>> COMMISSIONER WALDRON? >> I HAVE NONE AS WELL.
LET'S OPEN UP PUBLIC COMMENT ON CONSENT AGENDA.
>> CONSENT AGENDA PUBLIC COMMENT.
>> GOOD MORNING. HOW ARE Y'ALL DOING?
>> WELCOME BACK. >> MISS ME? CALLING ATTENTION TO ITEMS 13 AND 23 MAYBE SCRUTINIZE THOSE LITTLE EXTRA. THIRTEEN APPEARS TO BE ORDINARY ROUTINE ITEM ABOUT APPROVING SURPLUSING.
WE SEEM TO DECLARE A LOT OF THINGS SURPLUS.
MAYBE WE SHOULD STOP BUYING ELECTRONIC STAPLERS AND EXTRAVAGANT LOVE SEATS. I WOULD LIKE TO SEE POLICIES LAID DOWN ON WHAT CAN BE SURPLUSED AND WHY ARE WE BUYING TOO MUCH STUFF? 125 MILLION DOLLAR BOND ISSUE DESERVES A PRESENTATION. IT IS FOR VICKERS LANDING FOR ELDER HOUSING. I AM SURE IT IS A GOOD BOND ISSUE. I THINK WE NEED TO HAVE CLEAR POLICIES ON WHAT SHOULD GO ON THE CONSENT AGENDA.
SHOULD THERE BE A DOLLAR THRESHOLD? POLICY THRESHOLD. THERE WAS AN ITEM WHERE YOU WERE BEING ASKED TO APPROVE CORPORATE WELFARE PAYMENT AND VOTED IT DOWN. SNEAKY STUFF HAPPENS.
MY LATE FRIEND SAID WATCH THE CONSENT AGENDA.
ALSO CALL YOUR ATTENTION ON ITEM 23, ARTICLE 2, SECTION 2.2 LETTER O. NON DISCRIMINATION INCOMPLETE.
ONLY APPLIES TO RACE, RELIGION, SEX OR NATIONAL ORIGIN.
WHAT HAVE THEY LEFT OUT AND WHY THAT INCLUDES AMERICANS WITH DISABILITIES ACT? PRESIDENT BUSH SIGNED AFTER IT WAS APPROVED UNANIMOUSLY. WHY WOULDN'T WE HAVE SEXUAL ORIENTATION SAID THE TERM SEX ENTITLES SEXUAL ORIENTATION AND GENDER IDENTITY. WE NEED TO SPEAK OUT FOR SENIORS. SURE THIS WAS WELL INTENTIONED.
OUR COUNTY ATTORNEY DONE LESS THAN ADEQUATE JOB IN TERMS OF DRAFTING DOCUMENTS. I WANT TO SEE THE WRITING SAMPLES. I WANT TO SEE WHAT THEY INCLUDE.
PUBLISHED ARTICLES AND SEE THIS COMMISSION JUST POSTPONE THIS.
>> THANK YOU, SIR. >> WEST CITY OF ST. AUGUSTINE, CONSENT 14. MARCH 16, 2021, SALVATION ARMY PROPERTY FROM THE COUNTY FOR $600,000.
TODAY CONSENT AGENDA ITEM 14 CHANGES PURCHASE PRICE TO $1,705,000 NOT $600,000. QUESTION ONE, WILL TURNSTONE PAY THE COUNTY FOR THE 1850 STATE ROAD 207 PROPERTY? CONSENT NO. 22. TURNSTONE DEVELOPER WILL APPLY
[00:45:08]
TO FINANCE CONSTRUCTION OF AFFORDABLE HOUSING.APRIL 27TH -- RENT AT $8,430.75 WHICH DOESN'T INCLUDE INCOME OF -- THEY WOULD HAVE TO EARN $16 AN HOUR.
DRAWINGS SHOW THREE STORY BUILDINGS.
HOPEFULLY THEY WILL NOT LOOK LIKE TENANTS OF U.S. 1 NORTH AND 312. WHERE ARE THE OTHER 18 AFFORDABLE UNITS. MR. HEARTMAN NEEDS TO ANSWER QUESTIONS ON THE RECORD IF COUNTY STAFF AND ELECTED POLITICIANS CANNOT ANSWER SIMPLE QUESTIONS.
THIS IS ONE REASON I AM SPEAKING ABOUT THE AGENDA BECAUSE THERE ARE TOO MANY THINGS PUT ON THEIR WITHOUT DISCUSSION BEFORE THE PUBLIC SO THE PUBLIC KNOWS WHERE OUR MONEY IS GOING AND WHAT IS BEING DONE ESPECIALLY IN THE AREA OF AFFORDABLE HOUSING.
ANY FURTHER PUBLIC COMMENT ON THE CONSENT AGENDA? YES, SIR, NAME AND ADDRESS, PLEASE.
>> GOOD MORNING. EARNESTO TORREZ.

MOTION BY COMMISSIONER DEAN SECOND BY COMMISSIONER
[1. Commercial Property Assessed Clean Energy (PACE) presentation. At the April 6 Board of County Commissioners meeting, the Board received a request from Attorney Erin Deady to initiate a commercial PACE program in St. Johns County. The Board requested additional information on the PACE program. Ms. Deady has prepared a presentation with information on the commercial PACE program, including background on the applicable law, steps to implement the program, and examples of PACE projects from around the state. If the Board were to direct staff to take steps to implement the program, staff would bring back a resolution and interlocal agreements for consideration at a future Board meeting.]
WHITEHURST SEEING NONE PLEASE VOTE.PASSES 5-0. FIRST AGENDA ITEM.
GOOD MORNING. >> GOOD MORNING, COMMISSIONERS, SENIOR ASSISTANT COUNTY ATTORNEY.
AGENDA ITEM 1 PRESENTATION BY ATTORNEY AARON DEEDY.
ALSO KNOWN AS THE PACE PROGRAM. AT YOUR APRIL 6TH IMMEDIATING ERIN DEADY SPOKE DURING PUBLIC COMMENT AND REQUESTED THAT THE COUNTY A COMMERCIAL PACE PROGRAM.
AT THAT TIME THE BOARD REQUESTED MORE INFORMATION ABOUT THE PROGRAM. MISS DEED ERIN DEADY IS HERE TO PROVIDE A PRESENTATION WITH ADDITIONAL INFORMATION.
>> IS THERE A CLICKER? >> GOOD MORNING.
MY NAME IS ERIN DEADY. I AM AN ATTORNEY WITH PET ROWS PACE FINANCE. WHAT OUR REQUEST IS OF YOU.
COMMERCIAL PACE HAS BEEN PRETTY ACTIVE THROUGHOUT THE UNITED STATES TWO BILLION DOLLARS WORTH OF FINANCING FOR BUILDING NEW CONSTRUCTION AND RETROFITS. BREAKS DOWN TO A LOT OF DIFFERENT PROJECTS. MOST PROJECTS HAVE BEEN IN ENERGY EFFICIENCY. FLORIDA'S PACE LAW PASSED 2010.
IT WAS UNANIMOUS OUT OF OUR FLORIDA LEGISLATURE WHICH WAS VERY RARE. THIS IS A VOLUNTARY PROGRAM.
[00:50:03]
PROPERTY OWNERS ARE NOT GOING TO UNDERTAKE FINANCING IF THEY CAN FIND CHEAPER FINANCING IN SOME PLACE ELSE.WHAT CAN BE FUNDED UNDER COMMERCIAL PACE.
ENERGY EFFICIENCY MEASURES, WATER CONSERVATION CAN BE MEASURED. CAPTURING CONDENSATION.
ROOFS, WINDOWS, THOSE TYPES OF THINGS TO FORTIFY A HOME FROM STORM DAMAGE. REPAYMENT ATTACHED TO PROPERTY TAX BILL IT IS A LIEN AND REPAID OVER THE FINANCING.
IT CAN'T EXCEED THE USEFUL LIFE OF THE PROJECT.
WE DON'T FINANCE A SIMPLE AIR CONDITIONER FOR OVER 25 YEARS.
WE USE UNIFORM METHOD OF COLLECTION THROUGH AGREEMENT WITH TAX COLLECTOR. I HAVE SPOKEN WITH MR. HOLINGS WORTH AND THIS IS ONLY A COMMERCIAL NOT RESIDENTIAL ONE.
MULTIJURISDICTIONAL PACE PROGRAMS FORMED THROUGHOUT FLORIDA. ST. JOHNS COUNTY WOULD JOIN THROUGH INNER LOCAL AGREEMENT. THAT WOULD BE THE MECHANISM TO LAUNCH PACE. PROJECTS THAT MAYBE LOOKING FOR ADDITIONAL FINANCING OR CHEAPER CAPITOL.
THIS IS SOMETHING THAT WILL PUSH INTO REALM OF FEASIBILITY.
THERE IS INSURANCE BENEFITS. MAKING BUILDING STOCK MORE EFFICIENT. AGAIN COMMERCIAL PROPERTY OWNERS THEY ARE GOING TO USE THE PROGRAM OR THEY ARE NOT.
WE DO HAVE DEALS THAT ARE READY TO GO WITHIN ST. JOHNS COUNTY AND REQUESTS. THIS IS SOMETHING THAT IS GOING TO SAVE THE BUILDING OWNER MONEY ON OPERATIONS OF ENERGY OR MECHANICAL SYSTEMS. STEP ONE WOULD BE THAT THE COUNTY WOULD AUTHORIZE PROGRAM THROUGH RESOLUTION, EXECUTE AGREEMENTS WITH FOUR LOCAL ENTITIES.
TAXABLE AGREEMENTS WOULD BE UNDERTAKEN WITH MR. HOLINGS WORTH. THEY CONNECT WITH THE PACE PROGRAM. NEGOTIATE FINANCING TERMS STEP TWO. EXECUTE FINANCING AGREEMENT.
STEP THREE UNDERTAKE THE PROJECT.
RECEIVE ALL THE PERMITS. THEY HAVE TO RECEIVE THEIR PERMITS AND CONSTRUCTION APPROVALS AND THAT TYPE OF THING. WORK COMPLETED ON THE PROJECT AND PACE PAYS CONTRACTOR. THAT MONEY DOES NOT MOVE THROUGH THE COUNTY GOVERNMENT. STEP FOUR IS PACE PROGRAM PREPARES ASSESSMENT ROLE FOR THE PROPERTY OWNERS THAT DECIDED TO PARTICIPATE. ONLY THOSE PROPERTY OWNERS.
I AM GOING TO RUN THROUGH A COUPLE OF QUICK EXAMPLES.
THIS IS THE PROJECT FACILITATING WHY I WAS HERE.
THEY WANTED TO KEEP INFORMATION CONFIDENTIAL.
IT IS FOUR TO FIVE MILLION DOLLARS OUT OF 25 MILLION DOLLAR CONSTRUCTION BUDGET. THEY WANT TO USE C PACE FINANCING. ANOTHER ASSISTED LIVING FACILITY OUTSIDE PENSACOLA. HILTON IN OCALA.
ROOF RETROFITS IN CORAL GABLES. I WANT TO SPEND A MINUTE ON THIS ONE, THIS ASSISTED LIVING FACILITY UNDER NEW CONSTRUCTION AND RECAPITALIZED USING C PACE TO INSURE FINANCING.
WINDING UP THIS IS MY SECOND TO LAST SLIDE.
AGAIN FOUR PACE PROGRAMS WITHIN FLORIDA.
YOU WOULD JOIN THROUGH THE INNER LOCAL AGREEMENT AND THERE HAVE BEEN 22 INQUIRIES WITHIN ST. JOHNS COUNTY.
ONE IS TRACKING PHONE CALLS. WE DON'T HAVE THE DISTINCTION AS TO WHETHER OR NOT THAT IS RESIDENTIAL OR COMMERCIAL.
IT IS THE INDICATION THERE ARE PROPERTY OWNERS.
I KNOW OF TWO PACE PROVIDERS THAT HAVE PROJECTS READY TO GO.
OURS IS ONE OF THEM. WE DON'T PREDICT A TREMENDOUS AMOUNT OF PROJECTS EACH YEAR. IT IS NOT THE VOLUME THAT YOU WOULD HAVE WITH RESIDENTIAL. IT IS A DIFFERENT MODEL.
SUPER OPTIMISTICALLY 10-20 ESTIMATED A YEAR.
THAT WOULD BE GREAT. WE WOULD BE THRILLED WITH THAT.
NOT ALL OURS. AT THE ENDS OF THE DAY, COMMERCIAL ONLY PROGRAMS DON'T HAVE THE SAME CONSUMER
[00:55:04]
PROTECTIONS. THESE DEALS TAKE A LONG TIME TO GIN UP. PEOPLE ARE SOPHISTICATED AND LOOKING FOR CHEAPER COST OF FINANCING.THEY ARE NOT GOING TO UNDERTAKE PACE IF IT DOESN'T MAKE SENSE AND PENCIL OUT. COMMERCIAL PACE PROJECTS TAKE LONGER TO GET CLOSED YOU HAVE MORE SCRUTINY IN TERMS OF CAPITAL STACK. COMMERCIAL PACE PROJECTS ALSO REQUIRE ANY EXISTING MORTGAGE LENDER THEY HAVE TO CONCEPT TO THAT. THAT IS DIFFERENT MODEL.
LEGISLATIVE OUTCOMES I PUT THAT ON THERE.
EASILY, A BIG ZERO ON PACE THIS SESSION.
THERE WAS A BILL FLOATED TO DEAL WITH RESIDENTIAL CONSUMER PROTECTIONS. DIDN'T HAVE EFFECT ON COMMERCIAL. IT DIED IN THE WINNING DAYS OF THE SESSION. THAT IS MY PRESENTATION.
HAPPY TO ANSWER ANY QUESTIONS. >> OKAY T. THANK YOU.
QUESTIONS FROM THE BOARD? COMMISSIONER SMITH?
>> THANK YOU, MR. CHAIRMAN. HOW ARE THE LOANS APPROVED WHO
IS INVOLVED IN THAT PROCESS? >> A LOT OF LAWYERS, A LOT OF CAPITAL PROVIDERS. GOVERNMENT HAS NO ROLE IN APPROVING THE PROJECTS. IT IS A PRIVATE SECTOR TRANSACTION BETWEEN A BUILDING OWNER AND FINANCING ENTITY.
IT WOULD GO THROUGH A NORMAL PROCESS TAX DEED SALE.
THERE IS NOTHING DIFFERENT OR UNIQUE ABOUT PACE.
NOTICE TO PROPERTY OWNERS SHOULD THE PROPERTIES SALE.
>> THIS IS A PRIVATE TRANSACTION.
>> WHY IS PACE A PRIVATE ENTITY WANT A COUNTY TO HELP THEM WITH LIENS FROM THE GET GO DOES IT LOWER THEIR RATE?
>> YES. >> IF I CAME TODAY WHAT WOULD
THE RATE BE? >> DEPENDING ON FINANCING TERM
AS LOW AS 5% AND HIGH AS 8%. >> COMMERCIAL LOANS AROUND 3.
>> THAT'S RIGHT YOU ALSO HAVE A DEBT WITH PACE FINANCING.
>> THIS IS STILL A DEBT AND LIEN.
>> CORRECT. THEY MAY NOT WANT TO CARRY THAT MUCH DEBT ON THE BOOKS FOR COMMERCIAL PROJECT.
PACE MAY BENEFIT THEM BECAUSE THEY TAKE OUT A LESSER BANK LOAN. TOTALLY UP TO THE PROPERTY OWNERS TO WHETHER OR NOT THEY WANT TO USE THEM.
>> BACK TO COMMISSIONER SMITH. >> EVERYTHING I READ HIGHER INTEREST RATE. I ASKED THE QUESTION HOW THESE LOANS ARE APPROVED. GO TO A LOWER INTEREST RATE.
ADDITIONAL EXPENSES NOT AS DESIRABLE AS SOMEBODY SEEK AGO LOAN. IS IT TRUE? FROM WHAT I READ GENERALLY A HIGHER INTEREST RATE.
>> IT DEPENDS. WE OPEN UP THE PAPER.
WE LOOK AT INTEREST RATES, WE THINK THAT IS A CONSTRUCTION LOAN INTEREST RATE IS. THAT IS NOT ALWAYS THE CASE.
DEALING WITH, BIGGER TERMS, YOU ARE NOT GOING TO END UP WITH TWO OR THREE PERCENT YOU ARE READING IN THE
[01:00:03]
NEWSPAPER RIGHT NOW. IT IS MORE COMPATIBLE.>> THAT IS A STATUTORY REQUIREMENT THEY CAN CHARGE UP TO 2% IN THE COLLECTION OF AN ASSESSMENT.
THEY CAN CLARJ FOR THEIR SERVICES TO LEVY AND COLLECT ASSESSMENTS, PACE IS NO DIFFERENT.
>> COMMISSIONER WALDRON? >> WHEN THEY DO THE LOAN THERE WON'T BE A LIEN OWNER DEBT JUST THROUGH ACCOUNTING.
WHEN THEY RUN A CREDIT SCORE IT WILL NOT SHOW UP?
>> ANYTHING FURTHER FROM THE BOARD? DIRECTION OF THE BOARD REQUESTED?
>> PUBLIC COMMENT? >> NOW HAVE PUBLIC COMMENT ON
ITEM ONE. >> NO FURTHER COMMENTS.
>> LET'S GO TO LEGAL. >> THANK YOU.
IF I MAY THROUGH THE CHAIR I THINK YOUR POWERPOINT MATERIALS WITHIN THE AGENDA I THINK THEY MAKE IT CLEAR IT IS NOT PURELY A PRIVATE PROGRAM. THERE ARE PUBLIC ENTITIES SPECIAL DISTRICTS THE COUNTY WILL DO INTERLOCALS WITH.
IT IS FINANCED THROUGH THOSE. >> CORRECT.
PRIVATE CAPITAL. ALL THE PACE PROGRAMS HAVE UPWARDS 100 LOCAL GOVERNMENTS. ST. JOHNS COUNTY WILL BECOME
IF I MAY ONE MORE TIME THROUGH THE CHAIR IN YOUR EXPERIENCE WITH PACE COMMERCIAL PACE ANY INSTANCE OR COULD THERE BE ANY INSTANCE WHERE THE HOSTING LOCAL GOVERNMENT AND I MEAN IN THIS INSTANCE ST. JOHNS COUNTY COULD EVER BE LIEABLE FOR THE DEBT THAT ESSENTIALLY WAS INCURRED THROUGH A PACE?
>> NO, SIR. THAT IS VERY CLEAR.
ALL OF THE PROGRAMS HAVE UNDERTAKEN BOND VALIDATIONS.
THAT IS VERY CLEAR. I THINK IT IS SECTION 163.01 PARAGRAPH 7 THAT SAYS WHEN YOU HAVE INTERLOCAL ENTITY, DEBTS AND OBLIGATIONS DO NOT IMPORT TO THE PARTICIPATING LOCAL
GOVERNMENTS. >> THANK YOU MR. CHIRMAN.
>> OKAY. THANK YOU COMMISSIONER DEAN.
>> I HAVE TWO COMMENTS. ABOUT THREE YEARS AGO APPROACHED BY A REPRESENTATIVE OF THE PACE PROGRAM.
I LOOKED AT THAT. I REACHED OUT TO OUR TAX COLLECTOR DENNIS HOLINGS WORTH. HE FELT THERE WERE SIGNIFICANT PROBLEMS WITH THAT PROGRAM AND RECOMMEND WE NOT PURSUE THAT.
WHEN I WAS APPROACHED REGARDING COMMERCIAL PACE, I REACHED OUT TO EARLIER TO DENNIS HOLINGS WORTH THE TAX COLLECTOR.
HE SAID BECAUSE THIS PROVIDED ECONOMIC DEVELOPMENT FOR OUR COUNTY HE DID NOT WANT TO STAND IN THE WAY TO PREVENT THAT AND DIDN'T WANT TO -- BASED ON THAT I WANT TO MAKE THE FOLLOWING MOTION, I WILL DIRECT STAFF TO TAKE STEPS TO IMPLEMENT THE PROGRAM AND STAFF CAN BRING BACK RESOLUTION FOR CONSIDERATION AT
A FUTURE BOARD MEETING. >> SECOND.
>> WE HAVE A MOTION BY COMMISSIONER DEAN, SECOND BY
[01:05:04]
COMMISSIONER WHITEHURST. PUBLIC COMMENT, ANY FURTHER DISCUSSION? COMMISSIONER SMITH.>> THANK YOU, MR. CHAIRMAN. IN MY OPINION THIS IS FUNDAMENTALLY A PRIVATE MATTER. THERE ARE A LOT OF THE OF TOOLS FOR COMMISSIONERS TO UTILIZE AND APPEARS TO BE PUBLIC BENEFIT AND POTENTIAL CREATION OF JOBS. HOWEVER, I HAVE A RESERVATION ABOUT THE BENEFIT THAT DOESN'T OUTWEIGH THE CONSEQUENCES, I
WILL VOTE AGAINST IT. >> THANK YOU, ANY FURTHER COMMENT FROM THE BOARD? SEEING NONE, PLEASE VOTE.

[01:10:06]
THIS CONCLUDES THE PRESENTATION IF YOU HAVE QUESTIONS.>> OKAY. THANK YOU MISS ANDREWS.
ANY QUESTIONS FROM THE BOARD? COMMISSIONER WALDRON?
>> WE ARE ALLOWED TO NEGOTIATE THIS ON THE FLOOR?
>> IT IS A POLICY DECISION FROM THE BOARD SO THEY CAN PROVIDE FEEDBACK AND DIRECTION TO STAFF AND PART OF NEGOTIATION.
>> IN SECTION 15. >> WHAT SECTION?
>> 15. >> I THINK VCB MAY NOT BE AROUND
20 YEARS. >> THAT IS UNDER 15 D.
>> COMMISSIONER WALDRON. WITH THAT REQUEST.
WITH THE LANGUAGE WOULD READ ESSENTIALLY AS A REVISION ADVISE THE COUNTY AND ANY PARTY CONTRACTED WITH THE COUNTY FOR THE PURPOSES OF TOURISM AND ADVERTISING.
SO IT IS MORE GENERAL. >> YES.
>> IF I MAY MAKE A RECOMMENDATION, WE ARE GETTING TO THE MEAT AND SUBSTANCE OF DISAGREEMENT.
THIS IS NOT PART OF OUR NEGOTIATIONS.
ANY OTHER DIRECTION FROM THE BOARD, WE CAN TAKE A QUICK RECESS SO WE CAN NEGOTIATE TO ESSENCE OF THE DIRECTION FROM THE BOARD AND BRING IT BACK SHORTLY AFTER.
>> OKAY BEFORE WE DO THAT. LET'S GO TO OTHER COMMISSIONERS.
COMMISSIONER SMITH? >> I HAD A QUESTION.
IS THAT A PRESENTATION OR QUESTIONS?
>> GOOD MORNING MR. CHAIRMAN, FOR THE RECORD ELLEN AVERY SMITH HERE IN ST. AUGUSTINE HERE ON BEHALF OF THE PGA TOUR.
I THINK MISS ANDREWS DID A GREAT JOB OF SUMMARIZING THE AGREEMENT AND I AM HERE TO ANSWER QUESTIONS AND REPRESENTATIVES OF
THE TOUR HERE AS WELL. >> THANK YOU, MRS. SMITH.
NO. 1, I APPRECIATE WHERE WE ARE TODAY.
I WANT THE PUBLIC TO KNOW APRIL 6TH, I FELT MAYBE THE ONLY ONE, I FELT THIS WAS AN INCOMPLETE APPLICATION PREMATURELY BROUGHT BEFORE THE BOARD. WE DID NOT HAVE JOB'S NUMBERS.
WE DID NOT HAVE THE MARKETING AND PROMOTION CONTENT ASSISTANCE AT THAT TIME. PLUS WE HAD COMBINATION OF TWO DIFFERENT FACILITIES TOGETHER. I WANT TO SAY THANK YOU FOR ADHERING TO THE ORIGINAL CONTRACT AND MAKING THIS A SEPARATE ONE. I WOULD LIKE IF YOU DON'T MIND FROM A VERBAL STANDPOINT. WHAT I HAVE DONE IS TAKEN THREE DIFFERENT RESOLUTIONS. ONE FROM PGA TOUR.
THIS ONE PRESENT. ONE FROM NORTH DRUMMOND.
I WOULD LIKE TO MAKE OBSERVATIONS.
HELPFUL FOR ME AND WANT OTHERS. I WANT MISS ANDREWS.
IF I AM INACCURATE ON ANY OF THIS, PLEASE, PLEASE, PLEASE HELP ME, CORRECT ME. I DON'T WANT TO BE INACCURATE.
I WANT FOLKS TO KNOW THE MIDDLE IS WHERE WE ARE TODAY.
TO THE LEFT IS PGA TOUR ECONOMIC INCENTIVE DEVELOPMENT INCENTIVE DONE IN 2017 FOR GLOBAL HOME TO THE FAR RIGHT IS NORTH OF DUMB MONDAY'S AGREEMENT FROM 2013 MODIFIED BECAUSE OF LACK OF COMPLIANCE IN 2018. I WANTED TO WORK OUR WAY DOWN ON
[01:15:03]
THE LEFT ALL NEW FACILITIES BUILT.PGA TOUR 2017, 339, ALL THE WAY TO THE RIGHT NORTH OF DRUMMOND ABOVE 130 MILLION DOLLARS. THERE IS A MAINTENANCE REQUIREMENT FOR MAINTENANCE TO RETAIN JOBS.
THIRD LINE TO CREATE NEW JOBS. PGA TOUR CREATE 307 NEW JOBS.
THIS WAS TO CREATE 45 NEW JOBS. NORTH OF DRUMMOND 400 NEW EMPLOYEES. THAT IS NEW HIRES.
WAGES ARE CERTAINLY SOMETHING POWERFUL TO LOOK AT AS WELL.
79,442 WAS THERE. THIS AGREEMENT SAME.
NORTH OF DRUMMOND 44,943. JUST WANT YOU TO RECOGNIZE, TOO, REDUCTION OR LESS PRESENTATION OF NEW JOBS TO BE BROUGHT FORWARD. NEXT LINE ONE THAT IS MOST OUTSTANDING TO ME. GENERAL 25 YEARS OF TAXES ON REAL PROPERTY IMPROVEMENTS. THAT IS SIGNIFICANT AMOUNT OF TIME. NOTICE THERE IS NO TANGIBLE PERSONAL PROPERTY THERE. I HOPE THAT IS ACCURATE.
MOVING ALONG THE NEXT SLIDE. THE BOTTOM TO ME IS WHERE THE SIGNIFICANT OUTSTANDING LIAR IS. REACHING EXTENSIVE INCREASE IN REGARD TO THE OBLIGATION AND ALSO INVALUE AND WHAT YOU ARE GETTING WHEN YOU GO BACK AND LOOK AT IT, CREATION OF JOBS IS DEFINITELY LESS THAN THE OTHERS AS WELL.
TANK YOU MR. CHAIRMAN. >> MR. CHAIRMAN DO YOU MIND IF I RESPOND WITH A COUPLE OF QUICK FACTS? DO YOU MIND IF I BORROW THIS PIECE OF PAPER.
IF YOU PUT THAT BACK UP THERE ALSO THE VALUE OF THE MARKETING AND PROMOTION CONTENT ASSISTANCE.
I PUT IN THERE SECTION 15 COMMISSIONER WALDRON ALREADY ADDRESSED. THERE IS A MONETARY VALUE NOT CLEARLY DEFINED. REDUCE SOME OF THE ESTIMATED
VALUE. >> CORRECT, WE APPRECIATE YOUR THOROUGHNESS AS USUAL. I WANT A COUPLE OF QUICK NOTES TO GIVE A PERSPECTIVE. WE ARE TALK ABOUT A CORPORATE
[01:20:02]
CITIZEN OF ST. JOHNS COUNTY WHO HAS BEEN A FAITHFUL PARTNER TO THE COUNTY MORE THAN 40 YEARS. BRINGING LOTTEDS OF HIGH PAYING JOBS AND IN LOOKING AT YOUR LIST THEIR JOBS ARE ALMOST TWICE THE VALUE OR WAGE I WOULD SAY OF NORTH OF DRUMMOND.YOU ARE TALKING ABOUT INTERNATIONAL TOUR, SEVEN DIFFERENT TOURS. BEING PRODUCED AND TRANSMITTED FROM ST. JOHNS COUNTY. THIS IS AGAIN A GREAT ASSET TO ST. JOHNS COUNTY. DIFFERENT STATES AND CITIES THROUGHOUT THE NATION VYING FOR DIGITAL MEDIA ESPECIALLY 100 MILLION DOLLAR INVESTMENT. I WOULD ASK YOU TO CONSIDER TALKING ABOUT RETAINING HIGH PAYING JOBS,100 MILLION DOLLAR INVESTMENT. CREATION OF 145 MILLION JOBS.
I WOULD LIKE TO SEE THAT DISCLOSED.
SCHOOL IMPACT FEES PAID INTO THE COUNTY.
OVERALL ECONOMIC IMPACT WE CAN EXPECT IF WE APPROVE THIS PACKAGE TODAY. WHAT WE HAVE BEEN TOLD WILL BE THE OVERALL ECONOMIC IMPACT ON THE COUNTY.
SCHOOL OVER ALL OF THE YEARS WE HAVE BEEN TALKING ABOUT FOR THE TAX REBATE. I THINK THAT IS GOOD INFORMATION FOR THE PUBLIC TO HAVE AND APPRECIATE THE COMMENT.
I DON'T THINK YOU CAN TAKE FOR GRANTED PGA TOUR HAS HAD A HOME 30 YEARS THEY WILL BUILD SOMETHING AS BIG AS PROPOSED HERE. THAT IS ALSO FACTORED IN THE THOUGHT PROCESS. THAT IS ALL I HAVE FOR NOW MR.
CHAIRMAN. >> THANK YOU COMMISSIONER W.
WE ARE GOING TO COMMISSIONER WALDRON.
[01:25:48]
>> THAT IS THE IDENTICAL SLIDE. THAT IS WHAT COMMISSIONER WHITEHURST REFERRING TO, 304 MILLION DOLLARS DIRECT ECONOMIC IMPACT HOME TO 300 PLUS JOBS, 724 CONSTRUCTION JOBS.
16.7 MILLION DOLLARS IN SCHOOL TAXES OVER 30 YEARS.
OBVIOUSLY THE CREATION OF NEW TECH AND CONTENT AND INDUSTRY-RELATED JOBS. NATIONAL BROADCAST EXPOSURE FOR ST. JOHN'S COUNTY. 3375 TOTAL JOBS FOR PGA TOUR.
2028 CONSTRUCTION JOBS, 7.2 BILLION DOLLARS IN EMPLOYEE PAYROLL OVER THE NEXT 20 YEARS, 44.7 MILLION DOLLARS IN SCHOOL TAXES OVER 30 YEARS. 200 MILLION DOLLARS IN TWO NEW WORLD CLASS BUILDINGS. OBVIOUSLY THE GLOBAL HOME AND NOW DIGITAL MEDIA. 500 MILLION DOLLARS PLUS IN PROPERTY VALUE IN ST. JOHNS COUNTY.
70 MILLION DOLLARS IN LOCAL TAXES OVER THE NEXT 20 YEARS PAID BY THE TOUR. AND 33 BILLION DOLLARS IN LOCAL ECONOMIC OUTPUT FOR ST. JOHNS COUNTY OVER 30 YEARS.
>> WE ARE HAVING TECHNICAL DIFFICULTIES WE ARE GOING TO REBOOT. MISS ANDREWS REQUESTED A BRIEF
BREAK. >> MY QUESTION FOR MISS ANDREWS.
WE KNOW NUMBERS ON THE TOP PART OF THE SLIDE THAT IS FOR THE BROADCAST BUILDING ONLY. NUMBERS ON THE BOTTOM PART OF THE SLIDE COMBINED NUMBERS SHOULD THIS BE APPROVED?
>> PGA TOUR. >> THE JOBS ON THE TOP PART OF THE SLIDE 180 JOBS NOW. IS THAT RIGHT IT IS NOT NOW 300.
I WANT TO ADDRESS CONCERNS. >> MR. MAYS INTRODUCE YOURSELF.
>> PHIL MAYS. 309 EAST PACE ROAD ATLANTA, GEORGIA. ON THIS SLIDE CORRECT TOP PORTION FOR PGA TOUR DIGITAL MEDIA BROADCAST FACILITY.
THIS IS BASED OFF ERKG. BOTTOM IN -- THE FEELING IS OVER A NUMBERER OF YEARS, EVENTUALLY 300 PEOPLE WOULD OCCUPY AND IN AND OUT OF THE BROADCAST BUILDING? OVER TIME THAT IS THE BELIEF WE WERE TALKING ABOUT NOW.
[01:30:08]
BIG DIFFERENCE BETWEEN WAGES AND OFFERING TO PROVIDE DIGITAL MEDIA INDUSTRY AND BUILDING VERSES NORTH OF DRUMMOND NUMBERS. SPIN-OFF JOBS ARE ALSO.INDUSTRY AS A WHOLE. BENEFIT OF ECONOMIC ANALYSIS LOCATING THIS TYPE OF INDUSTRY IS TREMENDOUS AND WHY COMMUNITIES GO AFTER THIS TYPE OF INDUSTRY.
YOU REFERENCED PALM BEACH TO FRISCO, TEXAS.
WE WERE A BIDDER ON DEVELOPING THAT FACILITY OUTSIDE OF DALLAS.
NUMBERS WERE CONSIDERABLE. ACCORD USGA MOVING LOCATION FROM NEW JERSEY INTO NORTH CAROLINA AGAIN WITH A VERY FORMIDABLE PACKAGE INCENTIVES. IT IS NOT A SITUATION ON THIS BUILDING NO TAXES BEING PAID. ALMOST 50% OF TAXES PAID ON THIS BUILDING ALONE. ALL THE SCHOOL TAXES, COUNTY HEALTH. THIS IS A PORTION OF THAT THAT WOULD BE USED TO HELP PAY FOR THE BUILDING OVER A NUMBER OF
YEARS. >> WE HAVE ASKED OUR FINANCIAL ADDS ADVISE TO DO A COURTESY FACT CHECK.
WE DO NOT STAND BY THE NUMBERS HOWEVER WE HAVE DONE ALL THE NUMBERS PROVIDED ON THE BOARD. IT IS FACTUAL.
WE HAVE RUN THE TAX VALUE PROPOSED BRING TO ST. JOHN'S COUNTY OVER 25 YEARS AND I CAN PROVIDE THAT NUMBER QUICKLY.
THIS IS OUR OWN ANALYSIS. OVER 25 YEARS SCHOOL TAXES VALUED 14 CLOSE TO 15 MILLION DOLLARS OVER 35 YEARS SCHOOL TAXES VALUE 21 MILLION DOLLARS. BENEFITS GENERATED FROM THE TAXES. IF WE ARE LOOKING OVER 35 YEARS, THERE IS A POSITIVE NET BENEFIT TO ST. JOHNS COUNTY.
>> THANK YOU MISS ANDREWS. TO REALLY VALIDAE THE NUMBER OF JOBS. THAT IS THE PERFORMANCE THAT IS EXPECTED THROUGH THIS GRANT AGREEMENT.
THANK YOU, COMMISSIONER DEAN NEXT.
I WANT TO REFLECT ON SOMETHING IMPORTANT TO ME.
I ALSO WANT TO KEEP IN MIND THE LONG STANDING RELATIONSHIP, PARTNERSHIP HARD TO PUT A DOLLAR FIGURE ON AND I WILL TELL YOU WHY IN A MINUTE COUNTY AND PGA TOUR.
I DON'T KNOW WHAT ALL OF YOU WERE DOING 30 YEARS AGO TODAY, MAYBE THIS MONTH, I WAS ON A PLANE.
I WAS ON A PLANE WITH ON THE WAY TO NEW YORK FROM ST. AUGUSTINE WITH THE MAYOR OF JACKSONVILLE, A BOARD MEMBER FROM ST. JOHN'S
[01:35:08]
RIVER WATER MANAGEMENT DISTRICT AND COMMISSIONERS OF PGA.FLYING TO NEW YOK TO MEET WITH THE LANDOWNER THAT WAS GOING TO OFFER THE LOCATION FOR THE WORLD GOLF HALL OF FAME.
GOOD DISCUSSION, GOOD AGREEMENT FROM THE LAND ACQUISITION.
THE CITY OF JACKSONVILLE'S POSITION YES, WE WANT THE HALL OF FAME HEAD WATERS PENINSULA. WE ARE ONLY GOING FORWARD WITH APPROVALS IF THE PGA AGREES TO MOVE ITS HEADQUARTERS TO THAT LOCATION. COURAGEOUS CORRECT DECISION.
TO KEEP PGA HEADQUARTERS. HE STUCK BY THAT AND FUTURE COMMISSIONERS STUCK BY THAT. WE HAVE HAD AN UNBELIEVABLY SUCCESSFUL PARTNERSHIP AS A COUNTY WITH THE PGA TOUR.
THERE ARE INCALL CUEABLE BENEFITS THE CITIZENS HAVE RECEIVED BASED TON LOCATION AND PLAYER'S CHAMPIONSHIP IF IT WERE NOT FOR THE BENEFITS AS FAR AS TO PUT A NUMBER ON THOSE BENEFITS, SO IN CONSIDERING THIS ITEM, I WANT EVERYONE TO KNOW, I DIDN'T REACH THIS DECISION IN A CAVALIER MANNER IN A GENERALIST MANNER. WHAT I HAVE LOOKED AT IS THE BUSINESS RELATIONSHIP PGA TOUR HAD HAD WITH THIS COUNTY AND THE RESIDENTS OF THIS COUNTY DERIVED NOT ONLY IN BUSINESS BENEFITS FOR ALL THE SERVICES ARE PROVIDED AND ALL THE BENEFITS WE GET FROM THE NATIONAL PRESS, INTERNATIONAL PRESS AND PLAYERS CHAMPIONSHIP BUT THE DONATIONS PGA TOUR MAKES MULTIMILLION DOLLAR DONATIONS OVER THE LAST 30 YEARS THIS BENEFITS FROM.
WHEN I DID STUDY IT. I DIDN'T ARRIVE AT MY CONCLUSION BASED EXCLUSIVELY ON THE SPECIFIC NUMBERS.
I FELT COMPELLED TO SHARE THAT TODAY BECAUSE OF MY IN RECOGNIZING WE ARE LUCKY TOP PGA HEALTH CARE.
>> THANK YOU COMMISSIONER DEAN. COMMISSIONER SMITH.
ZO >> I HAVE A QUESTION IN REGARD TO ITS COMPETITIVENESS. I WANT TO CITE AN ARTICLE BY BOB ESPN SENIOR WRITER, MAY 4TH 2021.
PREMIER GOLF LEAGUE PROMISING MULTIMILLION DOLLAR GUARANTEES TO TOP RANKED GOLFERS TO BREAK AWAY HAS REEMERGED.
DAILY TELEGRAPH REPORTED THAT THE WORLD TOUR WOULD BEGIN IN SEPTEMBER 2022 LIKELY FORCING PLAYERS TO CHOOSE BETWEEN PGA TOUR AND CIRCUIT BACKED BY SAUDI ARABIA AND MONEY INTERESTS.
SAUDI ARABIA MONEY INTERESTS FROM THIS ARTICLE ARE GOING TO JUPITER, FLORIDA. WHICH IS PALM BEACH COUNTY WHERE PGA AMERICA LEFT FROM AND LOOKING FOR FAST DECISIONS FROM PLAYERS IN ORDER TO GET THE TOUR UP AND RUNNING.
IS THAT SOMETHING YOU ARE CONCERNED ABOUT?
>> NO PUN INTENDED. >> NOT CONCERNING.
>> THANK YOU FOR THE ANSWER. [LAUGHTER].
>> YOU HAVE TO MAKE PAR. >> THANK YOU, COMMISSIONER
[01:40:01]
SMITH. ANY FURTHER COMMENTS FROM THE BOARD? OKAY.STAFF, YOU ASKED FOR A FEW MOMENTS.
WE HAD A RECOMMENDATION FROM COMMISSIONER WALDRON?
>> I MIGHT BE ABLE TO ADDRESS THAT.
I THINK THE ANSWER IS SIMILAR. 25 YEAR AGREEMENT FOR ALMOST ANYTHING IS WHERE IT IS CONSULTING IN TWO PARTIES AND COUNTY. FIVE YEARS WOULD BE MORE APPROPRIATE. IF THAT WORKS OUT WELL, THERE IS AN OPPORTUNITY BECAUSE THE COUNTY AND PGA TOUR WORKED TOGETHER ON A NUMBER OF DIFFERENT ITEMS WITHIN PGA TOUR AND COUNT. THAT MIGHT BE THROUGH THE AGREEMENT OR SOMETHING LIKE THAT.
AT THIS POINT TO MAKE 25 YEARS PART OF THIS AGREEMENT ISN'T SOMETHING WE THINK WOULD BE A SMART THING TO DO WHEN WE HAVEN'T BEEN ABLE TO SEE HOW FIVE WORKS.
I THINK 25 WOULD BE MUCH AND RESPECTFULLY ASK IT STAY FIVE WITHIN THE NEGOTIATED AGREEMENT. I DO THINK IT CAN COME UP IN OTHER FORMS AS THE COUNTY AND TOUR WORK TOGETHER AS THEY DO THROUGHOUT ALMOST EVERY MONTH. THEY WILL BE RE-EVALUATED EVERY FIVE YEARS. THAT IS TOUGH.
NONE OF US WILL BE HERE FIVE YEARS.
IT IS TOUGH DOING A 25-YEAR -- THIS IS WHAT IT SAYS.
NOT UP FOR AN AGREEMENT BETWEEN COMMISSIONER.
THEY GET FORGOTTEN. WHAT WERE Y'ALL THINKING AT THE TIME. WHAT WAS GOING ON YOU MADE THAT
DECISION. >> I THINK WE WOULD BE AMIDABLE TO RIDE IN THERE AT THE CONCLUSION OF THE FIVE-YEAR PERIOD PARTIES WILL REEXAM THE AGREEMENT AND DETERMINE A MUTUAL FASHION. HOW BEST TO CONFORM.
>> IT WOULD BE SOMETHING LIKE AN EXTENSION AT THE MUTUAL
AGREEMENT OF THE PARTIES? >> CORRECT.
[01:46:19]
$3,384,893 GROSS RECEIPTS, THIS IS A WEALTHY CORPORATION.SUPREME COURT HELD IN THE CASEY MARTIN CASE COMMERCIAL ENTERPRISE RUN FOR THE BENEFIT OF ITS OWNERS.
THEY HAVEN'T EARNED THE RIGHT TO 16 MILLION IN CHANGE FROM ST.
JOHNS COUNTY TAX PAYORS. THIS WOULD BE A SERIOUS BREECH OF FE DUTY. LOBBYIST INFORM TALLAHASSEE FOR THE PGA TOUR ALSO LOBBYIST FOR ST. JOHNS COUNTY AND ST. JOHNS COUNTY SHERIFF AND JACKSONVILLE AND JTA AND ALL THE DEVELOPERS.
THE PARK GROUP. THIS STINKS ON ICE.
>> FURTHER PUBLIC COMMENT ON ITEM 2?
[APPLAUSE] >> BJ WEST CITY OF ST. AUGUSTINE A PHUT -- A PUTT-PUTT GOLFER. 16.7 MILLION DOLLARS FOR HIS COMPANY TO BUILD A MEDIA BUILDING FOR A PGA TOUR.
THE GLOBAL HOME RECEIVED TAX BREAKS ALSO KNOWN AS INCENTIVES FOR GLOBAL HEADQUARTERS. HAS A SELLING POINT COUNTY CAN USE FOR MEDIA OUTREACH. COMMISSIONER MAYS DID NOT SPEAK AT THE MEETING. AT LEAST HE SPOKE TODAY.
LET ME ENCOURAGE -- YOU GET A REAL FEEL WHEN YOU SIT IN THIS ROOM. 23.3 MILLION TO 16.7 MILLION.
LET'S HOPE THIS DEVELOPER WILL NOT RETURN WITH CHANGES AS THE COST OF LUMBER INCREASES. THIS IS NOT RESPONSIBLE PLANNING WITH CONSIDERATION FOR QUALITY OF LIFE RESIDENTS.
THIS IS NOT WORLD CLASS LIVING. MOST OF US ARE NOT FARMERS, HOWEVER WE KNOW A 50 POUND BAG OF POTATOES WILL NOT FIT IN A FIVE POUND BAG. THERE IS NO EX PARTE.
THEY HAVE BEEN TALKING WITH YOU SINCE APRIL.
I WANT TO THANK COMMISSIONER SMITH FOR YOUR HOMEWORK AND FOR YOUR PRESENTATION AND THERE NEEDS TO BE MORE HOMEWORK BY OUR STAFF. WE NEED TO EITHER TABLE AND BRING THIS BACK NEXT BCCC MEETING OR ELSE THERE WILL BE HOPEFULLY A 3-2 VOTE IN FAVOR. 3-2 VOTE SEEMS TO BE A LOT OF VOTING DONE BY THIS COMMISSION WHICH IS FINE.
IT IS NOT FOR THE BENEFIT OF THE ENTIRE COMMUNITY.
LET'S GET BACK TO THE EX PARTE. IT IS NOT JUST SOME APRIL, MAY.
HOW MANY CONVERSATIONS HAVE YOU HAD WITH THIS DEVELOPER AND
[01:50:04]
LAWYER? TOO MUCH TALKING BEHIND THE SCENES THERE ARE NO SECRETS. WE THE PUBLIC NEED TO KNOW WHAT IS GOING ON AND HOW YOU ARE SPENDING OUR TAX DOLLARS, THIS IS NOT RESPONSIBLE SPENDING. FURTHER PUBLIC COMMENT ITEM 2 SEEING NONE MR. CHAIRMAN COMPLETES PUBLIC COMMENT.>> MR. CHAIRMAN IF I MAY. >> WE ARE BACK TO THE BOARD.
>> THANK YOU MR. CHAIRMAN. I WANT TO MENTION EX PARTE DISCLOSURES REQUIRED WHICH YOU WILL HAVE IN THE AGENDA COMING UP. THIS IS AN EXECUTIVE BOARD
ALL RIGHT BACK TO THE BOARD. MOTION BY COMMISSIONER DEAN SECOND BY COMMISSIONER WHITEHURST.
>> JUST FOR CLARIFICATION. I THINK COMMISSIONER WALDRON TALKED ABOUT A COUPLE OF THINGS, ONE WAS USING THE MORE GENERAL AGENT, I THINK FOR THE COMMUNICATIONS.
OTHER WAS AT THE END OF THE FIVE YEARS THAT THE PARTIES WILL RECONSIDER. DOES THE MAKER OF THE MOTION IS THAT THE INTENT? THANK YOU, WE ARE GOING TO
COMMISSIONER SMITH. >> JUST IN DISCUSSION.
>> I VOTED FOR RESOLUTION 2017 FOR A GLOBAL HOME.
I VOTED FOR THE RESOLUTION FOR NORTH OF DRUMMOND.
THERE WERE FOUR-YEAR AGREEMENTS CONTRACTS THIS IS 25 YEARS.
I HAVE TREMENDOUS RESERVATIONS IN REGARD TO THAT.
THAT IS A LONG TIME. I JUST CANNOT IN GOOD CONSCIENCE DO THAT AT THIS POINT THANK YOU MR. CHAIRMAN.
>> THANK YOU, SIR. ANY FURTHER COMMENTS?
>> COMMISSIONER WHITEHURST? >> VERY QUICKLY.
I WANT TO POINT AGAIN TO THE OVERALL ECONOMIC IMPACT THAT THIS IS, I WOULD NEVER VOTE FOR ANYTHING I WASN'T CONVINCED A FINANCIAL BENEFIT TO THE SCHOOL DISTRICT I THINK WARRANTS THE ECONOMIC PACKAGE. I AM GOING TO VOTE YES.
>> COMMISSIONER SMITH? >> EVEN MR. MAYS' COMMENTS HE WAS NOT WILLING TO DO 25 YEAR AGREEMENT BECAUSE OF WHAT COULD HAPPEN IN THAT LENGTH OF TIME. HOWEVER FIVE YEARS AND FIVE YEARS. OUR COUNTY CAME OUT OF SIGNIFICANT ECONOMIC DOWN TURN. WE ARE WORKING DAILY ACTIVELY.
I AM GOING OVER VERY BRIEFLY. THIS IS 304 MILLION DOLLAR DIRECT ECONOMIC IMPACT. IT IS GREAT AS FAR AS NEW HOMES TO OVER 300 JOBS. 724 CONSTRUCTION JOBS.
READING OFF OF THE SLIDE PRESENTED BY STAFF.
THIS IS 16.7 MILLION SCHOOL TAXES OVER 30 MILLION YEARS.
NOT NEW RESIDENTIAL GROWTH. SCHOOL TAXES COMING IN.
BEST SCHOOL DISTRICT IN THE STATE OF FLORIDA AND WANT TO CONTINUE TO KEEP IT THAT WAY. ALMOST 45 MILLION SCHOOL TAXES.
[01:55:16]
THIS BOARD MADE A COMMITMENT RECENTLY TO ECONOMIC GROWTH AND JOB CREATION. I AM VOTING YES THAT MEANS THERE ARE BOARD GUIDELINES. ANY FURTHER COMMENTS?[3. Public Hearing * MAJMOD 2020-19 Silver Creek PUD. MAJMOD 2020-19 Silver Creek Commercial request for a Major Modification to the Silver Creek PUD (Ord. 2002-39, as amended) to allow a 20-foot building setback with an 8-foot landscape buffer along a portion of the northern property boundary, a 10-foot Perimeter Buffer in lieu of a 20B Incompatibility Buffer along an FDOT pond site that is zoned Open Rural (OR), and to clarify the addition of approximately .03 acres of land to the PUD. Located on the north-east corner of SR 207 and Silver Lane. This request was heard by the Planning and Zoning Agency at their regularly scheduled public hearing on April 15, 2021 and was unanimously recommended for approval, 6-0.]
GENTLEMAN PLEASE VOTE. MOVE ON TO NEXT AGENDA ITEM NO.3, THIS IS A QUASI-JUDICIAL MATTER THAT REQUIRES PUBLIC COMMENT AS WELL AS DISCLOSURES FROM THE BOARD COMMISSIONER
>> COMMISSIONER WALDRON? >> NONE.
>> COMMISSIONER DEAN? >> NONE.
>> I HAVE NONE AS WELL. >> GOOD MORNING.
SHANNON, THIS IS THE SILVER CREEK COMMERCIAL MAJOR MODIFICATION. AND MY CLIENT IS DANIA BEAT COMPANY MY CLIENT IS HERE SHOULD YOU HAVE ANY QUESTIONS.
WHAT WE ARE TALKING ABOUT IS A FOUR-ACRE PARCEL.
NORTH SIDE OF STATE ROAD 207 AS YOU CAN SEE ALONG SILVER LANE.
IT IS IN THE MIXED USE DISTRICT. AS I MENTIONED IT IS WITHIN THE SILVER CREEK PUD. PROVIDED THIS MAP WITHIN THE BOUNDARY. THIS IS THE SITE.
IT IS AN L-SHAPED SITE ALONG STATE ROAD 207.
PUD PARTIALLY DEVELOPED OUT WITH ASSISTED LIVING FACILITY AS YOU CAN SEE. PROJECT SUMMARY FOR THIS PARTICULAR MAJOR MODIFICATION TWOFOLD.
ONE TO INCORPORATE TINY 0.3 ACRE SITE INTO THE PUD BOUNDARY.
LEFT OUT FOR A SITE FOR THE COUNTY SINCE THEN DISCOVERED MORE LAND AREA NEEDED FOR THE COUNTY AND DEVELOPED THEIR UTILITY FACILITY. IT NEVER MADE IT INTO THE DESCRIPTION. OTHER PIECE OF THIS MODIFICATION REQUEST REDUCE A USE BUFFER FROM 20 FEET TO 10 FEET MEETING TYPICAL PERIMETER BUFFER AND SIMILARLY TO REDUCE FROM 20 FEET TO EIGHT FEET WHICH IS TYPICAL OF A LANDSCAPE BUFFER TO PARKING AREAS ALONG THE NORTHERN BOUNDARY WHICH FACES A POND ALTHOUGH IT IS A POND INTERIOR TO PUD.
THIS MODIFICATION DOESN'T INCREASE SQUARE FOOTAGE.
REMAINING 7740 AFTER THIS PARTICULAR PIECE IS DEVELOPED.
THIS IS THE SILVER CREEK COMMERCIAL SITE.
THERE IS ALSO ENCOMPASS HEALTH UNDERWAY ON THE OTHER SIDE OF SILVER LANE. THIS GIVES YOU AN IDEA WITH RELATION TO BUFFER REDUCTION REQUEST.
SO IN TERMS OF THIS WAIVER WE ARE REQUESTING IT WOULD ALLOW A 10-FOOT BUFFER ALONG THIS SIDE. HERE IS THAT FDOT POND.
IT WOULD BE A LANDSCAPE BUFFER. WE DO BELIEVE THERE IS EFFICIENCY TO BEY BEING ABLE TO CIRCULATE THE PARKING AND SUCH. HERE IS THAT LITTLE SQUARE WE TALKED ABOUT. INCORPORATING THAT INTO THE PUD
[02:00:06]
MORE EFFICIENCY TO CIRCULATE BUILDINGS ABOVE THERE.NORTHERN BOUNDARY THIS WOULD BE THAT LANDSCAPE BUFFER.
HERE IS THE EXISTING POND FOR PUD.
THERE WOULD BE A FENCE ALONG THE NORTHERN BOUNDARY AS WELL.
THAT JUST GIVES YOU A VISUAL TO SHOW HOW THOSE BUFFERS WOULD BE LAID OUT FOR THAT WAIVER REQUEST.
TO ALLOW FOR THESE REDUCED BUFFERS AS I MENTIONED EARLIER, PROPOSED MODIFICATION DOESN'T CAUSE ANY KIND OF INCOMPATIBLE CONCERNS FOR ADJACENT DEVELOPMENT.
BOTH WAIVERS NEXT TO PONDS ALREADY DEVELOPED.
IT IS CONSISTENT WITH THE LAND DEVELOPMENT CODE AND PERMITTING AGENCY REQUIREMENTS. WE REQUEST APPROVAL OF THIS MAJOR MODIFICATION. THAT CONCLUDES MY PRESENTATION.
>> THANK YOU, ANYTHING FROM STAFF? SEEING NONE. ANYTHING FROM THE BOARD.
OPEN UP TO PUBLIC COMMENT. >> WE NOW TAKE PUBLIC COMMENT ON ITEM 3. THIS IS QUASI-JUDICIAL, I SEE NO COMMENTS. IT WILL BE AN OPENING OF A KNEW COMMUNITY OUTREACH FOR OUR VETERANS.
I CAN SEE A LOT OF DANGER NOT ONLY OUR VETERANS BUT ALL OF OUR CITIZENS THAT ARE USING THAT INTERSECTION THE ONES COMING OUT OF SILVER CREEK SENIOR RETIREMENT COMMUNITY THERE.
THE ONES COMING OUT OF THE DEERFIELD COMMUNITY AS WELL AS OUR VETERANS WHO ARE UTILIZING AND PASSING THROUGH THAT INTERSECTION. I AM HERE THIS MORNING TO ASKED THE COUNTY COMMISSION BOARDS. SUMMER LAST YEAR I APPROACHED THE D DOT. THEIR HEALTH CARE AND COME OUT AND BE INJURED OR KILLED AT THAT INTERSECTION.
I AM REQUESTING THAT THE COUNTY BOARD THIS MORNING TAKE UNDER ADVISEMENT A REQUEST FOR A TRAFFIC STUDY WITH F DOT TO PUT AND INSTALL A TRAFFIC LIGHT AT THAT INTERSECTION.
THANK YOU. THE SITE SUBJECT IS HIGHLIGHTED IN YELLOW. THE SUBJECT MAJOR MOD.
C BOCK -- IS DIRECTLY ACROSS THE COUNTY ROAD 207 FROM THAT
PARTICULAR LOCATION. >> LET'S COME BACK TO THAT FOR A
[02:05:12]
MINUTE. I THINK THE F DOT HAS BEEN RATHER POULTRY IN ALLOCATION FOR FUNDS.IF YOU LOOK AT THE RECORD, THERE IS AN AREA CALLED DEADMAN'S CURVE. F DOT DOESN'T SEEM TO CARE ABOUT THE VALUE OF HUMAN LIFE. IF YOU LOOK AT THE HISTORY UNDER THE REAGAN AND BUSH ADMINISTRATION -- MR. FOX AND MR. PIT. MR. FOX ASKS MR. PIT WHAT HE ENJOYS, I ENJOY A GOOD BALANCE SHEET.
GIVING AWAY THAT MUCH MONEY TO A MULTIBILLION DOLLAR ORGANIZATION AND BUILD THAT BUILDING ANY WAY, IT IS JUST WRONG I TOTALLY AGREE. THANK YOU.
SINCE YOU ARE ASKING FOR THEM, $130,000.
I DON'T KNOW WHO WOULD DO THIS STUDY FOR THE GENERAL PUBLIC WANTS TO ANSWER THIS QUESTION WE'LL FIND OUT LATER ON SOME PLACE. YOU ARE DOING THIS BIG WORK FORCE PRETTY SOON. THIS IS INFORMATION PROVIDED AT ONE OF THE BOARD COUNTY COMMISSIONER MEETINGS ABOUT WHAT IS GOING ON UP THERE. I WOULD LIKE TO BE ON THE RECORD TO REMIND YOU ALL THERE HAVE BEEN ACCIDENTS AND DEATHS AT STOKES LANDING. STUDIES CAN OR CANNOT PROVE.
>> YES, THANK YOU. I'LL GIVE A QUICK SUMMARY WITH THIS PROJECT PLANNING, BY NO MEANS TRANSPORTATION ENGINEER.
I'LL GIVE A GENERAL SUMMARY. WHAT WE HAVE HERE.
WE ARE NOT ASKING FOR ANY ADDITIONAL COMMERCIAL SQUARE FOOTAGE WITHIN THIS PUD THAT IS ALREADY APPROVED.
THE REASON FOR THIS MAJOR MODIFICATION IS TO INCORPORATE A 0.30 ACRE PIECE OF PROPERTY. WE ARE CLARIFYING THAT WITH THIS MODIFICATION, REDUCTION IN BUFFERS.
HOWEVER WE ARE PLANNING PART OF THE ENGINEERING WE WILL HAVE TO LOOK AT TRIP GENERATION AND TRAFFIC.
AT THIS TIME IT IS NOT EXACTLY KNOWN WHAT THAT TRIP GENERATION WILL BE. THIS PROJECT WILL BE A COMBINATION OF MEDICAL AND GENERAL OFFICE.
THOSE HAVE SLIGHTLY DIFFERENT TRIP GENERATIONS.
[02:10:06]
AS FAR AS THE TRAFFIC SIGNALIZATION WE DID HAVE A PREAPPLICATION HOWEVER IT IS KIND OF A COMPLICATED METHODOLOGY THAT HAS TO BE DONE FIRST WITH TRAFFIC SITE ANALYSIS. THEN A MORE, AS I UNDERSTAND IT ADVANCED STUDY WOULD BE DONE AFTER THAT CALLED ICE WHICH LOOKS AT NOT ONLY TRIP GENERATION BUT THINGS LIKE SAFETY CONCERNS. CURVATURE OF THE ROAD.POPULATION. PATHS TO SCHOOL BUSES.
ALL TYPES OF THINGS FACTOR INTO WHETHER OR NOT A SIGNAL SHOULD BE WARRANTED FOR A PARTICULAR LOCATION.
AT THIS TIME I DO NOT BELIEVE IT WOULD BE WARRANTED.
HOWEVER WE WOULD HAVE TO DO A FULL TRAFFIC STUDY TO UNDERSTAND
COMMISSIONER DEAN. >> FIRST OF ALL IT IS AMAZING, RESIDENTIAL AND COMMERCIAL BUSINESS GROWTH EXPONENTIAL.
IT AIN'T LIKE IT WAS FIVE YEARS AGO.
MY QUESTION. I DON'T KNOW IF HE HAD COMMENT OR SUGGESTIONS ABOUT A TRAFFIC STUDY TO DETERMINE WHETHER A TRAFFIC LIGHT IS WARRANTED AT THIS TIME.
THAT WOULD BE MY REQUEST. >> I THINK IT WOULD BE GOOD TO
HEAR FROM STAFF RIGHT NOW. >> GOOD MORNING MR. CHAIRMAN, COMMISSIONERS. FUNG WANG.
RELATING TO 207. WE HAVE BEEN MONITORING THAT SEGMENT OF ROADWAY FOR THE PAST OVER 12 YEARS.
PROPOSED DEVELOPMENT WITH THE INTERSECTION FOUR QUADRANTS THERE. TO DETERMINE WHETHER SIGNAL WARRANTS HAVE MET AND THEN IT TAKES ANOTHER AT LEAST 18 MONTHS AFTER THAT TO PROGRAM FOR SIGNALIZATION.
THOSE ARE FOR THE PUBLIC 207 WILL BE RESURFACED SOON WITHIN A YEAR OR SO. TRY TO AVOID 207 AS MUCH AS YOU CAN. SO.
DOES STAFF HAVE ANYTHING ELSE TO ADD? OKAY THANK YOU. MR. MCCORMICK.
>> SEEING HOW THZ THIS IS QUASI-JUDICIAL.
FOR THE RECORD ASK IF THERE IS ANY OTHER REBUTTAL TO PUBLIC COMMENT BY THE APPLICANT AT THIS TIME.
MR. CHAIRMAN, IT IS JUST MY SENSE AS YOUR COUNTY ATTORNEY.
I DO THINK THE REQUEST FROM COLONEL DUDLY RELATED TO THIS IN THE SAME INTERSECTION AREA. I DON'T THINK THIS POINTS TO THIS APPLICATION SHOULD BE RESPONSIBLE.
THAT WAS MORE OF MY SENSE WAS A GENERAL REQUEST.
FOR THIS TRAFFIC STUDY. OR PERHAPS AN ACCELERATED REVIEW. I THINK ANY DIRECTION THE BOARD MIGHT WANT TO GIVE ON THAT CAN BE HANDLED SEPARATELY THAN ON A
[02:15:05]
MAJOR -- THANK YOU. >> COMMISSIONER WHITEHURST, I APPRECIATE COLONEL DUDLY BRING THIS UP.
>> I WAS GOING TO MAKE A MOTION? >> I'LL LET YOU DO THAT.
COMMISSIONER WHITEHURST FIRST. >> WHO WOULD PAY FOR THE TRAFFIC STUDY? DEVELOPER IN THIS CASE OR DOT? COUNTY ON THE HOOK? ANYBODY HAVE THE ANSWER?
>> MAY I MAKE A SUGGESTION. PART OF THIS APPROVAL TO HAVE THE APPLICANT CONDUCT SIGNAL WARRANT STUDY.
WE HAVE TO WAIT UNTIL DOT CAN COME THROUGH THERE.
JUST TO SEE THE IMPACT OF THE DEVELOPMENT TO THE INTERSECTION.
>> WITH ALL DO RESPECT TO MR. FONG.
IF THIS WERE A SPECIAL USE APPLICATION OR VARIANCE APPLICATION. I THINK THE BOARD COULD ATTACH A CONDITION LIKE THAT ON TO THIS FOR THE APPLICANT.
THIS BEING A PUD MAJOR MOD. IT WOULD BE MY ADVICE NOT TO REQUIRE THAT THE APPLICANT PAY FOR THAT IS PART OF THIS MAJOR MOD DECISION. THANK YOU.
>> WE ARE GOING TO COMMISSIONER DEAN NEXT.
312 INTERSECTIONS ALL THE WAY TO 95.
THIS PARTICULAR AREA IS GETTING CRAZY.
PERSONALLY, I WOULD NOT BE IN FAVOR OF TRYING TO REQUIRE OR OTHERWISE CON JOL THE APPLICANT. WHICH IS THE BUSY B.
THEY LOOK INTO THAT CONSIDERATION.

It is estimated that FEMA will reimburse up to 90% of eligible expenditures and the State will reimburse up to 5% of eligible expenditures, leaving St. Johns County to fund the remaining 5%. Summer Haven emergency beach berm project is estimated to cost $201,500 it is anticipated that FEMA and the State will reimburse $163,350 and $9,075 respectively, for the approved area and the County would be responsible for $20,000 of the area not approved. In total the County’s portion to complete this project would be $29,075. The County’s portion is requested herein to be transferred from the General fund.]

[02:45:01]
HARD WORK. THANK YOU.>> WHY DON'T WE MOVE INTO AGENDA ITEM NO. 10 AND ASSESS IF WE
WANT TO KEEP MOVING HERE. >> GOOD MORNING COMMISSIONERS, I AM HERE TO TALK ABOUT A SMALL BEACH PROJECT PART OF A LARGER PROJECT. THIS IS A SMALL PIECE.
REASON WHY I AM BRINGING IT TO YOU IS WE HAVE AN ABILITY FOR COST SAVINGS. WE HAVE A CONTRACTOR ALREADY WORKING ON A PROJECT TO DO A CHANGE ORDER TO BRING ON BOARD TO DO THIS SECTION WE HAVE. I APOLOGIZE THIS SLIDE IS MESSY.
IT IS THE AREA WE ARE TALKING ABOUT R MONUMENT 203 TO THE SOUTH, 202 TO THE NORTH. TO THE NORTH 202 WATERWAY DISTRICT PROJECT COMPLETED A COUPLE OF YEARS AGO.
IRMA WE PUT IN A PROJECT FOR BETWEEN BASICALLY THE SOUTH AREA BASICALLY THE REASON WE WENT TO R 202 WE UNDERSTAND THE PORT WATERWAY DISTRICT WOULD GO ALL THE WAY TO 202.
HOWEVER IT FELT SHY. 166 FEET DIFFERENCE NORTH OF 202. PROJECT CURRENTLY IS ELIGIBLE FOR THE FEMA REIMBURSEMENT BETWEEN R 203 AND R 202.
THAT IS THE 191 MILLION DOLLARS, 90% COST SHARE WITH THE STATE.
5 PERCENT FOR THE COUNTY. QUESTION I WANTED TO HIGHLIGHT BETWEEN 202 AND 201.8, 166 FEET. THAT IS NOT CURRENTLY COVERED BY EITHER STORM EVENT HOWEVER WE HAVE TALKED ABOUT TO FEMA SPECIFICALLY ON THE IRMA -- THEY ARE LOOKING TO ALLOW US TO ADD THIS PIECE TO THE CLOSE OUT PROJECT.
WE SHOULD BE ABLE TO GET REIMBURSEMENT AT THE 9010 SPLITTER, 9055. HOWEVER WE DON'T HAVE THAT CURRENTLY. WE ARE WORKING AND TOLD IT IS LOOKING LIKE IT IS POSSIBLE. THAT IS THAT SEPARATE PIECE OF IT. SEEKING REIMBURSEMENT FOR THAT.
SO WITH THAT, I HAVE A MOTION AND I AM HERE FOR ANY QUESTIONS.
>> ANY QUESTIONS FOR STAFF? OKAY.
COMMISSIONER WHITEHURST? >> IT HAS COME TO MY ATTENTION THROUGH RECEIVING SEVERAL E-MAILS THERE ARE PARTS OF OUR COASTLINE WHO NO LONGER WISH TO HAVE SAND THAT WE ONCE THOUGHT MAY HAVE WANTED SAND AND BOUGHT WITH FUNDING.
THERE HAS BEEN FUNDING ALLOCATED.
COULD SOME OF THAT FUNDING BE USED TO FUND THIS PROJECT TO
PROJECTS ARE VERY SPECIFIC WHERE THEY ARE ALLOCATED FOR CERTAIN
PROJECTS. >> I M COMING FORWARD WITH A LARGER PROJECT FEMA BEACH BIRM. ANSWER IS NO.
THAT IS WHAT IS COVERED. RESIDENTS OR FOR SOME REASON WE DON'T DO THAT PROJECT THERE, WE DON'T SEEK REIMBURSEMENT, THANK YOU. SIR.
>> COMMISSIONER DEAN? >> I AM SOME WHAT PUZZLED ABOUT THE FACT THIS PARTICULAR -- I AM SORRY? I THOUGHT I WAS SPEAKING INTO THE MICROPHONE.
I AM SOME WHAT PUZZLED AND DISAPPOINTED THIS PARTICULAR GAP THAT IS BEING PROPOSED DOESN'T RISE TO THE LEVEL OF 12 FEET BECAUSE PROBABLY DON'T SEE WAY TO CHANGE FEMA.
[02:50:07]
I DON'T WANT TO GET INTO DISCUSSION TODAY TO DISCUSS WHAT WOULD BE A MAJOR BUDGET IMPACT WITHOUT HAVING IT THOROUGHLY VETTED BY STAFF UNTIL THE TIME WHEN YOU CONSIDER THE FACTS COMMISSIONER SMITH CONSIDER BUDGET ITEMS WHEN THEY ARE WELL VETTED AND WELL REPAIRED. I WANT TO EXPRESS MY DISAPPOINTMENT. THIS GAP IS ONLY SIX FEET AND GOING TO CONNECT AS I UNDERSTAND IT.>> TO THE SOUTH YOU ARE CORRECT BEACH BIRM WE PUT TOGETHER.
SO WE, IRMA TO GO BACK MATTHEW WE HAD A BREECH THERE.
THIS PROJECT WAS TO REPLACE PROTECTION FOR IRMA.
THERE WAS TWO PROJECTS IN THE LOCATION.
DIFFERENCE BETWEEN THE SOUTH, SOUTH IS IS A DIFFERENT TYPE OF PROJECT. STARTED AS A ROAD PROJECT TALKED ABOUT PUTTING A ROAD IN A DUNE. THIS AREA ONLY QUALIFIES FOR BIRM SAND. ALREADY HAD A PROJECT WITH THE BREECH WE COULDN'T ADD TO IT. ONLY COULD GO UP TO THE FIVE-YEAR STORM LIMIT. I KNOW I AM GETTING MORE TECHNICAL. ONLY QUALIFIED UP TO SIX CUBIC
YARDS. >> BASED ON THAT OUR HANDS ARE TIED WITH RESPECT TO ADDITIONAL FUNDING.
THAT JUST REINFORCED MY POINT. MAYBE IN THE NOT TOO DISTANCE FUTURE CIRCUMSTANCES CHANGE. IT IS GOING TO BE A HUGE DIFFERENCE BASED ON STORMS WE DON'T EVEN PREDICT TODAY NEXT SIX MONTHS, NEXT YEAR, TWO YEARS.
STORM SURGE ON THIS PARTICULAR SECTION SIX FEET VS. TWELVE AND HIGHER. MAYBE WE WILL HAVE A CHANCE TO VISIT THIS WHEN TIMING IS APPROPRIATE.
I WANT TO BE TON RECORD. >> THANK YOU, COMMISSIONER.
ANYTHING ELSE FROM THE BOARD? OPEN THIS UP TO PUBLIC COMMENT ITEM 10? PLEASE APPROACH THE PODIUM MISS

I APPRECIATE YOU TABLING THIS. WE HAVEN'T HAD A CHANCE TO GET WITH OUR CONSTITUENTS. WE HAVE PEOPLE PREPARED TO SPEAK IF NECESSARY. I WOULD LIKE TO THANK YOU FOR ALL THE WORK YOU HAVE DONE AT SUMMER HAVEN.
IT IS A SMALL HAMLET BUT A VERY VALUABLE PLACE.
IF YOU HAVEN'T BEEN THERE INVITE YOU TO COME WE APPRECIATE YOUR TIME. I WOULD LIKE TO MAKE A COUPLE OF BRIEF COMMENTS. I WOULD LIKE TO TELL YOU VERY QUICKLY THE VOLUME AND I'LL TRY NOT TO TALK ABOUT SUMMER HAVEN RIVER. I NEED A SOAP BOX FOR THAT.
ANYHOW, BIRMS PROTECT HOMES NOT JUST 1A 1 BUT SUMMER ISLAND.
THEY PROTECT SUMMER HAVEN RIVER WHICH EFFECTS -- PROVIDES ENVIRONMENTAL RECREATIONAL, ECONOMIC AND HISTORIC BENEFITS.
PROTECTS A 1 A WHICH IS AN EVACUATION ROUTE.
I AM LOCAL, BORN AND RAISED IN ST. AUGUSTINE.
I HAVE SEEN TIMES WHEN IT WAS USED WHEN THEY HAD FIRES IN PALM COAST. THEY MADE BOTH LANES NORTHBOUND TO GET PEOPLE OUT BECAUSE THEY VERY IMPORTANT ROAD.95.- THESE DUNES PROTECT IT. DURING MATTHEW CAME RIGHT OVER A 1 A, WATER FROM THE OCEAN. IT IS NOT JUST ABOUT SUMMER HAVEN IT IS ABOUT OUR COMMUNITY. THE DUNES ALSO PROVIDE HABITAT.
TWO LISTED SPECIES THAT USE THE DUNES THERE.
[02:55:04]
SEA TURTLES AND LEASE TURNS PIPING CLOVERS, THERE IS A BENEFIT TO HABITAT AS WELL. I AM TELLING YOU THIS SO YOU CAN BE THINKING ABOUT IT WHEN YOU TALK TO PEOPLE AND WHEN YOU BRING THIS UP AGAIN. AND THE WAY TO PROTECT THIS AREA IS TO PUT IN A SUBSTANTIAL DUNE SYSTEM.IT IS NOT HARDENED THERE. SHORELINE IS NOT HARDENED THERE.
ALL COASTLINES IN FLORIDA NEEDS TO BE MAINTAINED.
FROM WHAT WE CAN SEE AS PEOPLE WHO LIVE DOWN THERE IF YOU COULD REGULARLY MONITOR THE DUNE IF THERE IS A LOW AREA.
BRING IN SAND AND FILL THE LOW AREAS IN.
WATCH IT. BE PROACTIVE AM I DONE? UGH UGH. OKAY.
I CAN WRAP IT UP QUICKLY. IF THERE IS A BREECH THE SIZE OF THIS PODIUM, BRING SAND IMMEDIATELY UNDER EMERGENCY DEP PERMIT AND HEAL THE BREECH WHILE IT IS COST EFFECTIVE AND GET IT
CHEAPLY AND QUICKLY. >> WE ARE DONE.
>> NEXT SPEAKER. >> I AGREE WITH THE LADY AND VICE CHAIRMAN DEAN. ULTIMATE SOLUTION IS ONE PROPOSED BY THE MAYOR. IF WE ARE GOING TO PROTECT A 1 A. IF WE ARE GOING TO PROTECT OUR ECONOMY WE HAVE TO TAKE INITIATIVE TO GET CONGRESS TO PASS FIRST NATIONAL PARK SERVICE STUDY ACT.
PROVIDE FOR HEARINGS. AND IN TWO YEARS OR SO, MAYBE LESS CONGRESS WOULD GET RECOMMENDATIONS FROM NATIONAL PARK SERVICE, TWO, THREE, FOUR RECOMMENDATIONS.
I THINK WHAT IT NEEDS TO LOOK LIKE THOUGH IS PROPOSAL WE CAME UP WITH IN 2006. THAT WOULD TAKE ACRES.
HALF LAND ACQUIRED BY AND REDEEMED FOR HOT WATER MANAGEMENT DISTRICT. PUT THAT ALTOGETHER.
140,000 ACRES IN TWO COUNTIES. WE CAN PRESERVE AND PROTECT OUR SYSTEM PUT IT IN THE HANDS OF THE PROFESSIONALS.
SEE THE BOOK CADILLAC DESERT. DESCRIBES WHAT THE ARMY CORP DID TO THE WEST. NATIONAL PARKS SERVICE BEEN DESCRIBED AS AMERICA'S BEST IDEA.
IF YOU LOOK AT KEN BURN SERIES, EVERY SINGLE ONE OF THE PARKS WAS THE RESULT OF LOCALS. PEOPLE WHO SAW A BEAUTIFUL SUNSET WHERE THEY SAW A BEAUTIFUL FOREST OR GRAND CANYON. THEY SAID WE ARE GOING TO PROTECT THIS. WE HAVE TO MAKE THAT DECISION, GENTLEMAN. FASTER THAN THE SPEEDING DUMP TRUCK DEVELOPERS ARE MAKING ST. JOHNS COUNTY GOD'S COUNTRY.
FUTURE AGENDA, LET'S TALK WITH OUR CONGRESSMAN.
LET'S GIVE THEM WORK TO DO. WORK THAT IS BENEFITTING THE PEOPLE RATHER THAN VOTING TO SACK LIZ CHENEY OR RIDICULOUS STUFF OR SUPPORTING INSURRECTIONIST OR SAYING TO SAY BIDEN WASN'T ELECTED. LET'S GET ST. JOHNS COUNTY TO DO SOMETHING FOR THE PEOPLE. HISTORICAL PARK.
WOULD PRESERVE WHAT WE KNOW AND LOVE.
PROTECT US FROM FLOODING. HELP TO INCREASE BARRIERS.
PROTECT US IN THE EVENT OF ANOTHER HURRICANE OR OCEAN LEVEL RISE. WE HAVE TO DO IT, FOLKS.
DEVELOPERS ARE NOT GOING TO DO IT FOR YOU.
THEY ARE NOT GOING TO DO ANYTHING OTHER THAN CONTINUE TEARING DOWN NATURE AND DESTROYING WHAT WE KNOW AND LOVE. TO PRESERVE AND VALUE PEOPLE'S HOMES. WE HAVE TO HAVE.

MOVE AHEAD. THANK YOU.NAME AN ADDRESS. >> GOOD AFTERNOON, ME AGAIN, ED SLAVIN, BOX 3084, EDSLAVIN.COM. FIRST I WANT TO POINT OUT $700,000 WAS EMBEZZLED THE FLRIDA SHERIFF'S DEPARTMENT AND THE LADY WHO DID IT GOT A PLEA-BARGAIN.
MAY NOT BE HONORED BY THE JU JUDGE.
I HOPE HE REJECTS IT. DAVID SHORE RECOMMENDED A PLEA-BARGAIN THREE TO SEVEN YEARS FOR STEALING THAT MUCH MONEY AND GETS A DISCOUNT ON THE TIME SERVED IF SHE RETURNS SOME OF THE MONEY. I DIDN'T KNOW THEY DID A CONSTRUCTIVE TRUST AND GET THAT MONEY IMMEDIATELY.
THAT THIS IS OUTRAGEOUS. I WOULD LIKE TO HAVE A REPORT FROM THE INSPECTOR GENERAL OF ST. JOHNS COUNTY AT THE NEXT MEETING. YOU NEVER DID BOTHER TO ASK THE CONSTITUTIONAL OFFICERS TO PRESENT THEIR BUDGETS.
SO AT THE COUNTY ADMINISTRATOR'S BUDGET HEARING NEXT WEEK, THREE DAYS, AT THE AG CENTER.
WHY THE AG CENTER? WE DON'T HAVE THE OPPORTUNITY TO QUESTION THE NEW HER PWRIVT EMBEZZLEMENT AND PROCEDURAL SAFEGUARDS AND HOW IT IS FIVE YEARS THAT SOMEBODY WAS ABLE TO EMBEZZLE THAT MUCH MONEY. RIGHT OUTSIDE DAVID SHORE.
DAVID SHORE IS STILL RUNNING THIS COUNTY BECAUSE WE ARE NOT ABLE TO HAVE THIS ISSUE DISCUSSED.
NO REPORT SCHEDULED FROM THE CLERK OF COURTS OR THE SHERIFF.
ALSO, I AM VERY DISAPPOINTED, GENTLEMEN.
MARCH 8, COUPLE OF LADIES REQUESTED A SIMPLE PROCLAMATION FOR GAY PRIDE, LBGTQ GAY PRIDE. THEY NEVER GOT A WRITTEN RESPONSE. ONE FROM THE ST. JOHNS BOARD OF COMMISSIONERS SAID WITHOUT A VOTE, WITHOUT YOU GUYS HAVING DISCUSSED IT OR PUT IT IN THE AGENDA THAT THE BCC WAS NOT GOING TO DO IT BECAUSE THEY DIDN'T WANT ANYTHING TOO LEFT AND TOO RIGHT. GAY RIGHTS IS JUST RIGHT.
WE HAD UNTIL 2005 A NUMBER OF SUPREME COURT DECISIONS THAT PROTECTED OUR RIGHTS. I AM PERSONALLY OFFENDED, GENTLEMEN, THAT YOU WILL DEVALUE MY RIGHTS AS A GAY MAN AND THOSE LADIES WHO ASKED FOR IT AND PROUD OF COMMISSIONER HENRY DEAN TELLING THE PRESS THAT HE WOULD VOTE FOR IT.
VOTE FOR THE PROCLAMATION PUT ON THE AGENDA.
THE PROBLEM SEEMS TO BE MR. CHAIRMAN BLOCKER.
YOU REFUSED TO PUT IT ON THE AGENDA.
I WOULD LIKE FOR YOU TO SAY ON THE RECORD THAT YOU WOULD ALLOW A VOTE BECAUSE I DON' THINK ONE MAN SHOULD ASTRIDE PROGRESS, PROGRESS WITH MULTIPLE SUPREME COURT DECISIONS THE LAW OF THE LAND AND SAY YOU THINK OUR RIGHTS SHOULD BE DEMEANED AND YOU WILL NOT EVEN ALLOW A DISCUSSION BY THIS BOARD WHICH HAS NEVER RECOGNIZED THE JUNE 15TH, 2020 DECISION IN BOSTOCK VERSUS CLAYTON COUNTY, GEORGIA.
YOU HAVE NOT DONE ANYTHING -- ST. AUGUSTINE, ST. AUGUSTINE BEACH HAVE DONE PRIDE PROCLAMATION SEVERAL YEARS RUNNING. WHY NOT YOU? ARE YOU AFRAID OF THE KLU KLUX KLAN? I AM NOT. YOU NEED TO BE REPLACED IF YOU WON'T DISCUSS THIS. YOU NEED TO BE REPLACED IF YOU DON'T DISCUSS THIS. PLEASE PUT IT ON THE AGENDA.

I OPEN PRIDE TICKETS WITH ST. JOHNS COUNTY.
SORRY -- PRIDE TICKETS FOR ST. JOHNS COUNTY -- WITH ST. JOHNS COUNTY ALMOST TWO YEARS AGO AND IN -- NOVEMBER 8,2019 AND THESE ISSUES HAVE NOT BEEN FIXED. COUNTY OFFICIALS HAVE BEEN OUT TO MY PROPERTY AND AGREE THERE ARE ISSUES THAT NEED TO BE FIXED. I AM ASKING THE COUNCILMEMBERS TO HELP PATRICK MCCORMICK AND WHO NEEDS TO GET THE ISSUE FIXED RIGHT AWAY AS IT HAS BEEN WELL OVER 18 MONTHS.
AND THE WATER CONTINUES TO DAMAGE OUR HOME IN MARSH MARSHLANDING. TAMPA IT IS ALSO BROUGHT TO OUR ATTENTION THAT OUR PONDS DON'T MEET THE STATE OF FLORIDA AND
[03:10:03]
ST. JOHNS REQUIREMENTS FOUR TO ONE SIDE SLOPE ISSUES.THIS IS JUST AN EXAMPLE OF ONE POND AND IT SHOULD BE GREEN ON ALL SIDES AROUND TO SHOW FOR SAFETY FOR ANYONE WHO FALLS IN BEING CHILD, ELDERLY, ANYONE. FOR SAFETY ISSUES.
I AM ASKING THAT THE COUNTY LOOK INTO THIS AND THE RULES TO MAKE SURE OUR COMMUNITY IS SAFE.
AND TO PLEASE HELP ME FIX THE ISSUES THAT THE COUNTY HAS COME OUT AND LOOKED AT AND AGREED NEED TO BE FIXED.
I APPRECIATE YOUR TIME. THANK YOU.
>> LET ME MAKE ONE COMMENT IF I MAY.
ASK PUBLIC COMMENT AND GROWTH MANAGEMENT TO GET IT -- IS IT
>> JEREMIAH BLOCKER: BEFORE WE GO ANY FURTHER, ASK PATRICK ON THIS. WE HAD NUMEROUS CONVERSATIONS ABOUT THIS AND YOU UPDATED US. WILL YOU UPDATE THE BOARD WITH
THIS. >> PATRICK MCCORMACK: SURE.
THANK YOU, MISS FISH ARE FOR BRINGING THIS INFORMATION IN FRONT -- FISHER FOR BRINGING THE INFORMATION IN FRONT OF THE BOARD. WE WILL PUT THE DOCUMENTS IN
THE RECORD. >> JEREMIAH BLOCKER: IF YOU CAN HAND THAT OVER TO THE ACCOUNT ATTORNEY FOR THE RE
RECORD. >> PATRICK MCCORMICK: IT MAY BE HELPFUL I THINK IF MR. DESOUZA IN PUBLIC WORKS HAS A VERY DETAILED KIND OF UNDERSTANDING OF THIS.
IN A NUTSHELL, I THINK MISS FISHER'S CONCERNS ARE VALID CONCERNS. A SOMEWHAT COMPLICATED SITUATION BECAUSE IT ROFES THE WATER MANAGEMENT DISTRICT, THE MARSHLANDING AND HOA OR BROADER THAN THAT THEIR PARTIES AND ON TOP OF THAT SORT OF A COUNTY REVIEW OF WHAT WILL BE DONE ON THESE BONDS. THERE ARE A NUMBER OF ISSUES.
THERE ARE SOME FLOODING ISSUES. THEY ARE BASICALLY FOR CNSTRUCTION, ELECTRICAL. AS MISS FISHER POINTED OUT, I THINK THERE ARE SOME THE PONDS. THE SLOPE IS COMPLICATED IN S SUM, IN THAT THIS SUBDIVISION WAS BUILT BEFORE A LOT OF THE COUNTY REGULATIONS PERTAINING TO SOME OF THE ELEMENTS ARE, BUT NONETHELESS, THEY DO HAVE TO MEET THE WATER MANAGEMENT DISTRICT REGULATIONS AND TO DO THAT ULTIMATELY THEY WILL NEED A COUNTY PERMIT TO HAVE THAT WORK COMPLETED.
THAT'S IT IN A VERY BROAD NET SHELL.
I THINK MR. DESOWS ZA SNOWS THIS MUCH MORE IN DETAIL SHOULD THE BOARD WISH THAT DESCR DESCRIPTION.
THANK YOU. >> JEREMIAH BLOCKER: WHY DON'T WE DO THIS GO THROUGH PUBLIC COMMENT AND ASK MR. DESOUZA TO
WEIGH IN. >> I AM JAMES HENSLEY, 7330 UPON DRA VIS DRA BEACH. MY FORTH TIME COMING HERE AND HOPEFULLY IT MIGHT BE MY LAST FOR YOUR SAKE AND ALL OF US.
I WANT TO GO OVER A COUPLE OF DOCUMENTS IN MY MINUTES.
AND I WANT TO MAKE SURE THIS IS IMPORTANT FOR YOU TO SEE.
IT HAS TANK US FOUR YEARS FOUR YEARS TO GET RIVER WATER MANAGEMENT TO FINALLY ADMIT THAT MARSHLANDING SUBDIVISION WAS NOT CONSTRUCTED CORRECTLY, RIGHT, NOR WAS IT MAINTAINED CORRECTLY AND I DID THIS ALL ON MY OWN.
1100 PEOPLE IN THERE AND I AM ONLY ONE PERSON AND TOOK ME ALMOST FOUR YEARS. TOOK ME -- I HAVE HIS PERSONAL CELL PHONE THE HEAD OF DEP HAS HELPED ME ADAM BLALOCK HELPED ME. RON HOUSE HELPED ME.
THE DEPARTMENT OF TRANSPORTATION.
I HAVE DONE THIS ALL ON MY OWN. AND I WANT YOU TO SEE THE NAMES ON THAT LIST, ML PARTNERSHIP, MARSHLANDING WHO BUILT IT AND THE PEOPLE WHO BUILT IT. I WANT TO SHOW YOU THEIR
COMMENTS. >> JEREMIAH BLOCKER: MR. HENSLEY -- PATRICK, WE CAN'T SEE WHAT HE IS TRYING TO SHOW US. CAN YOU ENLARGE IT PLEASE.
>> I WANT -- >> JEREMIAH BLOCKER: SIR, HOLD US A SECOND. GIVE US A CHANCE -- IS THAT
BETTER? >> AS YOU SEE THE PARAGRAPH AS STATED THE SYSTEM WAS NOT CONSTRUCTED AND OPERATED PER THE ORIGINAL PERMIT AND THE MODIFICATION THAT THEY ARE DOING AND DID NOT MAINTAIN IT CORRECTLY EITHER.
WANT TO MAKE THIS EITHER. AND YOU CAN HEAD IT YOURSELF
[03:15:05]
BASED ON THE RESULTS. STAFF DETERMINED THE EXISTING SYSTEM WAS NOT FOR THE ORIGINAL PERMIT.AND IF YOU ARE OKAY SEEING T THAT, I THOUGHT IT WAS IMPORTANT FOR ALL FOUR OF YOU SEE THAT IT IS ALL ON RIVER MANAGEMENT AND I FINALLY GOT IT DONE AFTER FOUR YEARS THAT GOES TO THE ISSUE I WANT TO DISCUSS EVEN MORE AS YOU GO THROUGH MARSH LANDING, MANY DEVELOPERS IN MARSH LANDING.
EVEN THOUGH I HAVE 40 SECONDS TO GO AND A LOT OF ISSUES AND THEY ARE JUST STARTING TO UNFOLD THEM TOO.
I, TOO, HAD PRIDE TICKETS OPEN, JUST TO BE CLEAR, FOR 29 MONTHS TO GET THINGS DONE. 29 MONTHS.
PLANNED DESOUZA HERE. 'S GREAT GUY, BUT IT IS TIME THAT WE NEED YOUR HELP. MARCH LANDING HAS BEEN IGNORING YOUR PEOPLE AND WE NEEDED HELP FOR LONG TIME TO FINE THEM OR HAVE THEM COME TO THE TABLE. THE CONSTRUCTION PERMIT THEY STARTED IN AUGUST OF 2020. THEY DID THAT WITHOUT A COUNTY PERMIT -- DICK IS HERE. THEY KNEW THEY NEEDED A DOWNTOWN PERMIT AND IGNORED YOU AND BUILDING SINCE LAST AUGUST.
WE ARE TALKING ELECTRICAL MOVEMENTS AND, ETC.
>> HENRY DEAN: THANK YOU, SIR. >> WANT TO MAKE SURE THAT WE
ARE CLEAR. >> HENRY DEAN: NOW WE ARE UNDER GENERAL PUBLIC COMMENT. WE WILL COME BACK -- ANY FURTHER PUBLIC COMMENTS? YES, SIR.
YOU GOT TO DO YOUR NAME AND ADDRESS AGAIN, I AM SORRY BUT
EVERY TIME. >> NAME IS BILL HENESSEY, ST.
AUGUSTINE, FLORIDA. WINDSWEPT ACRES SUBDIVISION.
I'M HERE REPRESENTING 200 OF THE RESIDENTS WHO SIGNED PETITIONS WANTING TO KNOW JUST WHAT IS GOING ON WITH BUTLER PARK NORTH AND THE PALMETTO ROAD BOAT RAMP THAT IT SEEMS THE COUNTY TURNED OVER TO S SUNSET LANDING HOMEOWNERS ASSOCIATION. THEY LET THE MAN WHO BOUGHT THE LOT ADJACENT TO THE BOAT RAMP WHERE OFF 360-DEGREE TURN TO LAUNCH THE BOAT. THEY ALLOWED FOR HIM TO PUT A DRIVEWAY. CALLED FOR 17 PAVER AND ENDED UP 35-FOOT CONCRETE DRIVEWAY. AND LET HIM PUT A MAILBOX WHERE THEY ALREADY HAVE A MAILBOX STATION IN THE SUBDIVISION.
EVERYTHING THAT HAPPENED IN 2016 HAVE BEEN IN SAVER OF THE SUNSET LANDING RESIDENTS AND THE MAN WHO BOUGHT THE LOT ON THE SOUTH SIDE OF THE BOAT R RAMP.
WHEN HE BOUGHT THE RAMP, HE STARTED CUTTING DOWN MANGROVES.
WE REPORTED HIM TO THE REC DEPARTMENT AND AFTER HE LEFT, HE CONTINUED TO CUT THEM, 18 MORE FOR A TOTAL OF 27.
AND THEN CONTINUED. AND THEY STILL CONTINUED TO -- THE PEOPLE ON THE NORTH SIDE, ANY TIME SOMEBODY THEY HAVE A CONTRACTOR COME DOWN THERE. THEY BLOCKED A BOAT RAMP.
THEY BLOCKED A PARK. THEY HAVE CONSTRUCTION MATERIAL EVERYWHERE. PILINGS EVERYWHERE, AND PEOPLE ON THE NORTH SIDE THOUGHT WELL HE GOT AWAY WITH IT, HE WILL PUT PILINGS ON THE WATERWAY AND EXTENDED ABOUT 40 FEET.
RAN AIRLINE CABLE TO IT AND ATTACHED IT TO A FIXTURE ON THE PENINSULA PART OF THE PARK PROPERTY.
COULD HAVE KID SOMEBODY. AND THEY DID THIS WITHOUT A PERMIT. THE DOCK BUILDERS HAVE JUST LEFT DOWN THERE AND THEY PUT ANOTHER SECTION OF DOCK ON THE NORTH SIDE OF THE PEOPLE'S BOAT HOUSE WITHOUT PROBABLY AN EPA PERMIT BECAUSE WE GOT IN TOUCH WITH EPA AND THEY REMOVED THE PILINGS THERE ILLEGALLY. BUT SO FAR, THEY FIND THE PEOPLE ON THE SOUTH SIDE FOR CUTTING THE MANGROVES AND HE SAID THE HECK WITH IT. I GOT WITH MR. MCCORMACK, WE HAD A MEETING WITH THE REC DEPARTMENT, WITH THE HOMEOWNERS SAYING THEY ARE COUNTY RIGHT-OF-WAY.
THREE EMPLOYEES ONE WAS TEDDY MYERS HEADING THE BOAT RAMP DEPARTMENT. HE TOLD THE PEOPLE IT WAS NOT THEIR PROBLEM. THE NEXT -- THE MAN ON THE SOUTH SIDE CUT SOME PILINGS AND PUT REBARW IN THEM AND RIGHT NEXT TO THE BOAT RAMP AND HECK WITH EVERYBODY ELSE.
THAT IS MINE. THAT IS WHAT WE ARE DEALING WITH DOWN HERE AND GETTING HOSTILE.
[03:20:01]
AND MR. MCCORMACK KNOWS IT. > THANK YOU, SIR.>> GOOD AFTERNOON, BJ KALALY, WEST ST. AUGUSTINE.
LET ME THANK THE TOURIST DEVELOPMENT COUNCIL FOR PROVIDING GENERAL PUBLIC COMMENT AT THE BEGINNING OF THEIR MEETINGS AS WELL AS DURING AGENDA ITEMS. IN SHOWS RESPECT FOR THE PUBLIC WHO GOVERNMENT IS EMPOWERED TO REPRESENT. THOSE CONCERNED WITH THE TOURIST INDUSTRY, INCLUDING THIS BOARD, NEED TO LISTEN TO THE DISCUSSION ABOUT THE FIFTH CENT.
MR. DANNY'S COMMENT, A STUDY WITHOUT A REVENUE SOURCE FOR HIS VOTE WAS ENCOURAGING. THERE ARE NO TREES WITH $100 BILLS HANGING FROM THEM. ANOTHER COUNCILMEMBER ASKED ABOUT RAISING THE GAS TAX. THE BOARD OF COUNTY COMMISSIONERS SHOULD RETURN GENERAL PUBLIC COMMENT TO THE BEGINNING OF THE MEETING. THE BOARD OF COUNTY COMMISSIONERS SHOULD RETURN GENERAL PUBLIC COMMENT TO THE BEGINNING OF OUR MEETINGS. IT IS "OUR" MEETINGS.
NOT DEVELOPERS AND LAWYERS' MEETINGS.
AND THESE PEOPLE THAT HAVE BEEN SITTING HERE ALL DAY, LISTENING TO EVERYBODY ELSE AND FINALLY GETTING UP TO EXPLAIN TO YOU ALL WHAT IS GOING ON AND NO ONE ELSE HERE IN THIS AUDITORIUM.
THE DEVELOPERS, LAWYERS NEED TO SIT AND LISTEN TO THE PUBLIC.
WE HAVE TO LISTEN TO THEM. THEY CAN WAIT AROUND HERE AND LISTEN TO US IN THE BEGINNING. EVEN THOUGH EX-PARTE WAS NOT REQUIRED ON AGENDA ITEM 2 OR SOME OF THE OTHER ITEM, TRANSPARENCY TO THE PUBLIC ABOUT CONVERSATIONS WITH ELECTED OFFICIALS WHEN VOTING TO GIVE MILLIONS OF TAX DOLLARS TO DEVELOPERS TO ENCOURAGE MORE TRUST WITH OUR ELECTED OFFICIALS. LET ME REPEAT THAT, I GOT 1.01 SECONDS. EVEN THOUGH EX-PARTE WAS NOT REQUIRED ON AGENDA ITEM 2, TRANSPARENCY TO THE PUBLIC ABOUT CONVERSATIONS WITH ELECTED OFFICIALS AND STAFF WHEN VOTING TO GIVE MILLIONS OF TAX DOLLARS TO DEVELOPERS WOULD ENCOURAGE TRUST. YOU TRUST US.
WE TRUST YOU. SOME PEOPLE DON'T TRUST THE GOVERNMENT. AND THIS MAY BE ONE OF THE REASONS WHY. IT GOES BACK TO RESPECT.
AND I TRY TO BE RESPECTFUL AND SOME PEOPLE DON'T.
BUT I WILL CONTINUE TO COME UP HERE AND SPEAK FOR THE PUBLIC AS MUCH AS I CAN FOR THE QUALITY OF LIFE THAT WE ARE SUPPOSED TO BE LIVING IN THIS COUNTY AND THE CITY OF ST.
AUGUSTINE, WHICH IS GRIDLOCK, WHICH I HEARD A COMMISSIONER STATE. THANK YOU.
>> HENRY DEAN: THANK YOU. FURTHER GENERAL COMMENT? GENERAL PUBLIC COMMENT? NAME AND ADDRESS, HOWARD.
BOARD OF COUNTY COMMISSIONERS, UTAH FOR YOUR TIME.
I KNOW WE ARE STRETCHING OUT AND I WON'T NEED THREE MINUTES.
IN A COUNTY WHERE YOU HAVE SUCH DIVERSITY AND SUCH E EVER-CHANGING DEVELOPMENT AND THE NEED TO APPROVE THAT DEVELOPMENT, THERE ARE CONSTITUTIONAL RIGHTS -- HOWARD MCGAFFNEY. THANK YOU.
I BELIEVE THAT IT IS -- IT IS A TOUGH JOB FOR YOU.
I WANTED TO NOT CONTRADICT THE OTHER MEMBERS OF THE GENERAL PUBLIC BUT AS I AM A RESIDENT HERE OF THE COUNTY AND ALSO MANAGE SOME CDBS IN THE COUNTY. AND IT IS NOT AS EASY AS IT LOOKS. REQUIRES TO DO CERTAIN THINGS AND ALWAYS FOUND THE INDIVIDUALS HERE AND MET WITH MOST OF YOU INDIVIDUALLY TO TALK OF DEVELOPMENT IN THE COUNTY AND OTHER THINGS AND I WANT TO SAY YOU ARE VERY OPEN TO THOSE DISCUSSIONS BEFORE A VOTE.
AND ENCOURAGE RESIDENTS TO THE COUNTY TO REACH OUT TO ELECTED OFFICIALS AS I DO. I CAN RESPECT INDIVIDUALS WANTING TO COME UP AND VOICE THEIR OPINIONS.
AND TIE UP SOME TIME TO MAKE SURE THAT THEY GET THEIR OPPORTUNITY TO SPEAK AND MAKE SURE THEY ARE HEARD.
I JUST WANT TO SAY THAT I AM VERY, VERY APPRECIATIVE OF EVERYTHING THAT YOU DO AND YOUR DUE DILIGENCE.
MR. SMITH, APPRECIATE YOUR TIME AND LOOKING AT THE PGA AS WELL.
I HAD TO STEP OUT AND I KNOW THE PGA IS A GOOD PARTNER AND THEY GIVE BACK TO THE YOUTH AND I WAS AT ST. JOHNS MIDDLE
[03:25:03]
SCHOOL ASSOCIATION, AND I WAS AWARE THEY GAVE A GRANT TO THE MILL SCHOOL ATHLETIC ASSOCIATION.I WILL YIELD ANY OTHER TIMES AND MR. WALDRON, GLAD SEE YOU
BACK. >> HENRY DEAN: THANK YOU, HOWARD. ANY OTHER PUBLIC COMMENT? I THINK THAT COMPLETES PUBLIC COMMENT.
>> JEREMIAH BLOCKER: GENERAL PUBLIC NOW CLOSED.
ASK MR. DESOUZA TO COME BACK UP.
DICK. >> YES, SIR PWHOBINGZ BLOCKER YOU HEARD A DISCUSSION OF MARSH LANDING.
DO YOU HAVE ANY INFORMATION? >> MR. HENNSSEY CAME TO OUR STAFF. WITH HURRICANE MATTHEW.
AND THE CORRESPONDENCE WITH HIM AND MULTIPLE ENTITIES, NORMAL -- NUMBER OF HOAS AND HIS OWNER RESEARCH THAT HE HAD DONE DISCOVERED DISCREPANCY WHAT WAS PERMITTED WITH THE WATER MANAGEMENT DISTRICT VERSUS WHAT WAS CONSTRUCTED ON GROUND.
IN ADDITION VERY OBVIOUS EVIDENCE, ADVERSE IMPACT FOR HIS PROPERTY AND MILITIA FI FISHER'S POLICY.
STAFF DID RECOGNIZE THAT AND FELT THAT THE OVERALL CONSTRUCTION WAS IN VIOLATION FOR A NUMBER OF THESE THINGS.
THEY WERE ORIGINALLY CONSTRUCTED UNDER ORDINANCE 7838, I BELIEVE, WAS THE DEVELOPMENT CODE THAT THEY WERE -- THAT THEY WERE CONSTRUCTED UNDER WHICH IS VERY LIMITED COMPARED TO OUR CURRENT LAND DEVELOPMENT CODE STANDARDS.
THE THINGS WE LOOK FOR IN SUBDIVISION WAS NOT APPLICABLE AT THE TIME AND WE DO FEEL COMFORTABLE THERE WERE ISSUES THERE AND STAFF HAS GONE BACK AND FORTH WITH MARSH LANDING AND TO COME ABOUT TO HAVE THE PERMIT CORRECTLY AND COVERING EVERYTHING THAT THE COUNTY WAS INTERESTED IN FOR THE ACTIVE PRIDE COMPLIANT TO MAKE SURE TO BRING THEM IN COMPLIANCE AND FURTHER CLEAR OUT THE ISSUES. PART OF THE ISSUE WITH THE WATER MANAGEMENT DISTRICT THEY WERE PUT UNDER A FAIRLY EXTREME TIMELINE FOR COMPLETION OF WORK THAT THE COUNTY WAS NOT AWARE OF UNTIL MUCH LATER AFTER THE FACT.
PETITION YO THAT THE WATER MANAGEMENT DISTRICT HAD A LOT OF CONDITIONS ON THE PERMIT AND SOME OF THOSE CONDITIONS THAT DIDN'T NEED TO BE ACTIVELY ADDRESSED IN THE PERMIT THE WATER MANAGEMENT DISTRICT IS ISSUED COUNTY STAFF FELT NEEDED IN THE BIGGEST HOLD-UP FOR THEIR PERMIT GETTING UP OF OUR STAFF'S HANDS AND GETTING RELEASED FOR CONSTRUCTION.
WE FOUND OUT THEY WERE CONSTRUCTING SOME OF THE WORK.
SOME OF IT WAS CONSTRUCTION. SOME OF IT WAS MORE DEEMED TO BE IN THE EALM OF MAINTENANCE WHICH WE DO NOT PERMIT AT THE COUNTY. COUNTY STAFF FELT IT WAS REASONABLE TO CONTINUE SOME OF THAT WORK IN KIND KNOWING THAT WE WERE GOING TO PERMIT IT AND INITIAL REVIEW OF SOME OF THE WORK AND WE CHOSE A HIGHER LEVEL OF THERE ARE HOLD FOR PERMITS, FOR GROWTH MANAGEMENT PERSPECTIVE TO GUARANTEE AS-BUILTS. AND NECESSARY TO GET AS-BUILTS BECAUSE OF THE LARGE IMPACT THAT SOME OF THE IMPACT MIGHT BE. HAD TO GO OUT AND HAVE A PERMIT AT A MUCH LOWER THRESHOLD THAT WOULD -- WOULDN'T HAVE REQUIRED ANY INSPECTION STAFF TO MAKE ROUTINE INSPECTIONS AND CERTIFICATION WITH ALL THAT. THAT IS WHY WE ARE STILL SITTING HERE IN THIS HOLDING PATTERN WAITING TO SUBMIT BACK TO US HOPING THEY ARE IMPROVING SOME OF THIS WORK THAT THEY ARE WANTING TO SEE FROM THE COUNTY PERSPECTIVE TO CLOSE OUT SOME OF THESE PRIDE ISSUES. IF YOU HAVE ANY QUESTIONS, I
WILL BE HAPPY TO ANSWER THEM. >> JEREMIAH BLOCKER: I DO.
HAS A DETERMINATION THAT THEY ARE OPERATING WITHOUT A PERMIT.
>> THEY ARE DOING SOME CONSTRUCTION OUTSIDE OF BEING PERMITTED. SOME OF IT WILL BE DEEMED MAINTENANCE. SOME OF IT IS CONSTRUCTION.
A LOT OF IT REPLACING OF STRUCTURES.
CLEANING OUT OF PONDS. SOME OF IT RESHAPING PONDS.
BUT STRUCTURES THAT WEREN'T ORIGINALLY PERMITTED AND A DESIGN SWELL IN ONE INSTANCE. SWITCHED OVER TO PIPE SYSTEM FOR COLLECTION. COUNTY STAFF DID NOT WANT TO HOLD UP COMPLIANCE WITH A STATE PERMIT FOR SOME OF THESE ISSUES SO GROWTH MANAGEMENT STAFF FELT IT WAS ACCEPTABLE FOR SOME OF THESE SMALLER ISSUES THAT THEY WERE DEALING WITH TO CONTINUE AS HAD ALREADY BEEN GOING ON DIDN'T WANT TO STOP A GLOBAL PROBLEM FOR A COMMUNITY. EXPOSED SOIL.
STRUCTURES THAT MAY OR MAY NOT BE IN STATES OF DISARRAY.
CONNECTIONS THAT MAY NOT HAVE BEEN FULLY FUNCTION GOING WE PUT A FULL STOP TO IT AND WE ARE ASKING THEM TO DO WORK OUTSIDE OF THEIR STATE PERMIT. AND THERE IS SOME WORK BEING DONE OUTSIDE OF PERMIT FOR THE COUNTY.
[03:30:01]
>> WORK HAPPENING OUTSIDE PERMIT.
ANY OF THAT -- CAN ANY OF THAT RESULT IN A FINE FOR MARSH
LANDING? >> CERTAINLY COULD HAVE.
WE FELT THAT GROWTH MANAGEMENT. WE FELT THAT IT WAS ACCEPTABLE FOR A SMALL AMOUNT OF WORK TO CONTINUE KNOWING THAT THEY WERE COMING INTO PERMIT FOR US AND HAVING AN ACTIVE PERMIT ON HAND THAT WE WERE REVIEWING THAT THEY HAVE ALREADY PAID FOR AND THE WORK WE WERE SEEING IN THE PERMIT WE FELT MET OUR LAND DEVELOPMENT CODE, WORK THEY ALREADY STARTED IN ESSENCE.
WE SOUGHT COMMENCEMENT NOTICE THAT THE WATER MANAGEMENT DISTRICT HAD RECEIVED AND WE ACTUALLY DID REVIEW THOSE FOR ELEVATIONS MAKING SURE IT WAS HITTING WHAT WE NEEDED.
WOULD HAVE ALREADY LEFT PERMITTING IF NOT FOR THE FACT TRYING TO ENCOMPASS THINGS OUTSIDE OF THE WATER MANAGEMENT DISTRICT PERMIT AND NOTES OF CONCERN FOR SOME OF THESE PRIDE
CASES. >> JEREMIAH BLOCKER: OKAY, MR.
MCCORE MANAGE. >> PATRICK MCCORMICK: YES, THERE CHAIRMAN. BLOCKER PWLOYBINGZ ASKED MR. MCCORMACK AND TO FOLLOW UP ON THIS.
SEEMS LIKE THERE ARE A LOT OF MOVING PARTS AND STAY UPDATED
ON WHAT IS GOING ON. >> THANK YOU.
AND IF I MAY, MR. CHAIR. I THINK MR. DESOUZA IS WALKING A DESCRIPTION OF THE MATTER MORE IN A MEMO FORM.
I WOULD SAY THIS. I THINK OUR COUNTY STAFF OBVIOUSLY DEALS WITH A LOT OF CONSTITUENTS AND MAYBE HERE HAS BEEN USING SOMEWHAT OF THE C CARROT APPROACH AT SOME POINT THOUGH, MAYBE SOME OF THE STICK APPROACH MAY NEED TO BE UTILIZED AS WELL. AND WE -- WE WILL RE-REVIEW THIS WITH GROWTH MANAGEMENT, ETC. TO SEE IF THAT TOOL WILL BE APPROPRIATE TO BRING ONLINE. THANK YOU.
>> JEREMIAH BLOCKER: I LOOK FORWARD TO HEARING YOUR RECOMMENDATIONS. THANK YOU, COMMISSIONER DEAN.
>> HENRY DEAN: I WILL JUST ADD IF I MAY, MR. CHAIRMAN, INCLUDE A REPORT WHAT IS GOING ON WITH THE COUNTY LEVEL, ASK THE COUNTY STAFF TO KEEP US INFORMED HOW THE PERMIT PROCESS GOING WITH THE WATER MANAGEMENT DISTRICT BECAUSE BASICALLY THE SAME SUBJECT MATTER TWO DIFFERENT JURISDICTIONS AND DOING THE SAME THING AND I WOULD LIKE TO HEAR FROM THE
[Commissioners’ Reports]
WATER MANAGEMENT DISTRICT -- LIKE YOU GIVE US A REPORT FROM THE WATER MANAGEMENT DISTRICT OF THE PENDING PERMITS THEY AREPROCESSING. >> JEREMIAH BLOCKER: THAT
>> JEREMIAH BLOCKER: GENERAL PUBLIC COMMENT DONE, WE WILL MOVE INTO COMMISSIONER REPORTS. COMMISSIONER WHITEHURST.
>> CHRISTIAN WHITEHURST: NO REPORTS TODAY, MR. CHAIRMAN.
>> JEREMIAH BLOCKER: COMMISSIONER WALDRON.
>> PAUL WALDRON: A COUPLE OF THINGS, MR. CHAIRMAN.
I HAD AN EMPLOYEE REACH UP ABOUT.
WE HAVE A SECTION OR A PERSONNEL CODE AND ORDINANCE THAT DOES NOT ALLOW COUNTY EMPLOYEES TO RUN FOR OFFICE AND OTHER JURISDICTIONS AS WELL AS, LIKE, SCHOOL BOARD AND DOESN'T ALLOW FOR THEM TO BE ON THE HOA BOARDS AND ANYTHING.
THEY CAN'T DO ANYTHING IN THEIR COMMUNITY THAT WAY.
AND I DIDN'T KNOW HOW THE COUNTY FELT.
MAYBE WE COULD GET -- NECK MEETING MAYBE GET THE ATTORNEY -- NEXT MEETING TO GET THE ATTORNEY SHOW US WHAT WE GOT.
THE ORDINANCE '9, 92-119. AND TO BE UNDER HOA, THEY CAN'T EVEN DO THAT. IT WOULD CONFLICT WITH WORK.
THEY COULDN'T DO IT AND RUNNING WITH OFFICE I DON'T THINK THEY CAN DO ANYTHING THERE. IF THEY LIVE ON PALM COAST AND WANTED TO RUN FOR COUNTY COMMISSIONER DOWN THERE.
I WOULDN'T SEE A REASON THEY WOULD HAVE TO TERMINATE THEIR
EMPLOYMENT HERE. >> JEREMIAH BLOCKER:
ABSOLUTELY. >> PAUL WALDRON: I WANT TO GET
MORE INFORMATION. >> JEREMIAH BLOCKER: A CONSENSUS ON THE BOARD FOR MORE INFORMATION ON THIS.
WRITTEN IN '92. MAYBE SOMETHING WE NEED TO LOOK AT UPDATING. IS THERE CONSENSUS? OKAY. LET'S DO THAT.
LET'S LOOK AT IN THE NEXT 30 TO 60 DAYS A IF WE COULD A LOOK AT THE AGENDA ITEM TO RELOOK AT THE EMPLOYEE -- THAT PART OF THE ORDINANCE, OUTSIDE EMPLOYMENT.
>> PATRICK MCCORMICK: IT IS A RESOLUTION THAT IS GOOD BECAUSE IT WOULD BE FAIRLY NOT CUMBERSOME TO CHANGE AND LANGUAGE IN THE COUNTY'S PERSONNEL CODE, WHICH I WILL REVIEW WITH ADMIN TOO THAT MAY BE SUBJECT TO REVIEW.
>> HENRY DEAN: THE OTHER THING I HAD WAS -- MR. HENNESSSEY
[03:35:06]
BROUGHT UP GOOD POINT TO LOOK AT PALMETTO ROAD TO MAKE SURE IT WAS IN THE IN OUR RIGHT-OF-WAY.I HAD IN ISSUE WHEN I WAS FIRST ELECTED THEY HAD TO GO OUT AND MOVE SOME STUFF. FIND OUT DID THE GENTLEMAN ON THE NORTH SIDE APPLIED FOR A MAIL POX PERMIT ON THAT ROAD, AND WHAT THE PERMIT WAS FOR HIS DRIVEWAY.
NO, SIR, WE DON'T -- >> SOUTH SIDE.
>> SOUTH SIDE. ONE WITH A BIGGER DRIVEWAY AND PERMITTED. WE HAVE SOME ISSUES THERE.
AND I KNOW PARKS AND REC ARE WORKING ON IT.
>> NEVER APPLIED FOR THE A VARIANCE.
THEY WILL CHECK ON THAT. AND THE OTHER THING I HAVE WAS FOR THE COUNTY ATTORNEYS. YOU KNOW WE WERE TALKING OF A MORNING FEEL. YOU THINK THE STATE LEGISLATURE JUST CHANGED SOME LAWS THAT WE CAN DESIGNATE MOORING AREAS AND DECLARE SOME OFFLIMIT AND LOOK WHAT THE LANGUAGE IS.
I HAVE NOT READ IT ALL AND READ A LITTLE BIT OF IT.
I THINK THAT'S IT. >> THANK YOU, COMMISSIONER WALDRON. COMMISSIONER SMITH.
>> JEB SMITH: THANK YOU MR. CHAIRMAN.
COOL FOR START, GROSS IS GROWING AND SO IS MY PERENNIAL PEAPUT IN FOR DRIED CURED FORAGE.
AND HOPE TO CUT AN CONDITION. MOST CROPS HAVE CONTINUED HARVESTING THAT INCLUDE BROCCOLI AND CABBAGE.
POTATO IS IN FULL SWING POTATO STOCK IS MOVING AND CHIP STOCK IS EXTREMELY SLOW. DECAY IN THE TUBERS AT THIS POINT. QUALITY ISSUES.

FUTURE CORN FUTURES ARE HE CAN TROOPLY HIGH.
MOVING CARCASSES 700 A HEAD AND AFFECTING OUR CATTLE MARKETS.
UNEMPLOYMENT BENEFITS ARE IMPEDING SUPPLY OF LABOR ON MULTIPLE FRONTS AND WILL HAVE LONG-LASTING EFFECT ON OUR ECONOMY AND ALL SECTORS AND INCLUDING AGRICULTURE INCLUDED.

FEDERAL SPENDING GOING THROUGH THE ROOF.
HOW CAN AN ECONOMY RECOVER WITH SUCH ISSUES AND THOSE EFFECT US HERE JUST LIKE THEY DO ANYWHERE ELSE IN THE UNITED STATES.
AND I CAN TELL YOU, THERE ARE -- THERE ARE SOME REAL CONCERNS IN THE PRIVATE BUSINESS SECTOR ON SOME OF THESE FRONTS.
THANK YOU, MR. CHAIRMAN. >> JEREMIAH BLOCKER: THANK Y YOU. COMMISSIONER DEAN.
>> HENRY DEAN: THE LAST MONTH I HEARD IT WAS MARCH FROM YOU, COMMISSIONER SMITH AND YOU HEARD APRIL WAS 4.2%.
>> JEB SMITH: IT'S GOING THROUGH THE ROOF.
>> HENRY DEAN: MONTHLY 4.2%. >> JEB SMITH: WHAT HAPPENS WITH INTEREST RATES EVENTUALLY AND WHAT HAPPENS WITH CONSTRUCTION UPON INTEREST RATES INCREASING.
I AM TELLING YOU, IF YOU BUILD YOUR ECONOMY ON A FALSE PRE PREMISE, YOU ARE IN TROUBLE. AND THAT'S WHY IT IS SO IMPORTANT FOR US -- I SAY THIS EVEN WITH ECONOMIC INCENTIVE.
DEVELOPMENT INCENTIVES, ETC, WE MR. OUR ECONOMY RIGHTFULLY ON THAT. I TELL YOU THREE PRIMARY THINGS YOU CAN BUILD AN ECONOMY ON. GROW IT, MAKE IT OR MINE IT.
EVERYTHING ELSE IS PERIPHERAL. IF YOU CAN'T GROW IT, MAKE IT OR MINE IT, IT IS VERY PRECARIOUS.
SORRY TO INTERRUPT YOU. BUT IT IS IMPORTANT WHEN WE ARE MAKING DECISIONS THAT IT MA MATTERS EVEN HERE AND OUR COMMUNITY WILL HAVE LONG-LASTING EFFECTS FROM IT.
IT IS. INFLATION IS GOING THROUGH THE
CEILING. >> HENRY DEAN: MR. HENNESSEY, DON'T LEAVE YET. BY WANT TO TELL YOU SOMETHING.
DON'T LEAVE YET, PLEASE. I WANT TO YOU KNOW I WAS A HOMEOWNER IN WINDSUSPECT WITH ACRES FROM 1984 TO 2010.
I AM FAMILIAR WITH THE BOLT RAMP AND DOCK RAMP.
I WAS THERE BEFORE SUNSET LANDING OVER THE DEVELOPMENT
[03:40:02]
AND WATCHED THE HOMES, AND I WILL REITERATE COMMISSIONER WALDRON'S REQUEST. AND I WOULD LIKE TO GET A REPORT ON THIS PARTICULAR BOAT RAMP, DOCK AND DRIVEWAY EXPANSION, BECAUSE I USED TO BICYCLE IT THREE TIMES A WEEK AND PRETTY FAMILIAR WITH IT. [INAUDIBLE]>> HENRY DEAN: I FEEL LIKE I AM A MEMBER EMERITUS.
>> HENRY DEAN: WELL, THERE YOU GO.
ALL RIGHT, WELL, THANK YOU. I AM GOING TO FOLLOW IT CLOSELY THOUGH. I HAVE TWO OTHER -- I HAVE TWO OTHER ITEMS TO GET TO MR. H HENNESSE Y.
>> SORRY. >> HENRY DEAN: LET ME TALK ABOUT HOUSE BILL 337 QUICKLY. I DON'T KNOW WHAT WE HAVE ALL LEARNED IN THE LAST TWO WEEKS, BUT I STILL FEEL THAT IT IS IMPORTANT THAT WE CONSIDER A -- A MESSAGE, A LETTER TO THE GOVERNOR RECOMMENDING VETO OF THAT -- OF THAT TUCK LEGISLATION FOR ALL THE REASONS I REITERATED AT OUR MAY 4 MEETING. WE CAN DISCUSS THAT IN THE M MANNER THAT I WISH. THE LAST MATTER AND DISCUSS SOMETHING ON THE AGENDA POSSIBLY.
I THINK -- WHEN DOES THE FEMA BURN CONSTRUCTION START.
JUNE 1, DO WE KNOW? PONDRE VEDRA BEACH.
>> WE STARTED JUNE 1. BUT WE HAVE TO DELAY IT.
>> HENRY DEAN: A LOT OF MOVING PARTDZ TO OUR, QUOTE, FEMA BERM PROJECT AND NOW PROJECTS BROKEN DOWN IN THE SUMMER HAVEN IS ISSUES. THERE ARE ISSUES ALONG THE BEACH ON ANASTASIA ISLAND THAT MAY OR MAY NOT BE INCLUDED AND SPOTS THAT HAVE PRECIOUS POLLEN AMOUNT OF SAND AND DON'T NEED TO BE INCLUDED IN THE PROJECT AND THE THIRD ISSUE IS THERE ARE -- I HAVE RECEIVED A NUMBER INQUIRIES ABOUT ACCESS POINTS APPROPRIATE OR NOT FOR THE FEMA BERM CONSTRUCTION AT PONDRE VEDRA BEACH. IT WILL BE HEALTHY FOR A STAFF BRIEFING A GOOD WORKSHOP ON FEMA BURN AND ALL THESE ISSUES IF NOT JUNE 1, MAYBE THE NEXT MEETING BECAUSE A LOT OF MOVING PARTS I JUST HAPPENED TO BE TIED AT THE HIP WITH BEACH ISSUES. WITH THAT HAVING BEEN SAID, YOU THINK I WAS GOING TO TALK OF MARSH LANDING AND REQUEST THAT YOU SAY IN TOUCH WITH WATER MANAGEMENT AND THAT CONCLUDES
-- >> JEREMIAH BLOCKER, EFFECT.
LET'S SEE MORE CONSENSUS. I WOULD LIKE TO SEE A COASTLINE RESTORATION BRIEFING. I HAVE CONSTITUENTS THAT HAVE SPECIFIC QUESTIONS OF THE FEMA PROJECT.
SOME HAVE INDICATED THEY FEEL THEY HAVE NOT BEEN FULLY INFORMED. WE DON'T WANT TO EVER EMBARK ON A PROJECT. WE WANT TO MAKE SURE THE PUBLIC IS AS UPDATED AS POSSIBLE SOONER THAN HATER.
WHAT IS THE RESPONSIBILITY, HOW QUICKLY CAN A BRIEFING BE PUT
TOGETHER. >> MR. CHAIRMAN, WE PLAN TO BRING THE FEMA BERM AS A REGULAR ITEM OF DISCUSSION IN JUNE. IF YOU WANT SOMETHING SOONER, WELL SEPARATELY, WE COULD POTENTIALLY DO THAT, OTHERWISE WE WILL HAVE AN AGENDA ITEM IN JUNE.
>> JEREMIAH BLOCKER: THE SECOND MEETING IN JUNE.
>> YES. >> JEREMIAH BLOCKER: BOARD CONSENSUS TO MOVE IT UP TO JUNE 1? THAT'S WHY I AM ASKING. ARE YOU ABLE TO DO THAT?
>> YES, SIR. IF IT IS THE BOARD'S DESIRE TO DISCUSS THAT BEFORE THE RIPENESS OF THE AGENDA ITEM WHICH IS REALLY TALKING ABOUT IF WE ARE READY TO MOVE FORWARD WITH THE FEMA BERM PROJECT WITH THE SCOPING OF THE INVESTIGATION FROM THE STAFF, WE COULD HAVE A PRELIMINARY
DISCUSSION PRIOR TO THAT. >> YOU CAN DO IT JUNE 1.
IS THERE BOARD CONSENSUS. WE WILL DO THAT JUNE 1.
BACK TO YOU. ANYTHING ELSE? YOU ARE DONE? SO LET ME -- LET ME JUST BRIEFLY HIT ON TWO THINGS AND BRING IT TO THE BOARD'S ATTENTION. FIRST IS THE LETTER THAT THE ST. AUGUSTINE LIGHTHOUSE MARITIME MUSEUM HAVE ASKED AND LETTER OF SUPPORT. I COMPLETED AND STAFF IS ASSISTED IN COMPLETING A DRAFT OF THIS AND WILL ASSIST THEM IN APPLYING FOR AN APPLICATION FOR THE GENERAL SPORTS GRANT FOR
[03:45:02]
DIVISION CULTURAL AFFAIRS. YOU SPOKE WITH STA STAFF AND DID NOT CONFLICT WITH ANY OF THE OTHER GRANTS AND ENTITIES.WHAT I AM SEEKING TODAY AND WHAT I WANT TO BRING TO THE BOARD'S ATTENTION IF THERE IS BOARD'S CONSENSUS IN ALLOWING THIS LETTER OF SUPPORT TO GO OUT.
CONSENSUS? CONSENSUS? WE WILL -- I WILL SIGN THAT TODAY AND GET THAT SENT OUT.
>> MR. CHAIR, OPEN IT UP TO PUBLIC COMMENT.
>> JEREMIAH BLOCKER: LET'S OPEN IT UP TO PUBLIC COMMENT.
>> HENRY DEAN: PUBLIC COMMENT ON THE LIGHTHOUSE MUSEUM ITEM.
THE LETTER? SEEING NONE, THAT COMPLETES
THAT. >> JEREMIAH BLOCKER: THANK Y YOU. THE NEXT ISSUE I HAVE AS FAR AS BUSINESS IS, THERE IS A RESIDENT, MR. COLLETTE IN PNDRE VEDRA IS LOOKING FOR A HISTORICAL MARKER.
HE WORKED ON THE PLANNING, DESIGN, AND POTENTIALLY PERMITTING THAT GOES ALONG WITH THIS WHAT STAFF HAS BROUGHT US TO ARE TWO OPTION, ONE OPTION IS TO ASSIST IN THE INSTALLATION AND THE DESIGN OF THIS MARKER.
THE OTHER IS TO FACILITATE THE FEE WAIVER.
WHAT I WOULD LIKE TO DO WITH THE BOARD CONSENSUS BETTER HANDLED WITH EXPENDITURE OF MONEY AS AN AGENDA ITEM HAVE A BRIEFING AND WE AS A BOARD FULLY UNDERSTAND.
I THINK IT IS MEANINGFUL AND UM PACTS THE HISTORY OF PONDE VEDRA AND PETER TO HAVE CONSENSUS FROM STAFF WITH A BRIEFING. COMMISSIONER WALDRON.
>> PAUL WALDRON: I AGREE WITH THAT BUT THE HISTORICAL REVIEW
BOARD OR CULTURAL COUNCIL? >> THAT'S CORRECT AS A NORMAL
PROCESS. >> PAUL WALDRON: THIS HAVEN'T GONE THROUGHOUT PROCESS IT GOES THROUGH TO GET TO US.
>> JEREMIAH BLOCKER: WELL, LET'S DO THIS THEN.
WHAT I HAVE IS A MEMO FROM MR. COTTON OUTLINING A COUPLE OF OPTIONS FOR THE BOARD. MR. COTTON, ARE YOU ABLE TO SPEAK ANY MORE ON THIS? ANYONE FROM STAFF CAN.
>> YES, SIR, AS THE MEMO DETAILS, THIS INITIAL REQUEST GOES BACK TO EARLY 2020. AND SOME BACK AND FORTH WITH STAFF CLARIFY THE ISSUE AT H HAND.
I WILL ASK MERCEDES HERALD TO FILL IN A FEW OF THE BLANKS FOR ALL OF US. AND I WILL BE HAPPY TO SUPPORT
AS NECESSARY. >> JEREMIAH BLOCKER: THANK
YOU, MA'AM, PLEASE. >> MERCEDES HERALD CULTURAL RESOURCES COORDINATOR. , WE WOULD LUKE FOR IT TO GO FOR THE CULTURAL REVIEW ADVISORY BOARD FOR THE COUNTY COMMISSIONERS. WE DON'T HAVE A PROCESS FOR HICK FOR CAL MARKERS BUT MOVE FORWARD WITH PROCESSES WE DO HAVE FOR GROWTH MANAGEMENT AND BRING THE PROJECT BEFORE THE CRB AND BRING THE CR B'S RECOMMENDATION TO YOU ALL.
>> JEREMIAH BLOCKER: I THINK THAT MAKES SENSE.
HOW MANY REQUESTS DO WE HAVE FOR HISTORICAL MARKERS.
HOW OFTEN DOES THAT COME UP? >> SINCE I HAVE BEEN HERE THREE
YEARS ONLY THIS ONE YES, SIR? >> MAY NOT BE CATEGORIZE THIS WAY BUT A MARKER OUT FOR THE RIVER AREA THAT ENDED UP -- I DON'T KNOW IF THAT WAS A HISTORICAL MARKER OR WHAT YOU
WOULD CALL IT. >> RIGHT BEFORE I ARRIVED A CIVIL RIGHT MARKER WAS PUT OUT INSTALLED AT CHANCES BRIDGE.
BUT OTHER THAN THAT, WE HAVE NOT HAD THIS TYPE OF HISTORICAL MARKER A STATE HISTORICAL MARKER.
THE BOARD AGREES LET IT GO THROUGH THE PROCESS.
AND I BELIEVE MR. COLLETTE IS TRACKING THAT.
SEE WHAT THAT PROCESS IS AND AN OPPORTUNITY TO BRING IT BACK TO THE BOARD. IS THE BOARD WILLING TO HEAR THIS? CONSENSUS? OKAY. LET'S LET GO THROUGH NORMAL PROCESSES AND IF THAT IS WORKED OUT, WE WILL PUT THAT AS AN
AGENDA ITEM. >> MY ONE QUESTION IS FOR THE FEE WAIVER AND ADAMANT. HE HAS ASKED FOR THE FEE WAIVER
FOR THE PERMITS. >> A REQUIREMENT TO GO THROUGH
THE PROCESS. >> A FEE FOR THE PERMIT.
>> JEREMIAH BLOCKER: I THINK THAT IS SOMETHING WE CAN HEAR WITH AN AGENDA ITEM AND LOOK AT THAT.
I THINK BECAUSE IT INVOLVES EXPENDING MONEY AT THIS POINT WE HAVE TO GO THROUGH THAT PROCESS.
ANY FURTHER COMMENT FROM THE BOARD?
[County Administrator’s Report]
SEEING NONE. WE WILL GO WITH THAT.DO WE NEED TO HAVE PUBLIC COMMENT?

SO WILL LOOK FOR A UPDATE AND IF THE BOARD AGREES WE CAN FACILITATE ASSISTANCE WITH T THAT.>> JEREMIAH BLOCKER: LET ME SEE HERE? SO, GENTLEMEN, THAT'S ALL I HAD.
GO TO THE COUNTY ADMINISTRATOR. >> JESSIE DUNN, OMB DIRECTOR IS HERE TO DISCUSS AND PRESENT TO THE BOARD POSSIBLE FUNDING FROM THE AMERICAN RESCUE PLAN AND SEEK DIRECTION FROM THE BOARD
>> GOOD AFTERNOON, COMMISSIONERS, JESSIE DUNN, DIRECTOR OF THE OFFICE OF MANAGEMENT AND BUDGET.
LAST MONDAY, MAY 10, THE DEPARTMENT OF TREASURY ANNOUNCED THE LAUNCH OF THE CORONAVIRUS STATE AND LOCAL FISCAL RECOVERY FUNDS, EXCUSE ME KNOWN AS THE AMERICAN RESCUE PLAN ACT OF 2021. WITH THAT WE PROVIDED FEDERAL GUIDANCE AND TAKES A WHILE TO DECIPHER.
I AM WORKING TO VET THAT GUIDANCE AND PROVIDE IS BACK TO THE BOARD FOR CONSIDERATION THEY WANT TO MOVE FORWARD WITH THE FUNDING ALLOCATION PLAN. THIS IS SIMILAR TO HOW STAFF APPROACHED THE CARES ACT FUNDING LAST YEAR.
IT WOULD BRING BACK FUNDING ALLOCATION PLAN AND THE BOARD WOULD GIVE A CONSENSUS AND APPROVAL AND MOVE BACK TO THAT PROGRAM. AND, AGAIN, WE ARE IN THE INITIAL STAGES OF THAT. IT WILL TAKE SOME TIME TO VET IT. HOWEVER WHAT I AM ASKING TODAY AND PUT A SUGGESTED MOTION UP ON THE OVERHEAD ISED A MINISTERIAL IN NATURE. ASSOCIATED WITH THE FUNDING.
THERE IS A REQUEST FOR FINANCIAL -- FINANCIAL INSTITUTION INFORMATION LARGELY IF YOU THINK ABOUT IT IN YOUR PERSONAL LIFE. YOU ARE ROUTING INFORMATION IN OUR BANK ACCOUNT INFORMATION WHERE WE DO THAT TYPE OF INFORMATION SO THAT WHEN THOSE DOLLARS ARE AVAILABLE, WE CAN DRAW THOSE DOWN. FOR MY PERSONAL OPINION, WE DON'T HAVE TO DO THIS AT THIS POINT.
I WOULD LIKE TO GET INTO THE QUEUE, BECAUSE IF AND WHEN THIS COMMISSION DECIDES TO MOVE FORWARD WITH FUNDING ALLOCATION PLAN, I WOULD PREFER TO USE THE FEDERAL DOLLARS ON THIS RATHER THAN THE COUNTY DOLLARS AND WOULD LIKE TO GET THOSE DOLLARS HERE AND UTILIZED AS QUICKLY AS POSSIBLE IF THE BOARD MOVES FORWARD WITH THAT PROGRAM. I AM GOING TO PUT ON THE OVERHEAD THE SUGGESTED MOTION, AND I WILL READ IT OUT FOR CONSIDERATION. I WILL NEED MY GLASSES.
THAT IS A MOTION TO AUTHORIZE THE COUNTY ADMINISTRATOR OR HIS -- OR HIS DESIGNEE TO COMPLETE THE PRESCRIBED FUNDING REQUEST DOCUMENTATION AND A REQUEST FOR AMERICAN RESCUE PLAN FUNDING THROUGHOUT DEPARTMENT OF TREASURY SUBMISSION PORTAL 37 WITH THAT AND IF YOU HAVE QUESTIONS.
THIS ISED A MINISTERIAL. THIS DOES NOT APPROPRIATE DOLLARS. WE CAN NOT SPEND A PENNY UNLESS IT BECOMES APPROPRIATED. GETTING US QUEUED UP IN LINE
FOR THAT FUNDING. >> JEREMIAH BLOCKER: BEFORE THAT, HOW TIME CITIZENS I HAVE IT IS THIS?
>> IT IS NOT -- THE OVERALL PROGRAM THROUGH DECEMBER OF 2024. WITH 67 COUNTIES IN FLORIDA PLUS MUNICIPALITIES AND EVERY OTHER STATE I WANT TO GET INTO -- OR IF YOU WOULD GET IN LINE IN CASE THERE ARE ANY PROBLEMS WITH THE OF THE ALLOCATION OF DOLLARS IN THE BANKS.
>> I HAVE NO QUESTIONS. I WANT TO SAY THANK YOU FOR SENDING THIS OUT PREVIOUSLY SO IF YOU CAN REVIEW IT MADE IT MORE PALATABLE. I AM WILLING TO MOVE THAT -- I MOVE THE MOTION AS PRESENTED BY MR. DUNN.
>> A MOTION BY COMMISSIONER SMITH.
A SECOND BY COMMISSIONER WALDRON.
WE NEED TO OPEN IT UP FOR PUBLIC COMMENT.
LET'S SEE HERE. NAME AGED DRESS.
>> BJ KALALY. I THOUGHT EVERYBODY WOULD KNOW THAT BY NOW. ANYWAY, I APPRECIATE THAT, BECAUSE SOMEONE GAVE ME THE PAPER AND I SAW THIS MONEY THAT IS GOING TO BE AROUND. I DON'T KNOW, BUT JUST FOR THE PUBLIC'S UNDERSTANDING WHEN THEY HAVE A CHANGES TO LISTEN TO THIS. MR. D U NN DO YOU KNOW OR HAVE
[03:55:01]
ANY IDEA HOW MUCH MONEY IS IN THE POT AND HOW MUCH MONEY WILL BE COMING TO FLORIDA PEOPLE AND HOW MUCH WE MAY BE GETTING IN THE COUNTY AND THE CITY AND HOW SOON ARE WE GOING TO KNOW ANYTHING ABOUT THAT ONCE WE GET THIS RESOLUTION GOING IN.THANKS. >> JEREMIAH BLOCKER: YOU CAN
GOOD QUESTION. $350 BILLION FOR THE OVERALL PROGRAM SPECIFIC TO ST. JOHNS COUNTY.
IT IS $51 409, 433 AS THE CEILING.
THE APPROPRIATE AS WE UNDERSTAND IT WOULD BE A 50% NOW THROUGH THIS PORTAL AND 50% ONE YEAR FROM NOW.
MISS KALA LY, FIND OUT WHAT THE OVERALL FLORIDA APPROPRIATION IS AND I HAVE ROUND NUMBERS I BELIEVE FOR THE CITY OF ST. AUGUSTINE BEACH AND THE CITY OF SANCTION AUGUSTINE.
$3 MILLION AND $5 MILLION RESPECTFULLY AND CHANGE AND I WILL CONFIRM THOSE NUMBERS. THERE IS AN OVERALL ON THE DEPARTMENT OF -- ON THE U.S. TREASURY WEB SITE.
THEY HAVE THAT -- THOSE APPROPRIATION AMOUNT.
FOR THE COUNTY ABOUT 51.4 MILLION AS A CEILING ON IT.
>> JEREMIAH BLOCKER: ANY FURTHER PUBLIC COMMENT? SEEING NO MORE FOR PUBLIC COMMENT.
A MOTION BY COMMISSIONER SMITH AND SECOND BY COMMISSIONER
[County Attorney’s Report]
WALDRON. ALL THOSE IN FAVOR, PLEASE V VOTE. PASSES 5-0.>> NO, SIR. >> JEREMIAH BLOCKER: MR.
MCCORMACK. >> PATRICK MCCORMACK: THANK YOU MR. CHAIR, COMMISSIONERS. AS THE BOARD KNOWS, I AM CONCERNED ABOUT THE HOUSE BILL 337 FROM THIS YEAR'S LEGISLATIVE SESSION WHICH GOES TO THE QUESTION OF IMPACT FEE.
IMPACT FEE CREDIT BUT THE PORTION I AM PARTICULARLY CONCERNED ABOUT GOES TO WHETHER THE TRANSFERABILITY OF IMPACT FEE CREDITS GOES TO CREDITS THAT WERE ALREADY CREATED BEFORE THE LEGISLATION AND AS THE BOARD MEMBERS, THERE WAS A -- A BILL LAST YEAR WHICH PROVIDED FOR CHANCE FORABILITY, BUT DID NOT SPEAK TO THEED FOR LOOKING OR BACKWARD LOOKING.
AS THE BOARD ALSO REMEMBERED IT AUTHORIZED THE CHAIR TO REQUEST AN ATTORNEY GENERAL OPINION ON THAT PARTICULAR ISSUE AND THE ATTORNEY GENERAL AFTER SEVERAL MONTHS DEKLOOUR KLEINED TO ANSWER ON THE MERITS. WELL, WHAT HOUSE BILL 337 DOES PERTAINING TO THAT ISSUE IS IT ADDS SOME NEW LANGUAGE FOR THIS YEAR, WHICH SAYS THIS SUBSECTIONS APPLIES TO ALL IMPACT FEE CREDITS REGARDLESS OF WHETHER THE CREDITS WERE ESTABLISHED BEFORE OR AFTER THE EFFECTIVE DATE OF THIS ACT.
SO I WOULD READ THAT TO MEAN NOT JUST THIS ACT FROM THIS YEAR BUT FROM -- TO CHU PROBABLY LAST YEAR, SO EVEN BEFORE LAST YEAR. THE TRANSFESHLT.IMPACT FEE CRED KOYTS HAVE A SIGNIFICANT FINANCIAL IMPACT FOR THE CO COUNTY. WHAT IT MAY ENABLE IS THAT FOR IMPACT FEE USERS, SOME ENTITY TYPICALLY A BUILDER THAT WOULD BE REQUIRED TO PAY IMPACT FEES INSTEAD OF PAYING THE IMPACT FEES, THEY MAY PURCHASE THESE -- THESE CREDITS.
SOME OF THESE CRED RITZ YEARS AND YEARS OLD.
THE COUNTY HAS IMPACT FEE CREDIT FEE AGREEMENTS WHICH TYPICAL LANGUAGE IN THERE LIMITS THE TRANSFESHLT OF THOSE CREDITS. TRANSFERABILITY OF THESE CREDIT AND I THINK THE COUNTY'S FINANCIAL PLANNING WAS BASED ON THAT PREMISE. AND CONCERN ABOUT THAT IS WHYRAA PROPOSED LETTER TO THE GOV GOVERNOR.
I THINK COMMISSIONER DEAN HAD REFERRED TO REQUESTING THAT THE
[04:00:09]
GOVERNOR VETO THIS HOUSE BILL 337.I AM AWARE FOR DIFFERENT REASONS.
THE THOUSAND FRIENDS OF FLORIDA ARE REQUESTING A VETO OF THAT BILL. I KNOW THAT SOME OF THE OTHER FLORIDA COUNTIES ARE CONCERNED ABOUT THIS BILL AS WELL.
AND NOT JUST FOR THE ISSUE THAT I HIGHLIGHTED HERE.
BUT I THINK SOME OF OUR ISSUES. I HAVE DRAFTED A -- A PROPOSED LETTER FOR THE CHAIR THAT I THINK THE BOARD HAS SCENE AND MR. BOLTIDE PUT IT ON THE SCREEN WHICH GOES THROUGH THE BASES. IF WE CAN GET THAT ON THE OVERHEAD. MR. BOLTISE.
YOU CAN HAVE IT FOCUSED ON WHAT THE TWO ISSUES ARE THERE.
ONE ISSUE, AGAIN, IS THIS NEW LANGUAGE WHICH I HAVE JUST READ OUT THAT SAYS THAT THE -- THE IMPACT FEE CREDITS CAN BE USED WHETHER THEY WERE ESTABLISHED BEFORE OR AFTER THE EFFECTIVE DATE OF THE ACT THE OTHER ISSUE THAT GOES TO IS THAT THIS NEW HOUSE BILL 337 CONSTRAINS INCREASES TO IMPACT FEES BUNS EVERY FOUR YEARS. OF COURSE THE COUNTY HAS A MECHANISM WHERE YEARLY INCREASES ARE DONE WITHOUT A REQUIRED APPLICATION OF THE BOARD.
BUT THROUGH THE PRESENT ORDINANCE, THEY ARE TIED TO A CONSTRUCTION COST INDEX WHEREAS CONSTRUCTION COST OR TRANSPORTATION FACILITIES MOVES AND THE IMPACT PHI WOULD AL ALMOSTCALLY GO TO THAT. , AND SO THIS.
THIS HOUSE BILL 337 CASTS SOME UNCERTAINTY OR WORSE ON -- ON THAT LAGE. SO FOR THOSE TWO REASONS, I THOUGHT IT WOULD BE PRUDENT TO HAVE THE BOARD CONSIDER AUTHORIZE A LETTER TO THE GOVERNOR REQUESTING A VETO AND THE BOARD MAY WISH TO DISCUSS THAT.
RELATED TO THAT, BUT NOT DEPENDENT ON THE BOARD'S DECISION TO SEND THIS LETTER OR NOT.
IT WAS MY ATTENTION AS YOUR COUNTY ATTORNEY TO SEND A LETTER SIMILAR TO WHAT WE SPENT LAST YEAR TO THE IMPACT FEE CREDIT HOLDERS AND JUST TO ALERT THEM BEFORE THEY START SELLING CREDITS IF THIS -- IF THIS LEGISLATION ACTUALLY BECOMES LAW. BEFORE THEY SELL THE CREDITS TO I THINK COORDINATE WITH THE COUNTY, YOU KNOW, AS TO THE COUNTY'S SPWRPING OF THIS HOUSE BILL 337 SHOULD IT BECOME ENACTED. AND THE EFFECT OF THE EXISTING IMPACT FEE CREDIT AGREEMENT AND RESTRICTIONS IN THOSE AGREEMENTS. IT WOULD BE MY INTENT UNLESS DIRECTED OTHERWISE TO SEND A LETTER OUT TO THE IMPACT FEE CREDIT HOLDERS TO ALERT THEM OF THOSE ISSUES.
THANK YOU, MR. CHAIR. >> JEREMIAH BLOCKER: GO TO
COMMISSIONER DEAN NEXT. >> HENRY DEAN: WE DISCUSS THIS MAY 4, I THOUGHT WE HAD A DISCUSSION AND REQUEST TO FIND THE STATUS OF THE PARTICULAR BILL.
HAVE YOU HAD A CHANCE TO LOOK INTO THAT?
>> IT HAS PASSED THROUGH THE LEGISLATURE AND IT IS ENROLLED.
I HAVE NOT SEEN AN INDICATION THAT IT IS ACTUALLY BECOME LAW NOW. I DON'T HAVE SORT OF THE -- THE BEST MECHANISM TO DETERMINE WHETHER IT IS ACTUALLY BEEN SENT TO IT THE GOVERNOR YET OR NOT.
I DON'T SEE THAT AS INDICATED WHERE I AM LOOKING ON THERE -- ON THEIR LEGISLATIVE PAGE AND I WOULD DESCRIBE IT IS -- IT IS -- IT IS PASSED BY BOTH THE HOUSE AND THE SENATE.
IT IS ENROLLED, WHICH, I MEAN, I THINK THE LEGISLATURE IS DONE WITH IT. I -- AS I AM SITTING HERE RIGHT NOW, I DO NOT KNOW IF IT HAS ACTUALLY BEEN TRANSMITTED TO
THE GOVERNOR. >> ONCE RECEIVED, WE TALK ABOUT THE TIME THE GOVERNOR HAS SIGNED OR -- LET ME FINISH, LET IT BECOME LAW WITHOUT A SIGNATURE OR VETO IT.
WE AGREE THAT WAS 15 DAYS? >> PATRICK MCCORMACK: RIGHT, 14 OR 15 DAYS. 14 OR 15 DAYS.
[04:05:01]
>> HENRY DEAN: WELL, AGAIN, I AM CERTAINLY -- I CERTAINLY FAVOR SENDING THE LETTER THAT WAS ON THE OVERHEAD WITH THIS AND ENCOURAGE US TO DO THAT FOR ALL THE REASONS WE DISCUSSED.
>> JEREMIAH BLOCKER: ANY FURTHER DISCUSSION?
>> I WILL SECOND COMMISSIONER DEAN'S MOTION IF THAT IS A
MOTION. >> JEREMIAH BLOCKER: BEFORE WE DO THAT, I HAVE A COUPLE OF QUESTIONS.
THE FLORIDA ASSOCIATION OF COUNTIES, DID THEY OPPOSE THAT WHEN IT WAS GOING THROUGH? IF MY UNDERSTANDING THE FLORIDA SOCK OF COUNTY POSITION IS, THEY ARE NOT -- SOCK OF COUNTY POSITION IS, THEY ARE NOT REQUESTING A VETO.
BUT MY SENSE IS SINCE THEY WERE ABLE TO KNOCK OUT SOME MORE -- THE JAGGED EDGES AND THEY ARE CONTACTS IN THE LEGISLATURE GAVE SOME ASSISTANCE IN DOING THAT, THEY WILL NOT COME BACK LATER AND ASK FOR AN ENTIRE VETO.
I WOULD SAY THOUGH, THAT ALL THE 67 COUNTIES ARE NOT SITUATED SIMILARLY TO ST. JOHNS COUNTY.
A NUMBER OF THEM ARE BUT CERTAINLY NOT ALL 67.
FIRST OF ALL, NOT ALL 67 HAVE IMPACT FEES AND CERTAINLY NOT IMPACT FEE CREDIT. AND SECOND OF ALL, IT MAY BE THAT MANY OF THE ONES THAT DO HAVE IMPACT FEES AND IMPACT FEE CREDITS DO NOT HAVE THE -- THE LEVEL OF EXPOSURE THAT ST.
JOHNS COUNTY DOES WITH THOSE CREDITS SITTING OUT THERE SOMETIMES FOR -- FOR MANY, MANY YEARS.
AS I HAD SAID, I DO THINK THERE ARE SOME OTHER COUNTIES -- I WILL TELL YOU AS THE COUNTY ATTORNEY, I HAD DIALOGUE WITH THE PALM BEACH COUNTY COUNTY ATTORNEY'S OFFICE, THE CHARLOTTE COUNTY COUNTY ATTORNEY'S OFFICE, AND I BELIEVE THAT THERE MAY BE SOME OTHERS.
THOSE ARE THE ONES THAT I -- I HAD DIALOGUE WITH, THANK YOU.
>> JEREMIAH BLOCKER: THAT WAS ACTUALLY MY NEXT QUESTION AND I WANT TO MAKE SURE WE UNDERSTAND.
SENATOR ESSENTIAL -- COMMISSIONER DEAN SAID SENDING A LETTER LIKE THIS HAS NOT BEEN DONE AND MEMBERS OF THE LEGISLATIVE COUNTY. HAVE PUTNAM AND FLAGLER COUNTY
WEIGH IN ON THIS? >> TO MY KNOWLEDGE, THEY HAVE NOT. I HAVE NOT HEARD FROM ANY OF
>> I AM NOT FAMILIAR WITH NASA COUNTY HAS TAKEN A POSITION.
>> JEREMIAH BLOCKER: IT IS REGIONAL.
IN SOUTH FLORIDA WHERE IMPACTS ARE LITTLE BIT DIFFERENT FROM US AND WE ASKED THE ATTORNEY GENERAL TO WEIGH IN ON THIS AND I DON'T HAVE THE LETTER IN FRONT OF ME BUT AFTER REVIEWING IT, PART OF IT WAS SHE REFERENCED BACK TO THE LEGISLATURE PROVIDING SOME CLARIFICATION? THAT'S CORRECT? COMMISSIONER SMITH, DO YOU REMEMBER THAT? A FAIR REPRESENTATION.
>> JEB SMITH: YES, SIR. I HAVE THAT LETTER ON MY HE IS GUESS CAN BLOCKER PWLOUBINGZ DIDN'T BRING THAT DOWN WITH ME AND THE ONLY REASON WE BRING THAT UP ASKED THE ATTORNEY GENERAL FOR CLARIFICATION AND WAS REFERRED BACK TO THE LEGISLATURE. I SPOKE TO MEMBERS OF THE LEGISLATIVE DEALTGATION THEY REFERENCED THIS WAS SOMETHING THEY NEEDED TO BE ADDRESSED NOT THAT WE AGREE WITH THE CONTENT OF IT BUT A REQUEST TO THE ATTORNEY GENERAL THINK ABOUT BODY AND SENT BACK TO THE LEGISLATURE.
THE FLORIDA ASSOCIATION OF COUNTIES DID NOT WEIGH IN AND IS REQUESTING A VETO. I THINK COMMISSIONER DEAN DO SUPPORT ME AND WEIGH IN FREQUENTLY ON MATTERS THEY FEEL SHOULD BE VETOED. I WANT TO HAVE THIS BACK GROUND INFORMATION. THE OTHER THING IS HAVE THE BOARD HAD AN OPPORTUNITY TO REACH OUT INDIVIDUALLY TO INDIVIDUAL AND ARE YOU ALL SATISFIED WITH -- HAVE
COMMISSIONER WHITEHURST, -- >> I WAS UNABLE TO REACH REPRESENT BRENNER BUT REPRESENTATIVE SEARCHSON THAT AGREED WITH COMMISSIONER DEAN AND PAT TRUCK.
AND I THINK IT IS A COMPLEX ISSUE.
>> JEREMIAH BLOCKER: COMMISSIONER WALDRON.
>> PAUL WALDRON: I HAVEN'T REACHED OUT AND I KNOW HOW IT WOULD AFFECT OUR COUNTY. THE WATER AGREEMENT IS
TREMENDOUS. >> JEREMIAH BLOCKER: COMMISSIONER DEAN AND SMITH, DO YOU HAVE AN UNDERSTANDING WHERE
THE DELEGATION IS ON THIS. >> HENRY DEAN: MY UNDE UNDERSTANDING THEY ALL THREE VOTED IN FAVOR OF 3 37.
I LOVE MY DELEGATION, ALL THREE OF THEM BUT I AM NOT GOING TO AGREE WITH THEM 100% TIME OF POLICY ISSUES THAT AFFECT THE
HOME OWNERS OF THIS COUNTY. >> IF I MAY, I THINK THAT
[04:10:06]
COMMISSIONER STEVENSON HAD NOT VOTED FOR IT IS MYUNDERSTANDING. >> JEREMIAH BLOCKER: TWO OUT OF THREE. SO COMMISSIONER DEAN.
>> HENRY DEAN: I WANT TO SAY ONE THING BECAUSE I MEANT TO SAY IT EARLIER. WHEN I SPOKE ON THIS MAY 4, I SAID TWO THINGS THAT WERE GOING TO BE BAD IF THIS BILL PASSED.
AND ACTUALLY I MISSPOKE AND COMMISSIONER SMITH CORRECTED ME -- I WON'T SAY HE CORRECTED ME BUT ADDED A THIRD AND THAT IS THAT THERE MAY BE FUTURE DEVELOPMENTS PROPOSED THAT DON'T GET IMPROVED. A, DON'T HAVE THE IMPACT FEES TO PAY FOR THE NEW STRUCTURE. AND B, I WON'T RAISE AD VALOREM TO FORCE PAYMENT FOR NEW DEVELOPMENT.
ONLY THREE THINGS CAN HAPPEN AND ALL BAD.
EITHER NO INFRASTRUCTURE. TAX AD VALOREM HOMEOWNERS OR NO NEW DEVELOPMENT. AND I DON'T FAVOR ANY OF THOSE.
SO I THINK THERE IS AN OVERWHELMING PUBLIC POLICY ISSUE I NEED TO ADDRESS. I AM NOT AS ACTUALLY CONCERNED OF THE CONTRACTUAL ISSUE WITH THE IMPACT CREDIT.
IMPACT FEE CREDIT AND WORK THEMSELVES OUT ONE WAY OR THE OTHER THROUGHOUT THE QUART SYSTEM.
I AM CONCERNED ABOUT THE LEGISLATURE ONCE AGAIN, PREEMPTING OUR ABILITY AS A LOCAL GOVERNMENT TO DETERMINE OUR OWN DEGREES ME WITH RESPECT HOW -- DESTINY HOW WE WANT GROWTH TO BE IN OUR COUNTY. NOT ANY OTHER COUNTY, I CAN CARE LESS. BUT HOW WE DEAL WITH GROWTH AND PAY FOR IT AND THAT'S WHY WE ARE RECOMMENDING A LETTER BLOCKER PWLOYBINGZ UNDERSTAND. MY QUESTIONS -- AS A FULL CONSENSUS AND SOMETHING WE HAVE NOT DONE ON OUR TIME ON THE BOARD. COMMISSIONER WHITEHURST.
>> CHRISTIAN WHITEHURST: AS I SAID LAST WEEK, I -- YOU KNOW, I SHARE COMMISSIONER DEAN'S CONCERNS.
WE CAN'T AFFORD TO TAKE A BIG HIT TO THE BUDGET.
WE HAVE A LONG LIST OF NEEDS AND WE DON'T ALWAYS HAVE THE DOLLARS TO MEET THE NEEDS YEAR IN AND YEAR OUT.
WE ALSO DID ASK STAFF AS A BOARD TO KIND OF COME BACK AND DETAIL HOW THIS WILL AFFECT US FINANCIALLY.
HOW MUCH MONEY WE COME OUT OF THE BUDGET THAT WE EXPECT -- THE FIGURE WE ARE HOLD TWO WEEKS AGO WAS 60 MILLION.
APPEAR THE BRIEFING 70 MILLION. I HAVEN'T SEEN ANY PAPERWORK OR DETAILING HOW WE REACH THAT NUMBER.
MY QUESTION IS HOW MANY IMPACT FEE CRED RITZ AVAILABLE FOR PURCHASE FOR OTHER DEVELOPERS IN THE COUNTY?
>> RIGHT, I THINK FARMWOOD WOULD KNOW THAT.
I THINK THAT, FIRST OF ALL, SOME OF THE DEVELOPERS THAT HAVE CREDITS THEY ARE ACTUALLY -- THEY ARE GOING TO USE THOSE CREDIT AND NOT SELL THOSE. I THINK THAT STAFF HAS DONE A VERY KIND OF ROUGH ESTIMATE OF WHAT KIND OF CREDITS WOULD BE NOT UNLIKELY TO BE AVAILABLE FOR TRANSFER.
I THINK THAT WHEN WE LOOK AT THAT --
>> THANK YOU, PATRICK AND COMMISSIONER WHITEHURST, YOU WILL RECALL THIS TO SOME EX EXTENT, IT IS -- WE HAVE TO MAKE GUESSTIMATES AND PROJECTIONS BASED ON WHAT A PARTICULAR DEVELOPMENT WILL ACTUALLY BUILD OUT AS IMPACT FEES ARE ASSESSED BASED ON SQUARE FOOTAGE AND DIFFERENT LEVELS WHEN YOU REACH A IFFERENT AMOUNT OF SQUARE FOOTAGE, YOUR IMPACT FEES REACH A HIGHER LEVEL AND SO TO SOME EXTENT, WE HAVE TO ESTIMATE IF THERE ARE UNITS LEFT IN A DEVELOPMENT, YOU KNOW, IF THEY BUILT TO THEIR MAXIMUM.
THEN HOW MANY CREDITS WOULD BE LEFT FOR IMPROVEMENT THEY MADE AND RECEIVED CREDITS FOR. AND IMPACT FEE CREDIT THAT COULD BE -- THAT COULD BE SUBJECT TO TRANSFER BECAUSE THEY WOULDN'T BE USED IN THE DEVELOPMENT THAT THE CREDITS WERE GIVEN FOR. UNDER THIS -- THIS NUMBER.
SO THAT'S WHERE WE CAME UP WITH THAT.
OR THAT IS WHERE GROWTH MANAGEMENT STAFF CAME UP WITH THAT NUMBER. I WILL BE HAPPY TO PROVIDE THE SPECIFIC AGREEMENT OR ESTIMATES FOR EACH OF THOSE.
I DON'T HAVE THAT WITH ME BUT THAT WAS DEVELOPED TO MAKE THIS $78 MILLION NUMBER AND WICK PROVIDE THAT IF YOU WOULD LIKE.
>> CHRISTIAN WHITEHURST: I DID THINK KNOWING THIS DISCUSSION WAS COMING WE WOULD HAVE A COMPREHENSIVE VIEW OF HOW TO WILL FINANCIALLY IMPACT US. SEEMS SO ABSTRACT TO ME AND PUT A NAIL THROUGH A JELLO MODE AND NOT BEING PRODUCTIVE.
[04:15:04]
I SHARE THE CONCERNS. I DON'T WANT TO TAKE A BIG HIT TO THE BUDGET FOR ALL THE REASONS THAT HAVE BEEN DET DETAILED. HARD TO PINPOINT THE EXACTCONDITIONS. >> IF I MAY, I APPRECIATE COMMISSIONER WHITEHURST'S COMMENT ON THAT AND CONCERNS.
I WILL SAY THAT THE LANGUAGE THAT IS IN THE STATUTE WHICH GOES. SO IMPACT FEE CREDITS ARE ASSIGNABLE AND TRANSFERABLE OF ONE DEVELOPMENT AND PARCEL TO ANY OTHER THIS IS LIMITATION WITHIN THE SAME IMPACT FEE ZONE OR IMPACT FEE DISTRICT OR THAT IS WITHIN AN ADJOINING IMPACT FEE ZONE OR IMPACT FEE DISTRICT WITHIN THE SAME LOCAL GOVERNMENT JURISDICTION. AND WHICH RECEIVES BENEFITS FROM THE IMPROVEMENT OR CONTRIBUTION THAT GENERATED THE CREDITS. BECAUSE OF THAT LANGUAGE, THERE ARE SOME LIMITATION OF LANGUAGE ON THAT.
AND IT IS NOT CRYSTAL CLEAR EXACTLY HOW MUCH THAT WOULD APPLY TO THAT'S WHY WE DESCRIBED SORT OF THE NORTH SIDE WOULD BE THE MILLION TH THING.
HOW THIS WILL BE LIMITED BY HOW CLOSE AND RECEIVING BENEFITS.
EVEN THERE -- THAT IS NOT EVEN DEFINED AND DESCRIBED RECEIVING BENEFITS. DOES THAT MEAN A 1% BENEFIT OR HAVE TO HAVE A SUBSTANTIAL BENEFIT LIKE 25%? IN OTHER WORDS, I THINK THERE IS SOME AMBIGUITY IN THE STATUTE THAT MAKES IT DIFFICULT TO PINPOINT AND HAVE A 22 MILLION EFFECT. I APOLOGIZE FOR THAT AMBIGUITY BUT SOME OF THE SACH TORY LANGUAGE THAT MAKES IT SO.
>> JEREMIAH BLOCKER: TO COMMISSIONER DEAN NEXT.
>> HENRY DEAN: LET'S BE CLEAR ABOUT THAT POINT BECAUSE ONE OF THE REASONS I WAS PURSUING THIS ISSUE THE WAY IT WAS PARTICULARLY THE CREDIT ISSUE. MY MEMORY WHEN WE DISCUSS THIS A YEAR AND A HALF AGO SEPTEMBER IT THE AG.
I WAS TOLD BY STAFF THAT THE DISTRICT WERE FOUR DISTRICTS.
THAT ARE BASICALLY NORTHWEST AND SOUTHEAST, WEST AND SOUTHWEST. SO BY DEFINITION.
THEY ALL TOUCH EACH OTHER. SO THAT LANGUAGE WAS A LITTLE MISLEADING AND THEY ALL TOUCH EACH OTHER.
WE ARE TALKING OF TRANSFER WITHIN THE WHOLE COUNTY AT LARGE. THAT IS NOT -- LET'S NOT FOOL OURSELVES WE ARE DEALING WITH A LITTLE DISTRICT TALK ONLY GO THREE MILES THIS WAY OR THREE MILES THIS WAY.
PRESIDENT WAY THEY ARE GROWING THEY TOUCH EACH OTHER IN THE ENTER AND THE WHOLE COUNTY WE ARE TALKING ABOUT AS FAR AS CREDIT TRANSFERS. I AM WRONG, TELL ME NOW, STAFF.
>> NO, NO, COMMISSIONER DEAN, YOU BRING UP A GOOD POINT.
READ MOST BROADLY WILL BE THE WHOLE COUNTY.
>> HENRY DEAN: THAT IS A POINT.
>> JEREMIAH BLOCKER: IF I CAN TELL, LISTEN, NEED TO PUT THE BEST INTEREST OF CITIZENS FIRST AND COMMISSIONER DEAN HAS OUTLINED SOME RASONS OF CONCERNS HOW WILL THIS NEGATIVELY IMPACT OUR CITIZENS. I WRISH IN RETROSPECT WE SENT A LETTER PRIOR TO THE HOUSE AND SENATE PASSING THIS.
I DON'T KNOW WHAT EFFECT THIS WILL HAVE ON THE GOVERNOR AT THIS POINT, BUT, I DO UNDERSTAND THE CONCERN.
THEY ARE VALID. IMPORTANT TO UNDERSTAND WE ARE TAKING THIS STEP. COMMISSIONER DEAN, WOULD YOU
LIKE TO HAVE A MOTION? >> HENRY DEAN: YES, I WOULD LIKE TO MOVE THAT WE ASK THE CHAIRMAN -- PUT YOU ON THE HOT SEAT. SIGN A LETTER TO THE GOVERNOR ON YOUR BEHALF THAT YOU SAW ON THE OVERHEAD THAT I THINK WE HAUL A CHANCE TO REVIEW -- WELL WRITTEN BY THE WAY, PATRICK.
THAT IS MY MOTION. AND THAT'S IT.
>> JEREMIAH BLOCKER: IS THERE A SECOND? A MOTION BY COMMISSIONER DEAN AND A SECOND BY COMMISSIONER WALDRON. COMMISSIONER WHITEHURST.
>> CHRISTIAN WHITEHURST: I WOULD APPRECIATE HEARING MR. SMITH'S THOUGHTS ON THIS. YOU ARE SOMEBODY THAT SCRUTINIZES THE NUMBERS AND PRETTY STUDIOUS.
BY WOULD APPRECIATE YOUR IDEAS ON THIS ITEM.
>> JEB SMITH: NOTHING LIKE PUTTING MYSELF IN THE HOT SEAT.
TO ME THIS COMES DOWN TO WHAT BOTHERS ME ABOUT IT ANY SITUATION A SIGNED CONTRACT. THAT IS ACCURATE.
WHAT WE HAVE DONE IN AN IMPACT FEE NEGOTIATION IS A CONTRACT WHAT THAT ALLOWS FOR THE CONTRACT TO BE NEGOTIATED AND MAKES IT DIFFICULT FOR THIS BOARD TO PROCEED WITH DECISION WHEN THEY ARE BEING CHANGED IN THE FUTURE.
THAT -- AND GUILT BACK TO EVEN THE PGA TOUR THIS MORNING WITH REGARD TO THAT CONTRACT THAT WAS SIGNED IN 2017.
[04:20:03]
THAT MEANS SOMETHING TO ME AND I WOULD LIKE TO ADHERE TO CONTRACTS, BECAUSE I CANNOT MAKE GOOD, SOLID, PRUDENT AND WISE DECISIONS BASED ON SOMETHING MANIPULATED DOWN THE ROAD. WHAT I AM AFRAID HAPPENS IS WE ARE GOING TO END UP IN A COMPROMISE POSITION WITH REGARD TO THE NEGOTIATIONS. THE OTHER SIDE OF IT.THAT IS ONE SIDE. WHAT I AM AFRAID HAPPENS IS THE TAX BURDEN FOR NEEDED INFRASTRUCTURE.
WILL FALL ON THE TAXPAYER, PROPERTY OWNERS, EVEN MORE DISCOURAGING TO ME IS THAT FALLS ON OUR BUSINESSES.
AND I CAN TELL YOU WHY. WHAT HAPPENS MOST OF OUR RESIDENTS HAVE HOMESTEAD PROTECTION.
OUR BUSINESSES DO NOT. AND IN THE 200 SAVE OUR HOMES ACT, THE -- 2008 SAVE OUR HOMES ACT, THE MAXIMUM OF 3%.
PLUS HOMESTEAD EXEMPTION. WHAT HAPPENS TO OUR BUSINESSES ARE NO HOMESTEAD EXEMPTION AND MAXIMUM HOME VALUATION INCREASES OF 10%. WE ARE SEEING THAT.
WHAT HAPPENS IS, WE PLACE ADDITIONAL TAX BUD BURDEN ON OUR BUSINESSES BY SHIFTING IMPACT FEES TO THE AD VALOREM TAXPAYER. TO ME A REPREHENSIBLE THING AND A SLAP IN THE WAYS IF OUR BUSINESSES FACE TRIAL AND TRIBULATION THIS YEAR, AT LEAST CERTAIN SECTORS.
AND ALSO GOING TO -- I BELIEVE THIS HAS TO DO WITH HOME RULE.
AND IT HAS TO DO WITH DECISIONS BEING MADE AT A -- AT A COMMUNITY LEVEL. I UNDERSTAND THE STATE'S PRESEVRNGS DESIRE TO THWART SOME OF THE BAD LOCAL GOVERNMENTS ESPECIALLY IN SOUTH FLORIDA.
BUT IT ALSO THROWS US INTO THE RING THAT I THINK IS NOT VERY REASONABLE. AND I THINK IS -- THERE ARE EXCEPTIONS. WHEN WE TRY TO PAINT WITH A BROAD BRUSH, IT AFFECTS US ALL. THE REALITY AND PROBABILITY OF IT BEING VETOED WITH A FAVORABLE VOTE OF THE STATE LEGISLATURE IS REALLY SLIM. I SAW A TREMENDOUS REACTION FROM STATEWIDE ENTITIES SERVING AS CHAIR WHEN I SENT AT YOUR REQUEST LAST YEAR AND THIS BOARD'S REQUEST A LETTER TO THE ATTORNEY GENERAL AND A LOT OF ACTIVITY AND THEY HAVE DECLARED THAT. AND THE CLARIFICATION WAS VERY OBVIOUS AND NEEDFUL AND DEALT WITH.
I DON'T THINK IT WILL HAVE AN ADVERSE OR POSITIVE EFFECT, BUT I THINK IT WILL MAKE A STATEMENT.
I WILL SAY THIS, THAT WHAT IT IS GOING TO DO IN THE FUTURE, COMMISSIONER, IS IT IS GOING TO AFFECT MY DECISION MAKING BECAUSE WE AREN'T ADHERING TO THE CONTRACTS THAT WERE MADE AND THAT TO ME WAS VERY DIGS TURBING.
I HOPE THAT CLARIFIES WHERE I STAND.
I DON'T WANT TO SEND A LETTER BUT AN EFFECTIVE MEANS THAT WE NEED TO DO. THAT IS FOR OUR BUSINESSES, ESPECIALLY, NUMBER ONE AND OUR RESIDENTS AND CONSTITUENTS NEW MEXICO TWO. 37.
>> JEREMIAH BLOCKER: THANK Y YOU, MR. SMITH.
A MEANINGFUL EXPLANATION. WHEN YOU WERE CHAIRMAN WE HAD A LOT OF DISCUSSION ABOUT THIS. HERE WE ARE AGAIN.
WILL MCCORMACK AND THEN LET'S HEAR FROM YOU.
>> THANK YOU, MR. CHAIR. MY VERY LAST COMMENT.
I APPRECIATE ALL OF THE COMMISSIONERS COMMENT ON THIS.
I THINK IT IS -- IT IS AN IS ISSUE.
AS YOUR COUNTY ATTORNEY, IT WILL BE MY POSITION TO VIG VIGOROUSLY DEPEND THE CONTRACT THAT THE COUNTY HAS ENTERED INTO. HAVING SAID THAT, IF THIS HOUSE BILL 337 BECOME LAW, IT WILL BECOME MORE DIFFICULT TO DO THAT. SO THERE YOU GO.
>> JEREMIAH BLOCKER: WE APPRECIATE, PATRICK, YOU AND YOUR TEAM AND THE HARD WORK ON THIS.
AND THANK YOU COMMISSIONER DEAN FOR BRINGING THIS ATTENTION.
OPEN IT UP TO PUBLIC COMMENT AND THEN VOTE ON THIS.
>> HENRY DEAN: PUBLIC COMMENT ON OUR MOTION TO SEND A LETTER TO THE GOVERNOR RECOMMENDING VETO OF HOUSE BILL 337.
YES, SIR. >> ED SLAVIN, BOX 304.
I SUPPORT BOTH LETTERS. WE NEED TO PRESERVE AND PROTECT OUR CONTRACTS. WE NEED TO CONSIDER THE POSSIBILITY OF A DECLARATORY JUDGMENT LAW ENFORCEMENT IN LEE I DON'T KNOW CIRCUIT COURT. PATRICK, PLEASE LISTEN.
JOIN EVERY SINGLE ONE OF THE CREDIT AND ENGINE THE GOVERNOR IF HE SIGNS IT. AND WE RECOGNIZE THAT THE
[04:25:02]
SANCTITY OF CONTRACTS MUST BE BE PROTECTED AND MUST BE PROTECTED AGAINST THE FLORIDA STATE LEGISLATURE.AND LET ME ADD IF I AM ELECTED TO THE STATE LEGISLATURE, I WILL PRESERVE, PROTECT AND DEFEND HOME RULE.
WE MIGHT WANT TO REMIND GOVERNOR DESANTIS THAT HIS VERY FIRST VETO WAS A BILL THAT WOULD HAVE PREVENTED LOCAL JURISDICTIONS FROM REGULATING OR BANNING PLASTIC BAGS, PLASTIC STRAWS. AND HE VETOED IT.
THAT VETO AND STRAW BANS. IT WAS SPOT ON AND VERY PROUD OF THE THAT MOMENT OF GOVERNOR DESANTIS.
A SPINAL AND.IMPLANT AND IF HE SIGN IT IS, WE NEED TO CHALLENGE THAT LAW. AND SANCTITY OF CONTRACTS.
I MEAN THAT IS THE AMERICAN W WAY.
I TOTALLY AGREE WITH COMMISSIONER SMITH.
ALL OF YOU ALL. DOING A GOOD JOB.
THANK YOU. >> HENRY DEAN: NEXT, PUBLIC
COMMENT, PLEASE. >> BJ KALALY.
THAT IS FINE TO SEND A LETTER. I WANT TO CLARIFY TOO WHAT MR. MCCORMACK SAID THAT HE IS GOING TO WANT TO GO AHEAD AND SEND A LETTER TO EVERYONE WHO IS IMPACT FEE CREDIT HOLDERS.
DOES HE HAVE ANY IDEA HOW MANY PEOPLE -- I AM ASSUMING THESE ARE DEVELOPERS OR LAWYERS ARE GOING TO BE GETTING THAT LETTER AND WE WOULD BE INTERESTED IN KNOWING HOW MANY IMPACT FEE HOLDERS ARE OUT THERE AND WHAT THE DEAL IS.
SO A ANSWER WHAT MR. WHITEHURST SAYS TOO, MORE DETAILS I THINK WOULD HELP ALL OF US TO KNOW WHERE WE ARE AND AGAIN NEXT TIME MR. WHITEHURST, MAYBE YOU WANT TO ASK MR. BLOCKER FOR AN IN-DEPTH RESPONSE OF WHAT IS GOING ON.
AND I REALLY APPRECIATE THOUGH THAT MR. SMITH IS UP THERE.
HE SPEAKS IN MY LANGUAGE. VERY SIMPLE.
NOT LEGAL MUM BOW JUMBO AND I THINK IT HEMS THE PUBLIC TO UNDERSTAND AND TRULY UNDERSTAND BECAUSE IT WILL BE AFFECTING IMPACT FEES AND IN THE LONG RUN MAYBE PEOPLE'S PROPERTY TAXES.
SO THANK YOU VERY MUCH. >> HENRY DEAN: THANK YOU.
FURTHER PUBLIC COMMENT? SEEING NONE.
