[Approval of meeting minutes for PZA 11/5/20.]

TROUBLE KEEPING UP WITH THIS CHART AT THE SAME TIME AS GETTING QUESTIONS AND ALL THE OTHER THINGS GOING, I'M GOING TO ASK FOR SPART EX PARTE. DOES ANYBODY HAVE ANY EX PARTE

TO DECLARE ON ITEM NUMBER 1? >> NO. >> NO.

>> NO. >> VERY GOOD. THANK YOU.

[00:05:02]

AND I HAVE NONE TO DECLARE. SO -- >> CHAIRMAN.

>> YES. >> SORRY. WE ARE NEEDING TO APPROVE MEETING MINUTES FROM THE NOVEMBER 5TH MEETING TO START WITH.

>> WELL, THANK YOU. I APPRECIATE YOU REMINDING ME OF THAT, PETER.

SO WE DO NEED TO LOOP BACK AND APPROVE THE MEETING MINUTES FOR NOVEMBER 5, 2020.

[1. SUPMAJ 2020-14 Thai Garden LLC. ]

DO -- I THINK WE CAN DO THIS BY VOICE. >> MOTION TO APPROVE.

>> OKAY. ROY. IS THERE A SECOND?

>> SECOND. >> ALL RIGHT. ANY DISCUSSION?

ANYONE OPPOSED? ALL THOSE IN FAVOR. >> AYE.

>> THANK YOU. THANK YOU, PETER. OKAY.

SO I THINK WE ARE READY AT THIS POINT FOR THE APPLICANT TO AM COULD FORWARD ON ITEM NUMBER -- COME FORWARD ON ITEM NUMBER 1 AND TELL US ABOUT THE NEW THAI GARDEN.

>> HI. GOOD AFTERNOON, EVERYONE. MY NAME IS USA LOBO AND I LIVE AT 120 KING ARTHUR COURT ST. AUGUSTINE 3 RO II 86. I AM REPRESENTING A MEMBER OF THAI GARDEN LLC. I AM HERE TO REQUEST A SPECIAL USE PERMIT TO ALLOW FOR THE ON-SITE SALE AND CONCEPTION OF BEER AND WINE BEVERAGE FOR 2COP IN IN CONJUNCTION WITH AN EXISTING RESTAURANT, WE ARE REQUESTING A NEW LICENSE TODAY AS WE COULD NOT TRANSFER THE LICENSE FROM THE PREVIOUS RESTAURANT OWNER. THE PREVIOUS RESTAURANT OWNER

WAS CONRAD, AND CLOSED IN 2020 WHEN THE OWNER WAS RETIRING. >> OKAY.

THANK YOU VERY MUCH. >> THANK YOU. >> DOES NUB HAVE ANY QUESTIONS FOR THE APPLICANT? HEARING NONE, I WILL BRING IT BACK TO AGENCY FOR A MOTION.

>> MR. CHAIRMAN, I JUST WANTED -- I DID HAVE A QUESTION IT.

SAYS IT WILL BE -- ONE OF THE -- SHALL BE TRANSFERABLE, AND THEY WERE SAYING THAT IT WASN'T TRANSFERSABLE FOR THEM, SO IS THAT SOMETHING THAT WE ARE LOOKING AT OR --

>> WOULD STAFF LIKE TO SPEAK TO THAT? >> YOU'RE CORRECT.

AS WRITTEN IT'S TRANSFERABLE. >> BUT IT WASN'T TRANSFERABLE FOR THEM WHEN THEY -- OKAY.

>> FOR THE RECORD MARIE KIEHL, GROWTH MANAGEMENT. YOU'RE CORRECT.

THE ORGANIZING ONE FROM CONRAD IS LISTED AS NON-TRAPS FIRSTABLE AND WE HAVE UPDATED THE CODE TO INCLUDE A SPECIFIC SECTION THAT ADD LOUSE FOR ADMINISTRATIVE APPROVALS, AND IN THIS CASE, BECAUSE IT'S A 2COP THERE'S NO OUTSIDE SEATING AND IT'S WITHIN ONE OF THE COMMERCIAL DESIGNATED ZONING AREAS, IT WOULD QUALIFY FOR AN ADMINISTRATIVE TRANSFER IN THE FUTURE, SO LONG AS THEY WENT WITH THE SAME LICENSE LICED MOVED FORWARD IN THE SAME MANNER.

IF THEY BANDIT TO INCREASE THEIR LICENSE, THEY WOULD HAVE TO BE BACK BEFORE YOUR BOARD.

>> I GOT YOU. THANK YOU. >> DOES ANYBODY ELSE HAVE A

MOTION TO MAKE? >> MR. CHAIR, DO YOU WANT TO SEE IF THERE'S ANY PUBLIC SPEAKERS

ON THIS? >> GOOD IDEA. DO WE HAVE NECESSITY SPEAKER

CARDS? >> WE DO NOT. DO WE HAVE ANY SPEAKER WARDS?

>> WE DO NOT. >> AND DO WE HAVE ANYBODY ON THE GTV, ON THE PHONE? SO NOW WE WILL COMPLOAS THE CLOC HEARING AND WE WILL COME BACK INTO THE AGENCY FOR ACTION.

>> I'LL MAKE A MOTION IF THERE ARE NONE. >> IS THERE A SECOND?

>> SECOND. >> DO WE NEED A MORE SPECIFIC MOTION?

>> I'LL MAKE A MOTION TO APPROVE. WOULD YOU CARE MOOR ME TO READ

THE APPROVAL IN. >> CHRISTINA, DO YOU WANT HIM TO READ THE APPROVAL, COUNTRIES CH?

Y. >> WHY MESA. >> MAKE A MOGS TO APPROVE SUPMAJ 2020-14 REQUEST FOR A SPECIAL USE PERMIT TO ALLOW THE ON ZOOT SALE AND CONSUMPTION OF BEER AND HINE 2COP IN CONJUNCTION WITH THE PROPOSED RESTAURANT PURSUANT TO SECTION 2.03.02 OF THE LAND DEVELOPMENT CODE WITHIN THE COMMERCIAL GENERAL ZONING DESIGNATION, SPECIFICALLY LOCATE AT 4040 USE OF THE 1 SOUTH SUBJECT TO 12 CONDITIONS. AND EIGHT FINDINGS OF FACT AS

PROVIDED IN THE STAFF REPORT. >> AND SECOND. >> MEGAN SECONDS IT.

SO IS THERE ANY DISCUSSION? HEARING NONE, LET'S CALL THE VOTE.

[2. ZVAR 2020000022 129 S. Roscoe Blvd. (063140-0120). ]

[00:10:05]

AND BY YOUR ACTION YOU HAVE APPROVED THIS VARIANCE REQUEST NANLS.

CONGRATULATIONS. >> THANK YOU SO MUCH. UNANIMOUSLY.

>> OKAY LET'S MOVE TO ITEM NUMBER 2 ON THE AGENDA, AND I'LL ASK THE

AGENCY MEMBERS FOR ANY EX PARTE COMMUNICATIONS. >> NONE.

>> NONE. >> NONE. >> NONE BY THE CHAIRMAN.

OKAY. AND SO WOULD THE APPLICANT COME FORWARD, MR. CRABTREE.

>> SPEAKING. CRABTREE WALL GROUP 8777 SAN JOSE BOULEVARD, JACKSONVILLE, FLORIDA 32 TWR 17 HERE OH BEHALF OF MY CLIENT DR. AND MRS. PERRY. MRS. PERRY IS ACTUALLY OUT HERE IN THE AUDIENCE AND HOPING WE CAN GET THIS APPROVED SO THEY CAN GET THE CONSTRUCTION OF THEIR POOL BEFORE SHE HAS HER BABY. SO WE ARE REQUESTING A VARIANCE IN THE REAR YARD SETBACK FROM 1. IF YOU LOOK AT THE OVERALL SURVEYS ON THIS PIECE OF PROPERTY, THERE'S ABOUT TWO HOUSES TO THE SOUTH, AND THERE'S ABOUT EIGHT HOUSES TO THE NORTH WHERE WE HAVE ABOUT A 55-FOOT ARMY CORPS OF ENGINEERS, I ASSUME IT'S CALLED LIKE A RIGHT-OF-WAY. THEY OWN THE PROPERTY. WE HAVE EASEMENTS ACROSS THAT AND EVE A DOC PERMIT TO ALLOW TO GO TO THE INTRACOASTAL, HOWEVER, THE WAY WE HAD TO SET THE HOUSE OR THEY DIDN'T EVEN BUILD THE HOUSE, BUT WHEN THEY PURCHASED THE HOUSE, THE WAY IT WAS BUILT, AND THE SURVEY SHOWS THIS IN THE APPLICATION, THERE IS A ADRIANA FIELD AND THEY HAD TO PUT THE HOUSE POSITIONED ON THE FAR REAR BACK OF THE PROPERTY. SO WHEN THEY WENT TO GO LOOK FOR A BOOL BUILDER, THEY REALIZED THEY DON'T HAVE ENOUGH ROOM IN THE YEAR YARD, ALTHOUGH IT LOOKS QUITE EXPANSIVE BECAUSE YOU HAVE ABOUT A 19-FOOT SECTION IN THE REAR YARD THE TO PROPERTY LINE, AND THEN 55 MORE FEET TO THE ACTUAL WATERWAY, SO THAT'S WHY WE'RE HERE REQUESTING A VARIANCE TO GO FROM 10 FEET TO ZERO FEET. I WAS ACTUALY HERE ABOUT TWO YEARS AGO ON ANOTHER VARIANCE WITH THE EXACT SAME HOUSE. IRONICALLY MR. PRATT WAS IN THE BACK BUILT A POOL A COUPLE OF YEARS AGO FOR THESE CLIENTS O THERE IS A PRECEDENT IMMEDIATELY NEXT DOOR.

WITH THAT IF YOU HAVE ANY QUESTIONS, PLEASE LET ME KNOW IF YOU HAVE ANY.

>> ARE THERE ANY QUESTIONS ON THE PART OF THE AGENCY MEMBERS? YES, DR. HILSENBECK.

IS IT POSSIBLE ALSO THAT THIS IS FLORIDA INLAND NAVIGATION DISTRICT PROPERTY WHERE THEY CAN

PUT FILL WHEN THEY DO A DREDGE OF THE INTRACOASTAL WATERWAY? >> I DO NOT BELIEVE THAT IS THE CASE. WE ACTUALLY DID AS PART OF THE APPLICATION PROCESS, WE DID CONTACT THE ARMY CORPS OF ENGINEERS AND WE RECEIVED A LETTER FROM THEM AS A PART OF THE APPLICATION WHERE THEIR NOT OBJECTING TO THIS. THEY WILL NOT A MOVE ANYTHING OBVIOUSLY BECAUSE IT DOESN'T ENCROACH ON THE OTHER PROPERTY IN ANY WAY, SHAPE OR FORM.

MY UNDERSTANDING OF WHAT THIS ACTUALLY IS IS A POTENTIAL EXPANSION RIGHT OF THE INTRACOASTAL WATERWAY. HOWEVER IF YOU LOOK TWO HOUSES DOWN TO THE SOUTH OF THIS PIECE OF PROPERTY, THEIR ACTUAL PROPERTY LINE GOES ALL THE WAY TO THE WATERWAY.

SO I DON'T SEE THE ARMY CORPS OF ENGINEERS EVER UTILIZING THIS IN ANY WAY, SHAPE OR FORM.

JUST ONE OF THESE WEIRD, COOKIE THINGS, AND WITH THIS TEN STRETCH OF HOUSES ACROSS THE

BOULEVARD. >> FOR YOUR CLIENT'S SAKE, I JUST HOPE IT'S NOT A FLORIDA

INLAND NAVIGATION DISTRICT SITE. >> TOTALLY. THANK YOU.

>> ANY OTHER QUESTIONS FROM THE AGENCY MEMBERS? IF NOT, DO WE HAVE ANY SPEAKER

CARDS IN. >> WE DO NOT. >> AND ANYBODY ON GTV? ON THE PHONE? I'LL TAKE THAT AS A NO. AND I'LL BRING IT BACK INTO THE

AGENCY FOR A MOTION OR DISCUSSION. >> MOTION TO APPROVE ZONING CARE VARIESIANS 2020-226.01 TO ALLOW FOR A YEAR REGARD SETBACK ARE OF ZERO FEET IN LIEU OF THE 10-FOOT REQUIREMENT IN RESIDENTIAL, SING FELLOW RS-2 ZONING TO ACCOMMODATE AN OUTDOOR PATIO AND SWIM POOL AT SOUTH ROSCOE BOULEVARD SUBJECT TO TEN CONDITIONS AND FIVE FINDINGS OF

FACT AS PROVIDED IN THE STAFF REPORT. >> IS THERE A SECOND.

[3. ZVAR 2020-30 The Pratt Project. ]

>> SECOND. >> NR ALAIMO SECOND. ANY DISCUSSION? HEARING NO ONE, PLEASE VOTE. OKAY. SIX YEAST, NO NAYS.

-- SIX YEAS, NO NAYS. CONGRATULATIONS. >> THANK JULIA.

>> ITEM NUMBER 3 IS THE PRATT PROJECT, SO ONCE AGAIN, I'LL ASK THE AGENCY MEMBERS FOR ANY

[00:15:03]

EX PARTE COMMUNICATION. >> NONE. >> NONE.

>> NONE. >> NONE. >> OKAY.

NONE BY THE CHAIRMAN. AND MR. PRATT. >> HELLO, EVERYBODY.

THANK YOU FOR ASKING ME HERE TODAY. AIM ADAM PRATT OF 829 STATE ROAD 13 NORTH ASKING FOR A VARIANCE REQUEST TO ALLOW US TO BUILD THREE FEET OFF OF THE SIDE YARD SETBACK. RIGHT NOW SINCE WE ARE ZONED OPEN RURAL, WE HAVE TO BE 10 FEET OFF OF THE SIDE YARD. BUT AGAIN, WE WOULD LIKE TO ASK FOR A 3-FOOT SIDE YARD SETBACK.

IT WOULD BE 5-FOOT MEASURED TO THE EXTERIOR FOUNDATION OF OUR HOME.

3-FOOT MEASURED TO THE EAVES. THIS HERE WHY YOU'LL SEE THIS IS THE LOCATION OF OUR PROPERTY.

AGAIN, 1829 STATE ROAD 13 NORTH. WE ARE FOR A FUTURE LAND USE MAP, WE ARE ZONED OPEN RURAL, RESIDENTIAL B. AND THIS HERE IS OUR AERIAL MAP. AS YOU CAN SEE HERE ON OUR PROPERTY, WE HAVE A, ESPECIALLY FOR OPEN RURAL, WE DO HAVE A VERY ODDLY SHAPED LOT.

OUR LOT IS APPROXIMATELY 976 BY 105. SO PRETTY NARROW FOR OUR SIZE LOT, VERY LONG BUT AS YOU CAN ALSO SEE WE ARE 875 FEET OFF OF THE ROAD ON STATE ROAD 13 NORTH SO WE ARE SET PRETTY FAR BACK, AND REALLY WOULD ONLY HAVE TWO, WHICH ACTUALLY I'LL GO BACK HERE. YOU'LL SEE WE REALLY ONLY HAVE TWO NEIGHBORS ON EITHER SIDE OF USTHIS HERE IS A DETAILED SITE PLAN SHOWING OUR EXISTING HOME ON OUR CURRENT LOT.

THERE ON THE SOUTH SIDE OF THE PROPERTY YOU'LL SEE THE TWO CAR STANDARD WIDTH GRAJ THAT WE PLAN ON ADDING IN ADDITION TO OUR HOME. CURRENTLY RIGHT NOW -- WHICH YOU WILL SEE RIGHT THERE. CURRENTLY RIGHT NOW WE DO NOT HAVE A GARAGE AT ALL.

SO ADDING THIS WOULD ALLOW US TO THEN HAVE THE ATTACHED TWO-CAR GARAGE.

AT THE SAME TIME AS DOING THIS ADDITION, WE HAD ALSO PLANNED ON ADDING ADDITIONAL LIVING SPACE TO OUR HOME. THIS HERE SHOWS THE APPROXIMATE LOCATION OF THE PROPOSED LOCATION OF THE STANDARD WIDTH TWO-CAR GARAGE, AND WIEWL SEE THIS HER -- YOU'LL SEE THIS HERE IN THE NEXT VIEW AS WELL WURCH ONE OF THE MAIN REASONS -- I'LL JUST SAY THERE'S A FEW REASONS WHY WE WOULD LIKE AND WHY WE ARE REQUESTING FOR THIS VARIANCE.

THE NUMBER ONE REASON FOR THE HARDSHIP CLAIM, I THINK MY WIFE AND NEWBORN ARE BACK HERE IN THE BACK. WE ALSO HAVE TWO OTHERS THAT ARE CURRENTLY WITH THE SITTER RIGHT NOW BEING WATCHED A HOME. BUT IT'S FOR SAFETY. RIGHT NOW, ESPECIALLY EVEN THIS PAST WEEK, ALL OF THE RAIN THAT WE'VE BEEN RECEIVING, RIGHT NOW EVERY DAY WHENEVER MY WIFE COMES HOME, SHE'S HAVING TO CONSTANTLY GET THE QUIDS ON IT IN THUNDERSTORMS. SO THE ONLY WAY THAT WE ARE ACTUALLY ABLE TO ADD A STANDARD WIDTH TWO-CAR GARAGE TO OUR HOME IS BY REQUESTING THIS VARIANCE. SO THE NUMBER ONE REASON IS FOR SAFETY, SO THAT WAY WHEN I DO GET HOME, THEY DON'T HAVE TO GET OUT IN ALL THE STORMS AND HEAVY RAINS. ALSO, OUR LOT IS ODDLY SHAPED. THIS LOT HAS EXISTED SINCE 1978, SO, OF COURSE, WHENEVER WE PURCHASED OUR LOT, THAT WAS ALREADY IN THESE DIMENSIONS OF THE 978 BY 105. WE HAVE NO REASONABLE ROOM FOR ANY HORIZONTAL EXPANSION.

AGAIN, ON THAT SOUTH SIDE. AND MOST PROPERTIES THAT ARE ZONED OPEN RURAL ARE MUCH WIDER THAN WHAT WE HAVE. ALSO, WITHIN OR LOT, AND ACTUALLY I'M GOING TO GO BACK HERE A LITTLE BIT A COUPLE SLIDES. OKAY.

SO HERE YOU WILL SEE THIS IS OUR DRAIN FIELD HERE. OUR SEPTIC TANK IS HERE.

SO THE DRIVEWAY COULDN'T EXTEND STRAIGHT THROUGH BECAUSE THAT IS ALSO IN FRONT OF THE DRAIN FIELD, WHICH WE WILL SEE IN ANOTHER PHOTO THAT'LL BE PULLING UP HERE SHORTLY ON THE SLIDE.

ALSO, ON THE -- OVER HERE THIS IS WHERE OUR WELL HEAD AND ALL OF OUR WELL PUMP EQUIPMENT IS LOCATED OVER THERE ON THE BACK LEFT CORNER OF THE HOME. OUR EXISTING MASTER BEDROOM IS RIGHT HERE AND MASTER BATH IS RIGHT HERE. OUR CURRENT INDOOR, I'LL JUST SAY LAUNDRY ROOMIN AND DOOR KITCHEN IS RIGHT HERE SO THIS NEW GARAGE IS ALSO GOING TO MAKE IT NATURAL, NOT ONLY WITH THE DRAIN FIELD THAT WE SAW LOCATED UP HERE, BUT WHEN WE COME UP THE

[00:20:02]

DRIVEWAY, THIS IS GOING TO WORK PERFECT FOR TWO-CAR GARAGE AND THAT WAY WE CAN GO STRAIGHT FROM THE GARAGE, STRAIGHT THROUGH THE KITCHEN INTO OUR HOME. SO IT DOES ALSO WORK OUT PERFECTLY WITH THE EXISTING FLOOR PLAN OF OUR HOME. SO PLACEMENT.

THAT'S WHAT I WAS JUST SHOWING YOU GUYS ON THE SITE PLAN THAT WE WERE JUST LOOKING AT.

AGAIN, YOU'LL SEE THAT DRAIN FIELD LOCATED IN THE DEAD CENTER OF THE FRONT OF THE HOME.

THE WELL HEAD LOCATED ON NORTHEAST CORNER OF THE HOME AS WELL SLOONG WITH ALL OF THE WELL PUMP EQUIPMENT. HERE YOU WILL SEE THIS IS ME STANDING IN THE DRIVEWAY.

YOU CAN SEE THERE WHERE THE DRIVEWAY STARTS CREATING THE LITTLE "S" LOOPING AROUND THROUGH HERE. , THERE'S OUR EXISTING DRAINFIELD IN THE PROPOSED LOCATION OF THE TWO-CAR GARAGE. RIGHT NOW OUR CURRENT SHOME A THREE-2.

THREE-TWO, 1900 SQUARE FEET TOTAL. WE LOVE OUR HOME.

WE LOVE OUR LOT. WE LOVE OUR LOCATION. AND WE SEE THIS BEING THE PLACE THAT WE'LL BE AT FOREVER. WE DO HAVE A GROWING FAMILY. WE CURRENTLY HAVE FIVE OF US, AND WE ARE RUNNING OUT OF SPACE WITHIN OUR HOME, AT THE SAME TIME AS CREATING THE GARAGE FOR SAFETY, WE WOULD LIKE TO GO AHEAD AND ADD ADDITIONAL SPACE ONTO OUR HOME AS WELL.

AND THANK YOU VERY MUCH FOR EVERYTHING. >> THANK YOU, MR. PRATT.

DO ANY OF THE AGENCY MEMBERS HAVE QUESTIONS FOR MR. PRATT? >> I HAVE A QUESTION.

TO THROUGH THE CHAIR. YOU'VE GOT 31 FEET FROM THE EDGE OF THE HOUSE TO THE PROPERTY LINE, AND I GUESS YOU'RE WANTING 26. A TWO-CAR GARAGE IS ROUGHLY 20 FEET. THE DOOR IS 16 FEET. HAVE YOU NOT LOOKED AT -- YOU'VE

GOT A VERY WIDE TWO-CAR GARAGE, ESSENTIALLY. >> SO OUR GARAGE, WHICH WE DO HAVE THE PLAN TO HAVE IT ON THE APPLICATION, WE ARE ABLE TO SEE THAT IT IS A STANDARD WIDTH TWO-CAR GARAGE. WE ARE DOING A 16-FOOT WIDE GARAGE DOOR.

>> CAN YOU BRING UP -- >> THEN ON EITHER SIDE OF THE GARAGE THERE WILL BE APPROXIMATELY ABOUT 3 FEET TO THE LEFT AND RIGHT OF EACH SIDE OF GARAGE DOOR.

>> RIGHT. I SEE IT'S MORE THAN 3 FEET ON THE FLOOR PLAN HERE.

I CAN'T READ IT, THE EXACT DIMENSION BECAUSE IT'S SO TINE, BUT IF THAT'S THE IMPETUS FOR THE EXPANSION, I THINK THE GARAGE COULD CERTAINLY BE REDUCED IN ITS WIDTH, AND LESSEN

THAT SETBACK FROM 3 FEET TO SOMETHING MORE REASONABLE. >> AND, OF COURSE, ANOTHER THING, TOO, TO KEEP IN MIND AGAIN NOT ONLY DO WE HAVE THE FLOOR PLAN HERE THAT WAS ON THE APPLICATION, BUT AGAIN AT THE SAME TIME WE ARE ADDING THE FLOOR SPACE.

THERE YOU WILL SEE THE ADDITIONAL BEDROOMS THAT WE ARE ADDING AT THE SAME TIME, BOTH ON THE FIRST FLOOR AND THE SECOND FLOOR, SO THAT IS ALSO WHAT'S GOING TO ALLOW US TO ADD IN THE ADEQUATE SPACE AND ADEQUATE& ROOMS WITHIN THE FLOOR PLAN AS WELL.

>> SURE. I UNDERSTAND THE GROWING FAMILY PART.

I JUST PERSONALLY DON'T SEE THE HARDSHIP THAT THIS ENTAILS, AND I THINK THE 3-FOOT DIMENSION IS OUT OF THE CHARACTER OF THE RURAL NATURE IN THIS AREA AND WE'VE GOT TO FIRE RATE THAT

ANYWAY. THAT'S JUST MY OPINION. >> YES, SIR, DEFINITELY.

AND AS I MENTIONED EARLIER, YOU SEE HERE ON THE SITE PLAN IT IS 5-FOOT TO THE WALL.

THE EAVES WITH THE 2-FOOT OVERHANG WOULD END UP BEING THE 3 FEET.

SO REALLY THE BUILDING IS GOING TO BE, INSTEAD OF 10 FEET OFF THE PROPERTY LINE, THE BUILDING

WILL BE ITSELF 5 FEET OFF THE PROPERTY LINE. >> ANY OTHER QUESTIONS FROM

AGENCY MEMBERS? DO WE HAVE ANY SPEAKER CARDS? >> WE DO NOT.

>> ANYBODY ON THE GTV? NOT. I WILL BRING IT BACK INTO THE

AGENCY FOR A MOTION. >> I HAVE ONE QUESTION. >> YES, YOU MAY.

>> EVEN IF YOU SHORTENED THE WIDTH OF YOUR GARAGE TO A MORE STANDARD GARAGE, WOULD YOU STILL

BE HAVING TO COME HERE AND ASK FOR A VARIANCE? >> YES, MA'AM, THAT IS CORRECT.

SO WE ACTUALLY WORKED WITH OUR ARCHITECT PRIOR TO THE PLAN, THE FULL SET OF PLANS THAT WE HAVE NOW. WE DID ACTUALLY TRY SEVERAL OTHER OPTIONS, EVEN JUST TO GET THE TWO-CAR, STANDARD WIDTH TWO-CAR GARAGE STILL WOULD HAVE BEEN PROCEEDING BEYOND, BUT IT IS ALSO ON HOW EVERYTHING LIES OUT WITH THE EXISTING INTERNAL FLOOR PLAN OF THE HOME AS WELL.

>> I DON'T MIND OFFERING A MOTION. >> OKAY.

>> MOTION TO APPROVE ZONING VARIANCE 2020-30, THE PRATT PROJECT, A REQUEST FOR A ZONING

[00:25:03]

VARIANCE TO THE LAND DEVELOPMENT CODE TABLE 6.01 TO ALLOW A SIDE YARD SETBACK OF 3 FEET IN LIEU OF THE 10-FOOT REQUIREMENT OPEN RURAL ZONING TO ACCOMMODATED AN ATTACHED GARAGE IN I ADDITION TO THE EXISTING HOME, SPECIFICALLY LOCATE AT 1829 STATE ROAD 13 NORTH, FIVE FINDINGS OF FACT AND

SUBJECT TO SEVEN CONDITIONS AS PROVIDED IN THE STAFF REPORT. >> I HAVE A FIRST.

IS THERE A SECOND? >> SECOND. >> I HAVE A FIRST AND A SECOND.

IS THERE ANY FURTHER DISCUSSION? HEARING NO ONE, LET'S REGISTER THE VOTE.

[Items 4 & 5]

OKAY. THAT PASSES 5-1. THANK YOU.

>> THANK YOU. >> MOVING ON TO ITEMS 4 AND 5, SO THIS IS A LAND USE CHANGE ALONG WITH A COMPANION MAJOR MODIFICATION TO A PUD, SO I ASSUME, CHRISTINE, WE WILL HEAR

THESE TOGETHER. IS THAT CORRECT? >> YOU WILL HEAR THEM TOGETHER AND VOTE SEPARATELY ON EACH. I DO WANT TO POINT OUT REGARDING THE MAJOR MODIFICATION, THIS IS IN THE NORTH SECTOR, SO THE COMMUNITY MEETING IS REQUIRED AND THERE ARE CERTAIN NOTIFICATION REQUIREMENTS FOR THE COMMUNITY MEETING, MAILED NOTICES TO OWNERS WITHIN 200 FEET, NEWSPAPER ADVERTISING AND ALSO POSTING OF THE PROPERTY.

THE COUNTY RECEIVED THE AFFIDAVIT BACK FROM THE APPLICANT REGARDING COMPLIANCE WITH THE NOTICE REQUIREMENTS INDICATING THAT THEY DID NOT POST POST THE PROPERTY.

I WANT TO POINT OUT THAT THIS MEETING TODAY IS PROPERLY NOTICED AND YOU CAN PROCEED WITH THE RECOMMENDATION. THE BOARD OF COUNTY COMMISSIONERS MAY DECIDE EITHER TO FIND SUBSTANTIAL COMPLIANCE WITH THE NOTIFICATION REQUIREMENTS OF THE COMMUNITY MEETING CONSISTENT WITH THEIR ONGOING EMERGENCY PROCLAMATION OR THEY MAY ASK THE APPLICANT TO

HOLD ANOTHER COMMUNITY MEETING PRIOR TO THE BOARD'S FINAL VOTE. >> THANK YOU.

>> SO WE DON'T DEAL WITH EX PARE COMMUNICATIONS ON ITEM 4. BUT I'M GOING TO ASK IF THERE WY EX PARTE COMMUNICATIONS BY OTHEY MEMBERS ON ITEM 5. CORRECT ME IF I'M WRONG THERE,

CHRISTINE. >> CORRECT. >> THANK YOU.

>> I DID DRIVE BY THE PROPERTY D LOOKED AT IT. PRIOR TO THAT, THE DAY BEFORE IL MR. TONY PREISSIG TO SPEAK WITHM BECAUSE I DIDN'T WANT TO UNDERTT PROVED TO BE A 67-MILE ROUND TRM MY HOUSE WITHOUT KNOWING IF THEY WAS GATED OR NOT. IT IS GATED, BUT HE HAD TOLD MEE GATES OPENED DURING THE DAY, SOD DRIVE OUT THERE AND LOOKED AT ID THEN WE ALSO -- HE MAINLY DISCUE MERITS OF HIS -- WHAT WAS HIS HR OPPOSING THE APPROVAL OF THIS, D DISCUSS THAT.

>> AND THE CHAIRMAN WOULD LIKE O DISHOAS SOME COMMUNIQUES -- DISE COMMUNICATION WITH NATE DAY ABOE PROJECT AND THE MERITS OF THE P, AND WE DID ALSO DISCUSS THE NOTG ISSUE TO A CERTAIN EXTENT.

OKAY. SO AT THIS POINT I AM GOING TO E APPLICANT TO PRESENT, AND I THIT THE APPLICANT IS HERE NOT HET PRESENTING ONLINE BECAUSE I THIE APPLICANT IS DEALING WITH COVIDS

HOUSEHOLD. >> YEAH, CAN YOU GUYS HEAR ME O? >> YES, WE CAN.

>> ALL RIGHT. NATE DAY, 3741 SAN JOSE PLACE, , JACKSONVILLE FLORIDA 32257.

WE ARE RECOVERING FROM COVID, SI APPRECIATE YOU GUYS BEING ABLE E US OVER THE PHONE AS WELL.

I HAVE A POWERPOINT PRESENTATIO. YOU GUYS HAVE THAT UP ON THE SC? >> YES, WE DO.

>> ALL RIGHT. THE SLIDES ARE LABELED SO THAT D COMMUNICATE PRETTY EASILY WHICHE WE'RE ON, BUT IF YOU GO TO SLIDS IS AN EXISTING NEIGHBORHOOD. THERE'S THE MODIFICATION TO THES TO ADD ABOUT 30 GROSS ACRES, ABT 15 ACRES TO AN EXISTING NEIGHBOD THAT IS ALREADY APPROVED AND MOY BUILT CONSISTING OF 289 UNITS. IT'S ON BOTH SIDES OF LONG LEAFE PARKWAY JUST NORTH OF WHERE ROBD

[00:30:03]

INTEARKTS LONG LEAF PINE PARKWA. IF YOU HAVE NOT BEEN ABLE TO GOD VISIT, AS IT WAS STATED EARLIERS PRIVATE AND GATED. IT IS A VERY NICE WELL-BUILT CO. IT'S GOT AN AMENITY CENTER THATS FINISHED. MOST OF THE HOMES ARE OCCUPIED. EVERYTHING THAT WAS IN THE ORIGL PHASES, PHASES 1, 2 AND 3 ON THT SIDE OF LONG LEAF PARKWAY HAS BT OUT AND SOLD AND THOSE GATES AR.

THE EAST SIDE IS THE PORTION THS STILL BEING DEVELOPED AND SOLD. THE TWO BUILDERS IN THERE RIGHTE BASICALLY TWO HOMES AND THREE H. LIKE I SAID EARLIER, THUNDERSTOE IN THE HALF MILLION PLUS RANGE.

IT HAS BEEN A GOOD COMMUNITY THN BUILD HAVE BUILT OUT WELL AND IS PRETTY VALUABLE.

THERE'S A PORTION OF THIS 15 ACT WE'RE ADDING IS BASICALLY LAND S PART OF JOE HILLA'S LARGE TRACTS COMPLETELY PLOCKED WY WETLAND SS NO WAY FOR HIM TO USE ANY OF IT. WE HAVE ALWAYS HAD A PLAN TO EXO IN POCKET OF UP LNLDZ TO EX PANT IS GOING TO BE 31 LOTS INTO THEG OXFORD ESTATES COMMUNITY.

SO IT WILL GO FROM 289 TO 23 . IF YOU GO TO SLIDE 3, DECK TO 3. -- YOU CAN SEE WHAT THE CURRENT.

THIS IS THE 289 LOTS THAT'S CURY APPROVED TO THE BOOKS. IF YOU GO TO SLIDE 4, I'VE GOT T THAT'LL SHOW TEAR OF THE -- CIET THAT'LL SHOW THE AREA OF THE CUT PLAN WHERE WE ARE EXTENDING THE PROJECT. YOU CAN SEE THAT ALL OF THE MVPS THAT WE HAVE HAVE ALL SHOWN FUTE CONNECTIVITY AT THIS POINT. IT'S BEEN A REQUIREMENT PER THE NORTHWEST SECTOR OVERLAY AND ITS SOMETHING THAT WE HAVE ALWAYS HE PLAN TO SHOW THAT THERE WAS SOME CONNECTION CONTEMPLATED AT THIS, AND AT THIS PORTION OF THE PROP. IF YOU GO TO SLIDE 5, THIS IS TE PROPOSED MAP THAT INCLUDES THE ADDITIONAL 31 UNITS. YOU CAN SEE THE AMOUNT OF WETLAT BOARDERS THIS THING.

THERE'S NOT ANOTHER WAY TO REALY UTILIZE THIS PROPERTY WELL. AND SO IT MAKES SENSE TO TBLIT E AT THIS TIME BRING IT IT IN AND MAKE IT THE LAST PARTT WILL BE OXFORD SPHEAPTS IF YOU O SLIDE 6 THIS IS A ZOOMIN' ON TH0 ADDITION THAT IS BEING ASKED FO. THIS IS THROUGH TRANS MILT MILTD USE. WE HAVE ADDRESSED TAUGHT AGENCY COMMENTS.

THIS PORTION OF LAND WAS SILVICO WE HAVE TO TBLIET RES-B TO MATCE REST OF THE MOOSHED AND THEN, O, WE HAVE THE CHANGE THE ZONING FE OR THAT'S CURRENTLY THERE TO THD ZONING SO THAT IT IS COMPLICITIH THE WEST OF REST OF THE NEIGH. WE DID HOLD A COMMUNITY MEETING. WE LET THE STAFF KNOW PRETTY EAN THAT THERE HAD BEEN A MISTAKE IT POSTING THE SIGN AT THE PROPERT. I CAN TELL YOU THAT THE COMMUNIY MEETING WAS WELL ATTENDED. WE HAD A NUMBER OF PEOPLE THAT N THE ROADS THAT ARE IN THIS PARTE NEIGHBORHOOD ON OLD HILL WAY AND CLARENDON. I DO KNOW THAT THEY HAD POSTED E NOTICE ON THE FACEBOOK PAGE FORE COMMUNITY, SO THE COMMUNITY WASF THE MEETING THAT WAS COMING UP,N THOUGH IT WASN'T SOMETHING THAT. I KNOW THAT THAT HAPPENED. AND I KNOW THAT THERE WAS A NUMF PEOPLE THAT SHOWED UP, SO THEREA LOT OF COMMENT AND DISCUSSION TS HAD IN THAT HOUR-LONG MEETING.

THE LAST SLIDE I'LL GO TWO SLID, SHOWS A COUPLE THINGS THAT CAMEF COMMUNITY MEETING.

ONE OF THEM, THE ORANGE CIRCLE U CAN SEE WAS THE REQUEST THAT THE ADDITIONAL LOTS THAT ARE GOING E ACROSS THE STREET FROM EXISTINGS WOULD ALL BE 80 FEET WIDE, SO TD MATCH WHAT'S THERE CURRENTLY, AE DID MAKE THAT CHANGE. THAT WASN'T ON THE ORIGINAL PROT AFTER THE COMMUNITY MEETING WE O AND WIDEN THOSE LOTS THERE SO TY WOULD MATCH WITH WHAT'S ACROSS E STREET.

THE OTHER BIG CONCERN WAS CONSTN TRAFFIC. I'VE HIGHLIGHTED ON THIS MAP THO BLUE DPOPTS THERE ARE SOME EXISB SETS THAT ARE IN LONG LEAF PINEI THIS WERE CONTEMPLATED AT SOME .

OUR PLAN AND COMMITMENT IS THATE GOING TO USE THOSE EXISTING CURS FOR OUR CONSTRUCTION ACCESS, THE WILL CREATE OUR CONSTRUCTION ACS ALONG LONG LEAF PINE AT THIS PO. WE WILL HAVE ALL THE OUR HEAVY T COME IN AROUND THE POND WHILE TD IS BEING DUG AND EVERYTHING WILE MOBILIZED IN AND OUT FROM LONG E

[00:35:03]

PARKWAY SO THAT WE'RE NO BRINGIY TRAFFIC THROUGH THE NEIGHBORHOOS PROPERTY.

THERE SHOULD NOT BE ANY REQUIRER DIRT JUST BECAUSE OF THE SIZE OE POND AND THE SMALL NUMBER OF LOE DOING, BUT AGAIN, ANY CONSTRUCTN TRAFFIC THAT DOES NEED TO COME R COME OUT IS GOING TO BE DIRECTLF LONG LEAF PINE AND IS NOT GOINGE IN INTO THE PRIVATE ROADS THAT E ALREADY THERE.

THAT IS, YOU KNOW, THE BASIC EXN OF WHAT WE'RE LOOKING FOR. THIS IS SOMETHING THAT WE ARE TO UTILIZE EXISTING ROADS, EXISTING INFRASTRUCTURE, EXISTING CAPACID THE LIFT STATION TO ADD THESE LO THE NEIGHBORHOOD THAT HAVE BEEN CONTEMPLATED FOR A LONG TIME. SO I WILL KIND OF PAUSE THERE AF

THERE'S ANY QUESTIONS AND I'M HO ANSWER ANYTHING YOU'LL HAVE. >> OKAY.

I DO HAVE A FEW AGENCY MEMBERS N THE BOARD. THE FIRST ONE IS MR. ALAIMO.

>> YES, THANK YOU, MR. CHAIRMAN. I JUST HAD A QUESTION WITH REGAO THE LOT WIDTH.

SO THE FIRST FOUR LOTS WILL GO - THEY'LL GO TO 80 OR WILL THEY G3 TO MATCH THE CURRENT LOT WIDTH?

>> I BELIEVE WE HAVE THOSE AT 8T RIGHT NOW. >> OKAY.

AND SO I GOT SOME COMMENTS THATE COMMUNITY MEETING, THAT THOSE FR WOULD MATCH THE EXISTING WHICH O THAT'S WHY I BROUGHT THAT UP. AND THEN JUST IN YOUR COMMENTS E OF THE FOLKS THAT ARE REALLY COD

ABOUT THE ADDITIONAL TRAFFIC, IT WANTED TO GET YOUR THOUGHTS ON . >> ON THE ADDITIONAL TRAFFIC?

>> RIGHT. >> I MEAN, THE ONLY ADDITIONAL C IS GOING TO BE THE -- ONCE THESE BUILT OUT, 30 SOMETHING RESIDENT WILL LIVE BACK HERE AND BE A PAE SAME NEIGHBORHOOD.

BUT AGAIN, IT WAS ALWAYS SOMETHT WAS CONTEMPLATED ON THE ZONING N THE PUD MAPS, THAT THERE WOULD E

CONNECTIVITY HERE. >> OKAY. THANK YOU.

>> THANK YOU. DR. HILSENBECK. >> I AM ALSO CONCERNED ABOUT YOG ON THE MAP 80 HAVE 85-FOOT LOTSN EMAIL COMMUNIQUE WE HAD FROM EDN SAYS YOU HAD COMMITTED TO 83 FEM THE ORIGINAL 73-FOOT PROPOSED. SO I HOPE IN ANY MOTION THAT'S T FORWARD AT LEAST THAT WOULD BE N THERE AT 83 FEET. ALSO, WHEN I WAS OUT THERE YESTT IS REALLY TIGHT IN THERE.

WHEN YOU'RE DRIVING THROUGH THE, THERE'S CEMENT TRUCKS OUT THEREG CEMENT OR POURING IT, THERE'S CONSTRUCTION VEHICLES ON THE RO. IT'S REALLY TIGHT. SO IF YOU'RE GOING TO USE THE CS FOR CONSTRUCTION ACCESS, NUMBERY DON'T YOU UTILIZE THOSE ULTIMATR FINAL ACCESS TO THIS NEW PHASE,S IT'S PHASE 7 OF THE DEVELOPMENT. IF IT'S GOOD ENOUGH TO COME IN . I KNOW THERE WILL BE A POND ULTY ERECTED OR DUG, UTILIZED THERE,T THAT'LL BLOCK ONE OF THEM BUT YL COULD COME UP FURTHER NORTH ALOG LEAF PINE PARKWAY. AND IP WONDERING IF YOU HAD ALWS PLANNED THIS PARTICULAR EXPANSIY YOU POURED CONCRETE SIDEWALKS TT THE NEIGHBORHOOD AT THE. AT THE END OF OLD HALE THERE'S A BEAUTIFUL POURED CONCRETE SIDEWK THERE, AND IF I WERE BUYING IN T NEIGHBORHOOD AND I SAW THAT THES A POURED CONCRETE SIDEWALK, I WT THINK THERE WAS GOING TO BE A RT THROUGH THERE IN THE FUTURE, SOS A LITTLE CONCERNING TO ME. AND THEN I HAVE OTHER COMMENTS D QUESTIONS, MORE COMMENTS FOR CONSIDERATION LATER, BUT THOSE E QUESTIONS I HAVE FOR YOU AS THE APPLICANT.

THANK YOU. >> NO. THANK YOU.

AND IF I COULD JUST ADDRESS THAL QUICKLY. I DON'T THINK I HAVE A PROBLEM H COMMITTING THAT WE WILL DOUBLE-D MAKE SURE THEY'RE 83-FOOT WIDE D NOT 80-FOOT WIDE LOTS.

I DON'T THINK IT MAKES A DIFFERN OUR END. IF IT WAS COMMUNICATED, I DON'TO

[00:40:04]

ARGUMENT OVER 3 FEET. I'LL BE HAPPY TO HAVE WHATEVER E RECOMMENDATIONS TO MAKE SURE ITE RECORD, THAT WE WOULD MAKE THOST 80. I DEFINITELY AM NOT HERE TO FIG.

I WILL TELL THAT YOU HAVING ACCR THIS ALL 81U.31 LOTS KEUCHEL LOF PINE PARKWAY IS PRETTY PROHIBIT.

THERE'S ISSUES WITH HOW WE WOULW WE WOULD CONSTRUCT THE STORM WAD THAT WOULD HANDLE THE STORM WATR THIS NEIGHBORHOOD AND WE ALSO GG INTO HAVING TO PUT IN ACCEL ANDL LINES ALONG LONG LEAF PINE PARKN WE ALREADY HAVE THEM JUST A COUE HUNDRED FEET SOUTH. I KNOW THE NORTHWEST SECTOR WOUR HAVE SCENIC EDGES AND PONDS AND. KIND OF STUFF INSTEAD OF MORE CS AND MORE ACCESS ONTO THIS ROAD.

IT WOULD, IN MY OPINION, BE A DT TO LONG LEAF PINE PARKWAY TO NOT UTILIZED THE FACT THAT WE ALREAE INTERNAL ACCESS IN THIS NEIGHBOD THAT WE'VE ALWAYS SHOWN CONNECTY COMING THROUGH -- FUTURE CONNECY COMING THROUGH, TO THEN BE FORCO OUT ONTO LONG LEAF PINE PARKWAY. AND THEN THRARNS ISSUE WITH STU, IT'S A LOT EASIER TO UTILIZE THG EXISTING LIFT STATION. WE CAN PUT AUTO GRAVITY SEWER IE ROAD. JA DOES NOT WANT YOU RUNNING THE THINGS THROUGH BACKWARDS AND T

TO UTILIZE THE EXISTING FACILITS THERE. >> DR. HILSENBECK.

>> I DO HAVE A FOLLOW-UP QUESTII AGREE THERE'S A LOT OF TRAFFIC E RIGHT NOW ON LONG LEAF PARKWAY D FURTHER SOUTH PARTICULARLY. I DIDN'T DRIVE MUCH FURTHER NOR. BUT IF YOU'RE CONCERNED ABOUT TC AND CITADEL LANES AND ACCELERATN LANES FOR EXTREMELY RESIDENTS, G YUKS WHICH WILL TAKE A WHILE TO1 HOMES, THOUGH YA'LL ARE PUTTINGP REALLY QUICKLY OUT THERE, YOU'RG TO HAVE CONSTRUCTION VEHICLES, T AND CONCRETE TRUCKS COMING IN UG THAT WITHOUT THE SPRANG OF HAVIE KIND OF LANES DEVELOPED, WHICH K POTENTIAL CREATES A TRAFFIC HAZT BRINGING THE CONSTRUCTION VEHICN AND OUT OF THAT ROAD OFF LONG LF PARKWAY, SO THAT IS A CONSTRAINI SEE. SO THAT'S MY COMMENT THERE, BUTE

SOME MORE LATER. THANK YOU. >> MR. DAY, DO YOU HAVE ANYTHINS

ADD? >> NOT NOW. I THINK THERE MAY BE SOME INDIVN

THE PHONE, TOO, SO I'M HAPPY TOR ANY MORE QUESTIONS THAT COME UP. >> AFTER PUBLIC COMMEN WE'LL GIA

CHANCE TO SPEAK. SO DO WE HAVE ANY SPEAKER CARDS? >> WE DO.

ANTHONY PREISSIG. PLEASE STATE YOUR NAME AND ADDRR THE RECORD, AND IT SAYS YOU'LL E

PRESENTING SOME PRINTED VISUAL S AS WELL. >> GOOD AFTERNOON.

MY NAME IS ANTHONY PREISSIG PRE. I'M ANOTHER IMLUN ST. JOHNS 325. I JUST WANTED TO START BY RESPOO WHAT HAS ALREADY BEEN DISCUSSEDI GET INTO MY OBJECTIONS TO THE WE PROJECT MR. DAY WAS SAYING.

AGAIN, I HAVE A COPY OF THE CERD COMMUNITY MEETING NOTICE AFFIDAT SAYS THAT MR. DAY DID NOT PUT TS UP IN ACCORDANCE WITH THESE REG. I KNOW THERE WAS SOME DISCUSSIOH THE COIN ATTORNEY, AND WE AGREEO FORWARD, BUT I DON'T THINK THATA DISSERVICE TO YOU GUYS. HE FAILED TO DO PROPERLY NOTIFI.

I DON'T MEAN THE STRAWGHT PAPER. I DON'T HAVE FACEBOOK. I DON'T GO ONTO FACEBOOK.

AND THE MAIL SYSTEM IN MY COMMUS HORRENDOUS. SO THE MOST IMPORTANT WAY FOR MT THE OPPORTUNITY TO VIEW ANYTHING UP IN THE COMMUNITY AS FAR AS TS MEETING ALSO.

SO I PROPOSE THAT THIS MEETING D NOT BE HELD UNTIL MR. DAY COMPLH THE STANDARD.

SECOND OF ALL, HIS RESPONSE, I E DOCTOR MENTIONED THAT THE CONFUN MY CUL-DE-SAC THAT WAS DESIGNEDY WAS SAYING THAT WAS KNOWN TO BED OR KNOWN TO BE PUBLIC KNOWLEDGEE WAS EXTENDING IT, I FIND IT VERY CONFUSING. I'VE LIVED THERE SINCE JULY 31S. I MOVED IN.

PROVIDENCE HOMES NEVER TOLD US T THESE ADDITIONAL 31 HOMES BEING. THEY JUST MENTIONED THAT CUL-DEC

[00:45:04]

WOULD BE BUILT OUT. SO WHO IS RESPONSIBLE TO DO THEE DILIGENCE AND FIND OUT WHO IS DE WORK HERE? I HAVE A PICTURE THAT THE DOCTOR REFERENCED, THE SIDEWALK AND THE CUL-DE-SAC, A LAMPPOST IN THE WA SIGN FOR TABLE WEEKLY. IT'S VERY CONFUSING FOR A HOMEOO SPEND ALL HIS MONEY COMING IN TD SEEING THIS, NOT KNOWING WHAT'SG WOULD BE NOT KNOWING ANY HISTORD THEN SEEING A SIDEWALK THINKINGE CUL-DE-SAC WOULD END. NOW YOU'RE PUTTING 31 HOMES COMN MY STREET. I FIND THAT QUITE DISTURBING. I ALSO HAVE A PICTURE OF THE FOT WILL BE TORN DOWN. THE END OF THE CUL-DE-SAC A BEAL AREA.

IT CAUGHT MY ATTENTION. I THINK THE DOCTOR SAW MY HOUSE. IT'S A BEAUTIFUL HOUSE.

IT'S A DREAM COME TRUE FOR MY FY MIECHED FROM WORTHINGTON PARK DE WAY ABOUT THREE MILES AWAY.

THE REASON FOR THE MOVE IS STRIY GRANDSON. MY DAUGHTER LIVES WITH US NOW.

ABOUT READY TO GRADUATE FROM UNA BACHELOR'S DEGREE. SHE WAS A YOUNG MOM AND WE TOOK, KEPT WHESH RAISING OUR GRANDSON. IT'S A BEAUTIFUL PLACE FOR KIDS. THERE ARE KIDS IN THE NEIGHBORHY GRAND SNON'S AGE SO IT'S A BEAUL SPOTS TO RAISE A FAMILY. I WILL TLK ABOUT THE TRAFFIC CO.

AND THE SAFETY ISSUES NITTANY T TO CONTINUE WITH MR. DAY. HE ALSO SEEMED TO FAIL TO SUBMIR

PAPERWORK WITH THE STATE OR THE. >> YOUR THREE MINUTES ARE ABOUT. >> OKAY.

CAN I GET AN EXTENSION? >> I'LL GIVE YOU DID CAN I GET E HER THREE MINUTES?

>> SHE MAY COME UP AND SPEAK. >> MR. DAY DID NOT COMPLY WITH E STANDARD THAT HE HAD AN EXCEPTIO COVID-19. AGAIN, I PUT THAT RIGHT HERE. LET'S GO THROUGH THIS ISSUES.

SAFETY ISSUE FIRST. THE COUNTY HAS DESIGNATED 9.44 R DAY PER HOUSE.

>> SIR, YOU DON'T GET HER TIME. SHE GETS THE SPEAK. >> DOCTOR, CAN I HAVE MORE TIME?

>> I'M NOT AT LIBERTY TO GRANT . IT'S AT THE DIST DISCRETION OF E CHAIR.

>> NO, SIR. I THOUGHT YOU WERE ASKING IF SHD USE THREE MINUTES.

>> IF I DO DONATE MY THREE MINU. >> NO, YOU CAN'T DO THAT, MA'AM. >> THAT'S FINE.

OKAY. SHOULD I START OR SHOULD I SIT D WAIT?

>> THE NEXT SPEAKER IS KELLY PR. >> THAT'S ME. I'M HIS WIFE.

SO WE LIVE AT THE CORNER CLAREN- >> I NEED TO YOU STATE YOUR NAMD ADDRESS FOR THE RECORD AND THENO

AHEAD AND START THE TIMER. >> MY NAME IS KELLY PREISSIG. I LIVE AT 31 OLD HILL WAY S. JOS

FLORIDA 32259. >> COULD WE HAVE HER SPEAK IN TE MICROPHONE, PLEASE.

>> MY NAME IS KELLY PREISSIG, IT 31 OLD HALE WAY ST. JOHNS FLORI5 FINANCE 9.

MY HUSBAND SURPRISED ME BY SAYI& HE FOUND A BEAUTIFUL LOT FOR USE HAVE A GLAND CHILD.

IT'S ON TWO CUL-DE-SACS HE TOLD. HE DROVE ME INTO THE PROVIDENCEO LOOK AND THEY HAD THAT MAP THATY HAD UP THERE THAT SHOWED MY CULC AND THE OTHER CUL-DE-SAC ENDINGT THERE.

NO EXTENSION. AND THERE'S A SIDEWALK THAT GOED BOTH.

AND WHAT WE WERE TOLD BY THE DER IS THEY MIGHT FINISH YOUR CUL-D. THEY MIGHT NOT.

SO THAT LED US TO BELIEVE THEY T MAYBE FOR OUR FIVE MORE HOMES OT CUL-DE-SAC.

NOBODY TOLD US -- AND THEY CHARA LOT PREMIUM, SO WE PAID AN ADDIL SEVERAL THOUSAND DOLLARS TO LIVA CUL-DE-SAC. WE WOULD HAVE NEVER MOVED FROM WORTHINGTON PARKWAY WHICH WAS A CUL-DE-SAC THAT WE LIVED ON. WE LIVED WHERE THERE WERE ONLY T HOUSES PAST US ON WORTHINGTON PY BUT WE CONSIDERED THAT TOO BUSY. SO HE FOUND FOUND WHAT WAS IDEAR FIVE-YEAR-OLD CHILD, AND LIKE HE EXPLAINED THERE'S TONS OF CHILDN THE NEIGHBORHOOD. I CAN'T SPEAK FOR MY NEIGHBORS N TELL YOU TWHIFNL IS HANDICAPPEDY ARE LOOKING INTO HOW TO GO ABOUY WANT TO BE PUBLIC THAT THEIR CHS HANDICAPPED AND THEY DON'T FEELE WITH ALL THIS TRACK OF COMING. AS 4 NR NATE -- I FORGOT HIS NAY TALKING ABOUT JUST 31 HOUSES, T- IF EACH HOUSE HAS TWO DRIVER'S,E THREE, THAT'S 60 CARS A DAY, NOO MENTION UPS, NOT TO MENTION TRAH TRUCKS, PEOPLE HAVING POOLS BUIT TO MENTION RECYCLE BINS AND SAMS TO OUR HOUSE 30 TIMES A DAY SO S WE'RE ON THE END OF A CUL-DE-SAE TRAFFICKING IS DOWN OUR STREET CONSTANTLY IT'S A. I CANNOT IMAGINE THE NIGHTMARE 1 ADDITIONAL HOUSES.

WE COULD -- SIMPLY FUT WOOB WE E ST. JOHNS COUNTY. IT'S THE MOST BEAUTIFUL COUNTY R LIVED IN, AND WE JUST SIMPLY WOT HAVE MOVED HERE. WE WOULDN'T HAVE MOVED TO THIS Y CONTACT. WE WAVE STAYED OR LOOKED FOR A T ONE A CUL-DE-SAC.

[00:50:01]

THE WHOLE REASON WE BOUGHT THISS ON TWO CUL-DE-SACS. THAT IS OUR LIFE'S DREAM.

MY HUSBAND SURPRISED ME AND WE T MAYBE WE'LL HAVE FIVE MORE NEIGS BOUGHT THAT'S NOT A BIG DEAL.

IT WAS SUPPOSED TO GO AROUND IT. NOT 31. I'M SORRY, IT'S JUST BAD BUSINET TO MENTION THE RACCOONS THAT ARY CAKING OUT ON OUR DRIVEWAY BECAE THEY'RE LOSING THEIR -- THERE'SE FOR THE ANIMALS. I'M NOT A BIG NATURE PERSON, BUS NOWHERE FOR THE NATURE TO GO.

AND IT'S ALL WETLANDS AND IT'S , IT'S UNDERWATER. I JUST THINK IT'S BAD BUSINESS.

I DON'T THINK IT SHOULD HAVE BEN HANDLED THIS WAY, AND I THINK IS AFFECTING EVERYBODY.

SO THAT'S WHAT I'D LIKE -- AND U WOULD CONSIDER CONSIDER THE STRT TO TAKE OUR STREET, LIKE HE SAI, KEEPING IT A STREET -- THAT WOUD PROBABLY SOLVE THE PROBLEM FOR EVERYBODY.

>> THANK YOU, MA'AM. DO WE HAVE ANYBODY -- ANY OTHERR CARDS?

>> WE DO NOT. >> DO I HAVE ANY QUESTIONS FOR E APPLICANT -- CAN I ANSWER QUESTR

THE APPLICANT? >> NO, SIR. >> THE PROCEDURE HERE WITH THE Y ONLY GETTING THREE MINUTES IS N. THE APPLICANT GETS TO SPEAK ALLE WANTS, AND I GET THREE MINUTES O EXTENSION? THAT'S NOT RIGHT. AS A MEMBER FOR 13 YEARS I'VE LR E. HERE PAYING MY TAXES, TWO HOD YOU GIVE ME THREE MINUTES AND AT GIVE ME AN EXTRA MINUTE IS NOT .

GET THAT ON THE RECORD AND WE'LO THAT LATER ON. THANK YOU.

>> DO WE HAVE ANYBODY ON THE PHO SPEAK? >> NO PUBLIC COMMENT.

>> SO AT THIS POINT WE ARE BACKE AGENCY, AND I'M GOING TO GIVE TE APPLICANT THE OPPORTUNITY TO ADS

SOME OF THE COMMENTS. >> I APPRECIATE THAT. SO FIRST, IF I CAN GET MY CONTAO ON THE RECORD SO THAT THEY CAN , I'D BE HAPPY TO HAVE THEM CALL R EMAIL BETWEEN NOW AND BOARD OF Y COMMISSION AND GET NEM MORE TIMK TO US. I KNOW THERE'S STILL A PROCESS S TO HAPPEN HERE. I KNOW I GAVE MY ADDRESS. MY CELL PHONE, IS IT'S ROW.

THAT THE IT'S 9048941865. I KNOW IT'S PUBLIC RECORD BUT IY FOR THEM TO CALL ME.

AND MY EMAIL ADDRESS IS NDTAY@SSMITHINC.COM. I WANT TO GIVE THEM MORE TIME TK BECAUSE I KNOW THREE MINUTES IST IT IS THE PROCESS THAT WE GO TH. JUST A COUPLE QUICK THINGS FOR D TO. I DO KNOW THAT THE BUILDERS KNET THERE WOULD BE AN EXTENSION HER.

THEY HAD COMMUNICATED WITH MOSTE THAT THERE MIGHT BE LOTS ADDED . I MEAN CLEARLY THERE WAS NOT ANF HOW MANY, BUT 31 IS NOT A LARGER OF LOTS FOR TAPE CAL SCALE FOR S NEIGHBORHOOD.

YOU'LL SEE FROM THE PICTURES THE GOES INTO THE WOODS, IS IN THE S BECAUSE THAT'S WHERE THE VODE SD TO EXTEND. IT HAD ALREADY BEEN CONTEMPLATEE DIDN'T WANT A LAMPPOST AT THE EE CUL-DE-SAC THAT WOULD HAVE TO BD OUT. WE WANTED TO KEEP IT ALONG THE N OF WHATEVER ROAD MIGHT BE THERE. THE SIDEWALK HAS TO GO IN. THE COUNTY DOESN'T WANT A PROMIT YOU MIGHT EXPAND AND THEN IT FAL THROUGH AND THEY'RE STUCK WITH T HAVING A SIDEWALK THAT THEY'RE D TO HAVE. YES, THEY'RE BEAUTIFUL SIDEWALK. WE DO HAVE TO RIP THEM OUT BECAT HAPPENS ALL THE TIME WHEN WE STP PHASES. THERE HAS TO BE SOME ASSURANCE F THE NEXT PHASE DOESN'T HAPPEN, S CURRENTLY THERE IS ACCEPTABLE AE FULL STANDARD, SO THAT IS WHY IN SOMETIMES LOOK LIKE IT MIGHT BE FINISHED. YOU THE I. BUT I DO KNOW THAT TS COMMUNE CHASING THAT THERE WOULE EXTENSIONS HERE. AND -- -- COMMUNICATION THAT THD BE EXTENSIONS HERE. AND FROM AN APPROPRIATENESS STA, BECAUSE I DO KNOW THAT WHEN YOUE LOOKING FOR AT THESE THINGS, YOE LOOKING AT IS IT APPROPRIATE TOE THIS LAND THAT'S CURRENTLY SILVE AND TURN IT INTO A RES-B LAND UA PUD SHOANG THAT MATCHES THE CUR. AND I WOULD JUST ARGUE THAT WHII UNDERSTAND NO ONE LIKES TO SEE Y FUTURE GROWTH OR FUTURE HOMES, E ALL GOING TO BE VERY NICE HOMESH QUALITY. EVERY HOME THAT WE HAVE SOLD OUE HAS INCREASED IN VALUE.

THEY'VE BEEN INVESTMENTS FOR EV. IT HAS BEEN A VERY GOOD NEIGHBO. I MEAN, NOT JUST FOR THE DEVELOD THE BUILDERS BUT FOR THE HOMEOWT THAT HAVE BOUGHT OUT THERE TOO. SO THERE FROM AN APPROPRIATENESS STANDPOINT I WOULD REITERATE WHE DOING WAS CONTEMPLATED, IS GOINE CONSISTENT, IS NOT ANY MORE DENF A DIFFERENT TYPE OF USE THAN WHS CURRENTLY THERE, SO I WOULD JUSY THAT IF YOU CAN KEEP THAT IN MIU

[00:55:05]

CONSIDER THIS. >> THANK YOU, MR. DAY. SO AT THIS POINT I'M GOING TO BT BACK INTO THE AGENCY, AND ALTHOY PREFERENCE NORMALLY IS THAT WE D DISCUSSION UNTIL WE HAVE A MOTII WANT TO HEAR WHAT DR. HILSENBECO SAY FIRST BEFORE WE DO A MOTIONM GOING TO CALL ON DR. HILSENBECKT

NOW IF THAT'S ALL RIGHT. >> OKAY. I HAVE ONE QUESTION RIGHT NOW FE APPLICANT, AND WE'LL WAIT FOR TN AND THEN I'LL HAVE MY OTHER COMF THAT'S SATISFACTORY.

THANK YOU. YOU SAID YOU'D ALWAYS CONTEMPLA, AND IT DOES STATE IN THE POLITIT THIS APPLICATION THAT THIS IS CONSIDERED INFILL DEVELOPMENT.

TO ME, HOWEVER, THIS IS -- AND D THIS BEFORE FOR MORE MAJOR MODIS OR COMP PLAN AMENDMENTS, TO ME S OUTFILL. YOU'RE AGAIN ENCROACHING INTO WA RURAL/SILVICULTURE ZONING.

AND FUTURE LAND USE, AND I JUSTR WHAT -- IF INDEED YOU HAVE FUTUS TO DO THIS AGAIN, THIS IS ANOTHE AT TH APPLE, TAKING ANOTHER 35 S OUT OF NATURAL HABITAT, CONVERTO HOUSING, WHAT'S TO PREVENT YOU M COMING BACK NEXT YEAR AND SAYINU WANT ANOTHER 35 ACRES OFF TO THE NORTHEAST FROM HERE OR EAST OR ? AND THIS AGAIN TO ME, IT'S MORE CONVERSION OF NATURAL HABITAT, E HABITAT.

I KNOW THERE ARE NO END GAIRNLGR THREATEN SPECIES ON THE PROPERTI AM CONCERNED ABOUT FUTURE NIBBLY OF RURAL/SILVICULTURE, RURAL DED LANDS, PARTICULARLY WHEN PEOPLEO BOUGHT THERE BELIEVED, WHETHER E LED TO BELIEVE OR NOT, I DO NOT, BUT THEY BELIEVED THEY WERE GOIO BACK UP TO GREEN SPACE, WHICH DS ENHANCE THE VALUE OF A HOME, ANM WHAT THEY SAY, THEY PAID A PREMR THIS LOT IN TERMS OF MONETARY VR THE PROPERTY. SO I JUST WONDER IF YOU HAVE ANR PHASES, HIKE A PHASE 8 YOU'RE P.

>> NO. THROUGH THE CHAIR, THANK YOU FOE COMMENT OR THE QUESTION, I GUES.

WE DO NOT. WE HAVE REMOVED ANY CALL FOR ANE CONNECTIVITY IN THIS CURRENT MAS BEEN SUBMITTED. THERE WAS ONE OTHER CUL-DE-SAC E VERY FAR EAST OF THE PROPERTY TT ONE POINT HAD SHOWED A POTENTIAE CONNECTION. WE HAVE REMOVED THAT BECAUSE THE THE SAME COVMENT WANTING TO KNOS THERE ANY ADDITIONAL CONTEMPLATD CHANGES.

IF THAT NEEDS TO BE PUT IN THE R PART OF WHAT IS RECOMMENDED, I O OBJECTIONS TO THAT WHATSOEVER.

THERE'S NOT A PLAN FOR THIS TO Y BIGGER. THE AMENITY CENTER IS DISPIEND 0 UNITS. -- WE CANNOT UTILIZE ANY OTHER INFRASTRUCTURE FOR FUTURE EXPANH THAN THE 31 LOTS. SO THERE IS NO CONTEMPLATED EXP. I'M HAPPY TO DO BHAFER NEEDS TOE TO GIVE -- WHATEVER NEEDS TO BEO GIVE YOU CONFIDENCE OR ASSURANCT WE'RE NOT GOING TO DO THAT.

>> ALL RIGHT. THANK YOU, MR. DAY. ANYBODY ELSE HAVE ANY QUESTIONS? IF NOT, WE'RE READY FOR A MOTIOE LAND USE CHANGE, ITEM NUMBER 4. SO I'LL ENTERTAIN A MOTION.

>> MOTION TO RECOMMEND ADOPTIONP PLAN OOSMED 2019-01 OXFORD ESTA, BASED UPON FOUR FINDINGS OF FACS

PROVIDED IN THE STAFF REPORT. >> IS THERE A SECOND? >> I'LL SECOND.

>> I HAVE A FIRST AND A SECOND Y MR. ALAIMO. IS THERE ANY DISCUSSION?

DR. HILSENBECK. >> OKAY. HERE ARE SOME OF MY MAJOR CONCE.

IT'S STATED IN THE AGENDA ITEM E STAFF, IN THE STAFF REPORT REGAG TRANSPORTATION THAT LINK 154 --, MY GLASSES ARE FOGGING UP HERE E LINK 154 IS LONG LEAF PARKWAY FM ROBERTS ROAD TO VETERANS PARKWAS PROJECTED TO EXCEED ITS APPROVEK HOUR SERVICE VOLUME WITH A CURRY STATUS OF DEFICIENT AT 136.9% OF CAPACITY. SO ALREADY THAT ROAD IS OVER CA, THE MAJOR FEEDER ROAD.

IN TERMS OF SCHOOLS, IT ALSO STN THE STAFF REPORT THAT BARTRAM TL SHOIFERS

[01:00:05]

SERVICE AREA CURRENTLY HAS NO C. SO FURTHER GOES ON TO STATE THAE COUNTY DOES NOT HAVE ADEQUATE RS TO ADDRESS -- LET ME GET THESE , SORRY -- DOES NOT HAVE ADEQUATE RESOURCES TO ADDRESS SCHOOL OR D CAPACITY ISSUES AND CAPACITY IMPROVEMENTS, NOR IS IT ANTICIPT PROPORTIONAL SHARE CONTRIBUTIONE ADEQUATE TO UPGLADE THE IMPROVE- UPGRADE THE IMPROVEMENTS OR TO E THOSE IMPROVEMENTS.

SO IF -- AND YOU DID A VERY NICE ANALYSIS, FINANCIAL ANALYSIS INR SCWHREAND AGENDA AGENDA ITEM, BUT IF THE TRANSPON AND SCHOOL ISSUES CANNOT BE ADDY THE COUNTY EVEN WITH ADDITIONAL REVENUES, THAT'S A REAL CONCERN. ALSO, I POINTED THIS OUT ON NUMS OCCASIONS, THE COMP PLAN FOR STS COUNTY SAYS IT ENCOURAGES INFILD DISCOURAGES COMP PLAN AMENDMENTN LANDS DESIGNATED RURAL/SILVICULR AG INTENSIVE. SO AGAIN, TO ME THIS IS NOT INF. THIS IS SOME OUT-FILL.

AND I WILL HAVE TO SAY THAT PROPERTIES -- IT'S MENTIONED INF THE LETTERS THAT THEY THINK HAVS NEW PHASE OF THE DEVELOPMENT WIR THEIR PROPERTY VALUES, AND WITHT GETTING AN APPRAISER IN HERE TOE THAT OR TO SUBSTANTIATE THAT, IL POINT OUT THAT THERE ARE NUMEROS STUDIES.

ALL YOU HAVE TO DO IS GOOGLE TH. THERE'S SCORES OF STUDIES, FLORD OTHER STATES, THAT SHOW THAT LA, PROPERTIES, HOMES PARTICULARLY, RESIDENTIAL HOMES THAT BACK UP A GREEN SPACE COMMAND A PREMIUM I, AND THAT VARIES WIDELY DEPENDINA LOT OF FACTORS. YOU'D HAVE TO LOOK AT INDIVIDUAL ARTICLES THAT REFERENCE THIS. BUT HOMES THAT BACK UP TO GREENE COMMAND A HIGHER VALUE.

SO THEY PAID A PREMIUM FOR THE . IF THEY DON'T -- IF THEY NO LONK UP TO GREEN SPACE, AS THEY THOUY WOULD, THERE'S LIKELY, IN MY OP, STRICTLY MY OPINION, THAT THEREE A DIMINISHMENT OF VALUE OF THEIT PROPERTY AS WELL AS THE OTHER PS ON THAT CUL-DE-SAC, AS WELL AS E CUL-DE-SAC ON CLARENDON WAY.

AND IT ALWAYS COMES BACK TO THI. WHAT IF I LIVED IN THAT HOUSE, E THIS WAS MY NEIGHBORHOOD AND I D THERE. WOULD I WANT THIS ROAD TO BE PUH AND A NEW PART OF THE SUBDIVISIT DIRECTLY BEHIND MY HOUSE? I WOULD NOT. SO THOSE ARE MY COMMENTS UNLESSE SOME OTHER THING I OVERLOOBLGD D HERE. I WAS GOING TO MENTION THE SOILT THAT USUALLY DOESN'T GARNER MUCH SUPPORT. SO THOSE ARE SOME POORLY DRAINES BACK THERE. ONE OF THEM IS ADEQUATELY DRAINT THE OTHERS ARE POORLY DRAINED OY POORLY, AND I KNOW THERE ARE WE. THOSE ARE GOIIVET PRESERVED FORE MOST PART.

BUT THOSE CONSIDERATIONS ARE OF SUBSTANTIAL CONCERN FROM MY VIE. THANK YOU.

>> THANK YOU, DR. HILSENBECK. DOES ANYBODY ELSE HAVE ANY COMM? HEAR NONE, WE'RE GOING TO CALL R

THE VOTE. DR. MCCORMICK. >> I'M PREPARED TO MAKE A MOTIO.

>> DR. MCCORMICK, WE'RE VOTING. WE ALREADY HAD A MOTION AND A S. WE WERE IN DISCUSSION.

IT. >> SO WE HAVE A MOTION TO APPRO. >> YES, WE HAVE A MOTION TO APPD A SECOND TO APPROVE, AND YOU'REY ONE WHO HASN'T VOTEDOKAY. THAT MOST PASSES 4-2.

DID THAT MOTION PASSES 4-2. WE WILL MOVE ON TO ITEM NUMBER D DR. HILSENBECK, I'M GOING TO GIU

THE OPPORTUNITY TO TALK AHEAD OR DURING DISCUSSION. >> I HAVE NO FURTHER COMMENTS.

THE COIMENTS MADE COMMENO APPLY TO 5 AS WELL. THERE'S NO POINT IN REITERATING.

THANK YOU FOR THE OPPORTUNITY. >> YES, SIR. ALL RIGHT.

[01:05:02]

SO I WILL ENTERTAIN A MOTION, TM THE AGENCY ON ITEM NUMBER 5. >> I'LL MAKE A MOTION.

>> THANK YOU. >> MOTION TO RECOMMEND APPROVALE MAJOR MOD 2020-15 OXFORD ESTATEE 7, BASED ON SIX FINDINGS OF FACS PROVIDED IN THE STAFF REPORT SUO TWO CONDITIONS THAT WERE PREVIOY STATED THAT THEY WOULD HAVE THET LOT VERSUS THE 80-FOOT WHICH MRY AGREED TO, AND THEN THE SECOND N
