ARE FAIRLY SIMPLE REQUEST, REQUESTING A ZERO FOOT SETBACK IN THE REAR â– YARDTOPLACE A POOL AND A POOL ENCLOSURE.

THE ARCHITECTURAL REVIEW BOARD OR THE NEIGHBORHOOD ASSOCIATION HAS APPROVED A ZERO FOOT SETBACK PLANNING AND ZONING.

THIS IS A DIAGRAM OF THE PROJECT.

YOU CAN SEE THAT THE BACKYARD IS IRREGULARLY SHAPED.

WHAT'S DRIVING THAT IS A JURISDICTIONAL WETLANDS IS WHAT PUT THAT POINT IN THERE THE KIND OF CORNER TO CORNER NORMAL LOT SHAPE WOULD HAVE PROBABLY BEEN SUFFICIENT FOR THE SETBACK BUT THE IRREGULAR SHAPE OF THE LOT HAS CREATED A VERY NARROW SPACE BACK THERE. ABSENT THE ZERO FOOT SETBACK, THE PROJECT REALLY CAN'T GO FORWARD.

IT WOULD LOOK LIKE A SWIM LANE. IT'S NOT A LARGE POOL.

IT'S JUST KIND OF A NORMAL POOL THAT WOULD FIT, THAT WOULD FIT IF WE HAD A ZERO FOOT SETBACK. THE PROPERTY BEHIND ME IS OWNED BY THE NEIGHBORHOOD ASSOCIATION. AGAIN, THEY HAVE APPROVED THE ZERO FOOT SETBACK. IT'S WOODS.

IT'S VERY HARD TO SEE, BUT THAT FIRST ARROW ON THE LEFT IS POINTING TO MY NEIGHBOR'S CORNER.

SO THE -- IF YOU DIDN'T KNOW WHERE THE PROPERTY LINE WAS, YOU WOULD SEE MY PROJECT AS BEING EQUIVALENT TO THAT EXISTING ENCLOSURE. THE BOTTOM RIGHT AND THE BOTTOM -- EXCUSE ME. THE TOP RIGHT AND THE BOTTOM RIGHT ARE KIND OF LOOKING DOWN THAT LINE, AND YOU CAN SEE THAT THE PROPOSED ENCLOSURE IN THAT TOP PICTURE WOULD ACTUALLY SIT BEHIND VISUALLY WOULD SIT BEHIND THE NEIGHBOR'S YARD.

WE WOULD BE, OF COURSE, OBSERVING ALL SIDE SETBACK REQUIREMENTS. THIS IS JUST A REAR SHOT TO KIND OF ILLUSTRATE THAT THERE'S PLENTY OF AM RADIO BACK THERE BEFORE YOU GET TO THE -- ROOM BACK THERE BEFORE YOU GET TO THE TREES. I WAS HAVING TROUBLE FIGURING OUT HOW TO EXACTLY DEPICT THAT BUT IT ALSO SHOWS ON THE LEFT-HAND SIDE THAT THE PROJECT WOULD BE QUITE A WAYS AWAY FROM THE NEIGHBOR ON THE -- TO THE LEFT IN THIS PICTURE.

I WANT TO BE RESPECTFUL OF TIME, SO THAT WAS REALLY ALL I HAD PREPARED TO GIVE KIND OF AN OVERVIEW AND A RATIONALE FOR WHY THE ZERO FOOT SETBACK REALLY DOESN'T IMPACT ANYBODY, CERTAINLY NOBODY BEHIND ME. VISUALLY AGAIN, IT REALLY DOESN'T AFFECT THE NEIGHBOR ON MY LEFT.
