[1. County Attorney Employment Contract. Staff will provide an overview of the County Attorney negotiation process and agreed upon terms for Board discussion and consideration. ]
FLAG OF THE UNITED STATES OF AMERICA.AND TO THE REPUBLIC FOR WHICH IT STANDS ONE NATION UNDER GOD INDIVISIBLE WITH LIBERTY AND JUSTICE FOR ALL.
>> ALL RIGHT. SO WE ARE HERE ON A SPECIAL AGENDA ITEM OF HIRING THE NEW COUNTY ATTORNEY.
SO LET'S GO AHEAD AND START WITH YOU, (NAME).
>> GOOD MORNING, SARAH TAYLOR FORMER DIRECTOR OF HUMAN RESOURCES AND THE NEW ASSISTANT COUNTY ADMINISTRATOR.
WE ARE HERE TODAY TO REVIEW THE PROPOSED EMPLOYMENT AGREEMENT FOR DAVID (NAME) IS YOUR NEW COUNTY ATTORNEY.
THE CHAIR IS YOUR REPRESENTATIVE AND I MET WITH MR. (NAME) TO THE TERMS OF THE AGREEMENT.
HE TENTATIVELY AGREED T WOULD HAVE BEEN LAID OUT FOR YOU IN TE DRAFT THAT YOU HAVE FOR YOUR COSIDERATION TODAY.
MR. MCGETTIGAN IS HERE TO ANSWER ANY QUESTIONS YOU MAY HAVE. I WILL STANDBY PENDING ANY QUESTIONS OR ANY FACILITATION YOU MIGHT NEED.
MR. (NAME), DO YOU HAVE ANY COMMENTS BEFORE WE START?
>> GOOD MORNING, MR. CHAIR AND THE MEMBERS OF THE BOARD.
I JUST WANTED TO TAKE A QUICK MOMENT TO THANK YOU FOR CHOOSING ME FOR THIS POSITION. I'VE ENJOYED DISCUSSING IT WITH EACH OF YOU. I LOOK FORWARD TO WORKING WITH EACH OF YOU AND WOULD BE HAPPY TO ANSWER ANY QUESTIONS TODAY AS WE DISCUSSED THIS PROPOSED APPOINTMENT AGREEMENT.
>> THANK YOU. EVERYONE'S AN AGREEMENT?ALL RIGHT. SO WHERE DO WE NEED TO START? YOU WOULD MENTION TO ME WHEN YOU CAME UP THERE WERE FEW
THINGS WE NEEDED TO WORK OUT? >> YOU KNOW, I MET ONE ON ONE WITH SOME OF THE BOARD MEMBERS. THERE WERE SOME CONCERNS.
THE ONE CONCERN I HEARD A COUPLE OF TIMES SO I WOULD LIKE TO RAISE IT AND CHANGE IT IF IT'S THE BOARD'S DESIRE IS DURING THE NEGOTIATION PROCESS WITH THE CHAIR AND THE HR DIRECTOR, WE DISCUSSED A LOT OF THINGS.
I THOUGHT IT WAS A VERY PRODUCTIVE SESSION.
ONE OF THE THINGS THAT CAME UP AS WE WOUND UP CHANGING THE ANNUAL LEAVE NUMBER 230 DAYS. I KNOW THAT SOMETHING THAT MIGHT NOT HAVE BEEN SEEN IN OTHER CONTRACTS IN THE PAST.
AND THERE MAY BE ISSUES WITH THAT.
I'M WILLING TO GO BACK DOWN TO 20 DAYS WHICH WAS IN THE COUNTY'S FIRST DRAFT. THE ONE THING WAS IN MY FIRST DRAFT WHICH IS WHERE I THINK THAT 30 NUMBER CAME FROM.
IT IS DUE TO PRE-EXISTING PLANS I HAD THIS COMING MARCH, I HAD ASKED TO HAVE 10 DATES BANK. SO ESSENTIALLY I WOULD START EMPLOYMENT WITH 10 VACATION DAYS CREDITED INSTEAD OF SLOWLY STARTING TO ACCRUE. SO I WOULD WANT TO SEE IF THE BOARD WOULD BE AMENABLE TO CHANGING THAT LANGUAGE FROM INSTEAD OF 30 DAYS A YEAR, IT WOULD READ -- THE COUNTY ATTORNEY SHALL BE CREDITED WITH 10 WORKING DAYS ACCRUED VACATION UPON EFFECTIVE DATE AND SHALL THEREAFTER ACCRUE 20 WORKING DAYS PER YEAR. THAT WOULD JUST GIVE ME AN INITIAL EXTRA AMOUNT OF VACATION FOR A LIFETIME TRIP I HAD PLANNED BEFORE I EVEN KNEW I WAS APPLYING FOR THIS JOB.
SO I COULD STILL TAKE THAT THIS COMING MARCH.
AFTER THAT, IT WOULD BE THE 20 DAYS A YEAR.
[00:05:05]
SO THAT'S A CHANGE I'M WILLING TO MAKE.I'LL GLADLY DISCUSS IT WITH ANY OF YOU ALL OR ANSWER ANY QUESTIONS. BUT THAT'S SOMETHING I CAME UP
WITH BASED ON DISCUSSIONS. >> SURE.
I THINK IT MIGHT BE HELPFUL TO ALIGN THE BOARD AND HOW WE CAME TO THAT. MR. (NAME) HAS SCHOOL-AGED CHILDREN. OBVIOUSLY, THINGS COME UP.
SO I WANTED TO MAKE SURE HE HAD THE TIME TO BE EFFECTIVE ON THE JOB. SO IT MADE SENSE TO ME TO PUT OUT THERE 30 DAYS. BUT AGAIN, WE CAN CHANGE IT IF
YOU WANT TO GO BACK TO 20. P>> I'M OKAY WITH THAT CHANGE.
>> (INDISCERNIBLE) CREDITED FOR 10 DAYS ON VACATION LEAVE.
I'LL MOVE THAT. AND THEREAFTER, 21 DAYS.
-- TOLD DAYS. (INDISCERNIBLE).
>> MR. SMITH, DO YOU AGREE? WE HAVE A MOTION BY -- DO WE
NEED TO PUT THIS IN A MOTION? >> I THINK YOU CAN.
AT SOME POINT BEFORE THE BOARD ADOPTS THE CONTRACT, AND ALLOW FOR PUBLIC COMMENT. THAT COULD BE -- COMMISSIONER DEAN, IS THAT AN AMENDMENT ALONG THE WAY?R IS THAT APPROVE THE CONTRACT WITH THAT AMENDMENT? LEX MY MOTION WAS TO (INDISCERNIBLE) THAT AMENDMENT.
BUT I WOULD MOVE THAT CONTRACT WITH THE AMENDMENT INCLUDED.
LET ME STATE IT AGAIN MORE SPECIFICALLY, I'D ASK EITHER
SARAH OR YOU TO -- >> WOULD IT MADE SENSE IF WE WENT THROUGH -- IS THERE ANYTHING ELSE WE NEED TO DISCUSS?> I'LL LEAVE THAT UP TO THE BOARD.
I HAD DISCUSSIONS AND I THINK THE BOARD MEMBERS WERE SATISFIED WITH OUR DISCUSSIONS. BUT OF COURSE, IF ANYBODY HAS ANY CONCERNS OR QUESTIONS I'LL GLADLY ANSWER THEM.
>> ARE THERE ANY OTHER ISSUES OR MATTERS ABOUT THE CONTRACT (INDISCERNIBLE) SO WE CAN CHANGE IT? I'LL START WITH YOU, COMMISSIONER WHITEHURST.
>> I HAD A MEETING YESTERDAY AND HE ADDRESSED ANY CONCERNS I HAD. I DON'T HAVE ANY AT THIS TIME.
>> OKAY. COMMISSIONER WALDRON?
>> YEAH, I'M FINE RIGHT NOW. I LIKE TO HEAR WHAT OTHER
COMMISSIONERS HAVE TO SAY. >> COMMISSIONER DEAN.
>> I HEARD HE STATED I WANTED TO MOVE.
>> COMMISSIONER SMITH. >> HAVE A QUESTION FOR YOU, MR. CHAIRMAN. YOU ARE ABOARD LIAISON.
IS THERE ANYTHING YOU WOULD LIKE TO (INDISCERNIBLE) ? IS THERE ANYTHING SPECIFIC THAT YOU DISCUSSED ANY CONCESSIONS OR COMPROMISES MADE OR DISCUSSED
>> WE DID DISCUSS THE SALARY AND THE BASE FOR THAT.
THERE WAS SOME DISCUSSION ABOUT THAT SPECIFICALLY BASED ON MY RECOLLECTION. ALSO THE VACATION DAYS.
MY REASONING IS THAT MR. (NAME) HAD SOME PRE-EXISTING VACATION PLANS. AND ALSO HAVING SCHOOL-AGED CHILDREN I UNDERSTOOD THE CHALLENGES THAT CAN COME WITH THAT. HE AND HIS WIFE BOTH WORK.
AND THERE MAY BE DAYS WHEN HIS DAUGHTER NEEDS ONE OF THE PARENTS TO BE PRESENT. SO THAT'S THE FACTOR THAT WENT INTO THAT. OTHER THAN THAT, I CAN'T THINK OF ANYTHING SPECIFICALLY THAT CAME UP.
I THINK THOSE WERE THE TWO REALLY.
THE SALARY AND THE VACATION DAYS.
IS THAT CORRECT? >> THAT'S MY RECOLLECTION AS WELL.E DID DISCUSS QUITE A FEW THINGS.
BUT I THINK THOSE WERE THE TWO PREDOMINANT ISSUES.
>> THOSE ARE THE ONLY TWO MY --.
YES, SIR? >> MR. CHAIR AND COMMISSIONERS AND MR. (NAME). I THINK THE ONE THING FOR SARAH TAYLOR, RIGHT AT THE FIRST PARAGRAPH OF THE PROPOSED CONTRACT, BASICALLY MADE AND ENTERED INTO THIS DAY, MONTH, YEAR. THAT WOULD BE TODAY.
BUT THE START DATE -- IS THAT DETAILED OUT? OR DOES THAT NEED TO BE FILLED IN?
>> NO. WE WOULD NEED TO GET THAT INFORMATION AND FINALIZE IT TODAY AS FAR AS THE START DATE.
>> RIGHT. I KNOW THAT THE CHAIR AND MR. MAKE IT HAD TALKED ABOUT A DATE.
IN OTHER WORDS, THAT PROBABLY OUGHT TO BE PART OF THE APPROVAL -- THE START DATE, ETC.?
>> HER. I WANT TO MAKE SURE HE HAS AS MUCH TIME AS POSSIBLE TO MEET WITH MR. MCCORMICK.
WE HAVE A NUMBER OF ISSUES THAT ARE COMING UP.
WE HAVEREDISTRICTING. WE HAVE SEVERAL LAWSUITS.
[00:10:09]
WE HAVE A (INDISCERNIBLE) SITUATION AS WELL.SO WE HAVE A LOT OF TIME SENSITIVE LEGAL MATTERS.E ARE ALSO GOING INTO THE HOLIDAYS AS WELL.
SO WE WILL BE TAKING LEAVE. WE WON'T HAVE FULL STAFF BECAUSE PEOPLE ARE TAKING VACATION LEAVE.
SO WHAT'S IMPORTANT TO ME IS GETTING YOU IN AS QUICKLY AS POSSIBLE. WE ALSO WANT YOU TO HAVE OPPORTUNITY TO GIVE NOTICE TO YOUR JOB.
>> MY JOB IS AWARE. BUT I HAVE NOT YET GIVEN TWO WEEKS NOTICE BECAUSE I DON'T HAVE AN EMPLOYEE CONTRACT YET.
SO I WAS WAITING ON THAT. MY INTENTION WOULD BE, AFTER DISCUSSIONS, IF THIS IS APPROVED THIS MORNING, I'M GOING TO PUT IN MY TWO WEEKS NOTICE TODAY.
WITH MY LAST CURRENT EMPLOYMENT BEING TUESDAY, NOVEMBER 9. I WOULD BE WILLING TO START WEDNESDAY, NOVEMBER 10 HERE.
THERE MAY BE A FEW HOURS HERE AND THERE OVER THE FIRST TWO WEEKS WHERE I'VE PRE-EXISTING COMMITMENTS.
JUST AN HOUR OR TWO HERE OR THERE.
BUT I THINK IT'S BETTER FOR ME TO GET IN HERE, RATHER THAN TAKE A FEW WEEKS OFF. BECAUSE OF A FEW APPOINTMENTS HERE AND THERE. FOR THE REASONS YOU JUST SAID, MR. CHAIR. THE AVAILABLE TIME WITH MR. MCCORMICK TO LEARN FROM HIM AND WORK WITH HIM.
THE UPCOMING HOLIDAYS AND SOME STAFF MAY BE OUT OF THE OFFICE.
SO THE MORE TIME I CAN BE HERE, THE BETTER.
BASED ON THAT AND TO GET BACK TO BUT PATRICK FIRST BROUGHT UP, THERE IS A BLANKET IN THE CONTRACT FOR THE EFFECTIVE DATE. SO I WOULD PROPOSE THAT WE WOULD PUT NOVEMBER 10, 2021 ON THAT BLANK IN PARAGRAPH THREE.
EXCUSE ME, ARTICLE 3. AND I WOULD PLAN TO START WEDNESDAY, NOVEMBER 10. WHICH, I THINK IS THE FIRST DAY
I COULD CONCEIVABLY START HERE. >> COMMISSIONER WALDRON, IS
>> OKAY. COMMISSIONER WHITEHURST?> OKAY. THAT WORKS.
>> OKAY. I THINK ONE OF THE IMPORTANT THINGS IS IS YOU HAVE TO GET INTO MEET WITH THE ATTORNEYS AND STAFF. IT'S LIKE COLLEGE FOOTBALL RECRUITING. YOU HAVE TO SELL THEM ON YOUR LEADERSHIP AND MANAGEMENT STYLE.
SO I HAVE CONFIDENCE YOU WILL GET IN THERE AND DO THAT.
I THINK OTHER THAN THE DATES OF STARTING, IS THERE ANYTHING ELSE AS FAR AS MR. (NAME) HIS CONTRACT AND IMPROVING IT? IS THERE ANYTHING WE NEED TO DISCUSS?
>> I HAVE NOTHING FURTHER. >> OKAY.
DO WE HAVE ANYTHING FROM THE BOARD?OKAY.
IT'S QUIET MORNING. COMMISSIONER WALDRON .
SO WE HAVE A MOTION BY COMMISSIONER DEAN WITH AN
AMENDED MODIFICATION.>> (INDISCERNIBLE).
LET ME MAKE THE MOTION. I WOULD MOVE THAT WE APPROVE THE EMPLOYMENT CONTRACT OF DAVID MAKE IT SUBJECT TO AN AMENDMENT WHICH PROVIDES 10 DAYS OF ADDITIONAL LEAVE NOW.
THEN THEREAFTER 21 DAYS ANNUALLY.
AND THAT THE START DATE WOULD BE NOVEMBER 10, 2021.
I THINK THAT COVERS IT. >> I WANT TO MAKE SURE COMMISSIONER DEAN IS AT (INDISCERNIBLE) -- I WANT TO MAKE SURE WE ARE GETTING THE CORRECT MOTION INTO THE RECORD.
IT'S 20 DAYS? >> WELL -- 20 -- HE GETS CREDITED -- AS I UNDERSTAND, THE REQUEST I AGREED WITH IS HE'S ASKING FOR 10 DAYS OF ADDITIONAL LEAVE ADDED TO HIS
>> BUT THEREAFTER, STARTING IN THE NEXT FISCAL YEAR, I PRESUME
-- IS THAT RIGHT? >> NO, SIR,.
IT WOULD START AT THE DATE OF HIS EMPLOYMENT CONTRACT NOVEMBER 10 THAT HE WOULD ACCRUE THE MAXIMUM OF 20 DAYS.
10 DAYS WOULD BE CREDITED. >> I'LL SECOND THAT.
>> OKAY. WE HAVE A MOTION BY COMMISSIONER DEAN AND A SECOND BY COMMISSIONER WHITEHURST.
WHEN WE OPEN UP FOR PUBLIC COMMENT?
>> ALL RIGHT. I'LL TAKE THE PUBLIC COMMENT ON THE MOTION. PUBLIC COMMENT?I SEE NONE.
>> OKAY. THANK YOU, MR. VICE CHAIR.
PUBLIC COMMENT NOW CLOSE IN THIS MATTER.
WAS THERE ANY FURTHER DISCUSSION?
COMMISSIONER WALDRON? >> I'M SORRY --.
>> OKAY. NO FURTHER DISCUSSION? WE'LL GO WITH A VOICE VOTE.
