HAPPY TO ANSWER QUESTIONS INVOLVING SCHOOL SAFETY AND

EMERGENCY PREPAREDNESS. >> OKAY.

THANK YOU, ANY QUESTIONS? THANK YOU, SIR.

>> YES, SIR. >> GOOD MORNING, CHAIRMAN, COMMISSIONERS. I WANTED TO PROVIDE AN UPDATE ON STATISTICS WE ARE SEEING FROM COVID-19.

SOME OF THE THINGS DIFFERENT FROM WHERE I WAS HERE.

WE HAD DAILY NUMBERS. SOME OF THAT COMBINED MORE OF A WEEKLY STATUS. SO I WANTED TO START OFF BY SAYING LAST WEEK ENDING FRIDAY, WE HAD 1615 NEW CASES THAT WEEK.

HIGHEST AMOUNT OF CASES PRIOR TO THAT DATE JANUARY OF THIS YEAR 1631. WE ARE SEEING A SPIKE UPTICK OF POSITIVE CASES IN THE COUNTY. COMMUNICATING WITH AREA HOSPITALS AND WHAT WE CAN DO TO ASSIST THEM.

THEY ARE ENACTING PLANS. THEY HAVE NOT ASKED US FOR ANYTHING SPECIFIC. THERMANAGEING.

THEY ARE SEEING VERY HIGH INCREASE.

THEY HAVE NOT REACHED OUT AND SAID THEY ARE AT CAPACITY BUT THEY ARE SEEING THAT SURGE. FLAGLER HOSPITAL HAD 98 PATIENTS WITH COVID. HIGHEST FROM JANUARY, AROUND 50.

THEY ARE SEEING QUITE A FEW MORE PATIENTS.

THEY ARE NOT REQUESTING VENTILATORS WE WERE SEEING AT THE BEGINNING OF THE PANDEMIC. THEY HAVE RESOURCES.

AGAIN WE ARE STANDING BY AND WATCHING.

COMMUNICATING WITH THEM. 153,000 RESIDENTS IN THE COUNTY THAT HAVE BEEN FULLY VACCINATED. 65% VACCINATION RATE.

THAT IS REALLY GOOD. WE ARE HIGH IN THE STATE.

I WANTED TO THROW THAT OUT THERE TO MAKE SURE EVERYBODY UNDERSTANDS. WE AT THE EOC GETTING QUESTIONS ON TESTING. WE DON'T SEE ISSUE IN SUPPLY.

MORE OF A CAPACITY ISSUE WITH TESTING.

WHERE PEOPLE ARE WAITING ONE-TWO DAYS TO GET TESTED.

WE ARE NOT SEEING OUR PHONE VOLUME INCREASE DRAMATICALLY BUT GETTING A HANDSFUL OF QUESTIONS TO GET TESTING, IS THE COUNTY OFFERING TESTING? THINGS LIKE THAT WE ARE GETTING ASKED. I WANTED TO PUT UP ON THE OVERHEAD JUST -- THIS IS ALSO ON OUR WEBSITE.

WE CAN PROVIDE IT TO OTHER ENTITIES.

THESE ARE AREAS YOU CAN GET TESTED WITHIN THE COUNTY.

THEIR NUMBERS AND LOCATIONS. IF RESIDENTS CALL EOC THIS IS WHAT WE ARE PASSING TO THEM, THEY CAN GET TESTED.

WITH THAT I HAVE CHIEF AND OTHER STAFF IF YOU HAVE QUESTIONS.

>> ANYONE FROM FLAGLER HOSPITAL THAT CAN SPEAK WITH US TODAY?

THEY REACHED OUT LAST WEEK. >> WE ARE IN CONSTANT COMMUNICATION WITH FLAGLER AND AREA HOSPITALS.

>> OKAY. GREAT, THANK YOU.

>> BEFORE WE GO, CHIEF, LET'S GO TO COMMISSIONER DEAN FIRST.

>> COUPLE OF QUESTIONS, OVERHEAD HERE, I WANT TO BE CLEAR I AM

[00:10:04]

LOOKING AT ANYONE IN OUR COUNTY WHO DESIRES TO BE TESTED CAN GO TO ONE OF THESE SITES IT IS FREE.

>> THEY MIGHT HAVE A COPAY OR SYSTEM IN PLACE.

I KNOW THE FEDERAL GOVERNMENT HAS SOME KIND OF A PLAN WITH SOME OF THESE FACILITIES. I DON'T BELIEVE THEY ARE FREE.

>> IF ONE DESARS TO -- DESIRES TO GET TESTED THEY CAN GO TO ONE

OF THESE SITES. >> CORRECT.

>> I WOULD LIKE TO MAKE ONE COMMENT ABOUT FOR THOSE THAT MAYBE HERE IN THE AUDIENCE AND WATCHING ON PUBLIC TV, I HAVE SEEN A LOT OF NEWS ARTICLES, A LOT OF NEWS REPORTS ON TV AND SOCIAL MEDIA COMMENTS INVOLVING WHOLE ISSUE OF STUDENTS AND GOING BACK TO SCHOOL AND WHOLE ISSUE OF VACCINATIONS AND WHATNOT. I WANT EVERYONE THAT MAY NOT BE AWARE, I THINK MOST PEOPLE ARE, THAT WHOLE ISSUE THAT STATEWIDE IF NOT NATIONALLY, ISSUES TO BE RESOLVED BASICALLY EXCLUSIVELY BY SCHOOL BOARD MEMBERS. I HAVE GOTTEN E-MAIL REQUESTS.

UNLESS SOMEONE TELLS ME OTHERWISE ISSUES DEALT WITH BY INDEPENDENTLY ELECTED SCHOOL BOARD MEMBERS, I THINK ARE DOING A FANTASTIC JOB, BY THE WAY, ALSO WITH OVERSIGHT FROM THE STATE LEGISLATURE AND GOVERNOR DEALING WITH FUNDING ISSUES.

I WANTED TO BE CLEAR THAT ISSUE IS BEING DEALT WITH BY A SEPARATE WARD OTHER THAN US ON STUDENT ISSUES AND VACCINATIONS.

ON VACCINATIONS, I WANT TO SAY AS ONE COMMISSIONER, I WOULD STRONGLY ENCOURAGE ANYONE LISTENING TO MY VOICE IF YOU HAVE NOT GOTTEN VACCINATED UNLESS YOU HAVE A REASON WHETHER OR NOT IT IS MEDICAL, RELIGIOUS OR ANOTHER REASON NOT TO GET VACC VACCINATED, I WANT TO URGE EVERYONE TO GET VACCINATED. THE NUMBER YOU GAVE US, IS THAT

BOTH SHOTS? >> CORRECT.

WE ARE SEEING UPTICK IN VACCINES, OVER 4,000 RESIDENTS

LAST WEEK GET VACCINATED. >> THOSE THAT HAVEN'T, IT WOULD BE GOOD IF EVERYONE COULD GET VACCINATED.

I DON'T THINK ANY OF US KNOW WHERE THIS SCENARIO IS GOING TO END NATIONWIDE AND CERTAINLY IN THIS STATE.

FLORIDA IS -- THIS IS NOT A NO. 1 I AM PROUD OF AS A STATE.

I THINK WE NEED TO GET A HANDLE ON THIS AS QUICKLY AS POSSIBLE.

BEST WAY TO DO THAT GET VACCINATED.

GOVERNOR HAS MADE THAT CLEAR, TOO.

THOSE ARE MY COMMENTS. COMMISSIONER WHITEHURST?

>> THANK YOU, I WANT TO FOLLOW UP ON COMMISSIONER DEAN'S COMMENTS. GOVERNOR HAS DONE AN EMERGENCY ORDER PERTAINING TO 21-175 INSURING PARENTS FREEDOM TO CHOOSE MASKS IN SCHOOLS SORT OF THE SUBTITLE OF THAT ORDER.

ANY LISTENING AUDIENCE WOULD CARE TO LOOK THAT UP, COMMISSIONER DEAN IS ABSOLUTELY CORRECT.

THIS BOARD CANNOT MANDATE SOMETHING ON THE SCHOOL BOARD OR STUDENTS PERTAINING TO THAT ISSUE, THANK YOU.

>> THANK YOU COMMISSIONER. COMMISSIONER WHITEHURST?

>> THANK YOU MR. CHAIRMAN DO WE HAVE SPECIFIC DATA OF DELTA VARIANT AND PEOPLE THAT HAVE HAD COVID BEFORE?

>> I DON'T HAVE THE EXACT NMBERS.

WHAT WE ARE HEARING OVER 90% IN THE HOSPITAL THAT HAVE ATTRACTED COVID UNVACCINATED. I DON'T HAVE SPECIFIC NUMBER OF PEOPLE WITH DELTA VARIANT. THAT NUMBER SHOWS YOU WHERE THE VACCINE IS HELPING VS. ATTRACTING THE VIRUS.

>> OKAY. I HAVE MY ATTENTION DIRECTED TO AN ARTICLE WRITTEN BY NPR BASED ON OUTBREAK IN PROVINCETOWN,

[00:15:06]

MASSACHUSETTS 469 CASES STUDY BASED ON, 75% OF CASES WERE PRESENT AND FULLY VACCINATED PEOPLE.

IS THAT CONSISTENT, NOT THE HOSPITALIZATIONS.

I UNDERSTAND THOSE ARE HIGHER BY THOSE NOT VACCINATED.

BUT 75% OF THE CASES IN THIS STUDY FROM THE CDC WERE PRESENT

IN PEOPLE FULLY VACCINATED. >> I DON'T HAVE SPECIFIC DATA FROM THIS COMMUNITY. I CAN TRY TO GRET GET THAT.

>> THIS ARTICLE PUBLISHED JULY 30TH.

MOST UP TO DATE INFORMATION FROM CDC.

PROVINCETOWN, MASSACHUSETTS. THOUGHT IT WAS SIGNIFICANT.

I THINK THERE IS A FEELING IF YOU ARE VACCINATED YOU CANNOT CONTRACT OR TRANSMIT THE VIRUS. THIS STUDY SPECIFICALLY SAYS THERE ARE NO SIGNIFICANT DIFFERENCES IN THE VIRAL LOADS PRESENT IN THOSE VACCINATED AND THOSE UNVACCINATED.

REASON VIRAL LOADS ARE IMPORTANT TO NOTE, HIGH VIRAL LOAD MAKES ITS EASIER TO TRANSMIT THE VIRUS.

THIS STUDY SAYS VIRAL LOADS -- I WANT TO MAKE SURE WE ARE GIVING THE PUBLIC MOST ACCURATE INFORMATION POSSIBLE SO PEOPLE AREN'T ASSUMING THEY ARE SAFE WHEN IN FACT THEY MAY NOT BE.

>> YES, SIR. I WOULD SAY I WOULD HAVE TO GET A MEDICAL DOCTOR TO ANSWER THOSE SPECIFIC QUESTIONS.

I CAN ONLY LOOK AT STATISTICS HANDED IN FRONT OF ME.

>> OKAY. THOUGHT IT WAS WORTH MENTIONNG.

I KNOW WE ARE GETTING A COVID UPDATE AND KNOW YOU ARE NOT A MEDICAL DOCTOR PERHAPS WOULD BE WORTH CHASING DOWN.

>> SEE WHAT I CAN COME UP WITH. >> THANK YOU.

>> OKAY. ANY OTHER QUESTIONS?

ALL RIGHT THANK YOU, CHIEF. >> GOOD MORNING.

I WANTED TO FOLLOW UP IF WE ARE GOING TO TALK ABOUT COVID, DEPARTMENT INTERNALLY WITH FIRE RESCUE.

CERTAINLY OUR CALL VOLUME INCREASED LAST COUPLE OF WEEKS DUE TO THIS INCREASE INTERNALLY FINE.

REALLY GOOD CREW. WE HAVE IN THE NEIGHBORHOOD 10-12 QUARANTINED OR OUT POSITIVE.

WE HAVE A STAFF OF 300. WE ARE DOING WELL IN THAT STANDPOINT. I AM HERE TO ANSWER ANY QUESTIONS ON FIRE RESCUE. THANK YOU CHIEF.

[Consent Agenda]

ANY OTHER QUESTIONS? THANK YOU GENTLEMAN.

>> OKAY AT THIS POINT MOVE INTO DELETIONS COMMISSIONER

WHITEHURST? >> NONE.

>> COMMISSIONER WALDRON? >> NO.

>> COMMISSIONER DEAN? >> NONE.

>> COMMISSIONER SMITH? >> NO.

>> WHY DON'T WE MOVE TO PUBLIC COMMENT SPECIFICALLY FOR CONSENT

AGENDA. >> PUBLIC COMMENT ON CONSENT AGENDA ONLY. ANY PUBLIC COMMENT?

SEEING NONE. >> MR. CHAIRMAN?

>> BEFORE THE BOARD VOTES ON THE CONSENT AGENDA, I THINK ADMIN SENT OUT A NOTE CONSENT NO. 17 I WOULD LIKE TO PROVIDE CLARIFICATION TO THAT. DOESN'T CHANGE BUSINESS DEAL OF IT. APPARENTLY THERE WAS NOT FULLY ACCURATE LANGUAGE IN THE TITLE IN THE FIRST WHEREAS.

IF THE BOARD WILL ALLOW, I WOULD LIKE TO READ THAT AND BOARD CONSIDER ACCEPTING. CONSENT ITEM 17, AUTHORIZING COUNTY ADMINISTRATOR TOWARD 21-14R BISHOP STATES SIGNING 441220-1-58-01 TO TRAFFIC CONTROL PRODUCTS OF FLORIDA INK LOWEST RESPONSIBLE BIDDER AND TO EXECUTE AGREEMENT FOR COMPLETION OF THE WORK. FIRST WHEREAS.

WHEREAS THE COUNTY IS MOVING FORWARD WITH SIGNING IMPROVEMENTS, WHERE THE SCOPE OF WORK FOR THE PROJECT INCLUDES PROVISION OF ANY AND ALL LABOR, MATERIALS AND EQUIPMENT REQUIRED TO CONSTRUCT THE SIGNING IMPROVEMENTS FROM SAN JOSE TO RACETRACK. ST. JOHN'S COUNTY IN ACCORDANCE

[00:20:03]

WITH THE BID. IN OTHER WORDS THIS CLARIFIES RESOLUTION IS IN LINE WITH THE DOCUMENTS.

IF THE BOARD WOULD ACCEPT THAT, THANK YOU.

>> OKAY. THANK YOU.

COMMISSIONER DEAN? >> I'LL MOVE CONSENT AGENDA AS AMENDED BY THE LANGUAGE THE COUNTY ATTORNEY READ INTO THE RECORD REVISING ITEM 17 ON CONSENT AGENDA.

>> SECOND. >> MOTION BY COMMISSIONER DEAN.

SECOND BY COMMISSIONER WALDRON. ALL THOSE IN FAVOR.

>> WE RECEIVED A RED FOLDER ITEM FOR SHUTTERS AGREEMENT.

I WOULD LIKE TO MOVE 1A. DUE TODAY.

NEED TO GET IT OUT. >> OKAY.

SECOND BY DEAN. ALL IN FAVOR.

>> AYE. >> PASSES.

THAT WILL BE AGENDA ITEM 1. ALL RIGHT WE'LL GO INTO THAT AGENDA ITEM NOW. GOOD MORNING.

>> I APPRECIATE THAT. THIS IS ACTUALLY DUE TODAY.

SO. WE HAVE CHRIS CULL PEPPER.

IT IS THE REASON WHY WE ARE TALKING TO YOU TODAY WE ARE SEEKING APPROVAL TO ACCEPT SHUTTER VENUE OPERATOR GRANT BY THIS SMALL BUSINESS ADMINISTRATION.

I DO HAVE A POWERPOINT. FOUND OUT ABOUT THIS LAST TUESDAY. WE DIDN'T GET A CHANCE TO GET IT IN FRONT OF THE AGENDA. SUPER EXCITING FOR US.

FEBRUARY 16TH, WE CAME FRONT OF THE BOARD LET YOU KNOW WE ARE ELIGIBLE FOR THE GRANT TO GIVE YOU INTENTION OF THIS GRANT TO REIMBURSE LOSS REVENUE MANDATED TO STOP THEIR OPERATION BECAUSE OF THE SPREAD OF COVID. APRIL 26TH, WE SUBMITTED THE APPLICATION. RIGHT AFTER WE SUBMITTED, BEFORE WE SUBMITTED THE APPLICATION, SBA CHANGED THEIR BENCHMARK QUALIFICATIONS MAKING US, WE WERE TOP PRIORITY, MADE US LAST BECAUSE WE WERE IN GOVERNMENT, IF THERE IS ANY FUNDS AVAILABLE AFTERWARDS, WE'LL CONSIDER IT. IT WAS ABSOLUTELY DEVASTATING.

CHRIS PUSHED THROUGH. WE DECIDED WE WERE GOING TO SUBMIT THE GRANT AND PUT IN THE EXTRA EFFORT, WORTH THE CHANCE.

HAPPY TO INFORM YOU JULY 27TH, LAST TUESDAY NOTICED FOR AWARD OF $5,984,564. YOU CAN MOVE TO THE NEXT SLIDE.

JUST TO GIVE YOU DETAIL OF THE GRANT, IT WORKS SIMILAR TO THE CARES. REIMBURSEMENT.

NON-MATCHING GRANT. SERIES OF ITEMS IN WHICH WE ARE ELIGIBLE. PAYROLL, RENT AND UTILITIES, DEBT PAYMENTS, WORKER PROTECTION, CONTRACTUAL SERVICES, ADMINISTRATIVE COSTS, OPERATING LEASES, INSURANCE.

SPECIFIC SHOW-RELATED EXPENSES THAT QUALIFY AND ADDITIONAL BUSINESS EXPENSES. WE ESTIMATE REIMBURSEMENT 2020-FROM LAST YEAR FROM THE START 2$2,790,000.

IT IS GOING TO ALLOW US TO COVER A LOT OF EXPENSES MOVING FORWARD. WE DIDN'T KNOW IF WE WERE GOING TO GET THE GRANT. PLEASANT SURPRISE FOR US.

[00:25:01]

IT IS NOT DONE THERE. WE ARE -- CAN YOU GO TO THE NEXT SLIDE? WE ARE ELIGIBLE FOR SUPPLEMENTAL GRANT HALF THE AMOUNT OF THE INITIAL WARD $2,992,284.

AT THE SAME TIME WE WANT TO ASK TO APPLY FOR THE GRANT.

FULLY ANTICIPATING TO BE A SHORT TURN AROUND LIKE THIS ONE, THEY GAVE US SEVEN-DAYS NOTICE. WE'LL DEAL WITH THAT LATER.

WE ARE CONFIDENT. CHRIS IS EXCITED.

WHEN YOU GET TO THE POINT YOUR REVENUE HAS GONE DOWN TO THE POINT YOU HAVE TO PAY ATTENTION TO PROGRAMMING, MAKES YOU ADJUST A PROGRAM. WE SHOULD BE ABLE TO HAVE A NICE APPROACH. THAT IS IT.

YOU GUYS HAVE ANY QUESTIONS? >> ANY QUESTIONS? LET ME SAY GREAT STAFF WORK. APPRECIATE YOU BRINGING THIS TO OUR ATTENTION. LET'S MOVE TO PUBLIC COMMENT

FIRST. >> TAKE PUBLIC COMMENT ON THIS ITEM PUBLIC COMMENT ON ACCEPT TENSE OF THIS SHUTTER GRANT? SEEING NONE, CHAIRMAN BACK TO YOU.

>> THANK YOU MR. VICE CHAIR. CLOSE THIS MOTION.

>> MOVE ACCEPTANCE OF THE GRANT. >> IS THERE A SECOND?

>> SECOND. NEED TO READ IT OUT?

>> I WOULD. ALSO INCLUDES APPLYING FOR THE

OTHER GRANT. >> COMMISSIONER DEAN, WOULD YOU

MIND READING IT. >> MOVE TO SHUTTERED VENUE OPERATOR'S GRANT $5,984,568. AUTHORIZING CHAIR OR COUNTY ADMINISTRATOR TO EXECUTE NOTICE OF AWARD AND APPLY FOR SBOG

SUPPLEMENTAL GRANT. >> SECOND.

>> WE HAVE A MOTION BY COMMISSIONER DEAN.

SECONDS BY COMMISSIONER WALDRON. FURTHER DISCUSSION?

>> PLEASE VOTE. PASSES.

5-0. >> CAN I MAKE A COMMENT?

>> YES, SIR. >> I KNOW ALL OF US AS COMMISSIONERS KNOW WHAT AN OUTSTANDING FABULOUS JOB GABE AND STAFF HAVE DONE DURING COVID YEAR TAKING A LOT OF WORK DEALING WITH REOPENING, SANITIZING.

LONG LIST OF THINGS HE HAD TO DEAL WITH.

I WANT TO EXPRESS MY APPRECIATION TO GABE AND HIS STAFF. IT HAS BEEN QUITE A JOURNEY.

REALLY COME THROUGH WITH SHINING COLORS.

WE HAVE A FULL, I GUESS AGENDA OF DIFFERENT GROUPS COMING.

DIFFERENT ARTISTS SCHEDULED FOR REMAINDER OF THIS YEAR, GABE,

GREAT JOB. >> THANK YOU COMMISSIONER DEAN.

NOW WE ARE MOVING INTO AGENDA ITEM 1 BRAVO.

2021-001. GOOD MORNING.

>> WE ARE GOING TO QUASI-JUDICIAL NOTIFICATIONS, COMPLETE COMMISSIONER WHITEHURST.

>> THANK YOU I MET WITH ELLEN AVERY-SMITH TO DISCUSS DRI.

ANY NUMBER OF MARKET TRENDS THAT IS IT.

>> THURSDAY JULY 22ND, AT 1:00 P.M. MET WITH ELLEN AVERY-SMITH AND JACOB SMITH AND STAFF. DISCUSSED TIME LINES AND DRI.

THEIR REASONING FOR WANTING TO CHANGE THOSE TIME LINES.

MANY CONCERNS ARE CHANGING SOME >> THANK YOU, COMMISSIONER DEAN?

>> ON WEDNESDAY JULY 23RD, 1:00 P.M. I MET WITH ELLEN AVERY-SMITH AND JAKE JACOB SMITH AND CHANGED DATES OF THE DIFFERENT REQUIREMENTS FOR DELIVERING CERTAIN

[00:30:02]

INFRASTRUCTURE. >> OKAY.

THANK YOU. COMMISSIONER SMITH.

>> THANK YOU MR. CHAIRMAN JULY 22ND, 11:30.

I MET WITH JACOB O'KEEFE, LEN AND OUR OWN TERESA BISHOP.

WE DISCUSSED PRESENT STATE AND CONTRACT AND DRI IN REQUESTED HAND. AND REASONS BEING COMMISSIONER WHITEHURST ALREADY OUTLINED OUT PACING OF THE BUILDING THAT WAS GOING ON. THE REQUEST VERY SPECIFIC IN REGARD TO TIME CERTAIN DEADLINES.

FIRST 75 UNITS OF AFFORDABLE HOUSING NO LATER THAN JUNE 1ST, 2024. PRICE POINT $260,000 PER UNIT.

PRESENT FACES DISCUSSED WHERE THEY WERE, WHERE THE BUILD OUTS WERE, TOO. REQUEST NO EXTENSES FOR AFFORDABLE HOUSING FOR VETERAN'S PARKWAY AND WHERE THEY WERE IN REGARDS TO VETERAN'S PARKWAY. THAT SHOULD CONCLUDE MR.

CHAIRMAN. >> THANK YOU, I MET THURSDAY JULY 8TH, APPROXIMATELY 9:30 A.M., WITH MISS ELLEN AVERY-SMITH AND JACOB O'KEEFE. DISCUSSED TIMELINE MODIFICATIONS. THAT IS ALL I HAVE.

THANK YOU. >> GOOD MORNING, MR. CHAIRMAN, COMMISSIONERS, ELLEN AVERY-SMITH ROGERS TOWERS, 100 WEXTONE PLACE. THE DEVELOPER OF THE COMMUNITY.

I HAVE RYAN STILLWELL WHO IS THE ENGINEER FOR ALL OF RIVERTOWN.

WE ALSO HAVE CHRIS BUTTER MOORE FROM MATTHEWS DESIGN GROUP WHO IS DESIGNING EXTENSION OF VETERAN'S PARKWAY IN CASE WE NEED TO GET INTO THE DETAILS AND WHEN CONSTRUCTION IS EXPECTED TO BEGIN. ALSO SHINDULAR TRAFFIC SOLUTIONS IS WORKING WITH RESPECT TO INTERSECTIONS AND TRAFFIC MITIGATION FOR THE PROJECT. AND SO, WE HAVE A LOT OF TECHNICAL EXPERTISE IN CASE WE NEED IT.

JUST TO ORIENT EVERYONE A LITTLE BIT.

YOU ARE ALL FAMILIAR WITH RIVERTOWN.

EXISTENCE SINCE 2004. SITS IN THE NORTHWEST PART OF THE COUNTY ALONG ST. JOHN'S RIVER.

BEAUTIFUL COMMUNITY. ORIGINALLY APPROVED IN 2004.

PROJECT INCLUDES 4100 ACRES, APPROVED ALL THESE YEARS, 4500 DWELLING UNITS, 3700 SINGLE FAMILY, 800 MULTIFAMILY.

HALF A MILLION SQUARE FEET OF NON-RESIDENTIAL SPACE.

TWO ELEMENTARY SCHOOL SITES, MIDDLE SCHOOL SITE AND OTHER USES WITHIN RIVERTOWN BOUNDARIES.

IT IS IMPORTANT TO NOTE DRI DEVELOPMENT ORDERS ARE SUPPOSED TO MITIGATE FOR PROJECT IMPACTS OVER TIME.

THAT IS WHY DRI INCLUDED PIPELINING, CERTAIN NUMBER OF UNITS COULD BE PUT ON THE GROUND IN EXCHANGE FOR CERTAIN MITIGATION WHILE OTHER MITIGATION DELAYED ON PURPOSE.

THAT WAS EXCHANGE IN DRI DEVELOPMENT ORDER.

I WANT TO PUT ON THE RECORD TODAY, RIVERTOWN CONSTRUCTED MILLIONS OF DOLLARS FOR BENEFIT OF ST. JOHNS RESIDENTS.

DRI DEVELOPMENT ORDER ESTIMATED COST 12 MILLION DOLLARS.

I DON'T KNOW THE ACTUAL COST THAT WAS PAID BY THE ST. JO COMPANY BUT PIPELINING DOLLARS ANDS DO 12 MILLION DOLLARS.

ALSO PAYMENT OF 4 MILLION DOLLARS TO THE COUNTY FOR OTHER SIGNIFICANT ROADWAY IMPROVEMENTS.

THAT PAYMENT HAS BEEN MADE. RESTAURANT FACILITIES, FISHING PIER, WALKING PATHS AND TRAILS. THAT IS FULLY OPERATIONAL AND OPEN TO THE PUBLIC AS IS 100-ACRE COMMUNITY PARK, BEAUTIFUL BASEBALL FIELDS. MULTIPURPOSE FIELDS OPENS TWO YEARS AGO. ALL KINDS OF FIELDS RESTAURANTS, PARKING AND CONCESSIONS. TWO OTHERS RESERVED FOR THE

[00:35:05]

SCHOOL BOARD. I MENTIONED THIS TO YOU, RIVERTOWN HAS CONTRIBUTED A LOT. WE ARE TALKING TODAY ABOUT TALKING CONTRIBUTING MILLIONS OF DOLLARS MORE.

TO GIVE YOU A LAYOUT, OBVIOUSLY STATE ROAD 13 THROUGH THE PROJECTS. COVES DISTRICT.

BUNGALOWS DISTRICT. YOU KNOW WHERE THE RIVER FRONT PARK IS. THEN THE COMMUNITY PARK HERE.

COUNTY ROAD 244 ALONG LEAFPINE GREEN PRIOR TO 210 DOWN THIS WAY AND ELEMENTARY SCHOOL SITES RESERVED.

WHAT WE ARE HERE TODAY IS TALK ABOUT COUPLE OF MODIFICATIONS DEVELOPMENT ORDER, FIRST TO REVISE DATES FOR AFFORDABLE HOUSING. I NEED TO MENTION AFFORDABLE HOUSING COMPONENT OF THIS PROJECT SINCE DAY ONE.

WE ARE NOT ASKING TO NOT MAKE THE AFFORDABLE HOUSING PAYMENTS.

IT IS TO MAKE SURE THEY HAVE MORE TIME TO BUILD THE AFFORDABLE HOUSING. I'LL SAY THIS TO YOU ABOUT THIS AFFORDABLE HOUSING AND VETERAN'S PARKWAY.

A YEAR AND A HALF AGO, WHEN ALL OF US WERE SHOCKED ABOUT COVID, ALL OF YOU KNOW THE ECONOMY OF THE UNITED STATES TOOK A NOSE DIVE. THIS DEVELOPER AND MANY OTHERS PUT A PAUSE ON ANYTHING. NO ONE EXPECTED WHEN COVID WAS SIX OR EIGHT MONTHS OLD, REAL ESTATE MARKET WOULD TAKE OFF LIKE A ROCKET BUT IT DID. PURPOSE OF THE REQUESTED REVISION FOR AFFORDABLE HOUSING IS HONESTLY TO MAKE SURE THEY CAN BUILD THE AFFORDABLE HOUSING UNITS AS QUICKLY AS POSSIBLE.

LAND PLANS, INFRASTRUCTURE IMPROVEMENT AND THEN BUILD HOUSES. COMMITMENT IS THERE FOR 150 UNITS, FIRST 75 DELIVERS JUNE 1ST, 2024.

WE DID PUT IN THE DEVELOPMENT ORDER, NO LEGISLATIVE EXTENSIONS TO THAT DATE. THEY HAVE TO DELIVER THE UNITS JUNE 1ST, 2024 FOR FIRST 75 UNITS.

OTHER 75 UNITS WILL BE DELIVERED PURSUANT TO THE TIMELINE ALREADY IN THE DEVELOPMENT. SECOND THING IS CONSTRUCTION OF VETERAN'S PARKWAY FROM 210 TO LONG LEAFPINE PARKWAY.

TWO-LANE SEGMENT. IDEA IS TO CONTINUE CONSTRUCTING A FOUR-LANE SEGMENT LONG LEAF SOUTH TO 210.

MATTHEWS DESIGN GROUP SUBMITTED CONSTRUCTION PLANS TO THE COUNTY TO MEET THE TIMELINE IN THE REVISED DEVELOPMENT ORDER.

I SAT IN LAST WEDNESDAY. EVERYTHING GOING FINE IN THE REVIEW. APPRECIATE STAFF EXPEDITING REVIEW OF CONSTRUCTION PLANS. WE HOPE THOSE PLANS WILL BE APPROVED BY THE END OF THIS YEAR SO -- BY BEGINNING OF 2022 AND FINISH WITHIN FIRST PART OF 2024.

WE HAVE MADE CHANGES TO BIENNIAL MONITORING REQUIREMENTS PURSUANT TO CHANGES IN FLORIDA LAW THAT REQUIRES ROADWAY MONITORING.

ALL THE ROADWAY MONITORING TRAFFIC COUNTS ARE GOING TO BE DONE BY MR. SHINDULAR AND HIS GROUP.

THAT IS IN SUMMARY WHAT WE ARE TALK K ABOUT.

LOCATION OF EXTENSION OF VETERAN'S PARKWAY GREEN BRIAR AND 210. ALL THE WAY UP TO LONG LEAF PINE. IT WILL BE A FOUR-LANE CONFIGURATION. HOPEFULLY THAT ROAD IS DELIVERED IN TWO AND A HALF YEARS AND BE OPEN FOR TRAFFIC.

VOTED TO RECOMMEND APPROVAL OF THIS MODIFICATION APPLICATION TO YOU. APPRECIATE YOUR VOTE ON THE SAME. WE ARE HERE TO ANSWER ANY QUESTIONS YOU MIGHT HAVE ABOUT THE APPLICATION.

AND THANK YOU. >> THANK YOU, MA'AM.

ANY OTHER IMMEDIATE QUESTIONS FROM THE BOARD?

>> COMMISSIONER DEAN? >> MISS SMITH, THIS MAYBE A QUESTION FOR ONE OF THE REPRESENTATIVES NEVERTHELESS, AS I REVIEWED THIS OVER THE LAST COUPLE OF WEEKS, AS I LOOK AT IT

[00:40:04]

THIS MORNING, INTUITIVELY, I WOULD THINK THAT THE STARTING PROBABLY LAST FALL AS I UNDERSTAND IN ST. JOHNS COUNTY, I WAS THINKING THINGS WOULD CONTINUE TO SLOW DOWN DRAMATICALLY FOR SEVERAL REASONS, TAMPERING DOWN ON ECONOMY NATIONWIDE AND COST OF CONSTRUCTION SKYROCKETING.

I KNOW YOU ARE FAMILIAR WITH THE MONTHLY REPORTS, NEW HOME CONSTRUCTION HAS EXPLODED IN THE LAST 12 MONTHS IN ST. JOHNS COUNTY. JUNE 820 NEW BUILDING PERMITS FOR SINGLE FAMILY RESIDENTS. WHERE I AM HEADED IS: IT SEEMS TO ME, IF MADAME E HAS TAKEN PART IN THAT GROWTH SPURT, THAT INTU TIFFLY, BETWEEN HAS HAD NOT ONLY INCREASE IN HOMES BEING BUILT WITH INCREASE IN REVENUE, SALE OF THE LOTS OR HOMES, SO REVENUE HAS GONE UP UNEXPECTEDLY IN THE THAT TIME HAS TAKEN FOUR TO FIVE MONTHS FROM THE LEGAL PERSPECTIVE AND ALSO DRI DEVELOPMENT ORDER HAD A STOPPER IN IT OF A CERTAIN NUMBER OF FLATTED UNITS.

MADAME E RECOGNIZED THEY WERE GOING TO HIT THAT NUMBER OF UNIT POINT AND STARTED WORKING ON THIS AGOS.

WE WEREN'T RESTING ON OUR LURLS. PAPER WORK AND PROCESS TAKES TIME. THAT IS FROM THE LEGAL

PERSPECTIVE. >> THAT IS HELPFUL TO ME.

>> GOOD MORNING COMMISSIONERS JACOB O'KEEFE, APPRECIATE THE QUESTION FOR SURE. THIS IS MORE ABOUT THE TIMELINE ON THE DEVELOPMENT SIDE OF THINGS TO ADD TO ELLEN ON THE LEGAL SIDE. WE HAVE -- WHEN WE WERE ABLE TO IDENTIFY, THINGS ARE SURPRISINGLY GOING QUICKER IN TERMS OF SALES THAN EXPECTED. WE ENGAGED ENGINEERS TO DETERMINE SCHEDULES GET PLANS AND DESIGN AS QUICKLY AS WE POSSIBLY COULD. THERE ARE CHALLENGES WITH LABOR SHORTAGES WHICH HAS NOT HELPED IN TERMS OF OUR ABILITY TO ACCELERATE THE TIMELINE. MANPOWER ISSUES DEVELOPMENTAL SIDE AS WELL AS PLANNING SIDE OF THINGS.

WE ARE BY NO MEANS LOOKING TO GET OUT OF THE REQUIREMENTS OUTLINED IN DRI. WE ARE GOING AS FAST AS WE CAN WITH THE DESIGN AND HORIZONTAL DEVELOPMENTAL SIDE OF THINGS.

THESE TIMELINES ALLOW US TO MEET THE THRESHOLDS WITHOUT PUTTING A PAUSE ON BRINGING HOMEOWNERS INTO THE COMMUNITY.

THERE IS NO WAY WE CAN GO FASTER.

WE HAVE OUR VARIOUS ENGINEERING CONSULTANTS AND HAVE ALL THEIR STAFF WORKING TO HIT THE TIMELINES WE ARE PROPOSING.

NO WAY TO ACCELERATE. >> THANK YOU.

>> YES, SIR. THANK YOU.

>> ANY FURTHER QUESTIONS AT THIS TIME WHY DON'T WE OPEN IT UP FOR

PUBLIC COMMENT. >> WE WILL NOW TAKE PUBLIC

COMMENT 1B AT THIS POINT. >> THAT IS CORRECT.

RIVERTOWN DRI MOD. PUBLIC COMMENT? PUBLIC COMMENT GOING ONCE. GOING ONCE, GOING TWICE.

[00:45:08]

>> GOOD MORNING, BJ. >> BJ CALADY.

THIS REQUEST TO AMEND RIVERTOWN SHOULD BE DENIED.

APPROVED IN CHANGES OCCURRED IN 2010, 2017.

DEVELOPER SOLD MORE UNITS IN PHASE ONE IN SPITE OF COVID-19 IS NOT JUSTIFICATION FOR MODIFICATION.

GLAD THAT HAS BEEN BROUGHT UP. THEY ARE STILL UNDER REVIEW.

75,000 SHOULD HAVE BEEN PAID INSTEAD OF USING LEGISLATURE EXTENSIONS EVEN THOUGH YOU CAN. BUILDING AFFORDABLE HOUSING SHOULD NOT BE EXTENDED TO 2024. PAGE 147, COMMUNITY PARK COMPLETED IN 2017. YET NOT ONE OF THE 150 AFFORDABLE HOUSING HAS BEEN CONSTRUCTED.

IN 17 YEARS THIS DEVELOPER IGNORED AFFORDABLE HOUSING REQUIREMENT WHICH ALLOWS CHANGING IN ZONING REQUIREMENTS.

THEY GET BENEFITS FOR THAT. I UNDERSTAND THERE IS A NEW ENTRANCE TO THE RIVERTOWN. THAT NEEDS TO BE SHOWN PLAINLY DURING THIS CONVERSATION. THANK GOODNESS ONE PZA MEMBER VOTED AGAINST. WHEN THE ATTORNEYS PRESENT THEIR COMMENTS, INSTEAD OF GIVING THE REAL FACTS IT WAS A 6-1.

JUST SAYING PZ APPROVED. YOU NEED TO TELL THE PUBLIC THEY ARE QUESTIONING JUST BECAUSE THEIR BOTTOM LINE IS NOT WHAT IT SHOULD BE. PAY YOUR CONSTRUCTION PEOPLE AND GET AMOUNT OF WORK. THANK GOODNESS, THIS SHOULD BE DENIED. THEY SHOULD GO WITH WHAT THEY ARE SUPPOSED TO HAVE BEEN DOING ALL THE 17 YEARS ESPECIALLY FOR THE AFFORDABLE HOUSING ALL GOES BACK TO THE SAME OLE SAME, LOVE

OF MONEY IS ROOT OF ALL EVIL. >> I WOULD RECOMMEND PROVIDING

THAT. >> WHY DON'T WE HAVE YOU COME ON BACK UP. COMMISSIONER WALDRON NEXT.

>> MISS ELLEN, PAYMENT ON AFFORDABLE HOUSING IF WE SOLD SO MANY HOMES, WHY IS THAT AN ISSUE AT THIS TIME FOR A DOWN PAYMENT ASSISTANCE, $75,000, WHY WOULD THAT BE AN ISSUE?

>> IT IS NOT AN ISSUE. THAT DATE IS SUBJECT TO THE LEGISLATIVE EXTENSIONS JUST LIKE THE PHASING AND BUILD OUT DATES FOR DRI DEVELOPMENT ORDER. CHAPTER 252.363 FLORIDA STATUTES DEALS WITH EXTENSIONS OF DAYS AND DEVELOPMENT ORDERS PUD'S AND OTHER ORDERS BASED ON EMERGENCY DECLARATIONS.

THAT IS BASED ON THAT LAW. >> THE ISSUE I HAVE WITH THAT.

ST. JO PROMISED AFFORDABLE HOUSING, CONTRACT WITH THE COUNTY. JUST LIKE OUR STAFF ESTIMATES BASED ON AFFORDABLE HOUSING, YOU WOULD HAVE IT READY TO GO IN 13 MONTHS TO START BUILDING. ARTICLE ABOUT HAVING A

[00:50:06]

CELEBRATION. THEY KNEW SALES WOULD INCREASE.

HARD BEING IN BUSINESS, WE MADE ALL THIS EXTRA MONEY, NOW WE WANT TO DELAY EVERYTHING. I UNDERSTAND THE TIMING.

I HAVE NOT SEEN DELAYS IN OTHER. THERE IS A SUBDIVISION BY MY HOUSE, THEY HAVE BUILT 50 HOMES IN THE LAST MONTH.

THEY ARE STEADY BUILDING HOMES. WHERE IS THE NEED FOR THE AGREEMENT MADE WITH THE COUNTY AND RESIDENTS? THAT IS WHO THIS AGREEMENT WAS MADE WITH BACK WITH ST. JO DID IT. WHY SHOULD THERE BE A HUGE

CHANGE. >> I'LL SAY THIS POINT, MAYBE MR. O'KEEFE WILL COME UP AND TALK MORE.

ONE WITH RESPECT TO THE DATES EXTENDED BY OPERATION OF LAW, THOSE DATES PUT INTO THE DEVELOPMENT ORDER WHEN WE EXTENDED THEM BECAUSE OF THE LEGISLATION.

THE OTHER DATES RELATED TO COVID SIMPLY ARE.

I CAN TELL YOU FROM MY PRACTICE, I REPRESENT PEOPLE BEFORE YOU ALL THE TIME. MY PRACTICE CAME TO A SCREECHING HALT BACK IN EARLY 2020. I DON'T THINK ANYBODY ANTICIPATED THIS MARKET TOOK OFF THE WAY IT DID.

I BELIEVE JACOB CAN TALK TO YOU ABOUT THAT.

I DO BELIEVE THERE HAS BEEN A COMBINATION OF PEOPLE STOPPED.

THERE WAS A PAUSE. WE ALL KNOW PEOPLE HAVE NOT WANTED TO GO BACK TO WORK. SO PEOPLE ARE STRUGGLING TO FIND PEOPLE TO DO THE WORK. IT HAS BEEN THIS BE MOUNT OF ISSUE THAT IS CAUSED THIS TIMING CRUNCH.

ALSO CAN SAY WHEN WE WERE BEFORE THIS BOARD 2018.

BASED ON THE ABSORPTION AT THIS TIME.

IT IS HIGHER THAN 2004/05. NORTHEAST FLORIDA BUILDER ASSOCIATION SHOWS 800 BUILDING PERMITS FROM ST. JOHN'S COUNTY LAST MONTH. THAT IS UNHEARD OF.

PRIOR MONTH 500S OR 600S. I THINK THIS IS UNPRECEDENTED.

THAT IS MY EXPLANATION. WE SCRAMBLED TO PUT TOGETHER THIS APPLICATION KNOWING THESE DATES WERE COMING AND TRYING TO MOVE THE PROJECT FORWARD NOT ONLY DRI BUT MATTHEWS DESIGN

GROUP WORKING FEVERISHLY. >> ONE MORE QUESTION, STATE LAW, DOES IT PROHIBIT PAYMENT BEING MADE EARLY?

>> NO. >> I HEARD YOUR COMMENT IN TERMS OF HOUSES GOING UP. DEVELOPERS STILL MAKING MONEY.

HOUSE PRICES HIGHER THAN THEY HAVE BEEN.

POTENTIALLY SINCE MAYBE HIGHER THAN '05 ON AN AVERAGE BASIS.

WHY ARE WE ASKING FOR THIS? JUST TO FRAME, IT HAS NOTHING TO DO WITH MONEY GOING OUT. WE HAVE THE MONEY AND PLAN TO GO OUT. WE ARE PAYING OUR ENGINEERS AND DESIGNERS TO MAKE SURE THEY ARE WORKING AS HARD AS THEY CAN TO PUSH FORWARD. WE WENT FROM BUILDING A HOUSE IN 127 DAYS TO TAKING OVER 8 MONTHS TO BUILD A HOUSE.

MADAME E IS TURNING EVERYBODY DOWN.

WE ARE NOT EVEN SURE WE ARE GOING TO BUILD A HOUSE IN 10 MONTHS. THESE ARE REAL CONSTRAINTS BECAUSE OF THE DEMANDS THAT IS ACROSS THE MARKET VERTICAL CONSTRUCTION AND LACK OF LABOR TO MEET THOSE AND CORRESPONDS IN THE HORIZONTAL SIDE. FROM BEING ABLE TO CONSTRUCT A LOT NEIGHBORHOOD IN EIGHT MONTHS TO TAKING OVER TEN MONTHS.

AND CASCADES OVER TO THE PERMIT SIDE.

I HAVE NOTHING ELSE TO JUSTIFY THE ASK FOR THE EXTENSIONS ON

[00:55:01]

THESE OTHER THAN THE FACT THAT WE ARE WORKING AS FAST AS WE CAN TO MEET THESE DATES. BUT THE CONSTRAINTS IN THE MARKET FROM THE TIMING AND LABOR SUPPLY PERSPECTIVE ARE NOT ALOALOU ING -- ALLOWING US TO ACCELERATE FURTHER. H WE ARE TALKING 2027, 2028, IS THIS EVER GOING TO HAPPEN? WE WANTED TO LOCK IN HARD DATES SO COUNTY, RESIDENTS, MADAME E, THERE IS AFFORDABLE HOUSING AND ROADWAY BY A CONCRETE SET OF TIME. WE HOPE YOU SEE THAT AS A

POSITIVE. >> UNFORTUNATELY WE HAVE HAD AS

CONCRETE AS THE ONE ST. JO DID. >> BUT I DO THINK, COMMISSIONER WALDRON IN RESPONSE, I APPRECIATE WHAT YOU ARE SAYING, WE HAVE PURPOSEFULLY PUT IN THIS MODIFICATION, THERE CAN'T BE ANYONE REQUESTS. THESE DATES ARE HARD EXCEPT FOR SOMETHING LIKE -- IF THEY CAN'T BUILD A ROAD BECAUSE THE ROADWAY IS FLOODED. WE ARE PUTTING A STOPPER IN VETERAN'S REQUIREMENT AND AFFORDABLE HOUSING REQUIREMENT.

EVEN IF WE DO, AS LONG AS THEY DO NOT MATERIALLY EFFECT THEIR ABILITY TO BUILD THE ROAD OR AFFORDABLE HOUSING, THEY CAN'T ASK FOR DATE EXTENSIONS. I ALSO WANT TO POINT OUT, TOO, THIS IS A 20 PLUS MILLION DOLLAR ROAD.

THEY ARE READY TO GO. THEY ARE GOING AS FAST AS THEY CAN POSSIBLY GO. HOPEFULLY THAT WILL BE UNDER CONSTRUCTION BEGINNING OF NEXT YEAR.

>> OKAY. THANK YOU.

>> I RECOGNIZE THE CHALLENGES, LABOR CHALLENGES, MATERIAL CHALLENGES. I THINK YOU TRIED TO ADDRESS, WHAT HAPPENS IF WE HAVE ANOTHER SERIOUS ECONOMIC DOWNTURN.

I UNDERSTAND YOU ARE WILLING TO PUT LANGUAGE IN THERE.

AS A BOARD WE HAVE TO ANSWER TO THE PUBLIC.

I THINK YOU HEARD OTHER COMMISSIONERS HIGHLIGHT THAT.

I UNDERSTAND THE ECONOMY HAS BEEN WHACKY.

I WANT Y'ALL TO UNDERSTAND THESE ARE CONCERNS WE ARE FRONTED WITH. I UNDERSTAND DIFFICULTY, WHAT HAPPENS A YEAR FROM NOW, WE ARE IN THE THROWS OF ANOTHER EPIDEMIC, WE HAVE A HURRICANE. I UNDERSTAND YOU ARE GOING TO PUT LANGUAGE IN HERE. AGAIN CREATES CHALLENGES FOR US

AS A BOARD. >> COMMISSIONER BLOCKER, JUST TO NOTE FOR YOU, SPECIFICALLY WITH RESPECT TO VETERAN'S PARKWAY.

THEY NOT ONLY HAVE TO PUT DOWN THE MONEY FOR THE ROAD INSPECTION FEES, ALSO BOND. IF SOMETHING CATASTROPHIC HAPPENS ONCE THEY START CONSTRUCTION.

ONCE THE CONSTRUCTION PLANS APPROVED.

TIMELINE SET FORTH IN THE DEVELOPMENT ORDER AS IT IS BEING REVISED TO SAY THEY PAY CONSTRUCTION INSPECTION FEES AND BOND THE ROAD. THEY ALREADY HAVE THE RIGHT-OF-WAY. SO THE COUNTY, IF THEY DEFAULT.

COUNTY PULL IT IS BOND AND BUILDS THE ROAD.

THEIR DEVELOPMENT ORDERED REQUIRES THEM.

>> THAT IS HELPFUL MITIGATING CHALLENGES.

LET ME GO TO LEGAL HERE. THANK YOU.

>> THANK YOU. IF I MAY THROUGH THE CHAIR, MISS SMITH, I THINK MR. O'KEEFE MAY HAVE A QUESTION.

MISS SMITH BACK TO VETERAN'S PARKWAY COUPLE OF YEARS AGO, A LOT OF COORDINATION BETWEEN NUMBER OF PARTIES ON THE CONSTRUCTION OF VETERAN'S PARKWAY AND WHO WAS GOING TO CONSTRUCT THAT ETC. CAN YOU REPRESENT TO THE BOARD TODAY NONE OF THOSE OTHER ENTITIES ARE GOING TO BE SURPRISED BY THIS REQUEST TODAY? HAS THERE BEEN ANY COMMUNICATION WITH ICI AND SOME OF THE OTHER BUILDERS?

>> YES PBECAUSE THE ROAD IS UNDER CONSTRUCTION NOW.

PORTION OF THE ROAD. TWO-LANE PORTION OF THE ROAD THAT BENEFITS ICI AND LA NAR UNDER CONSTRUCTION BY MADAME E.

MADAME E IS PERFORMING TO GET TO THEIRTS.

>> SO EXTENSION IN YOUR VIEW WILL NOT NEGATIVELY EFFECT ICI?

>> NO. ACTUALLY THE GOAL IS, ROAD IS

[01:00:04]

UNDER CONSTRUCTION NOW. GOAL IS MATTHEWS DESIGNING ULTIMATE FOUR LANE. THEY DESIGN THE TWO LANE.

IF WE NEED FOR CHRIS TO COME UP, THAT IS FINE.

THEY ARE BUILDING THE TWO LANE BASED ON DESIGN FROM MATTHEWS.

MATTHEWS WENT BACK AND DESIGNED FOUR LANES STARTING AT LONGLEAF

PINE ALL THE WAY DOWN TO 210. >> OKAY.

THANK YOU. MR. CHAIR, IF I MAY, MISS SMITH OR IF I CAN GO THROUGH YOU TO MR. O'KEEFE, I THINK MR. O'KEEFE GAVE A GOOD DESCRIPTION OF WHAT IS HAPPENING ON THE GROUND OUT THERE IN TERMS OF YOU KNOW, INTERESTED BUYERS, BUT THE REALITIES OF CONSTRUCTION, ETC. I WOULD LIKE TO GO BACK TO COMMISSIONER WALDRON'S REQUEST. ASIDE FROM THE STATUTORY PROVISION FOR EXTENSION OF TIME, JUST ON THE 75K, AND WITHOUT TAKING ANY POSITION THAT IS NOT ENTITLED TO BE EXTENDED SHOULD IT BE REQUESTED. IT IS BEING REQUESTED.

I HEARD COMMISSIONER WALDRON'S COMMENTS IN THE PART, THE NEED STILL EXISTS PUSHING IT OFF TWO YEARS.

THERE IS A TIME VALUE TO MADAME E.

IT IS BASED ON SOMETHING THAT ACTUALLY WOULD BE HAPPENING, FIRST CO. IN OTHER WORDS IF THE FIRST CO ON THE UNIT OCCURS, OBVIOUSLY THAT DIDN'T SLOW DOWN TOO MANY.

IN OTHER WORDS WOULD THERE BE OBJECTION TO REMOVING THAT PART

OF THE REQUEST 725 -- 75K. >> IF THAT HELPS US GET TO THE FINISH LINE THAT IS NOT AN ISSUE AT ALL.

>> IF I MAY THROUGH THE CHAIR AND COMMISSIONER WALDRON, I

GUESS THAT WOULD BE THE REQUEST. >> I DON'T KNOW IF IT IS A REQUEST AS MUCH AS A POINT. MAY NOT CHANGE HOW I FEEL.

>> I WANT TO MAKE SURE I AM CLEAR WHEN WE ARE VIEWING THIS AGAIN, DID ST. JO HAVE A BOND WAS THAT ROAD BONDED?

>> TO BE HONEST, I AM NOT SURE OFF THE TOP OF MY HEAD.

>> IF IT IS ON THE RIGHT-OF-WAY OF THE COUNTY.

>> MY QUESTION IS PRIOR ST. JO. I BELIEVE THEY WENT THROUGH A BANKRUPTCY. DID THEY HAVE A BOND THAT

FAILED? >> NO.

>> COMMISSIONER WHITEHURST. >> THANK YOU MR. CHAIRMAN.

ELLEN AVERY-SMITH, WHEN WE MET, WE DISCUSSED PUSHING BACK THE PAYMENT. PLEASED TO HEAR YOU ARE WILLING TO MAKE THE PAYMENT. WITH BUSINESS BEING SO GOOD, SEEMS LIKE THAT IS A SMALL CONCESSION.

THANK YOU, MR. OH KEEF. PHASE ONE ENDING IN 2025.

REVISED PHASING TABLE, ENDING 2032 SHOULDN'T THE PHASING TABLE, SHOULDN'T THE DATE BE SOONER THAN LATER WHAT IS THE

RATIONAL? >> BECAUSE OF THE STACHT TOIR EXTENSIONS THAT ARE GRANTED BY OPERATION OF LAW, PHASE WE ALREADY REQUESTED. IF YOU COME TO THE MAXIMUM

[01:05:05]

NUMBER OF DWELLING UNITS BEFORE THE DATE TRIGGER, YOU GO INTO THE NEXT PHASE ANY WAY. ISSUE WITH THE AFFORDABLE IT IS BECAUSE OF THE UNIT COUNT. SAME WITH VETERAN'S PARKWAY.

IT HAS TO BE OPERATIONAL, STARTED BY 2392 UNITS.

THOSE ARE UNIT COUNTS. TO YOUR POINT THERE ARE NOT THE EXERCISE OF LEGISLATIVE EXTENSIONS WHICH OPERATES TO EXTEND THOSE. THAT IS WHY WE PUT THE STOPPER LANGUAGE IN FOR THESE TWO CONDITIONS SO THEY CAN'T BE

EXTENDED IN TIME. >> FELT COUNTER INTUITIVE.

NOT REALLY A MAJOR ISSUE. JUST MORE OF A CURIOSITY.

THE REASON I FELT LIKE I WAS SUPPORTIVE, WE ARE NOT KICKING THE CAN DOWN THE ROAD WITH OPEN ENDED DATES.

OBVIOUSLY, IT HAS BEEN WELL DOCUMENTED AND SHORTAGES NATIONWIDE IN ST. JOHNS COUNTY. I AM PREPARED TO MAKE A MOTION.

>> OKAY. THANK YOU.

ANYTHING FURTHER? GO AHEAD COMMISSIONER

WHITEHURST? >> MR. CHAIRMAN, I AM GOING TO

MOVE TO ADOPT RESOLUTION 2021. >> 334 BASED ON FIVE FINDINGS OF

FACT WITH STAFF REPORT. >> WOULD THE MAKER OF THE MOTION ACCEPT OR ACKNOWLEDGE I THINK THE PROVISION CONCESSION PAYMENT OF 75K NOT BEING ADJUSTED OR NOT BEING EXTENDED?

>> THANK YOU MR. MCCORMICK. I WOULD LIKE TO AMEND MY MOTION

TO REFLECT THAT CHANGE. >> OKAY WE HAVE AMEND YOUR

SECOND. >> MOTION BY COMMISSIONER WHITEHURST SECOND BY COMMISSIONER SMITH.

FURTHER DISCUSSION? SEEING NONE, PLEASE VOTE.

PASSES 5-0. AGENDA ITEM NO. 2.

2020-09. INDIAN BRANCH FARMS.

>> GOOD MORNING. SHANNON ACEVEDO.

MATTHEWS DESIGN. THIS IS THE INDIAN BRANCH FARMS APPLICATION. TODAY I AM REPRESENTING THE PROPERTY OWNERS CHUCK AND PEGGY WHO ARE ALSO IN THE AUDIENCE TODAY. GETTING RIGHT INTO IT, LOCATION WISE, L-SHAPED PROPERTY. FAR WEST SIDE OF INDIAN BRANCH RANCH ROAD. LITTLE WEST OF WHERE THAT ROAD INTERSECTS WITH CHURCH ROAD. AND LOOKING CLOSER UP.

THIS IS ABOUT 33.46 ACRES. IT IS EXISTING TWO PARCELS WITH 1400 SORRY, 1400 LINEAR FEET ON INDIAN BRANCH RANCH ROAD WHICH IS IN ON OPENED EXISTING RIGHT-OF-WAY OF 60 FEET AND WIDTH. ABOUT 750 FEET WEST OF INTERSECTION WITH CHURCH ROAD TO GIVE YOU AN IDEA OF SCALE.

AND IN TERMS OF LAND USE, CURRENTLY RURAL CIVIL CULTURE.

LIMITING TO SIX UNITEDS. ADJACENT TO ST. JOHNS DRI.

AND TO GIVE YOU A GENERAL IDEA OF WHAT IS PRECIPITATING THIS REQUEST PUT TOGETHER A GENERALIZED SITE PLAN TO GIVE AN IDEA OF HOW THIS COULD LOOK AT A MAXIMUM OF SIX UNITS.

FOR EACH OF THE SIX LOTS TO BE LEGALLY ACCESSED FROM EXISTING RIGHT-OF-WAY. PLANNING A CUL-DE-SAC TO THE CENTER OF THE PARCEL OF LAND TO GIVE EACH LOT ACCESS, ALSO SQUARE THEM OFF SO THEY ARE MORE USABLE.

THEY ARE TEN ACRES OF WETLANDS ON THE SITE.

WE TRIED TO BE EQUITABLE HOW THESE COULD BE SURVEYED OUT IN

[01:10:01]

ORDER TO GIVE EVERYONE ENOUGH UP LANDS TO MAKE THEM USABLE.

OTHER IDEA TO HAVE SHARED DRIVEWAYS.

IN TOTAL, GROSS DENSITY OF ONE UNIT PER 5.58 ACRES.

IDEA BEHIND HAVING THESE LARGE ESTATE LOTS TO FILL A NICHE MARKET FOR A VARIETY OF RURAL SITE OPTIONS CURRENTLY NOT A LOT OF SITE THAT IS FALL WITHIN THIS 3-4 ACRE RANGE.

WITH THIS COMES VARIETY OF DIFFERENT USES WHEN THE LOTS HAS A SPRING FED POND USED FOR FISHING.

IF YOU HAVE HORSES, WOULD BE A GOOD SITUATION FOR HAVING INDIVIDUAL ONE OR TWO HORSES. AGRICULTURAL OPPORTUNITIES.

JUST HAVING THE WILDLIFE AND KIND OF LOW IMPACT RURAL SETTING. AND WITH THAT, AS YOU CAN SEE FROM WHAT WE HAVE LAID OUT, THIS IS VERY GENERAL.

GIVES YOU AN IDEA HOW SOME OF THESE LOTS COULD SERVE THEM A LITTLE BETTER. ONE THING I WANTED THE MENTION, WE LOOKED INTO JUSTIFICATION AND MARKET DEMAND FOR THREE TO FIVE ACRE RANGE. WHAT WE FOUND IS TO DO THE OPTIONS WE HAVE AVAILABLE WITHIN THE EXISTING RURAL CULTURE DOESN'T WORK FOR A SITE LIKE THIS.

NOT QUITE LARGE ENOUGH TO DO PLANNED RURAL DEVELOPMENT.

IDEA IS WE'LL DO SOMETHING SIMILAR ON A SMALLER SCALE.

SO IN THIS CASE, EVEN WHEN WE SUBTRACT OUT THE WETLANDS, 3.92 ACRES PER LOT. THIS IS COMPATIBLE ALONG CHURCH ROAD. LOT SIZE 4.36 GROSS ACRES PER LOT. IT IS ADJACENT TO TRAILMARK.

IN TERMS OF MARKET TRENDS, WE DID SEARCHES ON PROPERTY APPRAISER WEBSITE TO GET AN IDEA OF HOW MANY PROPERTIES FALL INTO THIS RANGE, 332. OF THOSE, ON REALTOR.COM AND ZILLOW.COM 25 LISTINGS. HOWEVER LOOKING AT WHAT SOLD 2018-2020 RANGE, 65 LOTS. THERE IS MARKET POTENTIAL AND A NEED FOR A LOT LIKE THIS IN ST. JOHN'S COUNTY.

I LOOKED AGAIN BEFORE THIS HEARING, SAW THAT WAS EVEN LESS LISTINGS FOR THE SAME CRITERIA. SO WITH THIS, WE ARE LOOKING AT ADJACENT TO THE DEVELOPMENT BOUNDARY OF TRAILMARK.

TEXT AMENDMENT WHICH WOULD LIMIT TO SIX UNITS.

THERE MAY NOT BE SIX UNITS. COULD BE LESS.

DEPENDING ON THE MARKET TRENDS AND WHO WOULD WANT TO PURCHASE THIS PROPERTY. SIX WOULD BE THE MAXIMUM FALLS WITHIN EXISTING RURAL STANDARDS ONE ACRE LOT PER MINIMUM.

THERE ARE 35-FOOT EDGES. MINIMUM PROTECTION 10% HABITAT.

FALLS IN LINE WITH COMPREHENSIVE PLAN.

YOU CAN SEE IN GENERAL 4.36 ACRES PER LOT ALONG CHURCH LOT.

THIS IS A RURAL ENCLAVE NEXT TO THAT.

IN TERMS OF IMPACTS OF VERY SMALL TRAFFIC ESSENTIALLY WITHIN AN AREA THAT IS NOT AT CAPACITY. AND PLENTY OF SPACE FOR PRIVATE UTILITIES WITH LARGE LOT SIZE AND INTENTION IS AGAIN TO USE EXISTING RIGHT-OF-WAY FOR PRIMARY ACCESS AND SHARED DRIVEWAYS TO THE HOMES. WITH THAT WE BELIEVE THIS REQUEST IS JUSTIFIABLE AND COMPATIBLE WITH THE SURROUNDING AREA. CONSISTENT WITH THE COMPREHENSIVE PLAN AND LAND DEVELOPMENT CODE.

WE REQUEST APPROVAL OF THIS LAND USE AMENDMENT.

I'LL BE AVAILABLE FOR QUESTIONS YOU MAY HAVE.

>> OKAY. THANK YOU, ANY QUESTIONS? SEEING NONE, WHY DON'T WE GO INTO PUBLIC COMMENT.

>> WE'LL NOW TAKE UP PUBLIC COMMENT ITEM TWO, INDIAN BRANCH

[01:15:06]

FARMS. NAME AND ADDRESS PLEASE, MA'AM.

GOOD MORNING. >> GOOD MORNING.

MELISSA STRATTON. I COME TO YOU TODAY AS A CONCERNED CITIZEN. I HAVE ACCESSED OFF CHURCH ROAD THROUGH INDIAN BRANCH PASSED 38 YEARS AND MY PARENTS PASSED 47 YEARS. ROAD IS MY MAIN CONCERN.

THEY SAY EXISTING ACCESS, ACCESS BUILT BACK IN THE '70S.

IT WAS A TEMPORARY ROAD PUT DOWN FOR MY UNCLE TO ACCESS HIS CATTLE. HE PUT THE ROAD DOWN WITHOUT GETTING APPROVAL FOR THE ROAD. THE ROAD IS A ONE-LANE ROAD ENOUGH TO FIT ONE CAR DOWN. IT IS THROUGH THE MIDDLE OF A WET LAND BARRIER. WETLANDS COME DOWN FROM THE BACK OF MR. COLLEY'S PROPERTY WHICH IS THE 35 AMY KLO ACRES.

NOW SEVEN HOMES ALL DRAINS OUT THROUGH THAT WETLAND BARRIER.

MY MAIN CONCERN IS: I HAD A PREVIOUS MEET WITHING THE DEVELOPERS AND THE HOMEOWNERS. THEY STATED THAT UM, THEY WOULD ONLY BE BEHAVING THE FIRST 100 FEET OF THE ROAD.

REST OF THE ROAD WOULD BE GRAVEL.

HOWEVER THERE IS NO DRAINAGE, NO PIPES.

ONE PIPE THERE KEEPS CAVING IN FROM THE TRAFFIC COMING BACK THROUGH THERE WHETHER IT BE TRACTORS TO MOW THE GRASS, AND I JUST DON'T SEE HOW ACCESSING THROUGH A GRAVEL ROAD WITH SIX FAMILIES ALONG WITH IN THE BACK CORNER, IS MR. CRONEN'S PROPERTY. HE PLANS ON BUILDING THREE HOMES. MR. COLLEY IS AT 5450 INDIAN BRANCH ALSO WANTS TO PUT THREE HOMES.

WE ARE TALKING A TOTAL OFF OF A PRIVATE ACCESS, 20 FEET WIDE AT THE TIME NOW TO HAVE A TOTAL OF 13 HOMES? I JUST SEE IT BEING UNREASONABLE.

CHURCH ROAD IS -- I HAVE TO FIGHT WITH THE COUNTY EVERY YEAR IN ORDER TO GET THE BUSES TO COME DOWN AND TURN AROUND ON CHURCH ROAD. KIDS WITH ACCESSING THROUGH THERE TO HAVE TO WALK CHURCH ROAD THAT HAS NO MIDDLE LANE, NO WHITE OR YELLOW LINES. WE HAVE HAD THE COUNTY SCHOOL BUS ALMOST RUN INTO A TRASH TRUCK THAT THE TRASH TRUCK HIT THE DITCH AND WENT INTO MY YARD. ACCESSING THAT MANY MORE OHOMES SEEMS TO BE A PROBLEM. THANK YOU.

>> FURTHER PUBLIC COMMENT ON ITEM TWO?

NAME AND ADDRESS PLEASE, SIR? >> WILLIAM CRONEN.

I OWN THE SOUTHWEST PARCEL THAT IS ADJACENT TO THIS PROPERTY.

I WANT TO SAY I KIND OF SUPPORT CONCEPTUALLY IT IS GREAT THEY DID A GREAT JOB. I SHARE MELISSA'S CONCERN OTHER THAN HER FAMILY, I HAVE BEEN TRAVERSING THAT THING, MY SON AND I GOING BACK TO OUR PROPERTY FOR 17-18 YEARS NOW.

QUESTION THAT I HAVE IS WHAT IS GOING TO BE DONE THERE? GRAVEL ROAD IS A CONCERN. I GUESS THE ENGINEERING IS A CONCERN. SO THAT IS ALL I WANTED TO SAY.

I AM SUPPORTIVE OF IT. I THINK IT IS A GREAT IDEA.

VERY APPROPRIATE FOR THE AREA. THEY HAVE DONE A GREAT JOB.

MATTHEWS DESIGN. I WOULD LIKE TO HEAR MORE IT IS A BIG CONCERN. IT IS CAVED IN.

WE HAVE HAD A LOT OF ISSUES. THAT IS THE MAIN CONCERN.

>> THANK YOU. FURTHER PUBLIC COMMENT ITEM 2? OKAY. YES, SIR?

>> I DIDN'T SIGN IN? >> COLLEY STOL.

[01:20:06]

450 INDIAN RANCH BRANCH. I DON'T LIVE THERE.

THAT IS MY PROPERTY BEHIND MELISSA.

5180 SIESTA DELL RIO DRIVE JACKSONVILLE.

I AM TOTALLY IN AGREEMENT. I AM FOR THE DEVELOPMENT.

MY CONCERN IS THE ROAD ITSELF AND FUTURE -- I DO LIKE THE THOUGHT OF PEOPLE BEING ABLE TO ENJOY NATURE AND BIGGER LOTS AND THINGS LIKE THAT. THAT IS WHY I BOUGHT THE PROPERTY. MY ONLY CONCERN IS SEEING THE ENGINEERING. THANK YOU.

>> THANK YOU. >> REPRESENTING THE ST. JOHNS COUNTY CIVIC ROUND TABLE THIS MORNING.

I WOULD LIKE TO SUBMIT FOR THE RECORD LETTER WE SENT TO ALL COMMISSIONERS ON JULY 13TH WITH OUR CONCERN THAT THESE SIX SITES ARE GOING TO BE ON SEPTIC TANKS. WE FEEL IT IS ILLOGICAL TO HAVE NEW HOMES ON SEPTIC WHEN THERE ARE MULTIPLE CONNECTS FOR COUNTY, WATER, AND SEWER. ESPECIALLY WHEN OUR STATE LEGISLATIVE DELEGATION WORKING HARD TO GET FUNDS TO CONVERT FROM SEPTIC TO WATER AND SEWER. CERTAINLY REPRESENTATIVE CINDY STEVENSON HAS WORKED HARD IN THAT RECORD.

REPRESENTATIVE PAUL RENER MAKING IT A PRIORITY FOR HIS LEGISLATIVE TERM TO REQUIRE NEW FUNDS TO CONVERT FROM SEPTIC TO WATER AND SEWER. I WOULD LIKE TO SUBMIT THIS,

THANK YOU. >> THANK YOU.

>> JB CALADY. WEST AUGUSTINE.

I TRULY APPRECIATE THE NEIGHBORS THAT COME INTO THESE MEETINGS AND STATE THEIR CONCERNS. ESPECIALLY IF YOU HAVE BEEN LIVING HERE A LONG TIME. I WOULD HOPE WHEN YOU ALL MAKE YOUR DECISION ON THIS, THIS ROAD SITUATION WHICH HAS BEEN BROUGHT TO YOUR ATTENTION CAN BE SOME HOW HANDLED BEFORE THE CONSTRUCTION OF ALL OF THESE RESIDENTS WHICH THE NEIGHBORS ARE THERE DON'T HAVE OBJECTION TO.

SEEMS LIKE WHENEVER THINGS ARE DONE IN THE COUNTY, THAT THE FLOODING AND THE ROADS ARE CONSTANTLY BEING BROUGHT UP.

THIS IS AN OPPORTUNITY MAYBE FOR THE DESIGN TEAM AND THE DEVELOPER AND THE GOOD BUILDERS TO STEP FORWARD AND SOLVE A PROBLEM BEFORE IT IS CREATED. THAT IS WHY I SEE THINGS HAPPENING. I WANT TO TAKE A MINUTE AND TELL THE RESIDENTS THAT DO AND CAN COME INTO THESE MEETINGS, IT IS VERY IMPORTANT REGARDLESS OF WHAT THE RESULTS ARE FOR OUR ELECTED OFFICIALS AND OUR STAFF THAT WE PAY TO HEAR WHAT WE ARE CONCERNED ABOUT AND WHEN WE LOOK TO YOU TO HELP US LIVE IN A FIRST CLASS LIVING ENVIRONMENT HERE IN ST. JOHN'S COUNTY.

NOT JUST FOR THE PEOPLE THAT HAS A LOT OF MONEY BUT FOR EVERYBODY THAT LIVES IN THIS CONE. THANK YOU.

>> THANK YOU. >> FURTHER PUBLIC COMMENT ITEM 2

THAT COMPLETES. >> THANK YOU MR. VICE CHAIR.

PUBLIC COMMENT CLOSED. BACK TO THE BOARD.

COMMISSIONER SMITH? >> THANK YOU.

I WOULD LIKE TO ASK MISS SHANNON ACEVEDO TO COME BACK UP.

>> MISS SHANNON ACEVEDO, WOULD YOU CARE TO ADDRESS CONCERNS WITH DRAINAGE, COMPROMISED CULVERT ALREADY.

HAVE YOU LOOKED AT THIS, AS IT BEEN ADDRESSED AND HOW IT WILL

BE DEALT WITH? >> THANK YOU COMMISSIONER SMITH.

[01:25:03]

I DO APPRECIATE THE NEARBY RESIDENTS COMING IN AND SPEAKING. THESE ARE SOME OF THE THINGS WE TALKED ABOUT BACK IN OUR EARLY, GOSH IT WAS DURING COVID, DECEMBER 2020, NOVEMBER, COMMUNITY MEETING.

YES, WE WILL BE WORKING ON AN ENGINEERED PLAN FOR IMPROVEMENTS TO INDIAN BRANCH RAN ROAD AND COMPLY WITH THE SECTION OF THE CODE 60407B WHICH ALLOWS FOR EXISTING RIGHTS-OF-WAY TO MEET A CERTAIN STANDARD WHEN NINE OR LESS DWELLING UNITS.

PLAN IS TO PAVE FIRST 100 FEET. AS YOU HEARD THAT IS NOT REALLY THE WORST SITUATION OF THAT RIGHT-OF-WAY.

THERE IS AN AREA YOU CAN KIND OF SEE IT AS YOU COME DOWN, DO APPEAR TO BE WET LANDZ COMING THROUGH.

IT REALLY DOES NEED TO BE RECONSTRUCTED AND WHAT WE INTEND TO DO IS PROBABLY REPLACE A CULVERT THERE SO THAT THE WATER CAN MOVE FREELY WHERE THAT WETLAND STAND IS.

THE ACCESS HAS BEEN IN EXISTENCE A LONG TIME.

IN MY OPINION THIS IS A REAL OPPORTUNITY TO MAKE IT RIGHT AND BUILD IT RIGHT SO THAT IT HAS THE USE LTABILITY.

OUR PLAN IS TO PAVE FIRST 100 FEET AND 20 FOOT WIDE STABILIZE SERVICE ENOUGH TO SUPPORT AN ENERGY VEHICLE AND TURN AROUND FOR EMERGENCY VEHICLE. WE HAVE NOT GOTTEN INTO THE ENGINEERING JUST YET. WE WANTED TO MAKE SURE WE HAD THE LAND USE APPROVED FIRST. JUST TO GIVE YOU AN IDEA OF OUR NEXT STEPS FOR THE DEVELOPMENT WOULD BE TO START WORKING ON THE ENGINEERING AND ALSO YOU WILL SEE DETAIL ABOUT THAT, THOSE ACCESS EASEMENT IMPROVEMENTS BECAUSE WE ARE NOT ASKING FOR RELIEF FROM THE CODE REQUIREMENTS AS FAR AS THE DESIGN. THAT IS ONLY FOR UNPLATTED SUBDIVISIONS. WE WILL NEED A VARIANCE TO ALLOW FOR US TO COMPLY WITH STANDARDS. THIS WILL COME BEFORE THE BOARD ONCE AGAIN. BY THAT TIME, WE INTEND TO HAVE THE EASEMENT AGREEMENT IRONED IN.

WE HAVE A DRAFT WE SHARED WITH STAFF.

WE'LL BE WORKING WITH THE RESIDENTS TO MAKE SURE EVERYONE IS COMFORTABLE WITH EASEMENT AGREEMENT.

THIS IS AN OPPORTUNITY TO CONSTRUCT THAT PORTION OF THE ROAD THAT HASN'T BEEN GIVEN THE CARE IT NEEDS FOR A TRULY STABILIZE SURFACE FOR RURAL SUBDIVISION.

>> APPRECIATE THAT. >> TO ME, COMPATIBLE USE.

I LIKE RESTRICTION ON MAXIMUM UNITS AT SIX.

LOOKING AT NUMBERS IS NOT A PROBLEM.

ONE THING THAT CONCERNS ME WITH THE IMPORTANCE OF MAINTENANCE AS WELL AS CONSIDERATION OF DRAINAGE THERE SHOULD NEVER BE A COMPROMISE OR IMPEDIMENT TO EXISTING DRAINAGE.

WHETHER OR NOT THAT INCLUDES GREATER CAPACITY CULVERT SYSTEM THERE. ESPECIALLY I DON'T LIKE DEGRADING, I THINK IT OUGHT TO BE -- DON'T WANT TO COMPROMISE UPSTREAM LANDOWNERS REGARD TO ENHANCED DENSITY.

SOUNDS AT THIS POINT THERE NEEDS TO BE A CULVERT DUG UP.

THAT REMEDIED FAIRLY QUICKLY. I AM GLAD WE WILL HAVE AN ADDRESS OF THIS LATER. NEEDS TO HAVE GOOD ACCESS.

THAT IS PART OF THE REQUIREMENT LBR RATING 40 OR WHATEVER IT IS TO MAKE SURE IT CAN GET IN AND OUT.

THAT I DON'T HAVE CONCERN WITH. PAVING DOESN'T HAVE A CONCERN.

DRAINAGE DOES. THAT IS AN ABSOLUTE PRIORITY.

SHOULD NEVER BE COMPROMISED. I WANT TO MAKE THAT VERY CLEAR.

OUTSIDE OF THAT, I DON'T HAVE A PROBLEM.

THINK THAT NEEDS TO BE ADDRESSED.

APPARENTLY WILL BE LATER. THANK YOU.

>> THANK YOU. APPRECIATE THAT.

>> THANK YOU COMMISSIONER SMITH. COMMISSIONER WALDRON NEXT.

>> I HAD CONCERN ABOUT ACCESS AND DRAINAGE.

IT IS GOING TO COME BACK BEFORE US.

I FEEL BETTER ABOUT TODAY'S ACTION.

I FEEL IT IS A GOOD THING WITH SIX-LOT AMENDMENT.

[01:30:06]

OVER THE YEARS WE'LL BE GOING THROUGH A FAMILY FARM THING.

KIND OF LIKE TO SEE CHURCH ROAD BE UPDATED.

THAT IS NOT A CONCERN OF SIX HOUSES.

I HAVE TALKED ABOUT TO STAFF ABOUT DOING SIGNAGE AND SLOWING TRAFFIC DOWN. FROM WHAT I HAVE BEEN HEARING FROM RESIDENTS. AT THIS TIME IF WE GET ANOTHER

SHOT, >> COMMISSIONER DEAN NEXT.

>> I WANTED TO MAKE ONE COMMENT, I USUALLY, ALWAYS REALLY, LISTEN TO RECOMMENDATIONS AND ANY THOUGHTS FROM THE ROUND TABLE VERY CLOSELY AND VERY SERIOUSLY. IN RESPONSE TO THE LET IR -- LETTER SUBMITTED. I STILL FEEL REASONABLY COMFORTABLE, I -- IF IT WERE MUCH SMALLER LOTS, I WOULD QUESTION THAT. I DO TAKE THOSE RECOMMENDATIONS SERIOUSLY FROM THE CIVIC ROUND TABLE.

WITH MY EXPERIENCE FIVE ACRES VERY COMFORTABLE WITH DEALING

WITH SEPTIC TANKS. >> MOVING AWAY FROM ADVOCATING MOVING AWAY FROM SEPTIC TANKS. I UNDERSTAND THIS IS A SMALL DEVELOPMENT, COULD YOU ELABORATE ON THAT?

>> SURE. JUST FOR THE RECORD WE ARE NOT LOOKING FOR ANY KIND OF VARIANCE TO THOSE REGULATIONS.

WE'LL COMPLY WITH WHAT THE CODE REQUIRES US TO DO.

IT IS MY UNDERSTANDING THERE ARE NOT UTILITIES CLOSE BY WE COULD TIE INTO. COULD CERTAINLY REACH BACK OUT TO THE UTILITIES DISTRICT MY UNDERSTANDING IT WOULD BE MORE

THAN A HALF MILE AWAY. >> OKAY.

THANK YOU. ANYTHING FURTHER?

IS THERE A MOTION? >> I'LL MAKE THIS MR. CHAIRMAN, MOTION TO ENACT ORDNANCE 2020-452020-09 INDIAN BRANCH.

>> SECOND. >> WE HAVE A MOTION BY COMMISSIONER SMITH. SECOND BY COMMISSIONER DEAN, ANY FURTHER DISCUSSION? OKAY.

[3. Public Hearing * CDD AMD-2021-05 Trout Creek CDD.]

SEEING NONE, PLEASE VOTE. PASSES 5-0.

WE'LL SEE YOU ALL AGAIN. THANK YOU.

MOVE ON TO AGENDA ITEM NO. 3. THIS IS CDD AMENDMENT 2021-0 TROUT CREEK. GOOD MORNING.

>> MORNING. KATIE BUCHANAN FOR TROUT CREEK CDD 119 SOUTH MONROE SUITE 300AL HA -- TALLAHASSEE, FLORIDA. WHAT I WOULD LIKE TO DO IS WALK YOU THROUGH THE HISTORY OF CDD ESTABLISHMENT AND LEGAL FACTORS BOARD SHOULD CONSIDER. IDENTIFY CERTAIN FINDINGS AND CONCLUDE WITH QUESTIONS. SO BY WAY OF HISTORY, THIS BOARD ACCOMPLISHED CDD BOARD 2015. INITIALLY SIZED 997 ACRES.

DEVELOPER WANTED TO KEEP APPROVAL OF THE CDD AT A LOCAL LEVEL AS COMPARED TO THE STATE LEVEL.

THEN ADD ADDITIONAL 452 ACRES TO MAKE DISTRICT BOUNDARIES MATCH BOUNDARIES OF THE ASHFORD MILLS PUD ON EASTERN AND WESTERN SIDE OF THE DISTRICT. WE THEN WOULD WALK THROUGH THE CRITERIA. LET'S FIRST TALK ABOUT THE EXPANSION PARCELS. WHEN YOU LOOK AT THE GRAPHIC YOU CAN SEE THE HATCHED AREA, IDENTIFY PROPOSED EXPANSIONS.

[01:35:04]

AFTER AMENDMENT EXPECT 1450 ACRES WITHIN THE DISTRICT'S BOUNDARIES. WHAT I WANT TO EXPLAIN, BULK OF THE EXPANSION PARCELS INCLUDE IMPROVEMENTS FOR BENEFIT OF THE COMMUNITY. TRAILS, BOARD WALKS AND PARKS.

SOME OF THESE AREAS EASTERN SIDE INCLUDE WETLAND AND BUFFER AREAS. ALSO POINT OUT SMALL PORTION LIKE WASTE WATER, TRANSPORTATION AND STORM WATER IMPROVEMENTS.

ONLY EXPECTED TO SUPPORT UP TO 50 LOTS.

WHAT I WANT TO BE CLEAR, THIS DOESN'T CHANGE.

LOT COUNT PREVIOUSLY APPROVED. THESE 50 LOTS ARE APPROVED BY THE COUNTY. WE ARE IDENTIFYING ADDITIONAL LANDS TO LOCATE THOSE LOTS ON CURRENT BOUNDARIES OF PUD.

STATED DIFFERENTLY. DEVELOPER CAN PUT THESE 50 LOTS IN THERE. WHAT ONLY CHANGES AND WHETHER OR NOT THEY ARE INCLUDED IN THE DISTRICT'S BOUNDARIES.

WE WANT TO MAKE SURE WE ARTICULATE, IF YOU HAVE A NEIGHBORHOOD WITH CERTAIN LOTS IN THE BOUNDARIES AND CERTAIN OUTSIDE THE BOUNDARIES OF CDD'S. WE ARE CONCERNED WE HAVE THE PROBLEM. THOSE 50 LOTS WOULDN'T BE BUYING INTO NOR WOULD THEY HAVE THE CDD'S AMENDMENTS.

THIS IS A LONG-TERM MANAGEMENT PROBLEM FOR DEVELOPER, MARKETING AND DISTRICT ITSELF. WITH THIS ADDITIONAL CONTEXT, IF I COULD ADDRESS TO THE STATUTORY CRITERIA WE WOULD HAVE REVIEWED.

PETITION REQUIREMENTS LAID OUT ON POWERPOINT PRESENTATION.

DISTRICT HAS SATISFIED THOSE PETITION REQUIREMENTS.

ADDITIONALLY, WE HAVE CERTAIN FACTORS YOU ARE SUPPOSED TO CONSIDER AND REVIEW. THESE ESTABLISHMENT FACTORS WHAT YOU WOULD CONSIDER IF IT IS A NEW CDD.

WE HAVE TESTIMONY AVAILABLE TO CONCUR DISTRICT HAS MET ALL THESE CRITERIA. WHAT I WANT TO ALSO ADD TESTIMONY SPECIFICALLY NOTES EXPANSION OF CDD'S BOUNDARIES DOES NOT IMPACT THE PRIOR DEVELOPMENT ENTITLEMENTS GRANTED BY THE COUNTY. CDD DOES NOT HAVE THE POWER TO ADD UNITS, CHANGE UNIT TYPES OR ALTER ANY OF YOUR APPROVALS THOSE STAY WITH YOU. I WOULD NOTE WRITTEN CONSENT OF THE LANDOWNER FOR ALL THE LANDS INCLUDED IN THE PARCEL RECEIVED AND PUBLISHED NOTICE AMENDMENT IN ACCORDANCE WITH STATE LAW.

I WOULD ASK YOU CONSIDER ADOPTING ORDNANCE CONSIDERING EXPANSION OF THE CDD. I WANT TO ADDRESS CONCERN OF SPECIFIC RESIDENTS THAT RESIDE IN THE COMMUNITY.

I BELIEVE THERE IS A FEAR THIS IS GOING TO OPEN THE DOOR FOR CHANGE IN DEVELOPMENT RIGHTS WITHIN THE COMMUNITY.

I WANT TO EMPHASIZE DEVELOPMENT APPROVAL PROCESS AND CDD BOUNDARY PROCESS DIFFERENT ENTIRELY.

I AM HAPPY TO ANSWER QUESTIONS. I HAVE THE DISTRICT MANAGER, ENGINEER AND LAND OPENER REPRESENTATIVE.

IF WE HAVE QUESTIONS WE SHOULD BE ABLE TO ANSWER THEM.

ANY OTHER ITEMS I NEED TO ADDRESS AFTER PUBLIC COMMENT I

CAN COME BACK UP. >> OKAY.

THANK YOU. QUESTIONS AT THIS TIME FROM THE BOARD? SEEING NONE, OPEN UP TO PUBLIC

COMMENT. >> WE WILL NOW TAKE PUBLIC COMMENT ON ITEM 3 CDD AMENDMENT 2021 TROUT CREEK.

PUBLIC COMMENT, NAME AND ADDRESS, PLEASE, MA'AM.

>> HI MY NAME IS ANNA RYAN. I LIVE AT 325 BEEL AVENUE IN SHEER WATER. LAST YEAR AUGUST 4TH WE CAME BEFORE THE COMMISSIONERS AS A COMMUNITY OF SHARE WATER.

AT THE TIME ASHFORD MILLS WANTED TO INCREASE 716-785 AND CHANGE TO MULTIFAMILY TOWN HOMES. BUILT A 360 COMMUNITY OF RENTAL TOWN HOMES. NUMBER INCREASED TO 127.

MONTHLY RENTAL ON UNITS $2,205 TO $2,405.

NOW INCREASING 900 ACRES TO 1450 ACRES.

[01:40:08]

HOMEOWNERS TOLD IF THIS PETITION IS NOT ADOPTED KAYAK OUTPOST MAY NOT BE BUILT. SINCE MOVING TO SHEER WATER TWO YEARS I FEEL ASHFORD MILLS TROUT CREEK CDD HAS NOT BEEN HONEST WITH HOMEOWNERS. I AM CONCERNED THIS AMENDMENT IS PASSED BY THE COMMISSIONERS, IT WILL OPEN THE DOOR FOR TROUT CREEK TO NO. 1, INCLUDE LANDS UNDER CDD.

AND THEREFORE CDD WOULD HAVE MONETARY RESPONSIBILITY FOR ANY IMPROVEMENTS ON THIS LAND. MAINTENANCE, ADDITIONAL TRAILS, BUILDING KAYAK LAUNCH AREA TO ACCOMMODATE KAYAKS INSTEAD OF DEVELOPER INCURRING THESE COSTS. HOMEOWNERS WILL PAY THE COSTS WITH THE ADDITIONAL 550 ACRES. NO. 2 PETITION THE COUNTY AND BUILD MORE HOMES AND TOWN HOMES IN THOSE AREAS.

MANY HOMEOWNERS PURCHASE HOMES BECAUSE THEY ASSUME THEY HAVE CONSERVATION AREAS AND NATURE BEHIND THEIR HOMES.

THIS CAN HAVE EFFECT OF HOMEOWNERS LEAVING OUR COMMUNITY, NEW HOMEOWNERS CHOOSING THE COMMUNITY.

AMENDMENTS REQUESTED TO INCREASE NUMBER OF HOMES IN SHEER WATER.

NO. 3, PETITION COUNTY TO BUILD ADDITIONAL TOWN HOME RENTAL UNITS WHICH HAVE BECOME PROFITABLE.

TROUT CREEK CURRENTLY 127 VOTING RIGHTS IN OUR COMMUNITY AND NUMBER CAN CONTINUE TO GROW WITH INCREASED UNITS.

TROUT CREEK CDD -- I ASK THAT YOU PLEASE CONSIDER VOTING AGAINST AMENDING OVERALL BOUNDARY, THANK YOU.

I HAVE A QUESTION FOR YOU, ONE OF OUR HOME OWNERS COULD NOT BE HERE BUT ASKED ME TO READ HER OBJECTION TO IT, IS THAT OKAY TO

DO IT AT THIS TIME ALSO? >> MA'AM IF YOU COULD SUBMIT TO THE COUNTY ATTORNEY, THEY'LL MAKE SURE WE GOAT A COPY OF IT.

IF Y'ALL COULD GET THAT LETTER. >> FURTHER PUBLIC COMMENT, PLEASE. YES, MA'AM? GOOD MORNING. NAME AND ADDRESS PLEASE, MA'AM.

>> MY NAME IS CARLA JUSTICE, 155 BEEL AVENUE CLEAR WATER.

I REQUEST DENIAL OF TROUT CREEK CDD PROPOSAL AS WELL.

UNDERLYING REASONS LACK OF TRANSPARENCY.

WE HAVE NOT EVER KNOWN WHAT THE USE IS FOR, WHY IT IS REQUIRED NOW. 2014 ORDNANCE STATED WHATEVER LAND IS ADEQUATE. THINGS THAT WE DO NOW, HOWEVER OFFICERS OF THE CDD WHICH IS THEY ARE ALL CONNECTED TO THE DEVELOPER. WHOLE OBJECTIVE TO MAKE MONEY.

HARD TO BELIEVE EXPANSION WOULD NOT GENERATE MORE MONEY.

SEEMS TO BE A LOGICAL THING FOR ME.

BECAUSE THEY ARE LED BY THAT FINANCIAL INCENTIVE THERE WOULD BE SOME REASON THEY WOULD BUILD ON THAT.

THIS WOULD BE THE FIRST -- ONLY FIRST STEPS.

WE ARE TRYING TO STOP THAT NEXT STEP FROM OCCURRING IF THAT COMES UP. DEVELOPERS IF THEY DO BUILD MORE ON THERE, WE DO KNOW CERTAIN THINGS LIKE OUR AMENITY CENTER, 68 PARKING SPACES AND 47 GOLF CART SPACES.

THAT SERVES APPROXIMATELY 115 FAMILIES.

IT IS EXHAUSTING TO USE THOSE FACILITIES.

BECAUSE THE DEVELOPERS BUYING HOMES AND RENTING THEM UNDER 360 COMMUNITY, I JUST REITERATE, THEY HAVE MORE VOTING RIGHTS AND VERY STRINGENT ALREADY IN TELLING US WHAT WE CAN AND CANNOT DO. PEOPLE HAVE ASKED FOR BASKETBALL COURTS, ANSWER IS NO, NO DISCUSSION.

WE HAVE ASKED FOR RESEARCH ON ADDITIONAL PARKING, ANSWER IS NO. THOSE ARE THE PUSH BACK WE GET AND WHAT WE FEAR THIS IS JUST THE FIRST STEP FOR MORE THINGS

[01:45:04]

TO COME AGAINST THE COMMUNITY. THANK YOU.

>> THANK YOU. FURTHER PUBLIC COMMENT? ITEM 3. TROUT CREEK, YES, SIR?

GOOD MORNING. >> DON PREVERA.

FOR THE REASONS WELL STATED,IN THREE DAYS USING SOCIAL MEDIA SITE WE GATHERED 325 RESIDENTS ASKING YOU TO DENY THE REQUEST.

I WOULD LIKE TO SUBMIT IT. >> THANK YOU, PLEASE.

>> THANK YOU. >> FURTHER PUBLIC COMMENT ON

ITEM 3 YES, SIR? >> GOOD MORNING.

FRANK MURPHY, 247 DALTON CIRCLE ST. AUGUSTINE.

JUST TO ECHO WHAT YOU HAVE HEARD ALREADY, CONCERN I HAVE AS A RESIDENT IS THAT IF THE DEVELOPER INCREASED THE AMOUNT OF THE AREA BY ALMOST 50% OF WHAT IT IS TODAY, WHAT IS HIS, WHY IS HE DOING THAT? TO DONATE THE REST OF THE LAND TO THE COUNTY? TO THE CDD OR TO DEVELOP IT? IT IS A LOT OF ACREAGE. I REALIZE THAT WHAT IS BEING PRESENTED TODAY INCREASES THE BOUNDARIES, NOT TO APPLY TO BUILD MORE DWELLINGS. THAT WILL COME AT A LATER DATE.

I MEAN IT HAS BEEN MENTIONED BY A COUPLE OF FOLKS HERE, CREDIBILITY OF THE CDD. I SIT ON THE BOARD, I AM A RESIDENT BOARD MEMBER. THE BOARD HAS NOT BEEN THAT FORTHCOMING. HAS BEEN VERY UNCOOPERATIVE WITH THE RESIDENTS. I UNDERSTAND CDD IS NOT AN HOA.

RESIDENTS PAY ASSESSMENTS TO COVER CDD AREA.

WE HAVE LEGITIMATE CONCERNS ABOUT WHAT IS GOING TO HAPPEN NEXT IF THE COMMISSIONERS TODAY APPROVE THIS EXPANSION.

THANK YOU. >> THANK YOU, SIR.

COMMENT ON ITEM 3, YES, MA'AM? >> HI, ALSO A RESIDENT AT SHEER WATER, A LOT OF WHAT I WANTED TO SAY HAS BEEN REPEATED.

>> CAN YOU GIVE US YOUR ADDRESS 'E

>> 247 DALTON CIRCLE. WE ARE LIVING HERE TWO YEARS.

IN THE PAST, SAME THING CREDITABILITY, IN THE PAST THEY HAD INCREASED AMOUNT OF RESIDENTS FROM I DON'T REMEMBER THE EXACT NUMBERS, 2600 TO 2895 BY PUTTING A LITTLE R SIGN AND NO ONE NOON, BOOM, MORE UNITS. THEN THEY TRIED TO DO IT AGAIN NOT CHANGING THE NUMBER OF UNITS BUT THE WORDING OF THE UNITS AND TYPE OF UNITS SWITCHING TO TOWN HOMES AND RENTALS.

THEY KEEP DOING THIS KIND OF STUFF.

OUR CONCERN, THEY SAY IT IS ALL GOING TO BE OPEN LAND, TRAILS, HOPEFULLY MOST OF IT IS. CONCERN IS THEY ARE GOING TO PUT ANOTHER SIGN IN AND PUT MORE UNITS IN AS IT IS RIGHT NOW, AMENITIES, THE PARKING IS VERY LIMITED, DOES NOT HAVE ENOUGH CDD BOARD MEETING. ADDRESS PARKING.

ALL CONTINUOUS SPACE NEAR AMENITY CENTERS, WETLAND CAN'T BUILD ON IT. NOT FORTHCOMING.

AGAIN I UNDERSTAND THEY ARE TRYING TO MAKE MONEY AND DEVELOP THE LAND. WE ARE CONCERNED THEY ARE GOING TO TRY TO COME IN THE BACK DOOR AND DO THINGS WITH THIS LAND.

WE DO WANT LAND AND TRAILS AND OPEN SPACE.

IF THEY CAN PUT SOMETHING IN THERE THAT IS ALL THEY ARE GOING TO DO, WE WOULD HAVE NO PROBLEM. WE JUST WANT IT TO BENEFIT THE

[01:50:06]

RESIDENTS. >> THANK YOU.

FURTHER PUBLIC COMMENT? YES, SIR?

>> IF WE COULD, AS THIS GENTLEMAN IS COMING UP.

WE HAVE TWO PODIUMS. COME UP, LINE UP BEHIND THE PODIUMS, WE CAN HEAR FROM EVERYONE MAKE SURE WE HEAR ALL

YOUR INPUT. >> MORNING.

STEVE PINA. ANYONE ELSE THAT WANTS TO COME UP, LINE UP BEHIND THE OTHER SPEAKERS.

>> I WANT TO ECHO THE SAME CONCERNS EVERYONE ELSE HAD SO FAR. COMMUNICATIONS WERE A REAL PROBLEM. THEY WERE DOING THIS EXPANSION A LOT OF DISTRUST RIGHT NOW. LACK OF UNDERSTANDING WHAT THEY WANT TO DO.

IMPACTS WILL BE IS IT GOING UP 50% AS WELL? WE DON'T KNOW. THEY ARE NOT COMMUNICATING THAT.

>> SIR, I AM NOT SURE WE GOT YOUR ADDRESS.

SIR? >> 371 PINAR CIRCLE.

>> THANK YOU. THANK YOU, SIR.

>> YES, MA'AM? >> MY NAME IS KATHLEEN SIGH COWSKI, 180 RIVER CREEK TRAIL IN SHEER WATER.

I HAVE TWO QUESTIONS: I WANTED TO KNOW I DON'T KNOW IF I SHOULD PRESENT THE PAPER AFTERWARDS. IF YOU APPROVE CHANGE TO AMEND ADDITIONAL 550 ACRES DOES IT MAKE CHANGES TO THE BOARD MAKE UP AND TERM OF SERVICE? ANY CHANGE IN RESIDENTIAL UNITS REQUIRE A SEPARATE PLANNING BOARD HEARING.

CAN I PRESENT THESE QUESTIONS FOR FURTHER REVIEW?

>> CERTAINLY, ABSOLUTELY. IF YOU DON'T MIND OVER TO THE COUNTY ATTORNEY AND SEE IF WE CAN GET ANSWERS.

>> OKAY. THANK YOU.

>> THANK YOU. >> HI, 145 RIVER CLIFF TRAIL IN SHEER WATER. I HAVE BEEN CONCERNED, I HAVE GONE TO MANY, MANY OF OUR LOCAL MEETINGS.

THIS IS MY SECOND ONE SINCE HAS BEEN OPEN FOR US TO COME.

LIVED IN SHEER WATER SINCE 2019. MOVED HERE FROM NEW JERSEY.

WHEN I WAS SHOWN THE MAP AND AMENITY CENTER WHICH SHOWED RED LINES AND ALL THAT AREA MAINTAINED GREEN SPACE AND NATURAL AND NATIVE AND ALLOWING JUST TO FEEL LIKE YOU ARE OUTSIDE AND ABLE TO ENJOY WHICH IS ONE OF THE BIG THINGS OUR CDD OR DEVELOPER TALKS. TRAILS, WALKING, COMMUNITY.

EVERY TIME I HAVE GONE TO A MEETING AND I AM NOT A STUPID PERSON YOU PUT A QUESTION TO CDD BOARD MEMBERS OR TO THE BOARD, THEY DON'T WANT TO ANSWER IT. WE HAVE A LOT OF VERY INTELLIGENT PROFESSIONAL PEOPLE WHO LIVE IN SHEER WATER.

A LOT OF PEOPLE HAVE A LOT OF THE OF OPINIONS AND GOOD SUGGESTIONS. THEY DON'T WANT TO TALK TO US.

I AM VERY CONCERNED WHEN I AM - HEARING NOW WHICH WE HAVEN'T HEARD ABOUT 50 ADDITIONAL PARCELS.

WHERE ARE THEY? WHERE ARE THEY IN THOSE LITTLE SHADED LINES? HOW ARE THEY GOING TO IMPACT ME? I CAN TELL YOU I LIVE ON THE SKINNY SHADED SIDE.

I WAS TOLD I WOULD BE LIVING UNDER PRESERVE.

ARE YOU TELLING ME NOW I PAID THE MONEY I PAID IN 2019 BY MY BUILDER TELLING THAT WAS A PRESERVE.

NOW A CHANCE THEY MIGHT DEVELOP A LOT BEHIND ME? I AM CONCERNED IF THEY HAVE NO INTENTION OF IMPACTING THE PEOPLE WHO ALREADY LIVE HERE AND WHAT WE BOUGHT FOR, WHY AREN'T THEY BEING FORTHCOMING LETTING US KNOW EXACTLY THE PLANS FOR

THESE PARCELS, THANK YOU. >> THANK YOU, MA'AM.

>> ADDITIONAL COMMENT. >> ALTHOUGH YOU SPOKE IT WAS

[01:55:06]

ONLY FOR TWO SECONDS. DUMBFORD ERA.

349 -- CIRCLE CLEAR WATER. CONSIDER THE FILE SUBMITTED, 325 HOUSE HOLDS, RESIDENTS. NOT JUST SPOUSES.

IT IS SINGLE HOMES. IN JUST THREE DAYS.

I BELIEVE YOU GIVE US A FEW MORE DAYS WE CAN HAVE A THOUSAND.

THAT IS HOW CONCERNED THE RESIDENTS ARE BASED ON WHAT YOU HEAR EVEN NOW. WE ARE HOPING FOR A BETTER COMMUNICATIONS. WE WERE PROMISED A KAY YAK LOUNGE I DON'T KNOW WHY THAT WAS NOT PART OF THE REGIONAL.

IF THAT IS WHAT IT TAKES SO MANY OF US ARE WAITING JUST TO USE THAT AMENITIES. DOES WHAT IT TAKES TO APPROVE, MANY RESIDENTS SAY APPROVE, IF THAT IS WHAT IT TAKES TO GET THAT COMPLETED. IF NOT, WITHOUT INTRODUCTION TO THOSE VOTES BY 325 HOMES WAS EXPLAINING AND EVENING ATTACHING A COPY. ALL THOSE RESIDENTS ASKING, THAT

IS MY GOAL. >> THANK YOU.

ANY OTHER SPEAKERS THAT WANT TO SPEAK? APPROACH THE OTHER PODIUM. MY NAME IS GENIE BECK AND ANOTHER HOME ON 36 PERMIT COURT. I HAVE A BIG STAKE IN THE COMMUNITY. WE BOUGHT MY DAUGHTER A HOUSE AND WE BOUGHT THERE. WE PLANNED TO STAY A WHILE.

WHEN I ORIGINALLY BOUGHT THE HOME, REASON WE PICKED SHEER WATER WE WANTED ALL THE GREEN SPACE.

WE WERE TOLD THEY WOULD HAVE A KAYAK LAUNCH AND NAVIGATE THE RIVER. WE NEVER, EVER DREAMED THEY WOULD BE BUILDING MULTIFAMILY HOMES.

I NEVER WANTED TO LIVE IN A NEIGHBORHOOD WITH APARTMENTS.

I HAVE COUNTED TONS OF TOWN HOMES.

PLUS A LOT OF MY FRIENDS I HAVE MET LIVE IN THE RENTAL HOMES.

THEY ARE ALL BEING RENTED BY THE DEVELOPER.

THAT CONCERNED ME, TOO. I REAT LEAST $700,000 TO LIVE ON THIS STREET CALLED SEA HILL. MY CONCERN IS THE DEVELOPER, IF THEY EXPAND MAY FILL IN THAT LOW LAND AND BUILD.

AGAIN THERE IS NO TRANSPARENCY. WE DON'T KNOW WHAT THEY ARE GOING TO BUILD. WE DON'T KNOW IF IT IS MULTIFAMILY HOME. WHAT THE 50 UNITS ARE.

LOOKING AT THE TOWN HOME SECTION AND CONGESTION.

WE ALREADY NEED ANOTHER AMENITY CENTER AND ANOTHER SWIMMING POOL. DEVELOPER ISN'T PUTTING MONEY INTO THE AMENITY CENTER NOW. WE HAVE LIFE GUARDS DOING GARBAGE. WE HAVE THEM DOING CARE OF THE POOL CHEMICALS. WE HAVE THE LIFE GUARDS CLEANING THE BATHROOMS THERE. OUR AMENITY CENTER IS FALLING APART. I HAVE SEEN THAT AN ONLY LIVED THERE SINCE SEPTEMBER. IT HAS REALLY GONE DOWNHILL.

REALLY CONCERNS US. WE DON'T WANT TO EXPANSION.

WE WANT OUR NEIGHBORHOOD TO DO WHAT THEY TOLD.

AT LEAST 100 HOMES GOING UP IN THE BACK STILL.

THAT IS JUST WHAT WE SEE. I NEVER KNEW WE HAVE AN

[02:00:15]

AFFORDABLE HOUSING BACK THERE. IT IS JUST A MESS.

THINKING OF THEM EXTENDING IT EVEN MORE.

>> THANK YOU. MA'AM.

THANK YOU. >> APPRECIATE IT.

>> YES, MA'AM? >> BJ CALADY.

PETITION BEFORE YOU TODAY WILL INCREASE TROUT CREEK CDD BY ALMOST 50% CONSIDERABLE INCREAS TO THE SOOID SIZE OF OUR COMMUNITY. THIS IS WHAT WE KNOW FOR CERTAIN ONCE THE LAND IS INCORPORATED WE WILL HAVE NO CONTROL OR SAY WHAT IS DONE WITH IT. NO FLORIDA STATUTES THAT PROTECT HOMEOWNERS FROM DEVELOPERS. POSSIBLE OF OUR COMMUNITY IS SOMETHING NONE OF US WOULD HAVE CHOSEN TO PURCHASE HOMES.

DEVELOPER BUILT OVER 100 TOWNHOUSES IN OUR COMMUNITY AND POISED TO BUILD MORE. THEY HAVE CONTROL OVER OUR CDD, HOA AND NOW LANDLORDS. IT WOULD BE NAIVE US OF -- ONLY WAY WE CAN PROTECT OURSELVES IS ASK THAT YOU DON'T APPROVE THIS PETITION. ALSO ONLY WAY WE CAN INSURE NUMBER OF HOMES PLAN TO BE BUILT AND AMENITIES DOES NOT GET OUT OF BALANCE. WE ARE ALREADY AT THE LIMIT BORDERING ON OVERCROWDING IN SOME INSTANCES.

ALL OF THIS IS CRUCIAL TO SHEER WATER LIFE STYLE.

DEVELOPER PROMISED WHEN WE PURCHASED OUR HOMES.

PLEASE TURN DOWN THIS PETITION. MISS LYNN WOODY.

ADDRESS 331 BEEL. SORRY.

I WAS RUNNING OUT OF BREATH THERE.

I KNOW IT WAS HARD FOR EVERYONE TO PAY ATTENTION TO THAT.

I THINK A LOT OF PEOPLE CAN'T GET HERE.

IT IS GOOD YOU ALL FIVE OF YOU CAN READ THIS.

WHEN YOU DON'T TAKE THE TIME TO READ THESE COMMENTS INTO THE RECORD BECAUSE YOU HAVE TO MOVE EVERYTHING ALONG, I THINK IT IS DISTRACTING TO HAVE PEOPLE STAND IN LINE WHEN SOMEONE ELSE IS TALKING. THAT IS JUST MY OPINION.

I THINK THIS WILL NOW BE GIVEN TO THE ATTORNEY AND EVERYONE WILL KNOW ABOUT IT. SORRY I COULDN'T READ IT SLOWER.

THIS LADY HAD IT RIGHT ON THE MONEY.

I HAVE 29 SECONDS LEFT. WHAT SHOULD I DO WITH IT? I HAVE NO IDEA, LET'S MOVE THIS ALONG.

I THINK YOU NEED TO DENY IT AND GET MORE INFORMATION BEFORE YOU DECIDE TO DO WHAT THIS LADY WANTS YOU TO DO.

THANK YOU. >> I THINK THAT COMPLETES PUBLIC COMMENT AT THIS POINT. I WAS WRONG.

YES, SIR. >> VINCENT SIGH COWSKI.

IS ANYBODY GOING TO ASK A QUESTION TO THE TROUT CREEK REPRESENTATIVE IF SHE IS GOING TO DO ANYTHING ON THE 452 ACRES ARE YOU REQUIRED TO OR PRESENT IT LIKE SHE DID.

WE DON'T KNOW WHAT THEY ARE GOING TO DO WITH THIS.

I WOULD LIKE TO KNOW BEFORE YOU GENTLEMAN PASS THIS FORWARD.

IS THAT POSSIBLE? >> I AM SURE THERE WILL BE ADDITIONAL QUESTIONS FROM THE BOARD.

>> THANK YOU. >> I THINK THAT COMPLETES PUBLIC

COMMENT MR. CHAIRMAN. >> THANK YOU.

PUBLIC COMMENT NOW CLOSED. MR. MCCORMICK, I BELIEVE YOU WERE HANDED A LIST OF QUESTIONS, DO YOU HAVE THOSE?

>> YES. >> QUESTION WHETHER THE EXPANSION WOULD REQUEST CDD BOARD ITSELF.

I BELIEVE ANSWER TO THAT IS NO. EVENTUALLY IF THERE ARE SOME UNITS PLACED INTO THE EXPANSION AREA, OBVIOUSLY PROPERTY OWNERS IN THERE WOULD BE ABILITY TO VOTE.

MISS BUCHANAN IS MUCH MORE OF A CDD EXPERT THAN I AM.

[02:05:05]

THIS EXPANSION WOULD NOT ITSELF CHANGE THE BOARD.

IS THAT CORRECT?? >> THAT IS CORRECT.

EXPANSION IS NOT GOING TO ALTER BOARD MAKE UP.

THIS BOARD ALREADY STARTED TURNING OVER TO RESIDENT CONTROL TWO OF THE FIVE SEATS FILLED WITH RESIDENTS RIGHT NOW, 2022, FOUR OF THE FIVE SEATS WILL BE FILLED BY RESIDENTS.

IT IS TRANSITIONING IN ACCORDANCE WITH FLORIDA LAW.

>> MR. CHAIRMAN, IF I MAY, SECOND QUESTION HAD TO DO WITH INCREASED MULTIFAMILY OR ANYTHING ELSE, WOULD THAT REQUIRE A PLANNING BOARD REVIEW AND APPROVAL? IN FACT WOULD REQUIRE PGA RECOMMENDATION BACK TO THIS BOARD IF I MAY THROUGH THE CHAIR, DOI HAVE JUST A FEW QUESTIONS MISS BUCHANAN, IN THE AGENDA MATERIAL, I THINK THIS WAS BASED ON APPLICATION MATERIAL, GRAY HASH MARKS AND VARIOUS USES, SINGLE FAMILY, MULTIFAMILY, ETC.

SEEMS TO ME THAT THERE ARE JUST A FEW AREAS WHERE SINGLE FAMILY OR MULTIFAMILY EXTEND INTO THE PROPOSED EXPANSION AREA.

ONE MIGHT BE DOWN HERE. DO YOU HAVE A BETTER ONE? THAT SORT OF, I THINK THAT KIND OF SHOWS SOME OF THE AREAS WHERE IF THE BOARD APPROVES EXPANSION, MULTIAREA FAMILY HERE.

NUMBER OF UNITS WOULD NOT BE ABLE TO CHANGE.

THERE IS A VERY MODEST EXPANSION IN A SINGLE FAMILY.

JUST I THINK LITTLE TINY SPOTS ALSO.

SO IN OTHER WORDS, IT APPEARS THAT THE GREAT MAJORITY OF THE

EXPANSION AREA IS PROBABLY 97%. >> I AGREE.

WE CAN HAVE OUR ENGINEER COME UP.

BULK OF THE IMPROVEMENTS RECREATION OR OTHER USES.

SQUARES ARE THE ONLY AREAS WE ANTICIPATE THERE COULD BE LOTS.

AGAIN THESE LOTS ARE ALREADY APPROVED.

>> MISS BUCHANAN, WHY DON'T YOU HAVE YOUR ENGINEER COME UP AND

VERIFY THAT. >> SURE.

RYAN? >> GOOD MORNING, RYAN STILL WELL WITH CROSSER INC. THE AREAS INDICATED ON THE MAP CIRCLED IN GREEN TO THE SOUTHWEST PORTION OF THE DEVELOPMENT ARE EXISTING UP LAND AREAS AND WETLANDS THEY ARE SLATED FOR ADDITIONAL LOTS. PROXIMATE NUMBER OF LOTS APPROXIMATELY 50 LOTS. EVERYTHING ELSE --

>> SIR, WHEN YOU SAY ADDITIONAL LOTS YOU MEAN ON THE GROUND NOT

ALLOTMENT OR TOTAL? >> CORRECT.

WE ARE NOT INCREASING TOTAL NUMBER OF UNITS WITH THIS

REQUEST SIMPLY FOR CDD BOUNDARY. >> OKAY.

THANK YOU, SIR. ANY QUESTIONS? MISS BUCHANAN, I UNDERSTAND YOU ARE AN ATTORNEY REPRESENTING YOUR CANDIDATE. LET ME READ SOME THINGS, CONCERNS ABOUT IMPACT AND PROPERTY RIGHTS, THESE ARE AS WE SIT HERE AND LISTEN, THESE ARE TROUBLING COMMENTS WE HAVE RECEIVED NUMBER OF E-MAILS. OBVIOUSLY SIGNIFICANT DISTRUST HERE. I UNDERSTAND YOU ARE AN ATTORNEY REPRESENTING YOUR CLIENTS, YOU MAY NOT BE ABLE TO ANSWER THOSE, HOW DO YOU ANSWER THESE CONCERNS?

[02:10:05]

>> IN TWO PARTS. DISTRICT IS A PUBLIC BOARD WE DO HAVE REGULAR BOARD MEETINGS. THEY ARE ADVERTISED IN THE NEWSPAPER. THEY ARE ON THE DISTRICT'S WEBSITE AND HELD AT THE DISTRICT'S AMENITY CENTER BIMONTHLY. I SEE A LOT OF THE OF FAMILIAR FACES JUST AS THEY HAVE INDICATED THEY HAVE EXPRESSED CONCERNS. I THINK THE ONLY WAY TO ADDRESS THIS HONESTLY IS TO ACKNOWLEDGE THIS TRANSITION BETWEEN DEVELOPER AND WHAT WILL ULTIMATELY BE A RESIDENT-CONTROLLED BOARD IS NOT GOING WELL.

AT THE SAME TIME, I DO THINK WE HAVE MADE AN EFFORT AT A STAFF LEVEL TO BE FORTHCOMING WITH INFORMATION.

WE LIKE I SAID DURING THESE PUBLIC MEETINGS DO TRY TO PROVIDE LEVEL OF DETAIL REQUESTED CHALLENGING TO DEAL W WITH.

WHETHER THE LOT BEHIND THEIR HOUSE IS A GREEN SPACE OR DEVELOPED, I CAN'T ANSWER THAT ON THE FLY.

>> UNDERSTAND, THANK YOU. WE ARE GOING TO COMMISSIONER

SMITH NEXT. >> THANK YOU, MR. CHAIRMAN.

MISS BUCHANAN, IF THIS IS DENIED, HOW DOES THE DEVELOPER PLAN TO FUND IMPROVEMENTS IN CDD AREA.

>> THEY WOULD LOOK TO EITHER INTERNAL FINANCING SOURCE OR RE-EVALUATE IMPROVEMENTS ON THE TABLE.

THAT BEING SAID I WANT TO NOTE KAYAK LAUNCH REFERENCED IS HAPPENING. THAT IS NOT SOMETHING THE DEVELOPER IS WITH HOLDING. THEY HAVE PERMITTED AND ORDERED THE SUPPLIES JUST DELIED DUE TO LABOR SCHEDULES.

>> DOES IT LAY WITHIN THE EXISTING CDD?

>> IT DOES NOT. IF THE CDD DOESN'T INCLUDE LANDS

LIKELY TURNED OVER TO HOA. >> THANK YOU.

THIS IS A QUESTION ASKED AND PRETTY GOOD QUESTION: COULD AND WILL THE EXPANSION CREATE A FINANCIAL BURDEN UPON EXISTING

PROPERTY OWNERS? >> YOU ARE TALKING ABOUT OUTSIDE WALKING TRAILS, PLAYGROUND MAINTENANCE JANITORIAL, KAYAK LAUNCH. AT THE SAME TIME, THE RESIDENTS WILL GET THE BENEFIT OF THE USE OF THOSE AMENITIES AND ADDITIONAL 50 LOTS TO SHARE THOSE COSTS WITH.

>> IF THEY DON'T ALLOW -- IF THIS IS NOT ALLOWED, THOSE IMPROVEMENTS LIKELY NOT TO BE MADE? TALKING ABOUT THE TRAILS ANDS THOSE THINGS, THEN SEPARATE 50 THAT MAY NOT BE INSIDE THE CDD AS WELL?

IS THAT CORRECT? >> LET ME START WITH YOUR LAST POINT IF THE 50 -- IF THE LANDS THAT HOLD THE 50 UNITS ARE NOT WITHIN THE CDD'S BOUNDARIES, DEVELOPER WOULD HAVE TO MAKE A DECISION NOT DEVELOP THOSE UNITS OR DEVELOP THEM AS PART OF THE SHEER WATER NEIGHBORHOOD BUT EXCLUDE THEM FROM THE CDD.

THEY COULD MOVE FORWARD ON A PATH THEY ARE IN THE NEIGHBORHOOD NOT IN THE CDD. THEN DISCONNECT BETWEEN THOSE LOTS AND NEIGHBORS AS TO WHAT USES AND PRIVILEGES.

>> I WANT EVERYBODY ELSE TO UNDERSTAND.

COULD THE 50 BE BUILT WITHIN THE CURRENT CDD?

>> WE ARE REACHING THE END OF DEVELOPMENT LIFE CYCLE.

IT IS LIMITED. >> ONE LAST QUESTION, IN REGARD TO THE AREA IN QUESTION, HOW MUCH OF THIS PROPOSED AREA IS DESIGNATED CONSERVATION AND OR WETLANDS AND CANNOT BE DEVELOPED WITH ANY PREVIOUS CONTRACTS. WETLANDS OR CONSERVATION THAT

CANNOT BE DEVELOPED? >> I DON'T HAVE THAT.

LET ME ASK BRIAN OR MIKE. >> IF I MAY THROUGH THE CHAIR, COMMISSIONER SMITH, IF I MAY SUPPLEMENT YOUR QUESTION A LITTLE BIT. AT THIS TIME, ARE THERE KNOWN DEVELOPMENT PLANS THAT WOULD BE SUBJECT TO APPLICATION WITHIN

THE NEXT TWO YEARS. >> TWO CHANGE THE DEVELOPMENT

RIGHTS? SHEER WATER PUD? >> THAT IS CORRECT.

[02:15:06]

>> AGAIN I'LL DEFER TO MY DEVELOPER.

AS A CDD LAWYER, I AM NOT PRIVY TO THOSE.

>> THANKS, KATY. MIKE MCCOLLUM.

ON THE MAP AREA HERE WE ARE IN FINAL NOT EVEN DESIGN YET BUT PLANNING ON THIS AREA. THERE ARE SOME AREAS HERE THAT WILL BE LOTS NOT CURRENTLY IN THE CDD BOUNDARY.

THESE FOLKS WE MAY HAVE RESIDENTS OF SHEER WATER NOT MEMBERS OF THE CDD. FOR THE FACILITIES INSTRUCTED BY THE DISTRICT. SIMILARLY THIS AREA WOULD BE THE SAME THING. STARTING PLANNING HERE.

IN THIS SMALL AREA HERE, WE HAVE A FEW LOTS.

WE ARE DONE WITH DESIGN ENGINEERING.

SEVERAL LOTS THAT WOULD GO OUTSIDE THE DISTRICT BOUNDARY.

WE'LL HAVE TO WORK WITH STAFF. THIS WHOLE EASTERN EDGE, ZERO DEVELOPMENTS. AS YOU GUYS LIKELY KNOW WET LANDZ -- WETLANDS PERMITTING, PUTTING OTHER AREAS IN CONSERVATION. NOT ALL THESE AREAS ARE IN CONSERVATION EASEMENT YET. OTHER THAN THE THAT IS UPLAND.

REST OF THIS AREA IS CONSERVATION.

THEN WE HAVE A BOARD WALK DOWN TO TROUT CREEK.

LIKE KATY MENTIONED ORDERED KAYAK LAUNCH AND ANXIOUSLY AWAITING ITS ARRIVAL TO GET IT INSTALLED.

>> DEVELOPMENT ORDER MODIFICATION.

WITH DREW THAT AND DON'T HAVE PLANS TO SUBMIT ANOTHER ONE.

>> THANK YOU VERY MUCH. >> THAT WOULD BE EXPANDING A FOOTPRINT. THERE IS NO PROJECTED APPLICATION TO INCREASE NUMBER OF UNITS EARTH SINGLE FAMILY OR MULTIFAMILY FOR THE DEVELOPMENT AS A WHOLE? YES. THAT IS CORRECT.

WE HAVE PROCESSED ALLOWABLE LAND USE CONVERSIONS AND CURRENTLY ALLOWS UP TO 785 TOTAL TOWN HOMES.

WE DO NOT INTENT TO ASK FOR AN INCREASE.

>> OKAY THANK YOU, COMMISSIONER WHITEHURST NEXT.

>> 2875. >> HOW MANY HAVING FULL PERMITS?

>> WE HAVE PLATTED CLOSE TO 1500.

THOUSAND CLOSED TO RESIDENTS. PROBABLY ANOTHER 100%.

>> I JUST WANT TO COMMUNICATE ALREADY ENTITLED.

>> YES, SIR. WE HAVE MULTIFAMILY AS A BIG PORTION. ROLLING THAT OUT NEXT YEAR.

[02:20:11]

NOT CDD ISSUES. TRYING TO WORK TOWARDS CREATING ORDER. ALSO ANSWERING QUESTIONS.

A LOT OF CONCERNS BROUGHT UP LEGITIMATE.

OUR STAFF IS WORKING HARD TO ANSWER THOSE.

>> THANK YOU MR. MCCULL LUM. >> ANYTHING FURTHER FROM THE

BOARD? >> MR. CHAIR, BEFORE THE BOARD GOES INTO HIS DELIBERATION, I WOULD REMIND THE BOARD STATUTORY CRITERIA. THOSE ARE THE SIX FACTORS IN YOUR AGENDA PACKAGE ON PAGE EIGHT OF THE STAFF REPORT.

MENTIONED ELSEWHERE AS WELL. IN OTHER WORDS, THE APPLICATION, TESTIMONY, EVIDENCE HAS TO BE MATCHED IN THOSE SIX CRITERIA NOT OUTSIDE OF THOSE. I THINK WHAT THE BOARD COULD DO TODAY, IT COULD APPROVE REQUEST. I THINK IT COULD DENY THE REQUEST. IF IT DENIES THE REQUEST,SHOULD BE ABLE TO POINT TO ONE OF THOSE SIX CRITERIA NOT MET.

OR SHOULD THE BOARD WISH TO CONTINUE FOR FURTHER FACT FINDING THE BOARD COULD DO THAT AS WELL.

>> WE ARE GOING TO COMMISSIONER SMITH.

>> MR. MCCORMACK, STAFF REVIEWED EACH OF THESE SIX THINGS AND FOUND SUBSTANTIVE, VALID AND VERIFIABLE, NO ISSUE.

>> AS PER YOUR STAFF REPORT, STAFF REVIEWED EACH OF THESE, GO THROUGH THE FIRST ONE. STAFF FINDS INSUFFICIENTLY COMPACT TO SERVE AS FUNCTIONAL INTERRELATED COMMUNITY.

I COULD GO THROUGH EACH OF THOSE.

STAFF REVIEWED. >> EACH HAS READ IT.

WHEN I LOOK AT THIS, MORE OFTEN TIMES I HATE TO SAY WE PARTICIPATE IN MAKING SURE THESE ARE ACCURATE AND VERIFIABLE.

IN MY BRIEFING. I READ THE STAFF REPORT.

I FOUND IT TO BE VALID AND NOTHING HAS COME TO ME TODAY HAS SAID IT IS NOT. THAT IS WHERE I HAVE QUESTIONS, I WANT THE COMMUNITY TO HAVE MORE ASSURANCE THIS IS ACCURATE AND CORRECT AND LEGAL. ALSO THAT WHAT IS BEING INTENDED TO BE DONE IS NOT NECESSARILY HARMFUL TO THEM AS INDIVIDUAL PROPERTY OWNERS. THAT'S WHY I ASK EACH QUESTION.

I ASKED WHAT IF IT IS DENIED. >> THANK YOU COMMISSIONER SMITH.

COMMISSIONER DEAN? >> FOR THE REASONS MR. SMITH JUST STATED, I AM GOING TO EXPLAIN, IT IS MY UNDERSTANDING, MR. MCCORMICK, CLEAR DISTINCTION BETWEEN ENTITLEMENTS ON THE ONE HAND TO THE PROPERTY OWNER FOR LAND USE CHANGES.

THERE IS A CLEAR RELINE -- RED LINE.

CDD CONDUIT FOR FINANCING INFRASTRUCTURE OF A PLAN DEVELOPMENT OR APPROVED DEVELOPMENT.

SO WITH THAT SAID, IF I AM CORRECT, IF WE APPROVE CDD

[02:25:01]

BOUNDARY CHANGE TODAY, THAT DOES NOT IN ANY WAY SHAPE OR FORM INCREASE THE ENTITLEMENTS OF SINGLE OR MULTIFAMILY HOMES FOR THE PROJECTED. DID I HEAR 2900 ACRES? TO ME THERE IS MEETING THESE SIX CRITERIA TO APPROVE THIS.

IT IS NOT ADDING ANY NEW HOUSES, ANY NEW HOMES, NEW MULTIFAMILY.

NOTHING CHANGED WITH RESPECT TO THE FOOTPRINT ON THE GROUND IS

THAT CORRECT? >> THAT IS CORRECT.

IF I MAY ADD ONE MORE NOTE AS YOUR COUNCIL, I LISTENED TO THE APPLICANT AND THE RESIDENTS AND PROPERTY OWNERS WHO HAVE VALID CONCERNS. VALID CONCERNS ABOUT A NUMBER OF ITEMS. QUESTION IS, IS THAT WHAT IS IN FRONT OF YOU TODAY WITH STATUTORY SIX CRITERIA? THAT IS THE QUESTION I WILL TELL YOU AS YOUR COUNSEL, I AM NOT SEEING HOW THOSE FIT INTO THESE PARTICULAR ITEMS HERE.

I DIDN'T HERE MEMBERS OF THE PUBLIC SAY NO. 4, NO. 2, DOESN'T QUALIFY. I DIDN'T HEAR IT THAT WAY.

SO AGAIN. BOTTOM LINE IS, A LOT OF HEART FELT, VALID CONCERNS EXPRESSED TO YOU TODAY.

QUESTION IS FOR THIS TIME OF APPLICATION STATUTORY CRITERIA.

THEY ARE SET OUT IN YOUR AGENDA, THANK YOU.

>> THAT IS EXACTLY WHY I POSED THE QUESTION, I HEARD THESE VALID CONCERNS. I WANT TO MAKE SURE.

I WANT TO BE SHOTGUN SURE NOT ONLY NO INCREASE IN DENSITY, INCREASED UNITS THAT THESE INDIVIDUALS UNDERSTAND THAT IS THE CASE. THERE WON'T BE INCREASE.

CDD IS SIMPLY A CONDUIT FOR FINANCING INFRASTRUCTURE WHEN IT IS NEEDED. THAT IS MY UNDERSTANDING.

WHICH IS WHY I HAVE NO PROBLEM AGAIN MAKING A SECOND IF THERE IS A MOTION. THANK YOU MR. CHAIRMAN.

LDC AMENDMENTS FAMILY FARMS. >> FOR THE RECORD JOSEPH CEARLY.

THIS IS THE LDC AMENDMENT. BOARD POLICY REQUIRES TWO PUBLIC HEARINGS FOR LAND DEVELOPMENT CODE AMENDMENTS.

THIS IS THE FIRST HEARING. LITTLE BACKGROUND, AINRS LAND USE PLACE MULTIPLE SINGLE FAMILY DWELLING UNITEDS.

SECTION 60810 WHICH IS WHAT WE ARE LOOKING AT TODAY.

REQUIRES 39 ACRE LOT SIZE. CONSIDERED EXACT AMOUNT [INAUDIBLE] LIMITED TO A ONE-TIME USE FOR FARMERS.

ISSUE WITH FAMILY FARM PARCELS CANNOT LEGALLY SUBDIVIDE.

IF A FAMILY MEMBER PASSES AWAY, THEY TAKE ON BURDEN OF MORTGAGE OR TAXES. STAFF HAS HAD TO DEAL WITH, MEMBERS WISH TO MOVE ELSEWHERE AND SELL TO SOMEONE OUTSIDE THE FARM AND CREATES ILLEGAL SUBDIVISION OF LAND.

BOARD DIRECTED STAFF TO PROVIDE RELIEF TO FAMILY FARM OWNERS.

UPON DETERMINATION OF THE FAMILY FARM STATUS.

PARCELS CONSIDERED EXEMPT PARCELS AND MINIMUM LOT SIZE FOR INSTANCE ONE ACRE LOT SIZE. THEY WOULD BE PROHIBITED FROM CREATING ANOTHER FAMILY FARM. MINIMUM LOT SIZE FOR WORLD LAND USES FAR EXCEEDS WHAT OTHER COUNTIES PROVIDED IN LAND DEVELOPMENT CODE. STAFF PROPOSED TO REDUCE AI USE 39 ACRES TO 29 ACRES. PROVIDES FLEXIBILITY TO OWNERS OF NON EXEMPT PARCELS STILL PRESERVING AGRICULTURAL.

THERE IS NO MOTION. I BELIEVE THIS IS I DON'T KNOW THE POLICY, WE HAVE NEVER DONE THE TWO-MEETING.

IMAGINE WE WOULD ABORT THAT DISCUSSION.

FIRST HEARING OF THE ADOPTION HEARINGS FOR LAND DEVELOPMENT CODE AMENDMENTS. COMPREHENSIVE PLAN FOR ADOPTION 17TH. LITTLE BIT OF BOOK HISTORY APPROVED APRIL 2020. FLEXIBLE DESIGN STANDARDS, INCREASED DENSITY WITHOUT USE TO REZONE.

SOLD MAXIMUM SALES PRICE 210,000.

CURRENTLY 75,000. APRIL OF THIS YEAR, BOARD DIRECTED STAFF TO MOVE MAXIMUM SALES PRICE.

THIS 210,000 SALE PRICE ADOPTED AND PLACED IN THE COMPREHENSIVE PLAN AND LAND DEVELOPMENT CODE WHICH REQUIRES FOURTH PUBLIC HEARING WHICH WE REQUIRE FIVE HEARINGS.

ADDITIONAL DIRECTION GIVEN BY THE BOARD TO INCREASE THAT MAXIMUM SALES PRICE 210,000 TO 240,000 TO REFLECT RECENT RISE IN THE MARKET. THERE WAS AN OPTION PROVIDED TO YOU LAST TIME, UPON FURTHER RESEARCH, SO STAFF NARROWED IT DOWN TO FOUR OPTIONS, FIRST OPTION NOTATED IN STAFF REPORT, SOME PERCENTAGE OF THE INCOME THAT WOULD GET US TO 240,000 MAX SALES PRICE. WOULD GET US TO 240,000.

CONSTRUCTION COST INDEX CURRENTLY WHAT WE USE TO ASSESS IMPACT FEES ANNUALLY. PROVIDE FOR INCREASES AND DECREASES. THIS OPTION WOULD BE GIVEN 240,000 EVERY YEAR AND DWIGHT THE CONSTRUCTION COST INTO THE IN INDEX.

THIS WOULD RESTART. THIS WOULD BE THE OPTION.

OPTION NO. 3, USES CONSTRUCTION COST INDEX.

INCREASES AND COMPOUNDS ANNUALLY.

SIMILAR TO WHAT WE DO WITH OUR IMPACT FEES.

FOURTH OPTION PLACE NUMERICAL FIGURE 240,000 AND LAND DEVELOPMENT CODE AND COME BACK. THERE ARE OTHER OPTIONS.

ANOTHER OPTION WOULD BE TO LIMIT 210,000.

THIS IS A POLICY DECISION. STAFF IS HERE SEEKING DIRECTION ON THESE FOUR OPTIONS OR ALTERNATIVE OPTIONS BOARD MAY SUGGEST. THERE WERE NO COMMENTS RECEIVED.

THAT CONCLUDES THE PRESENTATION. >> COMMENTS FROM THE BOARD OPEN

IT UP FOR PUBLIC COMMENT. >> PUBLIC COMMENT ITEM 7 AFFORDABLE HOUSING INDEX. ITEM 7.

[02:45:09]

PEOPLE IS LUDACRIST. OPTION FIVE WHICH YOU DON'T HAVE CAME UP WITH ONE. USE 240,000 AS WORK FORCE HOUSING PRICE IN THE LDC. THEN DREVELOPERS CAN INCREASE SALES PRICE OF OTHER UNITS IN THEIR DEVELOPMENTS TO INCREASE THEIR BOTTOM LINE. THAT IS WHAT IT IS ALL ABOUT.

SO WE CAN HELP THE WORK FORCE 240,000.

THEN THE OTHER PEOPLE COMING HERE.

LIKE I HEARD THERE ARE 34,000 PEOPLE FROM NEW YORK CAME TO FLORIDA SINCE SEPTEMBER 2020. OTHER PEOPLE COMING HERE, TOO SO OPTION FIVE USE 240,000 AS WORK FORCE HOUSING PRICE IN LDC AND DEVELOPERS CAN TAKE UP THE SLACK AND SPEAKING TO WHAT MR. JOE SAID, THIS NO. 2 WHICH YOU ARE PROBABLY GOING TO GO WITH IS INTERESTING, BECAUSE YOU SEE, MAYBE IN 2021 IF THEY GET ANY BUILT, $246,240. NEXT YEAR, IT WILL BE $247,200.

I AM LOOKING FOR THE $250,000. I DON'T KNOW IF WE ARE GOING TO GET THAT FAR FOR WORK FORCE. IF WE DO, HERE ARE MY TRUE FEELINGS, STOP USING WORKING POOR IN THIS COUNTY TO PRETEND THERE IS WORLD CLASS LIVING HERE FOR EVERYONE.

IT ISN'T. IF YOU DON'T KNOW THAT, YOU NEED TO LET ME GIVE YOU A TOUR OF ST. JOHNS COUNTY AND CITY OF ST.

AUGUSTINE AND SEE WHAT IS HAPPENING TO THIS BELOVED COUNTY. ARE THERE ANY QUESTIONS? CAN WE GET UP TO 300,000 EVENTUALLY FOR WORK FORCE? IF WE DO SHAME ON ALL OF US. THAT IS NOT WORK FORCE.

NOT FOR THE PEOPLE LIVING IN THIS COUNTY.

>> ANY OTHER PUBLIC COMMENT. >> THANK YOU MR. VICE CHAIR.

PUBLIC COMMENT CLOSED NOW BACK TO COMMISSIONER DEAN.

>> MY PREFERENCE, I DON'T FEEL TERRIBLY STRONG.

I COULD LIVE WITH ALL OPTIONS. MY PREFERENCE AND WHY NO. 2, REASON I LIKE OPTION 2 IS THAT NO. 1, IT GOES BACK TO WHY WE HAD THIS DISCUSSION EARLIER THIS YEAR.

REFLECTED THE INCREASED AND COST OF BUILDING HOMES.

THAT IS WHY I THINK WE MADE THE CHANGE 210 TO 240.

THIS IS CAUGHT IN OPTION TWO. UNLIKE OPTION 3 DOESN'T COMPOUND ANN ANNUALLY.

IF WE NEED TO MAKE ADJUSTMENTS IN THE FUTURE WE CAN.

I KNOW WE ARE NOT VOTING TODAY. I WANT TO SEE IF ANY OTHER BOARD MEMBERS HAVE OTHER OPTIONS OR SHARE MY OPINION AS WE ASKED

Y'ALL TO GO FORWARD ON THE 17TH, >> YES.

>> THANK YOU SUPERVISOR CHAIR. COMMISSIONER WALDRON.

THEN COMMISSIONER WHITEHURST. >> I LIKE OPTION ONE.

I LIKE STAYING AT 210,000. MAY NOT BE AN OPTION.

SOME OF THE THINGS I WANT TO CITE, PEAK OF LUMBER PRICES THEY HAVE DROPPED 68%. DROPPED 40% MONTH OF JUNE.

ACCORDING TO FORBES MAGAZINE. CAN THAT CCI BE NEGATIVE?

WOULD WE GO DOWN ON PRICE? >> CCI OPTION TWO WOULD NOT START EVERY YEAR 240,000 AND INCREASE BY CCI THAT YEAR.

>> HAVE WE EVER SEEN IT BE A NEGATIVE FIGURE?

>> YOU KNOW I TALKED ABOUT TO HOWARD WHITE THIS MORNING.

WHEN THEY DO ENTRY LEVEL EVALUATION FOR PERMITTING THEY USE FIGURE $79 A SQUARE FOOT. THAT DOES NOT INCLUDE LAND

[02:50:03]

PRICE. PREMIUM SMALLER UNIT.

ADD TO 1400 SQUARE FEET. I JUST THINK IF WE HAD TO KEEP IT DEVELOPER DOESN'T WANT TO DO WORK FORCE HOUSING, THAT IS THEIR CHOICE. WE MET THEM AT THE BEGINNING, 210 AGREED ON IT WILL TAKE TIME FOR THAT PRICE TO COME BACK DOWN AND WHAT THEY ARE BUYING. IT HAS DROPPED 68%.

WE ARE GOING UP IN PRICE NEVER BUILT.

WE USE CCI. 240 WOULD NEVER BE DONE AT THAT.

SO I MEAN, WE CAN KIND OF WORK ON WHAT WE THINK THE PRICE CAN BE. I DO LIKE OPTION 1 BETTER.

WE GET UP TO 75,000. THAT IS GOING TO BE PRETTY CLOSE HAVE TWO TEACHERS LIVING TOGETHER, BARELY MAKING THAT.

THIS IS SOME OF THE ISSUES WE HAD HERE.

I DON'T 100% HOW WE DO A1A. EVEN IN THE HUD STUFF, WE ARE

INCORPORATING IT. >> THANK YOU.

COMMISSIONER WHITEHURST NEXT. >> THANK YOU MR. CHAIRMAN.

I THINK LIKE COMMISSIONER WALDRON, I WANT TO MAKE SURE THERE IS AN OPTION FOR US TO COME DOWN, JUSTIFICATION FOR WORKFORCE HOUSING, GONE UP DRASTICALLY.

COMMISSIONER WALDRON CONFIRMED LUMBER IS IN FACT DOWN.

I WOULD LIKE TO SEE US MODIFY THIS INDEX THAT WOULD PERHAPS WEIGH DID HE RECALL -- MATERIAL COSTS.

I DON'T PRETEND IT IS EASY. BIGGEST OBSTACLE TO ANYBODY EARLY IN PROFESSIONAL CAREER OR BLUE COLLAR WORKER, DIFFERENCE $42,000 DOWN PAYMENT AND $48,000 DOWN PAYMENT COULD BE A YEAR OR LONGER OF SAVING. TAKING A LONG TIME FOR PEOPLE TO SAVE THAT KIND OF MONEY. I AM SENSITIVE TO THAT.

I WOULD LIKE TO SEE AN OPTION FOR COST OF WORK FORCE HOUSING COULD GO DOWN SHOULD MATERIAL COSTS DECREASE SUFFICIENTLY.

>> I AGREE WITH COMMISSIONER DEAN.

I AGREE WITH COMMISSIONER WALDRON AND COMMISSIONER WHITEHURST. UP TO THREE PERCENT DECREASE.

I THINK THERE IS GOING TO BE FLUCTUATION OF LABOR AND BUILDING COST. ALLOWING FLEXIBILITY TO GO DOWN WOULD BE HELPFUL SO WE ARE NOT SEEING CONSTANT INCREASE.

DOES THAT MAKE SENSE? >> IT DOES.

WITH OPTION TWO, EVERY YEAR STARTS BACK AT 240,000.

WE PUT IT IN, THERE INITIAL THOUGHT, 240,000 INCREASES BY LITTLE BIT THAT YEAR. REFLECT THE COSTS.

HOWEVER REVERTS BACK TO 240,000 EVERY YEAR.

NEXT YEAR 240,000 TIMES THE CCI. >> RIGHT.

BUT WE DON'T KNOW WHAT THE ECONOMY WILL BE LIKE DOWN THE ROAD. COULD GO BELOW 240,000.

I WOULD LINKE TO SEE A BOTTOM OT CAP.

UP TO 3 PERCENT DOWN BASED ON WHERE WE ARE AT.

A LOT OF THIS IS PERSPECTIVE. A LOT OF US HAVE MORE FLEXIBILITY. COMMISSIONER DEAN?

>> I HAVE NEVER BEEN GOOD AT MATH.

WHEN I READ OPTION TWO CONSTRUCTION COST INDEX INDICATOR -- I WAS ASSUMING IF WE START ADD 240, WE COULD GO DOWN FOLLOWING YEAR IF THE COST OF CONSTRUCTION ITEMS ACTUALLY

[02:55:02]

WENT DOWN THREE WHY WOULD THAT NOT GO DOWN?

>> THAT IS OPTION THREE. WHAT YOU ARE DESCRIBING.

>> I AM READING OPTION TWO. PAGE ISN'T NUMBERED.

WHY AM I READING OPTION TWO UNDER CONSTRUCTION COST INDEX AND OPTION ONE IN MY BOOK IS ANNUAL MEDIAN INCOME.

>> OPTION TWO CCI BASE MAX SALES PRICE $240,000 REPEATS EVERY YEAR. GRADUAL INCREASE OR DECREASE BUT HOVER AROUND 240. OPTION THREE, COMPOUND ANNUALLY.

IF THERE IS ONE PERCENT INCREASE IN CCI NEXT YEAR, IT WILL JUMP UP TO 245,000. MAX SALES PRICE.

TWO PERCENT INCREASE FOLLOWING YEAR JUMPS UP TO 252.

>> SO DO YOU AGREE OR DISAGREE WITH ME? I AM TRYING TO UNDERSTAND WHAT I AM SEEING IN OPTION TWO, PAGES AREN'T NUMBERED. PAGE TWO OF THE NARRATIVE SUMMER IF YOU WANT TO FOLLOW ME. PAGE 2 AT THE BOTTOM OF THE PAGE: OPTION 2, CONSTRUCTION COST INDEX CCI INDICATOR OF AVERAGE COST OVER TIME WITH REPRESENTATIVE GOODS IF THAT IS TRUE, IT COULD GO DOWN NEXT YEAR AS OPPOSED TO GOING UP.

>> CORRECT. >> I THOUGHT I WAS TOLD UNDER MY SUGGESTED OPTION TWO WOULD NEVER GO DOWN.

IF YOU UNDERSTAND MY QUESTION, AM I THAT CONFUSED?

>> I DON'T THINK SO. I THINK OPTION TWO CONFUSING, STARTS BACK AT INITIALLY 240 EVERY YEAR.

COULD GO DOWN. >> UNDER THE NEW NUMBERS, COULD

GO DOWN? >> CORRECT.

>> THANK YOU. >> JOE IS THERE A WAY TO MAKE THAT IN THERE? I THINK WE ARE ASKING THAT.

SEEMS UNCLEAR FROM THIS? >> I UNDERSTAND THAT.

>> OPTION THREE IS COMPOUNDING, BASE PRICE IS INCREASING.

WE ARE LOOKING FORWARD TO ADJUSTING DOWN.

LOOKS LIKE IT CAN. >> OPTION THREE AND SO COULD OPTION TWO. TWO CONSECUTIVE YEARS CCI DROPPED ALWAYS STARTS BACK AT 240.

WE THOUGHT IT WAS THE INTENT OF THE BOARD TO HOVER AROUND 240 WITH INCREASED LITTLE BIT OR DECREASED LITTLE BIT AND BACK TO

240. >> SURE.

I UNDERSTAND. WHAT IS NOT CLEAR OPTION TWO

THAT CAN DECREASE AS WELL. >> CORRECT.

>> IT IS NO LONGER UNCLEAR TO ME.

IT IS NOW CLEAR. >> MY NOW WE'RE CRYSTAL CLEAR. CAN WE CRYSTALLIZE THAT SO WE

CAN ADD SOME LANGUAGE? >> THERE WE GO.

>> YEAH, I UNDERSTAND WHAT YOU'RE SAYING HERE.

IT'S UP TO THE BOARD. IF YOU WANT TO START AT 240, THAT'S FINE. OPTION ONE IS WHAT I LIKE THE MOST. OPTION TWO IS FEASIBLE.

I DO NOT LIKE OPTION THREE AT ALL.

>> I AGREE. I'M NOT A FAN OF OPTION THREE.

BECAUSE IF YOU USE OPTION THREE TODAY, LET'S SAY WE APPROVED ONE TODAY, BY THE TIME THEY STARTED CONSTRUCTION, THEY COULD BE AT $253,000. IT WOULD BE A YEAR PLUS WHEN

THEY START CONSTRUCTION. >> COMMISSIONER SMITH.

>> THAT WAS GOING TO BE MY QUESTION, IS THAT WE HAVE ONE OF THESE APPROVED ALREADY AS WE SIT TODAY IN THE PRESENT COMPOSITION

OF THE LANGUAGE. >> WELL, YEAH.

AND THEY'RE AT $210,000. AND SO THEY'RE UNDER THE OBLIGATION TO COMMIT TO CONSTRUCT AT THOSE VALUES TODAY.

IS THIS, THIS WON'T BE RETROSPECTIVE? THEY WON'T HAVE TO COME IN AND GET IT APPROVED?

>> NO. IF THIS IS APPROVED, THEY DON'T HAVE TO ADHERE AT THE MAX SALES PRICE UNTIL THE TIME OF PLATTING. AT THE TIME OF PLATTING, THEY COME IN AND THIS WAS APPROVEDA THE $240,000 OR $210,000, THAT'S

WHAT THEY WILL BE STUCK >> OKAY.

THANK YOU. >> OKAY.

THIS IS A DISCUSSION. DO Y NEED ANY MORE

CLARIFICATION? >> SEEMS LIKE WE'RE MOVING

FORWARD WITH OPTION TWO. >> WE COULD, I THINK THE ONLY

[03:00:02]

ONE THAT HAS, I DON'T WANT TO SAY RULED OUT BUT IS NOT, PROBABLY OPTION THREE. COMMISSIONER DEAN, YOU'RE NOT A

FAN. >> JOE IS LOOKING FOR CLARIFICATION SO HE CAN BRING US BACK SOMETHING ON THE 17 TO REACT TO. I WILL MOVE OPTION TWO.

IF THAT FAILS, WE CAN GO TO ANOTHER ALTERNATIVE IN MY

OPINION. >> DO WE WANT TO NARROW DOWN TO OPTION ONE? OPTION TWO?

>> I'M PREPARED TO MAKE A MOTION FOR OPTION TWO.

IF THAT FAILS, SOMEONE ELSE CAN MAKE A MOTION.

THAT'S WHAT I SUGGEST WE DO. >> I THINK IT JUST BEING A DISCUSSION ITEM, DO WE JUST WANT THEM TO BRING BACK OPTION ONE

AND TWO FOR CONSIDERATION? >> THAT'S FINE.

THAT'S FINE BY ME. >> COMMISSIONERS.

>> I THINK JUST FROM A DIRECTIVE STANDPOINT, WE DEFINITELY HAD A DISCUSSION AND IT SEEMS LIKE THERE'S A HARMONY FOR IT.

I WOULD LEAVE IT WIDE OPEN IF THERE'S CHANGES PEOPLE ARE NOT PIGEONHOLED. THERE MAYBE ANOTHER OPTION THAT PRESENT ITSELF AS WELL. IT SEEMS TO ME THAT THE MAJORITY OF THE BOARD IS MORE DESIROUS ON OPTION TWO.

I CAN TAKE OPTION THREE WAY OUT FOR ME ANYMORE.

NONETHELESS, WE LEAVE IT OPEN. I THINK YOU HAVE DIRECTION.

YOU HAVE DONE YOUR JOB. YOU BROUGHT IT TO US.

YOU NARROWED TO A PLETHORA OF OPTIONS.

[8. Fiscal Year 2022 Recommended Budget and Proposed Millage Rates. ]

THAT'S ALL YOU HAVE TO SAY. APPRECIATE IT.

>> SO WE'LL GO WITH THAT AND BRING US BACK OPTIONS AGAIN.

THANKS JOE, YOU HAD A HEAVY HAUL.

>> WE'RE GOING TO MOVE INTO OUR LAST AGENDA ITEM, ITEM 8.

FISCAL YEAR 2022 RECOMMENDED BUDGET.

>> GOOD AFTERNOON. I CAN DO IT.

GOOD AFTERNOON, OFFICE OF MANAGEMENT AND BUDGETS.

LARGELY HERE IS A PRESENTATION I PROVIDED TO JULY 20TH.

I WILL GO THROUGH THIS QUICKLY. THERE ARE MOTIONS IN TERMS OF ESTABLISHING PROPOSED MILLAGE RATES WE BRING INTO OUR HEARINGS IN SEPTEMBER. I WILL QUICKLY GO THROUGH THAT.

WE ARE UP TO THE SECOND TO THE LAST BUBBLE THERE.

THE ESTABLISHMENT OF THE PROPOSED MILLAGE RATES TODAY.

THEY WILL BE AT THEIR SEALING RATES.

THEY CAN ALWAYS COME DOWN AND WE WILL HAVE TWO PUBLIC HEARINGS IN SEPTEMBER, THE FIRST ONE TENTATIVELY 5:01 ON THE SEVENTH.

THE BOARD WILL CONSIDER THAT DATE TODAY.

AT THE RECOMMENDED BUDGET RIGHT NOW, WE'RE AT $1.1 BILLION, COUPLE OF CHANGES THAT HAVE COME IN SINCE THE BOARD APPROVED THE ADDITIONAL PENNY FOR TDT. THAT WILL INCREASE THIS OVERALL RECOMMENDED BUDGET AND THEN AS WELL, WE'RE GOING TO BRING INTO THE BUDGET THE CAP, THE MULTI-YEAR CAPITAL CARRY FORWARD GRANTS CARRY FORWARDS INTO THE '22 ADOPTED BUDGET.

FOR THOSE PEOPLE WHO WONDER WHY IT WENT FROM $1.1 BILLION TO LET'S SAY 1 BILLION PLUS, THAT IS THE REASON, WE'RE NOT ADDING, WE'RE PUTTING STUFF IN AT THE END.

WE'RE SIMPLY CARRYING FORWARD ITEMS THAT HAVE BEEN APPROVED BY THIS COMMISSION. GOING THROUGH THIS AGAIN.

WE'RE AT 9.27% TAXABLE VALUE WHICH EQUATES TO A LITTLE OVER $19 MILLION FOR OUR MILLAGE FUNDS.

WE HAVE THE BREAK DOWN HERE. AT 12.7 MILLION FOR THE GENERAL FUND. CERTAINLY A TIF PORTION.

ABOUT $280,000, $3.6 MILLION FOR FIRE DISTRICT.

TWO POINT, ALMOST $2.4 MILLION FOR TRANSPORTATION, TRUSTEES OF THE INCREMENTAL AMOUNTS AND $44,000 INCREMENTAL FOR THE HEALTH DEPARTMENT FUND. BECAUSE WE WILL BE DISCUSSING THE CONCEPT OF ROLL BACK RATE TODAY, I WANTED TO PROVIDE THOSE NUMBERS TO YOU IN COMPARISON TO WHAT THE INCREMENTAL REVENUES ARE AT THE 9.27 %. YOU CAN SEE THAT THERE IN THE SECOND COLUMN. SO, IF WE MOVE FORWARD WITH THE ULTIMATELY, THIS IS AT THE ADOPTED LEVEL WITH THE MILLAGE RATES AS THEY STAND TODAY, WE WOULD BE BRINGING IN AN INCREMENTAL 19. IF THE BOARD WENT AS FAR BACK AS TO THE ROLL BACK RATE, WE WOULD BE BRINGING IN AN INCREMENTAL $8 MILLION. CERTAINLY SOME MATERIAL DIFFERENCES THERE. IT IS ABOUT $10.6 MILLION REDUCTION. WE DID GO TO THE ROLL-BACK RATE

[03:05:03]

FOR CERTAINLY FOR CITIZENS WATCHING.

WE DID GO TO THE ROLL-BACK RATE LAST YEAR, AS I MENTIONED, IT WAS CERTAINLY AN EASIER THING TO ACCOMMODATE.

WE CAN BUILD ANY BUDGET, CERTAINLY THE BOARD WANTS TO PUT FORTH BUT THIS YEAR THERE CERTAINLY ARE REQUESTS IN THERE.

FTES, CAPITAL, LAST YEAR WHEN WE BROUGHT THE BUDGET FORWARD, AND AGAIN BECAUSE WHERE WE WERE WITH THE PANDEMIC, THE BCC SIDE OF THE BUDGET HAD CONTRACTED. WE WERE ACTUALLY LOWER THAN THE PRIOR YEAR. SO CERTAINLY IT WAS A LITTLE EASIER TO ACCOMMODATE GOING TO THE ROLL BACK RATE.

I'M PUTTING THAT OUT THERE BUT IF THE BOARD GOES INTO ANY LOWER MILLAGE RATES, WE WILL ACCOMMODATE REDUCTIONS IN OUR OPERATIONS. I TALKED ABOUT THIS CERTAINLY LAST TIME, OUR INDICATORS FUEL TAX, WE HAVE ANOTHER REMITTANCE THAT WILL COME IN AUGUST. WE WILL GET THAT REFLECTED IN SEPTEMBER. IF THERE ARE CHANGES FOR WHERE WE SEE SALES TAX, REVENUE SHARING IS CERTAINLY GOING UP.

CERTAINLY PAST FISCAL YEAR '19, LEVELS AT OUR HIGHEST OF HALF CENT SALES TAX AND AS A REMINDER, THE BOARD HAD APPROVED THE ADDITIONAL PENNY FOR TDT TAX.

WE WILL SEE THAT CERTAINLY GOING UP.

WE HAVE ONE MORE MONTH HERE. WE'RE GOING TO GO WITH HOW THE BEHAVIOR IS REALLY KIND OF A STATUS QUO.

CERTAINLY WE'RE DEALING WITH SOME LEVEL OF COVID RESPONSE AGAIN AND SO WE'RE NOT REALLY GOING TO TAKE ANY TACTIC AT THIS POINT. I THINK WE'RE AT A PRETTY GOOD SHAPE IN TERMS OF WHAT TYPE OF REMITTANCE WE RECEIVED TO DATE.

TALKED ABOUT THE BUDGET SUMMARIES.

WE WENT THROUGH THESE AT THE WORKSHOP.

WE BROUGHT IN SOME REDUCTIONS OF ABOUT $800,000 OVERALL.

THAT'S INCLUDING ACTUALLY INCREASE OF MAINTENANCE OF ABOUT $1.1 MILLION. WE ACTUALLY REDUCED SOME OF OUR POSITION REQUESTS. SOME OF OUR VEHICLE AND CAPITAL SUMMARIES TO THE TUNE OF ABOUT $1.9 MILLION OVERALL.

WE HAVE HIGHLIGHTED THE CAPITOL IMPROVEMENT JUST FROM AN AGGREGATE IN TERMS OF THE AMOUNTS THAT WE'RE ABLE TO FUND IN THE '22 PROPOSED BUDGET. WE TALKED ABOUT RESERVES AND CERTAINLY, OUR UNRESTRICTED RESERVES FOR THE GENERAL FUND AT THE CURRENT MILLAGE RATES PUTS US AT $20 MILLION.

JUST AS A COMPARISON THIS YEAR, WE UTILIZED $11.1 MILLION IN GENERAL FUND RESERVES AND I KIND OF AS A REMINDER, THIS IS WITHOUT ANY SORT OF HURRICANE RESPONSE.

SO, IN YEARS PAST, WE HAVE CERTAINLY HAD TO DELVE INTO THE GENERAL FUND RESERVES AND THAT IS THE RESERVE WE USE FOR THOSE TYPE OF RESPONSE EFFORTS. WE ARE ONE OF THOSE COUNTIES THAT DIDN'T HAVE TO GO OUT AND BORROW MONEY TO RESPOND IN PREVIOUS HURRICANE RESPONSES. SO CERTAINLY KEEPING A HEALTHY RESERVE IS CERTAINLY A GOOD INDICATOR FOR THE COUNTY.

SO TODAY'S CONSIDERATION REALLY IS TO ESTABLISH THE PROPOSED MILAGE RATES. THIS IS THE CEILING AND THE PURPOSE OF THIS IS FOR US ULTIMATELY TO KIND OF BEHIND THE SCENES IF YOU WILL, IS TO FILL IN WHAT ARE CALLED THE DR 420 FORMS AND SEND THOSE OVER TO THE PROPERTY APPRAISERS OFFICE AT WHICH TIME THE TRIM NOTICES WHICH WAS WHAT WE KIND OF CALL OUR DRAFT TAX BILL IS THEN GENERATED FROM THE INFORMATION TODAY. TO LET PEOPLE KNOW WHAT THEIR MAXIMUM PROPERTY TAX BILL WOULD LOOK LIKE GOING INTO THE NEW YEAR. AND THEN THE SECOND MOTION WILL BE ULTIMATELY TO ESTABLISH SEPTEMBER SEVENTH, 501 AS THE RECOMMENDED DATE FOR OUR FIRST HEARING.

WITH THAT, I WILL REFERENCE ASSOCIATED WITH THE MOTION ONE, IF THE BOARD WANTS TO GO WITH THE MOTION, I CAN CERTAINLY READ THOSE MILLAGE RATES INTO THE RECORD.

TWO RATES ARE INCLUDED IN HERE. AND LET ME TALK ABOUT THESE.

WE CERTAINLY HAVE THE GENERAL FUND.

WE HAVE TRANSPORTATION. THE HEALTH UNIT TRUST FUND, FIRE DISTRICT. WE HAVE A COUPLE LIGHTING DISTRICTS AND MSTUS, INCLUDES ST. AUGUSTINE SOUTH.

SUMMER HAVEN MSTU AND OTHERS THAT HAVE BEEN ESTABLISHED BUT THERE'S BEEN MOW LEVY TO DATE SIMPLY BECAUSE THERE'S NO FINAL PROJECT AND ASSOCIATED COST ASSOCIATED WITH THE PROJECTS.

[03:10:04]

WE DO HAVE TO REFERENCE THOSE. PONTE VEDRA BEACH DUNE RESTORATION. THIS IS A CALCULATION INTENDED TO EXPRESS AN OVERALL AVERAGE TAX RATE FOR THE TAXING INTENTITY. YOU CAN SEE THAT GOES UP AS A, IT'S AGAIN A COMPARATIVE RATE. IT DOESN'T PROVIDE ANY IMPLICATION OF WHAT THE TAXES WOULD, HOW AN INDIVIDUAL'S TAXES WOULD BE EFFECTED FOR INSTANCE IF YOU USE JUST AN AGGREGATE MILLAGE RATE ON ITS OWN, THE INCREMENTAL INCREASE IS DIFFERENT IF YOU'RE HOMESTEADED, IF YOU HAVE NON-RESIDENTIAL BASED ON WHAT YOUR TAXABLE VALUE REALLY IS WHERE YOUR PROPERTY TAXES COME IN. AS AN AGGREGATE MILLAGE RATE, IT'S JUST A SUMMARY RATE. AT THIS SUMMARY RATE AT EVERY $500,000 IN TAXABLE VALUE, IT'S $0.85.

THAT'S CERTAINLY NOT REFLECTIVE OF WHAT PEOPLE SEE ON THEIR INDIVIDUAL TAX BILLS. IT IS A REQUIREMENT OF TRIM TO REFERENCE THAT AGGREGATE MILLAGE RATE AND THE AGGREGATE ROLL BACK RATE AND I WILL READ IS THE MILLAGE RATE NEEDED TO BE LEVIED IN THE NEW FISCAL YEAR TO GENERATE THE SAME AMOUNT OF TAX DOLLARS AS ADOPTED IN THE PREVIOUS YEAR WITH SOME EXCLUSIONS FOR NEW CONSTRUCTION. AND THAT IS THE OVERALL WE'RE RECOMMENDING THROUGH THE ADMINISTRATOR'S RECOMMENDED BUDGET THAT WE MAINTAIN AT LEAST AT THIS LEVEL IN THE PROCESS THE SAME MILLAGE RATES THAT WE HAVE FOR FISCAL YEAR '21.

THE BOARD HAS AT ANY POINT DURING THE TWO HEARINGS TO LOWER THE MILLAGE RATES, THE RECOMMENDATION IS TO NOT INCREASE THE RATES, THERE ARE SOME TRIM REQUIREMENTS WE HAVE TO REPUBLISH AND RE-SUBMIT BACK OUT A NEW TAX BILL.

THERE IS CERTAINLY A COST WITH THOSE MAIL OUTS.

AT THIS POINT, IT'S REALLY UP TO THE BOARD IF THERE'S DISCUSSION OR YOU WANT TO GO STRAIGHT TO THE MOTION.

I WITH READ THE MILLAGE FOR THE RECORD.

>> OKAY. >> WELL, PUBLIC COMMENT AND

QUESTION? >> IS THERE PUBLIC COMMENT ON OUR PROPOSED MILLAGE RATE? ITEM 8? BJ KLATY, YES, VERY GOOD. THE GENTLEMEN CAN'T SEE THAT.

A COUPLE PEOPLE ARE STILL LEFT. ALL RIGHT.

AND READING THIS STUFF OVER AND I APPRECIATE MR. DUNN AND HIS DEPARTMENT MAKING EVERYTHING AVAILABLE FOR PEOPLE THAT DON'T HAVE A COMPUTER. THE PROPOSED MILLAGE RATE FOR OCTOBER 21ST-SEPTEMBER 2022 IS 6.8147.

WHICH IS .0017 MORE THAN THE OCTOBER 20TH THROUGH SEPTEMBER '21 MILLAGE RATE. WILL THE ROLL BACK ACCORDING TO THIS DOCUMENT UP THERE, WILL THE ROLL BACK RATE BE 6.5273? QUESTION ONE. AND TO REPEAT, SINCE SEPTEMBER 2020, 34,000 PEOPLE HAVE MOVED TO FLORIDA FROM NEW YORK.

OTHERS HAVE MOVED WHICH INCREASES THE PROPERTY TAXES THEREFORE LET'S GO WITH THE ROLL BACK RATE.

ON PAGE 332 OF THE BIG BOOK, WHICH YOU ALL HAVE AT THE WORKSHOP, IT SHOWS 3000 TRAVEL EXPENSE FOR DISTRICTS 1, 3, 4 AND 5. IS THERE A REASON WHY DISTRICT 2 COMMISSIONER SMITH IS NOT LISTED THERE? I WOULD LIKE AN ANSWER TO THAT ONE.

THE RECOMMENDED BUDGET FOR OCTOBER 2021 THROUGH SEPTEMBER 30, 2022, IS I WANT TO SAY IT OUT LOUD, FOR EVERYONE WATCHING, $1,103,735,077. I AM GLAD WE HAVE ALL THAT MONEY. AND MY LAST QUESTION IS WHAT WAS LAST YEAR'S RECOMMENDED BUDGET WHICH ENDED SEPTEMBER 21ST, DO WE HAVE THAT FIGURE YET MR. DUNN WITH YOUR MAGIC PENCILS? AND WITH YOUR GOOD HELP? AND I CAN'T SAY ENOUGH.

HE HAS HELPED US AND IF EVERYONE HAS A COMPUTER CAN'T GET THE

[03:15:06]

HELP I'VE GOTTEN. GET WITH ME.

I WILL SHOW YOU HOW TO DO IT. THIS IS BASICALLY ME QUESTIONS SO PEOPLE TRYING TO SEE THE THING, THAT'S ACTUALLY HERE AND LISTENING AT HOME WILL GET AN IDEA WHEN YOU BRING IT BACK TO VOTE ON IT. IF HE DOESN'T GET IT NOW, I KNOW I WILL GET IT LATER ON FROM MR. DUNN.

THANK YOU VERY MUCH. ANY OTHER PUBLIC COMMENT ON THE PROPOSED BUDGET? THAT COMPLETES PUBLIC COMMENT.

>> PUBLIC COMMENT NOW CLOSED. JOY, IF I MAY, I AM GOING TO ROLL OUT AND TALK ABOUT BEACH RENOURISHMENT.

THAT'S THINK ABOUT THAT. WHAT IS IN FRONT OF US ON THE OVERHEAD, THIS IS THE MILLAGE THAT JESSE, IF WE VOTE TODAY, THIS CANNOT GO DOWN, BUT CAN GO UP WITHOUT SENDING LETTERS TO INDIVIDUALS. WHAT WE DO TODAY CANNOT GO UP BUT CAN ONLY GO DOWN. MY QUESTION, JOY, IF YOU LOOK AT THE TWO MSTUS, YOU DON'T THINK WE WILL BE IN ANY POSITION OVER THE COMING FISCAL YEAR TO HAVE A PROJECT READY TO GO OR ESTIMATED BUDGET OF THE BEACH RESTORATION THAT WOULD REQUIRE ANY KIND OF ASSESSMENT THIS COMING FISCAL YEAR FOR EITHER OF THE MSTUS, THE BEACH RESTORATION? YOU FOLLOW MY QUESTION?

>> YES. >> AND THE ANSWER IS?

>> THE ANSWER IS, IT'S NOT GOING TO BE A HOLDUP FOR THOSE TWO PROJECTS AT THIS TIME WE REALLY DON'T EVEN HAVE A SOLID ESTIMATE TO BRING BEFORE THE BOARD FOR A MEANINGFUL MSTU DISCUSSION.

WE WILL BE IN A FEW WEEKS. AND THE TIMING IS NOT GOING --

>> SO A FEW WEEKS BEYOND TODAY, WE CAN'T COME BACK AND PLUG IN A NUMBER. I WANT TO BE SURE NEXT APRIL OR MAY, AND SAY OH, MY GOODNESS WE FORGOT TO PLUG IN A NUMBER AND SITTING HERE WITH A NUMBER DARE I SAY HAVE TO GO TO THE GENERAL FUND RESERVES ASSUMING I HAVE THE VOTES TO DO THAT.

I WANT TO RAISE TODAY SO IF THERE'S ANY QUESTION ABOUT MEETING PROJECT FUNDS NEXT SPRING WE, AT LEAST ADDRESSED IT TODAY AND SAID, NO, WE'RE PRETTY CERTAINLY WE DON'T.

>> I WILL TALK WITH JESSE DUNN. OUR DISCUSSION WE DECIDED THAT BECAUSE OF THE SOURCE OF MSTU THAT USUALLY IS ONCE IT'S LEVIED WILL BE LEVIED FOR THE FOLLOWING CALENDAR YEAR BASED ON THE PROJECTS AT THIS TIME. WE DON'T HAVE A GOOD PROPOSED MSTU TO OFFER FOR THE BOARD'S CONSIDERATION.

ESPECIALLY FOR THE NORTH PONTE VEDRA.

>> IT'S PRUDENT TO ASSESS THIS AND COLLECT FUNDS TO BUILD UP A

RESERVE? >> THAT WOULD BE JESSE'

QUESTION? >> YES, CHAIRMAN BLOCKER, WE HAD THIS DISCUSSION, I'M UNCOMFORTABLE PUTTING A MILLAGE OUT THERE WITHOUT, I THINK THE PROJECTS THAT THE CONCEPT OF PROJECTS ARE OUT THERE. THE COST OF THE PROJECTS.

THERE'S BEEN A MILLAGE THAT'S BEEN PUT OUT.

THAT CALCULATION IS TWO YEARS OLD.

DURING A TIME WE HAD SOME APPRAISED VALUES THAT WERE DOWN, I THINK WE NEED TO LOOK AT THIS THING UNDER WHEN WE RECEIVE UPDATED COSTS. THERE'S A MILLAGE THAT HAS BEEN OUT THIS TWO YEARS OLD. I DON'T KNOW IF THAT'S AN ACCURATE MILLAGE. THE IDEA OF THE MILL ACKNO ACKNOWLEDGES -- MILLAGE IS FOR PARTICIPATION. JOY AND I HAD A LOT OF DISCUSSIONS ON THIS. I THINK IT'S PREMATURE WITHOUT HAVING AN IDEA OF WHAT THE COST IS.

IF THAT'S NOT TO SAY WE HAVE TO HOLD THIS PROJECT UP AND JOY SAID IT BEST, IF WE FIND OURSELVES IN JANUARY AND FEBRUARY WITH A PROJECT THAT NEEDS TO MOVE FORWARD AND THE BOARD WANTS TO MOVE ON THE PROJECT, WE CAN CERTAINLY HAVE THE MSTU IN THE NEXT YEAR REPLENISHED WHATEVER WE HAD TO PUT FORWARD ON THEIR PARTICIPATION.

>> I'M JUST CAUTIOUS TAKING MONEY OUT OF THE CAREER FUND.

I THINK IT'S LIKE PLANNING FOR YOUR KID'S TUITION.

WE DON'T KNOW WHAT IT'S GOING TO COST IN 18 YEARS.

[03:20:03]

IT'S PRUDENT TO RESERVE AND SAVE FUNDS.

IF YOUR RECOMMENDATION IS NOT TO DO THAT, I UNDERSTAND.

I THINK MR. DEAN IS BRINGING UP A GOOD POINT.

THIS IS OUR OPPORTUNITY TO ADDRESS THAT.

WE KNOW IT'S GOING TO COST SOMETHING.

WE DON'T HAVE FINALIZED NUMBERS. I'M CAUTIOUS ABOUT CONTINUING TO DRAW FUNDS OUT OF THE GENERAL REVENUE.

I DON'T THINK THAT'S THE PURPOSE OF IT.

>> MR. CHAIR, IF I MAY CHIME IN A LITTLE BIT AND BREAK THE TWO PROJECTS DOWN JUST FOR A LITTLE BIT OF DETAILED CONSIDERATION.

FOR THE PONTE VEDRA BEACH RESTO RESTORATION, THE BOARD DOES NOT HAVE THE OPPORTUNITY TO LEVY BECAUSE OF THE THREE MILES NORTH.

THE MSTU WOULD HAVE TO BE AMENDED FOR THE PROJECT TO MOVE FORWARD. BECAUSE OF THE NORTHERN THREE MILES IS BASICALLY REDUCED FROM THE INITIAL PLANNED PROJECT.

SO WE WOULD HAVE TO BRING THAT BACK.

FOR THE SOUTH PONTE VEDRA. WE HAVE A FOUR MILL DISCUSSION.

WE HAVE HEARD FROM THE COMMUNITY WHETHER OR NOT THAT IS EVEN STILL A VALID NEED FROM THE COMMUNITY, SO, REALLY JUST ECHO WHO JESSE SAID. IT'S PRUDENT FOR THE BOARD TO DELAY THIS DECISION OF THE MILLAGE SETTING SO THAT WE HAVE SOME TIME TO BRING BACK A LITTLE MORE UPDATED INFORMATION FOR

YOUR CONSIDERATION. >> SURE, I DON'T THINK WE MADE A FINAL DECISION ON THE NORTH THREE MILES.

THAT WAS JUST A PRELIMINARY ANALYSIS BASED ON THE NEEDS.

I DON'T THINK WE MADE A FINAL DECISION ON THAT

CLARIFY. >> YES, SIR.

>> DOES ANYONE SDIS DISAGREE WITH THAT?

>> WE JUST ASKED FOR Y'ALL TO COME BACK WITH RECOMMENDATIONS.

ANYTHING FURTHER ON THIS? ANY QUESTIONS? OKAY. IS THERE A MOTION?

>> >> LET ME ASK EITHER THE STAFF OR THE LEGAL, ARE WE AT A POINT. I'M PREPARED TO MOVE THIS.

REMIND ME, DO WE HAVE TO REACH EACH LINE?

>> NO. I DON'T THINK YOU DO.

YOU CAN REFER TO THE, YOU CAN -- I'M SORRY.

TO THE OVER HEAD. MAKE CLEAR YOU'RE REFERRING TO THE OVERHEAD INCLUDED IN THE STAFF REPORT.

>> SO, IF I CHOOSE TO MAKE A MOTION, I NEED TO READ IN EACH

OF THESE -- >> NO.

MOTION TO APPROVE THE PROPOSED MILLAGE RATES FOR FISCAL YEAR 2022 AS INDICATED BY THE STAFF CHART PRESENTED.

>> OKAY. GOOD.

I WILL MOVE TO ADOPT THE PROPOSED FISCAL YEAR 2022 MILLAGE RATES AS REFLECTED IN THE STAFF PRESENTATION ON THE

OVERHEAD. >> SECOND.

>> CAN WE HAVE A MOTION BY COMMISSIONER DEAN.

SECOND BY COMMISSIONER WHITEHURST.

ANY FURTHER DISCUSSION? SEEING NONE.

PLEASE VOTE. THAT PASSES 5-0.

>> THERE'S A SECOND MOTION. I WILL MOVE IF IF YOU WANT

JESSE. >> PLEASE.

THANK YOU. MOTION TO AUTHORIZE THE COMPLETION AND EXECUTION OF FISCAL YEAR 2022 DR-420 BY THE COUNTY ADMINISTRATOR WITH THE APPROVED PROPOSED MILLAGE RATES AND THE ESTABLISHMENT OF SEPTEMBER 7, 2021, AT 5:01 P.M.

RECLAIM THE PARK AND REPAIR THE RAMP. THE PEOPLE AT THE END OF THE ROAD HAVE IGNORED MR. WILL WE WENT TO THE SURVEY PIN WITH THESE PEOPLE AND I MENTION ABOUT THE VARIANTS ON THE DRIVEWAY.

WHILE HE GOT CAUGHT CUTTING DOWN MANGROVES, HE WAS GIVEN A SUNSET LANDING ADDRESS. LOW AND BEHOLD, HIS DRIVEWAY COMES UP ON PALMETTO ROAD 25 PEAT FROM THE BOAT RAMP, WHICH IS INSANE. IT'S INSANE.

BACK OVER YOU, WE HAVE TO WAIT FOR HIM TO MOVE HIS TRUCKS AND CARS OUT OF THE WAY TO USE THE RAMP.

AND ANY TIME YOU GO DOWN THERE, THAT'S CONSTRUCTION WORK GOING ON THERE. ANY TIME.

GO DOWN THERE TODAY THERE'S CONSTRUCTION TRUCKS EVERYWHERE.

AFTER THEY DID THE SURVEY, THIS GUY PULLED A SURVEY STAKES OUT OF THE GROUND AND THREW THEM IN THE GARBAGE AND IT WENT AROUND PUTTING REBARB AND TELEPHONE POST RIGHT NEXT TO THE ASPHALT WHERE YOU LAUNCH YOUR BOAT AND THEN WOULD CALL THE COPS AND SAY THAT YOU'RE TRESPASSING AND THEY CAME TO MY HOUSE A HALF DOZEN TIMES. WE NEED SHERIFF HARDWICK TO DO A CLASS ON TRESPASSING BECAUSE THEY HAVE HARASSED ME A HALF DOZEN TIMES AND I NEVER DID TRESPASS.

I HAVE BEEN LIVING THERE FOR OVER 20 SOMETHING YEARS.

AND HOW COME HERE YOU GO. ANOTHER TRAILER DOWN THERE.

MORE CARS. LOOK AT THAT.

THEY HAD STACKS OF PILINGS, THEY WOULD STACK PILINGS UP WITH NO BANDS AND WITH NO CONES AND DIDN'T GIVE TWO HOOTS ABOUT YOU IF YOU GOT HURT. TWO BY FOURS AND NAILS.

>> THROUGH THE CHAIR IF I MAY. >> LET ME SAY ONE OTHER THING.

I WENT TO USE THE BIG BOAT RAMP A MONTH AGO AND GOT ASSAULTED AND BEAT UNCONSCIOUS. HAD TO SPEND SIX HOURS IN THE EMERGENCY ROOM. I STILL AIN'T RIGHT.

>> I KNOW YOU FEEL STRONGLY ABOUT THAT.

AND I PAY TAXES TO MAKE SURE THAT DON'T HAPPEN.

>> WE LIMIT EVERYONE TO MINUTES.

>> THANK YOU SIR. >> THROUGH THE CHAIR.

MR. HENNESSEY, IF YOU WOULD LIKE TO SUBMIT THOSE INTO THE RECORD, WE CAN MAKE COPIES IF THEY'RE YOUR ONLY COPIES.

>> I HAVE TAKEN THEM TO YOUR OFFICE AND THE COUNTY

[03:30:02]

ADMINISTRATOR'S OFFICE AND I GOT THROWN OUT ON THE STREET JUST LIKE WHEN I WENT TO THE BUILDING DEPARTMENT.

I'M SICK OF THE LIES. SOMEBODY NEEDS TO COME UP WITH

THE TRUTH >> MR. HENNESSEY.

PROVIDE TO MR. MCCORMACK AND MR. BRADLEY, HAVE SOMEONE IN YOUR STAFF POINT HIM IN THE RIGHT DIRECTION.

>> ARE YOU GOING TO PROVIDE THAT TO THE COUNTY ATTORNEY?

>> OKAY. WE CAN USE THE ITEM THAT'S ON

THE OVERHEAD. >> OKAY.

FURTHER GENERAL PUBLIC COMMENT? >> B J KLATY, WEST CITY OF SAINT AUGUSTINE. I WAS JUST THINKING EARLIER ABOUT TROUT CREEK. YOU HEARD IT AT THE RIVER TOWN DRI. IS THAT THE SAME PLACE WHERE THAT MEMORIAL FROM THE CITY OF ST. AUGUSTINE DOWNTOWN PLAZA WAS RELOCATED IN 2020? AND IT WAS VANDALIZED.

I WAS SITTING BACK THERE WONDERING ABOUT THAT.

RECENTLY, A CITY OF ST. AUGUSTINE POLITICIAN IMPLIED 32084 WAS FOR THE CITY LIMITS OF ST. AUGUSTINE.

THIS ZIP CODE IS ALSO FOR AREAS IN THE COUNTY.

I'M TRYING TO GET A LIST OF THOSE TOGETHER BECAUSE WHEN IT WAS PRESENTED AT A MEETING, IT WAS ABOUT MONEY AGAIN.

SO, I JUST WANTED TO GET THAT ON THE RECORD.

AND I WILL CONTINUE TO SAY THIS, THE GENERAL PUBLIC COMMENT BELONGS AT THE BEGINNING OF THE BCC MEETINGS.

WE HAVE ANOTHER WORD THAT I WOULD LIKE TO SHARE.

GET YOUR PENS PEOPLE AT HOME, DISMISSIVE.

IT'S A SAD, SAD WORD. VERY SAD WORD.

AND SOMETIMES WE DON'T MEAN TO BE.

BUT, IT COMES ACROSS THAT WAY. SO, I HOPE WE WILL BE MORE RESPECTFUL OF EACH OTHER IN THESE MEETINGS AND IT'S HARD WHEREVER YOU THINK YOUR AREA WHERE YOU LIVE IS BEING DESTROYED. AND YOU CAN'T DO ANYTHING ABOUT IT. BECAUSE YOU CAN'T HIRE AN ATTORNEY. THAT'S WHAT YOU REALLY NEED IN THESE MEETINGS. BUT I DO APPRECIATE Y'ALL LISTENING AND I WILL BE BACK. I GOT 53, 52, WHAT SHOULD WE TALK ABOUT? ANYONE ELSE HAVE A QUESTION OF ME? I CAN ANSWER IT IN 45 SECONDS I'M SURE. THANK YOU VERY MUCH.

[Commissioners’ Reports]

>> THANK YOU. AND FURTHER PUBLIC COMMENT? GENERAL PUBLIC COMMENT? SEEING NONE.

MR. CHAIRMAN, THAT BRINGS IT BACK TO THE BOARD.

THANK YOU MR. VICE CHAIR. THANK YOU FOR THE PUBLIC COMMENT AND INPUT. WHY DON'T WE GO TO COMMISSIONER COMMENTS. COMMISSIONER SMITH?

>> THANK YOU, MR. CHAIRMAN. JUST A LITTLE FOOD FOR THOUGHT.

CORN HARVEST CONTINUES AND I HAVE HEARD REPORTS OF SOME ENORMOUS YIELDS. SOME 300 BUSHELS TO THE ACRE.

OVERALL AVERAGE IS IN EXCESS OF 200 BUSHELS PER ACRE.

THAT WON'T LAST LONG, STILL A VERY, VERY GOOD CROP THIS YEAR.

GROWERS HAD A GOOD PRICE AT OVER $5 OR BETTER PER BUSHEL.

THAT OUGHT TO BE A GOOD RETURN. SOD MOVES WELL.

NOT A LOT OF OTHER THING GOING ON THIS TIME OF YEAR EXCEPT BEGINNING TO PREP FOR YOUR WINTER CROPS OUR FALL CROPS SUCH AT CABBAGE AND COVER CROPS BEING KNOCKED DOWN.

IT IS WET. THE RAINY WEATHER MAKES IT CHALLENGING TO GET HAY CUT AND BAILED IN THE FARM.

THAT'S A NORMAL CHALLENGE. I WAS GOING TO BRING UP ONE OTHER THING. COMMISSIONER WALDRON, WERE YOU GOING TO DISCUSS THE FIND WITH CARL?

>> YOU COULD IF YOU WANT >> THAT'S IN YOUR WHEEL HOUSE AND I KNOW HE MET WITH A BUNCH OF US.

I WILL GIVE YOU A SUMMARY OF WHAT I HAD FROM HIM AND HIS REQUEST. I MET WITH CARL BLOED AT 10:00 A.M. AND DISCUSSED THE PALM VALLEY WEST BOAT RAMP AND THE PERMITTING. HE ENCOURAGED THAT THE BOARD

[03:35:02]

CONTACT OUR FEDERAL REPRESENTATIVES, RUTHERFORD, RUBIO AND SCOTT TO ASK THE ARMY CORPS OF ENGINEERS TO ISSUE A IMPORTANT. LAST YEAR BECAUSE OF THE PERMIT WAS NOT ADMINISTERED, WE HAD TO REAPPLY THIS LAST YEAR.

SO HE ASKED THAT MAYBE WE COULD TALK TO OUR REPRESENTATIVES TO TALK TO THE U.S. ARMY CORPS OF ENGINEERS TO EXPEDITE THAT GRANT. A $450,000 MATCH GRANT FOR PALM RIVER VALLEY WEST. I BRING THAT TO THE BOARD

CONSIDERATION. >> THANK YOU, COMMISSIONER SMITH. WHAT IS THE BEST WAY TO DO THIS?

WOULD A LETTER WORK? >> YES, YES, SIR.

>> CAN STAFF PREPARE THAT WE WILL GET THAT SIGNED.

IS THERE A CONSENSUS >> ABSOLUTELY.

>> YES. OKAY, WHY DON'T WE ASK FOR

PUBLIC COMMENT. >> FEEDBACK ON THAT.

>> PUBLIC COMMENT ON THE PROPOSAL TO SEND A LETTER TO OUR CONGRESSIONAL DELEGATION THAT WE REQUEST THEY ASK THE CORPS OF ENGINEERS TO EXPEDITE THE NECESSARY PERMITS WHICH HAVE BEEN UNDER REVIEW FOR SEVERAL YEARS TO EXPEDITE THE PERMITS PRIOR TO SEPTEMBER 20TH WHEN THE APPLICATION AND PERMIT IS DUE TO GET THE $450,000 GRANT. NO PUBLIC COMMENT.

>> THANK YOU. THERE VICE CHAIR.

YOU WILL HAVE YOUR >> YES, SIR.

GREAT. THANK YOU.

COMMISSIONER DEAN. >> WELL, MR. CHAIRMAN, I WANT TO COMMEND YOU FOR RUNNING A VERY I THINK BRISK YET FULLY OPEN MEETING TODAY. I THINK THAT YOU DO EVERYTHING THAT YOU CAN TO HEAR FROM EVERYONE, YET MOVE THE ITEMS ALONG AS QUICKLY AS POSSIBLE. TAKING IN EVERYONE'S TESTIMONY AND CONCERNS. ANOTHER OUTSTANDING JOB ON YOUR PART. YOU'RE TO BE COMMENDED.

>> THANK YOU THERE VICE CHAIR. APPRECIATE OUR STAFF AND OUR FELLOW BOARD MEMBERS AND WE'RE ALL WANT TO MAKE SURE WE'RE LISTENING TO EVERYONE AND I KNOW THE AGENDA IS LONG.

I APPRECIATE THAT, SIR. >> MR. WALDRON.

>> JUST ON ONE NOTE. I WOULD LIKE TO, WE HAD A RETIREMENT YESTERDAY. MS. KAREN BRUNER WHO WORKED FOR 31 YEARS I BELIEVE WITH THE COUNTY.

I WANT TO THANK HER FOR HER SERVICE.

I HAVE KNOWN HER FOR PROBABLY THAT LONG NOW.

SO, ALSO I DON'T KNOW WERE YOU GOING TO MENTION RYAN MURPHY? I WOULD LIKE TO CONGRATULATE HIM.

WON A GOLD, SILVER AND BRONZE IN SWIMMING IN THE OLYMPICS.

YOUNG MAN DRESSEL WHO HAS WON FIVE GOLD WHICH IS IMPRESSIVE

FOR NORTHEAST >>

>> THAT'S IT. >> THANK YOU.

NIRGZ COMMISSIONER WHITEHURST? >> THANK YOU, I WANTED TO HAVE MS. NOVAK COME UP AND ADDRESS THE RENTAL ASSISTANCE PROGRAM.

I KNOW WE VOTED ON THE GRANT TO HELP FOLKS OUT WITH THEIR RENT WHO ARE NEGATIVELY AFFECTED BY COVID-19.

COULD YOU TELL US HOW THAT'S GOING.

>> FOR THE RECORD, SHAWNA NOVAK, DIRECTOR OF HEALTH AND HUMAN SERVICES. AS YOU'RE AWARE, WE'RE CONTRACTED THE PROGRAM OUT TO WHIT O'BRIEN.

WE LAUNCHED THE PROGRAM THREE WEEKS AGO ON JULY 9TH.

SO FAR WE HAVE 75 APPLICATIONS AS OF LAST THURSDAY.

WE HAVE RECEIVED APPLICATIONS IN AN AMOUNT OF $213,000.

WE HAVE $5,000 THAT HAS GONE OUT AND ANOTHER $13,000 SITTING IN THE QUEUE TO GO OUT. THE MAJORITY OF THE APPLICATIONS ARE COMING FROM ZIP CODES 32084 AND 32086.

ANY OTHER QUESTIONS? >> YES.

I DO. I GUESS, MY CONCERN IS OBVIOUSLY WE'RE HAVING STAFFING SHORTAGES WITH THE REPUBLIC SERVICES.

WE'RE GETTING THAT EVERY DAY. HOW DO WE MAKE SURE THIS RENTAL ASSISTANCE PROGRAM ISN'T DEINCENTIVIZING PEOPLE TO GET BACK TO WORK? WHAT IS THE SYSTEM IN PLACE?

>> WE DID IMPLEMENT A CAP ON THIS.

THE ACTUAL TREASURY GUIDANCE ALLOWS YOU TO PAY IN ADVANCE UP TO 12 MONTHS OF RENT. WE DID NOT GO WITH THAT OPTION.

[03:40:03]

WE HAVE CAPPED IT AS WE DID IN SIMILAR PROGRAMS AT $5,000 PER HOUSEHOLD. AND THIS TREASURY PROGRAM FORCES YOU TO LOOK AT REARAGES FIRST. THE HOUSEHOLD CAN ONLY RECEIVE $5,000. WE ARE PREPARING DUPLICATION OF BENEFITS AS WELL. WE KNOW IF PEOPLE HAVE RECEIVED ASSISTANCE FROM THE PROGRAM LAST YEAR.

WE ARE SHARING INFORMATION TO MAKE SURE WE'RE NOT PAYING

DUPLICATIVE EXPENSES. >> I MEAN WITHOUT GETTING INTO SPECIFICS, PEOPLE HAVE BEEN ABLE TO DEMONSTRATE THEY HAVE BEEN ADVERSELY AFFECTED BY COVID-19? WE HAVE BEEN OPEN FOR A YEAR AND TWO MONTHS IN FLORIDA ESSENTIAL IN ST. JOHNS COUNTY.

>> I DID A PRECURSORY HEY CAN I GIVE ME THE REASONS WHY PEOPLE ARE STILL SAYING SOME PEOPLE HAVE, THEY HAVE RECENTLY CONTRACTED COVID AND THEY'RE OUT OF WORK AND THEY'RE BEHIND A COUPLE OF MONTHS. SOME PEOPLE ARE SAYING I HAVE EXHAUSTED ALL OF MY SAVINGS, I'M STILL STRUGGLING TO FIND EMPLOYMENT AND I'M JUNE AND JULY BEHIND OF 2021.

SOME PEOPLE ARE STILL SAYING THAT THE POSITIONS THAT THEY WERE IN THE BUSINESSES WENT OUT OF -- THEY CLOSED DOWN AND THEY'RE STILL STRUGGLING. THOSE ARE SOME OF THE REASONS

THAT WE HAVE SEEN. >> I APPRECIATE YOU AND YOUR STAFF. I KNOW IT'S A HEAVY LIFT.

OBVIOUSLY WE WANT TO HELP EVERYONE THAT NEEDS THE HELP.

THANK YOU FOR TAKING THIS ON. >> ANY OTHER QUESTIONS?

>> COMMISSIONER WALDRON NEXT. >> WOULD IT BE VIABLE? I'M ON THE CAREER SOURCE BOARD, WE HAVE A MEETING TOMORROW, WOULD IT BE VIABLE TO HAVE THAT BOARD CONTACT YOUR OFFICE TRYING

TO HELP THESE PEOPLE FIND JOBS? >> ABSOLUTELY.

WE'RE WILLING TO TALK TO ANY COMMUNITY PARTNERS.

THE CONSULTANT WHIT O'BRIEN HAS BEEN HAPPY TO SHARE INFORMATION WHEN WE SEND OUT CHECKS AND THINGS LIKE THAT.

THEY'RE GOING DIRECTLY TO THE LANDLORDS AND UTILITY COMPANIES.

>> COULD THAT INFORMATION BE SHARED ON WHO IT IS?

>> YES. >> MAYBE PUT IN THEIR BANK AND

CONTACT THEM WITH JOB OPENINGS. >> YES, BECAUSE WE SEND AWARD LETTERS AND CAN INCLUDE A LIST OF RESOURCES.

THAT'S SOMETHING SIMILAR WE DID LAST YEAR.

>> I WILL BRING THAT UP IN THE MORNING.

OKAY. THANK YOU.

ANYTHING FURTHER? OKAY.

SO, I JUST WANT TO BRIEFLY KIND OF RAISE THIS.

I THINK EVERYONE RECEIVED A COPY OF THE THIS IS A SUMMARY OF THE RESIDENTIAL WASTE COLLECTION ISSUE.

A WHITE PAPER WHEN OUR STAFF CREATED.

I WANT TO PUT THIS IN THE RECORD TO PUT THIS UP ON THE OVERHEAD.

ST. JOHNS COUNTY REPUBLIC SERVICES, WE ARE HAVING ISSUES WITH OUR YARD WASTE COLLECTION. I HAVE HEARD FROM NUMEROUS RESIDENTS IN THE COMMUNITY WHO HAVE CONCERN BUSINESS THIS.

SO THE STAFF HAS BEEN PROMPT IN TRYING TO ADDRESS THIS.

I WILL READ IT. WE CAN GO TO THE SECOND PAGE.

ST. JOHNS COUNTY REPUBLIC SERVICES EXPECTS THESE MEASURES TO RESOLVE THE CURRENT YARD WASTE DELAY.

UNFORTUNATELY, THE CURRENT STATE OF COVID-19 PANDEMIC CONTINUES TO HINDER THESE BENEFITS. REPUBLIC SERVICES EXPECTS TO BEGIN THE TRANSITION TO NORMAL YARD WASTE COLLECTION AND RESTORE ALL LEVELS BY OCTOBER. I WANT TO BE MINDFUL WE HAVE RESIDENTS WHO ARE PAYING TAXES EXPECTING THESE SERVICES.

I UNDERSTAND THE CHALLENGES OF THIS.

HOWEVER WE HAVE, THERE ALSO HAS BEEN A NOTICE SENT OUT TO BRING EVERYONE'S ATTENTION TO. NOTICE OF DEFAULT AND ASSESS LIQUIDATED DAMAGES. ST. JOHNS RESIDENTIAL WASTE FRANCHISE AGREEMENT AND WAS SENT TO MR. BRINKLEY AND SENT BY WINDY HICKS. I THINK IT'S IMPORTANT FOR US TO UNDERSTAND AS THE PUBLIC, OUR STAFF IS MAKING EFFORTS TO DEAL WITH THIS. BASED ON THIS LETTER, THIS IS A NOTICE TO REPUBLIC SERVICES, THEY ARE IN DEFAULT WITH THE FRANCHISE AGREEMENT. ANYTHING FURTHER TO ADD MR.

MCCORMACK? >> NO, MR. CHAIRMAN, AS YOU SAY, THERE'S THE NOTICE WHICH SETS OUT THE PROVISIONS OF THE

[03:45:03]

FRANCHISE AGREEMENT AT ISSUE AND THERE'S A POSSIBILITY OF LIQUIDATED DAMAGES AS WELL IF YOU SAW IN THE MEMO, THERE'S BEEN REQUEST THAT COUNTY STAFF PROVIDES ASSISTANCE AND INDICATED THE FULL COST FOR THAT STAFF NEEDS TO BE RECOVERED.

>> THANK YOU. I ONLY SPEAK FOR MYSELF BUT RESTORING ALL SERVICE LEVELS BY MID OCTOBER IS NOT ACCEPTABLE.

WE EXPECT THAT MUCH SOONER. WE WILL CONTINUE TO WORK ON THAT. DO YOU HAVE ANYTHING FURTHER?

>> YES. MISS HICKS HAS BEEN WORKING ON THIS TIRELESSLY. THEY HAVE GONE THROUGH EVERY

AVENUE THEY CAN. >> CAN YOU SPEAK -- THEY WILL CONTINUE TO WORK ON THIS EVERY DAY UNTIL IT'S

>> THANK DO YOU HAVE

>> OKAY. GREAT.

THANK YOU. WE WILL CONTINUE TO MONITOR THAT AND ADDRESS THAT. I JUST WANT TO NOTIFY THE BOARD THE COUNTY ADMINISTRATION VALUATION, I JUST COMPLETED THAT. I WILL BE DISCUSSING THAT WITH

>> CONRAD WHEN HE RETURNS FROM MILITARY DUTY.

COUNTY ATTORNEY HIRING COMMITTEE.

I KNOW COMMISSIONER SMITH AND DEAN HAVE BEEN WORKING HARD ON THAT. MY UNDERSTANDING IS THE APPLICATION PROCESS CLOSED A WEEK AGO, TWO WEEKS AGO.

>> THAT'S MY UNDERSTANDING. WE HAVE ALL THE APPLICATIONS IN AT THIS POINT. OUR HIRING COMMITTEE OF MR. DEAN

AND SMITH WILL EVALUATE THAT. >> WE HAVE A MEETING SCHEDULED

IN THE NEAR FUTURE. >> I ASKED MR. MCCORMACK TO PROVIDE ME AS A CHAIRMAN A LIST OF OUTSTANDING ISSUES.

WE HAVE SEVERAL COMING UP. REDISTRICTING THAT'S COMING UP.

THAT'S IMPORTANT. WE HAVE SEVERAL LITIGATION CASES AND OTHER PENDING MATTERS. MR. MCCORMACK IS WORKING ON A LIST TO PROVIDE THE BOARD AND GO FROM THERE.

WHOEVER THE NEW COUNTY ATTORNEY IS.

I WANT TO TAKE A MOMENT AND THANK OUR COMMITTEE AND CITIZENS, OUR PARTNERS IN THE COMMUNITY AND OUR STAFF FOR SUCH AN OUTSTANDING 200TH ANNIVERSARY CELEBRATION.

I THINK IT WAS AMAZING AND WELL PUT TOGETHER.

THIS CAME EARLY TO US AND OUR STAFF HAD A GREAT VISION FOR MAKING THIS INCREDIBLE OPPORTUNITY.

IT'S IMPORTANT TO RECOGNIZE HISTORY AND THE CONTRIBUTIONS OF SO MANY DIFFERENT PARTIES IN OUR COMMUNITY.

I REALIZE OUR STAFF WORK HARD BEHIND THE SCENES TO PUT THIS TOGETHER. YOU DON'T HAVE SOMETHING SO SPECTACULAR THAT HAPPENS OVER NIGHT.
