WELL WE HAVE A VERY SPECIAL PRESENTATION THIS MORNING.AND I AM GOING TO CALL ON THE SHERIFF TO INTRODUCE THE

WHILE THEY COMING UP I'D LIKE TO HAVE IT IN THE IMMEDIATE SHORT BIO ON KING BEDFORD. BY THE WAY THIS YOUNG MAN IS NOT SHY THIS IS MY QUARTERBACK AT PEDRO HE IS NOT SHY.
KING BEDFORD WAS BORN IN SAINT AUGUSTINE FLORIDA TO PARENTS BRANDON AND TONY, AND AS SHE CAN BEDFORD IN 2,003.
HE WAS DELIVERED BY THE LATE GREAT DR. JOYNER WHO A LOT OF YOU KNOW HERE WHO WAS ONE OF OUR FINEST DOCTORS AT THE FLAGLER HOSPITAL IN ST. JOHN'S COUNTY. KING GIVEN HIS MOTHER'S MAIDEN NAME IS A SYMBOL OF HONOR BY HIS FATHER, HE ATTENDED PRIMARY SCHOOL AT DR. JAMES A LONG ELEMENTARY AND PUTNAM COUNTY.
WHERE HE EXCELLED ACADEMICALLY, AND OUT THE OPEN TUNING PARTICIPATE IN THE CAMBRIDGE PROGRAM.
FOR STUDENTS THAT EXHIBIT EXIT ACADEMIC EXCELLENCE.
AFTER HIS FAMILY MOVED TO ELTON FLORIDA, KING TRANSITIONED HIS EDUCATION AT ROGERS MIDDLE SCHOOL.
IN ST. JOHN'S COUNTY. HE JOINED THE GAMBLE ROGERS FOOTBALL TEAM AND ULTIMATELY LEAD THE STINGRAYS TO THAT FIRST MIDDLE SCHOOL CHAMPIONSHIP FROM THE QUARTERBACK POSITION.

HE IS ALSO SUSTAINED A STELLAR ATHLETIC CAREER AS A FOUR YEAR STARTED, INCLUDING FIRST TEAM ALL STATE HONORS, THIRDS TO A AWLS TEAM HONORS AND CO- DISTRICT PLAYER THE YEAR. KING IS CURRENTLY THE ONLY QUARTERBACK IN PAGE HERNANDEZ HISTORY TO DEFEAT SAINT AUGUSTINE HIGH SCHOOL TO MR. WALTER.
HE WAS THE FIRST TO LEAD HIS TEAM TO A DISTRICT CHAMPIONSHIP.
HE WAS THE FIRST TO LEAD HIS TEAM TO A SECOND ROUND PLAYOFF, AND A FIRST DELETE HIS TEAM AND EXPERIENCE OF A HOME PLAYOFF
[00:05:02]
WIN. KING HAS MADE THE DECISION TO FOSTER HIS LEADERSHIP ABILITY BY COMMITTING OKAY HERE WE GO.HIS LEADERSHIP ABILITY TO THE UNITED STATES NAVAL ACADEMY ON A FULL ATHLETIC SCHOLARSHIP. HE WILL HAVE AN OPPORTUNITY TO SERVE HIS COUNTRY, CONTINUE A PASSION A PLAYING FOOTBALL AT A COLLEGIATE LEVEL, AND TO PURSUE A DREAM OF HELPING OTHERS IN THE MEDICAL FIELD. HOWEVER, HIS GREATEST ATTRIBUTE, IS NOT IN HIS ACADEMIC AND ATHLETIC ABILITY.
IT IS SIMPLY IN THE REFLECTION OF HIS DAILY LIFESTYLE AND SUBMISSION TO JESUS CHRIST. AS KING OF KINGS.
KING WAS NAMED KING, SO HE MAY NEVER FORGET THE TRUTH IN THE SCRIPTURE THAT IDENTIFIES THE LORD OF KING OF KINGS.
FOUND IN ONE TIMOTHY 615. HE UNDERSTANDS THAT IT'S LONG AS HE STAYS COMMITTED TO OUR LORD AND SAVIOR JESUS CHRIST, HE CAN'T RAIN AS A KING, EVEN IN LIFE'S CIRCUMSTANCES AND ANSWER THE QUESTION WHO ARE THOSE THINGS? BY EMPATHETICALLY SAYING WE ARE AND ENCOURAGE OTHERS TO FOLLOW THE TRUE LEADER. WE INTRODUCED TO SOME AND PRESENT TO OTHERS KING ANTHONY BEDFORD, WHO IF YOU DON'T KNOW WHEN THE ST. JOHN'S COUNTY SCHOOL DISTRICT AS A OF THE AIR ON MLK. WITHOUT FURTHER ADO MY QUARTERBACK, KING ANTHONY BEDFORD.
[APPLAUSE] >> HOW IS EVERYBODY DOING THIS MORNING? I WOULD LIKE TO THINK JOHN THANK ST. JOHN'S COUNTY BOARD OF COMMISSIONERS IN CHANCE TO READ THIS ESSAY I AM GOING TO BEGIN. NO ONE IS FREE, UNTIL WE ARE ALL FREE. NO ONE IS FREE UNTIL WE ARE ALL FREE. THESE WORDS WITHOUT BY A MAN WHO THOUGHT OF OTHERS BEFORE HIMSELF.
THESE WORDS ARE SPOKEN BY A MAN WHO USED HIS VOICE, TO BRING HOPE, COURAGE, AND HEALING TO THE WORLD.
THESE WORDS WERE DEMONSTRATED BY A MAN, WHO LIVED HIS LIFE TO INSHORE, THAT ALL WOULD HAVE THE OPPORTUNITY TO BE FREE.
REGARDLESS OF THE COLOR, RELIGION, OR GENDER.
THESE WORDS WERE BIRTHED FROM THE VERY SOUL OF ONE OF THE GREATEST CIVIL RIGHTS LEADERS TO EVER LIVE.
DR. MARTIN LUTHER KING JR. THROUGH THIS QUOTE HE EMPHASIZED FREEDOM IS NOT AN INDIVIDUAL MATTER BUT THE FREEDOM OF THE INDIVIDUAL IS BASED UPON THE FREEDOM OF THE COLLECTIVE WHOLE.
WE TRULY CANNOT BE FREE FROM OUR OWN OPPRESSION TO OUR BROTHER OR SISTER, AS FREE FROM THEIR OPPRESSION.
IT OUR RESPONSIBILITY TO FREE THEM, EVEN IF OUR BROTHER OR SISTER IS THE OPPRESSOR. HOWEVER, HOW CAN I FREE MY BROTHER, HOW CAN I FREE MY SISTER? WHAT IS FREEDOM EVEN BEGIN? FREEDOM, BEGINS IN THE HEART, AND TO BE FREE IN THE HEART, AND TO FREE THE HEART OF ANOTHER, WE MUST LOVE, WE MUST LOVE ONE ANOTHER WITH AGAPE LOVE.
THAT IS UNCONCERNED WITH THYSELF AND CONCERNED WITH THE GREATEST GOOD OF ANOTHER. WHEN WE UNSELFISHLY SEEK THE BEST FOR OTHERS, DESPITE THEIR DIFFERENCES WE HAVE SET OURSELVES FREE FROM SELFISHNESS, AND HATE.
WE DON'T SEE THEM FOR THE COLOR OF THE SKIN, THE GOD THEY SERVE, OR EVEN THE AGENDA THAT THEY IDENTIFY AS.
BUT WE SEE THEM FOR THE HUMAN THAT THEY ARE, AND WE GIVE THEM WHAT EVERY HUMAN BEING NEEDS. THE LOVE OF GOD.
DR. KING SAID WHEN YOU RISE TO ON THIS LEVEL, YOU BEGIN TO LOVE MEANT NOT BECAUSE THEY ARE LIKABLE BUT BECAUSE GOD LOVES THEM. HOWEVER, WHAT ABOUT THOSE THAT ARE LOOKING TO MENTALLY ABUSE US, OVER STEERING US DOWN, AND NEVER WANTING TO SEE US SUCCEED. DO THEY DESERVE LOVE? DO THEY DESERVE FREEDOM? WHEN THIS THOUGHT BOMBARDS OUR MIND WE MUST ALLOW DR. KING'S WORDS TO RAIN THROUGH OUR HEIRS AND PENETRATE OUR VERY SOULS. NO ONE IS FREE.
UNTIL WE ARE ALL FREE. EVEN WHEN SOMEONE HATES US WITHOUT CAUSE, WE MUST REALIZE THAT THEY ARE NOT FREE IN THEIR OWN HEART. HOWEVER, WE MUST GO DEEPER TO UNDERSTAND WHERE THEY ARE NOT FREE.
WE MUST MAKE IT OUR PERSONAL RESPONSIBILITY TO SET THEM FREE FROM THEIR HATE, BY CHOOSING TO FORGIVE THEM FOR IT.
FORGIVENESS SHOWS THAT DESPITE BEING MISTREATED, WE STILL CARE FOR THE WELL-BEING OF OUR OPPRESSOR.
AND DESIRED TO SEE THEM RELEASE FROM EIGHT THAT OPPRESSES THEM.
THIS DEMONSTRATION OF LOVE DOES NOT MAKE ANY LOGICAL SENSE, AS INCOMPREHENSIBLE TO THE HUMAN MIND.
HOWEVER, IT IS THIS DEMONSTRATION OF LOVE THAT CAN FREE SOMEONE ELSE ASIDE. BRINGING LIGHT TO THEIR ETERNAL DARKNESS AND IS THE ONLY THING THAT CAN TURN AN ENEMY INTO A FRIEND. NEVERTHELESS, EVEN THOUGH FREEDOM BEGINS IN THE HEART, IT IS MAINTAINED THROUGH THE MIND.
YOU MAY BE FREE IN OUR HEART, BUT OUR MIND GIVES US THE POWER TO OPERATE IN OUR FREEDOM. WHEN WE OPERATE IN OUR FREEDOM,
[00:10:02]
WE ARE NOT HELD BACK AND ABLE TO ELEVATE TO OUR HIGHEST POTENTIAL. INSTEAD, WE CAN BECOME ALL THAT WE ARE DESTINED TO BE, WITHOUT ANY RESTRAINT OR HINDRANCES.THE MIND CAN BE OUR GREATEST WEAPON, BUT OFTEN IS THE GREATEST BATTLEFIELD THAT MANY FIND THEMSELVES LOST AND DEFEATED. HOWEVER, EDUCATION CAN FREE OUR MINDS. GIVING US THE POWER TO THINK, SPEAK, AND ACT APPROPRIATELY. HELPING US TO ARTICULATE, OUR HEARTS INNERMOST DREAMS, AND DESIRES.
WE MUST SEEK TO BE EDUCATED, AND IF WE ARE ALREADY EDUCATED WE MUST EDUCATE EACH OTHER, RATHER THAN WITHHOLDING THE PRECIOUS KNOWLEDGE THAT WE POSSESS. AS A HUMAN RACE, WE CANNOT STRICTLY EDUCATE ONE GROUP OF PEOPLE AND NOT EDUCATE ANOTHER.
BECAUSE THIS WILL PRODUCE A RIPPLE EFFECT ON EVERYONE.
THE GROWTH OF HUMANKIND IS BASED UPON THE EDUCATION OF ALL PEOPLE, ALL RACES, ALL DIVERSE BACKGROUND.
EDUCATION ONLY HAS A CAPACITY TO FEED THE MIND OF ONE BUT THE POWER TO FREE THE WORLD. THUS WE MUST SET ASIDE OUR DIFFERENCES, AND STAND SIDE BY SIDE TO LOVE AND EDUCATE ONE ANOTHER, TO ENSURE THE FREEDOM OF ALL PEOPLE.
TRANSFORMING DR. MARTIN LUTHER KING JR.'S DREAM, INTO REALITY THANK YOU FOR YOUR TIME. [APPLAUSE]
>> I WILL TELL YOU WHEN I LISTEN TO THIS YOUNG MAN, IT TOTALLY RENEWS MY FAITH IN THE YOUNGER GENERATION.
AND I AM ALMOST SPEECHLESS. BE A LAWYER I'M NEVER TOTALLY SPEECHLESS. BUT I WILL SAY WHAT A WONDERFUL YOUNG MAN. WE WANT TO PRESENT YOU WITH A RECOGNITION. A CERTIFICATE OF RECOGNITION, KING WE THINK YOU HAVE DONE THINGS IN A STAND OF WAY.
>> ALL RIGHT WE ARE GOING TO MOVE INTO THE NEXT PROCLAMATION, WHICH WILL BE PRESENTED BY COMMISSIONER ARNOLD.

ON THE HALF OF THE I PRESENT YOU WITH THIS.
[APPLAUSE] >> THANK YOU TO THE COMMISSION WE ARE GRATEFUL TO BE HERE. IT IS ALWAYS AN EXPERIENCE OF GRATITUDE AND SUPPORT. AS LIBRARIANS WE LIKE FACTS AND INFORMATION, SO WE LIKE TO GIVE YOU A FEW PIECES OF INFORMATION THAT SUPPORT THE IDEA THAT WE ARE TRULY PART OF THE COMMUNITY.
IN THE UNITED STATES AS OF 2020 THERE ARE 13,673 MCDONALD'S FRANCHISES ACROSS THE COUNTRY. AT THE SAME TIME THERE WERE 9,057 PUBLIC LIBRARIES. 3,094 ACADEMIC LIBRARIES, 99,076 SCHOOL LIBRARIES INCLUDE A HUNDRED AND 60 WITH THE BUREAU OF INDIAN AFFAIRS. SPECIAL LIBRARIES WHICH COULD BE ALL SORTS OF THINGS, RELATED TO MUSEUMS. 5,150, THERE ARE 239 ARMED FORCES LIBRARIES.

EACH YEAR THE AMERICAN LIBRARY ASSOCIATION SPONSORS THE I LOVE MY LIBRARY AND AWARD, WHICH IS A COMMUNITY AWARD WHERE MEMBERS OF THE COMMUNITY AND THE CITIZENS NOMINATE THEIR LOCAL LIBRARIANS ACROSS THE COUNTRY FOR THE IMPACT OF THE COMMUNITY. OVER THE PAST YEAR WE'VE HAD 1300 NOMINATIONS ACROSS THE COUNTRY.
FOR THOSE CAME FROM ST. JOHN'S COUNTY.
IN THE PERSONS OF ANGEL BAYER, ANDY, ALEX PHILLIPS AND BRAD PELTZ. AND ONE OF THE NOMINATIONS I WOULD LIKE TO USE SIMPLE SENTENCE FROM I THINK YOUR SECRET IS THAT SHE TRULY IS AUTHENTIC AND GENERALLY CARES ABOUT THE COMMUNITY IN THE LIVES SHE INTERACTS WITH ON A DAY-TO-DAY BASIS. THIS CAN BE SAID FOR THE MANY STAFF AND VOLUNTEERS AND FRIENDS OF THE LIBRARY ARE PARTNERS THROUGHOUT THE COMMUNITY AND ANYONE WHO HELPS MAKE THE ST. JOHN'S COUNTY LIBRARY SYSTEM SPECIAL.

[Public Safety Update]

>> ALL IN FAVOR SAY AYE. >> AYE.
>> THE PROCLAMATION IS ACCEPTED LET'S GO TO THE PUBLIC SAFETY UPDATE. GOOD MORNING CHIEF.
>> GOOD MORNING COMMISSIONERS THIS PAST WEEKEND I HAD AN OPPORTUNITY TO GO TO WEB AND OUT WITH THE CHIEF ASSOCIATION WINTER GAMES THEY WERE HELD AT WORLD GOLF VILLAGE.
ABOUT 140 FROM THE STATE OF FLORIDA.
AND ACTUALLY ONE TEAM FROM GEORGIA.
TO COMPETE IN SOME FIRE RESCUE TYPE ACTIVITIES THROUGHOUT THE DAY. THERE WAS ALSO ADVISORS.
I HAVE TO BRING THIS UP WE STARTED OUR EXPLORER PROGRAM WE DID NOT COMPETE IN THIS YEAR'S EVENT.
HOPEFULLY THE YEARS, IT WILL BE ABLE TO PUT A TEAM TOGETHER IT WENT REALLY WELL AND IT JUST KIND OF REMARKABLE DECEIT 140 YOUNG PEOPLE WHO EAGLE. EAGER.
AND THEY WANT TO WIN TROPHIES ARE THOUGHT TO GIVE YOU AN UPDATE AND I WILL ANSWER QUESTIONS IF YOU HAVE ANY.
>> ANY QUESTIONS? THANK YOU CHIEF.
GOOD MORNING AGAIN SHERIFF,. >> MR. CHAIR AND COMMISSIONERS GOOD MORNING ONCE AGAIN, I JUST WANT TO SAY REAL QUICK BEFORE CAPTAIN DURBIN SPACE THANK YOU FOR ALLOWING ME TOO READ THE INTRODUCTION ON KING EFFORT. AND IF SOCIETY IS IN OUR HANDS OF OUR YOUTH I THINK WE CAN AGREE WERE GREAT HANDS.
WHEN YOU KNOW THESE KIDS PERSONALLY AND PROFESSIONALLY AND ACADEMICALLY AND YOU SEE THEM SIGNED WITH THE UNITED STATES NAVAL ACADEMY, I WAS HOPING FOR WEST POINT I AM AN ARMY GUY. WITH THAT BEING SAID, WE ARE IN GREAT HANDS WITH OUR YOUTH IN ST. JOHN'S COUNTY.
I WANT TO SIMPLY ADDRESS BEFORE CAPTAIN DURBIN SPACE, AS WE AT THAT SHERIFF'S OFFICE WILL BE MEETING WITH YOU TO DISCUSS OUR BUDGET WORKSHOPS. WE START OUR BUDGET WORKSHOP PROCESS. MORE IMPORTANTLY WE'VE HAD A STRATEGIC PLANNING FOR THE YEARS.
ME AS YOUR SHERIFF I WOULD JUST TELL YOU STRATEGIC PLANNING FOR ME IS A LITTLE MORE IMPORTANT THAN PUTTING PENCIL TO PAPER THAN SOMETHING A PUT A CHECK IN ABOUT FOR ACCREDITATION REASONS.
IT'S A TRUE PLANNING PROCESS AS WE MOVE FORWARD WITH MEANING YOU AND OUR CONSENSUS AS A REDRESS OF ISSUES, AS WE CONTINUE TO GROW HERE IN ST. JOHN'S COUNTY. WITH THAT BEING SAID, YOU WILL SEE OUR BUDGET HERE IN THE NEAR FUTURE.
EACH OF WILL YOU INDIVIDUALLY. I THINK I DON'T WANT TO TAKE THE SALE OF THE WIND. HE'S GONNA SAY A FEW THINGS ABOUT YOUR STAFF WORKING WITH US.
WHICH I WANT TO POINT ESTIMATION POINT BEHIND.
WHAT I WANT TO TALK TO YOU ABOUT TODAY AS WE CONTINUE WE ARE OFF
[00:20:02]
SITE AS WE SPEAK TODAY. THIS IS DAY THREE OF FOUR DAYS.WE ARE DOING A SQUAT ANALYSIS OF THE ST. JOHN'S COUNTY SHERIFF'S OFFICE. PUTTING THE STRENGTHS AND WEAKNESSES AND THE OPPORTUNITIES AND THREATS THAT WE WILL FACE WHEN WE CONTINUE TO PROTECT ST. JOHN'S COUNTY.
AND KEEP IT THE SAFEST PLACE TO LIVE AND WORK AND PLAY AND RAISE A FAMILY. AND RETIRE BECAUSE THAT SEEMS TO BE THE COMMON DENOMINATOR IN ST. AFTER THE PLANET WE ARE HERE TODAY THIS IS WHAT WE ADDRESS. WE COME WITH THREE PRIORITIES.
THIS IS SOMETHING THAT I BELIEVE OUR CONSTITUENTS KNOW ABOUT OUR COMMUNITY KNOWS ABOUT, AND AGAIN OUT VISION POPULATION WAS ABOUT AS WELL. WHERE ADDRESSING CONCERNS OF STS OFFICE AND MOVING TO ST. JOHN'S COUNTY SHERIFF OFFICE AND BUILDING A NEW OFFICE. WE NO LONGER CAN OCCUPY THE 1953 BUILDING, WHICH NOW IT USED TO BE THE JAIL THAT ACTUALLY HOUSE MOTLEY THINKING. WE CAN NO LONGER OCCUPY THE THE POTATO CHIP FACTORY IN 1,963. SO IT IS TIME TO MOVE THE SHERIFF'S OFFICE TO A BETTER LOCATION UNDER ONE ROOF WHERE THE OPERATIONS AND CRIMINAL OPERATIONS DIVISIONS, AND ARE EVIDENCE SECTIONS. IT GIVES US FUTURE GROWTH OF PROPERTY ACROSS THE STREET AS SOMEDAY DOWN THE ROAD WE ARE GOING TO HAVE TO RESPIN THAT JAIL.
WE CANNOT WRITE ON THESE NUMBERS FOREVER.
AND WE CANNOT OCCUPIED 1985 JAIL IN THE CURRENT FACILITY THAT WE SPEAK. SO NUMBER ONE IS MOVING TO ST. JOHN'S COUNTY SERVICE OFFICE UNDER ONE ROOF.
IN THE AREA OF ST. JOHN'S COUNTY WHERE WE DON'T NEED TO EVACUATE FROM HURRICANE IRMA AND MATTHEW. WE ARE NOT IN A FLOOD ZONE PLANE. WE HAVE COMMUNICATIONS AS YOU KNOW AND APPROVED A FEW YEARS AGO.
WHICH IS NOW OPERATING AS OF LAST YEAR.
PRIORITY NUMBER TWO IS TO CONTINUE TO ADDRESS CONCERNS OF COMPENSATION AND BENEFITS FOR THE EMPLOYEES OF ST. JOHN'S COUNTY SHERIFFS OFFICE. AS WE APPROACH 1,000 MARK, WE WILL BE CREEPING TOWARDS THAT 1,000 MARKS AND EMPLOYEES IN STS OFFICE. BETWEEN PART-TIME AND FULL-TIME, WE HAVE TO FIGURE OUT HOW EMPLOYEES CAN WORK AND LIVE AND RAISE A FAMILY IN ST. JOHN'S COUNTY.
THAT'S WILL BE A PLAN THAT YOU WILL HEAR ADDRESS TWO WORKSHOPS IN THE BUDGET. THE LAST THING WE WILL TALK ABOUT IS A ST. JOHN'S COUNTY JAIL.
RIGHT NOW THERE ARE SEVEN JAILS ON A 67 IN FLORIDA 67 SHARES AT 67 COUNTIES. SEVEN JAILS OPERATED BY THE BOARD OF COUNTY COMMISSIONERS. THE FLORIDA CONSTITUTION AS YOU ALL KNOW THAT JAIL TECHNICALLY BELONGS TO YOU.
I WOULD SAY, I WILL GIVE ABOUT YOU BUT I WON'T.
WE HAVE TAKING A PASSION, AND APPROACH FOR RE- OFFENDER REENTRY PROGRAM AND ST. JOHN'S COUNTY.
MY GOAL IS THIS AN MOTTO IS AS WE ARE MAKING PEOPLE INTO SOMETHING BETTER THAN WHEN THEY ENTER THE DOORS OF THE ST. JOHN'S COUNTY JAIL. WITH THAT BEING SAID WE AS A COMMISSION HAVE TO ADDRESS THE CONCERNS DOWN THE ROAD.
HOW LONG CAN WE LET THE SHELL GO AT THE CURRENT SIZE, AS WE DEAL WITH MENTAL HEALTH, SUBSTANCE ABUSE, COVID-19, UNIQUE CIRCUMSTANCES AND STUFF AND THAT THE JAIL BYLAW HAVE TO SEPARATE AND SEGREGATE PER SE BASED ON CLASSIFICATION.
SO AGAIN THOSE THREE PRIORITIES BY THE STREET PLANNING AND SWOT ANALYSIS ARE AGAIN TO MOVE IN WHEN WE GO IN ST. JOHN'S COUNTY? WE HAVE LAND THE COUNTY HAS LAND WE IDENTIFIED IT.
NOW IT IS HOW DO WE GET THIS FACILITY OUT OF THERE IN ONE ROOF FOR OUR EMPLOYEES. TO PUT IN THE BLESSED PLACE THAT WE CONTINUE TO PROVIDE THIS QUALITY OF LIFE ARE CITIZENS OF ST. JOHN'S COUNTY. AGAIN, ON PRIORITY NUMBER THREE THAT OPENS UP LAND ACROSS THE STREET FOR FUTURE DEVELOPMENT AND GROWTH. IN REFURBISHMENT OF THE JAIL THAT IS GOING TO HAPPEN UNDER OUR TENT IS GOING TO HAPPEN.
THE INCREASING GROWTH IN ST. JOHN'S COUNTY IS 47% IN THE LAST TEN YEARS. TO WE ARE GOING TO CONTINUE TO HAVE CRIME IN ST. JOHN'S COUNTY. WE HAVE A LOW CRIME RATE BUT I DON'T KNOW HOW LONG WE CAN SUSTAIN IT WITH GROWTH.
THANKS FOR THE TIME I WILL LET CAPTAIN DURBIN TOUCH ON A FEW
THINGS AND WE APPRECIATE YOU. >> GOOD MORNING.
GREG YOU CAN COME ON UP. YOU KNOW I HAVE BEEN IN THIS BUSINESS FOR 25 YEARS. I HAVE SEAT UNDULATING RELATIONSHIPS IN COUNTY GOVERNMENT.
BUT I JUST WANT TO TALK ABOUT RELATIONSHIPS FOR A MINUTE.
A MAN CAN ONLY GO SO FAR BY HIMSELF.
HE NEEDS HELP. SAME THING GOES FOR THE SHERIFF'S OFFICE. YOU CAN COME OVER HERE.
DON'T BE AFRAID. I JUST WANT TO SPEAK TO THE LEADERSHIP OF OUR SHERIFF AND ADMINISTRATOR.
THAT YOU KNOW WE HAVE CULTIVATED THESE RELATIONSHIPS.
HE AND I HAVE PRETTY MUCH WORKED TOGETHER ON A DAILY BASIS.
AND THAT IS KIND OF UNSEEN AND UNHEARD OF IN OUR BUSINESS.
BUT IT'S CULTIVATED SO MANY GOOD RELATIONSHIPS.
GAIL OLIVER, KATIE DIAZ, THE LIST GOES ON AND ON.
JOY AND PRATT, WE CONSTANTLY COMMUNICATE AND IT IS A BEAUTIFUL THING. TOGETHER I THINK WE CAN DO A LOT OF GREAT THINGS. I JUST WANT TO PRAISE YOUR STAFF PUBLICLY AND TELL THEM FROM THE BOTTOM OF MY HEART AND THE SHARES ARE THANK YOU FOR ALWAYS PARTNERING WITH US, I KNOW WE HAVE SOME MOUNDS WE HAVE TO CLIMB TOGETHER.
BUT WE ARE GOING TO DO IT TOGETHER TO THANK YOU.
[Clerk of Court's Report]
[APPLAUSE] >> THANK YOU GUYS APPRECIATE
[00:25:03]
THAT. NOW WE ARE GOING TO HEAR FROM THE CLERK OF COURT MR. PETTY HOW YOU DOING?>> GOOD MORNING COMMISSIONERS ARE WE DOING GOOD TO SEE WELL.

[1. NEFRC Educational Summit on Overdoses. At the direction of its Board of Directors, the Northeast Florida Regional Council will be conducting an Educational Summit on Overdoses (focusing on opioids/fentanyl). The summit will bring together key stakeholders and policy makers to discuss overdose related data in Northeast Florida. The summit will highlight several successful programs that have been implemented by counties in the Region, in hopes they can be replicated in other communities. The focus will be on sharing best practices, understanding needs, and identifying gaps as we start the conversation on a regional level. The summit will include information from behavioral and mental health facilities, hospitals, health departments, the Drug Enforcement Administration (DEA), the National District Attorneys Association, local fire rescue departments, law enforcement and others. This educational summit will be held at World Golf Village in St. Augustine, FL on Thursday, March 31, 2022. More details are to follow, and a save the date flyer for the event is attached. Speakers include: Dr. Raymond Pomm, Gateway Community Services, Nancy Russo, SMA Healthcare, Dr. Huson Gilberstadt, Ascension, Major Scott Surrency, Putnam County Sheriff’s Office, Glenn East, Clay County Fire Rescue]
REGULAR AGENDA START WITH NUMBER ONE.THE AND EF ARTSY EDUCATIONAL SUMMIT ON OVERDOSES.
>> IT WAS CHAMPIONED BY TWO OF OUR BOARD MEMBERS AND DISCUSS ABOUT ALL BOARD MEMBERS AND DECIDED TO TAKE IT AS A REGIONAL ISSUE, THAT THIS IS AN ISSUE THAT WE NEED TO TALK TO ABOUT A REGIONAL LEVEL AND TO PROMOTE NORTHEAST FLORIDA TO GET RESOURCES INTO NORTHEAST FLORIDA.
AS A RESULT OF THIS STAFF CAME UP WITH THE IDEA OF DOING AN EDUCATIONAL SUMMIT ON OVERDOSES. AND WHEN STAFF GOT INTO THIS AND STARTED LOOKING AT THE ISSUE, WE REALIZE THAT THE ISSUE IS A LITTLE BIT BIGGER THAN JUST OPIOIDS AND FENTANYL.
YES WE ARE SEEING THE DEATHS COME FROM AND PEOPLE GETTING KILLED AS A RESULT OF THESE SPECIFIC SUBSTANCES, BUT THERE IS A LARGER ISSUE HERE. WHICH IS ADDICTION.
WE'VE SEEN ADDICTIVE QUALITIES AND INCREASE IN THE PAST FEW YEARS AND IS SOMETHING THAT WE REALLY THOUGHT WE SHOULD ADDRESS HEAD ON. AS A RESULT OF THIS WILL GET TO THIS EDUCATIONAL SUMMIT. HELD ON MARCH 31 HELD IN ST. JOHN'S COUNTY WORLD GOLF VILLAGE.
WE WERE REALLY GOING TO FOCUS ON A FEW KEY FACTORS, THE STIGMA BEHIND IT, GETTING PEOPLE TO FEEL COMFORTABLE COME OUT AND
[00:30:01]
ASKED FOR HELP. SAY HEY YOU ARE NOT ALONE.LET'S GET YOU HELP AND DO STUFF TO GET YOU ON THE RIGHT PATH.
THE MENTAL HEALTH SUBSTANCE ABUSE DISORDER TREATMENT.
WE ARE TALKING NEUROSCIENCE OF THE BRAIN AND WHAT IS GOING ON CHEMICALLY. BUT THEN IN NORTHEAST FLORIDA WE HAVE A NUMBER OF COUNTIES DOING SOME SORT OF A PROJECT ADDRESS THE ISSUE. ONE OF THOSE PROJECTS IS HOW ARE THEY FUNDED? HOW ARE THEY COMING, WHAT CHALLENGES DO THEY SEE SO WE REALLY WANT TO HIGHLIGT THOSE PROJECTS. AS WELL AS WHAT ARE OUR LAW ENFORCEMENT PARTNERS AND FIRST RESPONDERS AND FIRE RESCUE DEPARTMENTS WHAT DO THEY SEE WHEN THEY RESPOND TO THESE CALLS? WHAT DO THEY SEE EVERY DAY ON THEIR DAILY JOB? WHY ARE WE DOING THIS? WELL IN A 2021 SURVEY, 41 MILLION AMERICANS AGES 12 AND OVER HAD A SUBSTANCE ABUSE DISORDER.
OF THOSE 41 MILLION AMERICANS ONLY 4 MILLION SOUGHT TREATMENT.
YOU CAN KINDA INFER OF THOSE PEOPLE THAT DID NOT GET SPECIALIZED TREATMENT, THERE IS PROBABLY THREE GROUPS CONTAINED IN THAT. THERE IS THE GROUP THAT IS NOT READY FOR RECOVERY, THERE IS THE GROUP THAT DOES NOT HAVE ACCESS TO SPECIFIC PROGRAMS OR PROJECTS TO HELP THEM.
OR, THERE IS THAT OTHER GROUP THAT MAY NOT BE AWARE OF IT OWED JUST DO NOT HAVE IT AVAILABLE. SO WE REALLY WANT TO ADDRESS THE ISSUE HEAD ON. BETWEEN 2018-2,019TH THERE WERE 2,000 PEOPLE IN NORTHEAST FLORIDA THAT NEEDED 911 MEDICAL SERVICE. AS YOU ALL KNOW EVERY TIME 91 IS CALLED EACH RESCUE UNIT, THAT IS A COST.
AND THAT IS A COST THAT THE COUNTIES ARE INCURRING.
I DID PURPOSELY LEAVE THE CITY OF JACKSONVILLE OUT OF THIS FOR THE SAKE OF SOMETIMES AND A LOT OF OTHER COMMUNITIES, THINGS THAT HAPPEN IN THE CITY OF JACKSONVILLE OVERSHADOW WHAT IS GOING ON OUTSIDE THE CITY OF JACKSONVILLE.
WHEN YOU ADD THEM INTO THIS THE NUMBER GOES UP TO OVER 4,000 INDIVIDUALS IN NORTHEAST FLORIDA ALONE.
THE METHODOLOGY AND WHY WE ARE DOING THIS WITH STAFF WITH THE WAY THE STAFF ADDRESS THE ISSUE BUT IT DOWN INTO THESE THREE TOPICS. THE BEHAVIORAL MENTAL HEALTH SIDE WHAT IS ADDICTION? WHAT ROLE DOES STIGMA PLAY? WHAT RESOURCES ARE AVAILABLE? SUPPLY AND DEMAND? HOW CAN WE CURB THAT, HOW CAN WE LOWER THE DEMAND FOR SUBSTANCES? WHAT ARE OUR LAW ENFORCEMENT PARTNERS NEED? THE FUNDING SOURCES IMPORTANT, WHAT OTHER PROJECTS OUT THERE? HOW ARE THEY FUNDED? HOW CAN WE GET MORE OF THAT FUNDING INTO THE REGION? WHAT GRADES MAY BE AVAILABLE? BUT ALSO WHAT IS JUST FREE, IT IS JUST A SOCIETAL AND MINDSET CHANGE OF HOW WE ADDRESS THIS ISSUE.
SO WE ARE GOING TO TALK ABOUT SOME OF THOSE THINGS.
JUST TO HIGHLIGHT A FEW OF THESE SUCCESSFUL PROJECTS THAT WE TALKED ABOUT, THESE WILL BE SOME OF THE PROJECTS SAVE LIVES, MOST OF YOU HEARD IT OUT OF JACKSONVILLE IT'S MATCHING PEERS WITH INDIVIDUALS IN THE HOSPITAL WHEN THEY COME TO THE HOSPITAL WITH AN OVERDOSE. BUT THEN THERE IS ALSO SOME OTHER THINGS. AND WE HAVE TWO HOSPITAL SYSTEMS THAT WILL ALSO COME INTO SAY HOW THE HOSPITAL SYSTEM AS LEARNED AND CHANGE THEIR PRESCRIPTION PRACTICES AS WE BECOME MORE KNOWLEDGEABLE WITH THE SUBSTANCES.
OVERDOSE TWO ACTION IS A STATISTICAL GROUP, THEY WERE KIND ENOUGH TO PROVIDE ME WITH STATISTICS AND WHAT THIS IS FOR ST. JOHN'S COUNTY. LOOKING AT 2019, COMPARED TO 2021, INDIVIDUALS THAT WENT TO AN EMERGENCY ROOM WITH ZIP CODE DATA WHEN THEY PROVIDED INFORMATION, WHO WENT TO THE EMERGENCY ROOM AS A RESULT OF AN OVERDOSE OR CONSUMING A SUBSTANCE? SO THESE THREE ZIP CODES STOOD OUT. 32034, FROM 2019-2021, PSALM 198% INCREASE. 32097, SAW A 70% INCREASE, 32046 HUNDRED AND 82%. INDIVIDUAL 75 YEARS AND OLDER CZAR IN AN INCREASE OF 621%. 55-74258%, AND 35-54 -YEAR-OLDS SEEING 66%. BREAKING THAT DOWN JUST A LITTLE BIT FURTHER, MAY ALSO SAW AN INCREASE OF OVER 106% AND FEMALES SAW AN INCREASE OF HUNDRED AND 17%.
SO IT IS AN ISSUE THAT TOUCHES ALL ASPECTS OF SOCIETY, ALL OF OUR ZIP CODES AND ALL OF THE INDIVIDUALS THAT RESIDE HERE IN FLORIDA. THESE WILL BE SOME OF THE SPEAKERS THAT YOU WILL HEAR FROM THAT DAY.
JUST TO COME TO GIVE YOU A BRIEF GLIMPSE INTO WHAT THEY WILL TALK ABOUT. DR. PALM WILL SPEAK TO NEUROSCIENCE, AND GIVING A PRESENTATION WOULD PAINLESS AS A RESULT OF SIGMA. WHAT ROLE THAT PLACE, AND THEN SOME OF OUR OTHER COUNTY PROJECTS THAT WILL BE COMING IN AS WELL AS WELL AS THE DEA WILL BE HERE TO PRESENT TO US.
THE EVENT WILL BE MARCH 31 AND WORLD GOLF VILLAGE IN SAINT AUGUSTINE. THEN IT IS A FREE EVENT THAT WILL BE DONE VIA AWARD CEREMONY AND IS THE SAME SYSTEM.
AND THAT WILL BECOME OUT HERE IN THE NEXT WEEK AND IT IS ALL READY TO GO WE ARE JUST WAITING ON THE PERFECT TIME TO SEND IT
[00:35:04]
TO EVERYBODY. THAT WILL COME THROUGH YOUR COMMISSIONERS WHO SIT ON THE BOARD OF REGIONAL COUNSEL.AND TO COUNTY STAFF AND WE HOPE THAT YOU CAN ATTEND.
THE TARGET AUDIENCE WE LOOK FOR IS TO MISS A PALI AND COUNTY LEADERSHIP. YOUR ADMINISTRATION'S FIRST RESPONDER LEADERSHIP, BUT A GROUP THAT IS NOT ON THIS LIST THAT ABSOLUTELY SHOULD BE IS YOUR SCHOOL BOARD OFFICIALS.
TOUCHING THIS THING EARLY, CATCHING IT IN SCHOOLS, IS THE MOST VITAL IMPORTANT PIECE OF THIS.
WITH THAT THAT IS ALL I HAVE FOR YOU, THIS IS TO SAVE THE DATE MARCH 31, WORLD GOLF VILLAGE FREE EVENT TO ATTEND AND YOU WILL GET THE EVENT REGISTRATION PAGE AND NEXT WEEK OR SO WITH THAT I'M HAPPY TO ANSWER ANY QUESTIONS.
>> ANY QUESTIONS OF MR. NOLAN? >> THANK YOU, MR. CHAIRMAN AND MR. KNOWING TO YOU AND ALL OF YOU I WANTED SAY SAY THANK YOU.
A LOT OF PEOPLE HAVE THE PERCEPTION WE HAVE A LOT OF FOLKS ARE DOING WELL AT ST. JOHNS COUNTY AND A LOT OF PEOPLE WHO ARE EDUCATED. [Items 2 & 3]
>> THANK YOU. >> THANK YOU YOU ALL HAVE A GOOD
MORNING. >> WE WILL TAKE UP ITEMS TWO AND THREE AND HERE'S HOW WITH THE APPROVAL OF MY FELLOW COMMISSIONERS HERE WAS WHAT I WOULD SUGGEST.
I HAVE BEEN TOLD THAT THE APPLICANT WISHES TO WITHDRAW ITEMS TWO AND THREE THIS MORNING.
SO WHAT I WOULD LIKE TO DO IS HAVE A QUICK PRESENTATION BY THE APPLICANT, AND THEY TAKE PUBLIC COMMENT, AND THAT IN THE PUBLIC COMMENT WE WILL ONLY ADDRESS THE ITEMS THAT WITHDRAWAL OF ITEMS TWO AND THREE. AND THEN I WILL CALL FOR A VOTE ASSUMING THAT WE PROCEED WITH THE VOTE I WILL CALL FOR A VOTE.
JUST ONE VOTE ON ITEMS TWO AND THREE.
SO HOPEFULLY THIS WILL GO REASONABLY SMOOTH.
NEVERTHELESS WHAT SAY THE APPLICANT?
>> FIRST OF ALL GOOD MORNING COMMISSIONERS GOOD TO SEE YOU AS A POINT OF CLARIFICATION OUR REQUEST TODAY IS TO CONTINUE TO A DATE UNCERTAIN OF THESE TWO DEVELOPMENT AGREEMENTS FROM TODAY TO A DIFFERENT DATE. ALSO THERE ARE TWO COMPANION APPLICATIONS ONE IS A COMPREHENSIVE PLAN AMENDMENT APPLICATION. THE SECOND IS A PUD REZONING APPLICATION THAT WAS SCHEDULED FOR YOUR BOARD ON MARCH 15.
AND SO WE WOULD RESPECTFULLY REQUEST THAT THAT ENTIRE DOCUMENT PACKAGE, BE CONTINUED FROM PUBLIC HEARINGS TO A DATE UNCERTAIN. THAT WE WILL WORK WITH STAFF TO RESCHEDULE THESE HEARINGS, WE JUST HAVE A LITTLE BIT MORE WORK TO DO ON TRANSPORTATION MITIGATION FOR THE PROJECT.
>> OKAY, I WILL TAKE PUBLIC COMMENT NOW ON ITEMS TWO AND THREE TOGETHER. ITEMS TWO AND THREE AND THE ISSUE IS WHAT ALL -- WITHDRAWAL THESE ITEMS TO A FUTURE DATE, AND ANYBODY WISH TO SPEAK ON ITEMS TWO AND THREE TOGETHER? DOES IT IS THERE ANYONE WHO WISHES TO SPEAK? SEEING NONE WE WILL HAVE IS THERE A MOTION TO WITHDRAW IT TO A TIME UNCERTAIN ON ITEMS TWO AND THREE?
IS THERE EMOTION? >> MR. CHAIRMAN I WILL MOVE WE
WILL WITHDRAW THESE ITEMS. >> SECOND.
>> WE HAVE A MOTION BY COMMISSIONER WHITEHURST AND A SECOND BY COMMISSIONER ARNOLD TO WITHDRAW ITEMS TWO AND THREE AND ALSO NOTE THAT THE COMPLIMENT AND PUD THAT WERE SCHEDULED FOR MARCH 15 ALSO BE POSTPONED AND MOVED TO AN UNCERTAIN TIME.
WITH THAT PLEASE VOTE. THAT PASSES 5-0.
>> COMMISSIONER DEAN? EXCUSE THE INTERRUPTION SENIOR ASSISTANT COUNTY ATTORNEY, FOR THE PURPOSES OF THAT MOTION, IT WAS TO CONTINUE THE ITEMS, AND NOT WITHDRAW, WITHDRAW HAS A DIFFERENT MEANING. I JUST WANT TO MAKE IT CLEAR FOR
[4. St. Johns County Florida Taxable Special Obligation Revenue Note, Series 2022: South Ponte Vedra Beach Dune and Berm Restoration Project. On January 18, 2022, the St. Johns County Board of County Commissioners adopted Resolution 2022-25, associated with the South Ponte Vedra Beach Dune Restoration Project, awarding a contract for Bid No. 22-32 contingent upon approved financing and directing the County’s financing team to prepare the loan documentation necessary to finance the South Ponte Vedra/Serenata Beach Dune Restoration Project, to be brought back for BCC consideration on February 15, 2022. The agenda item presents the prepared financing, including the Authorizing Resolution, TD Bank proposal and the Loan Agreement. If approved, a Tourist Development Fund Category 5 reserve was established, as part of the adopted FY 2022 Budget, for the purpose of participating in the annual debt service. Staff would recommend the appropriation of up to $400,000 from Tourist Development Category 5 reserves for initial debt service payment for this project. ]
THE RECORD. >> I WILL ACCEPT THAT ON THE RECORD. THEY ARE CONTINUED AND TO A TIME
>> IS THAT CORRECT? OKAY ITEM FOUR.
>> GOOD MORNING CHAIRMAN DEAN COMMISSIONERS JESSE DONE DIRECTOR FOR THE OFFICE OF MANAGEMENT AND BUDGET ITEM FOUR IS THE I WILL BRING THAT UP ON THE SCREEN.
IT IS RELATED TO THIS SOUTH PONTE VEDRA BEACH IN DUNE AND PERM RESTORATION PROJECT. ON JANUARY 18 WE PRESENTED THE OVERVIEW OF THE PROJECT THOMAS AS FOR DIRECTION FROM THE COUNTY IN TERMS OF THE CONTRACT ITSELF. AS WELL AS THE FINANCING.
[00:40:02]
AND WE SAID WE WOULD BRING BACK THE FINANCING ON FEBRUARY 15.SO THAT IS WHAT WE ARE HERE FOR TODAY.
IT IS TO GO OVER THAT. WHAT I AM GOING TO DO IS I AM GOING TO BRING JAKE GLOVER FROM PFM TO PROVIDE A TRANSACTION OVERVIEW. PFM IS OUR FINANCIAL ADVISOR.
>> CHAIRMAN AND COMMISSIONERS JAKE GLOVER FROM PFM FINANCIAL ADVISORS. I AM HERE TO GIVE YOU A BRIEF OVERVIEW OF THE TRANSACTION CONTEMPLATED HERE.
AGAIN, AS JESSE MENTIONED, ON JANUARY THEY GAVE US DIRECTION TO MOVE FORWARD WITH FINALIZING THE DOCUMENTATION ASSOCIATED WITH FINANCING THIS PROJECT. IN ORDER TO PROVE TO BE ABLE TO REMOVE QUICKLY AND IN CASE THAT DIRECTION WAS PROVIDED.
WE ACTUALLY WENT OUT FOR AN RFP FOR A BANK LOAN AND 2021.
SO THAT WE COULD MOVE QUICKLY IF GIVEN THE DIRECTION TO COME BACK BEFORE YOU WITH THIS FINANCING SO THE PROJECT CAN GET STARTED.
SO THAT RFP WAS DONE AGAIN IN LATE 2021, WE ACTUALLY GOT 12 RESPONSES TO THE RFP WHICH IS A GREAT NUMBER.
I WILL NOT READ ALL OF THE BANKS THAT YOU CAN SEE IN THE THIRD BULLET THAT ALL THE BANKS THAT RESPONDED.
THAT NUMBER OF RESPONSES JUST SHOWS THE CREDIT STRENGTH OF THE COUNTY AND PEOPLE'S WILLINGNESS TO LEND TO YOU.
SO YOU SHOULD TAKE COMFORT IN KNOWING THAT.
THE HIGH CREDIT RATINGS THAT COUNTY MAINTAINS RC HELPS WITH THE PROCESS. WE REVIEWED THE PROPOSALS WITH YOUR STAFF, THIS CLOCK STAFF, THE COUNTY ATTORNEY'S OFFICE, TO DETERMINE THAT TD BANK PROVIDED THE BEST OPTION FOR FINANCING.
BASED ON THEIR MOST ATTRACTIVE INTEREST RATES AND TERMS AVAILABLE. WE WERE ABLE TO FOLLOW IN YOUR DIRECTION ON JANUARY 18, ACTUALLY LOCK AND THE TAXABLE INTEREST RATE OF 2.24%. AND THAT IS FIXED FOR THE ENTIRE TERM OF THE FINANCING. AGAIN, THESE BONDS WILL BE PAID OFF BY OCTOBER 1 OF 2031. AND ANOTHER IMPORTANT FEATURE IS THAT THEY ARE ABLE TO BE PREPAID AT ANY TIME WITHOUT PENALTY.
SO THE EXTENT OTHER FUNDS BECOME AVAILABLE FOR THE PYROGENIC IT CAN BE PAID DOWN FOR REDUCED DEBT COSTS MOVING FORWARD.
INCLUDED ON THE PRIOR BEACH FINANCING THAT WE DID, AND DID SO ON THIS ONE AS WELL JUST TO GIVE YOU THE ULTIMATE FLEXIBILITY OF MOVING FORWARD. IF APPROVED, WE ARE ACTUALLY READY TO ISSUE 7,635,000 SPECIAL OBLIGATION REVENUE BONDS TO FUND THIS PROJECT. ANDY FINANCING WOULD CLOSE ON FEBRUARY 18 OF 2022. SO WE ARE READY TO MOVE QUICKLY, ASSUMING WE WILL GET APPROVAL TODAY WE WILL CLOSE THE FINANCING AND LOT THESE TERMS IN.
YOU CAN SEE IN THE FIRST BULLET THE REQUESTED ACTION AND THE ACTUAL RESOLUTION AUTHORIZES NOT TO EXCEED $8 MILLION WORTH OF DEBT. BUT AGAIN WE WILL ONLY ISSUE 7.6 MILLION TO FUND THE PROJECT. AND PAY THE COSTS OF ISSUES AND FINANCING. SO THAT IS A BRIEF OVERVIEW I'M HAPPY TO ADDRESS QUESTIONS THAT YOU MIGHT HAVE ABOUT THE PROCESS THAT WE WENT THROUGH OR THE FINANCING TERMS BEFORE YOU
TODAY. >> THANK YOU ANY QUESTIONS? OKAY I THINK WE ARE READY FOR PUBLIC COMMENT ON ITEM FOR THIS IS FINANCING FOR THE SELF PUBLIC COMMENT.
IS THERE PUBLIC COMMENT? YES, MA'AM?
>> IRVINE BULLET 4370 COASTAL HIGHWAY TO SAINT AUGUSTINE 32084. I JUST WANT TO SAY TWO THINGS TIMELINESS, THESE FOLKS THE NORTH OF ME, AND THEY HAVE BEEN WAITING MUCH LONGER THAN ANYBODY ELSE TO GET THEIR SAND.
AND THEY HAVE HOUSES HANGING ON THE EDGE.
SO TIMELINESS IS OF THE EVIDENCE AND FAIRNESS.
THEY WILL PAY EIGHT TIMES WHAT I PAY FOR MY SAND.
BECAUSE THEY SIGNED ON EARLY TO PAY FOR SAND.
AND SO THEY WERE CUT OUT OF SOME BETTER DEALS.
IT'S I HOPE YOU ALL WILL GO AHEAD AND DO IT IT'S IMPORTANT TO DO IT AND IT'S IMPORTANT TO DO IT QUICKLY.
IT IS TWO YEARS LATE QUICKLY BUT PLEASE THANK YOU.
>> THANK YOU, ANY OTHER PUBLIC COMMENT ON ITEM FOR?
IS THERE EMOTION? >> MR. CHAIRMAN I WILL BE PROUD
TO MOVE THIS RESOLUTION 2022,. >> 58,.
>> ACCEPTING THE APPROVAL FROM TD BANK OF HER OWN AGREEMENT AND AUTHORIZING ISSUANCE OF THE ST. JOHNS COUNTY FLORIDA TAXABLE SPECIAL OBLIGATION NOTES. SERIES 2022, IN AN AGGREGATE PRINCIPAL AMOUNT BUT NOT TO EXCEED $8 MILLION.
>> IS THERE A SECOND. >> SECOND.
>> WE HAVE A MOTION AND A SECOND ON ITEM FOUR PLEASE VOTE.
AND THAT PASSES 5-0. ONE OF THE NEAT THINGS ABOUT THIS PROJECT JUST A SECOND I WILL CALL ON YOU.
[00:45:03]
IS IMPORTANT IN MY MIND, UNLIKE THE PROBLEMS THAT WE'VE HAD IN TRUCK CALLS FROM THE BERM ENHANCEMENT.THIS PROJECT WILL USE OFF SHORT SAND FOR SAND SOURCING.
SO WE WON'T HAVE THE PROBLEMS WITH TRUCKS UP AND DOWN COASTAL HIGHWAY OR USING ANY OF OUR PARKING FACILITIES.
SO I AM REALLY HAPPY ABOUT THAT. IT WILL RAISE A LOT OF HEADACHES. JESSE?
>> THERE IS A SECOND MOTION ASSOCIATED WITH AGENDA ITEM.
>> I WOULD BE HAPPY TO MAKE THAT MOTION AS WELL.
I WILL MOVE TO AUTHORIZE A TRANSFER OUT TO $400,000 FOR TOUR'S DEVELOPMENT TAX ON CATEGORY FIVE RESERVED FOR THE INITIAL SERIES 2022 DEBT. SERVICE PAYMENT.
>> SECOND. >> WE HAVE A MOTION AND A SECOND PLEASE VOTE. THAT PASSES 5-0 THANK YOU.
>> AS JESSE IS WALKING AWAY I WANT TO COMPLEMENT AND PAT ON THE BACK TO THE STAFF JESSE AND JOE AND DAMON WHO IS IN THE AUDIENCE FOR THE HARD WORK THEY ARE DOING.
THERE IS SO MUCH GOING ON BEHIND THE SCENES IS UNBELIEVABLE REALLY. WHAT THEY ARE CHARGED WITH AND
[5. Public Hearing * MAJMOD 2020-07 Tolomato River Farms PUD. A request to remove approximately 1.31 acres, change the overall layout of the project on the northern side, remove a planned shared access point, relocate the planned RV/Boat Storage area, add commercial square footage, and change lot layout. The property is located at 3301 and 3303 Coastal Highway in the Vilano Beach area. The Planning and Zoning Agency recommended approval with a 5-1 vote at its December 16, 2021 regular meeting. The Agency discussed the types of commercial that may occur in the PUD and the elevation of the property in relation to SR A1A and the adjacent County Park. The applicant responded that the type of uses will be limited by the size of the proposed building and parking. The applicant proffered that one-half of the building will be used as a market and associated related activities (such as packaged and preprepared foods, vegetables, food products for meals, local coffee, gallery and display space for local artists) and the second one-half of the building will be used for professional offices (which may include uses such as mail and package services, photography studio, and/or other personal services). The applicant revised the MDP Text to reflect this change as recommended by the PZA. ]
THEY ARE WORKING REALLY HARD AND THEY DESERVE RECOGNITION.SO WITH THAT SAID, ALL RIGHT, ITEM FIVE, THAT IS A QUASI JUDICIAL ITEM? ITEM FIVE DO WE HAVE X PARTIES
COMMISSIONER BLOCK. >> THANK YOU, MR. CHAIRMAN, I HAD A MEETING ON NOVEMBER 18, 2021 ABOUT A PARTIALLY 1:00 P.M.
WITH MR. DEREK WOOLVERTON AND GARY PHILLIPS.
WE DISCUSSED THE SCOPE OF THE PROJECT, SOME OF THE ITEMS THAT THEY HAVE A PLAN AND THE HISTORY IN THE BACKGROUND OF THE PROJECT AS WELL AS SOME OF THE IMPACTS OF THE LOCAL COMMUNITY.
WE ALSO HAD A MEETING ON TUESDAY, JUNE 22, SO WE ARE GOING TO GO ON REVERSE ORDER. 2021 APPROXIMATE 10:00 A.M. WITH MR. JARE OVERTON, KAREN TABOR AND MR. PHILLIPS IS PRESENT AS WELL. WE DISCUSSED SOME OF THE WORK THAT THEY DO TO MODIFY THIS PROJECT.
THE SCOPE OF IT AN ADDITIONAL EFFORTS THAT WERE TO MAKE THIS NOT IMPACTFUL ON THE RESIDENCE. THAT'S ALL I HAVE MR. CHAIRMAN.
>> THANK YOU. >> MR. CHAIRMAN ON WEDNESDAY JANUARY 12, AT 12:30 P.M., I MET WITH MS. KAREN TAYLOR AND DEREK OVERTON AND GARY PHILLIPS. WE DISCUSSED THE CHANGES IN THE PROJECT FROM THE ORIGINAL P YOU D THAT WAS PRINTED.
THE MODIFICATIONS UPFRONT AND PARKING WE DISCUSSED PARKING.
AROUND THE STORE ACCESS FROM THE HOUSES TO THE STORE AND UP THE STREET. AND I THINK THAT IS IT.
>> THANK YOU, ON JANUARY 12, ALSO I MET WITH PEOPLE TO DISCUSS THE PROJECT THE REVISED PROJECT, AND THE DIFFERENT AMENITIES OF THE PROJECT. AND IN ADDITION TO THAT I THINK I HAVE RECEIVED NINE OR TEN E-MAILS, REGARDING THIS PROJECT.
AND ALL OF THOSE E-MAILS WERE RECOMMENDING APPROVAL OF THIS PROJECT. FROM THE CITIZENS ALL ALONG THE COASTAL HIGHWAYS. WITH NONE OBJECTING.
THAT'S ALL I NEED TO REPORT. QUESTIONS?
>> ON JANUARY 12 AT A POSSIBLY 1:00 P.M. WITH KAREN TAYLOR AND DEREK WOOLVERTON, AND GARY PHILLIPS AND STAFF, TO DISCUSS EXPIRED PUD CHANGES AND MODIFICATIONS THAT THEY ARE MAKING BRINGING THEM BACK. AND HOW THIS WILL BE A LESS INTENSE USE OF THE LAND THAN PREVIOUSLY APPROVED.
AND I TO HAVE RECEIVED ABOUT A DOZEN OR SO E-MAILS IN FAVOR OF
THIS PROJECT. >> THANK YOU, MR. CHAIRMAN, I MET ON THURSDAY JANUARY 6, 10:30 A.M. KAREN TAYLOR, DEREK OVERTON AND GARY PHILLIPS, WE DISCUSSED THE SCOPE IN THE PLANS IN THE HISTORY OF THE PROJECT. ALSO THE PROPOSED MARKETPLACE, AND I TOO RECEIVED AN OVERWHELMING AMOUNT OF E-MAILS
IN SUPPORT OF THE PROJECT. >> THANK YOU.
MR. TAYLOR? >> THANK YOU GOOD MORNING KAREN TAYLOR 77 ACROSS THE STREET. WITH ME IS DEREK WOOLVERTON, AND MICHAEL PRESENTER WHICH IS JAMES WHITE HOUSE.
ALSO SO WE WILL GO THROUGH, WE CERTAINLY GAVE YOU A LOT OF INFORMATION AT OUR MEETINGS SO WE WILL KEEP THIS BRIEF.
BASICALLY THIS IS JUST A OVERVIEW OF WHERE THIS IS, IT IS NORTH OF THE TOWN CENTER WEST OF THE OCEAN ON THE INTERCOASTAL.
AND JUST SOUTH OF CARPENTER ROAD.
JUST KINDER TO GIVE YOU A RELATION IT IS NORTH OF THE
[00:50:02]
SURFSIDE SUBDIVIION, WHICH IS RESIDENTIAL, AND THAT YOU CAN SEE TO THE NORTH, THE VILLAGES OF MILANO AND THOSE THAT ARE ALSO A SIMILAR TYPE RESIDENTIAL DEVELOPMENTS.FUTURE LAND USE AS A RESIDENTIAL SEE, CONSERVATION, CONSERVATION RELATED TO THE ADJACENT LAND USE OF THE RESIDENTIAL C.
AND VERY SIMILAR RESIDENTIAL C AND CONSERVATION OF LAW ALONG THE COAST. ZONING, THERE IS PUD ZONING ON THAT ORDINANCE 2,000 TO 34. AND A PORTION OF THIS THAT IS BEEN ADDED IN A VARIETY OF THIS AREA.
THIS IS KIND OF JUST TO KIND OF GIVE YOU THE PDF ITSELF WHICH IS 20.48 ACRES. IT ACTUALLY HAS TWO PARTS TO IT WHICH WE WILL CALL THE NORTH PARCEL.
IN THE SOUTH PARCEL, THE SELF PARCEL IS 3.6 ACRES OF IT.
THE OTHER IS 16.88. AUNT VERY LITTLE CHANGE TO THE CELL PARCEL WHICH WE WILL GET INTO.
>> GOOD MORNING JAMES WHITE HOUSE ST. JOHN'S LAW GROUP HERE IN ST. JOHN'S COUNTY. AS KAREN SAID, YOU KNOW YOU GUYS ARE FAMILIAR WITH THE SITE, IT IS SOUTH OF NEW SALEM PARK.
REALLY, ONE OF THE BIG REASONS THAT PRECIPITATED THIS MAJOR MODIFICATION WAS THE FACT THAT THIS APPROVED BACK IN 2022, THERE WAS A SHARED ACCESS. THIS WAS THE MAP FROM THE ORIGINAL PD THAT WHEN IT WAS APPROVED.
THERE WAS A SHARED ACCESS WITH THIS COUNTY WHEN HIS COUNTY LAND IN SALEM PARK WAS TO BE DEVELOPED BACK THEN.
AND SO WE CAME TO AN AGREEMENT OR THE OWNERS CAME TO AN AGREEMENT BACK THAT THAT THIS WAS A SHARED ACCESS ON BOTH SIDES OF THE PROPERTY. AS YOU KNOW NOW, SALEM PARK THE PARKING HAS BEEN DONE ON THE NORTH SIDE OF THAT PROPERTY.
IT IS NOT SHOWN ON THE OVERHEAD. IT IS ACTUALLY I THINK? I THINK THIS IS IT RIGHT? OR JUST OUT OF THAT YES.
SO ANYWAY, THAT IS OKAY, OKAY THAT IS WHERE THE PROPERTY WAS ENDED UP BEING DEVELOPED UP HERE FOR THE PARKING.
SO THE SHARED ACCESS IS NOT NEEDED ANYMORE.
SO A MAJOR PART IS NECESSARY TO CHANGE THAT ACCESS.
SO THIS ACCESS ON THIS ORIGINAL POD APPROVAL APPEAR HAS BEEN MOVED A LITTLE BIT TO THE SELF NOT TO INTERFERE WITH THE COUNTY PROPERTY. THE NEW PUD MAP CLEARLY SHOWS THAT AND I WILL HAVE A LARGER BLOWUP OF IT IN A SECOND PERIOD BUT AS YOU CAN SEE FROM THE TWO GOING BACK AND FORTH, THEY ARE NOT USUALLY DIFFERENT IN THE WAY THAT WE WILL BE DEVELOPED, AS COMMISSIONER WHITE HOUSE NOTED. THERE IS A REDUCTION ON THE DENSITY OF WHAT IS GOING TO BE GOING ON HERE.
AND THERE IS A SALVE PIECE THAT IS PART OF THIS AS WELL THAT IS NOT BEING CHANGED. IN ANY CASE WE HAVE TO INCREASE THAT BECAUSE AS PART OF THE PUD. THERE IS A NUMBER OF SORT OF SMALL CHANGES THAT ARE GOING ON, AND HERE AND THERE IS SOME REMOVAL OF THE PROPERTY AND CONSERVATION OF THE PROPERTY.
THERE IS AN INCREASE OF THE THE BUFFER IN THE FRONT BECAUSE REQUIRED 30 FEET ALONG COASTAL HIGHWAYS.
SO WE ARE GOING FROM 25 OVER 230 IN THE FRONT THEN THERE IS A COUPLE PLACES ON THE MAP WHERE IN THE PUD.
BECAUSE WHEN WE MOVED THE DRIVE MILES FROM THE NORTH, CLOSER TO THE MIDDLE, WE STILL HAVE THAT GOES UP ALONG THE EDGE.
AND SO I THINK IT IS A LITTLE REDUCED OF WHAT THE TEMPLATE IS.
BUT IT IS THE SAME PLACE WHERE THE ROAD WAS GOING TO BE ANYWAY ON THE PREVIOUS PUD. NUMBER TWO THAT IS ALL AREA THAT IS NOT DEVELOPED A COUNTY AREA SO DOESN'T AFFECT ANYBODY ON THAT SIDE. A COUPLE OTHER THINGS IS THAT THERE IS IN THE MULTI FAMILY IN THE FRONT, THERE IS INCREASED TO THE HEIGHT, BECAUSE THAT THERE IS THE WAY THE PLAN THAT DIPS DOWN AND REALLY, IT IS TO PROVIDE THE REVIEW NUMBER ONE.
BUT THE HEIGHT FOR FLOODING OR ANYTHING THAT COMES ACROSS THAT WAY. AS YOU KNOW, THE WATER CAME ACROSS IN MATTHEW. SO IN ANY CASE THAT IS THE REASON FOR THOSE. WE WENT THROUGH A LOT OF THINGS WITH THE PCA AND YOU GOT A RECOMMENDATION.
WE TALKED ABOUT THEM AT LENGTH, AS YOU CAN SEE FROM THE STAFF REPORT THAT WE ADDRESS. IT WAS THE DISCUSSION ABOUT THE COMMERCIAL NEIGHBORHOOD COMMERCIAL PIECE THAT IS IN THE FRONT. IT REFLECTS ALL OF THE THINGS THAT WE JUST TALKED ABOUT. BUT THE COMMERCIAL NEIGHBORHOOD PIECE IN THE FRONT, THERE WAS A DISCUSSION PRIOR TO THE PCA OF WHAT WAS GOING TO BE IN THERE. AND TRYING TO START A BIG COMMERCIAL DEVELOPMENT AND NERVE PEACH.
NORTH BEACH. WE HAVE A RESIDENT UP TOP AND
[00:55:10]
COMMUNITY COMMERCIAL DOWN AROUND IT.A GOOD EXAMPLE WHEN AS I WAS A KID THEY HAD NORTHEAST CAMPGROUND AT LEAST MUSSINA DID AND THEY HAD A NEIGHBORHOOD COMMERCIAL AREA INSIDE THERE AND THEY HAD MEETING ROOMS AND OFFICE AREAS. FOR PEOPLE TO MEET WENT THERE WAS NOTHING OUT IN THAT AREA. IN ANY CASE I THINK THAT IS A REFLECTION OF THAT. AS YOU SAW FROM YOUR STAFF REPORT WILL ALSO REPLY THE TAX TO GO BACK TO SAY ON THE COMMERCIAL ON THE BOTTOM WILL BE LIMITED TO HALF OF IT.
HALF OF IT WILL BE SORT OF OFFICE SPACE AND MEETING SPACE FOR PEOPLE. AND THEN THE OTHER HALF WILL BE THIS LITTLE NEIGHBORHOOD MARKETS THAT HAS PREPACKAGED FOOD AND FRESH FRUIT AND THINGS LIKE THAT.
NOTHING TO THE COMMENTS OF PCA THAT'S WHY YOU SAW A POSITIVE
RECOMMENDATION FROM THE PCA. >> WE ALSO AND HE IS TALKING ABOUT THE MARKETPLACE WHICH IS THE REDESIGNATION.
WE DO HAVE TO EXTEND THE PHASING OBVIOUSLY.
BECAUSE IT EXPIRED FOR THE DIFFERENT THINGS.
WE ALSO HAVE A BUFFER WAIVER AND VARIANCE THAT WAS CREATED AFTER THAT PUD, WE'VE ALSO DONE SOME ARE OPERATING AROUND THE LINE THERE. SO TO GO TO THAT IF WE DO NOT HAVE TO GO THROUGH EACH OF THESE JAMES YOU'VE ACTUALLY KIND OF GONE THROUGH MOST OF THOSE, AND KINDA SHOWED PROBABLY THAT MARKETPLACE WAS ONE OF THE BIG CONCERNS OF PCAA.
SO, THAT IS ACTUALLY THE LANGUAGE, BUT IT IS VERY LIMITED TO THE SPECIFIC TYPE OF USES AS JAMES MENTIONED.
IT IS NOT A GENERAL COMMERCIAL GENERAL TYPE THING, THERE IS NO GAS STATIONS, IT IS A VERY SMALL SITE.
AND YOU CAN TAKE IT FROM THERE, THERE IS A FLOOR PLAN THAT GOES
WITH THAT TOO. >> RIGHT, THANK YOU KAREN.
AGAIN THIS IS SORT OF THE FLOOR PLAN THE GENERAL FOR PANT GOES BACK TO THE STUFF I HAVE ALREADY TALKED ABOUT.
WE CONTINUE TO GO ON THEIR A LITTLE DEPICTION.
YOU KNOW THE SITE WE DON'T NEED TO REHASH THAT.
I THINK THAT YOU KNOW THERE'S A FEW THINGS THAT WE TALK ABOUT PUD'S WE TALK ABOUT TRAFFIC IN CURRENCY AND COMPATIBILITY OF THIS PARTICULAR APPLICATION SINCE IT WAS ALREADY APPROVED PREVIOUSLY WE'VE HAD A LOT OF DISCUSSION ABOUT 2022 AND WE ARE GOING TO DISCUSS THOSE THINGS ABOUT COUNTY CODES FOR THOSE PARTICULAR THINGS AS YOU KNOW, YOU HAVE GOT LEAVES A LOT OF SUPPORT I THINK. FOR THIS PARTICULAR APPLICATION.
I DO NOT KNOW IF ANYBODY IS HERE TO TALK ABOUT IT? BEFORE ORGANZA, BUT I THINK IS NOT TO BELABOR THE ISSUE AND WE TALK ABOUT IT WHILE IT'S IN HIS INFANCY AND I WEAR HAD TO ANSWER ANY QUESTION WE APPRECIATE YOUR TIME THANK YOU.
>> IF THERE ARE ANY QUESTIONS WE WILL GO TO PUBLIC COMMENT.
>> YES OR WE WILL OPEN IT UP FOR PUBLIC COMMENT ON AGENDA ITEM NUMBER FIVE, IF ANYBODY WOULD LIKE TO MAKE A COMMENT NOW IS THE TIME. SEEING NONE WE WILL CLOSE PUBLIC COMMENT ON AGENDA ITEM NUMBER FIVE.
>> THIS IS IN DISTRICT FIVE ACTUALLY, AND I WILL MAKE A MOTION, AND I WILL PREFACE THE MOTION BY SAYING THIS IS A VERY INTERESTING PROJECT IN REVIEW. IT ACTUALLY TAKES WHAT I THINK IS AN UNTITLED PROJECT, TO MAKE IT BETTER.
SO I AM VERY PLEASED THAT IT TURNED OUT THIS WAY.
SO I WILL MOVE TO AN ACT 2022-12 APPROVING THE 202007 TOTAL MODEL RIVER FARMS PUD BASED ON SIX FINDINGS OF FACTORS.
[6. Public Hearing * REZ 2021-35 Red Moon Properties. Request to rezone approximately 1.34 acres of land from Commercial Neighborhood (CN) to Residential, Manufactured/Mobile Home or Single Family (RMH(S)) to allow for one (1) singlefamily home on each of the six (6) platted lots of record. This request was heard before the Planning and Zoning Agency at their regularly scheduled public hearing on January 20, 2022, and was recommended for approval 5-0. ]
>> WE HAVE A MOTION AND A SECOND, PLEASE VOTE.
AND THAT PASSES 5-0. OKAY NUMBER SIX.
NUMBER SIX I THINK THAT IS, YES IT IS.
NUMBER SIX IS QUASIJUDICIAL, SO ANY X PARTAKE COMMISIONER
>> YES MR. CHAIRMAN I HAD A CALL FROM MR. BILL MILLER ON THURSDAY ABOUT 4:00 P.M., AND WE SPOKE ABOUT THE CHANGES FROM COMMERCIAL TO RESIDENTIAL AS WE HAVE DONE IN THE PAST.
ALSO TALKED ABOUT THE BEACH WALKOVER, I KNEW HE WAS ON THE AGENDA SO I DID NOT THINK IT WAS OKAY.
[01:00:01]
I ALSO DID A SITE VISIT HAS BEEN ABOUT THE SITE A FEW TIMESLOOKING AT A COUPLE OF THINGS. >> 0 THANK YOU COMMISSIONER?
>> I HAVE NO MR. CHAIRMAN. >> I HAVE NONE, IT WAS WHO IS PRESENTING ON ITEM NUMBER SIX? YES, SIR.
>> HOW YOU GUYS DOING TODAY? NICE FOR YOUR TIME, MR. WALDRON
>> JUST CHECKING IN ON THAT KNOW I AM JUST HERE TO PRESENT THIS PROJECT, WORKING TO REZONE SIX LOTS THAT ARE CURRENTLY ZONED AND WE ARE LOOKING TO REZONE THOSE TO RESIDENTIAL.
RESIDENTIAL HS, SIMILAR TO THE 12 LOTS THAT WE HAVE DONE IN THE PAST. SO WE ARE ASKING FOR THE SAME APPROVAL FROM THE BOARD, IF APPROVED IT WILL CONSTRUCT SIX RESIDENTIAL HOMES ON THAT PROPERTY TO BE COMPLETED.
BY THE END OF 22. I WOULD LIKE TO TAKE ANY
QUESTIONS FROM THE COMMISSION. >> ANY QUESTIONS?
OKAY PUBLIC COMMENT? >> OKAY WE WILL OPEN IT UP FOR PUBLIC COMMENT ON AGENDA ITEM NUMBER SIX, WE ARE NOW TAKING PUBLIC COMMENT ON AGENDA ITEM NUMBER SIX.
SEEING NONE, WE ARE GOING TO CLOSE PUBLIC COMMENT.
>> YES, SIR MR. CHAIRMAN I WILL MAKE IN A MOTION TO ENACT 2022-13 BASED ON FOUR FINDINGS OF FACT THE SUBJECT ON ONE
CONDITION, AS PROVIDED. >> SECOND PERIOD.
>> WE HAVE A MOTION AND A SECOND PLEASE VOTE.
AND IT IS APPROVED 5-0. ITEM NUMBER SEVEN, THAT IS OUR LAST QUAD SITE JUDICIAL X PARTAKE.
[7. Public Hearing * REZ 2021-28 631 Oakland Avenue. Request to rezone approximately .23 acres of land from Commercial General (CG) to Residential, Single Family (RS-3) to accommodate construction of one (1) single-family home. This item was heard before the Planning and Zoning Agency at their regularly scheduled public hearing on January 20, 2022, and was recommended for approval, 5-0. ]
>> AND I HAVE NOT, ITEM SEVEN, THE OAKLAND AVENUE PROJECT, OAKLAND AVENUE. GOOD MORNING?
>> GOOD MORNING, MY NAME IS KEENAN I AM REQUESTING TO REZONE 631 OAKLAND AVENUE FROM CG TO RESIDENTIAL.
SO WE CAN BUILD A SINGLE-FAMILY HOUSE THERE.
AND THIS REQUEST RECEIVED 5-0 IN FAVOR DURING THE PUBLIC HEARING.
DO YOU HAVE ANY QUESTIONS? >> WE WILL OPEN IT UP FOR PUBLIC COMMENT ON AGENDA ITEM NUMBER SEVEN, PUBLIC COMMENT ON AGENDA ITEM SEVEN, SEEING THAT WILL CLOSE PUBLIC ON.
>> I WILL MOVE ITEM SEVEN MOTION TO ENACT OR AND IS 2022-14 BASED
[8. Impact Fee Credit Transfer Presentation. The County has received several requests to transfer unused road impact fee credits to other development projects. The presentation discusses current state and county law and options the Board may consider. ]
ON COURT FINDINGS PROVIDED IN THE STAFF REPORT.>> SECOND. >> WE HAVE A MOTION IN THE SECOND PLEASE VOTE. AND THAT PASSES 5-0.
>> NUMBER EIGHT, WHO ON THE STAFF IS PRESENTING THIS ITEM?
>> MS. VALLIERE? >> GOOD MORNING COMMISSIONERS CHRISTINE VALLIERE SENIOR ASSISTANT COUNTY ATTORNEY.
TODAY, FOR THE CHAIRMAN DIRECTION WE HAVE AN AGENDA AND THEM FOR YOU TO DISCUSS. IN IMPACT FEE TRANSFERS.
I HAVE THAT FEW SLIDES TO SET THE TABLE FOR THE DISCUSSION.
BEGINNING WHY DO WE HAVE ON USED ROAD IMPACT FEE CREDITS? GENERALLY THIS OCCURS DUE TO PROPORTIONATE FAIR SHARE AGREEMENTS, WHICH MAY RESULT IN EXTRA CREDITS BECAUSE THE DEVELOPER AGREES TO PAY FOR THEIR UNFORTUNATE FAIR SHARE.
THEN WHAT THEY WOULD ULTIMATELY USED TO OFFSET AN IMPACT FEES LATER AND DEVELOPMENTS. SO THEY COULD HAVE EXCESS CREDITS, WHICH RIGHT NOW THEY ARE LOOKING TO TRANSFER.
GIVEN CHANGES IN STATE LAW. WE HAVE AN AMENDMENT TO THE IMPACT THESE STATUES RECENTLY. WE MADE CLEAR THAT IMPACT FEE CREDITS ARE ASSIGNABLE AND TRANSFERABLE WITHIN THE SAME IMPACT FREEZONE OR DISTRICT. OR AN ADJOINING DISTRICT, WHEN THERE IS A SHOWING OF BENEFIT BETWEEN THE PROJECT OR FUNDS CREATING THE CREDITS AND THE NEW DEVELOPMENT.
WE ALSO HAVE SIMILAR TRADITIONS IN OUR VOTE IMPACT FEE ORDINANCE AND OUR STANDARD CURRENCY PROPORTIONATE FAIR SHARE AGREEMENT, IN THE ORIGINAL ROAD IMPACT FEE ORDINANCE, 8757 THERE
[01:05:02]
IS LANGUAGE IN SECTION 13, THAT STATES CREDITS MAY BE ARE NOT TRANSFERABLE FROM ONE PROJECT TO ANOTHER WITHOUT APPROVAL FROM THE BOARD OF COUNTY COMMISSIONERS.IT DOES INCLUDE THE LANGUAGE THAT IS SIMILAR IN A STATUTE WHICH TALKS ABOUT TRANSFERRING BETWEEN ZONES.
WHEN THERE IS A BENEFIT. THE STANDARD AGREEMENT IN THE COUNTY'S TEMPLATE, OR THE STANDARD LANGUAGE IN THE COUNTY TEMPLATE AGREEMENT ALSO PROVIDS FOR APPROVAL OF IMPACT FEE CREDITS, TRANSFER IMPACT FEE CREDITS, SUBJECT TO APPROVAL BY THE COUNTY. THERE IS A PROVISION IN ARTICLE 11 OF THE LDC, WHICH PERTAINS TO CURRENCY MANAGEMENT THAT LIMITS TRANSFERABILITY OF IMPACT FEE CREDITS HOWEVER, THAT LANGUAGE IS PREEMPTED BY THE RECENT CHANGE IN FLORIDA STATUTES.
SO, THE POTENTIAL OPTIONS THAT THE BOARD CAN CONSIDER IN THIS TOPIC, ALL ROAD IMPACT FEE CREDIT TRANSFERS COULD BE CONSIDERED BY THE BOARD. THE BOARD MAY DIRECT STAFF TO DEVELOP ADMINISTRATIVE PROCEDURES, SO THAT THOSE REQUESTS ARE CONSIDERED ALL OR IN PART AT STAFF LEVEL.
THE BOARD MAY CHOOSE TO CONSIDER ONLY THOSE REQUESTS THAT INVOLVE TRANSFERS BETWEEN DISTRICTS IN BENEFIT NEEDS TO BE SHOWN THE BOARD COULD TAKE NO ACTION, AND DISCUSS ANY OTHER OPTIONS.
>> OKAY ARE THERE ANY QUESTIONS OR DISCUSSIONS THAT YOU WANT TO
JUMP INTO? >> DO YOU WANT TO GOING TO
PUBLIC COMMENT? >> WE CAN SURE,.
>> SURE ALL RIGHT WE WILL OPEN IT UP FOR PUBLIC COMMENT ON THIS TIME ON AGENDA I AM IN NUMBER EIGHT.
THE CREDIT TRANSFER DISCUSSION. YES SIR NAME AND ADDRESS FOR THE
RECORD. >> GOOD MORNING TOM INGRAM 233 EAST BAY STREET JACKSONVILLE FLORIDA.
I AM HERE LAND-USE ATTORNEY AT PRACTICE AT ST. JOHNS COUNTY FOR OVER 20 YEARS NOW. AND I HAVE TWO PENDING REQUESTS FOR APPROVAL OF IMPACT FEE CREDIT TRANSFERS ONE INVOLVES THE FOUNTAINS NORTH PROJECTS AT 21095, THE REQUEST IS TO BE ABLE TRANSFER CREDIT TO FOUNTAINS EAST, AND EXCUSE ME AS FOUNTAIN SOUTH BUT AS YOU KNOW THE FOUNTAINS IS BASICALLY ONE PROJECT, THAT IS IN THREE PUD'S THAT ARE ALL ADJACENT TO EACH OTHER THEY ALL SHARE ACCESS TO OUR INVESTMENT ONE RECEIVES IN CREDIT FOR RIGHT OF WAY CONTRIBUTIONS.
THEY DID NOT HAVE A PROPORTIONATE SHARE OF NONRESIDENTIAL PROJECTS. THAT IS ONE OF THEM, IT IS IN THE IMPACT FEE CREDIT DISTRICT. THE OTHER IS A NESTLING DEVELOPMENT COMPANY THEY RECEIVED CREDITS FOR MANY YEARS AGO FOR THEIR EFFORTS TO WIDEN COUNTY ROAD 210 WEST OF I-95 THE REQUEST IS TO TAKE SOME REMAINING CREDIT WHICH IS NOT APPRECIATED WITH INFLATION IS QUITE DEVALUED NOW.
IT IS A TRANSFER IT TO THE BRIDGEWATER PUD WHICH IS ON THE EAST SIDE OF 210, IT IS THAN 4 MILES AWAY FROM THE SITE, AND HUNDRED YEAR POLICIES YOU DID ANALYZE TO SEE WHETHER OR NOT ANY PROJECT WOULD IMPACT TRAFFIC WITHIN A 4-MILE RADIUS.
THE STAFF IS ALSO COMPLETED THAT THERE IS A BENEFIT TO BRIDGEWATER FOR ROAD IMPROVEMENTS.
THAT THAT WAS CONDUCTED MANY YEARS AGO.
WITH THAT, I JUST YOU KNOW, GENERAL STATEMENTS ON THE STATUTE. AS TWO OF YOUR ATTORNEYS YOU SHOULD NOTE THE FIRST THE RULE OF LEGAL INTERPRETATION IS TO IMPLY MEANING. THE WORDS ON THE PAGE CLEARLY SUPPORT THE HOLDERS OF IMPACT FEE CREDITS ARE ENTITLED TO TRANSFER, AND THIS IS NOT AN OPTION.
THERE WAS SOME DISCUSSION ABOUT WHETHER THIS STATUTE APPLIED RETROACTIVELY, TAKEN BY YOUR COUNTY ATTORNEY.
THAT THE LEGISLATURE RESPONDED, AND CHANGE THE STATUTE AGAIN.
IT DOES APPLY TO ANY CREDITS AND IN THE ZONING CONTEXT, YOU PROBABLY FOR THIS MANY TIMES THE DECISIONS IN THE ZONING, ARE GIVEN FAIRLY BROAD DEFINITIONS BY THE COURTS.
HOW YOU APPLY POLICIES TO ZONING DECISIONS.
SO IF THE FINDINGS ARE SUPPORTED BY COMPETENCE OF SUBSTANTIAL EVIDENCE TO WHY ZONING WAS APPROVED OR DISAPPROVED, YOU'RE PROBABLY GOING TO WIN AS THE COUNTY, AND I KNOW FROM EXPERIENCE, UNFORTUNATELY, IN THIS CASE THIS IS A STATE STATUTE. THERE IS NO DEFERENCE GIVEN TO THE COUNTY INTERPRETATION OF THE STATUTE THE COURSE WILL JUST READ THE WORDS ON THE PAGE. AND MAKE THE BEST DECISION THEY KNOW HOW. I BELIEVE IT IS CLEAR AS THE
[01:10:08]
TOOLS IN THE TOOLBOX HAVE CERTAIN INFRASTRUCTURE NEEDS AND YOU ARE TRYING TO MEET THOSE. AND KEEP YOUR BALANCE BUDGET, THERE ARE OTHER TOOLS IN THE TOOLBOX TO LOOK AT RAISINGFUNDS, SUCH AS MOBILITY FEE. >> THANK YOU SIR THAT IS THE TIME. ANYBODY ELSE FOR PUBLIC COMMENT ON THIS AGENDA ITEM? YES OR MR. FISHER.
NAME AND ADDRESS PLEASE FOR THE RECORD.
>> MY NAME IS WILLIAM FISHER, 10130 MCMAHON AVENUE FLAGLER ESTATES. PRESIDENT OF FLAGLER ESTATES WROTE IN WATER CONTROL DISTRICT. AND I HAVE BEEN ASKED SEVERAL TIMES, WHERE IS FLAGLER ESTATES SHARE OF THE IMPACT FEES THAT ARE CHARGED? WE CAN USE THE FUNDING FOR PAVING THE ROADS, FLAGLER ESTATES ROAD IN WATER CONTROL DISTRICT ALSO IMPOSES A TAX. THE COST OF THE MATERIALS THESE DAYS IS OUTRAGEOUS. WE NEED A LITTLE HELP.
CONSIDER IT THANK YOU VERY MUCH. >> THANK YOU MR. FISHER I APPRECIATE IT ANYBODY ELSE FOR PUBLIC COMMENT?
>> GOOD MORNING BJ COLLETTI WITH THE CITY OF SAINT AUGUSTINE CITY LIMITS OF STATE AUGUSTINE. LISTENING TO THIS I WILL GET THE BACKUP EVENTUALLY. I KNOW THAT YOU CAN'T DENY THIS, BECAUSE OF THE LAW THAT WAS PASSED BECAUSE THE LOBBYIST GOT IT THERE. BUT THE THING IS, I THINK THIS SHOULD BE BROUGHT BEFORE THIS BOARD, AND YOU WILL JUST PASS IT LIKE YOU HAVE IN THE PAST. SO THE PUBLIC CAN KNOW WHAT IS GOING ON. STAFF SHOULD NOT BE ONE MAKING THE DECISIONS. THERE IS TOO MUCH MANIPULATION WITH THE STAFF, AND THAT IS GOING TO CHANGE TOO AS YOU ALL ALLOW DEVELOPERS AND THE LAWYERS TO GET UP HERE.
AND NOT HAVE THE STAFF MAKE THE PRESENTATION.
YOU HAD JUSTIFY THAT IN YOUR MIND AND I STILL DON'T BELIEVE THAT IS RIGHT. BECAUSE COVID-19 IS OVER WITH.
THIS SHOULD BE CONTINUED TO BE BROUGHT BEFORE THE BOARD SO YOU CAN PASS IT IN THE PUBLIC WILL KNOW WHAT IS GOING ON WITH THE
IMPACT FEES THANK YOU. >> THANK YOU, WHEN ANYBODY ELSE LIKE TO MAKE PUBLIC COMMENT ON AGENDA ITEM NUMBER EIGHT? OKAY SEEING HIM WE WILL CLOSE PUBLIC COMMENT.
>> THANK YOU, OKAY COMING BACK TO THE BOARD, WE PUT THIS ON THE AGENDA AS IN AGENDA ITEM BUT IT IS ALSO SERVING AS A WORKSHOP BECAUSE WE AGREE TO HAVE A WORKSHOP ON IMPACT CREDIT TRANSFERS. BEFORE WE WENT FORWARD WITH ANY MORE INDIVIDUAL REQUESTS FROM APPLICANTS.
THAT WAS MY GOAL TO HAVE A THOROUGH DISCUSSION AND HOPE TO MAKE A DECISION THAT MIGHT MAKE AND ALLOW US TO CONSIDER IT NOT THAT IT WILL PROVE IT NECESSARILY.
BUT AT LEAST CONSIDER INDIVIDUAL REQUESTS.
WITH THAT OTHER ANY COMMENTS? >> MR. CHAIRMAN I APPRECIATE YOU HAVING THIS ON THE AGENDA TODAY. MY CONCERNS ARE THROUGHOUT MY TIME ON THE BOARD. WE BEEN HERE THE SAME AMOUNT OF TIME. WE HAVE BEEN PROMISED PUBLIC BENEFIT BY DEVELOPERS, CONTINUOUSLY THAT DAY.
AS TO THE ROADWORK THAT THEY WILL DO, AS THEY PROBABLY WOULD BENEFIT. BECAUSE WE DID NOT HAVE TRANSFER ABILITY IMPACT FEES. NOW THAT PUBLIC BENEFIT THAT WAS PROMISED TO THE BOARD. SO TO THE BOARD APPROVED THE DEVELOPMENT, IT IS NOT THERE ANYMORE IT HAS TO BE TRANSFERRED. AND THAT BURDEN, ON IMPACT AND ROADS WILL FALL AGAIN TO THE TAXPAYER OF ST. JOHN'S COUNTY.
I THINK IT IS A BIG ENOUGH ISSUE, I UNDERSTAND WHAT THIS STATUS SAID, BUT I THINK IT IS A BIG ENOUGH ISSUE, I'VE ASKED LORRAINE AND THEM TO PLAY A TAPE OF ONE HENRY ON IR ON IT.
JUST TO KINDA SEE WHAT IS PROMISED AND WHAT WE WILL LOOK AT OF THE PROPORTIONAL FAIR SHARE ACTION AGREEMENT ACTUALLY SAYS. IF YOU DON'T MIND FOR A FEW
MINUTES TODAY. >> WE NEED TO TURN UP THE VOLUME AND START OVER WE CANNOT HEAR IT.
>> MR. CHAIR I AM SORRY IF WE CAN HAVE TOM UP IN THE BACK WITH PUTTING THE VOLUME UP MAYBE THAT MAY WORK?
[01:15:07]
THE VOLUME IS ALL THE WAY UP ON THE COMPUTER AS WELL.THAT SECTION HAS TO BE COMPLETE. YOU ARE COMMITTING THAT THAT HAS
TO BE DONE. >> APOLOGIES MR. CHAIRMAN THAT
IS THE MAXIMUM VOLUME. >> IT STOPPED PLAYING.
20 MILLION IT IS GUARANTEED. >> YOU HAVE ON YOUR CONSENT AGENDA A CURRENCY AND IMPACT FEE CREDIT THAT IS CONTINGENT ON YOUR APPROVAL OF THIS COMPREHENSIVE PLAN AMENDMENT AND THE PUD REZONING APPLICATION. THIS SLIDE IS A SUMMARY OF THAT DOCUMENT. YES, COMMISSIONER MORRIS, THAT DOCUMENT SAYS THAT IF THIS ROAD, IF THE ESTIMATE IS 15 MILLION AND A COST $20 MILLION TO BUILD, WE HAVE TO SPEND $20 MILLION TO BUILD IT. IT IS THE DEVELOPERS RISK.
>> BUT TO YOUR POINT, BECAUSE THE THE CURRENCY AND IMPACT FEE PART OF THE AGREEMENT IS QUITE DENSE.
WE PUT TOGETHER A SLIDE THAT WALKS THROUGH AND I WILL CALL IT THE FIVE-YEAR TIMELINE. SO THAT YEAR ONE STARTS ON THE DAY THAT YOU ADOPT IF YOU CHOOSE TO ADOPT TODAY.
SO YEAR ONE IS THE POND ACQUISITIONS AND DESIGN THAT CAUSE SUPPRESSED ME $2.6 MILLION THAT MEANS THE DEVELOPER IS PAYING THAT MONEY UNDER ITS OWN POCKET.
SO IT WILL FUND DIRECTLY THAT UPON SITE ACQUISITION IN THE ROAD DESIGN OF ITS FUNDS. AND THEN IN YEAR TWO, THE ROAD PERMITTING SIZE. SO ONCE THE ROAD IS DESIGNED IT HAS TO BE PERMITTED TO DOT THE EPA, AND THE OTHER GOVERNMENTAL AGENCIES THAT IS WHEN THE CASH MONEY STARTS COMING INTO THE COUNTY TO BE PLACED IN ESCROW. AND SO THAT BY THE TIME SO YOU GOT THE $2.6 MILLION IN-KIND PLUS IS 1.59 MILLION IN ESCROW, IN YEAR NUMBER TWO. BY THE TIME YOU HAVE 212 PLOTTED UNITS WITHIN THE PROJECT. THAT MEANS PLOTTED NOT NECESSARILY CONSTRUCTED. YEAR THREE, THEY HAVE TO BOND CONSTRUCTION OF THE ROAD. IN THAT SAME YEAR THEY PAY THREE $.7 MILLION TO THE COUNTY IN CASH TO FOR YOU TO HOLD IN ESCROW. AND THEY ALSO, SO THAT IS THE PROPORTIONATE SHARE AMOUNT. THEY ALSO START PAYING THE PUBLIC BENEFIT DOLLARS OF $1,847,000.
SO BY THE TIME YOU GET 581 UNITS, SO YOU'LL HAVE $9.7 MILLION EITHER ON IN-KIND PLANS OR ROAD PERMITS AT THE COUNTY CAN USE, IN CASH, IN CASE THEY DEFAULT.
SO THAT IS THE MECHANISM BY 500 BY THE EARLIER OF 581 UNITS.
THAT ROAD REACHING CAPACITY AS MR. NGUYEN TALKED ABOUT EARLIER.
THEY HAVE TO COMMENCE CONSTRUCTION OF THE ROAD.
THEY ARE PAINT THE REST OF THIS MONEY OUT OF THEIR POCKETS DIRECTLY TO CONTRACTORS TO BUILD A ROAD UNDER THEIR GUIDANCE.
WITH DOT INSPECTORS AND ALL OF THAT BECAUSE THAT IS JUST PART OF THE DOT PROGRAM. SO THIS JUST SHOWS YOU, BY END OF YEAR FIVE THEY HAVE COMPLETE CONSTRUCTION OF THE ROAD AT
THEIR COST AND THEIR REST. >> COMMISSIONER JOHNS.
>> I NOTED THAT YOU HAD. >> THIS IS SOME OF MY CONCERN FOR YOUR FIVE FOR THIS DEVELOPMENT IS NEXT YEAR.
THEY HAVEN'T STARTED THE ROAD AT ALL.
THESE ARE THINGS THAT WE HAVE BEEN TOLD, BY DEVELOPERS FROM TIME TO TIME THAT THIS IS A PUBLIC BENEFIT.
THIS PUBLIC BENEFIT NO LONGER EXISTS.
DO YOU HAVE A COPY OF WHAT WAS, IF WE COULD ASK WHETHER THE PROPORTION OF A FAIR SHARE AGREEMENT.
AND I AM NOT PICKING ON THIS ONE IN PARTICULAR BUT IT IS ONE THAT HAD A RESIDENT CONTACT ME ABOUT HOW AND WHEN THE ROAD IS GOING TO BE COMPLETED? IT KINDA HELPED SIGNIFY MY ANGST OR SOME OF THE THINGS. WHAT DOES THE PROPORTIONAL FAIR SHARE AGREEMENT STAY THEY HAVE TO PAY TO FIX THE ROAD?
AND BUILD A ROAD? >> YES GOOD MORNING MR. CHAIR
[01:20:03]
AND COMMISSIONERS. FOR THE RECORD FOLLOWING TRANSPORTATION DEVELOPMENT MANAGER.YOUR QUESTION IS WHAT IS A PROP SHARE? THE PROP SHARE AMOUNT IS BASED ON THE IMPACT OF PROPOSED DEVELOPMENTS, THAT WHEN WE ASSESS THAT IMPACTS ALL OF THE IMPACTED AND ADVERSELY IMPACTED ROADS.
IN SEGMENTS. AND THE COST IN ORDER TO IMPROVE THAT, THEY PAY A PROP SHARE BAYS BASED ON A NUMBER OF TRIPS THAT IMPACTED THAT PARTICULAR SEGMENT.
FOR EXAMPLE, THEY HAVE 20 TRIPS, IMPACTING THAT SEGMENT.
AND IN ORDER TO IMPROVE THAT SEGMENT, THAT 20 TRIPS WILL COST APPROXIMATELY 100,000 I'M JUST GIVEN A HYPOTHETICAL NUMBER.
>> I DON'T MEAN TO CUT YOU OFF, I UNDERSTAND WHAT IT IS,.
>> OKAY SORRY. >> FOR THIS PARTICULAR SUBDIVISION WE JUST ASK AND LISTEN TO COMMISSIONER MORRIS' QUESTIONS WHAT WAS THE AGREEMENT WITH THEM FOR THE PROPORTION
FAIR SHARE AGREEMENT? >> THEY AGREED THAT THE PROP SHARE THAT WAS RECALCULATED FOR GRAND OAKS WAS ROUGHLY ABOUT 10 MILLION. SO THEY ARE WILLING TO PAY 50 MILLION, SO THE PUBLIC BENEFIT WHEN THEY WERE PROPOSIG
IS AN ADDITIONAL 5 MILLION. >> NOW WOULD THAT BE TRANSFERABLE NOW? UNDER NEW STATE LAW?
THAT $5 MILLION? >> YES, IT WILL BE TRANSFERABLE.
>> SO IT IS REALLY NOT TRULY A PUBLIC BENEFIT OTHER THAN THEY
ARE FRONTING THE MONEY. >> YES BUT PART OF THE AGREEMENT THAT WE AGREED WITH THEM IS THAT WOULD BE IMPACT FEE CREDITABLE.
SO THE 15 MILLION THAT THEY POTENTIALLY WE HAVE NOT RECEIVED ALL OF IT. BUT POTENTIALLY WHEN WE RECEIVE THAT, THAT COULD BE FOR IMPACT FEES CREDITS.
>> WHAT DO WE ESTIMATE THE COST OF THAT ROAD TO BE BUILT NOW
UNDER DOT? >> [LAUGHTER] YOU DON'T WANT TO KNOW.
>> THE BOARD NEEDS TO KNOW, THIS IS MORE EDUCATIONAL FOR US.
WE WE HAVE ALWAYS PROJECTED THE CAUSE FOR THE 3-MILE IS NOT 30 MILLION. THEY MAKE A STATEMENT THAT THEY WERE WILLING TO PAY 50 MILLION AND CONSTRUCT THAT THAT 3-MILE SEGMENT. THE REASON THE COST ESTIMATE THAT WE RECEIVED FROM THE APPLICANT, AND FOR DISCUSSION OF THEM ABOUT SEVERAL WEEKS AGO IS ABOUT $59 MILLION FOR THE
THREE-MILE SEGMENT. >> BUT WHAT WE WERE PROMISED TO THE BOARD, TO APPROVE THIS, WAS THEY WOULD PAY THE COST OF THAT
NO MATTER WHAT THE COST. >> THAT WAS ON THE RECORD VERBALLY YES, SIR. I'D LIKE TO GET THE BOARD'S FEEDBACK, I KNOW HOW TO TAKE IT WHEN WE ARE SITTING HERE AND I DON'T THINK THIS IS THE ONLY ONE OUT HERE.
IN ABOUT 10 MINUTES WE WILL TALK ABOUT RAISING THE TAX.
TO COVER THESE WE ARE NOT GOOD STEWARDS IN MY OPINION.
WE DID NOT HOLD THEM TO WHAT THEY SAID.
AND THAT IS WHAT THAT IS WHY, I HAVE A HARD TIME TRANSFERRING CREDITS, BECAUSE TO MEET WE WOULD HAVE TO GO BACK TO EACH INDIVIDUAL ONE AND SAY HEY DID YOU PROMISE THIS IS A PUBLIC BENEFIT? BECAUSE IF YOU ARE TRANSFERRING THEM IT IS NOT A PUBLIC BENEFIT IN MY EYES.
OF WHAT YOU PROMISE TO GET YOUR SUBDIVISION APPROVED.
I DON'T KNOW IF ANYBODY? I SEE OTHER NAMES.
>> BEFORE I CALL ON OTHER COMMISSIONERS, I JUST WANT TO SAY I AM SORT OF GETTING TO BE, I AM STARTING TO UNDERSTAND MAY BE A LITTLE BIT, OF WHY WE HAVE $220 MILLION FOR TRANSPORTATION INFRASTRUCTURE. SO WITH THAT SAID, CHRISTIAN WE
WILL START WITH YOU. >> THIS IS THROUGH THE CHAIR TO MS. VALLIERE, WHEN YOU ARE MAKING THE PRESENTATION I WANT TO UNDERSTAND AND CLARIFY FOR THE RECORD.
THESE CREDITS WERE BASICALLY BUILT BY DEVELOPERS OVERPAYING THAT PROPORTION FAIR SHARE OBLIGATION?
I JUST WANT TO MAKE SURE. >> YES.
>> I WANT TO MAKE SURE I'M UNDERSTANDING THAT CLEARLY.
>> YES FOR EXAMPLE, WITH THE DEVELOPMENT THAT WE ARE TALKING ABOUT HERE, THERE PROPORTION FAIR SHARE CALCULATED UNDER THE METHODOLOGY PROVIDED IN THE STATUTE, WAS APPROXIMATELY $10.1 MILLION. THEY AGREED TO PAY AN ADDITIONAL $4.8 MILLION AS A PUBLIC BENEFIT, IN THIS CASE THEY DID NOT SEEK IMPACTING CREDITS FOR THAT 4.8 MILLION, THEY DID FOR
THAT PROPORTION FAIR SHARE. >> THANK YOU THAT ANSWERS THAT
[01:25:03]
QUESTION. I THINK THAT I AM CONCERNED IN THE SAME VEIN AS COMMISSIONER WALDRON, AND THAT WHEN WE VOTE ON THE PROJECT CARE, WE BELIEVE THAT WE HAVE AN AGREEMENT THAT IS ENFORCEABLE. THROUGH LEGAL MEANS.SO WHEN WE HEAR A DEVELOPER TELL US THAT HEY IF THE ROAD COST 20 MILLION EVEN THOUGH WE PROMISE 15, IF THEY COST 20 WE WILL PAY THAT TOO, IS THAT NOT ENFORCEABLE?
>> IT MAY BE ENFORCEABLE IN DIFFERENT WAYS, AND THEN FORCING THEM TO BUILD THE ROAD. THERE IS A LIMITATION IN THE CONCURRENCY STATUTE, THAT SAYS THE COUNTY CAN'T REQUIRE THEM TO PAY MORE THAT THERE PROPORTION FAIR SHARE.
WE HAVE BY AGREEMENT COMMITMENTS OFTEN THAT THE DEVELOPER WILL PAY MORE AND THAT PROPORTION FAIR SHARE.
BECAUSE THEY DO IMPACTING CREDITS, AND THEN THEY CAN REQUEST IMPACTING CREDITS FOR THAT ENTIRE VALUE, AND USE THEM TO OFFSET THE COST OF IMPACT FEES THAT COME LATER IT THE DEVELOPMENT. SO THAT COULD LIMIT THE WAY THE COUNTY ENFORCES THE AGREEMENT, BUT THAT COULD BE OTHER MECHANISMS AND REMEDIES TO ENFORCE THE AGREEMENT IN THE SITUATIONS WITH THE DEVELOPER IS BACKING OFF THEIR ORIGINAL
PROPOSAL. >> OKAY, I KNOW YOU AND I'VE BASICALLY BEEN HERE FOR A YEAR. IN YOUR OPINION OF THE YEAR THAT YOU HAVE BEEN HERE HAVE YOU SEEN US TAKE THOSE ACTIONS DIRECTLY OR INDIRECTLY TO OWN FORCE THOSE AGREEMENTS? THAT WERE MADE YEARS AGO? TO ENFORCE THE DEVELOPERS TO
FILL THEIR OBLIGATIONS. >> THIS IS THE FIRST INSTANCE THAT I HAVE SEEN SEEK TO WALK BACK THERE AGREEMENT.
>> OKAY THANK YOU, THAT IS VERY HELPFUL.
SO, THAT IS ONE SIGHT OF IT THAT WAS COMMISSIONER WALDRON'S CONCRT WHICH IS MY CONCERN TOO. SECONDLY WE ALL FIVE COMMISSIONERS SET UP HERE, I KNOW COMMISSIONER OUT YOU WERE HERE. BUT WE UNANIMOUSLY MADE A MOTION TO SEND A LETTER TO THE GOVERNMENT LAST YEAR.
ASK HIM TO NOT SIGN THE HOUSE BILL IN THE SENATE BILL THAT SORT OF CHANGED THESE CREDIT TRANSFER AGREEMENTS.
SO WE ALL UNANIMOUSLY SPOKE AGAINST THIS BILL THAT WAS HANDED DOWN BY THE LEGISLATURE. IT PASSED ANYWAY, IT WAS SIGNED INTO LAW, BEING THAT IT IS LAW, AREN'T WE JUST BEATING OUR HEADS AGAINST A WALL? ARE THERE ANY ACTIONS THAT WE CAN TAKE NOW, I WE PREEMPTED? I KNOW I USE THE WERE PREEMPTED, CAN'T WE TAKE ANY ACTIONS AS A BOARD TO PUSH BACK ON THAT?
>> IT CAN BE DIFFICULT TO TAKE A BLANKET STANCE AT THIS POINT, ESPECIALLY CONSIDERING THE PROVISIONS IN THE 1987 IMPACTING ORDINANCE REGARDING TRANSFERABILITY SUBJECT TO APPROVAL BY THE BOARD. ALSO A SIMILAR LANGUAGE IN THE STANDARD AGREEMENT TEMPLATE. IT COULD BE A BETTER LEGAL POSITION IF THE BOARD CHOSE SELECTIVELY TO CHALLENGE A SPECIFIC INSTANCE THAT PERHAPS GOES BE ON THE BENEFIT ANALYSIS, DESCRIBED WHEN THEY ARE SEEKING TO TRANSFER BETWEEN ZONES.
>> ON A CASE-BY-CASE BASIS THERE MAY BE A CASE THAT PRESENTS ITSELF OR WE MAY HAVE A LEGAL WAY TO OVERBUILD THAT.
>> CORRECT. >> THANK YOU MR. CHAMBERS.
>> THIS IS WHY WE NEED MOBILITY FEES THIS EXAMPLE RIGHT HERE.
I WANT TO GO AWFUL COMMISSIONER WHITEHURST SAID.
I THINK THIS IS IMPORTANT I WILL IT EASY STAFF AT LEGAL STAFF IDENTIFY SOME OF THOSE MECHANISMS, TO HOLD PEOPLE ACCOUNTABLE WHEN THEY MAKE COMMITMENTS TO THE PEOPLE OF STS IMPORTANT. AND I THINK THEY'RE A LEGAL MECHANISM WE CAN EXPLORE. AND THEN WE NEED TO DEVELOP A TOOLKIT ON THAT. IF THERE ARE OTHER EXAMPLES OF THIS IS NOT THE FIRST EXAMPLE. AGAIN WE COME UP WHERE WE MAKE DECISIONS BASED ON THE INFORMATION THAT IS IN FRONT OF US. WE ARE TRYING TO MAKE THE BEST DECISION FOR THE COMMUNITY. IT IS DISCONCERTING TO SEE THIS LATER. MY QUESTION IS DOES IS TRANSFER CREDITS LIMITING THE OBLIGATION FOR DEVELOPERS TO FULFILL THAT
PUBLIC BENEFIT? >> NO IT DOES NOT.
>> OKAY, EVEN IF THE CREDITS ARE TRANSFERRED, THEY ARE STILL OBLIGATED TO FULFILL THESE REQUIREMENTS IS THAT CORRECT?
>> YES. >> I THINK WE AS A BOARD, TO ADDRESS THIS, WE NEED TO LOOK AT THE LEGAL TEAM HERE AND HOLD PEOPLE ACCOUNTABLE. IF WE ARE COMING UP HERE, AND WE ARE GOING TO HAVE PEOPLE MAKE COMMITMENTS TO THE CITIZENS OF ST. JOHN'S COUNTY AND WE NEED TO HOLD THEM ACCOUNTABLE.
MR. CHAIRMAN THAT SHOULD BE OUR NEXT WORKSHOP FIGURE THAT OUT.
THIS IS ACTUALLY UNACCEPTABLE THAT WE ARE DEALING WITH PEOPLE NOT FULFILLING OBLIGATIONS. A KNOCK ON ANYBODY BROUGHT THIS UP. DON'T SINGLE OUT THIS ONE
[01:30:01]
DEVELOPER HERE, OTHERS ARE DOING IT AS WELL.>> THERE WAS E-MAILS AND THINGS. >> I KNOW WHY YOU DID IT WE ARE LOOKING AT IT AND WE ARE LOOKING AT A TEAM WITH CONVERSATIONS ABOUT THAT GOING FORWARD. SO THANK YOU MR. JIMMY.
>> THERE IS A COUPLE COMMENTS I WANT TO MAKE ON THE COMMISSIONERS COMMENT. I DON'T SEE THIS AS AN OVERPAYMENT I SEE IS A MISCALCULATION.
LIKE WHEN YOU ORDERED SOMETHING IF IT COST WHEN IT, IS THAT AN OVERPAYMENT? OR DID YOU MISCALCULATE WITH THE COST ONCE? I THAT IS WHY WE NEED A MULTIPLIER IF WE DON'T HAVE FEES HOW DO WE KEEP IT UP? WE MAY NEVER HAVE ORDERS THAT MIGHT BE 20-YEARS-OLD.
THAT IS WAY MORE THAN IN THIS THING.
WHEN YOU TRANSFER EVENTUALLY, NOTHING AGAINST MS. CHRISTINE SAID. IT EVENTUALLY ENDS UP THAT THE TAXPAYERS WILL HAVE TO PAY ALL OF IT TO IMPROVE 207 OR 16.
BECAUSE THEY ARE GOING TO WALK UP AND HAVE THESE IMPACT CREDITS. WE DON'T HAVE TO FIX THEM.
EGO HERE IS WHAT WE COLLECTED. AND THAT IS GOING TO BE ON THE TAXPAYERS AND I DON'T THINK IT IS RIGHT.
ONE THING ABOUT DEVELOPMENT I KNOW IT INCREASES TAXES BUT IT INCREASES SERVICES. WHEN I WAS YOUNG HERE, AND DEVELOPMENT TOOK OFF, WE WERE PROMISE PAPERWORK ITSELF.
AND IN THIS DISCUSSION DOES NOT PAY FOR ITSELF.
BECAUSE YOU CANNOT KEEP UP WHEN INFLATION BIG INFLATION RIGHT NOW, LIKE TO SET ABOUT THE ROWS THEY HAVE TREMENDOUSLY INCREASING COSTS. IN THE OTHER AGREEMENTS ALLOW THE MULTIPLIER THEY ARE JUST A BAND-AID.
AND YOU KNOW, I DON'T MEAN TO JUST PICK ON THIS ONE, BUT THE COMMISSIONER IS CORRECT WE NEED TO LOOK AT MR. CHAIRMAN.
SO WE GO AND GET MAKE SURE WE HAVE WAYS TO ADHERE TO WHAT THEY HAVE TOLD THE BOARD. YEAR FIVE OF THIS PROJECT IS NEXT YEAR. AND BELIEVE IT OR NOT IF YOU DRIVE 16 YOU WANT THAT ROAD TO BE FOUR LANES.
AND ESPECIALLY IF WE HAVE ANOTHER 581.
>> MR. CHAIR CAN I DRESS THE GRAND OLD STUFF I DIDN'T EXPECT THIS TO BE ON THE AGENDA TODAY. THERE'S BEEN A LOT OF DISCUSSION ABOUT AN AGREEMENT AND APPLICATION AS AN ADMIN FILE.
I DO REPRESENT GRAND OAKS. THEY ARE NOT OUT OF COMPLIANCE WITH ANYTHING AND THEY HAVE NOT BROKEN ANY PROMISES, THAT AGREEMENT SAYS IF YOU PLANT SO MANY UNITS, THEN IT TRIGGERS A ROAD OBLIGATION, IT HASN'T REACHED THAT POINT, AS MR. SAID, THE ROAD BECAUSE IT IS NOW OVER $50 MILLION.
SO SURE THEY ARE LOOKING AT ALTERNATIVES.
BUT IT IS NOT THE CASE WHERE THEY HAD VIOLATED AN AGREEMENT
>> IF I CAN JUST MAKE ONE COMMENT MISSED CHAIRMAN.
>> THAT IS NOT THE STATE THAT THEY WROTE THE PROMISES, BUT WAS TOLD US ON THE FOURTH. THAT IS WHAT WE ARE LOOKING AT GOING FORWARD, AND HOW IT LAYS OUT TO HOLD THIS THEME.
>> I WILL ALLOW BJ TO SPEAK, SO BJ,.
>> I ONLY NEED ONE MINUTE BECAUSE I WAS GOING TO PUT ON SOMETHING ELSE. THIS REALLY CONCERNS ME, AND THE MOST IMPORTANT THING, THAT I WANT TO SAY IT WAS ADVERTISE, IMPACT FEE CREDIT TRANSFER PRESENTATION, IT WAS NOT ADVERTISED AS A WORKSHOP, WHICH WE HAVE BEEN WAITING FOR WHICH MR. WALDRON HAS BEEN ASKING FOR. SO THIS IS NOT DECISIONS SHOULD NOT BE MADE RIGHT NOW. BECAUSE WE NEED A REAL WORKSHOP AND IT NEEDS TO BE ADVERTISED WITH THE WORD IN IT.
SO THE PUBLIC CAN COME AND SIT HERE IF THEY NEED TO ALL DAY.
SO THIS LAWYER HAS BEEN COMING UP HERE AND FIND YOU YOU LET HIM TALK AND EVERYTHING. BUT THIS IS NOT WHAT THIS AGENDA ITEM STATED. AND THAT IS NOT FAIR TO THE GENERAL PUBLIC. BECAUSE YOU HAD A TWO AND HALF HOUR WORKSHOP ON THE GROWTH OF THE COUNTY.
AND PEOPLE SHOWED UP AND THEY STAYED HERE.
THAT IS THE ONLY THING THAT I AM SEEING RIGHT NOW, I AM GLAD YOU ARE DISCUSSING IT, BUT PLEASE DO NOT MAKE ANY DECISION TODAY WITHOUT HAVING A REAL WORKSHOP AND ANSWERING THE QUESTIONS THAT IS MY CONCERN KENTE -- TODAY AND THANK YOU FOR ALLOW ME TOO
SPEAK. >> LET ME MAKE A SUGGESTION, WE
[01:35:07]
NEED A FOLLOW-UP WORKSHOP AND WE NEED THREE THINGS, WE NEED TO LOOK AT WAYS THAT WE CAN IN THE FUTURE HOLD DEVELOPERS NOT ANY SINGLE DEVELOPER IN THE DEVELOPMENT OF COMMUNITY TO THE COMMITMENT AND THE PROMISES THAT ARE MADE WITH THIS BOARD, THAT THE PEOPLE EXPRESS US TO KEEP AND MAINTAIN.SO WE NEED TO HEAR FROM LEGAL WHAT OUR OPTIONS ARE.
ALSO I THINK WE NEED TO I'VE HAD SEVERAL PEOPLE WHO I RESPECT THEIR OPINION ON THIS YEAR LIKE LAND USE, THAT DON'T REALLY HAVE A DOG IN THE FIGHT IN ST. JOHN'S COUNTY.
HAVE ENCOURAGED ME TOO ASK EACH OF YOU TO JOIN ME IN THE FEES IN JACKSONVILLE AND IT WAS A REALLY GOOD EXAMPLE.
THIRDLY I AGREE WITH BJ. I THINK WE NEED AN ADVERTISED WORKSHOP AND I THINK WE NEED TO TAKE UP TWO ISSUES THAT I JUST LAID ON THE TABLE AS A RESULT OF THAT DISCUSSION.
SO WE ARE NOT MAKING ANY DECISIONS TODAY BJ WE WILL HAVE THAT WORKSHOP IF YOU AGREE WITH ME TO ADDRESS MOBILITY FEES AND ACCOUNTABILITY OF IMPACT FEE CREDITS AND HOW THEY ARE ENFORCED. IS EVERYBODY GOOD WITH THAT? WE WILL DO THAT SOONER RATHER THAN LATER IF NOT IN MARCH CERTAINLY NO LATER THAN APRIL. AND GET SOME CLEARNESS AND UNCERTAINTY OPERATING UNDER THE SAME RULES IN THE SAME POLICIES.
>> YES MR. YES MR. CHAIR IF I MAY COMMISSIONERS JUST SO THE BOARD IS AWARE AND THE CITIZENS THAT ARE HERE TODAY THAT ARE ALSO AWARE. IT IS PART OF THE PROCESS AND PLANNING THE 23 TO UNDERGO THERE IS A COST TO IT SO IT IS PLAIN PLAN FOR TO UNDERGO IMPACT FEES AND ANALYSIS WHICH IS WHAT WE HEARD FROM THIS WE NEED TO DO IT AGAIN IT IS DONE PERIODICALLY.
ADDITIONALLY WE ARE PAINTED IN BUDGET PROCESS FOR MOBILITY FEES AS WELL THAT IS A MULTIYEAR REVIEW AND IT IS INCREDIBLY EXPENSIVE BUT BOTH OF THOSE ARE BEING PLANNED FOR FISCAL YEAR 23 BUDGET SO JUST TO SET THE STAGE AS WE START TO TALK ABOUT THIS WORKSHOP AND THE COMMISSIONERS OF WHAT YOU WANT TO DISCUSS ALSO UNDERSTAND THOSE TWO FEES WILL BE UNDERGONE OVER THE NEXT YEAR END THE MOBILITY FIELD WILL BE STUDIED OVER COURSE OF THAT.
THERE ARE DISCUSSIONS AND WORKSHOPS THAT THE CONSULTANT WILL DRIVE AND LEAD SO THERE IS SOMEBODY THERE THAT CAN DISCUSS IT IN A VERY EDUCATIONAL AND INFORMATIONAL WAY THAT STAFF MAY NOT HAVE THE ABILITY TO ADDRESS. SO THOSE THINGS ARE PLANNED IN
[9. Local Government Infrastructure Surtax Option. Following the January 25, 2022 Growth Management Workshop and the February 1, 2022 BCC meeting, staff was directed to review existing County infrastructure needs and provide a recommended list of capital improvement projects. The presentation includes estimated costs for countywide infrastructure improvements and proposed funding strategy for the Board’s consideration and discussion. ]
THE 23 BUDGET IF YOU SHOULD APPROVE THAT.I JUST WANT TO MAKE THE BOARD AWARE OF THAT.
>> OKAY THANK YOU. SO DO WE HAVE A CONSENSUS ON MOVING FORWARD FOR THE WORKSHOP FOR THOSE TWO ITEMS.
>> ALL RIGHT LET'S MOVE TO ITEM NINE,.
>> THANK YOU MR. CHAIR AND COMMISSIONERS AS YOU ARE WELL AWARE THIS IS THE LOCAL GOVERNMENT INTEREST FOR STRUCTURED SURTAX OPTION DISCUSSION ALSO KNOWN AS THE SALES TAX. SO I WILL WALK YOU THROUGH A BRIEF INFORMATIONAL OVERVIEW, I WILL GIVE YOU BACKGROUND BASICALLY ON HOW WE CAME TO THIS DISCUSSION THE INFORMATION THAT HAS BEEN PROVIDED TO YOU IN THAT THIS FAR.
WE HAVE ADDITIONAL INFORMATION AND I AM HERE TO ANSWER ANY QUESTIONS THAT YOU MAY HAVE AS WELL AS SUBJECT MATTER EXPERT STAFF. WHO ARE HERE ACROSS ALL DEPARTMENTS THAT MAY ANSWER ANY QUESTIONS THAT YOU MAY HAVE RELATED TO THIS BASED ON YOUR DISCUSSION TODAY.
SO FIRST OF ALL JUST AN OVERVIEW OF HOW WE GOT HERE.
FOLLOWING THE 25TH GROWTH MANAGEMENT WORKSHOP IN THE BCC MEETING, WE WERE DIRECTED TO REVIEW CURRENT COUNTY INFRASTRUCTURE NEEDS AND PROVIDE A RECOMMENDED LIST OF PROJECTS THAT WOULD BE FUNDED SHOULD THIS BOARD AND THE COMMUNITY ULTIMATELY DECIDE TO IMPOSE A 1% INFRASTRUCTURE SURTAX.
THIS COULD BE PLACED ON NOVEMBEM THE VOTERS TO DECIDE.
ONE OF THE REASONS OF LOOKING AT THE TIMELINE IS OBVIOULY THERE IS LESS BECAUSE WHEN YOU PUT IT ON EIGHT NORMALLY SCHEDULED ELECTION. AND THIS INFRASTRUCTURE PROJECT WILL FALL EXCLUSIVELY INTO FOUR CATEGORIES ROAD INCH AND LIBRARIES. ALL OF THESE THINGS ARE DEEMED INFRASTRUCTURE UNDER THE FLORIDA STATUTE WHICH I WILL SHOW YOU ATTEND THE PRESENTATION. I THINK WHAT IS MOST IMPORTANT AND WHAT MOST PEOPLE WANT TO KNOW IS PART OF THIS DISCUSSION.
IS WHAT DOLLARS WOULD GO WHERE? BASED ON WHERE STAFF HAS IDENTIFIED TO THIS POINT. THERE IS A COUPLE OF THINGS I
[01:40:02]
WANT TO TELL YOU UPFRONT AS WE LOOK AT THIS.AND I WILL PUT ANOTHER SLIDE ON THE PROJECTION RELATED TO TRANSPORTATION AND'S JUST A SECOND PERIOD IT IS VERY IMPORTANT TO KNOW THESE ARE ALL RECOMMENDATIONS.
SHOULD THE BOARD CHOOSE TO GO FORWARD TODAY AND GET TO A SECOND READING IN THE BOARD CHOOSES TO PASS THAT AND THE VOTERS CHOOSE TO PASS IT AS WELL.
THESE ARE RECOMMENDATIONS. THIS IS NOT A HEART AND FINAL LIST, THIS BOARD IF THE COMMUNITY DECIDES TO APPROVE IT AND THE BOARD DECIDES TO APPROVE IT, HAS THE OPTION TO MOVE THINGS AROUND AND MOVE A PRIORITY LIST AND MOVE A PROJECT AND TAKE SOMETHING OFF AND TAKE SOMETHING ON.
THESE PROJECTS THAT ARE IDENTIFIED ARE PROJECTS THAT ARE ALREADY ON OUR CIP LESS. SO THE DIRECTION THAT WE GOT IS TELL US WHERE WE STAND TODAY, AND PROJECTS THAT WE HAVE NOT NEW AND PLANNED PROJECTS ARE PROJECT THAT ARE ALREADY ON THE LIST THAT MAY NOT HAVE FUNDING. WITH A COUPLE OF CAVEATS COASTAL MANAGEMENT IS NOT ON THE LIST, BUT WE ALL KNOW, THAT IS A CIP THAT IS ONGOING ACROSS THE COUNTY.
ADDITIONALLY I THINK THERE IS A FIRE STATION, THAT IS ON THAT THAT IS NOT IN THE CIP LIST BUT IT WAS IDENTIFIED IN THE MASTER PLAN. AS YOU ALL HEARD I WANT TO SEE BACK IN OCTOBER AND NOVEMBER AND ALSO DIRECTED THE FIRE DEPARTMENT TO COME BACK WITH A PLAN ON HOW TO ADDRESS THEIR NEEDS. SO THAT IS CAPTURED IN THE AIR ALTHOUGH IT IS NOT ORIGINALLY IN THE CIP PLAN.
BUT QUICKLY, LOOKING THROUGH HERE, THIS IS ROUGHLY THE $500 MILLION, 220 MILLION IS ROADWAY IMPROVEMENTS.
I WILL GIVE YOU A SLIGHT OF WHAT THAT IS.
I WILL TELL YOU WHAT THAT IS ABOUT THE SLIDE.
AND OF COURSE HAPPY TO ANSWER ANY QUESTIONS.
THERE IS ROAD INFRASTRUCTURE, PUBLIC SAFETY, PARKS AND RECREATION, AND LAB RACE. THERE ARE A COUPLE OF THINGS THAT YOU KNOW I HAVE E-MAILS AS I HAVE RELATED TO THE NAMING OF THESE PARKS AND DEVELOPMENTS AND COMMUNITIES.
I JUST WANT TO BE CLEAR SO THE COMMUNITY KNOWS, THESE ARE PARKS THAT ARE A PART OF A DEVELOPMENT ORDER THAT WERE GIVEN TO THE COUNTY YEARS AGO. THE LAND DEDICATED TO THE COUNTY. IT WAS DEDICATED TO US.
THE BOARD OF COUNTY COMMISSIONERS RESPONSIBILITY TO BUILD THE PARK. WHEN YOU DO IT AND HOW YOU DO IT THAT IS YOUR PURVIEW THAT IS WHAT YOU WERE ELECTED TO DO TO DETERMINE HOW YOU WANT TO PAY FOR IT WHEN YOU WANT TO PAY FOR IT IS COUNTY PARKS. WE WILL TAKE NOC A T FOR EXAMPLE. THAT IS NOT JUST FOR THE RESIDENTS OF NAKA T. THAT WOULD BE OWNED AND OPERATED IF YOU WILL BY THE COUNTY PROGRAMS, I CAN TELL YOU MY KIDS NOT TO MAKE THIS PERSONAL OBVIOUSLY I AM A POLITICAL THIS IS YOUR DECISION MY KIDS GO TO OTHER PARKS THROUGHOUT THE COUNTY, THAT ARE NOT JUST AROUND ME BECAUSE THEY ARE PROGRAMMED AND PLAYED TO THE RECREATION DEPARTMENT.
SO THESE PARKS ARE COUNTY WIDE. WHEN YOU START TALKING ABOUT BALL FIELDS MULTIPURPOSE FIELDS BEACH VOLLEYBALL, WHATEVER IT IS IT WOULD BE COUNTY PARKS AND IS SOME POINT IN THE FUTURE, I'M ASSUMING THAT THIS PART OF IT IS NOT BEEN DONE BASED ON THIS WILL FIND ANOTHER MECHANISM TO PAY FOR THESE PARKS.
AS YOU ALL KNOW COMMISSIONER WALDRON AND ALL OF YOU COMMISSION WHITE HORSES TALKED ABOUT THE NEED FOR SPACE.
THIS IS ONE OF THE WAYS THAT WE CAN DO IT.
I KNOW WITH YOU ALL HAVING TO MAKE A CONSIDERATION ABOUT THAT.
THAT IS ONE THAT IS COME UP IS IN THE DEVELOPMENT PART? IT IS IN THE DEVELOPMENT IS A LOCATION DESIGNATION.
THESE WILL NOT BE THE NAMES OF THE PARKS.
YOU SEE NORTHWEST THERE, THAT IS A LOCATION DESIGNATION, THEY HAVE A LOCATION DESIGNATION, THOSE ARE PIECES AND PARCELS THAT THE COUNTY WAS ALREADY OWNED AS PART OF THE DEVELOPMENT ORDER. THAT A PREVIOUS BOARD IS ALREADY SIGNED. WE ALL WANT YOU TO BE AWARE THAT THAT THE COMMUNITY UNDERSTANDS THAT WHAT IT LOOKS LIKE.
I WANT TO PUT THIS UPDATE TO HAVE AN OPPORTUNITY OF THE ROAD AND INFRASTRUCTURE. THANK YOU, THESE ARE ROADWAYS THAT YOU WROTE DEPARTMENT WORKS HAS IDENTIFIED THAT ARE NEEDED AND NEEDED TO BE FUNDED. SO THEY STEM FROM THE NORTH TO THE SOUTH THERE ARE A NUMBER OF PROJECTS IN HERE.
IT LET ME TELL YOU ONE OF THE REASONS THIS WAS OCCLUDED IN THE ORIGINAL SLIDE. WE ARE HAPPY TO PRESENT TODAY.
ALSO UNDERSTAND KIND I LIKE IDENTIFY THESE INITIAL PROJECTS.
THESE ARE SUBJECT TO CHANGE. THE DOLLAR AMOUNT IS SUBJECT TO CHANGE. THESE ARE ESTIMATES AS OF TODAY, AND TODAY'S DOLLARS, YOU WILL SEE THAT THEY ARE INCLUDED IN THE $243 MILLION. THE COUNTYWIDE DRAINAGE INFRASTRUCTURE WE DID NOT IDENTIFY EVERYPLACE THAT COUNTYWIDE DRAINAGE INFRASTRUCTURE WOULD NEED TO BE ADDRESSED. OR SIDEWALKS, SO THAT IS
[01:45:02]
INCLUDED IN THE $243 MILLION. THESE ARE AREAS THAT NEED TO BE ADDRESSED NOW. ESSENTIALLY.ADDITIONALLY SO YOU WILL KNOW, AGAIN ESTIMATES BECAUSE DURING THIS TIME WE WILL LOOK FOR SURE THE BOARD IN THE COMMUNITY DECIDE TO GO FORWARD WITH THIS REGARDLESS OF WHAT HAPPENS WE ARE STILL LOOKING FOR MATCHING FEDERAL DOLLARS, MATCHING STATE DOLLARS WHATEVER WE CAN TO REDUCE LIABILITY AND OUR CAUSE.
SHOULD THAT HAPPEN AND SHOULD THIS BOARD AND COMMUNITY GO FORWARD, ANOTHER PROJECT WOULD BE PUT ON THE LIST.
I WANT TO ADD TO THIS BECAUSE THE COMMUNITIES AWARE AND THE BOARD IS AWARE THIS IS NOT A STAFF DRIVEN INITIATIVE OR PROJECT. IF THIS GOES FORWARD AND THE COMMUNITY DECIDES TO MOVE FORWARD THERE IS PUBLIC ACCOUNTABILITY. SO I WEBSITE IS DEDICATED SO EVERYBODY CAN SEE EVERY DOLLAR THAT WILL BE SPENT ON THIS INITIATIVE. SO I JUST WANT TO MAKE THAT CLEAR TO THE BOARD, ANY OF THE RESIDENTS THAT ARE LISTENING, I'M SURE THERE IS LOTS OF QUESTIONS WE WILL ALL DO OUR BEST TO ANSWER AS MANY AS WE CAN.
THIS IS DIRECTION YOU GIVE US. AGAIN THIS IS A LIST OF HOW IT WOULD BE SPENT TODAY, AND I KNOW THAT EVEN FOR A COUPLE OF THESE PROJECTS WE ARE HOPING FOR STATE FUNDING AND 25 AND 26.
SO THAT WOULD OFFSET SOME OF THIS.
OTHER PROJECTS WOULD MOVE RIGHT ON UP.
THIS IS A VERY QUICK RESPONSE TO THE BOARD DIRECTION AS TO WHAT
THIS WOULD LOOK LIKE. >> IF YOU WILL GO BACK TO THE OVERHEAD FOR ME. THANK YOU, THERE IS A TOTAL HAPPY TO ANSWER QUESTIONS AND DEPARTMENT DIRECTORS ARE HERE IF YOU HAVE QUESTIONS ABOUT THESE I WILL KEEP MOVING AND THEN I WILL TURN IT OVER TO OFFER DISCUSSION.
SO HERE IS A FLORIDA STATUTE SAYS ABOUT INFRASTRUCTURE SURTAX OR INFRASTRUCTURE SALES TAX. A LOCAL GOVERNMENT INFRASTRUCTURE INSERT TEXT MAY BE LEVERED PURSUANT TO AN ORDINANCE ENACTED BY MAJORITY VOTE OF THE COUNTY'S GOVERNING BODY. APPROVED BY THE VOTERS AND COUNTYWIDE REFERENDUM. THE PROCEEDS MUST BE EXTENSIVE AND CONSTRUCT AN FLORIDA STATUTE PROVIDES INFRASTRUCTURE TO BE ANY FIXED CAPITAL EXPENDITURE A CAPITAL OUTLAY ASSOCIATED WITH THE CONSTRUCTION RECONSTRUCTION OR IMPROVEMENT OF PUBLIC FACILITIES THAT HAVE A LIFE EXPECTANCY OF FIVE OR MORE YEARS. ANY RELATED LAND ACQUISITION PLAY IN IMPROVING THE DESIGN ENGINEER BECAUSE IN ANY OTHER PROFESSIONAL RELATED BECAUSE YOU CAN READ THE REST.
LEMME SEE WHAT IT DOES NOT DO IT DOES NOT PAY FOR STAFF.
I KNOW THERE IS A CONCERN WITH THE BOARD OF COUNTY COMMISSIONERS TO MAKE A DECISION TODAY TO TURN TO THE VOTERS AND THEN THEY ARE JUST GOING TO PAY PEOPLE.
NO YOU CANNOT DO THAT. UNDERSTAND STACKS SHOULD THEY CHOOSE TO TRACK EVERY DOLLAR THAT IS SPENT ON THAT.
AND IT IS NOT GO TO STAFF YOU ARE NOT ALLOWED TO PAY FOR OPERATIONAL EXPENSES OUT OF A SURTAX.
I JUST WANT TO ADD THAT TO YOU ALL.
IN CASE ANYONE IS WONDERING. AND THEN HERE IS A SHORT TIMELINE AGAIN, SHOULD THIS BOARD CHOOSE TO MOVE FORWARD WITH THIS TODAY. TODAY IS FOR DISCUSSION FOR YOU WANT TO GIVE THIS DIRECTION TO STAFF AND LEGAL.
IF IT DOES MOVE FORWARD TODAY THIS IS WHAT IT LOOKS LIKE.
MARCH 1 IS OUR READING OF THE FIRST ORDINANCE, TODAY'S NOT YOUR FIRST READING TODAY'S DISCUSSION IN VOTE WEATHER AND NOT TO ASK LEGAL TO COME BACK WITH ORDINANCE.
FIFTEEN WOULD BE THE SECOND, AND HERE IS THE REST OF THE PROCESS.
JUST SO YOU KNOW IF PEOPLE WONDERING WHAT IS ALL PART OF THAT STATE OFFICE OF PROGRAM POLICY ANALYSIS AND GOVERNMENT ACCOUNTABILITY. SO THEY ARE THE CHECK AND BALANCE IN THIS PROGRESS. AND OF HOW THINGS ARE DONE.
THEY ARE DUE THE PERFORMANCE AUDIT.
SHOULD THIS BOARD MAKE THE DECISION TODAY TO ALLOW THE COMMUNITY TO VOTE OR TO GIVE MEMBERS OF A COMMUNITY TO MAKE A DECISION ON THIS IS YOUR PREROGATIVE.
IT'S IMPORTANT FOR ME TOO NOTE THERE IS A PERFORMANCE AUDIT COMPONENT TO THIS. JUST FROM A STAFF STANDPOINT THERE ARE CERTAIN THINGS THAT WE WOULD HAVE TO DO AND PREPARE THAT IS GOING TO BE UNDERGONE BY AN EXTENSIVE REVIEW BY THE STATE OF FLORIDA'S DEPARTMENT. AND SO HERE IS YOUR PROPOSED MOTION WHETHER OR NOT YOU WANT TO MOVE FORWARD I WILL BACK UP TO THE PROJECTS AND I WILL TURN IT OVER TO YOU ALL FOR DISCUSSION. HOW AGAIN MYSELF AND YOUR FINANCE TEAM AND DEPARTMENT HEADS ARE HERE IF YOU HAVE ANY
QUESTIONS. >> THANK YOU, I HAVE ONE QUESTION. YES THE QUESTION, LOOKING FOR FEEDBACK. IT IS ALSO MY UNDERSTANDING THAT A PROPORTIONATE SHARE OF ANY SALES TAX AND SURTAX WOULD BE ALSO AVAILABLE TO THE TWO CITIES.
>> THAT IS CORRECT MR. CHAIR. >> I WANT EVERYONE TO KNOW IN THIS DISCUSSION, IT IS BASED ON AS I UNDERSTAND IT BASICALLY A POPULATION MAYBE IT IS ADJUSTED A LITTLE BIT BUT MY POINT IS GIVEN THE FACT THAT WE HAVE 300,000 PEOPLE IN THE COUNTY, ABOUT 22,000 AND OUR CITIES A SMALL PORTION OF THIS WILL GO TO THE CITIES. OF SAINT AUGUSTINE AND SAINT AUGUSTINE BEACH THEY CAN ADDRESS THE INFRASTRUCTURE ISSUES.
>> THAT IS CORRECT, ONE OTHER THING MR. CHAIR A NUMBER OF YOU HAVE ASKED ME PRIVATELY, AS PART OF THIS DISCUSSION AND BRIEFINGS, AND I DO NOT HAVE THE ANSWER AT THAT POINT.
AGAIN NOT FROM AN ADVOCACY STANDPOINT BUT JUST FROM AN
[01:50:03]
INFORMATIONAL STANDPOINT ONLY. MANY TIMES PEOPLE AS SALES -- WEARS A GENERATING FROM. AND THIS IS NOT A SCIENCE THIS IS AN ART THAT IS GIVEN FROM THE TOURISM COUNCIL.APPROXIMATELY 35% OF SALES TAX COME FROM TAURIS AND OTHER 65 IS FROM RESIDENTS. I JUST WANT YOU TO BE AWARE THAT AS WELL MANY OF YOU ASKED THAT QUESTION I THINK THE PUBLIC WANT TO KNOW ANYWAYS. SO THAT IS THE APPROXIMATE BREAKDOWN OF HOW THE SALES TAX GOES UP AS WELL.
>> OKAY IN ADDITION TO THAT, BEFORE WE HAD PUBLIC COMMENT I CALL ON COMMISSIONERS, ANOTHER POINT IS IN MY MIND I DISCUSSED WITH STAFF THAT THIS WOULD NOT BE AN ON GOING SURTAX FOREVER.
IT HAS A TEN YEAR SUNSET PROVISION.
>> YES OR THAT IS UP TO THE BOARD DISCUSSION EVERY YOU CAN DO IT HOWEVER YOU WANT. IT IS WITHIN YOUR SUNSET YES OR.
>> AT LEAST FROM MY POINT IS ONE COMMISSIONER IT IS A TEN YEAR TAX ON THE HUNDRED YEAR TAX. IF IT GOES TO THE BALLOT AND PASSES, IN NOVEMBER, IT WOULD RAISE APPROXIMATELY 50 MILLION A YEAR, WHICH WOULD ADDRESS THE FACT THAT THE MILLION-DOLLAR BACKLOG AND INFRASTRUCTURE THAT BY THE WAY IT IS ALSO MY UNDERSTANDING, NONE OF THIS MONEY, NONE OF THAT 500 MILLION, IS GOING TO OR DESIGNED FOR FUTURE DEVELOPMENT.
IF WE HAVE NO MORE PROJECTS APPROVED, STARTING TODAY WE STILL HAVE THE SAME BACKLOG IN THE SAME TRAFFIC CONGESTION IN THE SAME SHORTAGE AS THE FIRE STATIONS IN THE SAME STORIES AS LIBRARIES AND PARKS. I GUESS FROM MY STANDPOINT WON OF THE REASONS OBVIOUSLY I'VE READ A FEW ARTICLES AND PROPOSE THIS PRETTY STRONGLY. BECAUSE I THINK IT IS OUR RESPONSIBILITY AS A COMMISSION TO ADDRESS IT.
AND THEN AS THE PEOPLE ALL OF YOU IN THE AUDIENCE, AND ALL OF THE PEOPLE WHO MAY BE LISTENING, THEN IT WILL BE UP TO YOU TO VOTE UP OR DOWN. DO YOU WANT THESE INFRASTRUCTURES THAT WE HAVE DESCRIBED AND IF SO WHAT IT WOULD COST, OR NOT? BUT THAT ISN'T UP OR DOWN VOTE AND TO ME THAT IS SORT OF THE DEMOCRATIC PROCESS.
SO THAT IS WHERE I AM COMING FROM.
IF YOU GUYS WANT TO HAVE PUBLIC COMMENT FIRST? OR WOULD YOU LIKE TO WEIGH IN WITH JEREMIAH?
>> I HAVE A QUESTION BEFORE PUBLIC COMMENT MR. CONRAD I KNOW I SPOKE TO A COUPLE DAYS VIEW AGO AND THERE'S LITTLE TIME TO ADDRESS IT. I GOT A LOT OF E-MAILS AND THE OTHER COMMISSIONERS HAVE, ABOUT WHOSE RESPONSIBILITY IT IS TO BUILD THE PARKS THAT ARE ON THE LIST.
HISTORICALLY IN ST. JOHN'S COUNTY, WITH WHAT LIMITED TIME YOU'VE HAD TO ANSWER THE QUESTION HAVE THE PARKS BEEN BUILT BY DEVELOPERS OR BY ST. JOHN'S COUNTY? THE PLANTATION FOR INSTANCE, THAT IS A PART THAT IS IN MY NEIGHBORHOOD WE HAVE A LOT OF BALL FIELDS.
>> I WOULD HAVE TO CHECK WITH STAFF BUT THE ONLY ONE THAT I KNOW OF, AND THAT MAY BE OTHERS THAT I BELIEVE THIS PART OF DEVELOPMENT ORDER OR MEMBER DEVELOPMENT ORDERS GO BACK SOMETIMES 20 OR 30 YEARS THAT WAS NOT BUILT AND PAID FOR IN LARGE PART BY THE COUNTY WAS VALENCIA.
THAT'S WHAT I WAS TOLD I'VE NEVER LOOKED AT THE DEVELOP MOTOR MYSELF. MOST OF THEM ARE PAID THROUGH A COMBINATION OF IMPACT FEES GENERAL REVENUE FUND, WHATEVER FUNDS ARE AVAILABLE. THESE ARE ALL COUNTY OBLIGATIONS BASED ON THE WAY DEVELOPENT ORDERS ARE BASED.
AND WHEN I SAY TODAY, DEVELOPMENT ORDERS THAT HAVE BEEN AGREED ON BY PREVIOUS BOYS IN THE PAST.
>> THANK YOU MR. CONRAD. >> MR. CHAD CHAIR IF I MAY ADD E MORE THING. THEY'VE ASKED ME ABOUT THE FUNDING OF THIS. TODAY, AS YOU ALL MAKE THE DECISION WHETHER OR NOT TO MOVE BOARDING WITH THE READING OF THE ORDINANCE AND IN NOVEMBER SHOULD YOU CHOOSE TODAY GOES TO THE PEOPLE. ONE THING I WOULD NOTE AGAIN.
A POLITICALLY IT IS MY RECOMMENDATION TO THIS BOARD WOULD BE IF THIS WERE TO MOVE FORWARD THAT THIS BE DONE ON A CASH FLOW BASIS. THAT IS SOMETHING YOU CAN TAKE UP AT A DIFFERENT DATE AND TIME. BUT THE INTEREST ON BOND INC.
THIS AMOUNT OF DOLLARS IS SIGNIFICANT.
IF NOT TENS OF MILLIONS OF DOLLARS WE ARE CLOSE TO INTO THE NINE FIGURES OF INTEREST ON BONDING EVERYTHING RIGHT UP FRONT. KIND OF A LATER DISCUSSION AND I WANT YOU TO HEAR THAT TODAY. I WANT YOU TO HEAR THAT.
>> THANK YOU, MR. CHAIRMAN BRIEFLY IF THIS IS NOT APPROVED BY THE BOARD AND SENT TO THE VOTERS AS A REFERENDUM, I WILL SAY THIS LIST AS YOU NOTED WE'VE ALL SEEN THE LIST BEFORE IT IS THE CURRENT NEED CAN YOU ELABORATE ON WHAT SOME OPTIONS ARE AND WHAT ARE THE LIMITATIONS ARE ON BONDING?
>> I WOULD LOOK TO MR. DUNN TO GIVE YOU FURTHER INFORMATION ON THE BONDING, BUT WHAT I CAN TELL YOU IS APPROXIMATELY $100 MILLION OVER 30 YEARS, BECAUSE OF THE OPERATION MAINTENANCE YOUR BONDING CAPACITY IS ACTUALLY A LITTLE LARGER THAN THAT AS YOU BOND THE PROJECT, SO IF YOU DON'T HAVE A
[01:55:01]
SEPARATE REVENUE SOURCE, AND YOU BOND FROM THE GENERAL FUND DOLLARS YOU HAVE TO USE A GENERAL FUND DOLLARS TO OPERATE AND MAINTAIN. SO THAT IS AN APPROXIMATE NUMBER THAT IS NOT SPECIFIC BONDING IS ONE COMPONENT THAT YOU CAN DO.THAT IS THE MAIN COMPONENT. YOU CAN DELAY PROJECTS OBVIOUSLY. THESE THINGS ARE NOT IN PLACE TODAY. SO JUST LIKE YESTERDAY THINGS CAN BE DELAYED IN ALLOWING IMPACT FEES TO DO THEIR BEST TO CATCH UP AS YOU ALL KNOW AND IDENTIFIED THERE ARE TIMES ARE BOARDS IN A PASSIVE NOT RAISE IMPACT FEES ONTO A SCHEDULE THAT IS NOT NECESSARILY MEET THE REQUIREMENTS TO CONTINUE TO FUND. AND SO YOU HAVE THE ABILITY TO WAIVE THE IMPACT FEES YOU ALSO HAVE THE ABILITY TO CHANGE IMPACT FEES AS STUDIES COME BACK IN FISCAL YEAR 23.
SO THERE ARE OTHER OPTIONS. THEY ARE LONGER, THE BONDING CAPACITY IS NOT ENOUGH TO TAKE CARE OF THIS.
EVEN IF YOU SAY WE ARE BONDING COMPLETELY OVER THE COURSE OF 30 YEARS YOU WOULD NOT EVEN BE ABLE TO TAKE CARE OF THE
TRANSPORTATION COMPONENT. >> PUT THAT LESS BACKUP FORCE PLEASE. SO THESE ARE CURRENT ROAD AND INFRASTRUCTURE DEEDS THAT WE HAVE TODAY IS THAT CORRECT?
>> YES OR THAT'S CORRECT. >> SO YOU'RE LOOKING AT
APPROXIMATE 243 MILLION? >> YES.
>> IN THE RUNNING CAPACITY IS 100 MILLION?
>> THE BONDING CAPACITY IS 200 MILLION IN TOTAL, BACKING THAT UP YOU WILL HAVE AN OPERATION AND MAINTENANCE COMPONENT TO THAT, WHEN YOU CONSIDER THAT OVER THE SAME TIME IS CLOSE TO $100 MILLION. I'M GIVING YOU WHAT YOU NOT YOUR CAPACITY AS BUT WHAT YOUR ABILITY TO OPERATE IS AS WELL.
>> THESE ARE QUESTIONS I WANT TO GATHER INFORMATION SO I CAN MAKE AN INFORMED DECISION. CAN YOU GO OVER BRIEFLY'S SOME AGAIN THE TIME AND PURPOSE RESTRICTIONS UNDER FLORIDA
STATUTES TO 12 ON 055. >> PUT IT BACK TO THAT SITE FOR
ME RIGHT THERE. >> WHAT I AM LOOKING AT SPECIFICALLY TO DO IS 815 YEAR IT CAN'T BE A BE ON 15 YEARS.
>> THAT IS RIGHT, AND THAT'S WHAT COMMISSIONER DEAN WAS
ALLUDING TO IS WELL. >> I THINK WHEN MR. DEAN ALLUDED TO FOR THIS PURPOSE UNDER FLORIDA STATUTES 15 YEARS.
CAN YOU ELABORATE ON SOME OF THOSE RESTRICTIONS?
>> THOSE ARE THE ONLY RESTRICTIONS I AM AWARE OF, THERE ARE THE RESTRICTIONS UNDER THE SURTAX STATUTE THAT SAYS YOU CAN ONLY USE 1% FOR CERTAIN THINGS.
I DO NOT HAVE A LIST OF ALL THAT IS IT'S A VERY LONG STATUTE.
FOR INSTANCE YOU CANNOT BOND FOR INFRASTRUCTURE EXCUSE ME, YOU CANNOT RAISE EXTRACTS FOR INFRASTRUCTURE, THE VOTERS CANNOT RAISE ATTACHED FOR INFRASTRUCTURE, AND THEN GOVERNMENT COME BACK AND SAY WE TOOK CARE OF THAT, BUT WE ALSO WANT TO DO A HOSPITAL SURTAX. SO THERE IS 304 CAVEATS THAT ARE IN THERE THAT ARE STILL GOVERNMENT FACILITIES, I DON'T KNOW WHAT THEY ARE IN FRONT OF ME BECAUSE IS NOT BEEN A PART OF THE DISCUSSION, IT JUST WHAT I HAVE DONE AND ON MY OWN.
BUT YOU CANNOT CONTINUE TO RAISE AND SAY WHETHER THIS IS GOING TO TAKE CARE OF INFRASTRUCTURE, AND WE ARE GOING TO DO THIS TO TAKE CARE OF SOMETHING ELSE. ONCE YOU DO THIS IT IS A BLANKET
INFRASTRUCTURE TAX. >> SO WE HAVE MULTIPLE STEPS IN THIS PROCESS, MOVING FORWARD TODAY I WOULD LIKE TO SEE THAT.
WE UNDERSTAND WHAT THE RESTRICTIONS ARE, AND LOOKING FORWARD. IN SOME OTHER COUNTIES IN OUR REGION AND ADDRESSING THE NEEDS OF THIS?
>> THEY HAVE, THAT I DON'T HAVE IT IN FRONT OF ME I BELIEVE, ANYBODY I CAN LOOK AT DUVALL COUNTY IS AT SEVEN A HALF% CLAY COUNTY IS AT SEVEN A HALF PERCENT.
AND I BELIEVE FLAGLER IS AT 7%. AS FAR AS THEIR SALES TAX ST. JOHNS COUNTY IS AT SIX &. I DON'T KNOW WHAT NASSAU IS AND I DON'T KNOW WHEN THOSE REPLACED ON THE BALLOT OR REFERENDUM TO GO FORWARD. BUT YES.
THOSE OF THE COUNTIES UNFAMILIAR WITH.
>> I KNOW SOME OF THAT, TO SEE IF YOU GATHERED ALL THAT
INFORMATION THANK YOU. >> HUNTER THE ONLY QUESTION THAT I HAD WAS WE TALK ABOUT SUNSET, TO RENEW IT OR HAVE A CONTINUE IS THAT A BOARD VOTE OR DOES THAT GO BACK ON THE REFERENDUM?
>> THAT I DO NOT KNOW WE CAN FIND THAT OUT.
AND WE CAN FIND OUT WHEN THE DISCUSSION IS OVER.
>> MR. WALKER SAYS IT'S GOT TO GO BACK.
>> IT HAS TO GO BACK ON THERE. >> I JUST HAD NOT READ THAT.
>> SO IF I UNDERSTAND FOR SECOND PERIOD IF WE MOVE FORWARD TODAY IT GOES THROUGH MULTIPLE STEPS IF IT IS TEN YEARS, THAT IS WHAT THE VOTERS APPROVED THEM IT WOULD HAVE TO COME UP FOR APPROVAL. IS THAT CORRECT?
>> THANK YOU, MR. CHAIRMAN MR. KHAN OF THE QUESTION I HAVE IS WE DO ON A CASH FLOW BASIS WHAT IS THE PROCESS FOR PRIORITIZING THESE PROJECTS? IT IS A LONG LIST.
>> IT IS, THAT IS SOMETHINGD BR. OBVIOUSLY THERE IS A PERIOD OF TIME WHERE THIS IS JUST A PROJECT, BUT AT THE END OF THE DAY, YOU ALL VOTE ON THE PROJECTS AND HOW DOLLARS ARE
[02:00:01]
SPENT. SO IT WOULD BE COMING BACK TO THE BOARD IN THE BUDGET PROCESS IN ON A NEED BASIS, FOR INSTANCE, WHEN YOU GET TO THE ROADWAY, MY RECOMMENDATION WITHOUT HAVING TALKED TO SUBJECT MATTER EXPERTS THAT.WE NEED TO LOOK AT THE ROWS THAT ARE MOST EFFICIENT AND WHICH ONES CAN WE MOVE TO QUICKEST. SO WHERE ARE THE NEEDS THE GREATEST IN THE BEST WAY TO PRIORITIZE IT BASED ON CASH BASIS. ALL OF THEM ARE LEADS THAT HAVE BEEN IDENTIFIED, BUT, WHETHER OR NOT HOW YOU PRIORITIZE THEM IS BASED ON WHAT IS THE GREATEST NEED IN MY OPINION, WHICH I TRY NOT TO GET UNLESS THE BOARD ASKED FOR IT.
THE OFFICE HE GOING TO WANT TO DEAL WITH ROADS FIRST.
AND I THINK THAT WHAT YOU ALL SAID AND THE GENESIS OF THE DISCUSSION CAME FROM IS THESE DEFICIENT ROADS IN THE COUNTY.
THAT WOULD BE PART OF OUR PRIORITIZATION AND STAFF AS ROADWAYS TO MAJOR ROADWAYS AND TO GET SOME OF THOSE OTHER
CAPITAL PLAN PROJECTS. >> THANK YOU.
>> YES, MA'AM. >> THANK YOU WE WILL GO TO
PUBLIC COMMENT NOW. >> AT THIS TIME WE WILL OPEN IT UP FOR PUBLIC COMMENT ON AGENDA ITEM NUMBER NINE THE SURTAX
CONVERSATION. >> GOOD MORNING JOE MCINERNEY IF YOU CAN LEAVE THAT SLIDE UP PLEASE.
>> ADDRESS PLEASE? >> YES YOUR ADDRESS PLEASE.
>> 1005 BLACKBERRY LANE ST. JOHN'S 32251.
>> THANK YOU SIR. >> I THINK THE FIRST QUESTION TO ASK IS HOW DO WE GET HERE? AND, I MEAN, THAT IN A RESPECTFUL WAY. BECAUSE I KNOW THAT YOU WILL ADDRESS THAT AND YOU WILL ASKED THAT QUESTION.
LET ME SAY FIRST OF ALL, THAT LISTENING TO THE SHERIFF THIS MORNING, HE WAS EXACTLY RIGHT ON TARGET DISCOUNTING IS GROWING FOR A SAFETY AND FOR HEALTH WELFARE AND SAFETY.
HEAT NEEDS THAT COMMAND SENT TO COME I SAW THAT ON THE LIST, BEFORE I SAY ANYTHING LET ME SAY I WOULD VOTE FOR THAT.
IMMEDIATELY, I MOVED DOWN HEAR FROM OHIO, AND I KNOW THEIR COMMUNITY AS A CENTRAL OHIO AREA GROUP WE HAD BOND ISSUES TO CONSTRUCT LIBRARIES AND BOND ISSUES TO CONSTRUCT SCHOOLS.
AND PARKS, I RECOGNIZE IT IS NECESSARY AND THAT CAN HAPPEN.
BUT WHEN WE ASK HOW DID WE GET HERE? LET'S LOOK AT PARK AND RECREATION FOR EXAMPLE.
FOR OUR COMP PLAN HAS STANDARDS. FOR NEIGHBORHOODS AND COMMUNITY DISTRICTS AND REGIONAL PARKS, AND YET I DO QUESTION THE WAY IN WHICH OUR PARK AND NATURAL AREAS ARE CALCULATED, YOU DON'T PLAY SOCCER IN A REGIONAL PARK. YOU DON'T PLAY SOCCER AND WETLANDS, AND I BELIEVE THOSE TOTALS ARE USED TO COME UP TO 1.
SIXTEEN PAPERS PER THOUSAND. IT APPEARS TO MEET THE STANDARDS, WE SEEN DEVELOPERS RELIEVED FROM HAVING TO CONTRIBUTE MONEY OR LAND, ON THE BASIS OF THE COUNTY HAS ENOUGH.
AND WE CAN CITE THOSE. WITH RESPECT TO ROADS, YOUR AGENDA ITEM NUMBER EIGHT, RIGHT ON TARGET, AND INTERRELATED HOW DO WE GET HERE? WE KEEP HEARING ABOUT THE NET BENEFIT, WE KEEP HEARING ABOUT DEVELOPMENT PROJECTS.
I AM PART OF THE COMMUNITY THAT FREQUENTLY COMES FORWARD TO SAY THAT IS TOO MUCH, HOW ARE WE GOING TO PAY FOR THIS HERE WE ARE LOOKING AT THIS ONE DOES NOT WRITE A CHECK TO COVER WHAT WE ARE LOOKING AT TODAY NONE OF US WOULD DO THAT IN BUSINESS OR IN-HOME LIFE. WE WOULD QUESTION HOW DID WE GET HERE SHOULD WE DO SOME THINGS DIFFERENTLY WHY DO WE HAVE SUCH A LONG LIST OF CRITICAL AND EFFICIENT ROADS THE BENEFIT THAT WE HEARD ABOUT ALREADY PAID FOR THAT.
SHOULDN'T WE HAVE MORE PARKS YES? SO I THINK THE BIG QUESTION IS HOW DO WE GET HERE? VOTERS WANT TO HEAR THAT. I THINK EVERY VOTE IT WANTS ALL OF THE PARKS THAT ARE CALLED FOR, THEY WANT GOOD ROADS THAT ARE CALLED FOR. THEY ARE GOING TO ASK THAT QUESTION HOW DO WE GET HERE? AND ARE YOU SURE THAT WE WILL NOT BE BACK IN TEN YEARS? THANK YOU.
>> THANK YOU SIR. >> GOOD MORNING NAME AND
ADDRESS. >> MIKE SULZER FOR A 512 STREET SAINT AUGUSTINE 432084. JUST A COUPLE PIECES OF MISSING INFORMATION FROM MY PERSPECTIVE THAT WOULD BE EXTREMELY HELPFUL TO GET ACROSS TO THE PUBLIC IN THIS PROCESS.
IS THE EXPECTED REVENUES THAT WOULD ARISE FROM 1% INCREASE.
AND WHETHER THIS IS GOING TO FIT THE BILL AND BE ADEQUATE FOR COVERING INFRASTRUCTURE COSTS. AND THIS SHOULD ALSO INCLUDE PROJECTIONS FOR FUTURE CROSS AS WE MOVE FORWARD.
BECAUSE THAT 1% OVER TIME, MAY BE CONSUMED.
AND NOT MEET THE NEEDS. THE OTHER PIECE OF INFORMATION THAT I THINK WOULD BE HELPFUL. IS TO UNDERSTAND WHICH OF THESE PROJECTS WOULD QUALIFY FOR STATE FUNDS OFFSET?
[02:05:02]
AND IT WOULD BE INTERESTING TO KNOW WHAT WE CAN EXPECT FROM THAT AND THE OVERALL PICTURE OF THINGS TO BE ABLE TO COVER INFRASTRUCTURE NEEDS FOR THE COUNTY.SO WITH THOSE PIECES OF INFORMATION, I THINK THAT COMMUNITY WOULD BE BETTER INFORMED, BETTER ABLE TO MAKE A COACHING DECISION, UPON WHICH IF THIS IS ENOUGH CAN'T WE EXPECT MORE TAX INCREASES IN THE FUTURE TO KEEP PACE WITH THE DEFICIENCIES AND INFRASTRUCTURES THANKS.
>> THANK YOU SIR MR. CHAIR IF I MAY, THROUGH THE CHAIR TO THE COMMISSION, I GENERALLY DON'T RESPOND TO PUBLIC COMMENT THIS WILL BE OF THE FIRST ONE EVER RESPOND TO.
I WANT TO BE CLEAR IT MAY BE A QUESTION OF SOMEONE ELSE ASKED.
THE $500 MILLION NUMBER IS APPROXIMATELY WHAT THAT 1% WOULD GENERATE IN TODAY'S DOLLARS. WE ARE GENERATING AROUND 49 AND ONE HALF MILLION DOLLARS AS A STANCE.
AND THAT MAY GO UP. WE'VE HAD THAT SO THIS IS THE APPROXIMATE GENERATION OF REVENUE OF 1% BASED ON A TEN YEAR OUTLOOK AGAIN SECONDLY TO THE SPEAKER'S POINT.
THAT'S WHY I SAID THIS. THE COST WILL GO UP YOU HEARD HIM SAY FOUR YEARS AGO NOW IT IS 60 MILLION.
THESE ARE ESTIMATES IN TODAY'S DOLLARS IN TODAY'S DOLLARS IT WILL ROUGHLY GENERATE 1 CENT IT WOULD ROUGHLY GENERATE ABOUT
500 MILLION. >> YES IF YOU WANT TO MAKE PUBLIC COMMENT YOU CAN STAND AT THE NEXT PODIUM AND FEEL YOU CAN ADDRESS AT ANY OF THE THREE PODIUM'S NAME AND ADDRESS
FOR THE RECORD. >> THANK YOU MY NAME IS PETER ROYAL 345 HEFFERNAN DRIVE, I AM ALSO A FIFTH DISTRICT CHAIRMAN FOR THE PUBLICAN PARTY. ON THE BOARD OF DIRECTORS OF THE ORGANIZATION THE COMMENT THE FIRST COMMENT IS THE THE INFRASTRUCTURE SIR SURTAX. I'M NOT ACCUSING ANYBODY I BOUGHT HOUSES AND BUILT HOUSES IN DIFFERENT STATES.
THIS IS THE FIRST ONE WE HAD CDD FEES.
WHICH IS A WAY FOR THE DEVELOPER TO TAKE THE MONEY THAT COST TO BUILD A HOUSE AND SHOVING IT OFF AND AREAS WHERE IT DOESN'T LOOK LIKE AS PART OF THE PRICE. THE QUESTION THAT COMES UP IS ARE THE DEVELOPERS INFLUENCING THE BOARD OF DIRECTORS OR THE COUNTY COMMISSIONERS? THAT IS WHAT I AM CONCERNED WITH. ST. JOHNS COUNTY, FOR THAT SEE TE CDDFEES, THE RESPONSIBILITY E REPUBLICAN PARTY TO GET GOOD CANDIDATES TO TAKE CARE OF THE COUNTY.
WE HAVE TAKEN AND GIVEN YOU THE TRUST TO ACCOMPLISH THAT FOR US.
SO WE HAVE TO WATCH AND PRAY CAREFULLY.
ONE OF THE THINGS THAT BOTHERS US IS THE COUNTY HAS ALLOWED DEVELOPERS TO AVENUE PROPERTY FOR DEVELOPMENT.
I THINK THERE IS 66,000 OF THEM RIGHT NOW.
WHICH IS BEEN A STATIC NUMBER FOR THE LAST FIVE OR SIX YEARS THE HOUSING DEVELOPMENTS THAT ARE APPROVED WITHOUT ANY REQUIREMENT TO TAKE THE JOB OR EVEN START THE JOB AS THE VALUE GOES UP AND THE PRICE GOES UP IN THE FEES THAT THEY ARE SUPPOSED TO PAY GOES DOWN. SO THAT IS SOMETHING TO WORRY ABOUT. THE THINGS THAT CHARGE THE TAXPAYERS THAT COVER THE COSTS OF THE DEVELOPERS SHOULD UP IN PAIN FROM THE START, IT IS ONE OF OUR PRIME CONCERNS.
IT IS OUR JOB TO TAKE CARE OF THE PEOPLE TO TAKE CARE THE COUNTY NOT THE PEOPLE WHO ARE BUILDING HOUSES HERE.
I THINK THE THING COMES TO A HEAD, WE HAD A REPRESENTATIVE OF ONE OF THE DEVELOPERS WHO IS PART OF THE GOVERNMENT JUMP TO THE R A C2 BREAK THE RULES THAT THE REPUBLICAN PARTY HAS NOT BACKING ONE CANDIDATE AGAINST ANOTHER.
TO PUT TOGETHER A VETTING COMMITTEE.
WHICH WOULD BE HIS FRIENDS TO GO OUT AND PICK WHO WOULD BE THE REPUBLICAN CANDIDATE TO RUN IN THE NEXT ELECTION.
THIS TYPE OF THING MAKES IT VERY SUSPECT AND WE ARE CONCERNED ABOUT IT. SO ARE YOU LOOKING FOR YOU TO
TAKE CARE OF IT. >> THANK YOU MR. ROYAL THANK YOU. YES SIR NAME AND ADDRESS FOR
RECORD. >> PATTERSON 1127 SOUTH MARSHALL WAY I'M ALSO IN THE RAC HERE IN ST. JOHNS COUNTY.
[02:10:03]
MR. CHAIRMAN AND COMMISSIONERS, THANK YOU FOR THIS MEETING FOR THE INFORMATION. JUST A FEW QUICK POINTS, ONE IS THE INFRASTRUCTURE DISCUSSION THAT HAS BEEN ONGOING SINCE THE WORKSHOP. WE APPRECIATE EVERYTHING YOU GUYS HAVE PUT FORTH. AND I THINK WE ALL AGREE, THAT THE COST OF INFRASTRUCTURE ASSOCIATED WITH LAND DEVELOPMENT IS THE COST OF DOING BUSINESS. BY THE LAND DEVELOPERS.IN THAT SPIRIT, I WOULD SUGGEST TO YOU, I AM A LAYPERSON I AM NOT A LAWYER, THAT YOU CONSIDER THE FOLLOWING CONCEPT, I DO NOT KNOW IT IF IS LEGALLY VIABLE. SIMPLY PUT A SURCHARGE ON ALL FUTURE IMPACT FEES UNTIL THAT 200 OR $250 MILLION SHORTFALL IS BEEN ADDRESSED. SO SIMPLY PUT SURCHARGES OF HIS FUTURE IMPACT FEES. MY SECOND.IS LOOKING AT THESE NUMBERS, I DO NOT KNOW HOW SHARP THESE PENCILS WERE BUT MY GOSH, $25 MILLION TO BUILD A PARK WHEN YOU ALREADY OWN THE LAND? WHAT ARE YOU DOING PUTTING SUPERCOMPUTERS IN THERE? THAT THESE NUMBERS NEED TO BE REFINED DRAMATICALLY AND REDUCE.
IN ALL DUE RESPECT TO OUR WONDERFUL LAW ENFORCEMENT DO WE REALLY NEED $55 MILLION FOR A COMMAND CENTER? THIS ISN'T COMMENT ON THE ADMINISTRATOR, AND ON YOU FOLKS, TO COME UP WITH RATIONAL NUMBERS.
WHAT IS A RATIONAL NUMBER HERE. IT IS A NUMBER THAT CITIZENS CAN AFFORD TO PAY. IT IS NOT WHAT YOU WANT IS NOT WHAT THE SHERIFF WANTS IS NOT WHAT THE DEVELOPER WANTS, IT IS WHAT WE AS CITIZENS CAN'T AFFORD TO PAY.
THANK YOU FOR YOUR ATTENTION. >> THANK YOU MR. PATTISON ANYBODY ELSE FOR PUBLIC COMMENT ON AGENDA ITEM NUMBER NINE?
>> NICOLE CROSBY L LENDING -- 1169 NECK ROAD.
WE NEED A LOT MORE INFORMATION I'M SURE YOU INTEND TO PROVIDE IT. NEXT STEP PLEASE PROVIDE A MAP THAT SHOWS EXACTLY WHERE THE 220 MILLION EVER WROTE A PERMISSIVE PLANT AND HOW THEY ARE PLANNED TO BE IMPROVED.
WE NEED TO SEE RATIONALE AND DETAIL FOR MONEY THAT IS REQUESTED. SAME WITH DRAINAGE IMPROVEMENT AND SIDEWALK IMPROVEMENTS A LOT OF CITIZENS REQUEST THOSE.
WHERE WOULD THEY GO? RE: 55 MILLION SHARES COMMAND CENTER, IT WAS JUST A FEW YEARS AGO THAT WE HAD TO COUGH UP 25 MILLION FOR A TRAINING CENTER, WHY DO WE NEED $80 MILLION WORTH OF BUILDINGS? WHEN DEPUTIES ARE COMPLAINING THAT THEY ARE UNDERPAID? IF YOU ARE CONCERNED ABOUT SAFETY SURE IN THE FIRST PRIORITY BE TO ADEQUATELY COMPENSATE THE PEOPLE WHO PUT THEIR LIVES ON THE LINE EVERY DAY TO PROTECT US? AGAIN MANY MORE DETAILS I NEEDED ON THIS COMMAND CENTER TO JUSTIFY SUCH AN EXPENDITURE.
MOST MIND-BOGGLING TO ME IS WE HAVE NOBODY CANCEL -- CAMP TO GATHER CRUCIAL EVIDENCE OF CRIMES TO PROTECT OFFICERS AND TO PROTECT THE PUBLIC FROM THE TINY MINORITY OF OFFICERS WHO MAY BE ABUSIVE. WHY DO WE HAVE TO RELY ON A BYSTANDER WITH AN IPHONE TO VIDEO A BEATING OF A MAN AT A TRAFFIC STOP OF A SAINT COUNTS COUNTY OFFICER.
THANKFULLY AN EX COUNTY OFFICER. WHAT ABOUT THE SAFETY OF OFFICERS? WE ARE GOING TO ALLOWED THEM TO BE ATTACKED OR SHOT AT OVER A RECORDING OF WHO DID IT.
TO ME THAT IS THE DEFINITION OF INSANITY.
BODY CAMS -- GAMES ARE CRUCIAL TECHNOLOGY FOR GATHERING EVIDENCE AND NOT HAVING THEM IS LIKE SAYING WE DON'T DO FINGERPRINT SO WE DON'T BOTHER WITH DNA EVIDENCE.
SAINT AUGUSTINE HAS BODY CANS -- GAMES SO SHOULD THE ENTIRE COUNTY. AND MORE MONEY FOR COPS BEFORE WE GET MORE BUILDINGS. FINALLY 80 MILLION FOR PARKS, WE LIKE TO SEE THE EXACT BOUNDARIES OF THE PROPOSED BONDS IN RELATION TO DEVELOPMENTS THAT WERE NAMED ON THE AGENDA.
WE WOULD ALSO LIKE TO SEE BECAUSE PROVIDED FOR LAND PURCHASE AND DEVELOPMENT OF LAND OR BOTH.
HOW WOULD BREAKDOWN AND SPORTS FIELDS ARE SOME NATURAL OR MIXED-USE? EVEN PEOPLE WHO LIVE OUTSIDE DEVELOPMENT WILL BE USING THESE PARTS, THE DEVELOPERS SHOULD BE TAKING AN ABORTION AMOUNT OF MONEY BASED ON USED BY THE RESIDENTS. THIS COUNTY HAS HISTORICALLY DEVELOPERS PAY FOR PARKS. AND FINALLY I WAS VERY PLEASED TO RECEIVE TWO POSITIVE RESPONSES TO THE E-MAILS OF COMMISSIONERS. PROPOSING COMMISSIONS OF THE OUTPOST TO THE PARK AND I WANT TO THANK THEM FOR THE INPUT.
I EAGERLY AWAIT RESPONSES FROM COMMISSIONERS.
I KNOW YOU'RE INUNDATED WITH E-MAILS.
THIS IS TOP INTERVIEW IN PONTE VEDRA AND IT HAS BEEN SINCE 2014. LOOK FORWARD TO PURSUING POSSIBILITIES OF HIS VIABLE THANK YOU VERY MUCH.
>> JOHNNY COUNTS 9470 FACTORY ROAD.
YOU OF ALL GOT A YOU KNOW WE GOT A LOT GOING ON IN THE COUNTY.
FIRST THING I WOULD LIKE TO DO IS TO ADD MY ACCOLADES TO EARLIER THIS MORNING WITH SPEAKING ABOUT GREG CALDWELL.
HE IS A VERY GOOD INDIVIDUAL AND AN ASSET IN THIS COUNTY.
BECAUSE HE MAKES THINGS WORK SMOOTHLY.
HE HAS BEEN AROUND A WHILE AND I'VE BEEN DEALING WITH THEM FOR OVER TEN YEARS. AND THERE IS I MEAN THERE IS HE MAKES IT TOO EASY. HE IS THE ONE YOU NEED TO HAVE A PAIR TRYING TO CON US INTO GET THIS TAX DONE.
[02:15:01]
THE ONLY THING THAT WE BRING UP. WE WENT OVER IT EARLIER, WHAT HAD BEEN DONE ALREADY? WHERE IS THE ACCOUNTABILITY FOR IS ALREADY SUPPOSED TO BE DONE? NOBODY CAN TELL, I MEAN, YOU PLAN AND PLAN IT IS GOOD TO PLAN.PLANNING IS GOOD, BUT THE PLAN IS NOT WORTH ANYTHING, NEXT YEAR, THE NEXT DAY, THE DYNAMICS INVOLVED IN THIS IS CRAZY.
AND WE HAVE NOT EVEN SEE WHAT IS CAUSING YET NEXT YEAR TO GET SOMETHING DONE WITH INFLATION IS OUR BIGGEST TAX.
SO, WE REALLY NEED A LOT MORE INFORMATION ON THIS BEFORE WE PUT IN AN EXTRA 65% BURDEN ON THE LOCAL PEOPLE.
THE TAXPAYERS THAT ARE ALREADY HERE.
ONLY 35% ESTIMATED AS TO WHAT THIS TAX IS GOING TO BRING IN.
SO YOU KNOW WE HAVE GOT TO DO WHAT IS NECESSARY, ROADS AND INFRASTRUCTURE, THAT IS PUBLIC GOOD.
THE PUBLIC SAFETY DEFINITELY. THAT'S WHAT GUZMAN IS INSTITUTED FOR. WE NEED TO GIVE THEM EVERYTHING NECESSARY OF COURSE, WE ALL WANT MORE, BUT WE GOT TO HAVE WHAT IS NECESSARY TO DO IT. AND WE DEFINITELY HAVE TWO WEED OUT SOME PROJECTS AND I KNOW IT IS JUST A WISH LIST AND AN ESTIMATE AND TRYING TO GET A BROAD MOVEMENT WE ARE JUST LOOKING AT THE STICKER PRICE WE ARE NOT SEEING OPTIONS.
AND IT IS LIKE I SAID, IT IS NOT GETTING CHEAPER.
MATERIAL, LABOR, EQUIPMENT, INSURANCE GOVERNMENT REGULATION, THE GOVERNMENT'S GREATEST CONTRIBUTIONS TO SOCIETY IS IT FINDS OUT THAT THE TAXPAYER IS MORE THAN ONE POCKET.
THAT WAS SAID YEARS AGO. SO I WOULD LOOK INTO WAYS AS FAR AS ROADS AND INFRASTRUCTURE A LOT OF THESE AUXILIARY ROADS COULD BE IMPROVED TO HELP OUT SOME OF THE TRAFFIC, AND YOU NEED TO LOOK BACK INTO RECYCLING AND WE DID SOME OF THAT HERE IN ST. JOHN'S COUNTY. I ACTUALLY WORKED IT WITH A COUPLE THAT DID THAT. IT IS A GOOD PROCESS, WE DON'T HAVE A ROBE BASE HERE IN FLORIDA.
SO THIS IS A PROCESS THAT HELPS TAKE CARE OF THAT.
IT GETS ROADS UP AND RUNNING QUICKLY.
IT WILL BE A LOT MORE EFFICIENT THAN WHAT WE HAVE TO PAY FOR AN
HOUR. >> YOU MR. COUNTS FOR YOUR PUBLIC COMMENT. NAME AND ADDRESS.
>> CHUCK LEBANON SKIED 1748 STREET SAINT AUGUSTINE.
JUST A COUPLE QUESTIONS. I SAW ON THE LIST OF INFRASTRUCTURE OF THE ROADS, THAT THEY ARE ALL COUNTY ROADS AND LOCAL ROADS. HOW MUCH DOES THE COUNTY HAVE TO PUT INTO THE COFFER FOR THE STATE ROADS? I DO NOT KNOW IF WE HAVE TO PUT IN ONE MONEY INTO IT AS WELL IF SO I WOULD LIKE TO KNOW WHAT THE PERCENTAGES ON THOSE KIND OF ROADS, PARKS I ASSUME THE NORTHWEST PARKS IS THE WORLD GOLF VILLAGE AREA I'M NOT SURE OF ALL THE OTHERS NAMES.
BUT AS FAR AS PRIORITIES ARE CONCERNED SILVER LEAF IS IN THERE. I KNOW IT IS A GENERAL LOCATION.
AGAINST ESTABLISHED BUILDER COMMODITIES THANK YOU.
>> THANK YOU MR. LOBO NOW SKI THANK YOU ANYONE ELSE YES,
MA'AM? >> HE LEFT ME 2 MINUTES I'M NOT GONNA TAKE IT BJ COLLATED AUGUSTINE.
IN 2015 A PRIVATE GROUP BY EDDIE KRAMER AND HEIDI JEMISON FOUNDED A STUDY TO BUILD CONSENSUS FOR A SALES TAX IN 2017 LISA COOK IN THE COALITION WON OF THE SALES TAX DIDN'T HAPPEN.
THE OVER DEVELOPMENT PERMITTED BY THIS BOARD OVER THE YEARS, AND THE NORTH ALSO KNOWN AS I HATE TO SAY IT BUT IT IS TO ORIGINALLY PART OF THE COUNTY CREATED THE CURRENT INFRASTRUCTURE DEFICIT YOU CAN LOOK AT THE LIST.
TO SOME IT IS OBVIOUS WE SUPPORT A SALES TAX INDUSTRIES I CANNOT READ HIS MIND BUT I THINK. COMMISSIONER ARNOLD BLOCKER IN WHITEHURST WHO LIVES IN THE NORTH PART OF THE COUNTY WOULD GO ALONG WITH MR. DEAN ON THE VOTE.
THEY COULD HAVE LISTEN UP YOU WON'T LIKE THIS EITHER.
THEY COULD HAVE INCREASED PROPERTY TAXES DURING THE BUDGET PROCESS, BUT THEN WHEN THEY RUN IN NOVEMBER 2022, VOTERS WOULD HAVE VOTED AGAINST THEM I THINK. I DON'T NOT READ MINDS.
POLITICIANS AND BUREAUCRATS CREATED THE DEFICIT.
THEY CAN GO TO THE DEVELOPER CRONIES FOR THE $500 MILLION.
VOTERS TAKE THIS OPPORTUNITY IN NOVEMBER OF 2022 TO VOTE NO TO A SALES TAX. ALSO KNOWN AS A SURTAX.
[02:20:02]
AND WHEN EVER YOU ARE PUTTING THINGS ON THE AGENDA, DON'T USE BIG WORDS. USE THE LITTLE WORDS.SALES TAX. WOULD GET THE ATTENTION OF MORE PEOPLE WHO MAY HAVE BEEN ABLE TO COME IN AND SHARE THEIR THOUGHTS. AS I LIKE TO DO WITH THIS BOARD.
AS OFTEN AS POSSIBLE. THANK YOU SO MUCH.
MR. DEAN, I HOPE YOU CAN HEAR THIS I WAS GOING AWAY FOR THE NEXT TIME. I APPRECIATE YOU ALLOWING ME TOO COME UP AFTER THE ATTORNEY DID TO SPEAK.
I KNOW THAT IS NOT DONE. AND SOME PEOPLE IN THIS ROOM WILL PROBABLY HAVING A HEART ATTACK WHEN THAT HAPPEN.
I JUST WANT TO SAY THANK YOU VERY MUCH FOR ALLOWING ME TOO DO
THAT I APPRECIATED. >> TEN SHE HAS THANK YOU, ANYBODY ELSE THAT WOULD LIKE TO MAKE A PUBLIC COMMENT NOW IS THE TIME? AND HE ALSO PUBLIC COMMENT? SEEING NONE WE WILL CLOSE THE COMMENT.
>> I WOULD LIKE IF I MADE TO MAKE A FEW ADDITIONAL COMMENTS AND MAYBE A COMMISSIONER WHO WOULD LIKE TO WEIGH IN.
AS WE MOVE FORWARD. THE OLD SAYING ABOUT YOU KNOW THE THOUSAND MILE JOURNEY STARTS WITH THE FIRST STEP.
WENT WE STARTED THIS DISCUSSION, A LITTLE WHILE AGO, WE PUT ON AN OVERHEAD SHOWING GIVEN THE TIMEFRAME, WE NEEDED TO START THE PROCESS TODAY. THERE HAS BEEN A LOT OF EXCELLENT QUESTIONS ASKED ABOUT THE PUBLIC THIS MORNING THERE HAVE BEEN A LOT OF GOOD COMMENTS.
AND THANKFULLY, WE HAVE AN OPPORTUNITY, IF WE MOVE FORWARD TO ADDRESS THOSE QUESTIONS AND ANSWER ANY QUESTIONS OF ANY CONSTITUENT THAT WANTS TO RAISE THEM.
BUT I THINK IT IS VERY IMPORTANT THAT WE MOVE FORWARD TODAY, WE COULD SPEND HOURS IF NOT WEEKS IF NOT MONTHS DISCUSSING HOW WE GOT HERE TODAY. WHO DID WHAT TO WHO SHOT JOHN? NO OFFESE JOHNNY. BUT, I MEAN, IT IS WHAT IT IS.
AND AS ONE COMMISSIONER I FEEL LIKE I HAVE AN OBLIGATION TO ADDRESS THIS PROBLEM HEAD ON. IN THE WAY I HAVE CHOSEN AND SUGGESTED TO FELLOW COMMISSIONERS IS TO TAKE IT TO THE VOTERS. EXPLAIN EDUCATE AND INFORM THE VOTERS OF WHAT THIS MEANS. WHAT THIS INFRASTRUCTURE WILL DO TO THE QUALITY OF LIFE, AND WHAT IT WILL DO IF WE DO NOT DO IT.
WITH THAT SAID I FIRMLY BELIEVE THAT WE ARE AT A POINT IN TIME IN THIS COUNTY, WHERE WE NEED TO GO TO THE VOTER AND EXPLAIN THE DEFICIT THAT WE HAVE AN INFRASTRUCTURE, AND ALLOW THEM TO DO WHAT IT'S ONLY RIGHT, AND IS FOLLOW THE DEMOCRATIC PROCESS AND VOTE UP OR DOWN. I AM HOPEFUL THE ANSWER WILL BE YES, BUT IT MAY NOT BE. AND IT WILL HAVE TO COME BACK AND DISCUSS PLAN B OR C. BUT THAT IS MY POSITION TODAY, AND I HOPE THAT MY FELLOW COMMISSIONERS SHARE MY POSITION.
SO WITH THAT I WILL CALL ON CHRISTIAN.
>> THANK YOU, MR. CHAIRMAN, I THOUGHT DURING PUBLIC COMMENT WE HEARD SOME GOOD QUESTIONS QUESTIONS THAT PROBABLY NEED TO BE A PART OF THE CONVERSATION IF WE MOVE THIS FORWARD.
ARE ANY OF THE THINGS ON THIS LIST STATE ROADS OR STATE OBLIGATIONS? COULD WE SEEK FEDERAL FUNDS OR STATE FUNDS TO ADDRESS ANYTHING ON THE LIST? I THOUGHT THAT WAS A GOOD QUESTION.
>> YES COMMISSIONER WHITEHURST AND SHARE.
THESE ARE COUNTY ROADS THAT ARE ON HERE.
THERE ARE THIS IS WHY I MENTIONED AT THE BEGINNING OF IT THAT WE WOULD CONTINUE TO SEEK FEDERAL DOLLARS TO OFFSET A NUMBER OF THESE PROJECTS. AS A MATTER FACT I CANNOT RECALL I BELIEVE THERE ARE TWO PROJECTS ON HERE.
THAT HAVE SOME STATE FUNDING PLANNED FOR IN 26 OR 27 SO FIVE OR SIX YEARS OUT THERE BE A COMPONENT FOR STATE FUNDING.
THESE ARE NOT STATE ROADS I AM LOOKING FOR HIM THESE ARE ALL COUNTY ROADS. I HEAR THE DISCUSSION ABOUT STATE ROAD 16. I DO NOT KNOW WHAT THAT BREAKDOWN IS ON THE COUNTY'S OBLIGATION IS ON STATE ROADS.
BUT THESE ARE CURRENT COUNTY ROADS THAT WE OWN AND OPERATE.
>> THANK YOU MR. CONRAD ALSO I KNOW WE PURSUE A LOT OF GRANTS AS A COUNTY IN THE FIRE CHIEF HAS BEEN TO THAT GRANT AND BEEN SUCCESSFUL IN THE SHERIFF HAS BEEN GOT SOME GREAT FUNDS.
WE ARE PURSUING EVERY GRANT THAT IS AVAILABLE TO HELP US IN THE
INFRASTRUCTURE DIVISION. >> WE DO YES, SIR.
>> THANK YOU FOR CONFIRMING THAT.
I'VE HEARD PUTTING A SURGE ON THE IMPACT FEES AND MR. PATTISON I'VE HEARD THAT LOUD AND CLEAR, I SEE THAT TWO E-MAILS, I THINK WE NEED TO BE CAREFUL OF THE POSSIBLE CONSEQUENCES WE HEAR FROM FOLKS ALL THE TIME TO TEACHERS AND NURSES AND SHERIFF'S DEPUTIES AND FIRE DEPARTMENT EMPLOYEES CAN FORWARD TO LIMIT THE COUNTIES CERTAINLY TO WHAT THEY SEE SAVING LIVES.
WE HAVE DEVELOPED THESE IMPACT FEES UPFRONT.
BUT THAT COST GETS PASSED ALONG TO THE HOMEBUYER.
[02:25:04]
SO THE PROPERTY APPRAISER JUST RECENTLY PROPOSE AN ARTICLE AND THESE ARE APPROXIMATIONS THAT THE HOMES LAST YEAR ON AVERAGE WERE ABOUT $320,000. IN THIS YEAR THERE ABOUT $380,000. DO WE WANT TO CONTINUE TO ADD TO THOSE COSTS MAYBE I THINK THAT IS SOMETHING WE NEED TO UNDERSTAND IF WE ARE GOING TO INCREASE IMPACT FEES IF UNINTENDED CONSEQUENCES FOR THOSE WHO SERVED IN ST. JOHN'S COUNTY SO BRAVELY EVERY DAY. AS FOR ME I KNOW THAT ST. JOHN'S COUNTY IS POPULATED BY SOME OF THE MOST SUCCESSFUL AND WELL EDUCATED PEOPLE. I TRUST THOSE PEOPLE WITH A LOT OF DEGREES HANGING ON THE WALL TO COLLECT INFORMATION.AND TO MAKE THAT DECISION IN NOVEMBER.
AND IF THEIR DECISION IS TO VOTE THE STYLE, AS A COMMISSIONER I FEEL I HAVE CLEAR DIRECTION ARE YOU HAPPY ARE THE WAY THAT WE ADDRESS THESE INTRODUCTORY DEFICIENCIES? OR DO NOT WANT TO ADDRESS OF ANY COURSE.
THAT NEEDS TO ADDRESS THEM. IF YOU FEEL LIKE WE NEED TO DO A BETTER JOB AT ADDRESSING THESE EFFICIENCIES OR FASTER JOB OF IT PERHAPS YOU WANT TO VOTE YES. I TRUST THE PEOPLE OF ST. JOHNS COUNTY TO MAKE THAT DECISION AND GIVE US DIRECTION, WITH HOW TO SERVE THEM. SO THOSE ARE MY COMMENTS.
>> THANK YOU MR. SHARE, I WANT I THINK WAS MR. PATTISON.
I THOUGHT HE BROUGHT UP AN EXCELLENT POINT THAT ONE WEEK WE NEED TO UNDERSTAND GOING FORWARD.
THAT WAS SPECIFICALLY ABOUT THE COST OF SOME OF THESE ORIGINAL PARKS. I AM NOT PREPARED TO ANSWER THAT, THESE COSTS WHEN YOU LOOK AT THE TICKER PRICE ON THAT THAT IS A LOT. THAT IS SOMETHING I DON'T KNOW IF WE ARE ABLE TO ADDRESS IT NOW, BUT 25 MILLION FOR PARKS.
I KNOW THESE COSTS HAVE GONE UP QUITE A BIT.
IT MAY BE HELPFUL TO UNDERSTAND WHAT WE ARE DEALING WITH.
I THOUGHT IT WAS A GREAT QUESTION.
>> GOOD MORNING MR. CHAIRMAN COMMISSIONERS I AM THE DIRECTOR OF PUBLIC WORKS. NOW WE ARE GOING THROUGH THE PROCESS COMMISSIONER. PART OF THE SCOPE WILL ALLOW THE CONSUMER TO COME ON OUT REACH OF THE COMMUNITY.
TO UNDERSTAND THE WANTS AND NEEDS OF THAT COMMUNITY.
AND GO AHEAD AND MOVE FORWARD THROUGH DESIGN.
BUT WE ARE EXPECTING SOME OF THESE PARTS TO BE 60 ACRES OR 4G A RULE OF THUMB OF 500,000 PER ACRE FOR THE CONSTRUCTION OF THESE PARKS WITH THE DESIGNS THAT MAY BE ASSOCIATED WITH THAT. WE WILL GO AS PART OF THE NEXT STEP FOR THE PROJECT IS THE OUTREACH TO THE DIFFERENT PARTS OF THE COMMUNITY THAT ARE IMPACTED BY THESE REGIONAL FACILITIES TO BETTER UNDERSTAND THE NEEDS OF THIS AREA.
>> I UNDERSTAND THESE EARLY ESTIMATES AND WE WANT TO MAKE SURE THAT THEY NEED TO SUPPORT IN THE RANGE, SO I WANT TO MAKE SURE WE FULLY UNDERSTAND THAT AGAIN I KNOW THIS IS EARLY LIST HERE. IT IS EARLY SIR BUT IS BASED OFF THE NUMBERS WE ARE SEEING RIGHT NOW.
AND BASED ON WHAT THE RECESSION NEEDS TO BE.
>> MAYBE CAN ANSWER THE NEXT QUESTION, AS I GO BACK, MR. CROSBY, THEY ARE BROUGHT TO SUB SPECIFICALLY THIS IS A GOOD QUESTION SPECIFICALLY ABOUT SALARIES FROM ALL OFFICERS.
MY UNDERSTANDING IS THAT THIS WOULD ONLY BE FOR CAPITAL PROJECTS NOT SALARIES ARE CORRECT?
>> THAT IS CORRECT MR. COMMISSIONER.
THAT IS CORRECT, THIS ONLY GOES TO CAPITAL IMPROVEMENTS.
YOU WERE THE SHERIFF THIS MORNING INDICATE THAT ONE OF HIS PRIORITIES IS PART OF THEIR STRATEGIC PLANNING IS TO COMPENSATE THAT LAW ENFORCEMENT. HIGHER ESPECIALLY THOSE WHO ARE STARTING HE IS INDICATED TO ME AS WELL THAT IS GOING TO BE WHEN HIS PRIORITIES IN HIS BUDGET. AND REFLECTED AS SUCH.
AS WE GET INTO BUDGET DISCUSSIONS AND WORKSHOPS AND AS A BOARD LOOKS AT BUDGETS. SO THAT IS A TOTALLY SEPARATE AND EXCLUSIVE DISCUSSION. HIS COMMAND CENTER.
>> IT IS IMPORTANT TO BRING UP BUT YOU MAY HAVE HEARD THAT.
SOME OF THE SPECIFIC AGING INFRASTRUCTURE I THINK THERE IS STILL THE JAIL IT'S A HISTORIC JAIL THAT WAS MARTIN LUTHER KING WAS ACTUALLY PLACED IN. THERE IS INFRASTRUCTURE NEEDS AT THE SHERIFF'S DEPARTMENT HAS I'M SURE WE WILL GO THROUGH THAT A LITTLE BIT MORE. BUT ALSO PURCHASING CONSERVATION LAND. WITH THAT BE A STATUTORY REQUIREMENT HERE THE PURCHASE OF CONSERVATION LAND?
>> I WILL LOOK TO LEGAL FOR THAT BUT THE INITIAL RESPONSE WOULD BE BASED ON THE STATUTE THAT YOU CAN GO FORWARD TWO/LORETTA.
IF YOU WILL. THERE HE GOES TO THE STATUTORY DEFINITION OF INFRASTRUCTURE, MY INITIAL INCLINATION IT WOULD BE IT DOES NOT AS YOU CAN SEE THERE IS A FIXED CAPITAL OUTLAYS ASSOCIATED WITH CONSTRUCTION RECONSTRUCTION OR IMPROVEMENT OF PUBLIC FACILITIES THAT HAVE A LIFE EXPECTANCY OF FIVE MORE YEARS, IT DOES SAY AND RELATED TO LAND ACQUISITION RELATED TO THE SERVICE. I THINK THAT IS REFERENCING I AM GOING TO LOOK AT THEM. I THINK IT IS REFERENCING LAND RELATED TO IMPROVEMENT OF A FACILITY.
THAT HAS A CAPITAL NEED OF OVER FIVE YEARS.
[02:30:03]
BUT AGAIN I WILL TURN TO THEM THAT WOULD BE MY INCLINATION.>> THANK YOU I WOULD AGREE WITH MR. CONRAD'S ASSERTION ON THAT BASED ON THE DEFINITION OF THE PAST.
TO OUR PREVIOUS QUESTION, I WOULD LIKE TO TURN REAL QUICK TO ANSWER MORE INFORMATION ON RECENT QUESTIONNAIRES.
>> SURE, THROUGH THE CHAIR IN RESPONSE TO WHAT TYPES OF IMPROVEMENTS CAN BE USED. THE MONEY CAN BE USED FOR EMERGENCY LAW ENFORCEMENT PERSONNEL.
IT IS NOT JUST INFRASTRUCTURE BUILDINGS, AND THAT NATURE.
THIS STATUE ALLOWS FOR EMERGENCY RESPONSE AND LAW ENFORCEMENT AGENCIES THE SURTAX CAN BE USED TO PAY FOR VEHICLES AND EQUIPMENT NECESSARY FOR OFFICIAL USE AS LONG AS THE EQUIPMENT HAS A LIFE EXPECTANCY OF FIVE YEARS OR MORE.
>> THAT WOULD NOT INVOLVE SALARIES OR ANY OTHER
>> FOR EXAMPLE AMMUNITION WOULD NOT FIT WITH THAT?
>> WE ARE TALKING VEHICLES AND EQUIPMENT THAT HAVE A LIFE
EXPECTANCY. >> I THINK THAT'S IMPORTANT TO CLARIFY, AS WE GO FORWARD WE TEACH PLUS SET OUT I THINK IT IS IMPORTANT TO KIND OF FLESH THAT OUT.
AND AS FAR AS THE CONSERVATION, DO YOU HAVE A DIFFERENT? WE HAVE TOO MANY LORRIES IN THE ROOM.
>> NOTE MY APOLOGIES IF I WAS NOT CLEAR I AGREE WITH MR. CONRAD'S TAKE ON THE DEFINITION.
I DON'T THINK THE CONSERVATION WOULD BE INCLUDED.
UNLESS SOME WAY IT WAS TIED TO INFRASTRUCTURE.
BUT CONSERVATION WOULD NOT BE. >> LET ME JUST FOR ONE MINUTE.
HALF A MINUTE. >> IT IS TIED A LITTLE TO INFRASTRUCTURE, I'M SORRY IT IS TIED TO INFRASTRUCTURE THAT IS
THE LODGE THAT IS ON THE LAND. >> OKAY THANK YOU.
>> I APPRECIATE THAT THANK YOU MS. CROSBY.
JUST THROUGH RESEARCH I BELIEVE SOME COUNTIES IN FLORIDA HAVE FOUND WAYS OF TYING THAT IN I AM JUST CURIOUS OF WE CAN DO THAT A LITTLE BIT WE CAN TALK MORE OF LINE.
I AM CURIOUS OF WHAT OTHER COUNTIES HAVE DONE TO LOOK AT
THAT. >> AS FAR AS TYING INTO INFRASTRUCTURE SPECIFICALLY LET ME JUST SAY QUICKLY AND IS BEEN QUITE A WHILE. I USED TO BE IN THE FIELD QUITE A BIT. THERE ARE COUNTIES LIKE MARTIN COUNTY AND SEMINOLE COUNTY AND BREVARD COUNTY.
WHICH HAS SPECIFICALLY PASSED REFERENDUMS FOR EITHER FOR CONSERVATION LAND ACQUISITION WHICH IS DISTINCT IN MY OPINION.
FROM INFRASTRUCTURE AS BY DEFINITION OF TO 12.
I THINK WE'VE CLEAR DEMARCATION BETWEEN CONSERVATION LAND ACQUISITION AND DESIGN AS I UNDERSTAND IT.
VERSUS INFRASTRUCTURE THAT IS AVAILABLE TO US THROUGH THIS.
>> I DIDN'T ASK FOR CLARIFICATION I JUST WANT TO MAKE SURE IT'S IN E-MAILS I THINK THAT IS GREAT CLARIFICATION. THANK YOU, MR. CHAIRMAN.
>> COMMISSIONER BLOCKER, ALSO CHAIRMAN DEAN STOLE MY THUNDER AS I MENTIONED LEE COUNTY AS YOU KNOW, I BELIEVE IT IS A PROPERTY TAX MILLAGE. IT IS NOT THROUGH A SALE SURTAX THEY HAVE WHAT IS CALLED A CONCERT DIVISION 2020 PROGRAM.
THOSE ARE AVENUES TO LOOK AT IN A DIFFERENT TIME.
WHEN IT BE UNDER THE SURTAX, BUT IF THAT IS THE BOARD'S DIRECTION, PROGRAMS LIKE THAT ARE POSSIBLE IN THE FUTURE JUST NOT UNDER WHAT IS BEFORE YOU TODAY.
>> NO ABSOLUTELY, THAT CLARIFIES WHAT THAT.
I DO NOT KNOW ALL THE ANSWERS TO THESE QUESTIONS.
BUT MEMBERS OF THE PUBLIC ARE INTERESTED IN ASKING.
SO IDENTIFYING WHAT THE PARAMETERS AND BOUNDARIES ARE.
AND TRYING TO ANSWER THOSE QUESTIONS IS GOING TO BE GOOD SO THE VOTERS CAN MAKE AN INFORMED DECISION SO THIS MOVES FORWARD
SO I APPRECIATE THAT. >> THE CHAIRMAN IF YOU DON'T MIND, MR. CALDWELL, IF YOU WOULD JUST.
DID YOU SAY WE ARE HIRING A CONSULTANT TO LOOK AT WHAT WE
NEED IN PARTS? >> WE ARE GOING OUT RIGHT NOW FOR AN RFQ, FOR EXCEL A CONSULO COME IN.
>> JUST THE DESIGN? >> WE ARE GOING TO GO OUT THERE WITH THE PARK AND REC TEAM COMMISSIONERS AND THE ENTIRE COMMUNITY TO HAVE A FULL PROGRAM THAT WE UNDERSTAND THE NEEDS AND
THE DESIRES OF THE COMMUNITY. >> OKAY, WE HAVE A PARK AND RECREATION MASTER PLAN THAT WE DID TWO OR THREE YEARS AGO.
AND WE ARE NOT GOING TO USE IT I JUST KINDA WANT TO KNOW DOWN THE
ROAD WHY WE DID IT? >> THAT WOULD ALSO BE PART OF THAT WE ARE JUST MAKING SURE THAT WE CONFIRM THAT PUBLIC.
>> OKAY THAT IS FINE THANK YOU. I WAS JUST CLARIFYING.
I WILL SAY AT THIS TIME, PERSONALLY I AM NOT FOR A SALES
[02:35:03]
TAX INCREASE AT A TIME OF INFLATION.IT IS A VERY HARD TIME IN OUR COUNTY FOR LOW INCOME PEOPLE AND PEOPLE IN GENERAL. BECAUSE EVERYTHING IS GOING UP.
ABOUT 7% LAST MONTH. AND THAT IS EXCLUDING FOOD.
AND YOU ARE GOING TO ADD A TAX, ON EVERYBODY THAT WILL BE PAYING OR ALREADY PAYING. IT WILL GO ON THE BALLOT, THERE WAS WAYS THAT I WOULD LIKE TO SEE THINGS GO I DID NOT WANT TO SEE IT BONDED. I WE CAN TELL YOU IF THAT GOES THROUGH. IF WE CANNOT FIGURE OUT WHAT TO DO IT IS ESTIMATED 815 OUT BY THE TIME IT GETS THERE, WE HAVE GOT INFLATION OF ABOUT 7%, SO IT EVERYTHING IS GOING TO COST MORE. AND SELL GOES ON.
I THINK OUR HAVE SENT RIGHT NOW IS OVE 225 OR 26 IS ESTIMATED RIGHT NOW AND WHEN HE FIRST CAME ON THE BOARD.
ABOUT THE HALF% THAT WE RECEIVE. THAT IS THE BIGGEST CONCERN ABOUT WHAT IT WOULD DUE TO THE LOW INCOME PEOPLE IN THE COUNTY, TRYING TO MAKE IT THROUGH, YOU ARE GOING TO INCREASE A TAX, DURING HIGH INFLATION. HIGHER THAT WE HAVE EVER SEEN.
BECAUSE IN THE 80S, THE CALCULATED FOOD AND FUEL INTO IT AND RIGHT NOW THEY ARE NOT. AND AS IT KEEPS GOING UP EVERY MONTH. SO THAT IS ALL I GOT
MR. CHAIRMAN. >> PAUL, LET ME SAY I AGREE WITH YOU IN A SENSE THAT, IT IS TOUGH WENT WE ARE IN AN INFLATIONARY PERIOD. BUT WHAT THAT ALSO TELLS ME, IS THAT THE COST OF INFRASTRUCTURE IS GOING TO CONTINUE TO GO UP.
AND WE ARE NEVER GOING TO CATCH UP.
WE ARE NEVER GOING TO CATCH UP, AND THAT IS FINE, I THINK WE NEED TO ASK THE VOTER, WE ARE NOT MAKING THIS DECISION ON OUR OWN. THAT IS WHAT CHRISTIAN SAID, WE WANT TO ASK THE VOTER AND HEAR FROM THE VOTER AT WHAT DO THEY WANT TO DO? WE HAVE I THINK A LOTS MORE EXPLAINING AND A LOT MORE INFORMATION TO SHARE IT WITH THE VOTERS. TO GET DOWN TO THE SPECIFICS, AND LET'S MAKE THAT DECISION. AND THAT IS WHY I HAVE BEEN PURSUING THIS. I AM PREPARED TO MAKE A MOTION.
ANY OTHER COMMENTS? I WOULD LIKE TO MOVE TO DIRECT THE OFFICE OF THE COUNTY ATTORNEY, TO PREPARE FOR A CLOSED ONE SAMPLE OF THE GOVERNMENT INFRASTRUCTURAL SURTAX ORDINANCE FOR FIRST READING ON MARCH 1, 2022.
>> SECOND. >> WE HAVE A MOTION IN A SECOND PLEASE VOTE. THAT PASSES 4-1.
[Public Comment ]
THANKS EVERYONE, THAT HAVE WEIGHED IN.WE WILL CONTINUE TO HAVE DISCUSSIONS ON THIS ISSUE THROUGH THIS SPRING AND SUMMER, AS WE FORMULATE THE BEST PLAN.
WITH THAT SAID, I THINK THAT BRINGS US TO PUBLIC COMMENT, GENERAL PUBLIC COMMENT SO WE WILL BEGIN WITH PUBLIC COMMENT.
>> AT THIS TIME THE BOARD WILL HEAR PUBLIC COMMENT ON MATTERS THAT ARE NOT ON THE REGULAR AGENDA.
REGULAR AGENDA ITEMS WILL HAVE THEIR OWN PUBLIC HEARING.
AS YOU HAVE SEEN, ANY PERSON WISHING TO ADDRESS THE BOARD SHOULD COME TO THE PODIUM TO ANSWER THE NAMES AND ADDRESS.
THERE WILL BE PROVIDED 3 MINUTES TO SPEAK AND SHALL COMPLY WITH THE BOARDS DECORUM. THEY SHOULD BE ADDRESSED TO THE BOARD NOT AS A WHOLE AND TO THE INDIVIDUAL COMMISSIONER AND MAY NOT DEMAND AN IMMEDIATE RESPONSE FROM THE BOARD.
THAT PERSON MAY ADDRESS THE BOARD AND MEMBERS OF THE RN SHOULD REFRAIN FROM APPROVAL OR DISAPPROVAL OF ANY COMMENTS.
FINALLY I WOULD ASK THAT ANY SPEAKER THAT PRESENTS ANY OVERHEAD MATERIAL, POLICE PRESENT THAT MATERIAL TO THE STAFF OF THE CLERK OF THE COURT TO BE ENTERED INTO PUBLIC RECORD THANK YOU. YES, SIR?
>> MY NAME IS CRAIG ANSELL I AM THE OFFICER OF EVERYTHING IS POSITIVE BOWL AND OF THE NEW DOG KENNEL.
>> MY DAUGHTER MISTY IS THE OWNER OF THE KENNEL I LIVE AT 133 LAGOON FOREST DRIVE AND MARSHALL LANDINGS.
>> THANK YOU SIR. >> FACT NUMBER ONE ALTHOUGH MISSY AND I TRY TO DO EVERYTHING BY THE BOOK TO TO BUILD A DOG KENNEL IN ST. JOHN'S COUNTY, YOU AND YOUR EMPLOYEES AND TURN US AWAY AT EVERY TURN. YOU COUNTY EMPLOYEE ADAM COMMENTED AND SAID TO WE HAD TO HAVE 5 ACRES.
YOU SAID THE PURCHASE OF 3.78 ACRES WAS NOT ENOUGH.
YOU SAID WE COULD NOT PURCHASE ADJACENT PROPERTY NEXT TO THE PROPERTY WE HAD TO PURCHASE IN ORDER TO GET TO THE 5 ACRES.
FACT NUMBER TWO SIMULTANEOUS WITH OUR EFFORTS, YOU COUNTY EMPLOYEE CASEY KEOUGH, ACTIVELY ASSISTED KATE WAGGONER BY ORCHESTRATING AND LEADING HER THROUGH THE USE OF PROPERTY OF AN INDEPENDENT VETERINARIAN TO BUILD A NEW KENNEL AT ABOUT ONE HALF ACRE. SUBSEQUENTLY WE WERE INFORMED THAT THERE WAS NO EXCEPTION TO THE EXCEPTION ST. JOHN'S LAW.
FOR EXPANSION OF A VETERINARY CLINIC TO KENNEL DOGS.
[02:40:01]
FACT NUMBER THREE, I POINT OUT TO YOU NUMEROUS TIMES HOW SAWGRASS PETS RESORT AND ANIMAL MEDICAL CLINIC AT SAWGRASS VILLAGE WERE COMPLETELY SEPARATE BUSINESSES.FACT NUMBER FOUR, THE EX- MAYOR OF SAINT AUGUSTINE BEACH HAS BUILT A DOG CANDLE MATE NAMED DOG BEACH ON PREVIOUSLY UN- OCCUPIED PROPERTY IN A PLASMA ON A ONE A.
THERE ARE NOT 5 ACRES AS REQUIRED UNDER ST. JOHN'S COUNTY LAWS, NOR IS THIS EXPANSION OF VETERINARY CLINICS.
A NEW SEPARATE BUSINESS VETERINARY CLINIC HAS OPENED ADJACENT TO THE KENNEL. FACT NUMBER FIVE, BOTH SAWGRASS PET RESORT AND DOG BEACH ARE SHAMS WITH THERE IS CONNECTION TO VETERINARY CLINICS NET ALONE EXPANSION OF A VETERINARY CLINIC. NOR EMPORIA'S WERE ACTIVELY PART OF THE SHAM. IN SPEAKING WITH THE NEW VETERINARIAN OPENINGS OR COMBINATION VETERINARY CLINIC AND DOG KENNEL HE INFORMED ME THAT KATE WAGONER OF SAWGRASS PET RESORT IS TRYING TO GET HIM TO JOIN IN A LAWSUIT AGAINST DOG BEACH BECAUSE THE VETERINARY CLINIC NEXT DOOR DOES NOT COMPLY WITH COUNTY LAWS. TALK ABOUT THE COP POT CALLING THE KETTLE BLACK? FACT NUMBER SEVEN THE NEW VETERINARIAN BELIEVES THAT YOUR LAWS MAKE NO SENSE WHY IS IT OKAY FOR VETERINARIAN TO HAVE A DOG KENNEL ON LESS THAN ONE HALF ACRE, OF LAND WHILE REQUIRING A STANDALONE DOG KENNEL TO REQUIRE 5 ACRES? FACT NUMBER EIGHT, MOST OF THESE HAVE ALREADY BEEN COMMUNICATED MULTIPLE TIMES AND YOU HAVE IGNORED THEM. YOU HAVE KEPT YOUR HEADS IN THE SAND. IT IS TIME FOR YOU TO PERFORM A PROPER INVESTIGATION AND TAKE APPROPRIATE ACTION.
MY DAUGHTER AND I HAVE SUFFERED DAMAGES THE END RESULT OF YOUR ACTION TAKE YOU FOR YOUR TIME, I WILL SEE YOU IN TWO WEEKS IF YOU GET CONTINUE TO KEEP YOUR HEAD IN THE SAND.
>> ALL RIGHT THANK YOU, ANYBODY ELSE THAT WOULD LIKE TO MAKE A GENERAL PUBLIC COMMENT? WAIT, THERE SHE IS.
>> I WANT TO TAKE ADVANTAGE OF THIS MOMENT I JUST WANT TO
QUICKLY ASK AND I KNOW YOUR. >> MS. CROSBY.
>> NICOLE'S CROSBY PONTEVEDRA. YOU BEEN ASKED MANY TIMES BEFORE, IT HAS BEEN ABOUT A YEAR END A MONTH SINCE PUBLIC COMMENTS MOVED TO THE END. AND I RESEARCHED ALL ABOUT 12 OR 13 OTHER COUNTIES IN NORTHEAST FLORIDA.
AND NONE OF THEM DO THAT. THIS IS THE OTHER WHEN IT DOES.
AND WHEN IT SPOKE TO PEOPLE ON THE PHONE AT THESE OTHER COUNTIES. THEY WERE QUITE PROUD OF HOW EASY THEY MAKE IT FOR RESIDENTS TO SPEAK AT PUBLIC, EVEN IF THEY CANNOT SPEAK AT THE BEGINNING, THEY WILL SCHEDULE A TIME LIKE HALFWAY THROUGH OR AFTER LUNCH. THEY WILL FIGURE OUT A WAY SO RESIDENTS DON'T HAVE TO SIT FOR HOURS.
BECAUSE IT IS SO HARD TO CALCULATE WENT THE MEETING IS GOING TO BE OVER IT IS DIFFICULT.
SO I ASK YOU AGAIN TO CONSIDER OTHER WAYS OF ALLOWING THE GENERAL COMMENT TO BE MADE, THAT IS MORE CONVENIENT TO PEOPLE.
>> THANK YOU MS. CROSBY ANYBODY ELSE?
>> BJ COLLETTI SAINT AUGUSTINE. IT IS WRONG, DEVELOPERS AND LAWYERS CAN'T CHANGE THE AGENDA ON THE DATE SCHEDULED WENT THE PUBLIC IS NOT NOTICE. THIS HAPPENS AGAIN TODAY ITEM TWO AND THREE. THIS IS THE RIGHT TIME TO DO THE RIGHT THING GENERAL PUBLIC COMMENT SHOULD BE MOVED BACK IF YOU ARE AGENDA ITEM NUMBER ONE. MS. CROSBY, YOU PUT A SMILE ON MY FACE. OTHER PEOPLE DO RESEARCH AND THEY DON'T COME UP WITH THE SAME ANSWER BUT I WAS GLAD TO HEAR THAT AND AGAIN MR. DEAN, I DO APPRECIATE THE SECOND CHANCE EARLIER. THAT MEANT A LOT.
MR. WALDRON, I AM GLAD YOU ARE STILL HERE WITH US.
AND I AM GLAD THAT YOU ARE DOING YOUR HOMEWORK, AND SOMETIMES IT IS HARD AS COMMISSIONERS, AND AS THE PUBLIC, TO STAND ALONE.
WHEN YOU DO THAT YOU ARE GOING FOR THE RIGHT THING JUST KEEP ON STANDING, AND EVENTUALLY, THERE MIGHT BE A CROWD THAT SHOWS UP LIKE MS. CROSBY, AND REPEAT HER SUGGESTIONS.
SO THANK YOU VERY MUCH. >> THANK YOU MS. COLLETTI.
YES, SIR? >> CHUCK WEBB AND ASCII 1748 SAINT AUGUSTINE. I WAS NOT GOING TO SAY ANYTHING BUT A COMMENT THAT WAS MADE A LITTLE WHILE AGO ABOUT THE PARKS AND THEY ARE GOING TO ANOTHER STUDY ON THE PARKS AGAIN? HOW MUCH OF THESE STUDIES COST US?
[02:45:01]
I HAVE SEEN PLANS FOR THE TURNBULL PARK FOR SEPARATE PLANTS, ON THAT PARK. HOW MUCH DOES IT COST TO DO UP AN EXTRA SET OF PLANS EACH TIME? AND THE WORST PART ABOUT IT IS BEING REDUCED. THE ORIGINAL ONE WAS MUCH LARGER THAN THE CURRENT PROPOSAL. I DO NOT KNOW IF THIS IS GONE OUT FOR BID YET FOR THIS PART, I HAVE NOT SEEN THE FINAL LAYOUT FOR THIS PART. BUT TO HAVE A PARKED REDUCED FOR AN AREA THAT IS GROWING SO LARGE, IT DOES NOT MAKE ANY SENSE. AND IT DOES NOT MAKE ANY SENSE[Commissioners’ Reports ]
TO HAVE THIS MANY PLANS DONE. JUST FOR ONE PARK AND HAVE A ANOTHER STUDY PROCESSED THANK YOU.>> THANK YOU MR. LEBEN ASCII WOULD ANYBODY ELSE LIKE TO MAKE COMMENT? ANYBODY ELSE FOR PUBLIC COMMENT SAYING THAT WE WILL CLOSE GENERAL PUBLIC COMMENT.
>> THANK YOU CHRISTMAS BRING HER BACK TO THE BOARD FOR BOARD COMMENTS. TO MR. BLOCKER.
>> NO, SIR. >> COMMISSIONER WALDRON?
>> YES, SIR MR. CHAIRMAN. >> THAT IS A PRETTY THICK
NOTEBOOK. >> YOU KNOW I WOULD HAVE SOMETHING. FIRST OF ALL I WOULD LIKE TO CONGRATULATE GABE PELLETIER AND THE STAFF AT THE END.
THEY WERE DENOMINATED AS THE OUTDOOR VENUE OF THE YEAR.
THE SMALLEST OUT TO A VENUE TO BE NOMINATED FOR THIS AWARD.
SO I WOULD LIKE TO SAY THIS IS FOR THEM.
HOPEFULLY THEY WILL WIN, BUT IT IS GREAT TO KNOW THAT WE HAVE BEEN RECOGNIZED BY THE COUNTRY MUSIC ASSOCIATION.
ALSO, I WOULD LIKE TO BRING TO YOUR ATTENTION WE HAVE ADDED A LOT OF ISSUES WITH DERELICT VOTES.
THIS ONE SLIPPED BY ME BECAUSE I WILL TELL YOU RIGHT NOW I DO NOT READ ALL OF THE BILLS OR THE HOUSE BILLS IN THE STATE.
SENATE BILL NUMBER 1946, WHICH WAS PUT INTO LAW OF JUNE 29.
ALLOWS FOR US TO WORK ON A ORDNANCE FOR US TO HAVE FOR DERELICT VOTES BY IF THEY ARE NEAR ANY FACILITIES, HOMES, COUNTY FACILITIES THAT THEY USE. THE DERELICT VOTES, VOLUSIA COUNTY JUST IMPLEMENTED ONE SO I WOULD LIKE TO SEE IF THE BOARD IS WILLING TO HAVE LEGAL LOOK AT THAT, AND SEE IF WE CAN DO IT.
IF YOU BEEN IN THOSE AREAS ESPECIALLY IN THE WATERWAYS, A LOT OF PEOPLE ARE LIVING ON BOATS, AND A LOT OF DIFFERENT
THINGS GOING ON. >> ASKED THE STAFF TO LOOK INTO
THAT. >> I WOULD ALSO LIKE TO ASK THAT THE ESCAMBIA WALK WAIT THE ONE THAT MR. MULLEN AND I TALKED ABOUT THE ENDED UP EXTENDING IT FARTHER THAN EXPECTED, WE LIKE TO SAY WHAT THE BOARD WHEN THEY DO COME, THEY CAP GOT IT BUILT.
AND PAID FOR BUT THEY ARE SHORT ON THE MONEY THAT THEY PUT IN FOR ESCROW. THEY ARE DOING ANOTHER FUNDRAISER, AND THEY TOLD ME WE WILL SEE WHEN THEY ARE DONE.
AS THE BOARD. ALSO, I DID NOT GET A CHANCE BEFORE, WE'VE HAD A VERY PLEASANT WELL-THOUGHT-OUT YOUNG MAN HERE KING BEDFORD. AND MY DAUGHTER TAUGHT HIM IN MIDDLE SCHOOL. AND SHE TOLD ME WE WATCHED HIM PLAY FOOTBALL, HE IS A BETTER STUDENT AND KID THEN HE IS AN ATHLETE. HE JUST GOT A FULL RIDE TO THE NAVAL ACADEMY. AND A PLACE IN THE NAVAL ACADEMY IS QUITE AN HONOR. THAT IS IT MR. CHAIRMAN.
>> COMMISSIONER? >> I DO NOT HAVE A REPORT BUT I DIDN'T WANT TO ADDRESS THE COMMENT ON THE NORTHWEST PART.
IT IS NOT THE VILLAGES PARK, THAT IS IN YOUR NEIGHBORHOOD, IT IS SOUTH OF GREENBRIAR ROAD. IT IS KIND OF IN THAT CORRIDOR, THAT IS THE PROPOSED PARK JUST TO ANSWER THAT QUESTION FOR YOU.
OTHER THAN THAT I AM FINISHED. >> OKAY SARAH?
>> NOTHING TO REPORT MR. CHAIRMAN.
>> I WILL BE BRIEF, THIS IS NOT SOMETHING THAT I NORMALLY BRING UP. BUT HAS BEEN BOTHER ME THE LAST SEVERAL DAYS. AND IT IS NOT LOCAL AND IS NOT STATE IT IS NOT EVEN NATIONAL. I AM TORN AND DISHEARTENED ABOUT THE POSSIBILITY OF AN INVASION IN ATTACK IN THE UKRAINE.
IT IS ABSOLUTELY IT SERVES ABSOLUTELY NO PURPOSE IN MY MIND OTHER THAN POWER AND GREED. AND I FEEL SO BADLY ABOUT THOSE RESIDENTS. APPROXIMATE 40 MILLION RESIDENTS WHO HAVE DONE NOTHING TO DESERVE AN ATTACK.
[02:50:02]
AND IN TERM I THINK WE ARE HIS MOM SENT A SMALL ELITE GROUP TO TRAIN ON THE GROUND. I COULD NOT WALK AWAY HERE FROM HERE TODAY, WITHOUT
